Regulations on Material for Propagation of the Vine

Issued pursuant to Section 5, Clause 3
of the Plant Protection Law

I. General Provisions

1. These Regulations prescribe the conformity criteria for propagating material and procedures of circulation of vine (Vitis L.) (hereinafter - material).

2. These Regulations shall not apply to material intended for:

2.1. utilisation for a consumer's personal needs;

2.2. exportation (export) and kept separately from other material;

2.3. for trials or scientific purposes;

2.4. selection work; and

2.5. the conservation of genetic diversity.

3. Observance of the requirements of these Regulations, state supervision and control shall be performed by the State Plant Protection Service (hereinafter - Service).

4. Growers and distributors of material shall perform a regular quality control of the material and are liable for its conformity to the specified criteria.

II. Classification of Material

5. Material shall be divided into the following groups:

5.1. young vine plants

5.1.1. rooted cuttings - ungrafted parts of plants or rooted vine shoot intended for planting without grafting or for use as rootstocks;

5.1.2. rooted grafts - pieces of vine shoot joined by grafting and the underground parts of which are rooted;

5.2. parts of young vine plants:

5.2.1. one-year vine shoots;

5.2.2. rootstocks for grafting the cuttings - pieces of vine shoot constituting the underground part of the rooted grafting;

5.2.3. cuttings for grafting the top - pieces of vine shoot intended to form the part above ground by preparing rooted grafts or grafting these plants in situ; and

5.2.4. nursery cuttings - pieces of vine shoot for producing rooted cuttings.

6. The categories of material shall be as follows:

6.1. reference plants;

6.2. basic material;

6.3. certified material; and

6.4. standard material.

7. Material shall comply with the following requirements:

7.1. material shall be virus-free:

7.1.1. regenerated and recognised as free of virus or virus-like organisms and shall be kept in conditions where it is impossible to become infected with virus or virus-like organisms; and

7.1.2. obtained by propagating virus-free material in a vegetative way in a definite generation; and

7.2. material shall be virus-tested:

7.2.1. tested and recognised as free of harmful organisms referred to in Annex 1 and virus or virus-like organisms referred to in Part A, Annex 2 and shall be kept in conditions in which it is impossible to become infected with the virus mentioned above; and

7.2.2. obtained by propagating virus-tested material in a vegetative way in a definite generation.

8. Reference plants shall be:

8.1. plants conforming to the identity and pomological characteristics of the variety;

8.2. tested plants in which the harmful organisms referred to in Annex 1, virus or virus-like organisms and their agents referred to in Part A, Annex 2, as well as harmful organisms referred to in Part B, Annex 2 of these Regulations have not been determined; or correspondingly regenerated plants; and

8.3. plants intended for the production or acquisition of basic material.

9. Basic material shall be material that:

9.1. is derived from a reference plant and cultivated in accordance with the requirements of cultivation of the variety.

9.2. complies with the requirements for basic material specified in these Regulations; and

9.3. is intended for the production of certified materials.

10. Rooted grafts shall be qualified as basic material if:

10.1. basic material is grafted on the basic material; or

10.2. basic material is grafted on the certified material.

11. Certified material shall be material that:

11.1. is propagated in a vegetative way from basic material, maintaining the varietal identity;

11.2. is intended for producing and acquisition of planting material; and

11.3. complies with the requirements of the certified material.

12. Grafts, obtained from the basic material and grafted on the certified material, shall be qualified as certified material.

13. Other combinations shall be qualified as standard material.

14. Standard material shall be material that:

14.1. is propagated in a vegetative way maintaining the varietal identity and purity;

14.2. is intended for production of grapes or acquisition of planting material; and

14.3. complies with the requirements prescribed for standard material.

