Regulations Regarding the Procedures for Registration of Events and Reaction Time of the Police

Issued pursuant to
Section 10, Paragraph four of the Law On Police

I. General Provisions

1. This Regulation prescribes:

1.1. the procedures by which submissions and information regarding criminal offences and other violations of the law, regarding events endangering the safety of persons or public safety (hereinafter - events), and regarding persons involved therein shall be registered, as well as the amount and term of storage of the information to be registered;

1.2. the reaction time of the police if information regarding events has been received.

2. Within the meaning of this Regulation reaction shall mean the arrival of the police at the scene.

II. Procedures for Registering Submissions and Information, the Amount and Term of Storage of the Information to be Registered

3. The police shall register submissions and information regarding events and persons involved therein regardless of the type of receipt (in writing, electronically or in oral form) without delay in the single register of events (hereinafter - register), which is a component of the State information system "Integrated Information System of the Interior".

4. The manager of the register shall be the Information Centre of the Ministry of the Interior.

5. Police officers shall ensure inclusion of information in the register in online data transmission mode.

6. The following information shall be included in the register in relation to an event:

6.1. the date and time of registering a submission or information;

6.2. the official (officer) who registered a submission or information:

6.2.1. the name of the institution and its unit;

6.2.2. the given name and surname;

6.2.3. the position;

6.2.4. contact details;

6.3. the date, time and type of receipt or acquisition of a submission or information;

6.4. the date and time or time period of the event;

6.5. the provider of a submission or information (if known):

6.5.1. the given name (given names) and surname (surnames);

6.5.2. the personal identity number;

6.5.3. the date of birth;

6.5.4. sex;

6.5.5. nationality;

6.5.6. contact details;

6.6. place and circumstances of the event;

6.7. resources sent to the scene;

6.8. reaction time of the police after receipt of information.

7. After verification of information and examination of the scene the following information shall be included in addition in the register without delay:

7.1. the results of verification of a submission or information;

7.2. the persons who have been or may have been caused financial, physical or moral harm in relation to the event or who may provide information regarding the circumstances and nature of the event (if such persons are known):

7.2.1. regarding natural persons:

7.2.1.1. the status of the person in the event;

7.2.1.2. the given name (given names) and surname (surnames);

7.2.1.3. the personal identity number;

7.2.1.4. the date of birth;

7.2.1.5. sex;

7.2.1.6. nationality;

7.2.1.7. contact details;

7.2.2. regarding legal persons:

7.2.2.1. the status of the person in the event;

7.2.2.2. name;

7.2.2.3. registration number;

7.2.2.4. legal address;

7.2.2.5. contact details;

7.3. persons involved in the event who are examined in relation to causing (committing) the event (if such persons are known):

7.3.1. regarding natural persons:

7.3.1.1. the status of the person in the event;

7.3.1.2. the given name (given names) and surname (surnames);

7.3.1.3. the personal identity number;

7.3.1.4. the date of birth;

7.3.1.5. sex;

7.3.1.6. nationality;

7.3.1.7. contact details;

7.3.1.8. anatomical and functional features of the person which may help identifying the person;

7.3.1.9. general description of the person;

7.3.1.10. photograph of the person (if such is available and necessary for identification of the person);

7.3.1.11. special indications regarding potential dangerousness of the person;

7.3.2. regarding legal persons:

7.3.2.1. the status of the person in the event;

7.3.2.2. name;

7.3.2.3. registration number;

7.3.2.4. legal address;

7.3.2.5. contact details;

7.4. damaged, illegally alienated, removed, lost or found property related to the event (information that is known):

7.4.1. type of the property;

7.4.2. make and model;

7.4.3. identification number;

7.4.4. national registration number;

7.4.5. state of registration;

7.4.6. state of manufacture;

7.4.7. colour;

7.4.8. year (date) of manufacture (issue);

7.4.9. given name (given names), surname (surnames) and date of birth of the owner or holder of the property;

7.4.10. description of the property (including special features which may help in identifying the property);

7.4.11. picture of the property (if available);

7.4.12. indication regarding cultural and historical significance of the property - cultural monument, museum article, art or antique article;

7.4.13. indication regarding material value of the property;

7.5. damaged, illegally alienated, removed, lost or found documents related to the event (information that is known):

7.5.1. type of the document;

7.5.2. number;

7.5.3. date of issue;

7.5.4. state of issue;

7.5.5. issuing authority;

7.5.6. given name (given names), surname (surnames) and date of birth of the person to whom the document has been issued;

7.5.7. indication regarding cultural and historical significance of the document - cultural monument, museum article, art or antique article;

7.6. the decision taken, the date of taking and number thereof, the official (officer) who took the decision;

7.7. further action in relation to reviewing the event, the institution and its unit which reviews the materials of the event;

7.8. the institution and its unit to which the materials of the event have been sent for reviewing according to jurisdiction, if the materials have been sent to another institution.

