1.pants. 1979.gada 12.aprīļa Līgums par tirdzniecību ar civilajiem gaisa kuģiem (turpmāk — Līgums) un 2001.gada 6.jūnija Protokols par grozījumiem Līguma par tirdzniecību ar civilajiem gaisa kuģiem pielikumā (turpmāk — Protokols) ar šo likumu tiek pieņemti un apstiprināti. 2
2.pants. Ekonomikas ministrija koordinē Līgumā un Protokolā paredzēto saistību izpildi. 3
3.pants. Līgums stājas spēkā tā 9.3.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis". 4
4.pants. Protokols stājas spēkā tā 3.punktā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis". 5

AGREEMENT ON TRADE IN CIVIL AIRCRAFT PREAMBLE Signatories1 to the Agreement on Trade in Civil Aircraft, hereinafter referred to as "this Agreement"; Noting that Ministers on 12-14 September 1973 agreed the Tokyo Round of Multilateral Trade Negotiations should achieve the expansion and ever-greater liberalization of world trade through, inter alia, the progressive dismantling of obstacles to trade and the improvement of the international framework for the conduct of world trade; Desiring to achieve maximum freedom of world trade in civil aircraft, parts and related equipment, including elimination of duties, and to the fullest extent possible, the reduction or elimination of trade restricting or distorting effects; Desiring to encourage the continued technological development of the aeronautical industry on a world-wide basis; Desiring to provide fair and equal competitive opportunities for their civil aircraft activities and for their producers to participate in the expansion of the world civil aircraft market; Being mindful of the importance in the civil aircraft sector of their overall mutual economic and trade interests; Recognizing that many Signatories view the aircraft sector as a particularly important component of economic and industrial policy; Seeking to eliminate adverse effects on trade in civil aircraft resulting from governmental support in civil aircraft development, production, and marketing while recognizing that such governmental support, of itself, would not be deemed a distortion of trade; Desiring that their civil aircraft activities operate on a commercially competitive basis, and recognizing that government-industry relationships differ widely among them; Recognizing their obligations and rights under the General Agreement on Tariffs and Trade, hereinafter referred to as "the GATT", and under other multilateral agreements negotiated under the auspices of the GATT; Recognizing the need to provide for international notification, consultation, surveillance and dispute settlement procedures with a view to ensuring a fair, prompt and effective enforcement of the provisions of this Agreement and to maintain the balance of rights and obligations among them; Desiring to establish an international framework governing conduct of trade in civil aircraft; Hereby agree as follows: Article 1 Product Coverage 1.1 This Agreement applies to the following products: (a) all civil aircraft, (b) all civil aircraft engines and their parts and components, (c) all other parts, components, and sub-assemblies of civil aircraft, (d) all ground flight simulators and their parts and components, whether used as original or replacement equipment in the manufacture, repair, maintenance, rebuilding, modification or conversion of civil aircraft. 1.2 For the purposes of this Agreement "civil aircraft" means (a) all aircraft other than military aircraft and (b) all other products set out in Article 1.1 above. ___________________________________________________________ 1 The term "Signatories" is hereinafter used to mean Parties to this Agreement. Article 2 Customs Duties and Other Charges 2.1 Signatories agree: 2.1.1 to eliminate by 1 January 1980, or by the date of entry into force of this Agreement, all customs duties and other charges1 of any kind levied on, or in connection with, the importation of products, classified for customs purposes under their respective tariff headings listed in the Annex, if such products are for use in a civil aircraft and incorporation therein, in the course of its manufacture, repair, maintenance, rebuilding, modification or conversion; 2.1.2 to eliminate by 1 January 1980, or by the date of entry into force of this Agreement, all customs duties and other charges1 of any kind levied on repairs on civil aircraft; 2.1.3 to incorporate in their respective GATT Schedules by 1 January 1980, or by the date of entry into force of this Agreement, duty-free or duty-exempt treatment for all products covered by Article 2.1.1 above and for all repairs covered by Article 2.1.2 above. 2.2 Each Signatory shall: (a) adopt or adapt an end-use system of customs administration to give effect to its obligations under Article 2.1 above; (b) ensure that its end-use system provides duty-free or duty-exempt treatment that is comparable to the treatment provided by other Signatories and is not an impediment to trade; and (c) inform other Signatories of its procedures for administering the end-use system. _______________________________________ 1 "Other charges" shall have the same meaning as in Article II of the GATT. Article 3 Technical Barriers to Trade 3.1 Signatories note that the provisions of the Agreement on Technical Barriers to Trade apply to trade in civil aircraft. In addition, Signatories agree that civil aircraft certification requirements and specifications on operating and maintenance procedures shall be governed, as between Signatories, by the Provisions of the Agreement on Technical Barriers to Trade. Article 4 Government-Directed Procurement, Mandatory Sub-Contracts and Inducements 4.1 Purchasers of civil aircraft should be free to select suppliers on the basis of commercial and technological factors. 4.2 Signatories shall not require airlines, aircraft manufacturers, or other entities engaged in the purchase of civil aircraft, nor exert unreasonable pressure on them, to procure civil aircraft from any particular source, which would create discrimination against suppliers from any Signatory. 