Procedures for the Issuance of Special Permits (Licences) and State Police Permits for Commercial Activities with Fireworks and Theatrical Pyrotechnic Articles, and Procedures for the Payment of the State Fee

Section 16, Paragraph nine of
the Law On the Circulation of Pyrotechnic Articles

I. General Provisions

1. This Regulation prescribes:

1.1. the requirements to be met by a merchant in order to receive a special permit (licence);

1.2. the procedures by which a special permit (licence) shall be issued to a merchant;

1.3. the requirements to be met by a merchant during the term of validity of a special permit (licence);

1.4. the procedures by which a duplicate of a special permit (licence) and a repeat special permit (licence) shall be issued to a merchant;

1.5. the procedures by which the operation of a special permit (licence) shall be suspended and a special permit (licence) shall be cancelled;

1.6. the procedures by which the State Police shall issue a written permit to purchase, store and use Category 4 fireworks and Category T2 theatrical pyrotechnic articles;

1.7. the procedures by which a State fee shall be paid for the issuance of a special permit (licence), a duplicate thereof or a repeat special permit (licence), and the amount of such State fee.

II. Requirements for Receipt of a Special Permit (Licence)

2. A merchant who wishes to receive any of the special permits (licences) (Annex 1) referred to in Paragraph 27 of this Regulation:

2.1. depending on the type of planned commercial activities, shall construct (set up) premises for the production, storage and trade of fireworks and theatrical pyrotechnic articles in accordance with the requirements of the laws and regulations governing the circulation of pyrotechnic articles, or shall conclude a contract on lease of premises conforming to such requirements:

2.1.1. production premises and warehouse - to receive a special permit (licence) for the production of fireworks and theatrical pyrotechnic articles;

2.1.2. warehouse - to receive a special permit (licence) for wholesale trade of fireworks and theatrical pyrotechnic articles, provision of pyrotechnic services or another type of commercial activities;

2.1.3. shop - to receive a special permit (licence) for the retail trade of fireworks and theatrical pyrotechnic articles;

2.2. shall provide the opportunity to officials of competent State authorities to inspect at a specific time whether the production premises, warehouses and shops of fireworks and theatrical pyrotechnic articles conform to the requirements of the laws and regulations governing the circulation of pyrotechnic articles.

3. If the planned commercial activity requires a warehouse, a merchant shall draw up:

3.1. a plan of the location of the warehouse on a scale 1:1000 or 1:2000. The plan shall show the location of the warehouse and the buildings and main roads within 200 metre radius;

3.2. a plan of the warehouse on a scale 1:50 or 1:100. The plan shall state the categories of fireworks and theatrical pyrotechnic articles intended for storage and the total maximum permitted mass of propellant, as well as the address and telephone number of the warehouse. The merchant shall appoint a warehouse manager.

4. In order to receive a special permit (licence) for the provision of pyrotechnic services, a merchant shall hire a pyrotechnician - a person who has received a pyrotechnician's certificate or a document equivalent thereto issued by another European Union Member State or European Economic Area State certifying professional competence (hereinafter - document equivalent to a pyrotechnician's certificate).

5. A merchant shall ensure that the employees whose job responsibilities are directly related to production, storage or trade of fireworks and theatrical pyrotechnic articles or to provision of pyrotechnic services (hereinafter - employees) are trained on issues concerning categories and types of fireworks and theatrical pyrotechnic articles, restrictions on and procedures for storage, purchase, trade, carrying, transportation and use thereof, and fire safety regulations.

