Regulations Regarding Registration of Ships in the Latvian Ship Register

I. General Provisions

1. This Regulation prescribes the procedures for maintaining the files of ships of the Latvian Ship Register of the State stock company "Maritime Administration of Latvia" (hereinafter - Maritime Administration) (hereinafter - Latvian Ship Register), the requirements for the information to be entered in the book of the electronic data base (hereinafter - Ship Register), the documents to be submitted to the Latvian Ship Register for the registration, re-registration, exclusion and deletion of ships and ship encumbrances in the Latvian Ship Register, the documents to be issued by the Latvian Ship Register, as well as the amount of information to be included in the extracts from the Ship Register issued by the Latvian Ship Register, the duties of the representative of the shipowner, the minimum scope of powers and the requirements to be set, as well as prescribes which ships shall be considered as ships under construction.

2. Decisions related to the operation of the Latvian Ship Register and determined in the Maritime Code shall be taken and the documents issued by the Latvian Ship Register shall be signed by an official of the Latvian Ship Register (hereinafter - a registrar of ships). A registrar of ships shall have a seal with the image of the lesser State coat of arms of Latvia and the inscription "LATVIJAS KUĢU REĢISTRS" [LATVIAN SHIP REGISTER] in Latvian and English.

II. Procedures for Maintaining the Ship Register and Files of Ships

3. When registering a ship in the Ship Register, a registration number shall be granted to the ship and it shall be entered in the relevant Ship Register Book.

4. The number of the file of a ship shall be the registration number of the ship.

5. The files of ships under construction shall be stored separately in accordance with the succession of registration numbers.

III. Information to be Entered in the Ship Register Books

7. The following information shall be entered in the Ship Register Books referred to in Section 9, Paragraph two, Clauses 1, 2, 5 an 6 of the Maritime Code:

7.1. date of the registration of the ship;

7.2. registration number of the ship;

7.3. name of the ship;

7.4. previous name of the ship;

7.5. number granted by the International Maritime Organization;

7.6. port of registry;

7.7. call sign;

7.8. data regarding shipowner, bareboat charterer or manager;

7.9. ship's technical data.

8. The following shall be entered in the Ship Register Book referred to in Section 9, Paragraph two, Clause 3 of the Maritime Code:

8.1. day and time of registration of encumbrances;

8.2. name and registration number of the ship;

8.3. date and number of debt obligation of the ship;

8.4. data regarding a holder of encumbrance;

8.5. a note regarding cession of a ship mortgage and amendments thereof;

8.6. date and basis for deletion of an encumbrance.

9. The following shall be entered in the Ship Register Book referred to in Section 9, Paragraph two, Clause 4 of the Maritime Code:

9.1. registration date and registration ordinal number of the ship;

9.2. data regarding a ship builder and customer of a ship;

9.3. date of commencement of the ship building and built number;

9.4. the number of the ship building contract and date of entering into it;

9.5. ship's technical data.

IV. Documents to be Submitted to the Latvian Ship Register

10. In order to register the ships referred to in Section 8, Paragraph two, Clause 1, Sub-clause "a", the fishing vessels referred to in Sub-clause "d" and the floating structures referred to in Section 8.¹, Paragraph two of the Maritime Code, an owner or his or her authorised person shall submit the following documents to the Latvian Ship Register:

10.1. an application (Annex 1);

10.2. a copy of the registration certificate of a merchant (only a foreign merchant). A natural person shall present a personal identification document (except the case, if the ship is registered as a service ship of the State). The personal identification document need not be presented if the application is prepared in accordance with the requirements for the drawing up of e-documents and is signed with a safe electronic signature in accordance with the procedures laid down in laws and regulations;

10.3. documents attesting the ownership rights (in accordance with Section 16 of the Maritime Code, except the case if a ship is registered on the basis of a bareboat charter agreement);

10.5. a written consent of the holder of an encumbrance (if any) for registration of the ship in the Ship Register;

