Decision No. 1/8 of the Board of the Public Utilities Commission
Adopted 7 April 2016

Regulations Regarding the Use of System for Input and Processing of Merchant's Information

Issued pursuant to
Section 25, Paragraph one of the law On Regulators of Public Utilities, Section 35,
Paragraph one of the Electronic Communications Law, and Section 12 of the Postal Law

I. General Provisions

1. The Regulation (hereinafter - the Regulation) regarding the use of System for Input and Processing of Merchant's Information (hereinafter - the system) prescribes the provisions for the receipt of access rights to the system and conditions of use of the system for the providers of public utilities.

2. The administrator of the system shall be the Public Utilities Commission (hereinafter - the regulator).

3. The use of system for the providers of public utilities shall be free of charge.

4. User of the system (hereinafter - the user) is a representative of the provider of public utilities - a natural person to whom the rights to use the system have been granted.

5. To commence the work with the system, the user shall use the user name (hereinafter - the account reference) assigned by the Regulator.

6. The system provides for the following user statuses:

6.1. user with rights to submit (hereinafter - the official) - a representative of the provider of public utilities who has rights to prepare and submit the documents to the regulator on behalf of the provider of public utilities; if the official submits the documents to the regulator by using the system, they shall be deemed as signed by hand by the provider of public utilities in accordance with the Electronic Documents Law;

6.2. rights manager - a representative of the provider of public utilities who has the rights to create or change another user with rights to prepare or user with rights to view of the specific provider of public utilities; the provider of public utilities may have only one rights manager;

6.3. user with rights to prepare - a representative of the provider of public utilities who has only the rights to prepare the documents for the regulator and save them in the system on behalf of the provider of public utilities;

6.4. user with rights to view - a representative of the provider of public utilities who has only the rights to view the information entered in the system by the specific provider of public utilities.

II. Conditions for Receipt, Refusal to Grant, and Annulment of the Account Reference

7. To receive access to the system, the provider of public utilities shall accurately and completely fill in and submit to the regulator a signed application regarding the use of the system (hereinafter - the application) in which the following shall be indicated:

7.1. Official;

7.2. Rights manager.

8. The provider of public utilities shall submit the application (Annex) to the regulator in one of the following ways:

8.1. by submitting in person;

8.2. by sending by post;

8.3. by sending to the e-mail sprk@sprk.gov.lv using a safe electronic signature and time stamp.

9. Within 5 working days after receipt of the application the regulator shall:

9.1. create users and grant the account reference to the official and rights manager;

9.2. refuse to create users taking into account the cases specified in Paragraph 10 of this Regulation.

10. The regulator shall refuse to create users - the official and rights manager if:

10.1. the application is incomplete, and mistakes that may delay granting of the account reference have been established therein;

10.2. the application is not signed by a person who has the rights to represent the provider of public utilities;

10.3. the regulator establishes that the information included in the application is not true;

10.4. the submitter of the application is not a provider of public utilities registered with or licensed by the regulator;

10.5. the regulator has annulled the account reference of the official or rights manager of the specific provider of public utilities.

11. The regulator shall inform the provider of public utilities electronically regarding the creation of users and granting of the account reference within 5 working days after the day of receipt of the application (to the e-mail address indicated in the application).

12. The regulator shall inform the provider of public utilities electronically regarding the refusal to create users within 5 working days after the day of receipt of the application (to the e-mail address indicated in the application).

13. The regulator shall annul the account reference if:

13.1. the provider of public utilities has lost the rights to provide public utilities;

13.2. by using the system, the user has violated the regulations for use of the system;

13.3. the access to the system has been blocked on the basis of the fact that indications of illegal activities have been established in the activities of the user in the system. If necessary, the regulator is entitled to block the user's access to the system until the relevant institutions or a court has taken a ruling in relation to the established illegal activities and such ruling has come into legal effect.

III. Security Conditions for Use of the System

14. Security conditions for use of the system shall be approved by the Chair of the regulator.

15. Upon logging in to the system for the first time, the user shall accept the security conditions of the use of the system.

16. The user shall get acquainted with the amendments to security conditions for use of the system electronically by logging in to the system after the amendments have been made.

IV. Final Provision

17. This Regulation shall come into force on 16 May 2016
