Regulations Regarding the Procedures for Obtaining the Certificate of a Pyrotechnician, and the Procedures for and Amount of the Payment of the State Fee

Issued pursuant to
Section 19, Paragraphs four and seven of the Law
on the Circulation of Pyrotechnic Articles

I. General Provisions

1. This Regulation prescribes:

1.1. procedures for obtaining the certificate of a pyrotechnician;

1.2. the procedures for and the amount of the payment of the State fee for the issue of the certificate of a pyrotechnician, a duplicate thereof and a repeated certificate.

2. The certificate of a pyrotechnician (Annex 1) shall be issued by the State Police. The State Police shall establish a licensing commission for the issue of the certificate of a pyrotechnician that shall consist of at least five persons (hereinafter - the licensing commission).

II. Procedures for Obtaining the Certificate of a Pyrotechnician

3. In order to obtain the certificate of a pyrotechnician, a person shall submit an application to the licensing commission (Annex 2). The following shall be indicated in the application:

3.1. the given name, surname, and the personal identity number of the person or the date of birth of the person, if a personal identity number has not been granted;

3.2. the address of the place of residence, phone number and electronic mail address (if the person wishes to receive the certificate of a pyrotechnician electronically);

3.3. the type of receipt of the certificate of a pyrotechnician - in printed form or in the form of an electronic document.

4. The following documents shall be appended to the submission referred to in Paragraph 3 of this Regulation:

4.1. a document attesting the acquisition of the profession or qualification of a pyrotechnician, or the acquisition of a programme for vocational training, further training or vocational orientation necessary for obtaining the certificate of a pyrotechnician, and the passing of qualification examination at an educational institution (a copy);

4.2. one photograph (3 x 4 cm).

5. The application referred to in Paragraphs 3, 12, 14 and 15 of this Regulation and the documents to be appended thereto or their copies shall be submitted in printed form or in the form of an electronic document in conformity with the laws and regulations regarding the drawing up of electronic documents.

6. Within 15 days after receipt of the application referred to in Paragraph 3 of this Regulation, the licensing commission shall examine it and the documents appended thereto, and inspect whether the person is subject to the restrictions for the issue of the certificate of a pyrotechnician determined in the Law on the Circulation of Pyrotechnic Articles.

7. Within 15 days after carrying out the inspection referred to in Paragraph 6 of this Regulation, the licensing commission shall decide on the issue of the certificate of a pyrotechnician or the refusal to issue the certificate of a pyrotechnician.

8. The licensing commission shall record the decision taken in the minutes of the meeting of the licensing commission, and shall inform the person thereon.

9. If additional examination of the application referred to in Paragraph 3 and the documents appended thereto is necessary to decide on the issue of the certificate of a pyrotechnician or the refusal to issue the certificate of a pyrotechnician, the licensing commission shall extend the time period for taking a decision in accordance with the procedures laid down in the Administrative Procedure Law.

10. When issuing the certificate of a pyrotechnician, the licensing commission shall ascertain in accordance with the procedures laid down in the laws and regulations that the payment of the State fee has been received in the State budget. If the person has expressed a wish to receive the certificate of a pyrotechnician in the form of an electronic document, the licensing commission shall inspect whether all the documents referred to in Paragraphs 3 and 4 of this Regulation have been submitted and the payment of the State fee has been received in the State budget, and shall send the certificate of a pyrotechnician to the person in the form of an electronic document in conformity with the laws and regulations regarding the drawing up of electronic documents within three working days after receipt of the payment of the fee.

11. If a person fails to pay the State fee determined for the issue of the certificate of a pyrotechnician within two months after receipt of the information on the issue of the certificate of a pyrotechnician, the application for obtaining the certificate of a pyrotechnician shall be submitted anew in accordance with general procedures.

12. If the certificate of a pyrotechnician issued in paper form is damaged, lost or stolen, the pyrotechnician shall, within five working days, inform the licensing commission thereon in accordance with the procedures referred to in Paragraph 5 of this Regulation by submitting an application (Annex 2) for the issue of a duplicate of the certificate of a pyrotechnician. The information referred to in Sub-paragraphs 3.1, 3.2 and 3.3 of this Regulation and the reason for issuing the duplicate of the certificate of a pyrotechnician shall be indicated in the application, and one photograph (3 x 4 cm) shall be appended thereto.

13. Based on the application referred to in Paragraph 12 of this Regulation, the licensing commission shall send or issue a duplicate of the certificate of a pyrotechnician within five working days.

14. If the certificate of a pyrotechnician issued in the form of an electronic document is damaged, lost or stolen, the pyrotechnician shall, within five working days, inform the licensing commission thereon in accordance with the procedures referred to in Paragraph 5 of this Regulation by submitting an application (Annex 2) for the issue of a repeated certificate of a pyrotechnician. The information referred to in Sub-paragraphs 3.1, 3.2 and 3.3 of this Regulation and the reason for issuing the duplicate of the certificate of a pyrotechnician shall be indicated in the application, and one photograph (3 x 4 cm) shall be appended thereto.

15. If the given name or surname of a pyrotechnician has changed, the pyrotechnician shall inform the licensing commission thereon in writing within five working days by submitting an application (Annex 2) for the issue of a repeated certificate of a pyrotechnician. The information referred to in Sub-paragraphs 3.1, 3.2 and 3.3 of this Regulation and the reason for issuing a repeated certificate of a pyrotechnician shall be indicated in the application, and one photograph (3 x 4 cm) shall be appended thereto.

16. Based on the application referred to in Paragraphs 14 and 15 of this Regulation, the licensing commission shall send or issue a repeated certificate of a pyrotechnician within five working days.

17. A duplicate of the certificate a pyrotechnician and a repeated certificate of a pyrotechnician shall be issued by complying with the procedures referred to in Paragraphs 10 and 22 of this Regulation.

18. When receiving a repeated certificate of a pyrotechnician in accordance with the Paragraph 15 of this Regulation, the pyrotechnician has an obligation to submit to the licencing commission the certificate of a pyrotechnician that was previously issued in paper form before the receipt of the repeated certificate of a pyrotechnician.

19. The pyrotechnician is obliged to perform health examination before the expiry of the time period indicated in the opinion of a psychiatrist and narcologist or not later than after five years from the day when the opinion was issued, if the time period for the validity of the opinion has not been indicated therein.

III. Procedures for and Amount of the Payment of the State Fee for the Issue of the Certificate of a Pyrotechnician, a Duplicate Thereof and a Repeated Certificate

20. The State fee shall be paid for issuing the certificate of a pyrotechnician, a duplicate and repeated certificate thereof in the following amount:

20.1. for the issue of the certificate of a pyrotechnician - EUR 49.80;

20.2. for the issue of a duplicate of the certificate of a pyrotechnician - EUR 19.92;

20.3. for the issue of a repeated certificate of a pyrotechnician - EUR 19.92.

21. If the certificate of a pyrotechnician is issued in the form of an electronic document, the State fee referred to in Paragraph 20 of this Regulation shall be paid by applying the coefficient of 0.9.

22. The State fee shall be paid before receipt of the certificate of a pyrotechnician. The payment of the State fee shall be made with the intermediation of a provider of payment services who has the right to provide payment services within the meaning of the Law on Payment Services and Electronic Money.

23. The State fee shall be transferred into the State basic budget.

IV. Closing Provision

24. This Regulation shall come into force on 4 July 2013.