10.6. a Report of Survey issued by the Maritime Safety Inspectorate of the Maritime Administration (hereinafter - Maritime Safety Inspectorate) regarding conformity of the technical status and equipment with safety requirements (in accordance with the laws and regulations regarding equipment of sea-going ships and the flag State supervision of ships);

10.7. a copy of tonnage certificate of a ship;

10.8. if the ship has a relevant radio equipment - a copy of ship station permit issued by the State stock company "Electronic Communications"(in accordance with the Electronic Communications Law);

10.9. if the ship conveys more than 2000 tons of oil or oil products - a document regarding civil liability insurance of the shipowner for oil pollution damage (in accordance with the Law on the Denouncing of the International Convention on Civil Liability for Oil Pollution Damage);

10.9.¹ if the gross tonnage of the ship exceeds 1000, - a document regarding civil liability insurance of the shipowner for bunker oil pollution damage (in accordance with the Law On the International Convention on Civil Liability for Bunker Oil Pollution Damage);

10.10. if the ship has been registered in a foreign state previously - a document regarding deletion from the previous ship register or document similar thereto in which the shipowner at the time of deletion is specified (Certificate of Deletion);

10.11. if the ship is subject to the requirements of the International Ship and Port Facility Security Code - a copy of Continuous Synopsis Record issued by the previous ship register in which the date of deletion is specified;

10.12. if the ship is subject to the requirements of the International Management Code for the Safe Operation of Ships and for Pollution Prevention (hereinafter - the ISM Code), - a copy of the Document of Compliance to the person who carries out the technical operation of the ship;

10.13. if the ship is registered on the basis of bareboat charter agreement - a permit issued by the register of the state of initial registry in which the shipowner is specified. The Latvian Ship Register shall inform the register of the state of initial (underlaying) registry of the ship regarding the registration of the ship in the bareboat registry book of the Ship Register;

10.14. a written consent of the Ministry of Agriculture for the registration of a fishing vessel (in accordance with laws and regulations regarding commercial fishing in territorial waters and economic zone waters);

10.15. if the ship carries more than 12 passengers - a document regarding insurance or other financial security in respect of the carrier's liability for the death and personal injury to passengers in accordance with the Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the liability of carriers of passengers by sea in the event of accidents;

10.16. a bareboat charter agreement and a protocol of delivery and acceptance of a ship, if the ship is registered on the basis of a bareboat charter agreement;

10.17. a copy of the management agreement, if the ship is subject to the requirements of the ISM Code.

10.¹ In order to register the floating structures referred to in Section 8.¹, Paragraph three and the fixed installations referred to in Section 29, Paragraph two of the Maritime Code, the owner or his or her authorised person shall submit the following documents to the Latvian Ship Register:

10.¹ 1. an application (Annex 1);

10.¹ 2. a copy of the registration certificate of a merchant. A natural person shall present a personal identification document;

10.¹ 3. documents attesting the ownership rights in accordance with Section 16 of the Maritime Code;

10.¹ 4. a certificate issued by the Maritime Safety Inspectorate, in which the technical data and equipment of the floating structure or the fixed installation are indicated.

11. In order to register the ships referred to in Section 8, Paragraph two, Clause 1, Sub-clause "b" or the fixed installations referred to in Section 29, Paragraph one of the Maritime Code, a ship builder or his or her authorised person shall, upon commencement of the ship building or entering into an agreement regarding ship building, submit an application (Annex 3) to the Latvian Ship Register and the Report of Survey issued by the Maritime Safety Inspectorate which approves the commencement of ship building (in accordance with the laws and regulations regarding maritime administration and marine safety). A recreational craft and fishing boat under construction shall not be registered.