III. Growing of Material

15. When growing material, the following requirements shall be complied with:

15.1. ensure that soil, in which the basic or certified material shall be grown, is not infected with plant quarantine or other harmful organisms or disease carriers ( in particular nematodes, which transmit diseases caused by viruses) and viruses;

15.2. visually inspect if the material has any signs of infection with plant quarantine organisms and other harmful organisms referred to in Annex 1 and Annex 2 of these Regulations and which reduce the quality of the material; and

15.3. material plant nurseries shall not be formed:

15.3.1. in places where for the last six years tomatoes and strawberries have been grown; or

15.3.2. in fructiferous vineyards and orchards or in the vicinity thereof;

16. When growing reference plants the necessary conditions shall be provided to avoid any repeated infection with pathogens, which are spread by air or soil, and the following requirements shall be observed:

16.1. initial propagating material shall be grown in pots in the plant house;

16.2. polyethylene, tarpaulin or similar material shall underlie the pots to prevent contact of roots with other soil;

16.3. a net preventing insects shall cover the plant house (maximum size of the mesh 1 millimetre);

16.4. the floor covering of the plant house shall be of gravel, fragments, concrete or similar material;

16.5. the plant house's entrance shall have a double door, disinfection equipment shall be placed at the door;

16.6. material shall be regularly inspected visually; and

16.7. if the harmful organisms have spread, the plants shall be treated with plant protection products,

17. When growing basic material, plant nurseries of a lower category, as well as orchards or vineyards may not be located closer than 15 - 20 metres.

18. When growing certified material, plant nurseries of other categories, as well as orchards and vineyards may not be located closer than 8-10 metres.

19. When growing standard material, the health of plants shall be visually tested. Material breeders shall ensure the conformity of varietal identity.

20. The Service shall issue a label and a certificate of the propagating material to a material breeder or distributor who in accordance with regulatory enactments has registered in the register of persons involved in circulation of plants and plant products subject to phytosanitary control (hereinafter - registered person).

IV. Checks on Conformity of Material and Production Process

21. The Service shall, during the time of vegetation and before distribution, carry out conformity assessment of material (hereinafter - check)

22. The conformity criteria for material shall be as follows:

22.1. material shall conform to the particular variety or category

22.2. material and the place where it is grown or stored shall conform to the phytosanitary norms prescribed by regulatory enactments;

22.3. material shall conform to the requirements referred to in these Regulations; and

22.4. material shall not be infected with quarantine organisms and the harmful organisms referred to in Annex 1 and Annex 2 of these Regulations.

23. If the presence of plant quarantine organisms and the harmful organisms referred to in Annex 1 and 2 of these Regulations has been detected, the registered person shall notify about this to the Service immediately and take the phytosanitary measures specified by an inspector of the Service necessary to reduce the risk of spreading of quarantine and harmful organisms.

24. The Service taking into account the manufacturing methods used in producing basic and certified material shall check at least once a year:

24.1. the quality of the material before the production process is started;

24.2. the planting of material

24.3. the conformity of the material to the phytosanitary norms;

24.4. the plan and methods for the treatment of soil;

24.5. the general cultivation of plants

24.6. the propagating and harvesting of the material;

24.7. the chemical treatment of material, premises and tools; and

24.8. wrapping, storage and transportation of the material.

25. The registered person shall set up a nursery book, in which he or she shall specify:

25.1. information on material grown

25.1.1. species and variety of material;

25.1.2. amount and quality of planted material

25.1.3. area of grown material; and

25.1.4. name of the harmful organism to be combated, trade and chemical name, concentration, date of use of the used plant protection product;

25.2. information regarding the movement of the material:

25.2.1. species, variety and quantity, origin, number of the plant passport or label of the acquired material;

25.2.2. species, variety and quantity of the marketed material;

25.2.3. number and batch number of the issued labels; and

25.2.4. numbers and amount of plant passports; and

25.3. information regarding composition of the batch and origin of its individual components or lots if materials of different origin or different lots during packaging and storage of materials are mixed or put together.

26. The registered person who is engaged only in distribution of the material shall set up records of movement of the material in which the information referred to in Sub-Paragraph 25.2 shall be specified.