6. In order to receive the special permit (licence) referred to in Paragraph 27 of this Regulation, a merchant shall submit to a licensing committee of the State Police (hereinafter - licensing committee) an application for receipt of a special permit (licence) (Annex 2). The following shall be indicated in the application:

6.1. a partnership or capital company:

6.1.1. the name and uniform registration number;

6.1.2. the contact details - legal address, telephone number, as well as electronic mail address (if the merchant wishes to receive the special permit (licence) electronically);

6.1.3. information regarding persons (given name, surname and personal identification number or date of birth if personal identification number has not been assigned) who hold positions in the administrative bodies of the merchant (hereinafter - official of the administrative body of the merchant);

6.1.4. information regarding members of the merchant:

6.1.4.1. the given name, surname and personal identification number of a natural person or date of birth if personal identification number has not been assigned;

6.1.4.2. the name and uniform registration number of a legal person;

6.2. an individual merchant:

6.2.1. the given name, surname and personal identification number or date of birth if personal identification number has not been assigned;

6.2.2. the contact details - legal address, telephone number, as well as electronic mail address (if the merchant wishes to receive the special permit (licence) electronically);

6.3. information regarding the merchant's employee (pyrotechnician) (given name, surname and personal identification number or date of birth if personal identification number has not been assigned) who has received a pyrotechnician's certificate or a document equivalent to a pyrotechnician's certificate (for receipt of a special permit (licence) for the provision of pyrotechnic services);

6.4. the planned types of activity (production, wholesale trade, retail trade, provision of pyrotechnic services);

6.5. categories of fireworks and theatrical pyrotechnic articles intended for commercial activities;

6.6. address of production premises, warehouse or shop of fireworks and theatrical pyrotechnic articles;

6.7. form of receiving the special permit (licence) - in printed form or as an electronic document.

7. The following documents shall be appended to the application referred to in Paragraph 6 of this Regulation:

7.1. a copy of the document certifying that the merchant owns or possesses the immovable property in which storage, trade or production of fireworks and theatrical pyrotechnic articles is intended;

7.2. a copy of the security guard contract confirming that the production premises, warehouses and shops of fireworks and theatrical pyrotechnic articles are equipped with a fire detection and fire alarm system and security alarm system that are connected to the central security control panel of a security guard merchant;

7.3. the plans referred to in Sub-paragraphs 3.1 and 3.2 of this Regulation if a warehouse is necessary for the commercial activity;

7.4. an opinion of a psychiatrist and a narcologist regarding the state of health of officials of administrative bodies of an individual merchant and merchant, and employees of the merchant;

7.5. a list of employees indicating the given name, surname and personal identification number of each employee or date of birth if personal identification number has not been assigned, and the position;

7.6. a copy of the document equivalent to the pyrotechnician's certificate if the employee has not received a pyrotechnician's certificate (for receipt of a special permit (licence) for the provision of pyrotechnic services);

7.7. copies of employment contracts, contracts for work performance or other contracts entered into with employees regarding performance of the works concerned.

8. In order to receive a special permit (licence) for seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles (Annex 3), a merchant who has received a special permit (licence) for trade or production of fireworks and theatrical pyrotechnic articles shall submit an application (Annex 4) to the licensing committee. The following shall be indicated in the application:

8.1. the name and uniform registration number of the merchant;

8.2. the contact details - legal address, telephone number, as well as electronic mail address (if the merchant wishes to receive the special permit (licence) electronically);

8.3. addresses in which seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles is planned;

8.4. form of receiving the special permit (licence) - in printed form or as an electronic document.

9. The following shall be appended to the application referred to in Paragraph 8 of this Regulation:

9.1. a copy of the lease agreement for the premises of the seasonal trade location or a copy of the document certifying that the merchant owns the immovable property in which seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles is planned;

9.2. a plan of the premises on a scale 1:50 or 1:100 that shows the planned seasonal trade location of pyrotechnic articles;

9.3. a list of employees who will sell the pyrotechnic articles at the seasonal trade location, indicating the given name, surname and personal identification number of each employee or date of birth if personal identification number has not been assigned;

9.4. the following documents of the employees referred to in Sub-paragraph 9.3 of this Regulation:

9.4.1. a copy of the employment contract, contract for work performance or other contract entered into with the employee regarding performance of the work concerned;

9.4.2. an opinion of a psychiatrist and narcologist regarding the state of health of the employee.