12. In order to register the recreational craft referred to in Section 8, Paragraph two, Clause 1, Sub-clause "c" of the Maritime Code, a shipowner or his or her authorised person shall submit the following documents to the Latvian Ship Register:

12.1. an application (Annex 4) where the intended purpose of use of the recreational craft is specified;

12.2. a copy of the registration certificate of a merchant (only a foreign merchant).A natural person shall present a personal identification document. The personal identification document need not be presented if the application is prepared in accordance with the requirements for the drawing up of e-documents and is signed with a safe electronic signature in accordance with the procedures laid down in laws and regulations;

12.3. documents attesting ownership rights in accordance with Section 16 of the Maritime Code, except if the ship is registered on the basis of a bareboat charter agreement;

12.5. a written consent of the holder of an encumbrance (if any) for registration of a recreational craft in the Ship Register;

12.6. if a recreational craft is not intended for commercial use - a Report of Survey issued by the Maritime Safety Inspectorate in which the type of means of navigation, technical data and sailing area category are specified. If the owner has specified in the application for registration, that a recreational craft is intended for commercial use, he or she shall submit a Report of Survey regarding conformity of the technical state and equipment with the laws and regulations regarding construction, conformity assessment and placing on the market of recreational craft issued by the Maritime Safety Inspectorate or a recognised classification society;

12.7. if a recreational craft has a relevant radio equipment - a copy of the ship station permit issued by the State stock company "Electronic Communications" (in accordance with the Electronic Communications Law);

12.8. if a recreational craft has been registered in a foreign state previously - a document regarding deletion from the previous ship register or a document similar thereto in which the owner of the recreational craft at the time of deletion is specified;

12.8.¹ if a recreational craft has not been previously registered - a confirmation of the seller (previous owner) (Annex 23) of a non-existence of the registration and encumbrances;

12.9. if a ship is registered on the basis of a bareboat charter agreement - the permit issued by the register of the state of initial registry in which an owner of the recreational craft is specified. The Latvian Ship Register shall inform the register of the state of initial (underlaying) registry of the recreational craft regarding the registration of the recreational craft in the bareboat registry book of the Ship Register;

12.10. if a recreational craft carries more than 12 passengers for commercial purposes- a document regarding insurance or other financial security in respect of the carrier's liability for the death and personal injury to passengers in accordance with the Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the liability of carriers of passengers by sea in the event of accidents;

12.11. bareboat charter agreement and a protocol of delivery and acceptance of a ship, if the ship is being registered on the basis of a bareboat charter agreement.

13. In registering a recreational craft in the Ship Register, a document approving the purchase with requisites of a seller and buyer shall also be recognised as a document attesting the ownership, if the recreational craft is purchased from a builder or recreational craft trade company.

14. A self-built recreational craft shall be registered in the Ship Register provided that the documents attesting that construction is supervised by a recognised classification society or Maritime Safety Inspectorate in conformity with the laws and regulations regarding technical supervision of ships and a certificate of the ship building issued by a builder of the ship are submitted to the Latvian Ship Register.

15. In order to register a fishing boat, the owner of the fishing boat or his or her authorised representative shall submit the following documents to the Latvian Ship Register:

15.1. an application (Annex 5);

15.2. a copy of the registration certificate of a merchant (only a foreign merchant). A natural person shall present a personal identification document. The personal identification document need not be presented if the application is prepared in accordance with the requirements for the drawing up of e-documents and is signed with a safe electronic signature in accordance with the procedures laid down in laws and regulations;

15.3. a document attesting the ownership rights (in accordance with Section 16 of the Maritime Code);

15.4. a written consent of the holder of an encumbrance (if any) for the registration of the ship in the Ship Register;

15.5. a Report of Survey issued by the Maritime Safety Inspectorate regarding conformity of the technical status and equipment with the safety requirements (in accordance with laws and regulations regarding equipment of sea-going ships);

15.6. if the fishing boat has been registered in a foreign state previously - a document regarding deletion from the previous ship register or a document similar thereto in which the owner of the fishing boat at the time of deletion is specified;

15.7. a written consent of the Ministry of Agriculture for the registration of the fishing boat (in accordance with the laws and regulations regarding commercial fishing in territorial waters and economic zone waters).

