Procedures for the Issuance of Security Guard Certificates

Issued pursuant to
Section 14, Paragraph three of the Security Guard Activities Law

I. General Provision

1. The Regulation prescribes:

1.1. the education necessary for the receipt of the security guard certificate;

1.2. the persons who do not need to take the security guard employee qualification examination for the receipt of the security guard certificate (hereinafter - the examination);

1.3. the requirements for the examination and procedures by which the person shall take it;

1.4. the procedures by which the security guard certificate, its duplicate, and a repeat certificate shall be issued to a natural person and the term of validity of the security guard certificate shall be extended;

1.5. the sample security guard certificate;

1.6. the procedures for and amount in which the State fee for taking the examination, issuing the security guard certificate, its duplicate, and a repeat certificate, and extending the term of validity of the security guard certificate shall be paid.

II. Education Necessary for the Receipt of a Security Guard Certificate

2. In order to receive the security guard certificate, a person shall complete one of the following educational programmes:

2.1. the vocational in-service educational programme "Educational Programme for Basic Level Knowledge in Security Guarding Activities" (hereinafter - the Basic Level Knowledge Programme), and shall receive a certificate on the completion of the vocational in-service training;

2.2. the vocational further education programme in the field of security guarding services (profession code: 5414), and shall receive a certificate of professional qualification not lower than the second level of professional qualification;

2.3. a study programme of the first level vocational higher education and shall receive an educational document attesting the acquisition of the professional qualification "Security Specialist";

2.4. a study programme of the fifth level vocational higher education and shall receive an educational document attesting the acquisition of the professional qualification "Head of Security Service".

3. The Basic Level Knowledge Programme shall be developed by the educational institution in accordance with the vocational in-service educational programme sample approved by the Minister for the Interior. The amount of the Basic Level Knowledge Programme shall be 84 hours.

4. The Basic Level Knowledge Programme may be taken by persons who have acquired at least basic education.

III. Persons who Need not Take the Examination for the Receipt of the Security Guard Certificate

5. A person who has acquired the education referred to in Sub-paragraph 2.2, 2.3, or 2.4 of this Regulation need not take the examination to receive the security guard certificate.

6. If the term of validity of the security guard certificate is being extended, the following persons need not take the examination:

6.1. who have acquired the education referred to in Sub-paragraph 2.2, 2.3, or 2.4 of this Regulation;

6.2. who has completed the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours and has completed the training courses provided for in Sub-paragraph 6.3 of this Regulation within the term of validity of the security guard certificate;

6.3. who have acquired the education referred to in Sub-paragraph 2.1 of this Regulation and have completed the training courses in the amount of 80 hours within the term of validity of the security guard certificate in one or several study topics on:

6.3.1. the use of physical force and special means in the security guarding activities;

6.3.2. communication psychology in security guarding activities;

6.3.3. the special features of guarding objects;

6.3.4. latest developments in legal regulation of security guarding activities;

6.3.5. actions of a security guard employee in cases of different kinds of threats;

6.3.6. aspects of the mobile appointment activities of security guard;

6.3.7. technical means for security guarding and technical security systems;

6.3.8. the conditions and procedures for the use and application of firearms when performing security guarding activities;

6.3.9. ensuring compliance with fire safety requirements when performing security guarding activities;

6.3.10. special features of appearance of a person and their verbal description.

7. The educational institution which is implementing the training courses provided for in Sub-paragraph 6.3 of this Regulation has the obligation to issue a statement (Annex 1) to the person after completion of such training courses. The educational institution has the right to implement the training courses provided for in Sub-paragraph 6.3 of this Regulation, if the educational institution has been accredited in accordance with the requirements of laws and regulations and is implementing the educational programme in the groups "Protection of Persons and Properties", or "Security of Organisations", or "Civil Security and Protection".

IV. Requirements for the Examination and Procedures by which the Person shall Take It

8. In order to apply for taking the examination, a person shall submit an application for taking the examination (Annex 2) to the State Police. The abovementioned application may be submitted in person, sent by post or electronically. Information regarding the application for taking the examination may be sent also via electronic mail without safe electronic signature.