10. The merchant shall submit the application referred to in Paragraph 8 of this Regulation not earlier than three months and not later than one month before the permitted seasonal trade.

11. The opinions referred to in Sub-paragraphs 7.4 and 9.4.2 of this Regulation shall be valid for submission for 90 days from the date of issuance thereof.

12. An application and the documents to be appended thereto or copies thereof shall be submitted in the form of a printed or electronic form in accordance with the laws and regulations regarding the drawing up of electronic documents.

III. Issuance of a Special Permit (Licence)

13. Upon receipt of the application referred to in Paragraph 6 or 8 of this Regulation, the licensing committee shall verify whether all the required information has been indicated therein and all the documents referred to in Paragraph 7 or 9 of this Regulation have been appended.

14. If not all of the information referred to in Paragraph 6 or 8 of this Regulation has been indicated in the application or not all of the documents referred to in Paragraph 7 or 9 of this Regulation have been appended, the licensing committee shall inform the merchant thereof and determine a time period of not less than five working days for elimination of the deficiencies detected. If the merchant does not submit the requested information or documents within the determined period of time, the licensing committee shall take a decision to refuse to issue a special permit (licence). The decision taken by the licensing committee shall be recorded in the minutes of the meeting of the committee and notified to the merchant within three working days in accordance with the procedures laid down in the Administrative Procedure Law.

15. After receipt of the application referred to in Paragraph 6 of this Regulation and the documents appended thereto the licensing committee shall:

15.1. within three working days, request:

15.1.1. the territorial unit of the State Fire and Rescue Service, in the territory serviced by which production premises, warehouse or shop of fireworks and theatrical pyrotechnic articles is located - an opinion on the conformity of the production premises, warehouse or shop of fireworks and theatrical pyrotechnic articles (depending on the indicated type of commercial activity) with the requirements of the laws and regulations determining the fire safety requirements for production premises, warehouses or shops of pyrotechnic articles;

15.1.2. the regional unit of the State Police, in the territory serviced by which production premises, warehouse or shop of fireworks and theatrical pyrotechnic articles is located - an opinion on the conformity of the production premises, warehouse or shop of fireworks and theatrical pyrotechnic articles (depending on the indicated type of commercial activity) with the requirements of the laws and regulations governing the circulation of pyrotechnic articles;

15.1.3. the State Environmental Service - an opinion on the conformity of production premises and machinery of fireworks and theatrical pyrotechnic articles with the laws and regulations governing environmental protection;

15.2. within 15 days:

15.2.1. check whether the restrictions for the issuance of a special permit (licence) laid down in the Law On the Circulation of Pyrotechnic Articles apply to the individual merchant, commercial company, officials of the administrative body of the merchant, and employees of the merchant;

15.2.2. check whether the pyrotechnician indicated in the application has received a pyrotechnician's certificate, or assess the conformity of the document equivalent to a pyrotechnician's certificate and recognise the professional qualification (for receipt of a special permit (licence) for the provision of pyrotechnic services).

16. After receipt of the application referred to in Paragraph 8 of this Regulation and the documents appended thereto the licensing committee shall:

16.1. within three working days, request:

16.1.1. the territorial unit of the State Fire and Rescue Service, in the territory serviced by which seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles is planned - an opinion on the conformity of the trade location with the fire safety regulations;

16.1.2. the local government in the territory of which seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles is planned - approval of seasonal trade of fireworks and theatrical pyrotechnic articles in the territory indicated;

16.2. within 15 days check whether the restrictions for the issuance of a special permit (licence) laid down in the Law On the Circulation of Pyrotechnic Articles apply to the employees who will sell pyrotechnic articles at the seasonal trade location.

17. The documents referred to in Sub-paragraphs 15.1.1, 15.1.2, 15.1.3, 16.1.1 and 16.1.2 of this Regulation may also be submitted by the merchant together with the application referred to in Paragraph 6 or accordingly Paragraph 8 of this Regulation.

