Regulations Regarding the Imposition of National Sanctions in Relation to Subjects Connected with the Nuclear Programme and Political Regime Implemented by the Democratic People's Republic of KoreaIssued pursuant
to 1. The Regulation prescribes the national sanctions of the Republic of Latvia in order to prevent harm to external policy interests and national security of Latvia and to combat manufacture, storage, movement, use, or proliferation of weapons of mass destruction which are related to the nuclear programme and political regime implemented by the Democratic People's Republic of Korea. 2. The Cabinet shall determine the subjects of sanctions in relation to whom the restrictive measures of neither the United Nations Organization, nor the European Union have been imposed. The sanctions shall be imposed on subjects who: 2.1. are directly or indirectly involved in the programmes of the Democratic People's Republic of Korea related to the weapons of mass destruction, including nuclear weapons and ballistic missiles, and support or promote their manufacture, storage, movement, use, or proliferation, and on persons, units or structures that act on behalf of them or under their management, or that are in their ownership, possession or under their control; 2.2. provide financial services or transfer financial or other resources and material values to promote the development of the programmes of the Democratic People's Republic of Korea related to the weapons of mass destruction, including nuclear weapons and ballistic missiles, and on persons, units or structures that act on behalf of them or under their management, or that are in their ownership, possession or under their control; 2.3. are representatives of the government of the Democratic People's Republic of Korea or the Workers' Party of Korea and persons, units or structures that act on behalf of or under the supervision of such representatives, or are in their ownership, possession or under their control, provided that their relationship with the nuclear programmes of the Democratic People's Republic of Korea and other actions prohibited by the United Nations Security Council Resolutions and decisions and regulations of the Council of the European Union on the restrictive measures imposed on the Democratic People's Republic of Korea is established. 3. The financial restrictions referred to in Section 5 of the Law on International Sanctions and National Sanctions of the Republic of Latvia shall be imposed on the subjects of sanctions referred to in Paragraph 2 of this Regulation. 4. Exceptions may be applied in executing the national sanctions if, upon request of the subject of sanctions, the competent authorities take a decision to allow to release certain frozen funds or make available certain funds and if the funds are: 4.1. necessary for the basic needs of the subject of sanctions or family members dependent on him or her, including payments for food, rent or mortgage, public utility charges, medicinal products, medical assistance, taxes, insurance premiums; 4.2. intended exclusively for commensurate payment and remuneration for a qualified job or expenses in relation to legal services; 4.3. intended exclusively for payment of fees or service charge for holding or storing the frozen funds; 4.4. intended exclusively for making payments in accordance with the contract or agreement concluded by the subject of sanctions prior to the day on which the sanctions were imposed in relation to him or her, or in accordance with the obligations arisen to the subject prior to the day on which the sanctions were imposed in relation to him or her, provided that their relationship with the actions or subjects referred to in Paragraph 2 of this Regulation is not established.
