Regulations Regarding the Register of Weapons

Issued pursuant to
Section 83, Paragraphs three and five
and Section 87, Paragraph four
of the Law on the Handling of Weapons

I. General Provisions

1. The Regulation prescribes:

1.1. the amount of the information and the procedures by which a weapons dealer shall enter the information referred to in Section 83, Paragraph one of the Law on the Handling of Weapons in the Register of Weapons (hereinafter - the Register);

1.2. the amount of the information and the procedures by which a weapons broker shall enter the information referred to in Section 83, Paragraph four of the Law on the Handling of Weapons in the Register;

1.3. the amount of information to be entered in the Register, the procedures for the entry, use, and deletion thereof, and also the authorities to be granted access to the information entered in the abovementioned Register.

2. The authorities and merchants referred to in Chapter II of this Regulation shall be responsible for the reliability of the information, its timely entry in the Register, or its submission to the Information Centre of the Ministry of the Interior (hereinafter - the Centre) for entry in the Register.

3. The Centre is entitled to request and receive, free of charge, the information necessary for the operation of the Register from the Register users.

II. Information to be Entered in the Register and the Procedures for the Entry Thereof

4. The following shall provide information to the Register:

4.1. [14 July 2022];

4.2. [14 July 2022];

4.3. Latvijas Banka - on the weapons in its ownership or possession, the exchangeable essential components of firearms, deactivated firearms, ammunition, and firearms transferred for destruction;

4.4. the State Revenue Service - on the weapons in its ownership or possession, the exchangeable essential components of firearms, deactivated firearms, ammunition, and firearms transferred for destruction;

4.5. the Prison Administration - on the weapons in its ownership or possession, the exchangeable essential components of firearms, deactivated firearms, ammunition, and firearms transferred for destruction;

4.6. the Corruption Prevention and Combating Bureau - on the weapons in its ownership or possession, the exchangeable essential components of firearms, deactivated firearms, ammunition, and firearms transferred for destruction;

4.7. the Cadet Force Centre - on the weapons in its ownership or possession, the exchangeable essential components of firearms, deactivated firearms, ammunition, and firearms transferred for destruction;

4.8. the port police - on the weapons in its ownership or possession, the exchangeable essential components of firearms, deactivated firearms, ammunition, and firearms transferred for destruction;

4.9. the municipal police - on the weapons in its ownership or possession, the exchangeable essential components of firearms, deactivated firearms, ammunition, and firearms transferred for destruction;

4.10. the State Police - on the weapons registered by natural and legal persons and the issued authorisations for all types of weapons, and the suppliers of firearms and their essential components;

4.11. weapons dealers - on the weapons, the essential components of firearms, ammunition, gunpowder, deactivated firearms, and high-energy pneumatic weapons in commercial circulation;

4.12. weapons brokers - on brokering transactions in the field of handling of weapons in firearms, their essential components, ammunition, and gunpowder;

4.13. medical treatment institutions - on the conformity of the health condition of a natural person for the possession (carrying) of weapons and for work with weapons.

5. The following information shall be entered in the Register on a natural person who has been issued the authorisation for a weapon or for whom a Category E gas weapon and signal weapon or a firearm which has been deactivated in accordance with Commission Implementing Regulation (EU) 2015/2403 of 15 December 2015 establishing common guidelines on deactivation standards and techniques for ensuring that deactivated firearms are rendered irreversibly inoperable (hereinafter - the deactivated firearm) is being registered, and on a foreign natural person who has marketed a firearm or an essential component of a firearm, or a deactivated firearm:

5.1. the personal identity number or date of birth of the person if information on the person is not entered in the Register of Natural Persons;

5.2. the given name in Latvian or in the transliteration in the Latin alphabet of the original form of another language according to personal identification documents;

5.3. the surname in Latvian or in the transliteration in the Latin alphabet of the original form of another language according to personal identification documents;

5.4. the nationality and legal status;

5.5. the declared place of residence (for the foreign natural person referred to in this Paragraph - the address of the place of residence).

