Procedures for Establishing the Disciplinary Anti-doping Commission and the Therapeutic Use Exemptions Commission

Issued pursuant to
Section 11.3, Paragraph five and Section 11.4,
Paragraph five of the Sports Law

I. General Provisions

1. The Regulation prescribes the procedures by which the Latvian Anti-doping Bureau (hereinafter - the Bureau) shall establish the Disciplinary Anti-doping Commission and the Therapeutic Use Exemptions Commission, as well as determine the term of office for members of the Commissions.

2. The term of office for a member of the Disciplinary Anti-doping Commission or the Therapeutic Use Exemptions Commission shall be four years. The same person may be nominated for not more than two terms of office in succession.

3. The same person shall not be concurrently included in the composition of the Appeals Commission, the Disciplinary Anti-doping Commission, or the Therapeutic Use Exemptions Commission.

II. Establishment of the Disciplinary Anti-doping Commission

4. The Bureau shall invite each organisation referred to in Section 11.3, Paragraph five of the Sports Law to nominate two persons for participation in the Disciplinary Anti-doping Commission.

5. The organisation shall, within 10 working days after receipt of the invitation referred to in Paragraph 4 of this Regulation, inform the Bureau in writing of the nominated persons, appending copies of documents certifying education of each person and a curriculum vitae.

6. The Bureau shall, within three working days, evaluate the conformity of the person to the requirements laid down in this Regulation and Section 11.3, Paragraph five of the Sports Law. If the nominated person does not meet the requirements laid down in this Regulation and in the Sports Law, the Bureau shall invite the relevant organisation to nominate another person within five working days.

7. The Bureau shall establish the Disciplinary Anti-doping Commission. The nominated persons who meet the requirements laid down in this Regulation and the Sports Law shall be included in the composition of the Commission.

8. A member of the Disciplinary Anti-doping Commission who cannot continue to work in the composition of the Commission shall inform the Bureau and the relevant organisation thereof in writing without delay. After receipt of the abovementioned information the relevant organisation shall, within 10 working days, nominate another person in conformity with the conditions referred to in Paragraphs 2, 3, and 5 of this Regulation.

III. Establishment of the Therapeutic Use Exemptions Commission

9. The Bureau shall invite the Latvian Medical Association (hereinafter - the Association) to nominate at least three physicians for participation in the Therapeutic Use Exemptions Commission.

10. The Association shall, within 10 working days after receipt of the invitation referred to in Paragraph 9 of this Regulation, inform the Bureau in writing of the nominated persons, appending copies of documents certifying education of each person and a curriculum vitae.

11. The Bureau shall, within three working days, evaluate the conformity of the person to the requirements laid down in this Regulation and Section 11.4, Paragraph five of the Sports Law. If the nominated person does not meet the requirements laid down in this Regulation and in the Sports Law, the Bureau shall invite the relevant organisation to nominate another person within five working days.

12. The Bureau shall establish the Therapeutic Use Exemptions Commission. The nominated persons who meet the requirements laid down in this Regulation and the Sports Law shall be included in the composition of the Commission.

13. A member of the Therapeutic Use Exemptions Commission who cannot continue to work in the composition of the Commission shall inform the Bureau and the Association thereof in writing without delay. After receipt of the abovementioned information the Association shall, within 10 working days, nominate another person in conformity with the conditions referred to in Paragraphs 2, 3, and 10 of this Regulation.
