Regulations Regarding the Register of Asylum Seekers

Issued pursuant to
Section 5, Paragraph four of the Asylum Law

1. The Regulation prescribes the amount of information to be included in the Register of Asylum Seekers (hereinafter - the Register), the procedures for using information, as well as institutions to be granted access to the information to be included in the Register.

2. The Register is a State information system in which, for the purposes of implementing the asylum policy and ensuring the planning function, information regarding asylum seekers who have submitted an application regarding granting refugee or alternative status in the Republic of Latvia (hereinafter - the application) shall be included.

3. The Office of Citizenship and Migration Affairs (hereinafter - the Office) is the manager of the Register.

4. Information shall be included and updated in the Register online by the Office and the State Border Guard.

5. The following information shall be included in the Register:

5.1. regarding each of the identities of the asylum seeker:

5.1.1. the given name/names transliterated in Latin alphabet;

5.1.2. the surname transliterated in Latin alphabet;

5.1.3. the sex;

5.1.4. the date, state and place of birth;

5.1.5. the nationality and type thereof;

5.1.6. the ethnicity;

5.1.7. the religious affiliation;

5.1.8. the level of education;

5.1.9. the languages of communication;

5.1.10. the country of threat;

5.1.11. the safe third country;

5.1.12. the first country where asylum was received;

5.1.13. the presented personal document;

5.1.14. the personal document of the asylum seeker;

5.1.15. the photograph of the asylum seeker;

5.1.16. the detailed route of entry;

5.1.17. the identification number of the information system of fingerprints of asylum seekers;

5.2. regarding an unaccompanied minor:

5.2.1. the given name, surname, personal identity number or birth data of the representative appointed by the Orphan's and Custody Court;

5.2.2. the address, telephone number, e-mail of the representative;

5.3. regarding the application:

5.3.1. the date of submission;

5.3.2. the place of submission;

5.3.3. the type of the application;

5.3.4. the kind of the application;

5.3.5. the language of the application;

5.4. regarding the decisions taken:

5.4.1. the decision-taking institution;

5.4.2. the status of the decision;

5.4.3. the number of the decision;

5.4.4. the date of taking the decision;

5.4.5. the type of the decision;

5.4.6. the kind of the decision;

5.4.7. the justification of the decision;

5.4.8. the law or regulation substantiating the decision;

5.4.9. whether the decision was taken on the basis of a court judgement;

5.4.10. the date of notifying the decision;

5.4.11. the method of notifying the decision;

5.5. regarding the appeal of decisions:

5.5.1. the appeal body;

5.5.2. the date of the ruling;

5.5.3. the number of the ruling;

5.5.4. the kind of the ruling;

5.6. regarding the readmission of an asylum seeker from the European Union states and associated countries:

5.6.1. the kind of the request;

5.6.2. the date of the request;

5.6.3. the number of the request;

5.6.4. the state from which the request is received;

5.6.5. the category of the request;

5.6.6. the reply to the request;

5.6.7. the kind of the reply;

5.6.8. the date of the reply;

5.6.9. the category of the reply;

5.7. regarding the transfer of an asylum seeker to the European Union states and associated countries:

5.7.1. the kind of the request;

5.7.2. the date of the request;

5.7.3. the number of the request;

5.7.4. the state to which the request is sent;

5.7.5. the category of the request;

5.7.6. the reply to the request;

5.7.7. the kind of the reply;

5.7.8. the date of the reply;

5.7.9. the category of the reply;

5.8. regarding the assistance granted:

5.8.1. disbursement of a benefit:

5.8.1.1. the date of disbursement;

5.8.1.2. the amount and currency of the benefit;

5.8.1.3. the method of disbursement;

5.8.1.4. the period of disbursement;

5.8.2. accommodation;

5.8.2.1. the date of accommodation;

5.8.2.2. the place, method, room of accommodation;

5.8.2.3. the date when accommodation is discontinued;

5.8.3. issued belongings:

5.8.3.1. the date of the issuance of belongings;

5.8.3.2. the kind of belongings;

5.8.3.3. the date of return of belongings;

5.8.4. the educational institution for a minor asylum seeker;

5.9. the service notes.

6. The State administration institutions, courts and the Prosecutor's Office are entitled to receive the information referred to in Paragraph 5 of this Regulation from the Register and use it according to the competence of the abovementioned institutions.

7. The right to access information shall be granted and annulled by the head of the Office or his or her authorised official on the basis of a request of an institution or the head of the authority.

8. The information included in the Register, including changes to the initially included information, shall be stored in the Register for 10 years after the date when administrative proceedings regarding an application of an asylum seeker have ended.

9. Cabinet Regulation No. 356 of 1 July 2014, Regulations Regarding Register of Asylum Seekers (Latvijas Vēstnesis, 2014, No. 128), is repealed.