6. The following information shall be entered in the Register on the personal identification documents of the natural person referred to in Paragraph 5 of this Regulation (if such information is available):

6.1. type;

6.2. series and number;

6.3. date of issue;

6.4. issuing country;

6.5. issuing authority;

6.6. term of validity.

7. Medical treatment institutions shall enter the following information in the Register on the conformity of the health condition a natural person for the possession (carrying) of weapons and for work with weapons:

7.1. the date when the person has undergone the initial, regular, or early health examination;

7.2. the name and address of the medical treatment institution where the health examination was conducted;

7.3. the given name and surname of the medical practitioners who conducted the health examination or the head of the medical commission;

7.4. the given name and surname of the person;

7.5. the personal identity number (if information on the person is not entered in the Register of Natural Persons - the date of birth of the person);

7.6. the information on the conformity of the health condition of the person for the possession (carrying) of weapons and for work with weapons - conforms, conforms (physical deficiencies have not been evaluated), or does not conform;

7.7. the time limit by which the regular health examination must be undergone;

7.8. the information on the early health examination:

7.8.1. the given name and surname of the medical practitioner or the official of the State Police who issued the referral;

7.8.2. the date of issuance of the referral for the early health examination;

7.8.3. the information on the findings of the early health examination about the conformity of the health condition of the person for the possession (carrying) of weapons and for work with weapons - conforms, conforms (physical deficiencies have not been assessed), or does not conform.

8. The following information shall be entered in the Register on the authorisations for weapons:

8.1. issuing authority;

8.2. the name of the structural unit of the issuing authority;

8.3. type;

8.4. series and number;

8.5. date of issue;

8.6. term of validity;

8.7. date when the validity of the document was suspended;

8.8. reason and grounds for suspension;

8.9. date when the document was annulled;

8.10. reason and justification for cancellation.

9. The following information shall be entered in the Register on a legal person which has received the authorisation from the State Police for the acquisition, possession, and use of a weapon in its activities or which has a registered a gas weapon and a signal weapon or a deactivated firearm, and information on a weapons dealer, a weapons broker, or a foreign weapons dealer that has marketed a firearm or an essential component of a firearm, or a deactivated firearm:

9.1. the name;

9.2. the registration number;

9.3. the date of registration (except for the foreign weapons dealer referred to in this Paragraph);

9.4. the date of liquidation or cessation of activities (except for the foreign weapons dealer referred to in this Paragraph);

9.5. the legal address;

9.6. the address of the structural unit of the weapons dealer where commercial activities with firearms and their ammunition are carried out (except for the foreign weapons dealer referred to in this Paragraph).

10. The following information shall be entered in the Register on the shareholders or members (natural persons), managers (for example, members with the right of representation, members of the executive board and supervisory board of a capital company, sole proprietorships) of the legal person, weapons dealer, and weapons broker which have received the authorisation of the State Police referred to in Paragraph 9 of this Regulation, and employees of the legal person and weapons dealer who have access to weapons according to their job duties or who are directly related to the storage of weapons:

10.1. given name;

10.2. surname;

10.3. personal identity number or date of birth;

10.4. position;

10.5. telephone number.

11. The following information shall be entered in the Register on firearms of Categories A, B, and C and their exchangeable essential components, gas weapons and signal weapons, and salute weapons (acoustic weapons) in circulation:

11.1. the technical classification (indicating the category and sub-group). The technical classification shall not be indicated for weapons in the ownership or possession of State and local government authorities;

11.2. the classification according to use and information on whether the weapon is a long or short weapon, a smooth-bore or rifled weapon, or a smooth-bore weapon combined with a rifled weapon. The classification shall not be indicated for weapons in the ownership or possession of State and local government authorities;

11.3. the name of the manufacturer (manufacturer's brand);

11.4. the year of manufacture (using the designations of the manufacturer as indicated on the weapon);

11.5. the make;

11.6. the model (if known);

11.7. the calibre (using the designation of the manufacturer in the metric system or in inches);

11.8. the marking (as indicated on the essential components of the weapon in the original form transliterated in the Latin alphabet);