9. Within five working days after receipt of the application referred to in Paragraph 8 of this Regulation, the State Police shall, based on the type indicated in the application, inform the person of the time determined for taking the examination.

10. The State Police shall determine the time for taking the examination by taking into account the wishes of the person as much as possible, but not later than 25 working days after the time indicated by the person.

11. The person shall take the examination at the time and according to the procedures stipulated by the State Police. If the person does not arrive to take the examination at this time, he or she may request that another time for taking the examination is determined in accordance with the procedures referred to in Paragraph 8 of this Regulation.

12. Before taking the examination, the person shall:

12.1. present a personal identification document;

12.2. present an educational document attesting the completion of the educational programme provided for in Sub-paragraph 2.1 of this Regulation or the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours.

13. The person shall not be allowed to take the examination, if:

13.1. a personal identification document is not presented;

13.2. an educational document attesting the completion of the educational programme provided for in Sub-paragraph 2.1 of this Regulation or the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours is not presented;

13.3. the payment of the State fee specified for taking the examination has not been received.

14. In the case referred to in Paragraph 13 of this Regulation, a person may request that another time for taking the examination is specified in accordance with the procedures referred to in Paragraph 8 of this Regulation.

15. The examination shall test the theoretical knowledge of the person in the field of security guarding activities.

16. The room in which the examination is taken shall be under video surveillance. The data obtained in video surveillance shall be stored for three months.

17. The examination shall be taken in computerised form, providing answers to test questions. During the examination, a person shall consecutively respond to 40 questions by choosing an answer from the provided options. The time allocated for providing answers shall be 40 minutes, which shall be recorded by a computer. The examination shall be passed if the person has provided not more than four incorrect answers or left not more than four questions without an answer.

18. A person shall take the examination independently, without the assistance of other persons or ancillary materials. A person may not use laws and regulations, textbooks, notes, other study materials, electronic devices, electronic means of communication, and other ancillary means, as well as to talk to other persons taking the examination.

19. Results of the examination (passed or not passed) shall be shown on the monitor of the computer used by the person when responding to the test questions immediately after completion of the examination or after the end of the time allocated thereto.

20. A person has not passed the examination if:

20.1. the person has provided more than four incorrect answers or left more than four questions without an answer;

20.2. the person has not complied with the restrictions referred to in Paragraph 18 of this Regulation.

21. If the person who has not passed the examination wishes to re-take it, he or she shall apply for taking the examination in accordance with the procedures referred to in Paragraph 8 of this Regulation.

22. The examination may be re-taken for several times, paying the State fee for taking the examination each time.

23. If the examination has been successfully passed, its results shall be valid for 12 months from the day of passing the examination.

V. Issuance of the Security Guard Certificate

24. A person who has successfully passed the examination, as well as the person referred to in Paragraph 5 of this Regulation shall submit an application for the receipt of the security guard certificate (Annex 3) to the State Police. The following shall be appended to the application:

24.1. one photograph (2 x 3 cm) in paper or digital form that is not older than six months (to be submitted if there is no image of the face of the person in the Information System of Personal Identification Documents or if the person does not agree to the processing of such data);

24.2. a copy of a valid opinion issued by a psychiatrist and narcologist on the health condition of the person. If the opinion does not state the term of validity, not more than 90 days may have elapsed from the date of its issuance (this requirement shall not apply to a person who has undergone health examination at a medical treatment institution for the storage (possession) of weapons or for work with weapons, and information thereon in available in the Weapons Register or the Register of Licences and Certificates);

24.3. a copy of the certificate on the completion of a training course on basic first aid knowledge in the amount of 12 hours with a knowledge test of three hours or a copy of the medical education document, or a copy of the diploma and transcript of records of the educational institution which attest that the abovementioned person has completed the relevant training course at this educational institution;

24.4. a copy of an educational document attesting the completion of the educational programme referred to in Paragraph 2 of this Regulation or the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours.

