Implementation Plan of the Guidelines "Implementation Guidelines of the United Nations Convention on the Rights of Persons with Disabilities for 2014-2020" for 2014

The plan "Implementation Guidelines of the United Nations Convention on the Rights of Persons with Disabilities for 2014-2020" for 2014 (hereinafter - the Plan) is a short-term policy planning document that has been developed in order to commence implementation of a medium-term planning document "Implementation Guidelines of the United Nations Convention on the Rights of Persons with Disabilities for 2014-2020" (hereinafter - Guidelines).

In conformity with Paragraph 4 of the Cabinet Order No. 564 of 22 November 2013 Regarding Implementation Guidelines of the United Nations Convention on the Rights of Persons with Disabilities for 2014-2020, the Ministry of Welfare shall draw up and the Minister for Welfare shall submit the Implementation Plan of the Guidelines for 2014 to the Cabinet until 1 July 2014 in accordance with the laid down procedures.

The Ministry of Welfare organised a meeting on 29 January 2014 with the representatives of the NGO in order to discuss measures for the implementation of the Guidelines which are intended to be included in the Plan and also proposals regarding the measures to be included in the next plans (for 2015-2017 and 2018-2020) have been listened to. The information from the line ministries regarding the measures planned in the relevant sector for the implementation of the Guidelines has been received during the preparation process of the Plan.

On 27 February 2014 the draft plan drawn up has been placed on the website of the MoW www.lm.gov.lv in the section "Public participation". Consultations have been provided through both, telephone and electronically, to the questions asked regarding the content of measures included in the Plan.

The draft plan has been presented and supported by the meeting of the National Council for the Persons with Disabilities on 12 March this year.

1. Objective, action directions, tasks of the Guidelines and planned results of activities

Objective: An objective of the Guidelines and tasks to be carried out are directed towards promoting ensuring of fundamental rights and freedoms of the persons with disabilities in implementing the United Nations Convention on the Rights of Persons with Disabilities.

Action directions for achievement of the objective:

1) education;

2) employment;

3) social protection;

4) awareness-raising throughout society.

Planned results of activities:

• qualitative and competitive basic education and secondary education for children with disabilities will be ensured, by carrying out their integration in all levels and types of education in conformity with their abilities;

• measures will be carried out for integration of persons in the labour market by providing relevant support to them by taking into account the type of functional disorders of a person with disability;

• measures will be carried out for increase of the level of welfare of the persons with disabilities by reducing the number of persons subject to risk of poverty and ensure that each person with disability receives purposeful and efficient State aid in conformity with the type of functional disorder of a person;

• options to implement human rights and freedoms of persons with disabilities and to live wholesome and deserving life will be promoted by ensuring qualitative informative and democratic space thus strengthening mutual communication and awareness-raising throughout society.

2. Objective, intended measures of the Plan and results of activities

Objective: Implementation of the Guidelines in 2014, by implementing measures that would promote ensuring of fundamental rights and freedoms of the persons with disabilities.

Particular measures that are arranged in conformity with the action directions laid down in the Guidelines are included in the Plan. The Plan demonstrates also the financing necessary for the implementation of measures, the deadlines laid down for the performance of particular tasks, institutions responsible for the implementation of measures included in the Plan, and also direct results of measure activities. Implementation of measures directly ensures practical introduction of action directions of the Guidelines and solutions thereof.

In 2014 the following measures have been carried out for the implementation of the Guidelines within the framework of the action direction "Awareness-raising throughout society of the community" in respect of European Parliament elections which have taken place on 24 May 2014:

1) Informative sheet regarding voting options at the place of location of a voter for the voters in the European Parliament elections of 2014 who due to their health condition cannot arrive at the electoral district (6000 copies distributed at social care institutions);

2) To ensure access to the list of electoral districts of the European Parliament elections of 2014 for voters with reduced mobility (the list of electoral districts of the European Parliament elections of 2014 accessible for voters with reduced mobility has been established, the list has been published on www.cvk.lv);

3) Translation of the pre-election programmes of the lists of deputy candidates of the European Parliament elections of 2014 in the Latvian sign language for deaf (video recordings have been published on the website of the CEC www.cvk.lv, distributed to LAoD);

4) Audio recordings of the lists and pre-election programmes of deputy candidates of the European Parliament elections of 2014 (audio recordings have been published on the website of the CEC www.cvk.lv, distributed to LSoB);

5) Information regarding the European Parliament elections of 2014 in easy-to-read language. On the website of the CEC www.cvk.lv (The section "Easy-to-read" has been established on the website of the CEC www.cvk.lv).