11.9. the address of possession, transportation, delivery, or other address related to the handling of weapons;

11.10. the date of manufacture, acquisition, marketing, withdrawal, destruction, conversion into a salute weapon, deactivation, or another date related to the handling of weapons;

11.11. the following information shall be indicated on the exchangeable essential component of a firearm:

11.11.1. the type (the exchangeable barrel of the firearm or the exchangeable set of the barrel and breech block of the firearm, or the barrel which can be fitted and is intended for the change of the calibre, and the adapter);

11.11.2. the name of the manufacturer (manufacturer's brand);

11.11.3. the year of manufacture (using the designations of the manufacturer as indicated on the component);

11.11.4. the calibre (using the designation of the manufacturer in the metric system or in inches);

11.11.5. the marking (as indicated on the essential components of the weapon in the original form transliterated in the Latin alphabet).

12. The information referred to in Sub-paragraph 11.11 of this Regulation on the essential components of firearms of Categories A, B, and C in circulation shall be entered in the Register.

13. The following information shall be entered in the Register on high-energy pneumatic weapons of Category D and gas weapons and signal weapons of Category E in circulation:

13.1. the technical classification (indicating the category and sub-group). The technical classification shall not be indicated for weapons in the ownership or possession of State and local government authorities;

13.2. the classification according to use. The classification shall not be indicated for weapons in the ownership or possession of State and local government authorities;

13.3. the name of the manufacturer (manufacturer's brand) (using the designation of the manufacturer indicated on the weapon);

13.4. the serial number indicated on the weapon.

14. The following information shall be entered in the Register on ammunition for firearms and salute weapons (acoustic weapons) in circulation:

14.1. the calibre of the rounds (using the designation of the manufacturer on the ammunition packaging in the metric system or inches);

14.2. the quantity of rounds.

15. The information on the quantity of gunpowder in commercial circulation shall be entered in the Register.

16. The following information shall be entered in the Register on deactivated firearms:

16.1. the type (indicating whether the weapon to be registered is a long or short weapon, a smooth-bore or rifled weapon, or a smooth-bore weapon combined with a rifled weapon);

16.2. the name of the manufacturer (manufacturer's brand);

16.3. the year of manufacture (using the designations of the manufacturer as indicated on the weapon);

16.4. the make;

16.5. the model (if known);

16.6. the calibre (using the designation of the manufacturer in the metric system or inches);

16.7. the marking (as indicated on the weapon in the original form transliterated in the Latin alphabet);

16.8. the European Union or European Economic Area authority that has issued the deactivation certificate;

16.9. the certificate number;

16.10. the date of issuance of the certificate.

17. The following information shall be entered in the Register on verified salute weapons (acoustic weapons):

17.1. the certificate number;

17.2. the date of issuance of the certificate.

18. The following information shall be entered in the Register on control shots with rifled firearms:

18.1. the reference number;

18.2. the date when the control shots were made.

19. The information in the Register shall be entered and updated by the Centre on the basis of the notification of the State and local government authorities referred to in Paragraph 4 of this Regulation.

20. The authorities referred to in Sub-paragraphs 4.3, 4.4, 4.5, 4.6, 4.7, 4.8, and 4.9 of this Regulation shall provide the Centre with the information referred to in Paragraphs 11, 12, 13, and 16 of this Regulation for entry in the Register and updating within 10 working days after each importation of a weapon, exchangeable essential component of a firearm, high-energy pneumatic weapon, gas weapon, and signal weapon into the Republic of Latvia, and also acquisition, marketing, movement, and exportation from the Republic of Latvia (if the exportation term exceeds three months). The Centre shall enter the information referred to in this Paragraph in the Register and update it within one working day after receipt of the information.

21. The authorities referred to in Sub-paragraphs 4.3, 4.4, 4.5, 4.6, 4.7, 4.8, and 4.9 of this Regulation shall provide the Centre with the information referred to in Paragraph 14 of this Regulation for entry in the Register and updating once a year (in January). The Centre shall enter the information referred to in this Paragraph in the Register and update it within 30 working days after receipt of the information.

