Procedures for Granting Temporary Exceptional Aid of the European Union in Milk Sector

Issued pursuant to
Section 5, Paragraph four of the
Law On Agriculture and Rural Development

1. This Regulation prescribes the procedures, by which temporary exceptional aid of the European Union in milk sector shall be granted in accordance with Commission Delegated Regulation (EU) No 1263/2014 of 26 November 2014 providing for temporary exceptional aid to milk producers in Estonia, Latvia and Lithuania (hereinafter - Regulation No 1263/2014).

2. The aid laid down in Article 1 of Regulation No 1263/2014 (hereinafter - aid) for the quantity of milk in tons, which in accordance with the laws and regulations regarding administration of milk quotas for an approved purchaser (hereinafter - purchaser) has been actually (prior to adjustment of the fat content) supplied from 1 August 2014 to 31 October 2014, shall be granted to a milk producer, which in accordance with the laws and regulations regarding the uniform information system for agricultural sector has been registered in the uniform information system for agricultural sector and which according to the situation as on 1 January 2015:

2.1. in accordance with the laws and regulations regarding administration of milk quotas has milk supply quota;

2.2. in accordance with the laws and regulations regarding registration of farm animals, their herds and holdings has registered milk cows or heifers that are more than 18 months old.

3. The aid shall be disbursed by the Rural Support Service. In calculating the aid, the Rural Support Service shall use the data of the Agricultural Data Centre on the quantity of milk actually supplied by the producer (prior to adjustment of the fat content) (in tons) to the purchaser from 1 August 2014 to 31 October 2014.

4. In case of death of the milk producer the aid may be received by a manager of milk quota registered in accordance with the laws and regulations regarding administration of milk quotas.

5. The Rural Support Service shall submit the information specified in Article 3(b) of Regulation No 1263/2014 to the Ministry of Agriculture by 20 June 2015.

6. The Ministry of Agriculture shall submit the information specified in Article 3 of Regulation No 1263/2014 to the European Commission.