25. If a person submits a copy of a document, he or she shall present its original.

26. Upon receipt of the application referred to in Paragraph 24 of this Regulation, the State Police shall check whether the necessary information has been indicated in the submission and the documents referred to in Paragraph 24 of this Regulation have been appended.

27. Prior to issuing the security guard certificate, the State Police shall check whether the restrictions specified in the Security Guard Activities Law do not apply to the person, and also ascertain whether the person (except for the person referred to in Paragraph 5 of this Regulation) has passed the examination and the payment of the State fee for the issuance of the security guard certificate has been received in the State budget.

28. The State Police shall take the decision to refuse to issue the security guard certificate, if:

28.1. the person does not submit the requested information or documents within the time period stipulated by the State Police;

28.2. the restrictions specified in the Security Guard Activities Law for the issuance of the security guard certificate apply to the person;

28.3. the person has not acquired the education necessary for the receipt of the security guard certificate;

28.4. the person has not passed the examination (except for the person referred to in Paragraph 5 of this Regulation);

28.5. the result of the examination is not valid;

28.6. the State fee for the issuance of the security guard certificate has not been paid.

29. If the decision to refuse to issue the security guard certificate has been taken due to the reasons referred to in Sub-paragraph 28.1, 28.2, or 28.6 of this Regulation, the person who submits a new application for the receipt of the security guard certificate need not retake the examination if not more than 12 months have passed since taking it.

30. If the reasons for refusal referred to in Paragraph 28 of this Regulation have not been established, the State Police shall, after receipt of the application referred to in Paragraph 24 of this Regulation, take the decision to issue the security guard certificate and shall issue the security guard certificate (Annex 4) to the person.

31. The Register of Licences and Certificates shall be used for the personalisation of the security guard certificate by obtaining the necessary data therefrom (the given name, surname, and personal identity number of the person, the date of issue, term of validity, and number of the security guard certificate), as well as the Information System of Personal Identification Documents by obtaining the image of the face of the person therefrom, if it is in the Information System and the person has given consent to the use thereof, and a relevant note shall be made on the application referred to in Paragraphs 24, 32, 37, 42, and 45 of this Regulation.

VI. Extending of the Term of Validity of the Security Guard Certificate without Taking the Examination

32. A person who wishes to extend the term of validity of the security guard certificate without taking the examination shall, not later than a month and not earlier than three months before the end of the term of validity of the security guard certificate, submit an application for extending the term of validity of the security guard certificate (Annex 5) to the State Police.

33. The following shall be appended to the application referred to in Paragraph 32 of this Regulation:

33.1. one photograph (2 x 3 cm) in paper of digital form that is not older than six months (to be submitted if there is no image of the face of the person in the Information System of Personal Identification Documents or if the person does not agree to the processing of such data);

33.2. a copy of a valid opinion issued by a psychiatrist and narcologist on the health condition of the person. If the opinion does not state the term of validity, not more than 90 days may have elapsed from the date of its issuance (this requirement shall not apply to a person who has undergone health examination at a medical treatment institution for the storage (possession) of weapons or for work with weapons, and information thereon in available in the Weapons Register and the Register of Licences and Certificates);

33.3. a copy of the educational document attesting completion of the educational programme referred to in Paragraph 2 of this Regulation or the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours;

33.4. a statement from the educational institution on the completed training courses (the persons referred to in Sub-paragraph 6.2 or 6.3 of this Regulation).

34. The State Police shall extend the term of validity of the security guard certificate for the time period of the term of validity of the security guard certificate indicated in the Security Guard Activities Law. The term of validity of the security guard certificate shall be extended or the decision not to extend it shall be taken in accordance with the procedures indicated in this Regulation which have been specified in relation to the issuance of the security guard certificate.

35. If a person to whom the conditions referred to in Sub-paragraph 6.1 of this Regulation are applicable has missed the time period for submitting the application referred to in Paragraph 32 of this Regulation, the State Police shall take the decision not to extend the term of validity of the security guard certificate and the person may receive the security guard certificate by resubmitting the submission referred to in Paragraph 24 of this Regulation.