4.3 Signatories agree that the purchase of products covered by this Agreement should be made only on a competitive price, quality and delivery basis. In conjunction with the approval or awarding of procurement contracts for products covered by this Agreement a Signatory may, however, require that its qualified firms be provided with access to business opportunities on a competitive basis and on terms no less favourable than those available to the qualified firms of other Signatories1. 4.4 Signatories agree to avoid attaching inducements of any kind to the sale or purchase of civil aircraft from any particular source which would create discrimination against suppliers from any Signatory. ________________________________________ 1 Use of the phrase "access to business opportunities ... on terms no less favourable ..." does not mean that the amount of contracts awarded to the qualified firms of one Signatory entitles the qualified firms of other Signatories to contracts of a similar amount. Article 5 Trade Restrictions 5.1 Signatories shall not apply quantitative restrictions (import quotas) or import licensing requirements to restrict imports of civil aircraft in a manner inconsistent with applicable provisions of the GATT. This does not preclude import monitoring or licensing systems consistent with the GATT. 5.2 Signatories shall not apply quantitative restrictions or export licensing or other similar requirements to restrict, for commercial or competitive reasons, exports of civil aircraft to other Signatories in a manner inconsistent with applicable provisions of the GATT. Article 6 Government Support, Export Credits, and Aircraft Marketing 6.1 Signatories note that the provisions of the Agreement on Interpretation and Application of Articles VI, XVI and XXIII of the General Agreement on Tariffs and Trade (Agreement on Subsidies and Countervailing Measures) apply to trade in civil aircraft. They affirm that in their participation in, or support of, civil aircraft programmes they shall seek to avoid adverse effects on trade in civil aircraft in the sense of Articles 8.3 and 8.4 of the Agreement on Subsidies and Countervailing Measures. They also shall take into account the special factors which apply in the aircraft sector, in particular the widespread governmental support in this area, their international economic interests, and the desire of producers of all Signatories to participate in the expansion of the world civil aircraft market. 6.2 Signatories agree that pricing of civil aircraft should be based on a reasonable expectation of recoupment of all costs, including non-recurring programme costs, identifiable and pro-rated costs of military research and development on aircraft, components, and systems that are subsequently applied to the production of such civil aircraft, average production costs, and financial costs. Article 7 Regional and Local Governments 7.1 In addition to their other obligations under this Agreement, Signatories agree not to require or encourage, directly or indirectly, regional and local governments and authorities, non-governmental bodies, and other bodies to take action inconsistent with provisions of this Agreement. Article 8 Surveillance, Review, Consultation and Dispute Settlement 8.1 There shall be established a Committee on Trade in Civil Aircraft (hereinafter referred to as "the Committee") composed of representatives of all Signatories. The Committee shall elect its own Chairman. It shall meet as necessary, but not less than once a year, for the purpose of affording Signatories the opportunity to consult on any matters relating to the operation of this Agreement, including developments in the civil aircraft industry, to determine whether amendments are required to ensure continuance of free and undistorted trade, to examine any matter for which it has not been possible to find a satisfactory solution through bilateral consultations, and to carry out such responsibilities as are assigned to it under this Agreement, or by the Signatories. 8.2 The Committee shall review annually the implementation and operation of this Agreement taking into account the objectives thereof. The Committee shall annually inform the CONTRACTING PARTIES to the GATT of developments during the period covered by such review. 8.3 Not later than the end of the third year from the entry into force of this Agreement and periodically thereafter, Signatories shall undertake further negotiations, with a view to broadening and improving this Agreement on the basis of mutual reciprocity. 8.4 The Committee may establish such subsidiary bodies as may be appropriate to keep under regular review the application of this Agreement to ensure a continuing balance of mutual advantages. In particular, it shall establish an appropriate subsidiary body in order to ensure a continuing balance of mutual advantages, reciprocity and equivalent results with regard to the implementation of the provisions of Article2 above related to product coverage, the end-use systems, customs duties and other charges. 8.5 Each Signatory shall afford sympathetic consideration to and adequate opportunity for prompt consultation regarding representations made by another Signatory with respect to any matter affecting the operation of this Agreement. 8.6 Signatories recognize the desirability of consultations with other Signatories in the Committee in order to seek a mutually acceptable solution prior to the initiation of an investigation to determine the existence, degree and effect of any alleged subsidy. In those exceptional circumstances in which no consultations occur before such domestic procedures are initiated, Signatories shall notify the Committee immediately of initiation of such procedures and enter into simultaneous consultations to seek a mutually agreed solution that would obviate the need for countervailing measures. 8.7 Should a Signatory consider that its trade interests in civil aircraft manufacture, repair, maintenance, rebuilding, modification or conversion have been or are likely to be adversely affected by any action by another Signatory, it may request review of the matter by the Committee. Upon such a request, the Committee shall convene within thirty days and shall review the matter as quickly as possible with a view to resolving the issues involved as promptly as possible and in particular prior to final resolution of these issues elsewhere. In this connection the Committee may issue such rulings or recommendations as may be appropriate. Such review shall be without prejudice to the rights of Signatories under the GATT or under instruments multilaterally negotiated under the auspices of the GATT, as they affect trade in civil aircraft. For the purposes of aiding consideration of the issues involved, under the GATT and such instruments, the Committee may provide such technical assistance as may be appropriate. 