18. The opinions referred to in Sub-paragraphs 15.1.1, 15.1.2, 15.1.3, 16.1.1 and 16.1.2 of this Regulation shall be valid for submission for 90 days from the day of issue thereof.

19. The institutions referred to in Sub-paragraphs 15.1.1, 15.1.2, 15.1.3, 16.1.1 and 16.1.2 of this Regulation shall be provide opinions to the licensing committee within 15 days from the day of receipt of a request.

20. Within 15 days after receipt of the opinions referred to in Sub-paragraphs 15.1 and 16.1 of this Regulation and after performing the checks referred to in Sub-paragraphs 15.2 and 16.2, the licensing committee shall take a decision on the issuance of a special permit (licence) for the particular type of commercial activity with fireworks and theatrical pyrotechnic articles, or to refuse to issue a special permit (licence).

21. If additional checking of information is necessary for taking of a decision, the licensing committee shall extend the term for taking of the decision in accordance with the procedures laid down in the Administrative Procedure Law.

22. If a merchant who wishes to receive a special permit (licence) for seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles submits the additionally requested information or documents less than 15 days before the permitted seasonal trade, the licensing committee shall take a decision to refuse to issue a special permit (licence).

23. The licensing committee shall take a decision to refuse to issue a special permit (licence) if:

23.1. it has been detected in the check referred to in Sub-paragraph 15.2 or 16.2 of this Regulation that any of the restrictions referred to in the Law On the Circulation of Pyrotechnic Articles applies;

23.2. it has been detected that a pyrotechnician's certificate has not been issued to the pyrotechnician or that the pyrotechnician's certificate or a document equivalent thereto issued in another European Union Member State or European Economic Area State certifying professional competence has not been recognised in accordance with the laws and regulations determining the procedures for the recognition of professional qualification for permanent professional activity in the Republic of Latvia;

23.3. the opinion referred to in Sub-paragraphs 15.1.1, 15.1.2, 15.1.3 or accordingly Sub-paragraph 16.1.1 of this Regulation is received and it is negative for the merchant, or the approval referred to in Sub-paragraph 16.1.2 of this Regulation has not been received.

24. If necessary, the licensing committee may invite the director of the merchant or an authorised representative of the merchant to the meeting of the licensing committee.

25. The licensing committee shall record the decision to refuse to issue a special permit (licence) in the minutes of the meeting of the committee and notify to the merchant thereof within three working days in accordance with the procedures laid down in the Administrative Procedure Law.

26. A special permit (licence) shall be valid from the day when the merchant has received the special permit (licence) after paying the determined State fee. A special permit (licence) for seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles shall be valid from the date indicated in the special permit (licence) until 31 December of the indicated year,

27. The licensing committee, according to the decision taken, shall issue the following type of a special permit (licence) to the director of the merchant or his or her authorised representative:

27.1. a special permit (licence) for the production of fireworks and theatrical pyrotechnic articles, which gives the right to produce the category of fireworks and theatrical pyrotechnic articles and propellants thereof indicated in the special permit (licence), to purchase in Latvia and import from abroad propellants and raw materials necessary for the production of fireworks and theatrical pyrotechnic articles, store them at the address indicated in the special permit (licence), sell the produced fireworks and theatrical pyrotechnic articles in wholesale trade in Latvia and export for trade abroad;

27.2. a special permit (licence) for the wholesale trade of a certain category of fireworks and theatrical pyrotechnic articles, which gives the right to purchase in Latvia and import from abroad the category of fireworks and theatrical pyrotechnic articles indicated in the special permit (licence), store them at the address indicated in the special permit (licence), sell them in wholesale trade in Latvia and export for trade abroad, as well as perform transit and agency transactions;

