Regulations Regarding the Implementation of the First, Second, and Third Project Application Selection Round for the Activity 1.1.1.5 "Support for International Cooperation Projects in Research and Innovation" of the Specific Objective 1.1.1 "To Increase the Research and Innovative Capacity of Scientific Institutions of Latvia and the Ability to Attract External Financing, Investing in Human Resources and Infrastructure" of the Operational Programme "Growth and Employment"

I. General Provisions

1. This Regulation prescribes:

1.1. the procedures by which the first, second, and third round of project application selection within the scope of the Activity 1.1.1.5 "Support for International Cooperation Projects in Research and Innovation" of the Specific Aid Objective 1.1.1 "To increase the research and innovative capacity of scientific institutions of Latvia and the ability to attract external financing, investing in human resources and infrastructure" (hereinafter - the Specific Aid Objective) of the Priority Action "Research, Technology Development and Innovations" of the Operational Programme "Growth and Employment" (hereinafter - the Activity) shall be implemented;

1.2. the objective of the Activity;

1.3. the funding available to the Activity and selection rounds thereof;

1.4. the requirements for a European Regional Development Fund project (hereinafter - the project) applicant and cooperation partners of the project;

1.5. the eligibility conditions of aided activities and costs;

1.6. the conditions and procedures for the application of simplified costs;

1.7. the conditions for a unilateral termination of an agreement or contract for the implementation of a project.

2. The following terms are used in this Regulation:

2.1. a project of non-economic nature - a project conforming to the following criteria:

2.1.1. within the scope of the first round the project is implemented by the project applicant referred to in Paragraph 12 of this Regulation, within the scope of the second round - a scientific institution conforming to the definition of a research organisation referred to in Sub-paragraph 2.19 of this Regulation, whereas within the scope of the third round - a scientific institution conforming to the definition of a research organisation referred to in Sub-paragraph 2.19 of this Regulation or an institution of direct administration;

2.1.2. activities implemented within the scope of the project conform to the conditions referred to in Sub-paragraph 2.5 of this Regulation;

2.2. a project of economic nature - a project conforming to one or both of the criteria listed below:

2.2.1. the project is implemented by a scientific institution or by an enterprise registered in the Commercial Register of the Republic of Latvia;

2.2.2. activities of economic nature are implemented within the scope of the project;

2.3. Baltic Bonus programme - a financial aid programme funded from the State budget and having an aim to promote international cooperation in science and innovations, including by supporting cooperation between the research workers of the Baltic States, inter alia sub-programme calls for proposals of the programme "Horizon 2020", programme EURATOM, EUROSTARS-2, EUREKA, Joint Technology Initiatives of the Joint Baltic Sea Research and Development Programme BONUS, and ERA-NET COFUND project competitions;

2.4. start of work - obligations conforming to the definition laid down in Article 2(23) of the Commission Regulation No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty (hereinafter - Commission Regulation No 651/2014);

2.5. activity of non-economic nature - activity of a research organisation which does not fall within the scope of activity specified in Article 107(1) of the Treaty on the Functioning of the European Union, including:

2.5.1. educational activities to achieve an increase in the number and qualification of the personnel;

2.5.2. independent research and development to acquire more knowledge and a better understanding, including joint research and development by involvement of the research organisation in efficient cooperation;

2.5.3. dissemination of research results without exclusivity and discrimination, including through the use of teaching, free access databases, open publications or open source software;

2.5.4. knowledge and technology transfer, if:

2.5.4.1. the activities of knowledge and technology transfer are performed by a division of the research organisation or a subsidiary undertaking of the research organisation, which is such commercial company in which the participation share of the parent undertaking exceeds 50 per cent or in which the parent undertaking has majority of votes and which conforms to the definition of the research organisation, the research organisation together with other research organisations or the research organisation with third parties, concluding contracts regarding certain services in an open competition;

2.5.4.2. any profit from such activity is reinvested in primary activities of the research organisation;

2.6. effective co-operation - collaboration conforming to Article 2(90) of Commission Regulation No 651/2014;

2.7. European Strategy Forum on Research Infrastructures (ESFRI) - a strategic tool developed by the Council of Europe in 2002 to promote scientific integration in Europe, ensuring open access to high-quality research infrastructure;

2.8. experimental development - a research category conforming to conditions referred to in Article 2(86) of Commission Regulation No 651/2014;

2.9. ERA-NET (European Research Area Network) COFUND projects - projects developed by the members of the European Research Area Collaboration Network (State administrative institutions funding scientific activity, including administration of the national research programmes) aimed at facilitating closer integration of the European Research Area and the members thereof by supporting collaboration between scientists, free movement of knowledge and technologies therein, and also to promote the coordination of the implementation of national research programmes at transnational level. Multiple calls for proposals for research and technological development projects are organised within the scope of the ERA-NET COFUND projects, and the European Commission grants co-funding to first of such projects;

2.10. ERIC consortium - the European Research Infrastructure Consortium - established pursuant to Council Regulation (EC) No 723/2009 of 25 June 2009 on the Community legal framework for a European Research Infrastructure Consortium (ERIC) (Official Journal of the European Union, 08.08.2009, L 206);

2.11. portal EURAXESS - an European level portal (https://euraxess.ec.europa.eu/) which has been created for the purpose of providing a contemporary and convenient environment for the exchange of information to ensure international and sectoral mobility of scientists within the scope of the European Research Area;

2.12. fundamental research - a research category conforming to conditions referred to in Article 2(84) of Commission Regulation No 651/2014;

2.13. undertaking in difficulty - an enterprise which conforms to the definition laid down in Article 2(18) of Commission Regulation No 651/2014;

2.14. Joint Programming Initiatives - initiatives of the European Commission for implementing research in areas important to the public by pooling the resources of the European Union Member States. Within the framework of these initiatives, the European Union Member States elaborate the Strategic Research Agenda based upon a common vision of how to address major societal challenges, including through the application of the tools of "Horizon 2020", and also ensuring the financial contribution of the Member States;

2.15. ECSEL Joint Undertaking (Electronic Components and Systems for European Leadership (ECSEL)) - public-private partnerships in the form of Joint Technology Initiative Undertaking 'Electronic Components and Systems for European Leadership' established by Council Regulation (EU) No 561/2014 of 6 May 2014 establishing the ECSEL Joint Undertaking (Official Journal of the European Union, 07.06.2014, L 169), merging joint undertakings in the areas of the nanoelectronics and embedded computing systems with the Technology Platform on Smart Systems Integration;

2.16. large enterprise - an enterprise which conforms to the definition laid down in Article 2(24) of Commission Regulation No 651/2014;

2.17. National Contact Point - a structural unit of the State Education Development Agency to ensure the implementation of the functions of the National Contact Point of the programme "Horizon 2020";

2.18. research - activities which cover one or multiple research categories and intended for completing a precise undivided task of economic, scientific or technical nature with pre-defined, clear objectives. A research project can be composed of multiple work packages, and it includes clear objectives, activities to be carried out to achieve the relevant objectives (including their estimated costs), and also definite results to determine the outcome of these activities and to compare it with the relevant objectives. If two or more research projects are not clearly separable from each other, in particular when they do not have an independent probability of technological success, they shall be considered as a single project;

2.19. research organisation - an institution which conforms to the definition laid down in Article 2(83) of Commission Regulation No 651/2014;

2.20. full-time equivalent - the total number of hours worked in research activities by the employee employed in the field of science (including the annual paid leave) which should be spent within the normal working hours in the relevant calendar year;

2.21. programme "Horizon 2020" - European Union Framework Programme for Research and Innovation "Horizon 2020";

2.22. public funding intensity - total amount of the funding from the European Regional Development Fund in percentage from the total eligible costs of the project;

2.23. industrial research - research category conforming to the definition laid down in Article 2(85) of Commission Regulation No 651/2014;

2.24. economic activity - any activity which includes offering of goods or services on the market, including lease of research infrastructure, services implemented upon assignment of enterprises or contractual research;

2.25. micro, small and medium-sized enterprise - an enterprise which conforms to the definition laid down in Article 2(2) of Commission Regulation No 651/2014;

2.26. technical-economic feasibility study - activities conforming to the definition laid down in Article 2(87) of Commission Regulation No 651/2014;

2.27. technology rights - the know-how and other rights or their combination, including applications for the aforementioned rights or registration applications conforming to the definition laid down in Article 1(b) of Commission Regulation (EU) No 316/2014 of 21 March 2014 on the application of Article 101(3) of the Treaty on the Functioning of the European Union to categories of technology transfer agreements (Official Journal of the European Union, 28.03.2014, L 93) (hereinafter - Commission Regulation No 316/2014);

2.28. knowledge and technology transfer - any process having the objective to obtain, aggregate, and disseminate clear knowledge not expressed in words, including skills and competence both in economic activities and activities of non-economic nature, for example, research cooperation, consultations, licensing, establishment of new undertakings, publications, and mobility of researchers and other employees who are involved in these activities. Besides scientific and technological knowledge, it also includes other kinds of knowledge such as knowledge of the use of standards and regulations embedding them and of conditions of real life operating environments and methods for organisational innovation, and also management of knowledge related to identifying, acquiring, protecting, defending and exploiting intangible assets;

2.29. scientific staff - leading researchers, researchers, and scientific assistants elected in accordance with the laws and regulations governing scientific activity, and also persons working in a commercial company who fulfil the duties of a leading researcher, researcher, and scientific assistant;

2.30. scientific institution - a scientific institute registered in the Register of Scientific Institutions of the Republic of Latvia (a public agency, a derived public person, a structural unit of a State institution of higher education, a legal person governed by private law or a structural unit thereof) or an institution of higher education.

3. The objective of the Activity is to promote the development of bilateral and multilateral cooperation projects of the European Research Area and participation in international research, networking, and twinning measures, infrastructure objects of the European Strategy Forum on Research Infrastructures, by also providing support to strengthen the capacity of the National Contact Point.

4. The target group of the Activity is scientific institutions, scientific staff, enterprises registered in the Register of Enterprises of the Republic of Latvia, and the National Contact Point.

5. The following supervision indicators should be achieved within the Activity:

5.1. outcome indicator:

5.1.1. the number of project applications submitted within the scope of the programme "Horizon 2020", including within the scope of the Baltic Bonus programme, which by 31 December 2018 are evaluated above the quality threshold and are supported by the European Regional Development Fund - 154;

5.1.2. the number of project applications submitted within the scope of the programme "Horizon 2020" and within the scope of the 9th Framework Programme of the European Union, including the Baltic Bonus programme, which by 31 December 2023 are evaluated above the quality threshold and are supported by the European Regional Development Fund -1029;

5.2. financial indicator - until 31 December 2018 expenditures in the amount of EUR 4 809 228 are certified;

5.3. result indicator - joint result of the Specific Aid Objective 1.1.1 "To increase the research and innovative capacity of scientific institutions of Latvia and the ability to attract external financing, investing in human resources and infrastructure" of the Priority Action "Research, Technology Development and Innovations" of the Operational Programme "Growth and Employment" by 31 December2023:

5.3.1. the average number of scientific publications per one full time equivalent of scientific personnel per year - 0.48;

5.3.2. external funding attracted by the State and higher education sector for scientific research work - EUR 160 600 000;

6. The functions of the responsible institution within the scope of the Activity shall be carried out by the Ministry of Education and Science (hereinafter - the responsible institution).