36. If a person to whom the conditions referred to in Sub-paragraph 6.2 or 6.3 of this Regulation are applicable has missed the time period for submitting the submission referred to in Paragraph 32 of this Regulation, the State Police shall take the decision not to extend the term of validity of the security guard certificate. The person shall receive the security guard certificate after submitting the application referred to in Paragraph 8 of this Regulation and passing the examination.

VII. Extending of the Term of Validity of the Security Guard Certificate with Taking the Examination

37. A person who has not completed the training courses provided for in Sub-paragraph 6.3 of this Regulation within the term of validity of the security guard certificate and who wishes to extend the term of validity of the security guard certificate shall, not later than a month and not earlier than three months before the end of the term of validity of the security guard certificate, submit an application for extending the term of validity of the security guard certificate (Annex 6) to the State Police and shall take the examination in accordance with the procedures indicated in this Regulation.

38. The following shall be appended to the submission referred to in Paragraph 37 of this Regulation:

38.1. one photograph (2 x 3 cm) in paper or digital form that is not older than six months (to be submitted if there is no image of the face of the person in the Information System of Personal Identification Documents or if the person does not agree to the processing of such data);

38.2. a copy of a valid opinion issued by a psychiatrist and narcologist on the health condition of the person. If the opinion does not state the term of validity, not more than 90 days may have elapsed from the date of its issuance (this requirement shall not apply to a person who has undergone health examination at a medical treatment institution for the storage (possession) of weapons or for work with weapons, and information thereon in available in the Weapons Register and the Register of Licences and Certificates);

38.3. a copy of the educational document attesting completion of the educational programme provided for in Sub-paragraph 2.1 of this Regulation or the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours.

39. The person shall take the examination in accordance with the procedures specified in Chapter IV of this Regulation.

40. The State Police shall extend the term of validity of the security guard certificate for the time period of the term of validity of the security guard certificate indicated in the Security Guard Activities Law. The term of validity of the security guard certificate shall be extended or the decision not to extend it shall be taken in accordance with the procedures indicated in this Regulation which have been specified in relation to the issuance of the security guard certificate.

41. If a person has missed the time period for submitting the application referred to in Paragraph 37 of this Regulation, the State Police shall take the decision not to extend the term of validity of the security guard certificate and the person may receive the security guard certificate by resubmitting the application referred to in Paragraph 8 of this Regulation and taking the examination.

VIII. Issuance of a Duplicate of the Security Guard Certificate or Repeat Certificate

42. If the security guard certificate has been lost, stolen, or damaged, a person shall submit an application for the receipt of a duplicate of the security guard certificate or a repeat security guard certificate (Annex 7) to the State Police and pay the State fee for the issuance of a duplicate of the security guard certificate. One photograph (2 x 3 cm) in paper or digital form that is not older than six months (to be submitted if there is no image of the face of the person in the Information System of Personal Identification Documents or if the person does not agree to the processing of such data) shall be appended to the submission.

43. Upon receipt of the application referred to in Paragraph 42 of this Regulation, the State Police shall ascertain whether the payment of the State fee has been transferred into the State budget, and issue a duplicate of the security guard certificate within five working days after receipt of the application. If the person has not paid the State fee, the State Police shall take the decision not to issue a duplicate of the security guard certificate.

44. A duplicate of the security guard certificate shall be drawn up in accordance with the procedures referred to in Paragraph 31 of this Regulation, indicating the word "Duplicate" in addition.

45. If the person has changed the given name or surname, he or she shall submit an application for the receipt of a duplicate of the security guard certificate or a repeat security guard certificate (Annex 7) to the State Police and pay the State fee for the issuance of a repeat security guard certificate. One photograph (2 x 3 cm) in paper or digital form that is not older than six months (to be submitted if there is no image of the face of the person in the Information System of Personal Identification Documents or if the person does not agree to the processing of such data) shall be appended to the submission.

46. Upon receipt of the application referred to in Paragraph 45 of this Regulation, the State Police shall ascertain whether the payment of the State fee has been transferred into the State budget, and issue a repeat security guard certificate within five working days after receipt of the application. If the person has not paid the State fee, the State Police shall take the decision not to issue a repeat security guard certificate.