27.3. a special permit (licence) for the retail trade of a certain category of fireworks and theatrical pyrotechnic articles, which gives the right to purchase in Latvia and import from abroad the category of fireworks and theatrical pyrotechnic articles indicated in the special permit (licence), store them at the address indicated in the special permit (licence), sell them in retail trade in Latvia and export for trade abroad, as well as perform transit and agency transactions;

27.4. a special permit (licence) for the provision of pyrotechnic services with a certain category of fireworks and theatrical pyrotechnic articles, which gives the right to purchase in Latvia and import from abroad the category of fireworks and theatrical pyrotechnic articles indicated in the special permit (licence), store them at the address indicated in the special permit (licence), and provide pyrotechnic services with them;

27.5. a special permit (licence) for another type of commercial activity with a certain category of fireworks and theatrical pyrotechnic articles, which gives the right to perform the commercial activity indicated in the special permit (licence).

28. The name, uniform registration number and legal address of the merchant, the type of the special permit (licence), the address of production facility, warehouse and shop where storage, trade and production of fireworks and theatrical pyrotechnic articles is allowed, the permitted categories of fireworks and theatrical pyrotechnic articles and the maximum permitted mass of propellant in the warehouse and shop, as well as the date of issuance and number of the special permit (licence) shall be indicated in the special permit (licence). In a special permit (licence) for the provision of pyrotechnic services in addition the pyrotechnician's given name, surname and the number of the pyrotechnician's certificate or the name and number of the document equivalent to a pyrotechnician's certificate shall be indicated.

29. If it is not possible to indicate in the special permit (licence) all allowed addresses of warehouses and shops of fireworks and theatrical pyrotechnic articles, they shall be indicated in an annex to the special permit (licence).

30. Upon receipt of the special permit (licence), the merchant shall submit to the licensing committee a copy of the document confirming payment of the State fee or a printout of a payment made by means of Internet banking that clearly shows the given name, surname or company name of the payer and bears the payer's signature. If payment is made by means of Internet banking and the payment document is signed with a secure electronic signature and conforms to the requirements laid down in the laws and regulations governing the drawing up of electronic documents, the merchant may send them to the electronic mail address indicted by the committee.

31. If the merchant has expressed a wish to receive the special permit (licence) in the form of an electronic document, the licensing committee shall ascertain whether the documents referred to in Paragraph 30 of this Regulation have been submitted, and shall, within three working days after receipt of such document, send the special permit (licence) to the merchant in the form of an electronic document in accordance with the laws and regulations governing the drawing up of electronic documents.

32. If the merchant does not pay the determined State fee within six months after receipt of information regarding issuance of the special permit (licence) or has not received the special permit (licence), the application for the receipt of a special permit (licence) shall be resubmitted according to general procedure.

IV. Requirements to be Met during the Operation of a Special Permit (Licence), Issuance of a Repeat Special Permit (Licence) and Duplicate of a Special Permit (Licence)

33. If during the term of operation of a special permit (licence) it is planned to appoint (elect) a new director or an official of the administrative body of the merchant or to hire a new employee, the merchant shall inform the licensing committee thereof in writing by submitting an application and the documents referred to in Sub-paragraphs 7.4, 7.5, 7.6 and 7.7 of this Regulation. If during the term of operation of a special permit (licence) it is planned to change the composition of the members of the merchant, the merchant shall inform the licensing committee thereof in writing.

34. If the application referred to in Paragraph 33 of this Regulation has been received, the licensing committee shall, within 15 days after receipt thereof, carry out the check referred to in Sub-paragraphs 15.2.1 and 15.2.2 of this Regulation and shall give an answer to the merchant.

35. A merchant shall make changes in the composition of the members of the merchant, appoint (elect) a new director or an official of the administrative body of the merchant or hire a new employee accordingly after an answer of the licensing committee has been received that the restrictions laid down in the Law On the Circulation of Pyrotechnic Articles do not apply to the person concerned. When hiring a new pyrotechnician, the merchant shall receive a repeat special permit (licence) for the provision of pyrotechnic services.