8. The information accumulated regarding events shall be kept in the register for 10 years. After the end of the referred-to term information shall be automatically deleted from the register.

III. Reaction Time of the Police if Information Regarding Events has been Received

9. The police shall react to information received regarding an event:

9.1. in cities - within 15 minutes after information was received at the operational command unit;

9.2. in municipalities - within 25 minutes after information was received at the operational command unit.

10. If information regarding several events is concurrently received at the police, the police shall react in order of priority according to the level of danger to the persons involved or to the public safety:

10.1. in cities - within 15 minutes, in municipalities - within 25 minutes if information has been received at the operational command unit:

10.1.1. regarding an event which is occurring and is actually endangering the safety of a person or public safety, the health, life or sexual inviolability of a person, causes harm to the health or property of a person, and immediate action of the police is necessary in order to discontinue the event, to eliminate the threat or harm or to apprehend the person violating the law at the scene;

10.1.2. regarding a road traffic accident or an event on railway, as well as another event which has occurred on the main street of a town or on a road of State significance and which has blocked traffic;

10.1.3. regarding a traffic accident which has resulted in death of a person;

10.1.4. regarding escape of detained persons, arrested persons, persons held in custody or convicted persons;

10.1.5. regarding an explosion or threats of using explosives (if the event is not related, for example, to co-ordinated activities of manufacturing process, industrial use of explosives, planned military training);

10.2. in cities - within 25 minutes, in municipalities - within 40 minutes if information has been received at the operational command unit:

10.2.1. regarding an event which has occurred and in which the safety of a person or public safety, the health, life or sexual inviolability of a person was endangered or harm was caused to the health or property of a person, and in which immediate action of the police cannot eliminate the threat or apprehend the person violating the law, however, traces or evidence may be lost;

10.2.2. regarding an event which has resulted in detaining the possible person violating the law and threat to the safety of a person or public safety, the health, life or sexual inviolability of a person or harm to the health or property of a person has been discontinued;

10.2.3. regarding a traffic accident which has resulted in a victim or obstructed traffic;

10.2.4. regarding finding human remains or human body parts;

10.3. in cities - within 120 minutes, in municipalities - within 240 minutes or another time co-ordinating it with the provider of information if information has been received at the operational command unit:

10.3.1. regarding an event which does not endanger the safety of a person or public safety, the health, life or sexual inviolability of a person and does not cause harm to the health or property of a person, but for discontinuation or elimination of which the presence of the police is required;

10.3.2. regarding an event for discontinuation or elimination of which the time of arrival of the police at the scene is not important;

10.3.3. regarding a traffic accident which has not resulted in a victim and does not obstruct traffic.

11. In receiving information regarding an event in which arrival of police officers at the scene is not mandatory or is not necessary, the police shall reach an agreement with the provider of information regarding performance of the relevant measures without the presence of police officers at the scene.

12. After receipt of information regarding an event discontinuation or elimination of which is within the competence of other authorities, the police shall, without delay, transfer the received information to another authority according to the competence.

13. Police officers may arrive at the scene later than laid down in Paragraphs 9 and 10 of this Regulation in the following cases:

13.1. the arrival was hindered by circumstances caused by force majeure or great distance from the location of police officers to the scene;

13.2. concurrently information regarding two or more events has been received;

13.3. traffic problems have occurred on the way to the scene (for example, heavy traffic, closed railway crossings, traffic accidents, bad road surface, no access roads, technical damages to police vehicles).

14. In order to ensure fast arrival at the scene which according to the level of threats to the safety of persons involved or public safety is of priority, police officers are entitled to leave a place of event of lower priority in which performance of immediate procedural activities is not necessary. Where necessary, the police shall ensure arrival of police officers to the place of event of lower priority left for the performance of the relevant measures.
