Regulations Regarding the European Technical AssessmentIssued pursuant to 1. This Regulation prescribes the procedures by which the European technical assessment institution shall be selected, as well as the procedures by which a European technical assessment shall be issued. 2. A European technical assessment of a construction product (hereinafter - technical assessment) in accordance with Regulation No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (hereinafter - Regulation No 305/2011) and with this Regulation shall be issued by a technical assessment institution accredited in accordance with the procedures laid down in this Regulation. 3. A legal person who is a candidate for the issuance of technical assessments in Latvia (hereinafter - applicant) shall submit an accreditation application (Annex 1) to the unit - Latvian National Accreditation Bureau - of the limited liability company "Standardisation, Accreditation and Metrology Centre" (hereinafter - National Accreditation Bureau) and append documents certifying the conformity of the applicant with the requirements laid down in Table 2 of Annex IV to Regulation No 305/2011. 4. After receipt of the documents referred to in Paragraph 3 of this Regulation the National Accreditation Bureau shall evaluate the competence of the applicant in accordance with the laws and regulations regarding assessment, accreditation and supervision of conformity assessment institutions and take one of the following decisions: 4.1. to grant accreditation, if the applicant conforms to the requirements laid down in Table 2 of Annex IV to Regulation No 305/2011; 4.2. not to grant accreditation, if the applicant does not conform to the requirements laid down in Table 2 of Annex IV to Regulation No 305/2011. 5. An applicant who has been granted accreditation shall be considered a technical assessment institution approved in Latvia within the meaning of Article 29(1) of Regulation 305/2011. The Ministry of Economics shall notify information regarding the technical assessment institution to other member states of the European Economic Area and to the European Commission. 6. The operation and competence of the technical assessment institution shall be supervised by the National Accreditation Bureau in accordance with Article 29(3) of Regulation No 305/2011. 7. Each year by 31 March the technical assessment institution shall submit to the Ministry of Economics a report on technical assessments issued in the previous year and technical assessments in the stage of development, refusals to issue a technical assessment, as well as European assessment documents in the development of which the relevant technical assessment institution is participating or has participated. 8. In order to receive technical assessment, a manufacturer or its authorised representative which is established in a state of the European Economic Area and is especially authorised for submitting an application requesting European technical assessment (hereinafter - application) (hereinafter - submitter) shall submit an application to the technical assessment institution (Annex 2). 9. A submitter is entitled to request technical assessment concurrently for a specific construction product, set of construction products or family of construction products only in one technical assessment institution of a state of the European Economic Area. 10. Upon requesting technical assessment, the submitter agrees that the technical assessment institution shall inform the European Commission, the technical assessment organisation referred to in Article 31(1) of Regulation No 305/2011 and technical assessment institutions of other member states of the European Economic Area regarding the content of the application. 11. All the potential production units of a construction product and their locations shall be indicated in the application. The submitter shall ensure that specialists of the technical assessment institution or its authorised experts, in performing technical assessment, are able to visit such production units during their working hours. 12. The technical assessment institution has the right to request that the submitter appends the following documents to the application: 12.1. a description and technical drawings of the construction product; 12.2. specifications of the construction product; 12.3. test reports; 12.4. calculations; 12.5. other information which is necessary for technical assessment and conformity assessment of the construction product in relation to validity for the intended use. 13. The costs of the technical assessment procedure and granting of technical assessment shall be covered by the submitter. 14. The technical assessment institution and its authorised experts shall ensure protection of information which has become known to them upon examining an application and taking a decision on the issuance of technical assessment. 15. Cabinet Regulation No. 1185 of 29 October 2013, Regulations Regarding the European Technical Assessment (Latvijas Vēstnesis, 2013, No. 214), is repealed. 16.