7. The total eligible funding intended for the Activity shall be EUR 32 552 786, including the funding from the European Regional Development Fund in the amount of EUR 27 669 868 and co-funding from the State budget in the amount of EUR 4 882 918.

8. The maximum eligible amount of funding from the European Regional Development Fund for a project of non-economic nature implemented in the first, second, and third round shall not exceed 85 per cent of the total eligible funding of the project. The necessary national co-financing shall be ensured from the State budget, and it shall not exceed 15 per cent of the total eligible funding of the project.

9. In order to conclude an agreement or contract for the implementation of a project, until 31 December 2018 the total available eligible funding in selection rounds shall be EUR 23 537 360, including funding from the European Regional Development Fund - EUR 20 066 756, and co-funding from the State budget - EUR 3 530 604. From 1 January 2019, the responsible institution may propose to increase the total eligible funding up to the planned maximum amount of funding referred to in Paragraph 7 of this Regulation pursuant to provisions laid down in Paragraph 39 of this Regulation, according to a decision of the European Commission on execution of the performance framework determined by the European Regional Development Fund for Priority Action "Research, Technology Development and Innovations".

10. The project applicant of the selection round specified in Paragraphs 12, 35, and 54 of this Regulation who after concluding an agreement or contract for the implementation of a project is also the beneficiary of the funding from the European Regional Development Fund (hereinafter - the beneficiary) shall prepare and submit in accordance with the requirements laid down in the project application selection round regulations within the specified deadline the project application to the cooperation institution through the Information System for the Management of the Cohesion Policy Funds 2014-2020.

II. Conditions for the Implementation of First Round Projects

11. The first round shall be implemented in the form of restricted selection of project applications.

12. In the first round the project applicant shall be:

12.1. the Ministry of Education and Science;

12.2. the State Education Development Agency.

13. In the first round each project applicant shall submit one application for a project of non-economic nature and shall implement it individually.

14. The total eligible funding planned for the first round shall be EUR 16 635 686, including the funding from the European Regional Development Fund - EUR 14 140 333 and co-funding from the State budget - EUR 2 495 353.

15. The total eligible funding planned for the project applicant shall not exceed:

15.1. for the Ministry of Education and Science - EUR 10 806 632 (funding from the European Regional Development Fund - EUR 9 185 637, and the co-funding from the State budget - EUR 1 620 995);

15.2. for the State Education Development Agency - EUR 5 829 054 (funding from the European Regional Development Fund - EUR 4 954 696, and the co-funding from the State budget - EUR 874 358).

16. The total eligible funding available to the project applicant until 31 December 2018 to conclude an agreement for the implementation of a project shall not exceed:

16.1. for the Ministry of Education and Science - EUR 6 688 082 (funding from the European Regional Development Fund - EUR 5 684 870, and the co-funding from the State budget - EUR 1 003 212;

16.2. for the State Education Development Agency - EUR 5 776 894 (funding from the European Regional Development Fund - EUR 4 910 360, and the co-funding from the State budget - EUR 866 534).

17. The following indicators shall be achieved in the first round by 31 December 2023:

17.1. within a project of the project applicant referred to in Sub-paragraph 12.1 of this Regulation:

17.1.1. supervision indicator - the number of project applications submitted within the scope of the programme "Horizon 2020" and within the scope of the 9th Framework Programme of the European Union supported by the European Regional Development Fund and evaluated above the quality threshold, including not less than 10 projects supported and financed by the European Regional Development Fund in Joint Programming Initiatives;

17.1.2. specific outcome indicators:

17.1.2.1. participation in five Joint Programming Initiatives has been ensured;

17.1.2.2. the World Congress of Latvian Scientists has been held in Latvia;

17.2. within a project of the project applicant referred to in Sub-paragraph 12.2 of this Regulation:

17.2.1. supervision indicator - the number of project applications submitted within the scope of the programme "Horizon 2020" and within the scope of the 9th Framework Programme of the European Union supported by the European Regional Development Fund and evaluated above the quality threshold, including:

17.2.1.1. not less than 10 projects supported and financed by the European Regional Development Fund within the scope of ERA-NET COFUND projects;

17.2.1.2. the financing of the preparation of not less than 65 projects that have been submitted within the scope of the programme "Horizon 2020" and the 9th Framework Programme of the European Union and evaluated above the quality threshold, and for the preparation of which no support has been received in the second round has been supported within the time period from 2014 to 2023;

17.2.2. specific outcome indicator - a plan on extension of the scope of activity and increasing of efficiency of the National Contact Point has been implemented until the completion of the project for support in participation in the programme "Horizon 2020" and the 9th Framework Programme of the European Union;

17.3. upon implementing the activities to be supported referred to in Sub-paragraphs 19.2.3 and 20.4 of this Regulation, the following specific outcome indicators:

17.3.1. original scientific articles that have been published:

17.3.1.1. in magazines or conference symposia the quoting index whereof reaches at least 50 per cent of the average quoting index of the sector;

17.3.1.2. in magazines or conference symposia included in the Web of Science or SCOPUS (A or B) databases;

17.3.2. technology rights:

17.3.2.1. patents;

17.3.2.2. other non-material assets;

17.3.3. intellectual property licence contracts;

17.3.4. prototype of a new product or technology;

17.3.5. new treatment and diagnostic techniques (including a non-commercial technique) supplementing the indicators referred to in Sub-paragraphs 17.3.1, 17.3.2, 17.3.3, and 17.3.4 of this Regulation;

17.3.6. other indicators conforming to the specific character of the research or project (including data) supplementing the indicators referred to in Sub-paragraphs 17.3.1, 17.3.2, 17.3.3, and 17.3.4 of this Regulation.

18. The project applicant shall prepare and submit the project application to the cooperation institution pursuant to the requirements laid down in the project application selection round regulations. The following documents shall be appended in Annex:

18.1. for a project of the Ministry of Education and Science:

18.1.1. an action plan for participation in Joint Programming Initiatives which has been coordinated with the ministries of the relevant sectors and is implemented until the completion of the project;

18.1.2. a plan of communication activities for strengthening international cooperation implemented until the completion of the project and ensures complementarity with the activities to be supported within the scope of the Activity 1.2.1.2 "Support for Improvement of Technology Transfer System" (hereinafter - Activity 1.2.1.2) of the Specific Support Objective 1.2.1 "To increase investments of private sector in R&D" of the Operational Programme "Growth and Employment" implemented by the Investment and Development Agency of Latvia;

18.2. for a project of the State Education Development Agency:

18.2.1. an implementation plan for the extension of the scope of activity and increasing the efficiency of the National Contact Point which has been coordinated with the Latvian Academy of Sciences, Association of State Scientific Institutes, Latvian Association of Young Scientists, Rector's Council, Latvian Chamber of Commerce and Industry, and the Ministry of Education and Science, and which defines the activities funded from the State budget and activities to be supported in the project, ensuring complementarity and avoiding overlapping. The referred to plan shall be implemented until the completion of the project;

18.2.2. a plan for participation in indicative ERA-NET COFUND activity projects, taking into account the priority directions, the priorities of the Smart Specialisation Strategy, the implemented State research programmes and proposals of scientific institutions that is implemented until the completion of the project;

18.2.3. regulations laying down the procedures for granting aid to prepare projects submitted for calls for proposals under the sub-programmes of the programme "Horizon 2020" and evaluated above the quality threshold.

19. The beneficiary - the Ministry of Education and Science - shall implement the following activities to be supported within the scope of the project:

19.1. strengthening the representation of the Latvian research and development interests in programme committees of the programme "Horizon 2020" and other international programmes, including by ensuring a thorough analysis of the Smart Specialisation Strategy of Latvia and the field of specialisation defined within the scope thereof;

19.2. events of national level for the extension of international cooperation, including:

19.2.1. the purposeful building of relations and cooperation with the Latvian diaspora abroad for the implementation of joint research and development measures and extension of cooperation opportunities, including identification of Latvian scientists abroad and the analysis of previous measures of mutual cooperation and communication;

19.2.2. purposeful cooperation with Latvian and foreign economic and diplomatic missions to expand and obtain more thorough cooperation contacts, including preparation of appropriate information and communication materials by concurrently defining activities financed from the State budget and activities to be supported within the scope of the project, ensuring complementarity and avoiding overlapping with the activities implemented by the Investment and Development Agency of Latvia;

19.2.3. ensuring participation of Latvia in international research and development cooperation initiatives, primarily - in Joint Programming Initiatives, including the allocation of adequate participation funding and ensuring funding of the share of Latvian partners in projects of non-economic nature within the scope thereof pursuant to the activities to be supported and eligible costs determined in the relevant Joint Programming Initiative;

19.2.4. implementation of communications campaign, including target group studies, if necessary;

19.2.5. organisation of the World Congress of Latvian Scientists in 2018;

19.3. the extension of the functionality of the National Scientific Activity Information System and data integration solutions with other information systems or databases, including by ensuring complementarity with the activities to be supported under the Activity 1.2.1.2 implemented by the Investment and Development Agency of Latvia;

19.4. implementation of the project publicity and communication measures as defined in Regulation (EU) No 1303/2013 of the European Parliament and of the Council of 17 December 2013 laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for Rural Development and the European Maritime and Fisheries Fund and laying down general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Fisheries Fund and repealing Council Regulation (EC) No 1083/2006 (Official Journal of the European Union, 20.12.2013, L 347) (hereinafter - Regulation No 1303/2013 of the Parliament and of the Council), and in the laws and regulations regarding the procedures by which the requirements for communication and visual identity shall be ensured in introduction of the European Union Structural Funds and the Cohesion Fund in the 2014-2020 programming period;

19.5. project management.

20. The beneficiary - the State Education Development Agency - shall implement the following activities to be supported within the scope of the project:

20.1. measures for the extension of the scope of activity and increasing the efficiency of the National Contact Point:

20.1.1. ensuring of informative and advisory expertise and strengthening of the competence of the National Contact Point, including:

20.1.1.1. additional attraction of experts with appropriate qualification;

20.1.1.2. participation of the experts of the National Contact Point in events organised within the scope of the programme "Horizon 2020" and specialised training;

20.1.1.3. development of a database for the clients of the National Contact Point - potential project applicants under the programme "Horizon", including integration with the National Scientific Activity Information System;

20.1.1.4. provision of consultations and training events for the potential project applicants under the programme "Horizon 2020";

20.1.2. ensuring the activity of the EURAXESS portal in Latvia by facilitating the international and sectoral mobility of scientists, and provision of information on career opportunities in the field of science in Latvia;

20.1.3. mid-term and final evaluation of Latvia's participation in the programme "Horizon 2020";

20.2. ensuring of expertise in the selection of research applications under the Activity 1.1.1.2 "Post-doctoral Research Aid" (hereinafter - the Activity 1.1.1.2) of the Specific Aid Objective 1.1.1 "To increase the research and innovative capacity of scientific institutions of Latvia and the ability to attract external financing, investing in human resources and infrastructure" of the Priority Action "Research, Technology Development and Innovations" of the Operational Programme "Growth and Employment", starting from the implementation of the second round of project application selection under the Activity 1.1.1.2;

20.3. funding of the preparation of a project submitted within the scope of the programme "Horizon 2020" and within the scope of the 9th Framework Programme of the European Union and evaluated above the quality threshold (avoiding overlapping with the activities to be supported and eligible costs of the projects implemented in the second round), if funding of the European Structural and Investment Funds or the State budget has not been received for the preparation of the relevant project within the scope of the Baltic Bonus programme within the time period from 2014 to 2016;

20.4. ensuring the participation of Latvia in ERA-NET COFUND project consortiums and ensuring funding of the share of Latvian partners in research projects of non-economic nature submitted and supported within the scope of open calls for proposals and supervision thereof in accordance with the activities to be supported that are determined in the relevant ERA-NET COFUND project and with eligible costs in such selection rounds where co-funding of the European Commission has not been granted from the funds of the programme "Horizon 2020";

20.5. project management;

20.6. implementation of project publicity and communication measures in accordance with the provisions laid down in the Regulation No 1303/2013 of the Parliament and of the Council.