8.8 Signatories agree that, with respect to any dispute related to a matter covered by this Agreement, but not covered by other instruments multilaterally negotiated under the auspices of the GATT, the provisions of Articles XXII and XXIII of the General Agreement and the provisions of the Understanding related to Notification, Consultation, Dispute Settlement and Surveillance shall be applied, mutatis mutandis, by the Signatories and the Committee for the purposes of seeking settlement of such dispute. These procedures shall also be applied for the settlement of any dispute related to a matter covered by this Agreement and by another instrument multilaterally negotiated under the auspices of the GATT, should the parties to the dispute so agree. Article 9 Final Provisions 9.1 Acceptance and Accession 9.1.1 This Agreement shall be open for acceptance by signature or otherwise by governments contracting parties to the GATT and by the European Economic Community. 9.1.2 This Agreement shall be open for acceptance by signature or otherwise by governments having provisionally acceded to the GATT, on terms related to the effective application of rights and obligations under this Agreement, which take into account rights and obligations in the instruments providing for their provisional accession. 9.1.3 This Agreement shall be open to accession by any other government on terms, related to the effective application of rights and obligations under this Agreement, to be agreed between that government and the Signatories, by the deposit with the Director-General to the CONTRACTING PARTIES to the GATT of an instrument of accession which states the terms so agreed. 9.1.4 In regard to acceptance, the provisions of Article XXVI:5 (a) and (b) of the General Agreement would be applicable. 9.2 Reservations 9.2.1 Reservations may not be entered in respect of any of the provisions of this Agreement without the consent of the other Signatories. 9.3 Entry into Force 9.3.1 This Agreement shall enter into force on 1 January 1980 for the governments1 which have accepted or acceded to it by that date. For each other government it shall enter into force on the thirtieth day following the date of its acceptance or accession to this Agreement. 9.4 National Legislation 9.4.1 Each government accepting or acceding to this Agreement shall ensure, not later than the date of entry into force of this Agreement for it, the conformity of its laws, regulations and administrative procedures with the provisions of this Agreement. 9.4.2 Each Signatory shall inform the Committee of any changes in its laws and regulations relevant to this Agreement and in the administration of such laws and regulations. 9.5 Amendments 9.5.1 The Signatories may amend this Agreement, having regard, inter alia, to the experience gained in its implementation. Such an amendment, once the Signatories have concurred in accordance with the procedures established by the Committee, shall not come into force for any Signatory until it has been accepted by such Signatory. 9.6 Withdrawal 9.6.1 Any Signatory may withdraw from this Agreement. The withdrawal shall take effect upon the expiration of twelve months from the day on which written notice of withdrawal is received by the Director-General to the CONTRACTING PARTIES to the GATT. Any Signatory may upon such notification request an immediate meeting of the Committee. 9.7 Non-Application of this Agreement Between Particular Signatories 9.7.1 This Agreement shall not apply as between any two Signatories if either of the Signatories, at the time either accepts or accedes to this Agreement, does not consent to such application. 9.8 Annex 9.8.1 The Annex to this Agreement forms an integral part thereof. 9.9 Secretariat 9.9.1 This Agreement shall be serviced by the GATT secretariat. 9.10 Deposit 9.10.1 This Agreement shall be deposited with the Director-General to the CONTRACTING PARTIES to the GATT who shall promptly furnish to each Signatory and each contracting party to the GATT a certified copy thereof and of each amendment thereto pursuant to Article 9.5 and a notification of each acceptance thereof or accession thereto pursuant to Article 9.1, or each withdrawal therefrom pursuant to Article 9.6. 9.11 Registration 9.11.1 This Agreement shall be registered in accordance with the provisions of Article 102 of the Charter of the United Nations. Done at Geneva this twelfth day of April nineteen hundred and seventy-nine in a single copy, in the English and French languages, each text being authentic, except as otherwise specified with respect to the various lists in the Annex 2. ____________________________________________ 1 For the purpose of this Agreement, the term "government" is deemed to include the competent authorities of the European Economic Community. 2 On 25 March 1987, the Committee agreed that the Spanish text of the Agreement shall also be considered authentic. Annex (as amended by the Protocol (1986) amending the access to the Agreement on Trade in Civil Aircraft). PRODUCT COVERAGE 1. The product coverage is defined in Article 1 of the Agreement on Trade in Civil Aircraft. 2. Signatories agree that products covered by the descriptions listed below1 and properly classified for customs purposes under the Customs Co-operation Council Nomenclature (Revised) headings of the Harmonized System codes shown alongside shall be accorded duty-free or duty-exempt treatment, if such products are for use in civil aircraft or ground flying trainers* and for incorporation therein, in the course of their manufacture, repair, maintenance, rebuilding, modification or conversion. 