36. When hiring a new employee the merchant shall ensure conformity with the requirements referred to in Paragraph 5 of this Regulation.

37. If the term of validity of the document referred to in Sub-paragraph 7.4 of this Regulation expires during the term of operation of a special permit (licence), within 15 days the merchant shall submit valid opinions to the licensing committee on the state of health of the persons concerned. If no term of validity is indicated in the document referred to in Sub-paragraph 7.4 of this Regulation, the merchant shall submit valid opinions to the licensing committee on the state of health of the persons concerned not later than five years after the day of issuance of the document.

38. If during operation of a special permit (licence) the legal address or name of the merchant changes, the merchant shall, within five working days after the changes, submit a respective application to the licensing committee for receipt of a repeat special permit (licence).

39. The licensing committee shall, within 15 days after receipt of the application referred to in Paragraph 38 of this Regulation, issue to the merchant a repeat special permit (licence).

40. If during operation of a special permit (licence) another production premises, warehouse or shop of fireworks and theatrical pyrotechnic articles is set up, the merchant shall, prior to the use of the premises concerned, inform the licensing committee thereof by submitting an application for the receipt of a repeat special permit (licence).

41. After receipt of the application referred to in Paragraph 40 of this Regulation the licensing committee shall, within three working days, request the opinions referred to in Sub-paragraphs 15.1.1, 15.1.2 and 15.1.3 of this Regulation. When positive opinions are received, the licensing committee shall issue a repeat special permit (licence) to the merchant.

42. The documents referred to in Sub-paragraphs 15.1.1, 15.1.2 and 15.1.3 of this Regulation may also be submitted by the merchant together with the application referred to in Paragraph 40 of this Regulation. The merchant shall commence commercial activities in other premises after receipt of a repeat special permit (licence).

43. Upon receipt of a repeat special permit (licence), a merchant shall, within three working days, destroy the special permit (licence) previously issued. A repeat special permit (licence) shall be issued, conforming to the procedures referred to in Paragraph 30 of this Regulation.

44. If a special permit (licence) issued in printed form is damaged, lost or stolen, the merchant shall, within five working days, inform the licensing committee thereof in writing by submitting an application for the receipt of a duplicate of the special permit (licence). The licensing committee shall, within five working days after receipt of the application, issue a duplicate of the special permit (licence).

45. If a special permit (licence) issued in the form of an electronic document is damaged, lost or stolen, the merchant shall, within five working days, inform the licensing committee thereof in writing by submitting an application for the receipt of a duplicate of the special permit (licence). A licensing committee shall, within five working days after receipt of the application, send or issue a duplicate of the special permit (licence).

46. If a merchant discontinues the commercial activities indicated in the special permit (licence), it shall, within five working days, inform the licensing committee thereof in writing. The merchant has a duty to destroy the issued special permit (licence) within three working days after discontinuation of commercial activities.

V. Suspension of Operation and Cancellation of a Special Permit (Licence)

47. A decision to suspend the operation of a special permit (licence) in the cases laid down in the Law On the Circulation of Pyrotechnic Articles shall be taken by a competent official of the State Police, but a decision to cancel a special permit (licence) - by the licensing committee.

48. A merchant, for whom the operation of the special permit (licence) issued has been suspended, shall recommence the commercial activities indicated in the special permit (licence) only after a competent official of the State Police has taken a decision to restore the operation of the special permit (licence).

49. Upon taking a decision to cancel a special permit (licence), the licensing committee may specify a date, from which the special permit (licence) is revoked; however, it shall not be later than 30 days from the day when the decision was taken.

50. If a decision to cancel the special permit (licence) has been taken, the merchant has a duty to destroy the issued special permit (licence) within three working days after receipt of the decision.

51. A decision to suspend the operation of a special permit (licence) may be contested by submitting a corresponding application to a higher unit (official) of the State Police, and a decision of the licensing committee to revoke a special permit (licence) may be contested by submitting an application to the Chief of the State Police.