21. The following cost items shall be eligible in the first round:

21.1. the direct eligible costs of the project for the performance of activities referred to in Paragraphs 19 and 20 of this Regulation:

21.1.1. the direct eligible personnel costs:

21.1.1.1. the costs of the remuneration of the project management personnel (except for overtime), taking into account that:

21.1.1.1.1. such costs form up to five per cent of the total eligible costs of the project and do not exceed EUR 56 580 per year for the project applicant - the Ministry of Education and Science - for the implementation of the activity referred to in Sub-paragraph 19.5 of this Regulation;

21.1.1.1.2. such costs form up to five per cent of the total eligible costs of the project and do not exceed EUR 56 580 per year for the project applicant - the State Education Development Agency - for the implementation of the activity referred to in Sub-paragraph 20.5 of this Regulation;

21.1.1.2. the costs of the remuneration of the project implementation personnel (except for overtime) for the implementation of the activities referred to in Sub-paragraphs 19.1, 19.2, 19.3, 20.1, 20.2, 20.3, and 20.4 of this Regulation;

21.1.2. health insurance costs and mandatory health examination costs for the project management and implementation personnel of the beneficiary. If health insurance is provided at the institution of the beneficiary and the abovementioned personnel is employed within the normal working hours, the health insurance costs shall be eligible in the amount of 100 per cent. If the personnel is employed part-time or half-time, the health insurance costs shall be eligible in proportion to the distribution of the workload in percentage. Health insurance costs shall be eligible only for the period when the abovementioned personnel is employed in the project;

21.1.3. the costs of the acquisition of equipment (office furniture and devices, computer software and licences) for newly created workplaces in the amount of up to EUR 3000 per one workplace in the whole period of project implementation. Costs of the acquisition of equipment for newly created workplaces, including costs of the maintenance and repair of the equipment, shall be eligible in the amount of up to EUR 3000 per one workplace in the whole period of project implementation, if the project management or implementation personnel is employed in the project in the amount of at least 30 per cent of normal working hours on the basis of an employment contract. If the project management or implementation personnel is employed part-time or half-time, the costs of the acquisition of equipment for a newly created workplace shall be eligible in proportion to the distribution of the workload in percentage;

21.1.4. the costs of business travels (inland and foreign) and work trips for project management and implementation personnel in accordance with the laws and regulations regarding the procedures by which expenses related to business travels shall be reimbursed, if such are justified and related to the implementation of the project;

21.1.5. the transport costs (payment for fuel, lease of vehicles, purchase of transport services, payment for the use of public transport);

21.1.6. the service costs of the implementation of the activities referred to in Sub-paragraphs 19.1, 19.2, 19.3, 19.4, 20.1, and 20.6 of this Regulation. If the service provider is a natural person and he or she has not registered as a self-employed person at the State Revenue Service, the mandatory State social insurance contributions of the employer shall be also eligible;

21.1.7. the costs of the elaboration and publishing of informative and training materials for the implementation of the activities referred to in Sub-paragraphs 19.2 and 20.1 of this Regulation;

21.1.8. the costs related to organisation and implementation of seminars, discussions, and conferences, including lease of premise, if premises outside the legal address of the beneficiary are needed to be leased for the implementation of the activities, and costs of ensuring handout materials for the implementation of the activities referred to in Sub-paragraphs 19.1, 19.2, 20.1, 20.3, and 20.4 of this Regulation;

21.1.9. the value added tax for direct eligible costs of the project, if the beneficiary cannot retrieve it from the State budget in accordance with the laws and regulations of the Republic of Latvia in the field of tax policy;

21.1.10. the costs of information and publicity events of the project in accordance with the laws and regulations regarding the procedures by which the requirements for communication and visual identity shall be ensured in introduction of the European Union Structural Funds and the Cohesion Fund in the 2014-2020 programming period, for the implementation of the activities to be supported referred to in Paragraphs 19 and 20 of this Regulation;

21.1.11. the costs of the preparation of a project application under the programme "Horizon 2020" referred to in Sub-paragraph 20.3 of this Regulation that until coordination of the methodology for costs of one unit elaborated by the Ministry of Education and Science with the managing authority does not exceed EUR 9000, if the project applicant is the coordinator of the project application for the programme "Horizon 2020" and do not exceed EUR 6000, if the project applicant is the partner of the project application, taking into account the following restrictions on actual costs:

21.1.11.1. foreign travels to plan the preparation of the project application shall not be longer than four days and costs thereof shall not exceed EUR 1500;

21.1.11.2. the remuneration costs of the preparation of the projects referred to in Sub-paragraph 20.3 of this Regulation shall be determined in accordance with the internal remuneration policy of the beneficiary, and:

21.1.11.2.1. shall not exceed 400 working hours for scientific staff, if submitting the project application for the programme "Horizon 2020" as a coordinator;

21.1.11.2.2. shall not exceed 200 working hours for scientific staff, if submitting the project application for the programme "Horizon 2020" as a partner;

21.1.11.2.3. shall not exceed 35 working hours for an administrative head;

21.1.12. costs of the activities of Latvia's partners in research projects submitted and supported in open calls for proposals within the scope of ERA-NET COFUND projects;

21.2. indirect eligible costs of the project for the performance of the activities referred to in Paragraphs 19 and 20 of this Regulation. Such costs shall be planned as one cost item by applying the flat rate of indirect costs in the amount of 15 per cent of the direct eligible costs of the personnel referred to in Sub-paragraph 21.1.1 of this Regulation. The flat rate of indirect costs shall be applied for personnel costs which have been incurred on the basis of an employment contract (or when appointing in the position upon an order, if applicable).

22. In planning the direct eligible costs of the personnel referred to in Sub-paragraph 21.1.1 of this Regulation, the beneficiary shall ensure that the project management and implementation personnel is employed full-time or part-time in the amount of not less than 30 per cent from normal working hours by keeping an accurate account of the working hours of the project management and implementation personnel regarding the functions performed and time worked.

23. In order to ensure the activity to be supported referred to in Sub-paragraph 20.3 of this Regulation, aid shall be provided for:

23.1. the preparation of an application for a project of non-economic nature under the programme "Horizon 2020", if it conforms to the requirements specified in Sub-paragraph 2.1 of this Regulation;

23.2. the preparation of an application for a project of economic nature under the programme "Horizon 2020", if it conforms to the requirements specified in Sub-paragraph 2.2 of this Regulation.

24. Aid to the Activity referred to in Sub-paragraph 23.2 of this Regulation shall be provided in accordance with Commission Regulation (EU) No 1407/2013 of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid (Official Journal of the European Union, 24.12.2013, L 352) (hereinafter - Commission Regulation No 1407/2013) and the laws and regulations regarding the procedures for accounting and granting of de minimis aid and samples of de minimis aid accounting forms, and it shall be considered as the aid to commercial activity. Procedures by which the project applicant specified in Sub-paragraph 12.2 of this Regulation grants aid for financing the preparation of a project of economic nature shall be determined in the aid programme implementation regulations.

25. Prior to granting the de minimis aid the project applicant referred to in Sub-paragraph 12.2 of this Regulation shall verify whether the amount of the aid together with the de minimis aid granted in the relevant fiscal year and the two preceding fiscal years does not exceed the maximum amount of the total de minimis aid specified in Article 3(2) of Commission Regulation No 1407/2013. The amount of de minimis aid is evaluated at the level of one single undertaking.

26. One single undertaking is an enterprise which conforms to conditions of Article 2(2) of Commission Regulation No 1407/2013.

27. The project applicant referred to in Sub-paragraph 12.2 of this Regulation and the beneficiary of the aid referred to in Sub-paragraph 23.2 of this Regulation shall ensure the availability of information on de minimis aid for a period of 10 years, counting from the day on which the aid was granted pursuant to conditions laid down in Article 6(4) of Commission Regulation No 1407/2013.

28. The project applicant referred to in Sub-paragraph 12.2 of this Regulation shall not grant de minimis aid, if de minimis aid is related to any of the sectors and activities specified in Article 1(1) of Commission Regulation No 1407/2013.

29. If the beneficiary of the aid referred to in Sub-paragraph 23.2 of this Regulation is concurrently operating in one or several sectors not to be supported and performs activities not to be supported pursuant to Article 1(1) of Commission Regulation No 1407/2013, the beneficiary of de minimis aid shall ensure the separation of activities or costs of such sectors in accordance with Article 1(2) of Commission Regulation No 1407/2013.

30. Upon granting the aid referred to in Paragraph 23 of this Regulation, the project applicant referred to in Sub-paragraph 12.2 of this Regulation shall verify whether the beneficiary of the aid does not have tax or duty debts, including a debt of the mandatory State social insurance contributions, the total amount of which exceeds EUR 150, according to the information available in the database of debtors of taxes (duties) administered by the State Revenue Service.

31. The Joint Programming Initiative referred to in Sub-paragraphs 19.2.3 and 20.4 of this Regulation and the procedures for the supervision of the projects funded within the scope of ERA-NET COFUND projects shall be coordinated by the beneficiary with the responsible institution and cooperation institution.

32. The beneficiary shall implement a project of non-economic nature from the day on which an agreement for the implementation of a first round project is concluded, but not later than by 30 November 2023. The following activities shall be supported within the scope of the first round projects:

32.1. the activities referred to in Paragraph 19 and Sub-paragraphs 20.1, 20.2, 20.4, 20.5, and 20.6 of this Regulation, if such activities have not been funded from other public financial instruments and are performed from 1 January 2017;

32.2. the activities referred to in Sub-paragraph 20.3 of this Regulation, if such activities have not been funded from other public financial instruments and are performed:

32.2.1. from 1 January 2014 and until the agreement is concluded, if concurrently with a funding request the developer of a project submitted within the call for proposals under the programme "Horizon 2020" and evaluated above the quality threshold submits a justification on the sustainability of the activities provided for in the project application;

32.2.2. after conclusion of the agreement.

