Regulations Regarding Recognition of the Foreign State Civil Aviation Aircrew Certificates

Issued pursuant to
Section 30, Paragraph two and
Section 32, Paragraph three
of the Law On Aviation

1. This Regulation prescribes:

1.1. the procedures by which the State agency "Civil Aviation Agency" (hereinafter - Civil Aviation Agency) shall recognise a civil aviation crew certificate issued by another state in the territory of the Republic of Latvia (hereinafter - foreign state crew certificate);

1.2. the requirements provided for a holder of a foreign state crew certificate.

2. The Civil Aviation Agency shall recognise foreign state crew certificates in accordance with:

2.1. the requirements laid down in Annex III to Commission Regulation (EU) No 1178/2011 of 3 November of 2011 laying down technical requirements and administrative procedures related to civil aviation aircrew pursuant to Regulation (EC) No 216/2008 of the European Parliament and of the Council;

2.2. the requirements of this Regulation.

3. Sub-paragraph 2.2 of this Regulation shall be applied in relation to the following foreign state crew certificates:

3.1. flight navigator licences, flight engineer licences, glider, airship and hot-air balloon pilot licences issued in accordance with the requirements of Annex I to the Convention on International Civil Aviation of 7 December 1944 (hereinafter - Convention), if the holder of the licence is planning to perform commercial flights, using an aircraft registered in the register of civil aviation aircrafts of the Republic of Latvia;

3.2. foreign state crew certificates issued in accordance with the requirements of foreign national laws and regulations, if the holder of the certificate is planning to perform flights, using an aircraft registered in the register of civil aviation aircrafts of the Republic of Latvia, or to perform flights in the airspace of the Republic of Latvia;

3.3. flight navigator licences, flight engineer licences, glider, airship and hot-air balloon pilot licences issued in accordance with the requirements of Annex I to the Convention, if the holder of the licence is planning to perform flights, using a specific aircraft registered in the register of civil aviation aircrafts of the Republic of Latvia for the performance of a specific task (for example, training flights, demonstration flights, test flights).

4. A citizen and non-citizen of Latvia, as well as foreigner who in accordance with the Immigration Law has legal grounds to stay in the Republic of Latvia or who has entered into employment legal relationship with the aircraft operation regarding piloting an aircraft registered in the register of civil aviation aircrafts of the Republic of Latvia, are entitled to apply for recognition of the foreign state crew certificate referred to in Paragraph 3 of this Regulation in the Republic of Latvia.

5. The Civil Aviation Agency shall recognise the certificates issued in the states of the European Economic Area referred to in Sub-paragraph 3.1 of this Regulation together with the indicated qualification notes (notification in the certificate or an individual document in which the rights, conditions or restrictions related to such certificate are indicated), if upon request of the Civil Aviation Agency the issuing authority of the foreign state crew certificate has confirmed the validity of the medical certificate, the foreign state crew certificate and the qualification note of the holder of the certificate.

6. The Civil Aviation Agency shall recognise the certificates issued in the third countries referred to in Sub-paragraph 3.1 of this Regulation (states which are not the states of the European Economic Area) with the indicated qualification notes if:

6.1. upon request the Civil Aviation Agency the issuing authority of the foreign state crew certificate has confirmed the validity of the medical certificate, the foreign state crew certificate and the qualification note of the holder of the certificate;

6.2. the holder of the certificate does not comply with the requirements laid down in Annex to this Regulation.

7. The Civil Aviation Agency shall recognise the certificates referred to in Sub-paragraph 3.2 of this Regulation if:

7.1. the holder of the certificate submits a document proving his or her qualification and flight experience (the number of flight hours performed);

7.2. the holder of the certificate complies with the requirements laid down in Annex to this Regulation.

8. If, upon examining an issue regarding recognition of the certificate referred to in Sub-paragraph 3.2 of this Regulation, there are justified doubts regarding the conformity of the requirements of the foreign state with the relevant requirements in effect in the Republic of Latvia, the Civil Aviation Agency shall request additional information from the competent aviation authority of such state, which issued the relevant foreign state crew certificate. In evaluating the information received, the Civil Aviation Agency shall determine the necessary amount of and procedures for testing the theoretical knowledge and qualification on a case-by-case basis, informing the holder of the certificate thereof in writing.

