Packaging Classification and Marking Regulations

Issued pursuant to Section 10, Paragraph two of the
Packaging Law

1. These Regulations prescribe the procedures for the classification and marking of packaging.

2. The packaging materials shall be classified in accordance with Annex 1 of these Regulations.

3. The packer shall indicate the following information in the packaging or packaging material marking located on the packaging or its label:

3.1. type of packaging material (it shall be indicated by a code number or mark in conformity with Annex 2 of these Regulations);

3.2. possible type of processing of the packaging material (in conformity with Annex 3 of these Regulations).

4. Marking shall be clearly visible, easy legible and permanent (also after opening of the packaging).

5. If the end user of the packaged goods is a manufacturer or a service provider that uses the goods as raw materials, the information on the packaging of raw material may be indicated in the accompanying documents only.

6. A packer is liable for the correctness of information indicated on the marking or label of the packaging.

7. The following need not be marked:

7.1. packaging or its components if after opening its surface area is less than 20000 mm² or its nominal volume is less than 100 ml;

7.2. corks or other packaging components the weight of which is less than 50 grams;

7.3. labels, inlays or gaskets and wrapping materials if they are not printed.

8. Until 1 January 2004 packaging produced from glass, paper, paperboard, wood, textiles and composite material marking shall be voluntary.

9. Packaging manufactured from metal and plastic raw materials need not be marked, if it has been manufactured, imported or placed on the market together with goods by 1 July 2002. If the goods and packaging supply contract has been concluded before 1 July 2002, the referred to packaging need not be marked until expiration of the contract.

10. These Regulations come into force on 1 July 2002.

Special Marks

1. To Be Utilised for Recycling

The marking shall contain a general graphical symbol of recycling (Figure 1) or a simplified general graphical symbol of recycling (Figure 2) and a code number of the relevant packaging material, which shall be placed in the graphic symbol, and/or abbreviation, which shall be placed under the graphic symbol (Figure 3).

2. Secondary Raw Materials, which have been utilised in Manufacturing of Packaging or Packaging Material

The marking shall contain a general graphical symbol of recycling or a simplified general graphical symbol of recycling and a code number of the relevant packaging material, which shall be placed in the graphic symbol, and the internationally accepted mark "Recycled (number) %", which shall be placed under the graphic symbol. The indicated number conforms to the quantity in percent of secondary raw materials in the packaging material.