33. If any of the activities to be supported referred to in Sub-paragraphs 19.1, 19.2, 19.3, 19.4, 20.1, 20.3, 20.4, and 20.6 of this Regulation are implemented by the project applicant referred to in Paragraph 12 of this Regulation in the form of outsourcing, it shall ensure that outsourcing is performed by taking into account the procurement procedures laid down in the laws and regulations governing the field of public procurement.

III. Conditions for the Implementation of Second Round Projects

34. The second round shall be implemented in the form of restricted selection of project applications.

35. The following scientific institutions shall be the project applicants in the second round:

35.1. Daugavpils University with the cooperation partner for the implementation of a project - the Latvian Institute of Aquatic Ecology;

35.2. Institute of Electronics and Computer Science;

35.3. Jāzeps Vītols Latvian Academy of Music;

35.4. Latvian Biomedical Research and Study Centre;

35.5. Latvian Academy of Culture;

35.6. Latvia University of Life Sciences and Technologies with the cooperation partners for the implementation of a project - the Institute of Agricultural Resources and Economics and the Institute of Horticulture.

35.7. Art Academy of Latvia;

35.8. Latvian Institute of Organic Synthesis;

35.9. University of Latvia with the cooperation partners for the implementation of a project - the Institute of Solid State Physics of the University of Latvia, the Institute of Mathematics and Computer Science of the University of Latvia, and the Institute of Literature, Folklore, and Art of the University of Latvia;

35.10. Latvian State Institute of Wood Chemistry;

35.11. Latvian State Forest Research Institute "Silava";

35.12. Liepāja University;

35.13. Institute of Food Safety, Animal Health and Environment "BIOR";

35.14. Rēzekne Academy of Technologies;

35.15. Riga Stradiņš University;

35.16. Riga Technical University;

35.17. Ventspils University College;

35.18. Vidzeme University of Applied Sciences.

36. In the second round, each project applicant shall submit one application for a project of non-economic nature the scope of activity whereof conforms to conditions referred to in Sub-paragraph 2.5 of this Regulation, and shall be implemented independently or jointly with the cooperation partners referred to in Sub-paragraphs 35.1, 35.6, and 35.9 of this Regulation.

37. The total eligible funding planned for the second round shall EUR 6 617 100, including the funding from the European Regional Development Fund - EUR 5 624 535, and the co-funding from the State budget - EUR 992 565.

38. In order to conclude an agreement for the implementation of a project, until 31 December 2018 the total available eligible funding in the second round shall be EUR 6 272 384, including funding from the European Regional Development Fund - EUR 5 331 526, and the co-funding from the State budget - EUR 940 858.

39. The project applicant shall submit one project application to the co-operation institution and shall conclude an agreement for the implementation of a project with the cooperation institution. In the second round the project applicant shall plan the implementation of a project in stages, taking into account the following conditions:

39.1. funding in the amount of 93.9 per cent of the total eligible public funding available to the project applicant and calculated in accordance with to the methodology for distributing public funding referred to in Annex 2 to this Regulation shall be available in the first stage for the implementation of activities referred to in Sub-paragraphs 44.1 and 44.2 of this Regulation;

39.2. until 31 December 2018, the performance reserve funding in the amount of 6.1 per cent of the eligible funding within the scope of the second round which is intended for implementing the activities referred to in Sub-paragraphs 44.1 and 44.2 of this Regulation shall be included in the project performance fund of the second stage that shall be additionally available to the project applicant in accordance with Sub-paragraph 39.3 of this Regulation;

39.3. a decision on the re-distribution of the funding of the performance fund to the beneficiaries in the second round according to a decision of the European Commission on the execution of the performance framework shall be taken by the Ministry of Education and Science after 1 April 2020 pursuant to the procedures for granting funding of the performance fund accordingly approved by the Ministry of Education and Science based upon international co-operation results in the relevant period achieved by beneficiaries whereon information is obtained from the documents submitted annually to the Ministry of Education and Science for the purpose of calculating the financial reference amount. In such case the total amount of available eligible funding shall be increased to the project applicant by making the relevant amendments to the agreement for the implementation of a project.

40. The total eligible funding available to the project applicant of the second round until 31 December 2018 to conclude an agreement for the implementation of a project shall not exceed:

40.1. for Daugavpils University - EUR 219 867 (funding from the European Regional Development Fund - EUR 186 887, and the co-funding from the State budget - EUR 32 980);

40.2. for the Institute of Electronics and Computer Science - EUR 219 867 (funding from the European Regional Development Fund - EUR 186 887, and the co-funding from the State budget - EUR 32 980);

40.3. for Jāzeps Vītols Latvian Academy of Music - EUR 86 764 (funding from the European Regional Development Fund - EUR 73 750, and the co-funding from the State budget - EUR 13 014);

40.4. for the Latvian Biomedical Research and Study Centre - EUR 447 614 (funding from the European Regional Development Fund - EUR 380 472, and the co-funding from the State budget - EUR 67 142), whereof EUR 200 000 for the implementation of activities to be supported referred to in Sub-paragraph 44.3 of this Regulation;

40.5. for the Latvian Academy of Culture - EUR 86 764 (funding from the European Regional Development Fund - EUR 73 750, and the co-funding from the State budget - EUR 13 014);

40.6. for the Latvia University of Life Sciences and Technologies - EUR 344 097 (funding from the European Regional Development Fund - EUR 292 482, and the co-funding from the State budget - EUR 51 615);

40.7. for the Art Academy of Latvia - EUR 86 764 (funding from the European Regional Development Fund - EUR 73 750, and the co-funding from the State budget - EUR 13 014);

40.8. for the Latvian Institute of Organic Synthesis - EUR 555 579 (funding from the European Regional Development Fund - EUR 472 242, and the co-funding from the State budget - EUR 83 337), whereof EUR 100 000 for the implementation of activities to be supported referred to in Sub-paragraph 44.3 of this Regulation;

40.9. for the University of Latvia - EUR 1 778 050 (funding from the European Regional Development Fund - EUR 1 511 342, and the co-funding from the State budget - EUR 266 708), whereof EUR 360 000 for the implementation of activities to be supported referred to in Sub-paragraphs 44.3 and 44.5 of this Regulation;

40.10. for the Latvian State Institute of Wood Chemistry - EUR 246 487 (funding from the European Regional Development Fund - EUR 209 514, and the co-funding from the State budget - EUR 36 973).

40.11. for the Latvian State Forest Research Institute "Silava" - EUR 210 993 (funding from the European Regional Development Fund - EUR 179 344, and the co-funding from the State budget - EUR 31 649);

40.12. for Liepāja University - EUR 104 511 (funding from the European Regional Development Fund - EUR 88 834, and the co-funding from the State budget - EUR 15 677);

40.13. for the Institute of Food Safety, Animal Health and Environment "BIOR" - EUR 122 258 (funding from the European Regional Development Fund - EUR 103 919, and the co-funding from the State budget - EUR 919 219);

40.14. for Rēzekne Academy of Technologies - EUR 113 384 (funding from the European Regional Development Fund - EUR 96 376, and the co-funding from the State budget - EUR 17 008);

40.15. for Riga Stradiņš University - EUR 371 602 (funding from the European Regional Development Fund - EUR 315 862, and the co-funding from the State budget - EUR 55 740), whereof EUR 60 000 for the implementation of activities to be supported referred to in Sub-paragraph 44.3 of this Regulation;

40.16. for Riga Technical University - EUR 883 900 (funding from the European Regional Development Fund - EUR 751 315, and the co-funding from the State budget - EUR 132 585), whereof EUR 100 000 for the implementation of activities to be supported referred to in Sub-paragraph 44.4 of this Regulation;

40.17. for Ventspils University College - EUR 262 752 (funding from the European Regional Development Fund - EUR 223 339, and the co-funding from the State budget - EUR 39 413), whereof EUR 100 000 for the implementation of activities to be supported referred to in Sub-paragraph 44.3 of this Regulation;

40.18. for Vidzeme University of Applied Sciences - EUR 131 131 (funding from the European Regional Development Fund - EUR 111 461, and the co-funding from the State budget - EUR 19 670).

41. The following indicators shall be achieved in the second round by 31 December 2023:

41.1. outcome indicator - not less than 458 project applications within the scope of the programme "Horizon 2020" and within the scope of the 9th Framework Programme of the European Union have been supported by the European Regional Development Fund and evaluated above the quality threshold with the following division thereof according to project applicants:

41.1.1. Daugavpils University - at least 17;

41.1.2. Institute of Electronics and Computer Science - at least 17;

41.1.3. Jāzeps Vītols Latvian Academy of Music - at least 2;

41.1.4. Latvian Biomedical Research and Study Centre - at least 19;

41.1.5. Latvian Academy of Culture - at least 2;

41.1.6. Latvia University of Life Sciences and Technologies - at least 31;

41.1.7. Art Academy of Latvia - at least 2;

41.1.8. Latvian Institute of Organic Synthesis - at least 43;

41.1.9. University of Latvia - at least 150;

41.1.10. Latvian State Institute of Wood Chemistry - at least 20;

41.1.11. Latvian State Forest Research Institute "Silava" - at least 16;

41.1.12. Liepāja University - at least 4;

41.1.13. Institute of Food Safety, Animal Health and Environment "BIOR" - at least 6;

41.1.14. Rēzekne Academy of Technologies - at least 5;

41.1.15. Riga Stradiņš University - at least 27;

41.2. specific outcome indicator - implementation of the National Partnership Plan of Latvia for participation in eight ERIC consortiums:

41.2.1. Biobanking and BioMolecular Resources Research Infrastructure-European Research Infrastructure Consortium (BBMRI-ERIC) whose national coordinator is the project applicant referred to in Sub-paragraph 35.4 of this Regulation - the Latvian Biomedical Research and Study Centre;

41.2.2. Common Language Resources and Technology Infrastructure-European Research Infrastructure Consortium (CLARIN-ERIC) whose national coordinator is the co-operation partner of the project applicant referred to in Sub-paragraph 35.9 of this Regulation - the Institute of Mathematics and Computer Science of the University of Latvia;

41.2.3. European Social Survey-European Research Infrastructure Consortium (ESS-ERIC) whose national coordinator is the project applicant referred to in Sub-paragraph 35.9 of this Regulation - the University of Latvia;

41.2.4. European Advanced Translational Research Infrastructure in Medicine-European Research Infrastructure Consortium (EATRIS-ERIC) whose national coordinator is the project applicant referred to in Sub-paragraph 35.15 of this Regulation - Riga Stradiņš University;

41.2.5. Joint Institute for Very Long Baseline Interferometry-European Research Infrastructure Consortium (JIV-ERIC) whose national coordinator is the project applicant referred to in Sub-paragraph 35.17 of this Regulation - Ventspils University College;

41.2.6. Microbial Resource Research Infrastructure (MIRRI) Consortium whose national coordinator is the project applicant referred to in Sub-paragraph 35.9 of this Regulation - the University of Latvia;

41.2.7. the consortium of Europe's research hub for structural biology (INSCTRUCT) whose national coordinator is the project applicant referred to in Sub-paragraph 35.4 of this Regulation - the Latvian Biomedical Research and Study Centre;

41.2.8. European Infrastructure of Open Screening Platforms for Chemical Biology (EU-OPENSCREEN) Consortium whose national coordinator is the project applicant referred to in Sub-paragraph 35.4 of this Regulation - the Latvian Institute of Organic Synthesis;

41.3. specific outcome indicator - implementation of the action plan of the National Contact Point of Latvia of the European Organization for Nuclear Research (CERN);

41.4. specific outcome indicator - implementation of an action plan to ensure co-operation in the field of quantum computing between the project applicant referred to in Sub-paragraph 35.9 of this Regulation, the research centre for quantum software (the Netherlands) and Paris Centre for Quantum Computing (France).