47. A repeat security guard certificate shall be drawn up in accordance with the procedures referred to in Paragraph 31 of this Regulation, indicating the new given name or surname of the person accordingly and indicating the word "Repeat" in addition.

IX. Procedures for and Amount in which the State Fee for Taking the Examination, Issuing the Security Guard Certificate, its Duplicate, and a Repeat Certificate, and Extending the Term of Validity of the Security Guard Certificate shall be Paid

48. The State Fee for taking the examination, issuing the security guard certificate, its duplicate, and a repeat certificate, and extending the term of validity of the security guard certificate shall be paid in the following amount:

48.1. for taking the examination - EUR 40;

48.2. for the issuance of the security guard certificate - EUR 20;

48.3. for extending the term of validity of the security guard certificate - EUR 20;

48.4. for the issuance of a repeat security guard certificate - EUR 20;

48.5. for the issuance of a duplicate the security guard certificate - EUR 20.

49. A person shall pay the State fee for taking the examination prior to submitting the application referred to in Paragraph 8 of this Regulation.

50. A person shall pay the State fee for the issuance of the security guard certificate, extending the term of validity of the security guard certificate, issuance of a duplicate the security guard certificate or a repeat security guard certificate prior to submitting the application referred to in Paragraphs 24, 32, 37, 42, and 45 of this Regulation.

51. If a person has not taken the examination within the time period determined by the State Police and more than 12 months have elapsed from the day of paying the State fee, the State fee for taking the examination shall be paid anew.

52. The State fee shall be paid with the intermediation of a payment institution which has the right to provide payment services within the meaning of the Law on Payment Services and Electronic Money. The State fee shall be transferred into the State basic budget.

X. Closing Provisions

53. The security guard certificate shall be issued to a person who has completed the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours according to the same procedures as specified for the person who has completed the vocational in-service educational programme "Educational Programme for Basic Level Knowledge in Security Guarding Activities" in the amount of 84 hours.

54. Until 1 July 2018, educational institutions may continue the implementation of the vocational in-service educational programme "Security Guard Activities" (code: 20P 861 00) in the amount of 160 hours and issue educational documents attesting the completion of the educational programme.

55. Until 1 July 2018, the term of validity of the security guard certificate shall be extended in accordance with the procedures specified in Chapter VI of this Regulation, without applying the requirement regarding the need to complete the training courses provided for in Sub-paragraph 6.3 of this Regulation.

56. The security guard certificates issued until the day of coming into force of this Regulation shall be valid until the end of their term of validity.

57. Paragraph 16 of this Regulation shall come into force on 1 July 2018.

58. This Regulation shall come into force on 2 July 2017.

Notes.

1. 1. The application and the documents to be appended thereto or their copies shall be submitted in paper form or in the form of an electronic document in accordance with the laws and regulations regarding drawing up of electronic documents.

Sample Security Guard Certificate

1. General structure of the security guard certificate:

1.1. the format of the certificate conforms to ID-1 format;

1.2. length 85.47-85.72 mm;

1.3. width 53.92-54.03 mm;

1.4. thickness 0.76 ± 0.08 mm;

1.5. rounding radius of the corner 3.18 ± 0.30 mm;

1.6. polyvinyl chloride (PVC) multilayer laminated card is used for the certificate. The surface of the card - polished smooth, appropriate for personalisation with dye sublimation and dye thermal transfer printer.

3.1. fine-line anticopying and anti-counterfeit pattern with the lesser coats of arms of the Republic of Latvia in the background in two Pantone colours - Pant CoolGrey, Pant 559;

3.2. micro-print line with the micro-text "LATVIJAS REPUBLIKA VALSTS POLICIJA";

3.3. background printing integrated in the image of the face, using vector lines without raster;

5.4.3. 2nd channel - capital letters "LV" placed in the middle of the hologram around which contour in different colours has been inscribed which, in turn, has been multiplied several times from larger to smaller, thus creating a small illusion of movement for the LV letters. Each contour is in different colour so that there would be a higher resolution for them. Background of the hologram - brilliant silver colour without an inscription.