16. If in accordance with the requirements laid down in Sub-paragraphs 10.3, 10.¹ 3, 12.3 and 15.3 of this Regulation a purchase agreement or a bill of sale accepted in the international maritime practice (Bill of Sale), which is equal thereto, is submitted as one of the documents attesting the ownership rights, the authenticity of the signatures of the contracting parties thereto shall be notarially certified.

17. If in accordance with the requirements laid down in this Regulation the bareboat charter agreement referred to in Sub-paragraphs 10.16, 12.11 of this Regulation or the confirmation referred to in Sub-paragraph 12.8.¹ of this Regulation is submitted, the authenticity of the signatures of the contracting parties thereto shall be notarially certified.

18. In order to register the change of ownership rights of a ship, a floating structure or fixed installations registered in the Ship Register, as well as the change of parties who entered into a bareboat charter agreement, all the ship, floating structure or fixed installations registration documents laid down in this Regulations shall be submitted to the Latvian Ship Register. In order to register the change of parties who entered into a management agreement, the documents referred to in Sub-paragraphs 10.1, 10.17 and 10.12 shall be submitted.

18.¹ In order to register a ship in a joint property, the written agreement of all joint owners referred to in Section 16, Paragraph 3.¹ of the Maritime Code with a notarial certification of the authenticity of the signatures of the parties shall be submitted to the Latvian Ship Register.

19. In order to register the change of ownership rights of the fishing boat and recreational craft or the change of bareboat charterer of a recreational craft in the Ship Register, if the previous and new owner or bareboat charterer is a natural person and the re-registration is taking place in the presence of the ship registrar, the following documents shall be submitted to the Latvian Ship Register presenting a personal identification document:

19.1. an application for re-registration which is signed by both parties;

19.2. an application (Annex 4 or 5 respectively);

19.4. a Protocol of Delivery which is signed by both parties;

19.5. a written consent of the holder of an encumbrance (if any) for re-registration;

19.6. a written consent of the Ministry of Agriculture for the change of owner in the case of change of ownership rights of the fishing boat (in accordance with the laws and regulations regarding commercial fishing in territorial waters and economic zone waters);

19.7. if the fishing boat or the recreational craft is in a joint property - a written agreement of all joint owners on the re-registration with a notarial certification of the authenticity of the signatures.

20. If a ship is deleted from the Ship Register in accordance with Section 12, Paragraph one of the Maritime Code, the shipowner shall submit the following documents to the Latvian Ship Register:

20.1. an application indicating the reason for deletion. If the Certificate of Ownership has been issued for the ship in accordance with Sub-paragraph 34.1 of this Regulation, the application shall be drawn up in accordance with the notarial deed procedures. If the ship is owned by one natural person, it is not necessary to draw up the application in accordance with the notarial deed procedures. If the application has been drawn up in a country, in which the national laws and regulations do not prescribe drawing up of documents in the form of a notarial deed, the notary shall certify the legal capacity, the capacity to act, the scope of activity and the powers of representatives;

20.2. a written consent of the holder of an encumbrance (if any) for deletion of a ship;

20.3. original certificates issued by the Latvian Ship Register or, if none, a notification that the certificates are invalid, shall be published in the official gazette Latvijas Vēstnesis.

20.4. a copy of an agreement, if a ship is sold;

20.5. a statement issued by the State stock company "Electronic Communications" that the call sign (if any has been granted) is removed from the ship.

21. A ship which is registered on the basis of a bareboat charter agreement shall be deleted from the Ship Register:

21.1. after expiry of the term of validity of the bareboat charter agreement and expiry of the term of validity of the validity of the registration certificate issued on the basis thereof;

21.2. upon request of the state of initial registry;

21.3. on the basis of a written request of the shipowner or ship charterer of a bareboat;

22. Deleting a ship from the Ship Register, which is registered on the basis of a bareboat charter agreement, the Latvian Ship Register shall notify the register of the state of initial registry of the ship regarding the fact of deletion of the ship.

24. After settlement of liabilities provided for in the Maritime Code, the Latvian Ship Register shall issue a Certificate of Deletion to a shipowner (Annex 6).