42. The project applicants referred to in Sub-paragraphs 35.1, 35.6, and 35.9 if this Regulation shall implement the project application jointly as cooperation partners in compliance with the following conditions:

42.1. the project application shall be submitted by the project applicant responsible for the project implementation;

42.2. prior to submitting the project application to a cooperation institution, the project applicant shall enter into a cooperation contract with the co-operation partner for the joint implementation of the cooperation project, for the division of obligations and responsibility for ensuring the achievement of results and the rights to use the results (hereinafter - the cooperation contract). In addition to the information laid down in the laws and regulations regarding the procedures by which the institutions involved in the management of European Union Structural Funds and the Cohesion Fund shall ensure preparation of planning documents and introduction of such funds in the planning period 2014-2020, at least the following information shall be included in the contract:

42.2.1. the cooperation objectives and principles;

42.2.2. the total cooperation project funding;

42.2.3. the procedures for ensuring the financial flow of the project application;

42.2.4. indicators and results to be achieved by the cooperation partner in accordance with the activities to be supported to be implemented within the scope of the project application;

42.2.5. the sanctions, if the commitments referred to in the cooperation contract are not fulfilled.

43. The project applicant shall prepare and submit the project application to the co-operation institution pursuant to the requirements laid down in the project application selection round regulations. The following documents shall be appended in Annex:

43.1. a plan for participation in calls for proposals within the scope of the programme "Horizon 2020" and other research and innovation aid programmes and technology initiatives by defining international cooperation projects with a high level of maturity;

43.2. the internal procedures of a scientific institution for the funding of aid measures of international cooperation, including research mobility and participation in calls for proposals under the programme "Horizon 2020" and other research and innovation aid programmes and technology initiatives, that includes the activities to be supported for the implementation of which financial aid can be received, lays down the procedures for applying and criteria for the receipt of aid, and also the results to be achieved within the scope of the activities to be supported, and quality management and supervision;

43.3. the project applicant referred to in Sub-paragraphs 35.4, 35.8, 35.9, 35.15, and 35.17 of this Regulation - the National Partnership Plan of Latvia of ERIC consortium for the establishment and operation of the national consortium that includes the results to be achieved at the national level in compliance with the requirements laid down by the international ERIC consortium by coordinating the plan with the national partners included in the plan and the Ministry of Education and Science;

43.4. the project applicant referred to in Sub-paragraph 35.16 of this Regulation - the action plan of the National Contact Point of Latvia of the European Organization for Nuclear Research (CERN) which has been coordinated with the Ministry of Education and Science;

43.5. the project applicant referred to in Sub-paragraph 35.9 of this Regulation - an action plan to ensure cooperation in the field of quantum computing with the research centre for quantum software (the Netherlands) and Paris Centre for Quantum Computing (France) which has been coordinated with the Ministry of Education and Science;

43.6. the cooperation contract referred to in Sub-paragraph 42.2 of this Regulation (if applicable).

44. The following activities shall be supported in the second round:

44.1. the Activities for increasing the performance of international cooperation projects under the programme "Horizon 2020" and the 9th Framework Programme of the European Union in the field of research and development, by also avoiding overlapping with the activities to be supported and the eligible costs of the projects implemented in the first round:

44.1.1. the networking, training, and mobility, including research mobility, measures to participate in international consortiums and accordingly in projects under the programme "Horizon 2020" and the 9th Framework Programme of the European Union, including:

44.1.1.1. the participation in partnership exchange events and information days organised within the scope of the programme "Horizon 2020" and the 9th Framework Programme of the European Union;

44.1.1.2. the participation in aid measures organised by the Joint Research Centre of the European Commission;

44.1.1.3. the participation in international scientific conferences;

44.1.2. preparation of applications for the programme "Horizon 2020" and the 9th Framework Programme of the European Union, including business travels and work trips to potential project partners to attend the project planning meetings, organisation of workshops in Latvia and aid for the attraction of foreign experts;

44.2. the organisation of international scientific conferences in Latvia;

44.3. ensuring participation in ERIC consortiums - applicable to the project applicants referred to in Sub-paragraphs 35.4, 35.8, 35.9, 35.15, and 35.17 of this Regulation;

44.4. the implementation of the action plan of the National Contact Point of Latvia of the European Organization for Nuclear Research (CERN) - applicable to the project applicant referred to in Sub-paragraph 35.16 of this Regulation;

44.5. implementation of cooperation events in the field of quantum computing between the project applicant referred to in Sub-paragraph 35.9 of this Regulation and the research centre for quantum software (the Netherlands), and the Paris Centre for Quantum Computing (France);

44.6. the project management;

44.7. the implementation of project publicity and communication measures in accordance with the Regulation No 1303/2013 of the Parliament and of the Council.

45. The following cost items shall be eligible in the second round:

45.1. the direct eligible costs of the project for performing the activities referred to in Paragraph 44 of this Regulation:

45.1.1. the direct eligible personnel costs:

45.1.1.1. the costs for the remuneration of the project management personnel (except for overtime) for the implementation of the activity referred to in Sub-paragraphs 44.6 of this Regulation shall be up to five per cent of the total eligible costs of the project and shall not exceed EUR 56 580 per year for projects with direct eligible costs above EUR 5 000 000, or EUR 24 426 per year by adding 0.64 per cent of the direct eligible costs of the project, but excluding the direct costs of the project management personnel for projects with direct eligible costs below EUR 5 000 000;

45.1.1.2. the costs for the remuneration of the project implementation personnel (except for overtime) for the implementation of the activities referred to in Sub-paragraphs 44.1, 44.2, 44.3, 44.4, and 44.5 of this Regulation by complying with the restrictions on costs referred to in Paragraph 47 of this Regulation. If contract for work performance are being concluded, the mandatory State social insurance contributions of the employer shall be eligible, if the person involved in the implementation of project activities has not registered at the State Revenue Service as a self-employed person;

45.1.2. the health insurance costs and mandatory health examination costs for the project management and implementation personnel of the beneficiary. If health insurance is provided at the institution of the beneficiary and the abovementioned personnel is employed within the normal working hours, the health insurance costs shall be eligible in the amount of 100 per cent. If the personnel is employed part-time or half-time, the health insurance costs shall be eligible in proportion to the distribution of the workload in percentage. Health insurance costs shall be eligible only for the period when the abovementioned personnel is employed in the project;

45.1.3. the costs of the acquisition or lease of equipment (office furniture and devices, computer software and licences) for newly created workplaces in the amount of up to EUR 3000 per one workplace in the whole period of project implementation for the implementation of the activities referred to in Sub-paragraphs 44.1.2, 44.3, 44.4, 44.5, and 44.6 of this Regulation. Costs of the acquisition or lease of equipment for newly created workplaces, including the costs of the maintenance and repair of the equipment, shall be eligible in the amount of up to EUR 3000 per one workplace in the whole period of project implementation, if the project management or implementation personnel is employed in the project in the amount of at least 30 per cent of normal working hours on the basis of an employment contract or an has been appointed in the position upon an order. If the project management or implementation personnel is employed part-time or half-time, the of the acquisition or lease of equipment for a newly created workplace shall be eligible in proportion to the distribution of the workload in percentage, including by taking into account the principle of economic advantage;

45.1.4. the costs of business travels and work trips for project implementation personnel in accordance with the laws and regulations regarding the procedures by which expenses related to business travels shall be reimbursed, if such are justified and related to project implementation;

45.1.5. the handout and informative materials on the beneficiary (brochures, stickers, business cards, posters, presentations, video), if the justification for the creation thereof is the implementation of the activities referred to in Sub-paragraphs 44.1, 44.3, 44.4, and 44.5 of this Regulation and achievement of the project objective;

45.1.6. the fee for participation in the activities referred to in Sub-paragraph 44.1.1 of this Regulation;

45.1.7. the organisation of workshops on the preparation of the project applications referred to in Sub-paragraph 44.1.2 of this Regulation in Latvia, costs of the attraction of participants, handout materials, technical equipment, and communications equipment (including purchase of licences for teleconference systems) by complying with the principle proportionality and efficiency;

45.1.8. the organisation of the international scientific conferences referred to in Sub-paragraph 44.2 of this Regulation and seminars necessary to ensure the activities referred to in Sub-paragraphs 44.3, 44.4, and 44.5 of this Regulation (including lease of premises and stands, costs of technical equipment, costs of the publishing of conference materials and handout materials, costs of communications services, costs of the attraction of participants and representation costs) by complying with the principle of proportionality and efficiency;

45.1.9. the costs of participation in conferences and publishing of handout materials, lease, creation, transportation of stands, provision of operation, technical equipment for the implementation of activities referred to in Sub-paragraph 44.1.1 of this Regulation;

45.1.10. the service costs (including access to research infrastructure) for the implementation of the activities referred to in Sub-paragraphs 44.1, 44.2, 44.3, 44.4, and 44.5 of this Regulation. If the service provider is a natural person and he or she has not registered as a self-employed person at the State Revenue Service, the mandatory State social insurance contributions of the employer shall be also eligible;

45.1.11. the non-recoverable payments of the value added tax of the direct eligible costs of the project;

45.1.12. the costs of information and publicity events of the project in accordance with the laws and regulations regarding the procedures by which the requirements for communication and visual identity shall be ensured in introduction of the European Union Structural Funds and the Cohesion Fund in the 2014-2020 programming period, for the implementation of the activities to be supported referred to in Paragraph 44 of this Regulation;

45.2. the indirect eligible costs of the project for the performance of activities referred to in Paragraph 44 of this Regulation: Such costs shall be planned as one cost item by applying the flat rate of indirect costs in the amount of 15 per cent of the direct eligible costs of the personnel referred to in Sub-paragraph 45.1.1 of this Regulation. The flat rate of indirect costs shall be applied for personnel costs which have been incurred on the basis of an employment contract (or when appointing in the position upon an order, if applicable).

46. In planning the direct eligible personnel costs referred to in Sub-paragraph 45.1.1 of this Regulation, the beneficiary shall keep an account of working hours regarding the functions fulfilled by the project management and implementation personnel within the scope of the project and the time worked, and shall ensure that:

46.1. if within the project the employee is employed full-time or part-time in the amount of not less than 30 per cent of normal working hours, the wage, bonuses specified in laws and regulations, and social guarantee costs of the employee are included in eligible personnel costs;

46.2. if within the scope of the project the employee is employed in the amount of less than 30 per cent of normal working hours, the remuneration costs are to be settled in accordance with the hourly rate specified in the remuneration policy of the scientific institution by taking into account the number of hours worked in the project. Only the wage of the employee without the bonuses specified in laws and regulations and social guarantee costs shall be included in the eligible personnel remuneration costs.