Evaluation of the results of the research of the University of Latvia: Evaluation of the System of Special Education Institutions of the Republic of Latvia" has been carried out within the framework of action direction of the Guidelines "Education" and results of the research have been used for drawing up of the informative report regarding support measures for the supervision of the special education institutions and within the context of setting of the network of education institutions.

3. Institutions responsible for the implementation of measures and reports

The Responsible Institution regarding supervision of the results of the Plan introduction shall be MoW. The responsible institutions and involved institutions for the performance of particular measures have been determined in the Plan.

The MoW shall draw up and the Minister for Welfare shall until 1 November 2018 submit the interim assessment of the Guidelines to the Cabinet in which the information regarding implementation of the Plan and Implementation Plan of the Guidelines for 2015-1017 by operation periods thereof is included.

To ensure qualitative and competitive basic education and secondary education for children with disabilities, by carrying out integration of children with disabilities in all levels and types of education in conformity with their abilities.

3.1.1.1. To introduce new, improved disability determination system, in conformity with which disability will be determined by evaluating not only health condition of a person but also functioning of a person, in conformity with international functioning classification, by focusing more on the evaluation of social criteria in addition to medical criteria. By the new disability determination system, the number of institutions and specialists involved in disability expert examination will increase, and also co-involvement of the person himself/herself will be determined.

3.1.2.1. To evaluate the procedures for granting and disbursing of a benefit for persons with disabilities for whom a special care is necessary if a benefit recipient is placed in a long-term care institution.

To improve the services laid down in the Disability Law for the reducing of consequences caused by the disability (including, assistant service in the local government, assistant service for the acquisition of educational programmes, service of psychologist for children for whom disability is determined for the first time and legal representatives thereof, adjusting of housing service for persons with 1st group disability, for persons with visual or hearing disability of Group II and for persons up to 18 years of age for whom medical indications have been determined for the necessity for special care of a disabled child)

3.1.3.1. To make psychologist's services more efficient for a person up to 18 years of age for whom disability has been determined for the first time.

3.1.3.2. To determine financing of a benefit for a visually disabled person of Group I for the use of the assistant service and procedures for the receipt thereof from 1 January 2015.

3.1.3.3. To improve the procedures for the receipt of social rehabilitation services by persons with visual and hearing disability and procedures for the receipt of technical aids by persons with functional disorders of vision or hearing or anatomical defects (typhlo-tecnique and surdo technique) and also to update the range of typhlo-technique and surdo technique ensured by the State.

2. The range of recipient of technical aids - surdo technique - is broadened in respect of children with hearing impairments.

3. Amendments have been made to the Cabinet Regulation No. 1472 of 15 December 2009, Procedures for Providing of Social Rehabilitation Services by the Latvian Society of the Blind and Latvian Association of the Deaf and Ensuring of Technical Aids - Typhlo-tecnique and Surdo Technique.

Impact on the State and local government budgets for the implementation of the 2nd measure will be indicated in the developed draft Cabinet Regulation, in its turn the implementation of the measures indicated in Paragraph 1 and 3 will be ensured within the framework of the State budget.
3.1.3.4. To broaden the range of recipients of the assistant service for the acquiring of educational programmes, by determining that the assistant service may be received also by persons with disabilities who are studying at the higher education institutions.

- information regarding procedures for ensuring the possibility for persons with functional impairments to receive health care services provided by medical treatment institution (including information regarding alternative solutions).

4.1.5.3. To organise informative seminars regarding ensuring of accessibility of the environment and information for persons with disabilities.