3. These products shall not include: an incomplete or unfinished product, unless it has the essential character of a complete or finished part, component, sub-assembly or item of equipment of a civil aircraft or ground flying trainer*, (e.g. an article which has a civil aircraft manufacturer's number), materials in any form (e.g. sheets, plates, profile shapes, strips, bars, pipes, tubes or other shapes) unless they have been cut to size or shape and/or shaped for incorporation in civil aircraft or a ground flying trainer* (e.g. an article which has a civil aircraft manufacturer's part number), raw materials and consumable goods. 4. For the purpose of this Annex, "Ex" has been included to indicate that the product description referred to does not exhaust the entire range of products within the Customs Co-operation Council Nomenclature (Revised) headings or the Harmonized System codes listed below.1 ________________________________ 1 The list is not reproduced. * For the purposes of Article 1.1 of this Agreement «ground flight simulators» are to be regarded as ground flying trainers as provided for under 8805.20 of the Harmonized System. PROTOCOL (2001) AMENDING THE ANNEX TO THE AGREEMENT ON TRADE IN CIVIL AIRCRAFT Signatories to the Agreement on Trade in Civil Aircraft (hereinafter referred to as "the Agreement"), HAVING carried out negotiations with a view to transposing into the Annex to the Agreement the changes introduced in the 1992, 1996 and 2002 versions of the Harmonized Commodity Description and Coding System (hereinafter referred to as "the Harmonized System"), as well as extending the product coverage of the Agreement, HAVE, through their representatives, agreed as follows: 1. The Annex attached to this Protocol shall, upon its entry into force pursuant to paragraph 3, replace the Annex to the Agreement as established heretofore by the Protocol (1986) Amending the Annex to the Agreement on Trade in Civil Aircraft. 2. This Protocol shall be open for acceptance by Signatories to the Agreement, by signature or otherwise, until 31 October 2001, or a later date to be decided by the Committee on Trade in Civil Aircraft. 3. This Protocol shall enter into force, for those Signatories who have accepted it, on 1January2002. For each other Signatory it shall enter into force on the day following the date of its acceptance. 4. This Protocol shall be deposited with the Director-General of the World Trade Organization who shall promptly furnish to each Signatory and each Member a certified copy thereof and a notification of each acceptance thereof pursuant to paragraph 2. 5. This Protocol shall be registered in accordance with the provisions of Article 102 of the Charter of the United Nations. 6. This Protocol deals only with customs duties and charges under Article 2 of the Agreement. Except with respect to requiring duty-free treatment for products covered by this Protocol, nothing in this Protocol or the Agreement, as modified thereby, changes or affects a Signatory's rights and obligations, as they exist on the day prior to the entry into force of this Protocol, under any of the WTO Agreements referenced in Article II of the Marrakesh Agreement Establishing the World Trade Organization. DONE at Geneva this sixth day of June 2001, in a single copy, in the English, French and Spanish languages, each text being authentic. Annex PRODUCT COVERAGE 1. LĪGUMS PAR TIRDZNIECĪBU AR CIVILAJIEM GAISA KUĢIEM Preambula Līguma par tirdzniecību ar civilajiem gaisa kuģiem, turpmāk tekstā "Līgums", Parakstītāji1; atzīmējot, ka ministri 1973. gada 12.-14.septembrī vienojās, ka Tokijas Daudzpusējo tirdzniecības sarunu raundam jāpanāk pasaules tirdzniecības paplašināšana un vēl lielāka liberalizācija, inter alia, progresīvi novēršot tirdzniecības šķēršļus un uzlabojot starptautisko pasaules tirdzniecības regulējumu; vēloties panākt maksimālu brīvību pasaules tirdzniecībai ar civilajiem gaisa kuģiem, to daļām un citu ar tiem saistīto aprīkojumu, tajā skaitā nodokļu likvidēšanu un tirdzniecības ierobežojumu vai kropļojošas ietekmes samazināšanu vai likvidēšanu vislielākajā iespējamajā pakāpē; vēloties veicināt nepārtrauktu aviācijas nozares tehnoloģisko attīstību pasaules mērogā; vēloties paredzēt godīgas un vienlīdzīgas konkurences iespējas to darbībām ar civilajiem gaisa kuģiem un to ražotāju dalībai pasaules civilo gaisa kuģu tirgus paplašināšanā; paturot prātā to vispārējo savstarpējo ekonomisko un tirdzniecības interešu nozīmi civilo gaisa kuģu sektorā; atzīstot, ka daudzi Parakstītāji uzskata gaisa kuģu sektoru par īpaši svarīgu sastāvdaļu ekonomiskajā un industriālajā politikā; cenšoties likvidēt negatīvo ietekmi uz tirdzniecību ar civilajiem gaisa kuģiem, kas izriet no valsts atbalsta civilo gaisa kuģu attīstībai, ražošanai un tirgvedībai, tomēr atzīstot, ka šāds valsts atbalsts pats par sevi nevar tikt uzskatīts par tirdzniecību izkropļojošu; vēloties, lai to civilo gaisa kuģu ekspluatācija notiktu uz komerciālas konkurences pamata, un atzīstot, ka tajās valsts industrijas attiecības ir ļoti atšķirīgas; atzīstot to pienākumus un tiesības Vispārējās vienošanās par tarifiem un tirdzniecību ietvaros, turpmāk tekstā "VVTT", un saskaņā ar citiem daudzpusējiem līgumiem, kas noslēgti VVTT ietvaros; atzīstot nepieciešamību paredzēt starptautisko notifikāciju, konsultāciju, novērošanas un strīdu izšķiršanas kārtību, ar nolūku nodrošināt godīgu, precīzu un efektīvu Līguma noteikumu ieviešanu un uzturēt tiesību un pienākumu līdzsvaru starp tām; vēloties izveidot starptautisku regulējumu tirdzniecībai ar civilajiem gaisa kuģiem; ar šo vienojas par sekojošo: 1. pants Produktu saraksts 1.1. Šis Līgums attiecas uz sekojošiem produktiem: (a) visi civilie gaisa kuģi, (b) visi civilo gaisa kuģu dzinēji, to daļas un sastāvdaļas, (c) visas citas daļas, sastāvdaļas un civilo gaisa kuģu mezgli, (d) visi lidotāju sauszemes simulatori, to daļas un sastāvdaļas, kas tiek izmantotas gan kā oriģināls, gan kā rezerves aprīkojums civilo gaisa kuģu ražošanā, remontā, apkopē, pārbūvē, modificēšanā vai pārveidošanā. 1.2. Šī Līguma izpratnē "civilie gaisa kuģi" ir (a) visi gaisa kuģi, izņemot militāros gaisa kuģus, un (b) visi citi produkti, kas minēti iepriekš 1.1. pantā. _____________________________________ 1 Termins "Parakstītāji" šeit lietots, lai apzīmētu Līgumslēdzējas Puses.