47. The activities to be supported referred to in Sub-paragraph 44.1 of this Regulation shall be implemented in compliance with the following conditions and restrictions on the eligibility of costs:

47.1. the activities to be supported shall be implemented in accordance with the internal procedures elaborated and approved by the beneficiary for the purpose of funding international cooperation aid measures, including participation in the competitions of research mobility and participation in the call for proposals under the programme "Horizon 2020" and the 9th Framework Programme of the European Union, and other research and innovation aid programmes and technology initiatives;

47.2. the costs of the preparation of one project application for the programme "Horizon 2020" and the 9th Framework Programme of the European Union referred to in Sub-paragraph 44.1.2 of this Regulation until coordination of the methodology for costs of one unit elaborated by the Ministry of Education and Science with the managing authority shall not exceed EUR 9000, if the project applicant is the coordinator of the project application within the scope of the programme "Horizon 2020" and the 9th Framework Programme of the European Union, and shall not exceed EUR 6000, if the project applicant is the partner of the project application and has not previously received funding from the European Structural and Investment Fund or funding from the State budget for the preparation of the relevant project within the scope of the Baltic Bonus programme from 2014 until 2016, also by taking into account the following restrictions on actual costs:

47.2.1. foreign travels to plan the preparation of a project application for the programme "Horizon 2020" and the 9th Framework Programme of the European Union shall not exceed a period of four days, whereas the costs thereof shall not exceed EUR 1500;

47.2.2. remuneration costs for the preparation of the projects referred to in Sub-paragraph 44.1.2 of this Regulation shall be determined in accordance with the internal remuneration policy of the beneficiary, and:

47.2.2.1. shall not exceed 400 working hours for scientific staff, if submitting the project application for the programme "Horizon 2020" and the 9th Framework Programme of the European Union as a coordinator;

47.2.2.2. shall not exceed 200 working hours for scientific staff, if submitting the project application for the programme "Horizon 2020" and the 9th Framework Programme of the European Union as a partner;

47.2.2.3. shall not exceed 35 working hours for administrative head;

47.3. foreign travels referred to in Sub-paragraph 44.1.1.1 of this Regulation to partnership exchange events shall not exceed a period of four days, whereas the costs thereof shall not exceed EUR 1500.

48. If during the implementation of the project referred to in Paragraph 36 of this Regulation an advance payment is disbursed to the beneficiary, it may be disbursed in parts. The advance payment shall not exceed 30 per cent of the total amount of the public funding granted to the project. Following the conclusion of an agreement for the implementation of a project, the cooperation institution shall, on the basis of a written request of the beneficiary for an advance payment, ensure the advance payment to the beneficiary in accordance with the laws and regulations regarding planning of the State budget funds for the implementation of projects of the European Union Structural Funds and the Cohesion Fund and settlement of payments in the 2014-2020 programming period.

49. The beneficiary shall implement a project of non-economic nature from the day on which the agreement is concluded, but not later than by 31 December 2022.

50. The following activities of a project of non-economic nature shall be supported:

50.1. the activities referred to in Sub-paragraph 44.1 of this Regulation, if such activities are not funded from other public financial instruments and are performed:

50.1.1. from 1 January 2014 and until the conclusion of the agreement, if the beneficiary submits justification on sustainability of activities provided for in the project application;

50.1.2. after the conclusion of the agreement;

50.2. the activities referred to in Sub-paragraphs 44.2, 44.3, 44.4, 44.5, 44.6, and 44.7 of this Regulation, if such activities are not funded from other public financial instruments and are performed from 1 January 2017.

51. If any of the activities to be supported and referred to in Sub-paragraphs 44.1, 44.2, 44.3, 44.4, 44.5, and 44.7 of this Regulation are implemented by the project applicant referred to in Paragraph 35 of this Regulation in the form of outsourcing, it shall ensure that outsourcing is performed by complying with the procurement procedures laid down in the laws and regulations governing the field of public procurement.

IV. Conditions for the Implementation of Third Round Projects

52. The third round shall be implemented in the form of open selection of project applications.

53. In the third round, aid shall be granted to such fund projects of the programme "Horizon 2020", or parts thereof, which have been evaluated above the quality threshold and which have not yet received funding, and which have been submitted within the scope of the following Sub-programmes from 1 January 2015:

53.1. the ERA Chairs sub-programme of the Spreading Excellence and Widening Participation programme;

53.2. the sub-programmes of the Marie Skłodowska-Curie Fellowship:

53.2.1. European Fellowships;

53.2.2. Global Fellowships;

53.2.3. European Researchers' Night;

53.3. Frontier Research grants of the European Research Council:

53.3.1. Starting grant (ERC-SG);

53.3.2. Consolidator grant (ERC-CG);

53.3.3. Advanced grants (ERC-AG);

53.3.4. Proof of Concept (ERC-PoC);

53.4. work package aid to be funded from the European Structural and Investment Funds for a project approved within the scope of an ECSEL Joint Undertaking.

54. The project applicant shall be a scientific institution, but within the scope of the programme referred to in Sub-paragraph 53.2 of this Regulation, also an institution of direct administration, which submits one or multiple project applications in the third round.

55. The project applicant shall submit the project application and shall implement the project either individually or in cooperation with another scientific institution, including a foreign institution, if the cooperation partner is intended for the implementation of the project of the sub-programme referred to in Sub-paragraph 53.4 of this Regulation. If the cooperation partner is a foreign scientific institution or a foreign enterprise, the funding necessary for the implementation of the part of the project of the cooperation partner shall be ensured from the funds at the disposal of the cooperation partner.

56. The project applicant may implement the following in the third round:

56.1. a project of non-economic nature;

56.2. a project of economic nature.

57. The total eligible public funding planned for the third round shall be EUR 9 300 000, which consists of the funding from the European Regional Development Fund - EUR 7 905 000, and the co-funding from the State budget - EUR 1 395 000.

58. In order to conclude an agreement or contract for the implementation of a project, until 31 December 2018 the total available eligible funding in the third round shall be EUR 4 800 000, which consists of the funding from the European Regional Development Fund - EUR 4 080 000, and co-funding from the State budget - EUR 720 000.

59. The following supervision indicators are to be achieved in the third round by 31 December 2023:

59.1. outcome indicator - not less than 15 project applications for the programme "Horizon 2020" supported by the European Regional Development Fund and evaluated above the quality threshold;

59.2. specific outcome indicators:

59.2.1. original scientific articles that have been published:

59.2.1.1. in magazines or conference symposia the quoting index whereof reaches at least 50 per cent of the average quoting index of the sector:

59.2.1.2. in magazines or conference symposia included in the Web of Science or SCOPUS (A or B) databases;

59.2.2. technology rights:

59.2.2.1. patents;

59.2.2.2. other non-material assets;

59.2.3. intellectual property licence contracts;

59.2.4. prototype of a new product or new technology;

59.2.5. new treatment and diagnostic techniques (including a non-commercial technique) supplementing the indicators referred to in Sub-paragraphs 59.2.1, 59.2.2, 59.2.3, and 59.2.4 of this Regulation;

59.2.6. other indicators conforming to the specific character of the research or project (including data) supplementing the indicators referred to in Sub-paragraphs 59.2.1, 59.2.2, 59.2.3, and 59.2.4 of this Regulation.

60. In the third round the project applicant shall prepare and submit the project application to the cooperation institution pursuant to the requirements laid down in the project application selection round regulations. The following documents shall be appended in Annex:

60.1. a certified copy of the project application submitted under the sub-programmes referred to in Paragraph 53 of this Regulation within the scope of the programme "Horizon 2020";

60.2. documentation which certifies that the project application has undergone a project quality assessment and it has exceeded the determined quality threshold in the assessment of project applications for the programme "Horizon 2020":

60.2.1. the Seal of Excellence Certificate granted by the European Commission, if the European Commission grants the Seal of Excellence Certificate to the specific sub-programme of the programme "Horizon 2020";

60.2.2. a printout from the Research Participant Portal information system which contains information on the project evaluation and the quality threshold determined for the evaluation (Evaluation Summary Report);

60.3. if the European Commission does not grant the Seal of Excellence Certificate to the specific sub-programme referred to in Paragraph 53 of this Regulation or the project has been submitted prior to commencing the granting of the Seal of Excellence Certificate by the European Commission, in addition to the documents referred to in Sub-paragraph 60.2 of this Regulation - information of the responsible institution of the European Commission on the rejection of the project due to insufficient funding or inclusion of the project in the reserve list;

60.4. a printout from the Research Participant Portal information system which contains information on the date of submission of the project application, if such information is not specified in the documents referred to in Sub-paragraphs 60.2 and 60.3 of this Regulation;

60.5. the certification that the submitted project shall not be implemented under the programme "Horizon 2020" - applicable to the sub-programmes referred to in Sub-paragraphs 53.1, 53.2, and 53.3 of this Regulation;

60.6. the certified copy of the decision taken by the group of country representatives of ECSEL Joint Undertaking on the approval of the project for implementation - applicable to the sub-programme referred to in Sub-programme 53.4 of this Regulation;

60.7. a description of the financial management and accounting policy of the scientific institution and a report on its turnover for the last three reporting years completed which has been drawn up pursuant to Annex 1 to this Regulation;

60.8. an updated funding plan, budget, and other related parts of the project application for the project application submitted under the sub-programmes referred to in Paragraph 53 of this Regulation within the scope of the programme "Horizon 2020" in accordance with the provisions laid down in the regulations of the project application selection round, if pursuant to the laws and regulations governing the aid for commercial activity the project application on funding within the scope of this activity is classified as a project of economic nature. The permissible public funding intensity for such project in the third round shall be calculated in accordance with Paragraphs 63 and 64 of this Regulation (if applicable).

61. Direct project implementation costs for the implementation of projects of the sub-programme to be supported and referred to in Paragraph 53 of this Regulation and the indirect eligible costs of the project conforming to the provisions laid down in the Work Programme of the European Commission of the sub-programme referred to in Paragraph 53 of this Regulation and conforms to Regulation (EU) No 1291/2013 of the European Parliament and of the Council of 11 December 2013 establishing Horizon 2020 - the Framework Programme for Research and Innovation (2014-2020) and repealing Decision No 1982/2006/EC (Official Journal of the European Union, 20.12.2013, L 347), and Regulation (EU) No 1290/2013 of the European Parliament and of the Council of 11 December 2013 laying down the rules for participation and dissemination in "Horizon 2020 - the Framework Programme for Research and Innovation (2014-2020)" and repealing Regulation (EC) No 1906/2006 (Official Journal of the European Union, 20.12.2013, L 347) shall be eligible in the third round, including by applying the costs of a single unit, if such are provided in the relevant funding conditions of sub-programmes referred to in Paragraph 53 of this Regulation, to the extent the costs determined in the Work Programme do not contradict the legal framework of the European Union Structural Funds, concurrently complying with the conditions laid down in Sub-paragraph 62.1 and Paragraph 63 of this Regulation.