22. The State Police shall, according to its competence, enter in the Register and update the information referred to in Paragraphs 5, 6, 8, 9, 10, 11, 12, 13, 16, 17, and 18 of this Regulation in the online data transmission mode within one working day after receipt of the information.

23. Weapons dealers shall enter in the Register and update in the online data transmission mode:

23.1. the information referred to in Paragraphs 11, 12, 13, 14, 15, and 16 of this Regulation in accordance with Section 83, Paragraph one of the Law on the Handling of Weapons;

23.2. the information referred to in Sub-paragraphs 5.1, 5.2, and 5.3 and Paragraph 6 of this Regulation on a natural person from whom a firearm, its exchangeable essential components, a high-energy pneumatic weapon, a gas weapon and a signal weapon, a deactivated firearm or firearm ammunition has been acquired, and in the cases specified in the laws and regulations in the field of the handling of weapons - information on the number and date of issuance of the authorisation for the marketing of a weapon of the relevant natural person;

23.3. the information referred to in Sub-paragraphs 9.1, 9.2, and 9.3 of this Regulation on a legal person from whom a firearm, its exchangeable essential components, a high-energy pneumatic weapon, a salute weapon (acoustic weapon), a gas weapon and a signal weapon, firearm ammunition, rounds for salute weapons, or a deactivated firearm has been acquired, and the licence number of the weapons dealer or the number and date of issuance of the authorisation for the marketing of a weapon, the number and date of the supporting document;

23.4. the information referred to in Sub-paragraphs 5.1, 5.2, and 5.3 and Paragraph 6 of this Regulation on a natural person from whom a firearm and its exchangeable essential components, ammunition and its components (including gunpowder), magazines with the capacity of more than 10 rounds for a long-rifled firearm of Category A classified for sports, magazines with the capacity of more than 20 rounds for a short firearm of Category B classified for sports, and high-energy pneumatic weapons and their ammunition have been accepted into possession;

23.5. the information referred to in Sub-paragraphs 5.1, 5.2, and 5.3 and Paragraph 6 of this Regulation on a natural person from whom a firearm registered in his or her ownership or its exchangeable essential component has been accepted for repair;

23.6. the information referred to in Sub-paragraphs 9.1, 9.2, and 9.3 of this Regulation on a legal person from whom a firearm registered in his or her ownership or its exchangeable essential component has been accepted for repair, and the number and date of issuance of the accompanying document;

23.7. the information referred to in Sub-paragraphs 5.1, 5.2, and 5.3 and Paragraph 6 of this Regulation on a natural person from whom a firearm or a high-energy pneumatic weapon has been accepted for deactivation, and the number and date of issuance of the authorisation for the marketing of a weapon;

23.8. the information referred to in Sub-paragraphs 9.1, 9.2, and 9.3 of this Regulation on a legal person from whom a firearm or high-energy pneumatic weapon has been accepted for deactivation or conversion to a salute weapon (acoustic weapon), and the number and date of issuance of the authorisation for the marketing of a weapon, the number and date of issuance of the accompanying document;

23.9. the information referred to in Sub-paragraphs 5.1, 5.2, and 5.3 and Paragraph 6 of this Regulation on the natural person to whom a firearm, its exchangeable essential components, a high-energy pneumatic weapon, a gas weapon and a signal weapon, a deactivated firearm or firearm ammunition has been marketed, and also in the cases specified in the laws and regulations - information on the type, number and date of issuance of the authorisation for a weapon issued to the natural person;

23.10. the information referred to in Sub-paragraphs 9.1, 9.2, and 9.3 of this Regulation on the legal person to whom a firearm, its exchangeable essential components, a high-energy pneumatic weapon, a gas weapon and a signal weapon, a deactivated firearm or firearm ammunition, or rounds for salute weapons has been marketed, and the licence number of the weapons dealer or the number and date of issuance of the authorisation for the acquisition of a weapon, the number and date of the supporting document.