25. In order to register a debt obligation of a ship in the register book referred to in Section 9, Paragraph two, Clause 3 of the Maritime Code, one of the persons, who has signed a debt obligation of the ship, shall submit the following documents to the Latvian Ship Register:

25.1. the debt obligation of the ship (Annex 7) with a notarial certification of authenticity of signatures of the parties;

25.2. if the ship has several owners - a notarially certified consent of all the owners of the relevant ship for the registration of the ship's mortgage;

25.3. if a ship under construction is pledged - a confirmation of the builder that the ship is being built on account of the builder, or a confirmation of the commissioning party that the ship is being built on account of the commissioning party, or an agreement of the builder and the commissioning party on pledging of a ship under construction, in which the person is indicated, who will enter into the debt obligation of the ship.

26. Debt obligations of a ship shall be entered in the registry book of ship encumbrances in the succession of submission thereof. A note regarding registration shall be made and the day and time when the entry is made shall be indicated on each copy of the debt obligation.

27. A ship's mortgage shall be renewed, if:

27.1. the legal basis for the secured commitment or claim priority is amended;

27.2. the amount of secured claim is enlarged;

27.3. change of a mortgage creditor or debtor (mortgagee or mortgager) occurs.

28. In order to renew a ship mortgage, one of the persons, who has signed the contract of novation, shall submit an application to the Latvian Ship Register for registration of the novation of a ship mortgage (Annex 8) with a notarial certification of authenticity of the signatures of the parties.

29. Provisions for a ship mortgage (except for the provisions referred to in Paragraph 28 of this Regulation) may be amended without renewal of a ship mortgage.

30. In order to register amendments to a ship mortgage, an application for the registration of amendments to a ship mortgage (Annex 9) with a notarial certification of authenticity of signatures of the parties shall be submitted to the Latvian Ship Register.

31. In order to assign a ship mortgage (the right of claim arising from the ship mortgage), one of the persons, who has signed a cession agreement, shall submit an application to the Latvian Ship Register for the registration of cession of the ship mortgage (Annex 10) with a notarial certification of authenticity of the signatures of the parties.

32. In order to delete a ship mortgage, an application of the mortgage creditor (mortgagee) of the ship regarding deletion of the mortgage drawn up in accordance with the notarial deed procedures shall be submitted to the Latvian Ship Register. Such notarial deed shall not have the nature of permanent commitment. In case of novation of the ship mortgage, the ship mortgage being renewed shall be deleted at the time of registration of the renewed ship mortgage without the application from a mortgage creditor (mortgagee) regarding deletion of the mortgage.

IV.¹ Representative of the Shipowner

32.¹ The representative of the shipowner referred to in Section 16, Paragraph four of the Maritime Code may be a legal person registered in Latvia (for example, a merchant, an association, a co-operative partnership), as well as a citizen of Latvia, a non-citizen of Latvia or a person who has received a residence permit in Latvia, a registration certificate or a permanent residence permit, whose declared place of residence is in the Republic of Latvia and who has submitted to the Latvian Ship Register a respective authorisation of the shipowner. The authenticity of the signature of the authoriser shall be notarially certified.

32.² The representative of the shipowner shall perform duties of the shipowner laid down in this Regulation, represent the shipowner in communication with the Maritime Administration, ensuring that the duties determined by the flag State of the ship are performed, including a timely periodic approval of the documents required for the ship, carrying out of the technical examination of the ship and making of the payments determined for the ship, timely informing the shipowner regarding the claims of financial nature or non-financial nature, which are directed towards the ship or its owner.

V. Issue of Ship Registration Documents

33. A ship registrar shall assess within a month's time the submitted documents and take a decision regarding ship registration or refusal for ship registration, as well as other decisions related to the activities of the Latvian Ship Register laid down in the Maritime Code. A decision of the ship registrar may be appealed in accordance with the procedures laid down in the Maritime Administration and Maritime Safety Law.