62. If the project of the sub-programme referred to in Paragraph 53 of this Regulation shall be classified as a project of economic nature, the project applicant shall ensure the compliance of the project application with the following conditions:

62.1. the eligible costs of a project application comply with the research costs specified in Article 25(3)(a), (b), (d), and (e) of Commission Regulation No 651/2014, and the maximum permitted intensity of public funding specified in Paragraphs 63 and 64 of this Regulation is complied with;

62.2. the national co-funding necessary for the implementation of the project application shall be ensured from private funding of the project applicant (funds, credit resources or other financial resources at the disposal of the project applicant for which no public aid has been received, including the funding for which no State or local government guarantee has been received or a State or local government loan with preferential conditions).

63. The permitted intensity of public funding for projects of economic nature implemented within the third round shall be as follows:

63.1. 85 per cent for the performance of fundamental research;

63.2. for conducting a technico-economic feasibility study:

63.2.1. 70 per cent for a project applicant conforming to the definition of a micro or small enterprise;

63.2.2. 60 per cent for a project applicant conforming to the definition of a medium-sized enterprise;

63.2.3. 50 per cent for a project applicant conforming to the definition of a large enterprise;

63.3. for conducting industrial research:

63.3.1. 70 per cent for a project applicant conforming to the definition of a micro or small enterprise;

63.3.2. 60 per cent for a project applicant conforming to the definition of a medium-sized enterprise;

63.3.3. 50 per cent for a project applicant conforming to the definition of a large enterprise;

63.4. for conducting experimental development:

63.4.1. 45 per cent for a project applicant conforming to the definition of a micro or small enterprise;

63.4.2. 35 per cent for a project applicant conforming to the definition of a medium-sized enterprise;

63.4.3. 25 per cent for a project applicant conforming to the definition of a large enterprise.

64. The intensity of public funding referred to in Sub-paragraphs 63.3 and 63.4 of this Regulation may be increased by 15 per cent, without exceeding 80 per cent of the total eligible costs of the project, if at least one of the conditions referred to in Article 25(6)(b) of Commission Regulation No 651/2014 is fulfilled.

65. The project implementation period in the third round starts on the day on which the agreement or contract for the implementation of a project has been concluded and lasts until 30 November 2023. The activities performed within the scope of projects of the sub-programmes to be supported under the programme "Horizon 2020" referred to in Paragraph 53 of this Regulation shall be supported:

65.1. for a project of non-economic nature - from 1 January 2017;

65.2. for a project of economic nature - after submission of the project application to the cooperation institution pursuant to the provisions laid down in Article 6(2) of Commission Regulation No 651/2014.

66. If during the implementation of the project referred to in Sub-paragraph 56.1 or 56.2 of this Regulation an advance payment is disbursed to the beneficiary, it may be disbursed in parts. The advance payment shall not exceed 30 per cent of the total amount of the public funding granted to the project. Following the conclusion of an agreement or contract for the implementation of a project, the cooperation institution shall, on the basis of a written request of the beneficiary for an advance payment, ensure the advance payment to the beneficiary in accordance with the laws and regulations regarding planning of the State budget funds for the implementation of projects of the European Union Structural Funds and the Cohesion Fund and settlement of payments in the 2014-2020 programming period.

67. To ensure the supervision of the project implementation, the Ministry of Education and Science or an institution delegated thereof in cooperation with the cooperation institution shall ensure the quality evaluation of the mid-term and final results of the project submitted within the scope of the programmes referred to in Sub-paragraphs 53.1, 53.2, and 53.3 of this Regulation in compliance with the following conditions:

67.1. the evaluation shall be performed by experts included in the database of experts of the European Commission who comply with the following criteria:

67.1.1. the expert has a doctorate degree;

67.1.2. the scientific qualification of the expert conforms to the sub-sector of the science sector of the particular project application;

67.1.3. the expert has an appropriate professional experience and competence;

67.2. the Ministry of Education and Science or an institution delegated thereof shall develop and coordinate the standard forms of evaluation with the cooperation institution, by also including therein the requirement for the expert to specify in the evaluation of mid-term results how the progress of the project implementation corresponds to the plans, and to provide recommendations for adjusting the work plan, if necessary, whereas in the evaluation of final results - to justify the extent to which the planned results of the project have been achieved (also expressing the evaluation in percentage);

67.3. taking into account the conclusions and recommendations of the evaluation of mid-term results, the Ministry of Education and Science, cooperation institution, responsible institution, and the beneficiary, if necessary, shall agree on amendments to the work plan of the project;

67.4. the cooperation institution shall use the evaluation of final results to take a decision on the achievement of the objective and planned results of the project. On the basis of the final evaluation on the level of achievement of the planned results of the project, the cooperation institution shall take a decision on the application of a financial correction pursuant to the guidelines of the managing authority on the application of financial corrections in projects funded by the European Union Structural Funds, Cohesion Fund, European Economic Area Financial Mechanism, the Norwegian Financial Mechanism, Swiss-Latvian Cooperation Programme. The cooperation institution shall inform the responsible institution about the abovementioned decision.

68. If any of the activities of the project referred to in Paragraph 56 of this Regulation are implemented by the project applicant referred to in Paragraph 54 of this Regulation in the form of outsourcing, it shall ensure that the outsourcing is performed by complying with the procurement procedures laid down in the laws and regulations governing the field of public procurement.

V. Conditions for the Implementation of the Project and Receipt of the Funding

69. The following costs shall be ineligible within the scope of the Activity:

69.1. the acquisition costs of scientific facilities and equipment for the implementation of the project by the project applicant referred to in Paragraphs 12 and 35 of this Regulation;

69.2. costs related to building design, reconstruction, construction, and adjustment of premises of buildings;

69.3. payment for the examination, drawing up, reserving and servicing of a loan, fee for financial transactions, interest on late payments, penalties and expenses for legal proceedings;

69.4. costs which are not specified in Paragraphs 21, 45, 61, and 62 of this Regulation;

69.5. costs which exceed the restrictions for the amount of costs referred to in Paragraphs 21, 45, and 47 of this Regulation;

69.6. costs that are not directly related to activities performed within the scope of the project of the beneficiary, not conforming to the principles of financial management, particularly monetary value and cost-effectiveness;

69.7. costs for which payments have been made later than within a month after the end of the time period for the implementation of the project;

69.8. costs which are not justified by documents supporting such costs or have arisen as a result of non-conformity with the requirements of laws and regulations;

69.9. costs of opening and maintaining the account necessary for implementing the project of the beneficiary;

69.10. the value added tax (except when the beneficiary cannot retrieve it from the State budget in accordance with the laws and regulations of the Republic of Latvia in the field of tax policy), customs duties, fees, and penalty payments.

70. If the actual costs of the project exceed the total amount of the eligible costs of the project or ineligible expenditure or there is an increase in the costs during the planning period or during implementation of the project, the beneficiary shall cover them from existing funds at the disposal thereof that is not the funding of the European Union funds and funding from the State budget, or redistribute savings from other items of the funding of the project of the beneficiary.

71. The following requirements shall be determined for the project applicant referred to in Paragraphs 12, 35, and 54 of this Regulation and the cooperation partner referred to in Paragraph 35 of this Regulation (if applicable):

71.1. it is not an undertaking in difficulty according to the definition laid down in Article 2(18) of Commission Regulation No 651/2014 (if applicable);

71.2. the amount of its tax debts, State mandatory social insurance contributions, and debts of other State-defined mandatory payments does not exceed EUR 150;

71.3. it has not deliberately provided false information in relation to the implementation of the projects co-funded from the European Union Structural Funds to the cooperation institution, responsible institution or another competent institution;

71.4. it has not received and is not planning to receive funding from the State or European Union funds, or other financial resources for the same eligible costs or research results;

71.5. if aid for commercial activity is granted to the project applicant referred to in Paragraph 54 of this Regulation pursuant to Commission Regulation No 651/2014, the cooperation institution shall verify whether the project applicant is no subject to an outstanding recovery order referred to in Article 4(1)(a) of Commission Regulation No 651/2014;

71.6. if the project applicant implements a project of economic nature and if any of the sectors in which the project applicant is operating, is not eligible for aid, but the project applicant has applied for the implementation of the project in the sector to be aided, the project applicant shall clearly separate the activities in the sectors to be aided and the financial flows related to the implementation thereof from activities and financial flows of other sectors during the implementation of the project and for five years after making of the final payment - applicable to the project applicant referred to in Paragraph 54 of this Regulation;

71.7. if the project applicant performs both economic activities and activities of non-economic nature, it shall separate the types of activities and their costs, financing and revenue in order to efficiently prevent cross-subsidisation of economic activity - applicable to the project applicant referred to in Paragraphs 35 and 54 of this Regulation;

71.8. in order for the project applicant referred to in Paragraph 35 of this Regulation to receive an invitation from the cooperation institution to submit the project application, the project applicant, within 20 working days after coming into force of this Regulation, shall submit to the cooperation institution a description of the financial management and accounting policy of the project applicant and a report on its turnover (Annex 1) for the last three reporting years completed which justify the conformity of the project applicant with the definition of a research organisation;

71.9. the project applicant conforming to the definition of a research organisation shall separate:

71.9.1. the principal activities not related to economic activity (and the financial flows related thereto) from principal economic activities;

71.9.2. the principal activities and the financial flows related thereto from other activities of the scientific institution and the financial flows related thereto.

72. Activities and sectors which conform to Article 1(2) and Article 1(3)(c) and (d) of Commission Regulation No 651/2014 are not to be aided within the scope of the project.

73. Aid shall not be granted within the project if any of the occasions specified in Article 1(5) of Commission Regulation No 651/2014 occurs.

74. The Republic of Latvia shall be the site of the project implementation within the scope of the first, second, and third round.

75. The beneficiary shall publish the current information on progress in the implementation of a project on its website at least once in three months.

76. The beneficiary shall ensure information and publicity measures of the project in accordance with Regulation No 1303/2013 of the Parliament and of the Council and the laws and regulations regarding the procedures by which conformity with the communication and visual identity requirements shall be ensured in introduction of European Union Structural Funds and the Cohesion Fund in the 2014-2020 programming period.

77. Integration of environmental requirements in procurements of goods and services (green public procurement) shall be supported within the scope of the Activity.

78. The beneficiary referred to in Paragraphs 12 and 35 of this Regulation shall:

78.1. collect the following data on the horizontal indicators of the horizontal principle "Equal Opportunities" - the number of projects where as the result of investment from the European Regional Development Fund compliance with the principles of gender equality, disability, age, and ethnic origin is ensured (if applicable);

78.2. collect the following data on the horizontal indicators of the horizontal principle "Sustainable Development" - the number of green public procurements organised in the implementation of the project (if applicable) to ensure the fulfilment of the conditions referred to in Paragraph 77 of this Regulation.

79. The beneficiary shall ensure the sustainability of the results envisaged in the project at least for five years following the settlement of the final payment.

