Regulations Regarding the Operational Report of the Administrator of Insolvency Proceedings and the Procedures for Filling in Thereof

Issued pursuant to
Section 85, Paragraph two of the Insolvency Law

1. This Regulation prescribes:

1.1. the procedures by which the administrator of insolvency proceedings (hereinafter - the administrator) shall fill in the operational report;

1.2. the sample forms of the report.

2. The administrator shall fill in the form of the administrator's operational report (hereinafter - the operational report) (Annexes 1, 2, 3, 4, 5 and 6) on the website www.mna.gov.lv (hereinafter - the website).

3. As regards the operational report referred to in Paragraph 2 of this Regulation the administrator shall:

3.1. submit it to the Insolvency Administration, using the special online form available on the website;

3.2. send it to creditors to electronic mail addresses indicated in claims of creditors, drawing it up in accordance with the laws and regulations regarding drawing up of electronic documents.

4. The operational report which has been submitted to the Insolvency Administration electronically, using the special online form available on the website, shall be considered as signed by the administrator in person.

5. In order to submit the operational report, the administrator shall login to the website, using the access details assigned to the administrator by the Insolvency Administration. The Insolvency Administration shall issue the access details to the administrator in person after verifying the identity of the administrator. The access details assigned may not be handed over and made known to a third party.

6. If the operation of the certificate of the administrator is terminated or it is cancelled, the Insolvency Administration shall cancel the access rights within one month from the day when an entry has been made in the insolvency register regarding removal of the administrator from the last proceedings managed by him.

7. The administrator shall submit the initial operational report in insolvency proceedings of a legal person (Annex 1) and in insolvency proceedings of a natural person (within the scope of bankruptcy procedure) (Annex 2) to the Insolvency Administration and shall send them to creditors within seven days after the end of the reporting period. The reporting period shall be three months after the day of proclaiming the insolvency proceedings of a legal or natural person.

8. Upon submitting the initial operational report to the Insolvency Administration, the administrator shall append:

8.1. the plan for the sale of debtor's property and amendments thereto, if any have been made in the reporting period, or the report on non-existence of the debtor's property and amendments thereto, if any have been made in the reporting period;

8.2. in insolvency proceedings of a legal person - the balance sheet referred to in Section 65, Clause 2 of the Insolvency Law.

9. The administrator shall submit the current operational report in insolvency proceedings of a legal person (Annex 3) and in insolvency proceedings of a natural person (within the scope of bankruptcy procedure) (Annex 4) to the Insolvency Administration and shall send them to creditors within seven days after the end of the reporting period. The reporting period shall be three months after the end of the previous reporting period.

10. Upon submitting the current operational report to the Insolvency Administration, the administrator shall append:

10.1. amendments to the plan for the sale of debtor's property or to the report on non-existence of the debtor's property, if any have been made in the reporting period;

10.2. in insolvency proceedings of a legal person - the balance sheet at the beginning of the current reporting year on the previous reporting year, if the administrator has taken a decision not to continue economic activity.

11. The administrator shall also use the sample form of the current operational report (Annex 3 or 4) upon submitting the operational report upon request of the Insolvency Administration in the case specified in Section 26, Paragraph three, Clause 5 of the Insolvency Law. In such case the administrator shall submit the operational report within seven days after receipt of the request of the Insolvency Administration.

12. The administrator shall submit the final operational report in insolvency proceedings of a legal person (Annex 5) and in insolvency proceedings of a natural person (within the scope of bankruptcy procedure) (Annex 6) to the Insolvency Administration and shall send them to creditors within 15 days after carrying out the plan for the sale of debtor's property. If the period of submitting the current operational report and the final operational report coincides, the administrator shall submit only the final operational report.

13. Upon submitting the final operational report to the Insolvency Administration, the administrator shall append:

13.1. amendments to the plan for the sale of debtor's property or to the report on non-existence of the debtor's property, if any have been made in the reporting period;

13.2. in insolvency proceedings of a legal person - the final balance sheet.

14. The administrator shall submit only the initial operational report, if after submitting the report on non-existence of the debtor's property:

14.1. an agreement has not been reached regarding funding the insolvency proceedings of the legal person, and the insolvency proceedings of the legal person have been terminated prior to setting in of the term for submitting the current operational report;

14.2. the bankruptcy procedure of the insolvency proceedings of the natural person has been completed or terminated prior to setting in of the term for submitting the current operational report.

15. If the administrator is removed from fulfilling the duties of the administrator in insolvency proceedings of a legal or natural person, he shall, within seven days from the day when an entry on his removal from the particular insolvency proceedings was made in the insolvency register, submit the final operational report (Annex 5 or 6) to the Insolvency Administration and shall send it to creditors. In such case, upon submitting the final operational report to the Insolvency Administration, the administrator shall append amendments to the plan for the sale of debtor's property or to the report on non-existence of the debtor's property, if any have been made in the reporting period.

16. The administrator shall also use the sample form of the final operational report (Annex 5 or 6) upon providing the operational report to the court and the Insolvency Administration in the case specified in Section 23, Paragraph two of the Insolvency Law. In such case the administrator shall submit the operational report concurrently to the Insolvency Administration and the court.

17. The administrator who commences the fulfilment of the duties of the administrator instead of the removed administrator, shall, within seven days after the end of the reporting period, in conformity with the procedures laid down in this Regulation, submit the current operational report to the Insolvency Administration and shall send it to creditors. The reporting period shall be three months from the day when an entry regarding appointing of the new administrator has been made in the Insolvency Register.

18. If an agreement is reached regarding transition of insolvency proceedings to legal protection proceedings, the administrator shall, within three weeks after rendering a court decision regarding termination of insolvency proceedings of a legal person, submit the final operational report to the Insolvency Administration and shall send it to creditors, indicating therein data as on the day of rendering the court decision. Upon submitting the final operational report to the Insolvency Administration, the administrator shall append amendments to the plan for the sale of debtor's property or to the report on non-existence of the debtor's property, if any have been made in the reporting period.

19. If the final date of the reporting period sets in until the day of coming into force of this Regulation, the administrator has the right to submit the relevant operational report by filling in the sample form of the relevant operational report approved with Cabinet Regulation No. 1003 of 26 October 2010, Regulations Regarding the Operational Report of the Administrator of Insolvency Proceedings and the Procedures for Filling in Thereof, and sending it to the Insolvency Administration to the electronic mail address parskati@mna.gov.lv and to creditors to electronic mail addresses indicated in claims of creditors.

20. Cabinet Regulation No. 1003 of 26 October 2010, Regulations Regarding the Operational Report of the Administrator of Insolvency Proceedings and the Procedures for Filling in Thereof (Latvijas Vēstnesis, 2010, No. 172; 2013, No. 215; 2015, No. 40), is repealed.