9. The Civil Aviation Agency shall recognise the certificates referred to in Sub-paragraph 3.3 of this Regulation if:

9.1. the holder of the certificate has a valid medical certificate, foreign state crew certificate and qualification note, which gives the right to perform flights with a specific aircraft category (type) and to perform a specific type of flight;

9.2. the holder of the certificate has a direct or indirect relation to the manufacturer of the particular aircraft (for example, the holder of the certificate is an employee or qualified pilot of the aircraft who may perform flight with the particular aircraft).

10. The Civil Aviation Agency shall take a decision to recognise the foreign state crew certificate or to refuse to recognise the foreign state crew certificate within a month after receipt of a written application of the holder of the foreign state crew certificate.

11. The Civil Aviation Agency shall take a decision to refuse to recognise a foreign state crew certificate, to which the requirements of Annex III of Regulation No 1178/2011 apply, if the holder of the foreign state crew certificate does not comply with the referred-to requirements.

12. The Civil Aviation Agency shall take a decision to refuse to recognise the foreign state crew certificate referred to in Paragraph 3 of this Regulation, if:

12.1. the holder of the foreign state crew certificate does not comply with the requirements referred to in Paragraph 4 of this Regulation;

12.2. the holder of the foreign state crew certificate does not comply with the requirements referred to in Annex to this Regulation;

12.3. the issuing authority of the foreign state crew certificate has not confirmed the validity of the medical certificate, foreign state crew certificate and qualification note of the holder of the certificate.

13. If the Civil Aviation Agency takes a decision to recognise:

13.1. a foreign state crew certificate to which the requirements of Annex III to Regulation No 1178/2011 apply, the Civil Aviation Agency shall issue a confirmation of the certificate to the holder of the certificate in accordance with Paragraph 2 of Annex III to Regulation No 1178/2011;

13.2. the foreign state crew certificates referred to in Paragraph 3 of this Regulation, the Civil Aviation Agency shall issue a confirmation of the certificate to the holder of the certificate according to the type, qualification notes and term of validity of the foreign state crew certificate, but not longer than for 12 months.

14. The following information shall be indicated in the confirmation of a certificate:

14.1. the name and logo of the issuing authority of the confirmation of the certificate;

14.2. the confirmation number of the certificate;

14.3. the category, number and issuing authority of such certificate, which is recognised by such confirmation of certificate;

14.4. the right granted by such confirmation of certificate;

14.5. the conditions for validity of the confirmation of certificate.

15. A holder of a foreign state crew certificate whose certificate is recognised in accordance with Sub-paragraph 2.2 of this Regulation shall maintain the foreign state crew certificate and the qualification notes during the term of validity of the confirmation of certificate in accordance with the requirements of Cabinet Regulation No. 51 of 18 January 2011, Regulations Regarding Certification of Civil Aviation Aircrew Members.

16. Paragraphs 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14 and 15 of this Regulation shall not apply to the certificates of a private pilot, glider, airship and hot-air balloon, which have been issued in accordance with the requirements of Annex I to the Convention, if the holder of the certificate plans to perform private flights only during day according to the visual flight provisions with an aircraft registered in the register of civil aviation aircrafts of the Republic of Latvia, which is certified for one-pilot control. A holder of a foreign state crew certificate is entitled to perform the flights referred to in this Paragraph without confirmation of the certificate.

1 Medical certificate in accordance with Cabinet Regulation No. 51 of 18 January 2011, Regulations Regarding Certification of Civil Aviation Aircrew Members.

2 Examination of theoretical knowledge in accordance with Cabinet Regulation No. 51 of 18 January 2011, Regulations Regarding Certification of Civil Aviation Aircrew Members. The holder of the certificate may take examination of theoretical knowledge in Latvian or English.

3 Examination of qualification on an aircraft or in a simulator according to a programme approved by the Civil Aviation Agency.