80. The co-operation institution has the right to unilaterally withdraw from the agreement or contract for the implementation of a project in any of the following cases:

80.1. the beneficiary does not fulfil the agreement or contract, including fails to conform to the deadlines specified in the project or other circumstances which negatively affect or may affect the achievement of the Specific Aid Objective, its outcome indicators or supervision indicators, have set in;

80.2. the beneficiary has intentionally provided false information to the cooperation institution during the implementation of the project, and this negatively affects or may affect the objective of the Activity or the achievement of the supervision indicators of the Specific Aid Objective;

80.3. in other cases determined in the agreement or contract.

81. If, upon implementing a project of economic nature, the cooperation institution during the implementation of the project or within five years following the settlement of the final payment finds that the conditions referred to in Sub-paragraphs 2.4, 62.1, Paragraphs 63, 64, and Sub-paragraph 65.2 of this Regulation have not been fulfilled, the public funding granted to the implementation of the project shall be regarded as unjustifiably granted and shall be repaid from the private funding of the beneficiary into State budget in accordance with the following procedures:

81.1. if the implementation of the project has been commenced prior to submission of the project application without taking into account Sub-paragraphs 2.4 and 65.2 of this Regulation, the beneficiary shall fully repay to the cooperation institution the entire public funding received;

81.2. if any of the conditions referred to in Sub-paragraph 62.1 or Paragraph 63 or 64 of this Regulation has not been fulfilled, but other conditions regarding the State aid for commercial activity have been complied with, the beneficiary shall repay the difference of the public funding between the initially applied and actual situation.

82. If, upon implementing a project of non-economic nature, the cooperation institution during the implementation of the project or within five years following the settlement of the final payment finds that the project does not comply with the criterion referred to in Sub-paragraphs 2.1 and 2.5 of this Regulation, the public funding granted to the implementation of the project shall be regarded as unjustifiably granted and shall be fully repaid from the private funding of the beneficiary.

83. If the costs of drawing up the project application are covered from the funding granted in the second round, the project applicant referred to in Paragraph 35 of this Regulation and the cooperation partner thereof (if applicable) cannot qualify for the aid referred to in Sub-paragraph 20.3 of this Regulation for drawing up the project application submitted under the programme "Horizon 2020" and evaluated above the quality threshold.

84. In order to ensure the control of double funding, within the scope of the activity the cooperation institution and the State Education Development Agency shall implement bilateral co-operation by concluding an interdepartmental agreement for the exchange of information and data and for the co-ordinated and supplementary implementation of activities by providing for the procedures by which the exchange of information on drawing up a project application submitted under the programme "Horizon 2020" and evaluated above the quality threshold is ensured.

85. Public funding for the implementation of projects of economic nature shall be granted in accordance with Article 25 of Commission Regulation No 651/2014.

86. The aid granted within the scope of the Activity (including de minimis aid) may not be joined with the aid to the same eligible costs, which has been provided within the scope of another State aid programme and project (including may not be joined with de minimis aid granted within the scope of another State aid programme or project).

87. The beneficiary shall submit and the cooperation institution shall collect data on the supervision indicators referred to in Paragraphs 17, 41, and 59 of this Regulation. The data on indicators referred to in Sub-paragraphs 17.1.1, 17.2.1, 17.3, and 41.1 and Paragraph 59 of this Regulation shall be collected by the cooperation institution pursuant to the two digit classification of science sectors and sub-sectors of statistical classification of economic activities NACE Revision 2 and the Frascati Manual "Guidelines for Collecting and Reporting Data on Research and Experimental Development" developed by the Organisation for Economic Co-operation and Development.

88. The cooperation institution shall ensure the publicity measures laid down in Article 9(1) and (4) of Commission Regulation No 651/2014.

89. The cooperation institution and the implementer of the project referred to in Sub-paragraph 56.2 of this Regulation shall ensure the supervision conditions specified in Article 12 of Commission Regulation No 651/2014.

90. Pursuant to Article 59 of Commission Regulation No 651/2014 or Article 8 of Commission Regulation No 1407/2013, decisions to grant aid shall not be taken after the end date of the application of the abovementioned regulations.

Methodology for the Calculation of the Division of the Public Funding According to Scientific Institutions within the Scope of the Second Project Application Selection Round Available to the Activity 1.1.1.5 "Support for International Co-operation Projects in Research and Innovation" of the Specific Aid Objective 1.1.1 "To increase the research and innovative capacity of scientific institutions of Latvia and the ability to attract external financing, investing in human resources and infrastructure" of the Operational Programme "Growth and Employment"

1. The division of the available public funding Fi according to scientific institutions within the scope of the Activity 1.1.1.5 "Support for International Co-operation Projects in Research and Innovation" (hereinafter - Activity 1.1.1.5) of the Specific Aid Objective 1.1.1 "To increase the research and innovative capacity of scientific institutions of Latvia and the ability to attract external financing, investing in human resources and infrastructure" of the Operational Programme "Growth and Employment" shall be calculated by applying the following formula:

Fi = FSi + FPi + FN_NKP + FMin + FPrV, where

Fi - the total public funding available to project applicant "i" (euros);

i - variation of the project applicant (i = 1, 2, ..);

FSi - the initial public funding available to project applicant to promote international co-operation in the amount of EUR 70 000;

FPi - the additional public funding available to project applicant to promote international cooperation (euros);

FN_NKP - the funding for the implementation of the National Partnership Plan of Latvia of the European Research Infrastructure Consortium (hereinafter - ERIC consortium) which has been determined in the amount of EUR 20 000 for a period of one year and is available to the project applicant referred to in Sub-paragraphs 35.4, 35.10, 35.11, 35.15, and 35.17 of this Regulation for a period of three years if within the ERIC consortium Latvia has the status of a participant, or the funding granted for a period of five years to ensure the functions of the National Contact Point of Latvia of the European Organization for Nuclear Research which is available to the project applicant referred to in Sub-paragraph 35.16 of this Regulation, or funding granted for a period of five years for the implementation of cooperation activities between the project applicant referred to in Sub-paragraph 35.9 of this Regulation, the research centre for quantum software (the Netherlands) and Paris Centre for Quantum Computing (France);

FMin - the minimum funding available to the project applicant for the promotion of international cooperation in the amount of EUR 18 000 which is determined if FPi pursuant to the calculation specified in Paragraphs 2, 3, 4, 5, and 6 of this Regulation does not exceed EUR 18 000;

FPrV - the funding available to the project applicant which is intended for the management of the project referred to in Sub-paragraph 44.6 of this Regulation.

2. Additional public funding for promotion of international co-operation shall be calculated by applying the following formula:

FPi = 0,5 x FInst + 0,5 x FST, where

FPi - the total additional public funding available to promote international cooperation (euros);

FInst - the additional public funding calculated for the project applicant for the implementation of international cooperation activities which has been determined by taking into account the institutional capacity of the project applicant (euros);

FST - the additional public funding calculated for the project applicant for the implementation of international cooperation activities which has been determined by taking into account the success of the project applicant in the European Union Framework Programme for Research and Innovation "Horizon 2020" from 2014 until 2016 (euros).

3. The additional public funding calculated for the project applicant for the implementation of international cooperation activities which has been determined by taking into account the institutional capacity of the project applicant shall be calculated by applying the following formula:

FInst = RZBF x F1115.2k, where

RZBF - the institutional capacity of the project applicant for the promotion of international cooperation which has been determined by, taking into account the maximum limit referred to in Sub-paragraph 47.2 of this Regulation;

F1115.2k - the initial additional public funding available to the project applicant for the promotion of international cooperation within the scope of the second project application selection round of the Activity 1.1.1.5.

4. The institutional capacity of the project applicant for the implementation of international cooperation activities shall be calculated by applying the following formula:

Ki - the coefficient of characteristics of the institutional capacity of the project applicant (i);

- the sum of coefficients of characteristics of the institutional capacity of project applicants.

Ki = (I2016 + P2016) × AT2016 + (I2017 + P2017) × AT2017, where

I2016 - the financial resources for the maintenance of the scientific institution in 2016 determined in accordance with the calculation referred to in Cabinet Regulation No. 1316 of 12 November 2013, Procedures for Calculating and Allocating Financial Reference Amount to Scientific Institutions;

P2016 - the financial resources for the remuneration of a scientific staff - senior researchers, researchers, and research assistants in 2016 determined in accordance with the calculation referred to in Cabinet Regulation No. 1316 of 12 November 2013, Procedures for Calculating and Allocating Financial Reference Amount to Scientific Institutions;

AT2016 - the development coefficient of a scientific institution in 2016 determined in accordance with the calculation referred to in Cabinet Regulation No. 1316 of 12 November 2013, Procedures for Calculating and Allocating Financial Reference Amount to Scientific Institutions;

I2017 - the financial resources for the maintenance of the scientific institution in 2017 determined in accordance with the calculation referred to in Cabinet Regulation No. 1316 of 12 November 2013, Procedures for Calculating and Allocating Financial Reference Amount to Scientific Institutions;

P2017 - the financial resources for the remuneration of a scientific staff - senior researchers, researchers, and research assistants in 2017 determined in accordance with the calculation referred to in Cabinet Regulation No. 1316 of 12 November 2013, Procedures for Calculating and Allocating Financial Reference Amount to Scientific Institutions;

AT2017 - the development coefficient of a scientific institution in 2017 determined in accordance with the calculation referred to in Cabinet Regulation No. 1316 of 12 November 2013, Procedures for Calculating and Allocating Financial Reference Amount to Scientific Institutions.

5. The public funding available to the project applicant for the implementation of international cooperation activities which has been determined by taking into account the success of the project applicant in the European Union Framework Programme for Research and Innovation "Horizon 2020" during the time period from 2014 until 2016 shall be calculated with the following formula:

RH2020 - the coefficient of the characteristics of international cooperation of the project applicant;

IznR1115.2k - the initial total outcome indicator of the second project application selection round of the Activity 1.1.1.5 specified in this Regulation;

F1115.2k - the initial additional public funding available to the project applicant for the promotion of international co-operation within the scope of the second project application selection round of the Activity 1.1.1.5.

6. The coefficient of characteristics of international co-operation of the project applicant RH2020 shall be determined by applying the following formula:

RH2020 = ( KH2020_14/16 ) x 6, where

KH2020_14/16 - the individual size of human resources of the project applicant for preparation of one project application submitted within the scope of the European Union Framework Programme for Research and Innovation "Horizon 2020" and evaluated above the quality threshold which is calculated by applying the following formula:

KH2020_14/16 = ZIPLE_13-15 , where
ZIH2020_14-16

ZIPLE_13-15 - the average number of scientific staff of the project applicant (expressed in the equivalent of full working time) in the period from 2013 until 2015 that is not less than the number of scientific staff (expressed in the equivalent of full working time) in 2015;

ZIH2020_14-16 - the number of project applications submitted by the project applicant and evaluated above the quality threshold within the scope of the European Union Framework Programme for Research and Innovation "Horizon 2020" (including programmes determined pursuant to Article 5 and paragraph 36 of Preamble of Regulation (EU) No 1291/2013 of the European Parliament and of the Council of 11 December 2013 establishing Horizon 2020 - the Framework Programme for Research and Innovation (2014-2020) and repealing Decision No 1982/2006/EC).

7. Funding available to the project applicant and intended for the management of the project specified in Sub-paragraph 44.6 of this Regulation shall be calculated by using the following formula:
