Decision No. 1/6 of the Board of the Public Utilities Commission

Regulations Regarding Conditions for Use of Efficient Permitted Load

Issued pursuant to
Section 9, Paragraph 2.2 of the Electricity Market Law and Section 25,
Paragraph one of the law On Regulators of Public Utilities

1. The Regulation prescribes the procedures by which the electricity distribution system operator shall develop, submit for approval to the Public Utilities Commission (hereinafter - the regulator), and publish the conditions for use of efficient permitted load (hereinafter - the conditions), and the procedures by which these conditions are applicable to new connections that comply with the requirements laid down by the regulator.

2. The distribution system operator shall submit to the regulator for co-ordination the conditions for new connections of the system of electricity users or for increase of permitted load in the existing connections of the system of electricity users (hereinafter - the connection) if the relevant connection concurrently complies with the following requirements:

2.1. voltage of the connection is:

2.1.1. 6 - 20 kV or

2.1.2. 0.4 kV and the permitted total nominal current of the input protection appliance is more than 100 A;

2.2. the amount of the system services used by the electricity user conforms to the efficiency criteria for the use of efficient permitted load laid down by the distribution system operator.

3. Concurrently with the information specified in Paragraph 2 of this Regulation, the distribution system operator shall submit to the regulator the efficiency criteria for the use of efficient permitted load and justification thereof.

4. The distribution system operator shall apply the conditions to the electricity user in a specific connection within a time period which is not longer than 5 years from the day of concluding the system service agreement or agreement on the amendments to a valid system service agreement.

5. The distribution system operator shall discontinue applying conditions to the electricity user in a specific connection from the moment when the difference between the total sum of invoices of distribution system services, if the conditions for use of efficient permitted load were not applied, and the total sum of invoices of distribution system services, by applying the conditions for use of efficient permitted load, reaches the connection fee paid by the electricity user.

6. The distribution system operator shall not apply the conditions if the electricity user uses the system connection for ensuring the self-consumption of electricity production object.

7. After co-ordination with the regulator, the distribution system operator shall publish on its website the conditions and procedures by which they are applicable to new connections that comply with the requirements laid down in Paragraph 2 of this Regulation.

8. Regulator decision No. 1/1 of 18 January 2012, Regulations Regarding Conditions for Use of Efficient Permitted Load (Latvijas Vēstnesis, 2012, No. 12), is repealed.

9. This Regulation shall come into force on the day following the publication thereof in the official gazette Latvijas Vēstnesis.