34. If a decision on ship registration or re-registration is taken after the payments related to and determined for the ship registration (in accordance with the Maritime Code) are made, the Latvian Ship Register shall issue:

34.1. a Certificate of Ownership (Annex 11) for a shipowner who has submitted a document to the Latvian Ship Register which attests the ownership rights in accordance with Section 16 of the Maritime Code. The time and substantiation for the acquisition of a property, registration and deletion of mortgages, as well as - in respect of fishing vessels - the registered agreements of lease shall be entered in such certificate;

34.2. a Certificate of Registry (Annex 12), if the ships (except for recreational craft and fishing boats) of the owner referred to in Sub-paragraph 34.1 of this Regulation are registered;

34.3. [30 July 2013];

34.4. a Certificate of Registry (Annex 14), if the ships (except for fishing boats) are registered on the basis of a bareboat charter agreement;

34.5. a Certificate of Registry (Annex 15), if recreational ships are registered;

34.6. a Certificate of Registry (Annex 16), if fishing boats are registered;

34.9. a Certificate of Insurance or other financial security in respect of civil liability for oil pollution damage (Annex 19), if a ship complies with the conditions referred to in Sub-paragraph 10.9 of this Regulation;

34.9.¹ a Certificate of Insurance or other financial security in respect of civil liability for bunker oil pollution damage (Annex 21), if a ship complies with the condition referred to in Sub-paragraph 10.9.¹ of this Regulation;

34.10. the Continuous Synopsis Record (Annex 20), if a ship is subject to the requirements of the International Ship and Port Facility Security Code.

34.11. a Certificate of Insurance or Other Financial Security in Respect of Liability for a Case of the Death and Personal Injury to Passengers (Annex 22), if the ship conforms to the conditions referred to in Sub-paragraph 10.15 or 12.10 of this Regulation.

34.¹ An extract from the Ship Register shall be issued only regarding ships, which are registered in the Ship Register. A separate extract shall be issued for each ship. In the extract the following data shall be included:

34.¹ 1. the nationality marking and name of the ship;

34.¹ 2. the first and last date of the registration of the ship;

34.¹ 3. the registered ownership rights;

34.¹ 4. the registered encumbrances;

34.¹ 5. technical data of the ship (length, width, water displacement, hull identification number, gross tonnage, net tonnage, type of the engines, model, amount, power and numbers).

35. The maximum term of validity of certificates issued by the Latvian Ship Register shall be:

35.1. for a Certificate of Registry - two years (except a Certificate of Registry of a recreational craft, the term of validity of which is five years, and for a Certificate of Registry of a cargo and passenger ship with the gross tonnage of 500 or more, which is non-term);

35.2. for a Certificate of Registry, if the ship is registered on the basis of a bareboat charter agreement - the term of validity of the bareboat charter agreement;

35.5. for a Certificate of Ownership - non-term.

36. If a recreational craft is intended for commercial use, a note "Paredzēts izmantot komercdarbībai" [Intended for commercial use] shall be entered in the Certificate of Registry.

VI. Issue of Duplicates

37. The Latvian Ship Register shall issue duplicates of documents, if:

37.1. the documents issued have perished during an accident at sea or otherwise and such fact is approved by the opinion of the investigation commission of the accident; or

37.2. the documents issued have been lost, stolen or irrevocably damaged.

38. A shipowner shall submit a relevant submission and notification published in the newspaper Latvijas Vēstnesis that the documents lost are to be considered as invalid to the Latvian Ship Register in cases referred to in Paragraph 37 of this Regulation. The notification shall indicate:

38.1. the name of the ship;

38.2. the name of each lost document;

38.3. time, number of issue of the document and the person to whom the document is issued;

38.4. the issuer of the document;

38.5. date from which the lost document shall be considered as invalid.

VII. Registration of Latvian Ships in the Bareboat Register of Ships of a Foreign State

39. A ship of Latvia may be registered in the Ship Register of a foreign state on the basis of a bareboat charter agreement, if it is provided for in the laws and regulations of the relevant state and a permit of the Latvian Ship Register has been received.