27. The registered person shall keep all documentation related to the movement of material (plant passports, labels, certificates of the propagating material, inspection statements, test results and nursery book) for three years.

28. If basic and certified material conforms to the referred to conformity criteria, the Service shall issue a certificate and a label of the propagating material.

29. If standard material conforms to these requirements, the Service shall issue a label.

30. If, when assessing conformity, it is determined that the material does not comply with the requirements of these Regulations, the Service shall lower its category or suspend the distributing of the material until the relevant deficiencies are fully rectified.

31. If it is not possible to rectify the deficiencies, the Service shall take a reasoned decision not to issue a certificate and a label of the propagating material or prohibit the distribution of the material.

32. Expenses related to the aforementioned examinations shall be covered by the registered person.

V. Marketing of Material

33. Material shall be dug out or separated from the parental plant, removed from the places where it is grown, stored or packed and distributed taking into account the following requirements:

33.1. material shall be sorted according to the dimension and quality in homogenous batches and in accordance with Annex 3 of these Regulations packed in bunches; and

33.2. the label shall be attached under the supervision of the Service to each batch in which the material is homogeneous according to composition and origin and which has one consignor and one consignee. The label shall include the information referred to in Annex 4 of these Regulations.

34. If the batch consists of several packaging units or bunches:

34.1. the label shall be attached to each packaging unit or bunch under the supervision of the Service; and

34.2. a copy of the certificate of propagating material shall also be attached to the accompanying documents of basic and certified material.

35. Basic material shall be marketed in new packaging, but certified and standard material - in new or reusable disinfected packaging.

36. A packaging unit shall be closed, sealed and the label shall be attached with a seal so that after opening the packaging unit it would not be renewable in its initial form.

37. Information on the label shall be printed and indelible. The label may not be used on a repeated basis.

38. In order to receive a label for marketing of the material, in the beginning of the vegetation period the registered person shall submit to the Service an application on the necessity of an inspection, specifying the species, variety, quantity of the material to be inspected, growing areas and place of inspection.

39. The Service inspector shall perform the inspection within a time period of 20 days after the receipt of the application.

40. The label may be substituted by a plant passport if it includes the information specified in Annex 4 of these Regulations.

41. When marketing material, the registered person shall provide a purchaser with a description of varieties on sale published in a catalogue, magazine or specialised publication.

VI. Closing Provisions

42. These Regulations shall come into force on 1 March 2003.

III. Rugose Wood Complex of Vine (Mechanically Non-transmittable)

14. Rugose wood complex of vine is spread world, carrier is unknown. Such diseases as corky bark disease, ruperstris stem pitting virus, Kober Stem Grooving virus and LN 33 stem pitting virus belong to this complex. The agent or agents of these virus-like diseases have not been identified yet, but they are not related serologically to the leafroll virus (closterovirus), which is mentioned in connection with cork bark.

Information to be Specified on Label, Size and Colour of Label

1. The following information shall be specified on a label:

1.1. State code "LV";

1.2. abbreviation of the State Plant Protection Service (VAAD);

1.3. the registration number of the registered person;

1.4. the given name and surname, or the name of the registered person.

1.5. the batch number,

1.6. the certificate number of the propagating material;

1.7. the botanical name of plants or plant products;

1.8. the name of the species of plants or plant products and clone if necessary;

1.9. the category and group of the propagating material;

1.10. the amount of the propagating material; and

1.11. the words ["virus-free"] or ["virus-tested"], if the propagating material conforms to such status.

2. Dimensions of Label

2.1. for the rootstock cuttings intended for grafting, cuttings intended for grafting the top and nursery cuttings - 110 x 67 millimetres; and

2.2. for rooted cuttings and rooted grafts - 80 x 70 millimetres.

3. Colour of Labels

3.1. for basic material - white;

3.2. for certified material - blue;

3.3. for standard material - dark yellow; and

3.4. for other material - brown. The label shall indicate that the relevant material does not conform to the requirements for the quality of standard material.