2. pants
Muitas nodokļi un citas nodevas 2.1. Parakstītāji vienojas: 2.1.1. līdz 1980. gada 1. janvārim vai līdz šī Līguma spēkā stāšanās brīdim likvidēt visus muitas nodokļus un jebkura cita veida nodevas1, kas piemērojamas uz vai noteiktas saistībā ar produktu importu, kas klasificēti muitas nolūkiem attiecīgajās preču pozīcijās, kas uzskaitītas Pielikumā, ja šādi produkti tiek izmantoti civilajos gaisa kuģos un iekļaušanai tajos ražošanas, remonta, apkopes, pārbūves, modificēšanas vai pārveidošanas laikā; 2.1.2. līdz 1980. gada 1. janvārim vai līdz, šī Līguma spēkā stāšanās brīdim atcelt visus muitas nodokļus un jebkura cita veida nodevas1, kas noteiktas civilo gaisa kuģu remonta darbiem; 2.1.3. līdz 1980. gada 1. janvārim vai līdz šī Līguma spēkā stāšanās brīdim iekļaut to attiecīgajos VVTT Grafikos beznodokļu vai nodokļu izņēmumu režīmu visiem produktiem, kas minēti 2.1.1. pantā un visiem remonta darbiem, kas minēti 2.1.2. pantā; 2.2. Katrs Parakstītājs: (a) ievieš vai pieņem galapatēriņa muitas administrācijas sistēmu, kas nodrošina tā pienākumi 2.1.panta ietvaros; (b) nodrošina, ka tā galapatēriņa sistēma paredz muitas beznodokļu vai nodokļu izņēmumu režīmu, kas ir pielīdzināms citu Parakstītāju paredzētajam režīmam un nav kavēklis tirdzniecībai; un (c) informē citus Parakstītājus par tā galapatēriņa sistēmas administrēšanas kārtību. _____________________________________ 1 "cita veida nodevām" ir tāda pati nozīme kā VVTT II pantā. 3. pants Tirdzniecības tehniskās barjeras 3.1. Parakstītāji atzīmē, ka Līguma par tehniskajām barjerām tirdzniecībā noteikumi tiek piemēroti tirdzniecībā ar civilajiem gaisa kuģiem. Papildus tam, Parakstītāji vienojas, ka civilo gaisa kuģu sertifikācijas prasības un to vadīšanas un apkopes kārtības tehniskie noteikumi starp Parakstītājiem nosaka Līguma par tehniskajām barjerām tirdzniecībā noteikumi. 4. pants Valsts pārvaldītais iepirkums, saistošie apakšlīgumi un stimuli 4.1. Civilo gaisa kuģu pircēji ir tiesīgi brīvi izvēlēties piegādātājus, pamatojoties uz komerciāliem un tehnoloģiskiem faktoriem. 4.2. Parakstītāji nepieprasa aviosabiedrībām, gaisa kuģu ražotājiem vai citām organizācijām, kas saistītas ar civilo gaisa kuģu pirkšanu, kā arī neizdara nepamatotu spiedienu uz tiem iepirkt civilos gaisa kuģus no kāda konkrēta avota, kas radītu diskrimināciju pret piegādātājiem no jebkura Parakstītāja. 4.3. Parakstītāji vienojas, ka šajā Līgumā ietverto produktu pirkums jāizdara, pamatojoties tikai uz konkurētspējīgas cenas, kvalitātes un piegādes principiem. Saistībā ar valsts iepirkuma apstiprināšanu vai piešķiršanu attiecībā uz šajā Līgumā ietvertajiem produktiem, Parakstītājs var pieprasīt, lai tā noteiktajām sabiedrībām tiek paredzēta pieeja uzņēmējdarbības iespējām pēc konkurences principiem un ar ne mazāku labvēlības režīmu, kā tas, kas piešķirts citu Parakstītāju noteiktajām sabiedrībām1. 4.4. Parakstītāji vienojas izvairīties no jebkāda veida stimulu piešķiršanas civilo gaisa kuģu pārdošanai vai iepirkšanai no kāda konkrēta avota, kas radītu diskrimināciju pret piegādātājiem no jebkura Parakstītāja. ____________________________________________ 1 Frāzes "pieeja uzņēmējdarbības iespējām...ar ne mazāku labvēlības režīmu..." nenozīmē, ka viena parakstītāja kvalificētajiem uzņēmumiem piešķirtais kontraktu apjoms dod tiesības cita Parakstītāja kvalificētajiem uzņēmumiem pretendēt uz tādu pašu kontrakta apjomu. 5. pants Tirdzniecības ierobežojumi 5.1. Parakstītāji nepiemēro kvantitatīvos ierobežojumus (importa kvotas) vai importa licencēšanas prasības, lai ierobežotu civilo gaisa kuģu importu tādā veidā, kas ir pretrunā ar piemērojamajiem VVTT noteikumiem. Tas neizslēdz importa novērošanas vai licencēšanas sistēmu piemērošanu saskaņā ar VVTT. 5.2. Parakstītāji nepiemēro kvantitatīvos ierobežojumus vai eksporta licencēšanu, vai citas līdzīgas prasības, lai komerciālu vai konkurences iemeslu dēļ ierobežotu civilo gaisa kuģu eksportu uz citu Parakstītāju tirgiem tādā veidā, kas ir pretrunā ar piemērojamajiem VVTT noteikumiem. 