40. In order to receive a permit for the registration of a ship of Latvia in the bareboat register of ships of a foreign state, the shipowner shall submit the following documents to the Latvian Ship Register:

40.1. a submission for the receipt of the permit;

40.2. written consent of the foreign state for the bareboat registration;

40.3. a bareboat charter agreement or notarially certified copy thereof;

40.4. a written consent of the holder of an encumbrance (if any);

40.5. certificates of the ship issued by the Latvian Ship Register.

41. A permit for the registration of a ship of Latvia in the bareboat register of ships of a foreign state is issued for a time period up to two years with a possibility to extend the term of validity thereof. During the period of time while the ship of Latvia is registered in the bareboat register of a foreign state it shall not be entitled to use the flag of Latvia and other signs of nationality of Latvia.

42. If the ship of Latvia is deleted from the bareboat register of a foreign state, the shipowner shall submit a document to the Latvian Ship Register which approves deletion of the ship from the bareboat register of the foreign state.

VIII. Ship under Construction

43. A ship under construction shall be:

43.1. a ship for which a keel is laid and construction work have been commenced;

43.2. a ship the assembly weight of which is at least 50 tons or covers at least 1% of all the mass of the intended construction material (depending which is the lesser of them).

IX. Closing Provisions

44. Ships, which have been registered in the Ship Register before the day of entering into force of this Regulation, shall keep the issued registration documents until 31 December 2007.

45. Until 1 July 2007 the former Ship Register Books shall be changed in accordance with the amendments of 22 December 2005 in the Maritime Code and Annexes to this Regulation.

46. Paragraph 14 of this Regulation shall come into force on 1 July 2007. Until 30 June 2007 self-made recreational craft shall be registered provided that the document referred to in Sub-paragraph 12.6 of this Regulation is submitted to the Latvian Ship Register.

47. Sub-paragraph s10.15 and 12.10 of this Regulation regarding class A passenger ships shall be applicable from 31 December 2016, but regarding class B passenger ships from 31 December 2018.

48. The Certificate of Registry, which is issued to a recreational craft after 29 June 2006, shall be valid until expiry of the term of validity indicated therein.

49. Joint owners of the ships, which have been registered until 21 January 2013, shall submit the agreement laid down in Paragraph 18.¹ of this Regulation to the Latvian Ship Register until 1 January 2014. Until the referred-to agreement is submitted, the Latvian Ship Register shall not carry out any activities in relation to the ship in joint ownership, the floating structure or the fixed installations.

3. OBLIGĀCIJAS NOTEIKUMI/CONDITIONS OF THIS DEBT OBLIGATION

3.1. Lai reģistrētu kuģa obligāciju Latvijas Kuģu reģistra apgrūtinājumu reģistra grāmatā, viena no personām, kas parakstījusi kuģa obligāciju, Latvijas Kuģu reģistrā iesniedz kuģa obligāciju ar pušu parakstu īstuma notariālu apliecinājumu./One of the Parties, who has signed this Debt Obligation, shall submit the Debt Obligation with notarised confirmation of the Parties signatures on it in the Latvian Ship Register for registration of the Debt Obligation in the Ship Mortgages Book of the Latvian Ship Register.

3.2. Obligācija stājas spēkā un kļūst par kuģa hipotēku ar tās reģistrācijas brīdi Latvijas Kuģu reģistra kuģu apgrūtinājumu reģistra grāmatā./This Debt Obligation shall come into effect and shall become the Ship Mortgage as of the time of its registration in the Ship Mortgages Book of the Latvian Ship Register.

3.3. Kuģa hipotekāro kreditoru prioritāti nosaka obligācijas reģistrācijas secība kuģu apgrūtinājumu reģistra grāmatā. Prasījuma tiesību pāreja vai maiņa neietekmē kuģa hipotēkas prioritāti./The order of the priority of the Ship Mortgage is prescribed in accordance with the Debt Obligation registration order in the Ship Mortgages Book. Transfer of or change in the right of claim shall not affect priority of the Ship Mortgage.