VI. Issuance of a State Police Permit for Purchase, Storage and Use of Category 4 Fireworks and Category T2 Theatrical Pyrotechnic Articles

52. In order to receive a State Police permit to purchase, store and use Category 4 fireworks and Category T2 theatrical pyrotechnic articles (hereinafter - permit) (Annex 5), a legal person which is entitled to purchase, store and use Category 4 fireworks and Category T2 theatrical pyrotechnic articles shall:

52.1. set up a warehouse or store-room that conforms to the requirements of the laws and regulations regarding warehouses or shop store-rooms for fireworks and theatrical pyrotechnic articles;

52.2. appoint an employee who is responsible for the purchase, storage, accounting and issue for use of fireworks and theatrical pyrotechnic articles (hereinafter - responsible person);

52.3. submit an application to the State Police (Annex 6).

53. The application referred to in Sub-paragraph 52.3 of this Regulation shall indicate:

53.1. the name and uniform registration number of a legal person;

53.2. the contact details - legal address, telephone number, as well as electronic mail address (if the applicant wishes to receive the permit electronically);

53.3. address of warehouse (store-room) of fireworks and theatrical pyrotechnic articles;

53.4. the given name, surname and personal identification number of the responsible person and the pyrotechnician or date of birth if personal identification number has not been assigned;

53.5. substantiation of the need to purchase, store and use fireworks and theatrical pyrotechnic articles;

53.6. the form of receiving the permit - in printed form or in the form of an electronic document.

54. The following shall be appended to the application referred to in Sub-paragraph 52.3 of this Regulation:

54.1. a copy of the document that confirms the type of activity of the legal person in making films or television broadcasts, producing and showing theatrical performances or organising other art and entertainment events;

54.2. a copy of the document certifying that the legal person owns or possesses the immovable property in which storage of fireworks and theatrical pyrotechnic articles is planned;

54.3. a copy of a security guard contract confirming that the warehouse (store-room) of fireworks and theatrical pyrotechnic articles is equipped with a fire detection and fire alarm system and security alarm system that are connected to the central security control panel of a security guard merchant;

54.4. the plans referred to in Sub-paragraphs 3.1 and 3.2 of this Regulation (if a warehouse has been set up);

54.5. a copy of such decision of the legal person in accordance with which a responsible person has been designated;

54.6. a copy of the employment contract entered into with the responsible person;

54.7. a copy of the employment contract, contract for work performance or other contract entered into with the pyrotechnician regarding performance of the works concerned;

54.8. a copy of the document equivalent to a pyrotechnician's certificate if the pyrotechnician has not received a pyrotechnician's certificate.

55. Upon receipt of the application referred to in Sub-paragraph 52.3 of this Regulation, the State Police shall verify whether all the required information has been indicated therein and all the documents referred to in Paragraph 54 of this Regulation have been appended.

56. If not all of the information referred to in Paragraph 53 of this Regulation has been indicated in the application or not all of the documents referred to in Paragraph 54 of this Regulation have been appended, the State Police shall inform the legal person thereof, determining a time period of not less than five working days for elimination of the deficiencies detected. If the legal person does not submit the requested information or documents within the determined period of time, the State Police shall take a decision to refuse to issue a permit and notify the merchant thereof within three working days, sending the decision taken in accordance with the procedures laid down in the Administrative Procedure Law.

57. After receipt of the application referred to in Sub-paragraph 52.3 of this Regulation and the documents appended thereto the State Police shall:

57.1. within three working days, request the opinions referred to in Sub-paragraphs 15.1.1 and 15.1.2 of this Regulation;

57.2. check whether the pyrotechnician indicated in the application has received a pyrotechnician's certificate, or assess the conformity of the document equivalent to a pyrotechnician's certificate and recognise the professional qualification.