6. pants Valsts atbalsts, eksporta kredīti un gaisa kuģu tirgvedība 6.1. Parakstītāji atzīmē, ka Vienošanās par Vispārējās vienošanās par tarifiem un tirdzniecību VI, XVI un XXIII pantu piemērošanu (Vienošanās par subsīdijām un pretsubsīdiju pasākumiem) noteikumi tiek piemēroti tirdzniecībā ar civilajiem gaisa kuģiem. Tie apstiprina, ka, piedaloties vai atbalstot civilo gaisa kuģu programmas, tie cenšas novērst negatīvu ietekmi uz tirdzniecību ar civilajiem gaisa kuģiem Vienošanās par subsīdijām un pretsubsīdiju pasākumiem 8.3. un 8.4. pantu izpratnē. Tie ņem vērā arī īpašos faktorus gaisa kuģu nozarē, īpaši plaši izplatīto valsts atbalstu šajā jomā, Parakstītāju starptautiskās ekonomiskās intereses un visu Parakstītāju ražotāju vēlēšanos piedalīties pasaules civilo gaisa kuģu tirgus attīstībā. 6.2. Parakstītāji vienojas, ka civilo gaisa kuģu cenām jābūt balstītām uz visu pamatoto izmaksu summu, ieskaitot vienreizējās programmu izmaksas, identificējamās un iepriekš novērtētās gaisa kuģu militārās izpētes un attīstības izmaksas, kas attiecināmas uz gaisa kuģiem to sastāvdaļām un sistēmām, kas attiecīgi piemērojamas šādu civilo gaisa kuģu ražošanai, vidējām ražošanas izmaksām un finansiālām izmaksām. 7. pants Reģionālas pārvaldes institūcijas un pašvaldības 7.1. Papildus citiem pienākumiem, ko Parakstītāji uzņemas, noslēdzot šo Līgumu, tie vienojas nepieprasīt vai neveicināt, tieši vai netieši, reģionālās pārvaldes institūcijas, pašvaldības un nevalstiskās organizācijas, kā arī citas iestādes veikt tādas darbības, kas ir pretrunā ar šī Līguma noteikumiem. 8. pants Uzraudzība, pārbaude, konsultācijas un strīdu izšķiršana 8.1. Tiek nodibināta Komiteja par tirdzniecību ar civilajiem gaisa kuģiem (turpmāk tekstā "Komiteja"), kas sastāv no visu Parakstītāju pārstāvjiem. Komiteja ievēl savu Priekšsēdētāju. Tā sanāk pēc nepieciešamības, taču ne retāk kā vienu reizi gadā, ar nolūku nodrošināt Parakstītājiem iespējas konsultēties par jebkuru jautājumu attiecībā uz šī Līguma darbību, ieskaitot notikumu virzību civilo gaisa kuģu nozarē, lai izvērtētu, vai ir nepieciešami grozījumi, lai nodrošinātu brīvas un neizkropļotas tirdzniecības turpināšanos, lai izvērtētu jebkuru jautājumu, kura dēļ nav bijis iespējams atrast pieņemamu risinājumu divpusējo konsultāciju ietvaros, un lai pildītu tās saistības, kuras nosaka šis Līgums vai Parakstītāji. 8.2. Komiteja ik gadu izskata šī Līguma īstenošanu un darbību, ņemot vērā tā mērķus. Komiteja ik gadu informē VVTT Līgumslēdzējas Puses par pārskata periodā notikušo notikumu virzību. 8.3. Ne vēlāk kā trīs gadus pēc šī Līguma spēkā stāšanās un pēc tam periodiski Parakstītāji uzsāk turpmākas sarunas nolūkā paplašināt un uzlabot šo Līgumu uz savstarpējās sapratnes pamatiem. 8.4. Komiteja var izveidot palīginstitūcijas, kas varētu būt nepieciešamas, lai nodrošinātu šī Līguma piemērošanas regulāru pārbaudi un nepārtrauktu savstarpējo priekšrocību līdzsvaru. Īpaši, tā izveido attiecīgu palīginstitūciju, ar mērķi nodrošināt savstarpējo priekšrocību līdzsvaru, savstarpējo izpratni un līdzvērtīgus rezultātus, ņemot vērā 2. panta noteikumu piemērošanu attiecībā uz produktu kontroli, galapatēriņa sistēmām, muitas nodokļiem un citām nodevām. 8.5. Katrs Parakstītājs ar sapratni nodrošina tūlītēju konsultāciju iespēju jebkādiem cita Parakstītāja paziņojumiem, attiecībā uz jebkuru jautājumu, kas ietekmē šī Līguma darbību. 8.6. Parakstītāji atzīst konsultāciju vēlamību ar citiem parakstītājiem Komitejā, ar mērķi rast savstarpēji pieņemamu risinājumu, pirms izmeklēšanas ierosināšanas, lai noteiktu jebkuras iespējamās subsīdijas esamību, apjomu un ietekmi. Tajos izņēmuma apstākļos, kad nenotiek nekādas konsultācijas pirms iekšzemes kārtības uzsākšanas, Parakstītāji nekavējoties paziņo Komitejai par šādas kārtības uzsākšanu un tajā pašā laikā iesaistās savstarpējās konsultācijās, lai nonāktu pie kopēja risinājuma, kas ļautu izvairīties no pretsubsīdiju pasākumu piemērošanas. 8.7. Ja kāds Parakstītājs uzskata, ka tā tirdzniecības intereses civilo gaisa kuģu ražošanā, remontā, apkopē, pārbūvē, modificēšanā vai pārveidošanā ir tikušas, vai tiks negatīvi ietekmētas jebkura cita Parakstītāja darbības rezultātā, tas var pieprasīt, lai Komiteja uzsāk šīs lietas pārbaudi. Saņemot šādu pieprasījumu, Komiteja sanāk trīsdesmit dienu laikā un izskata šo lietu, cik vien ātri iespējams, ar nolūku atrisināt saistītos jautājumus, cik vien precīzi iespējams, un īpaši pirms šo jautājumu galīgās atrisināšanas citur. Šajā sakarā Komiteja var izdot nepieciešamos lēmumus vai rekomendācijas. Šī pārbaude nenodara kaitējumu Parakstītāju tiesībām saskaņā ar VVTT vai saskaņā ar daudzpusēji pieņemtiem juridiskiem instrumentiem VVTT ietvaros, ja tie ietekmē tirdzniecību ar civilajiem gaisa kuģiem. Lai palīdzētu izskatīt jautājumus, VVTT un šādu instrumentu ietvaros, Komiteja var nodrošināt nepieciešamo tehnisko palīdzību. 