3.4. Viens šīs obligācijas eksemplārs tiek iesniegts Latvijas Kuģu reģistrā glabāšanai kuģa lietā./One copy of this Debt Obligation shall be submitted in the Latvian Ship Register for keeping in the file of the ship.

3.5. Ja šīs obligācijas 2.punkta 3.daļā ietveramie "Citi noteikumi" pārsniedz obligācijas veidlapā atvēlēto apjomu, tos pievieno kuģa obligācijai kā atsevišķu pielikumu bez izmaiņu veikšanas veidlapas izkārtojumā. /If the "other provisions" set in paragraph 2.3 are too voluminous for the allocated size they may be attached to the Debt Obligation as addendum without changing the layout of form of the Debt obligation.

1. NOTEIKUMI/PROVISIONS

1.1. Kuģa hipotēka ir pārjaunojama, ja tiek grozīts nodrošinātās saistības tiesiskais pamats, prasījuma prioritāte, palielināts nodrošinātā prasījuma apmērs, notiek hipotekārā kreditora vai debitora maiņa, kā arī citos gadījumos pēc pušu ieskata./A ship mortgage shall be renewed, if the legal basis for a secured commitment or claim priority is amended, the amount of a secured claim is enlarged, change of mortgage creditor or debtor occurs, as well as in other cases upon discretion of the parties.

1.2. Kuģa hipotēkas pārjaunojuma gadījumā kuģa hipotēka, kura tiek pārjaunota, tiek dzēsta pārjaunotās kuģa hipotēkas reģistrācijas brīdī bez hipotekārā kreditora iesnieguma par hipotēkas dzēšanu./In case of novation of a ship mortgage, the ship mortgage being renewed shall be deleted at the time of registration of the renewed ship mortgage without an application from a mortgage creditor regarding deletion of the mortgage.

1.3. Lai pārjaunotu kuģa hipotēku, viena no personām, kas parakstījusi pārjaunojuma līgumu, Latvijas Kuģu reģistrā iesniedz iesniegumu par kuģa hipotēkas pārjaunojuma reģistrēšanu ar pušu parakstu īstuma notariālu apliecinājumu./In order to renew a ship mortgage, one of the persons, who has signed the contract of novation, shall submit an application to the Latvian Ship Register regarding registration of the novation of the ship mortgage with a notarial certification of authenticity of the signatures of the parties.

1.4. Iesnieguma kuģa hipotēkas pārjaunojuma reģistrācijai viens eksemplārs ir iesniedzams Latvijas Kuģu reģistrā glabāšanai kuģa lietā./One copy of the application for registration of the novation of a ship mortgage shall be submitted to the Latvian Ship Register for storage in the ship file.

Kuģa hipotēkas grozījumus reģistrē Latvijas Kuģu reģistrā, pamatojoties uz iesniegumu par grozījumu reģistrēšanu kuģa hipotēkā ar pušu parakstu īstuma notariālu apliecinājumu, ko iesniedz viena no personām, kas parakstījusi šo iesniegumu./Amendments to a ship mortgage shall be registered in the Latvian Ship Register on the basis of the application regarding registration of amendments to a ship mortgage with a notarial certification of authenticity of the signatures of the parties which is submitted by one of the persons, who has signed such application.

2.2. Kuģu apgrūtinājumu reģistra grāmatā reģistrē izdarītos kuģa hipotēkas grozījumus./Amendments made to a ship mortgage shall be registered in the Ship Mortgages Book.

2.3. Grozot nodrošinātās saistības tiesisko pamatu, prasījuma prioritāti, palielinot nodrošinātā prasījuma apmēru, kā arī notiekot hipotekārā kreditora vai debitora maiņai, kuģa hipotēka ir pārjaunojama atbilstoši noteikumiem par hipotēkas pārjaunošanu./In amending the legal basis for a secured commitment, claim priority, enlarging the amount of a secured claim, as well as in case of change of a mortgage creditor or debtor, a ship mortgage shall be renewed in compliance with provisions regarding renewal of a mortgage.
