Procedures for Registering Personal Marks of Performers of Economic Activity for Work with Precious Metal Articles

Issued pursuant to
Section 27, Clause 3 of the law
On Supervision of Official Fineness

1. The Regulation prescribes the procedures for registering the personal marks of such persons who perform economic activity involving precious metals, precious stones and their articles (hereinafter - the performer of economic activity).

2. The performer of economic activity shall choose the image and design of a personal mark and shall submit the sketch of image of the impress of the personal mark (hereinafter - the sketch) and an application for the approval of the sketch to valsts sabiedrība ar ierobežotu atbildību "Latvijas proves birojs" [State limited liability company Assay Office of Latvia] (hereinafter - the Office). The following information shall be indicated in the application:

2.1. the performer of economic activity (firm name or given name and surname of a person);

2.2. registration number and the date of registration in the Commercial Register or a personal identity number.

3. The Office shall not approve the sketch if:

3.1. it includes the names of precious metals (also in foreign languages) or the names of chemical elements thereof;

3.2. it includes Arabic numerals which correspond to a fineness of precious metals used in Latvia or abroad in various fineness systems;

3.3. it is similar to the personal mark of another performer of economic activity, to the mark of Latvian or foreign assay supervisory authorities or to the fineness mark of Latvia or foreign countries.

4. The Office shall, within three working days, check the conformity of the sketch with the requirements referred to in Paragraph 3 of this Regulation and take the decision to approve the sketch or to refuse to approve the sketch, giving the reasons for refusal. The Office shall, within three working days, inform the performer of economic activity of the decision taken.

5. The performer of economic activity shall, within a month after approval of the sketch, submit the following to the Office:

5.1. personal mark;

5.2. [19 November 2019];

5.3. application for registering the personal mark. The following information shall be indicated in the application:

5.3.1. the performer of economic activity (firm name or given name and surname of a person);

5.3.2. registration number and the date of registration in the Commercial Register or a personal identity number;

5.3.3. sketch approval date and number with the Office.

6. The Office shall, within three working days, check the conformity of the personal mark impress with the approved sketch and prepare the personal mark registration certificate. The personal mark registration certificate together with the submitted personal mark shall be received by the performer of economic activity at the Office.

7. The personal mark registration certificate shall not be issued and the personal mark shall not be registered if the impress image thereof does not correspond to the approved sketch. A fee for the service received shall not be repaid to the performer of economic activity.

8. The following information shall be indicated in the personal mark registration certificate:

8.1. the certificate number;

8.2. the performer of economic activity (firm name or given name and surname of a person, registration number in the Commercial Register or personal identity number, date of registration in the Commercial Register);

8.3. the image of impress of the personal mark;

8.4. the date of registration;

8.5. the notes on re-registration of the personal mark;

8.6. the given name, surname, and signature of the official of the Office who has registered or re-registered the personal mark.

9. The personal mark registration certificate shall be approved by the mark of the Office.

10. In order to perform re-registration of the personal mark, the performer of economic activity shall submit the application and the personal mark registration certificate to the Office. The following information shall be indicated in the application:

10.1. the performer of economic activity (firm name or given name and surname of a person);

10.2. registration number and the date of registration in the Commercial Register or a personal identity number;

10.3. registration date and number of the personal mark to be re-registered.

11. The Office shall, within three working days after receipt of the application referred to in Paragraph 10 of this Regulation, make a note in the personal mark registration certificate on the re-registration of the personal mark.

12. If the performer of economic activity combines the image of the impress of the personal mark with a year distinction mark or wishes to change the image of the impress of the personal mark, the mark shall be registered anew in accordance with the procedures specified in this Regulation.

13. The Office shall place the images of registered sketches and impresses of personal marks on its website.

14. Cabinet Regulation No. 366 of 20 August 2002, Procedures for Registering Personal Marks of Makers of Precious Metal Articles (Latvijas Vēstnesis, 2002, No. 119), is repealed.