8.8. Parakstītāji vienojas, ka attiecībā uz jebkuru strīdu par šajā Līgumā ietvertajiem jautājumiem, ko neietver citi VVTT ietvaros daudzpusēji pieņemtie instrumenti, Parakstītāji un Komiteja šāda strīda izšķiršanas nolūkā piemēro mutatis mutandis Vispārējās Vienošanās XXII un XXIII pantu noteikumus un Vienošanās par notifikācijām, konsultācijām, strīdu izšķiršanu un uzraudzību noteikumus. Šo kārtību piemēro arī jebkura strīda izšķiršanai saistībā ar jautājumiem, ko ietver šis Līgums un citi VVTT ietvaros daudzpusēji pieņemti instrumenti, ja strīdus puses tā vienojas. 9. pants Nobeiguma noteikumi 9.1. Ratifikācija un pievienošanās. 9.1.1. Šis Līgums ir atvērts ratificēšanai, VVTT Līgumslēdzēju valdībām un Eiropas Ekonomiskai Kopienai, to parakstot vai citādi. 9.1.2. Šis Līgums ir atvērts ratificēšanai tām valdībām, kas provizoriski pievienojušās VVTT, to parakstot vai citādi, ar nosacījumu, ka tiek efektīvi piemērotas šī Līguma tiesības un pienākumi, kas ņem vērā to pagaidu pievienošanās instrumentos paredzētās tiesības un pienākumus. 9.1.3. Šis Līgums ir atvērts jebkuras citas valsts vēlmei pievienoties ar nosacījumu, ka tiek efektīvi piemērotas šī Līguma tiesības un pienākumi, par kurām tiktu panākta vienošanās starp šo valdību un Parakstītājiem, attiecīgi glabājot pievienošanās instrumentu, kurā nostiprināti noslēgtā Līguma noteikumi, pie VVTT Līgumslēdzēju ģenerāldirektora. 9.1.4. Attiecībā uz ratifikāciju ir piemērojami Vispārējās Vienošanās XXVI:5. (a) un (b) pantu noteikumi. 9.2. Atrunas. 9.2.1. Attiecībā uz jebkuriem šī Līguma noteikumiem nevar tikt uzrādītas nekādas atrunas bez citu Parakstītāju piekrišanas. 9.3. Spēkā stāšanās. 9.3.1. Šis Līgums stājas spēkā 1980. gada 1. janvārī valdībām1, kas tam pievienojušās vai to ratificējušas līdz šim datumam. Katrai citai valdībai tas stājas spēkā trīsdesmitajā dienā pēc šī Līguma ratifikācijas vai pievienošanās tam. 9.4. Nacionālā likumdošana. 9.4.1. Katra valdība, kas ratificē šo vai pievienojas šim Līgumam nodrošina likumu, noteikumu un administratīvās kārtības atbilstību šī Līguma noteikumiem, ne vēlāk kā pēc šī Līguma spēkā stāšanās. 9.4.2. Katrs Parakstītājs informē Komiteju par izmaiņām tā likumos un noteikumos, kas attiecas uz šo Līgumu, kā arī šādu likumu vai noteikumu administrēšanā. 9.5. Grozījumi. 9.5.1. Parakstītāji var izdarīt grozījumus šajā Līgumā, ņemot vērā, inter alia, pieredzi, kas iegūta, to īstenojot. Šādi grozījumi, tiklīdz Parakstītāji ir vienojušies saskaņā ar Komitejas noteikto kārtību, nestājas spēkā attiecībā uz jebkuru no Parakstītājiem, pirms šis Parakstītājs tās nav ratificējis. 9.6. Izstāšanās. 9.6.1. Ikviens Parakstītājs var izstāties no šī Līguma. Izstāšanās stājas spēkā divpadsmit mēnešus pēc dienas, kad tas ir saņēmis rakstisku paziņojumu par izstāšanos no VVTT Līgumslēdzēju Pušu ģenerāldirektora. Jebkurš Parakstītājs pēc šāda paziņojuma var pieprasīt tūlītēju Komitejas sanāksmi. 9.7. Šī Līguma nepiemērošana starp atsevišķiem Parakstītājiem. 9.7.1. Šo Līgumu nepiemēro starp jebkuriem diviem Parakstītājiem, ja kāds no Parakstītājiem nepiekrīt šādai piemērošanai, brīdī, kad kāds no tiem ratificē vai pievienojas šim Līgumam. 9.8. Pielikums. 9.8.1. Šī Līguma Pielikums ir tā neatņemama sastāvdaļa. 9.9. Sekretariāts. 9.9.1. Šo Līgumu administrē VVTT sekretariāts. 9.10. Depozīts. 9.10.1. Šis Līgums ir glabājams pie VVTT Līgumslēdzēju Pušu ģenerāldirektora, kurš nekavējoties nodrošina katru Parakstītāju un katru VVTT līgumslēdzēju ar apstiprinātu šī Līguma kopiju, katra tā grozījuma kopiju saskaņā ar 9.5. pantu un notifikāciju par katru tā ratifikāciju vai pievienošanos saskaņā ar 9.1. pantu, vai par katru izstāšanos saskaņā ar 9.6. pantu. 9.11. Reģistrācija. 9.11.1. Šo Līgumu reģistrē saskaņā ar Apvienoto Nāciju Organizācijas Statūtu 102. panta noteikumiem. Sastādīts Ženēvā tūkstot deviņi simti septiņdesmit devītā gada divpadsmitajā aprīlī vienā eksemplārā angļu un franču valodā, visi teksti ir vienlīdz autentiski, izņemot, ja tas ir citādi noteikts attiecībā uz dažādiem sarakstiem Pielikumā 2. _________________________________ 1 Šī Līguma ietvaros termins "valsts" ietver arī Eiropas Ekonomiskās Kopienas atbildīgās institūcijas. 