24. Weapons brokers shall enter in the Register and update in the online data transmission mode the information referred to in Paragraphs 11, 12, 13, 14, and 15 of this Regulation in accordance with Section 83, Paragraph four of the Law on the Handling of Weapons.

25. Medical treatment institutions shall enter in the Register in the online data transmission mode the information referred to in Paragraph 7 of this Regulation within two working days after conducting the health examination.

26. The information referred to in Paragraphs 5 and 6 of this Regulation and Sub-paragraphs 7.4 and 7.5 of this Regulation shall be entered in the Register from the Register of Natural Persons by using technical means of database interconnection, if such information is available.

27. The information referred to in Paragraph 9 of this Regulation (except for information on a foreign weapons dealer who has marketed a firearm or an essential component of a firearm, or a deactivated firearm) shall be entered in the Register from the registers maintained by the Enterprise Register of the Republic of Latvia by using technical means of database interconnection.

28. The information referred to in Paragraphs 7 and 9 of this Regulation shall be entered in the Register from the Register of Licences and Certificates by using technical means of database interconnection.

III. Procedures for the Use and Deletion of Information Entered in the Register

29. The following authorities are entitled to use the information entered in the Register until the destruction of the relevant firearms and their essential components:

29.1. the State Police;

29.2. the State Border Guard;

29.3. the State Security Service;

29.4. the Internal Security Bureau;

29.5. [14 July 2022];

29.6. the Constitution Protection Bureau;

29.7. the Defence Intelligence and Security Service;

29.8. the Military Police;

29.9. the Corruption Prevention and Combating Bureau;

29.10. the State Revenue Service;

29.11. the Prison Administration;

29.12. the municipal police;

29.13. the port police;

29.14. Latvijas Banka;

29.15. the Maintenance Guarantee Fund;

29.16. court bailiffs;

29.17. the Prosecutor's Office;

29.18. courts;

29.19. the State Forest Service;

29.20. the Ministry of Defence.

30. The following authorities are entitled to use the information entered in the Register for 10 years after the destruction of the relevant firearms and their essential components:

30.1. the State Police - for performing the functions specified in the laws and regulations in the field of handling of weapons;

30.2. the customs authorities - for performing the functions specified in the laws and regulations in the field of customs.

31. The following authorities the competence of which includes the prevention, investigation, detection of criminal offences or the prosecution of persons, or the execution of criminal penalties are entitled to use the information entered in the Register for 30 years after the destruction of the relevant firearms and their essential components:

31.1. the State Police;

31.2. the State Border Guard;

31.3. the State Security Service;

31.4. the Internal Security Bureau;

31.5. the Constitution Protection Bureau;

31.6. the Defence Intelligence and Security Service;

31.7. the Military Police;

31.8. the Corruption Prevention and Combating Bureau;

31.9. the State Revenue Service;

31.10. the Prison Administration;

31.11. the Prosecutor's Office;

31.12. a court.

32. The information entered in the Register shall be used by the user of the Register to whom the Centre has granted the right to use the Register on the basis of a request from the authorities referred to in Paragraphs 23, 24, and 25 of this Regulation.

33. A weapons dealer, a weapons broker, and a medical treatment institution shall enter information in the Register and use the information in the Register on the basis of the cooperation agreement concluded with the Centre.

34. The information entered in the Register on a firearm and its essential components, and also the personal data related to them shall be deleted from the Register by the Centre when the time limit specified in Section 87, Paragraph three of the Law on the Handling of Weapons has expired.

IV. Closing Provision

35. The authorities referred to in Sub-paragraphs 4.1, 4.2, 4.3, 4.4, 4.5, 4.6, 4.7, 4.8, and 4.9 of this Regulation shall provide the Centre with the information referred to in Paragraph 14 of this Regulation from 15 January 2021.

V. Informative Reference to European Union Directive

The Regulation contains legal norms arising from Directive (EU) 2017/853 of the European Parliament and of the Council of 17 May 2017 amending Council Directive 91/477/EEC on control of the acquisition and possession of weapons.