58. The documents referred to in Sub-paragraphs 15.1.1 and 15.1.2 of this Regulation may also be submitted by a legal person together with the application referred to in Sub-paragraph 52.3 of this Regulation. The opinions referred to in Sub-paragraphs 15.1.1 and 15.1.2 of this Regulation shall be valid for submission for 90 days from the day of issue thereof.

59. If additional checking of information is necessary for taking of a decision to issue a permit or to refuse to issue a permit, the licensing committee shall extend the term for taking of the decision in accordance with the procedures laid down in the Administrative Procedure Law, and perform the additional check necessary for taking of the decision, or request the necessary information from the competent authorities.

60. The State Police shall issue a permit within 15 days after performing the checks referred to in Paragraph 57 of this Regulation, if:

60.1. positive opinions referred to in Sub-paragraphs 15.1.1 and 15.1.2 of this Regulation are received;

60.2. the pyrotechnician indicated in the application referred to in Sub-paragraph 52.3 of this Regulation has received a pyrotechnician's certificate or the document equivalent to a pyrotechnician's certificate has been recognised in accordance with the laws and regulations determining the procedures for recognition of professional qualification for permanent professional activity in the Republic of Latvia;

60.3. a legal person is entitled to purchase, store and use Category 4 fireworks and Category T2 theatrical pyrotechnic articles in accordance with the Law On the Circulation of Pyrotechnic Articles.

VII. State Fee for the Issuance of a Special Permit (Licence), Duplicate Thereof and Repeat Special Permit (Licence), Amount of the Fee and Procedures for Payment Thereof

61. The State fee for the issuance of a special permit (licence), a duplicate thereof or a repeat special permit (licence) shall be paid in the following amount:

61.1. for the issuance of a special permit (licence) for the production of fireworks and theatrical pyrotechnic articles - LVL 1000;

61.2. for the issuance of a special permit (licence) for the wholesale trade, retail trade or other type of commercial activity with a certain category of fireworks and theatrical pyrotechnic articles - LVL 1000;

61.3. for the issuance of a special permit (licence) for the seasonal trade of Category 2 fireworks and Category T1 theatrical pyrotechnic articles - LVL 500;

61.4. for the issuance of a special permit (licence) for the provision of pyrotechnic services - LVL 1000;

61.5. for the issuance of a duplicate of a special permit (licence) - LVL 10;

61.6. for the issuance of a repeat special permit (licence) - LVL 10.

62. A merchant who has paid the State fee referred to in Sub-paragraph 61.1, 61.2 or 61.4 of this Regulation and has received a respective special permit (licence) shall pay a State fee for the issuance of the special permit (licence) of another type referred to in Sub-paragraph 61.1, 61.2 or 61.4 of this Regulation in the amount determined for the issuance of a repeat special permit (licence).

63. If an application is submitted and a special permit (licence) is issued in the form of an electronic document, the State fee referred to in Sub-paragraphs 63.1, 61.2, 61.3 and 61.4 of this Regulation shall be paid by applying a coefficient of 0.9.

64. The State fee shall be paid before receipt of a special permit (licence), and the payment shall be performed with the intermediation of such payment institution which has the right to provide payment services within the meaning of the Law On Payment Services and Electronic Money.

65. The State fee shall be paid into the State basic budget.

VIII. Final Provisions

66. If a special permit (licence) and a registration certificate for commercial activities with pyrotechnic articles has been issued prior to the day of coming into force of this Regulation, upon receipt of a termless special permit (licence) of the new type the merchant shall pay a State fee for the issuance of the special permit (licence) in the amount determined for the issuance of a repeat special permit (licence).

67. A merchant shall pay the State fee in the amount determined in Paragraph 66 of this Regulation, if an application for the receipt of a termless special permit (licence) of the new type is submitted not later than 30 days prior to the expiry of the term of validity of the special permit (licence) or registration certificate, but in any case not later than 23 April 2017 if a termless special permit (licence) or registration certificate has been issued.

68. The requirement referred to in Paragraph 4 of this Regulation shall apply from 4 July 2013.