2 1987. gada 25. martā Komiteja piekrita, ka šī Līguma spāņu teksts arī ir uzskatāms par autentisku. Pielikums (grozīts ar Protokolu (1986), kas groza Līguma par tirdzniecību ar civilajiem gaisa kuģiem pieejamību) PRODUKTU SARAKSTS 1. Produktu saraksts ir noteikts Līguma par tirdzniecību ar civilajiem gaisa kuģiem 1. pantā. 2. Parakstītāji vienojas, ka produktiem, kas ietverti zemāk uzskaitītajos aprakstos1 un ir pareizi klasificēti muitas nolūkiem pēc līdztekus norādītām Muitas sadarbības Padomes Nomenklatūras (Pārskatītās) Harmonizētās sistēmas kodu pozīcijām, piemēro muitas beznodokļu vai nodokļu izņēmuma režīmu, ja šādi produkti ir paredzēti izmantošanai civilajos gaisa kuģos vai lidotāju sauszemes trenažieros* un iekļaušanai tajos, to ražošanas, remonta, apkopes, pārbūves, modificēšanas vai pārveidošanas laikā. 3. Šie produkti neietver: nepilnīgu vai nepabeigtu produktu, ja vien tam nav civila gaisa kuģa vai lidotāju sauszemes trenažiera* aprīkojuma pilnīgas vai pabeigtas daļas, sastāvdaļas, mezgla vai priekšmeta raksturs (piemēram, izstrādājums, kam ir civilo gaisa kuģu ražotāja daļas numurs), jebkādas formas materiālus (piemēram, loksnes, plāksnes, profila veidnes, sloksnes, stieņi, caurulītes, caurules vai citas veidnes), ja vien tie nav piegriezti pēc izmēra vai veidnes un/vai veidoti iekļaušanai civilajā gaisa kuģī vai lidotāju sauszemes trenažierī* (piemēram, izstrādājums, kam ir civilo gaisa kuģu ražotāja daļas numurs), izejmateriālus un patēriņa preces. 4. Šī pielikuma izpratnē "Ex" ir iekļauts, lai norādītu, ka attiecīgais produkta apraksts nav attiecināms uz pilnīgi visu produktu apjomu, kas ietilpst zemāk uzskaitītajās Muitas sadarbības padomes Nomenklatūras (Pārskatītās) pozīcijās vai Harmonizētās sistēmas kodos1. ______________________________ * Šī Līguma 1.1. panta izpratnē "lidotāju sauszemes simulatori" jāsaprot kā lidotāju sauszemes trenažieri, kā paredzēts Harmonizētās sistēmas 8805.29 subpozīcijā. 1 Šis saraksts nav izveidots. PROTOKOLS (2001) PAR GROZĪJUMIEM LĪGUMA PAR TIRDZNIECĪBU AR CIVILAJIEM GAISA KUĢIEM PIELIKUMĀ Līguma par tirdzniecību ar civilajiem gaisa kuģiem (turpmāk tekstā— Līgums) parakstītāji, veicot sarunas ar nodomu Līguma pielikumā iekļaut Preču aprakstīšanas un kodēšanas harmonizētās sistēmas (turpmāk tekstā — Harmonizētā sistēma) 1992., 1996. un 2002. versijā ieviestās izmaiņas, kā arī paplašināt Līguma ietverto produktu sarakstu, izmantojot savus pārstāvjus, vienojušies par sekojošo: 1. Protokolam pievienotais pielikums, tam stājoties spēkā, saskaņā ar 3. paragrāfu, aizstāj Līguma pielikumu, kas līdz tam bija noteikts ar Protokolu (1986) par grozījumiem Līgumā par tirdzniecību ar civilajiem gaisa kuģiem. 2. Protokolu Līguma Parakstītāji ratificē, parakstot vai citādi, līdz 2001. gada 31. oktobrim, vai vēlākam datumam, ko nolemj Tirdzniecības ar civilajiem gaisa kuģiem komiteja. 3. Protokols, Parakstītājiem, kas to ratificējuši, stājas spēkā 2002. gada 1. janvārī. Jebkuram citam parakstītājam tas stājas spēkā nākošajā dienā pēc tā ratifikācijas. 4. Protokols glabājas pie Pasaules Tirdzniecības organizācijas ģenerāldirektora, kurš nekavējoties nodrošina katru Parakstītāju un dalībvalsti ar apstiprinātu tā kopiju un notifikāciju par katru tā ratifikāciju saskaņā ar 2. paragrāfu. 5. Protokolu reģistrē saskaņā ar Apvienoto Nāciju Organizācijas Statūtu 102. panta noteikumiem. 6. Protokols aplūko tikai muitas nodokļus un nodevas, kas minētas Līguma 2. pantā. Izņemot beznodokļu režīma prasību Protokolā ietvertajiem produktiem, nekas cits Protokolā vai ar to pārveidotā Līgumā, nemaina vai neietekmē parakstītāju tiesības un pienākumi, kas pastāvēja dienu pirms Protokola stāšanās spēkā, saskaņā ar jebkuru PTO Līgumu, kas norādīts Marakešas līguma par Pasaules tirdzniecības organizācijas izveidošanu 2. pantā. Sastādīts Ženēvā 2001. gada 6. jūnijā vienā eksemplārā angļu, franču un spāņu valodā, visi teksti ir vienlīdz autentiski. Pielikums PRODUKTU SARAKSTS 1. Produktu saraksts ir noteikts Līguma par tirdzniecību ar civilajiem gaisa kuģiem 1. pantā. 2. Parakstītāji vienojas, ka produktiem, kas ietverti zemāk uzskaitītajos aprakstos un ir pareizi klasificēti pēc Harmonizētās sistēmas pozīcijām un subpozīcijām, līdztekus norādītām, piemēro muitas beznodokļu vai nodokļu izņēmuma režīmu, ja šādi produkti ir paredzēti izmantošanai civilajos gaisa kuģos vai lidotāju sauszemes trenažieros* un iekļaušanai tajos, to ražošanas, remonta, apkopes, pārbūves, modificēšanas vai pārveidošanas laikā. 3.
