Regulations Regarding the Procedures for the Issue of the Certificate of a Blaster and the Certificate of a Blasting Manager, and the Procedures for and the Amount of the Payment of the State Fee

Issued pursuant to
Section 24, Paragraph eight and Section 25, Paragraph two
of the Law on the Handling of Explosives for Civil Uses

I. General Provisions

1. This Regulation prescribes:

1.1. the procedures for the issue of the certificate of a blaster and the certificate of a blasting manager, a duplicate and a repeated certificate thereof;

1.2. the procedures for and the amount of the payment of the State fee for the issue of the certificate of a blaster and the certificate of a blasting manager, a duplicate and a repeated certificate thereof;

1.3. the institution which shall conduct the qualification examination of a blaster and a blasting manager;

1.4. the procedures for the revocation of the certificate of a blaster and the certificate of a blasting manager.

2. Certificates of a blaster and certificates of a blasting manager shall be issued by the licensing commission established by the State Police. It shall be composed of at least five persons. In the course of fulfilling its obligations, the licensing commission is entitled to invite experts.

II. Institution which shall Conduct the Qualification Examination of a Blaster and a Blasting manager

3. The qualification examination of a blaster and qualification examination of a blasting manager may be conducted by a legal person who has obtained licences in accordance with the laws and regulations governing the procedures for the licensing of education programmes for further training that allows to implement education programmes for further training to obtain the certificate of a blaster and certificate of a blasting manager (hereinafter - the educational institution).

4. The State Police shall develop the education programmes for further training referred to in Paragraph 3 of this Regulation and co-ordinate them with the Ministry of Education and Science.

5. The educational institution shall establish the commission for conducting the qualification examinations of a blaster and blasting manager. The competent persons delegated by the State Police, Security Police and State Fire-fighting and Rescue Service shall be included in the composition of the commission.

III. Issuing the Certificate of a Blaster and Certificate of a Blasting Manager

6. In order to obtain the certificate of a blaster (Annex 1), a person shall submit an application to the licensing commission (Annex 2). The following shall be indicated in the application:

6.1. the given name, surname, and the personal identity number of the person or the date of birth of the person if a personal identity number has not been granted;

6.2. the address of the declared place of residence, phone number and electronic mail address (if the person wishes to receive the certificate electronically);

6.3. the type of receipt of the certificate - in printed form or in the form of an electronic document.

7. The following documents shall be appended to the application referred to in Paragraph 6 of this Regulation:

7.1. a copy of the document which attests the acquisition of the education programme for the further training of a blaster and passing the qualification examination at the educational institution;

7.2. an opinion of a psychiatrist and narcologist on the health condition of the person;

7.3. one photograph (3 x 4 cm) taken not earlier than three months before.

8. In order to obtain the certificate of a blasting manager (Annex 3), a person shall submit an application to the licensing commission (Annex 4). The following shall be indicated in the application:

8.1. the given name, surname, and the personal identity number of the person or the date of birth of the person if a personal identity number has not been granted;

8.2. the address of the declared place of residence, phone number and electronic mail address (if the person wishes to receive the certificate electronically);

8.3. the type of receipt of the certificate - in printed form or in the form of an electronic document.

9. The following documents shall be appended to the application referred to in Paragraph 8 of this Regulation:

9.1. a copy of the document which attests acquisition of the qualification of a mining engineer at the educational institution or the acquisition of the education programme for the further training of a blasting manager and passing the qualification examination at the educational institution;

9.2. a copy of the document which attests that the person has work experience of at least three years in the position of a blaster or blasting manager;

9.3. an opinion of a psychiatrist and narcologist on the health condition of the person;

9.4. a copy of the certificate of attendance of a training course on first aid or a copy of the medical education document, or a copy of the diploma and transcript of records of the educational institution which attests that the abovementioned person has acquired the relevant training course at this educational institution;

9.5. one photograph (3 x 4 cm) taken not earlier than three months before.

10. The opinion referred to in Sub-paragraphs 7.2. and 9.3 of this Regulation shall be valid for 90 days from the date of its issue.

11. The application referred to in Paragraphs 6 and 8 of this Regulation and the documents referred to in Paragraphs 7 and 9 of this Regulation or their copies shall be submitted in printed form or in the form of an electronic document in conformity with the laws and regulations regarding the drawing up of electronic documents.

12. The licensing commission shall, within 15 days after receipt of the application referred to in Paragraph 6 of this Regulation, examine it and documents appended thereto, and inspect whether:

12.1. the person is subject to the restrictions specified for the receipt of the certificate of a blaster in the Law on the Handling of Explosives for Civil Uses;

12.2. the person whose certificate of a blaster has been previously revoked has passed the qualification examination referred to in Sub-paragraph 7.1 of this Regulation.

13. The licensing commission shall, within 15 days after receipt of the application referred to in Paragraph 8 of this Regulation, examine it and documents appended thereto, and inspect whether:

13.1. the person is subject to the restrictions specified for the receipt of the certificate of a blasting manager in the Law on the Handling of Explosives for Civil Uses;

13.2. the person whose certificate of a blasting manager has been previously revoked has passed the qualification examination referred to in Sub-paragraph 9.1 of this Regulation.

14. The licensing commission shall, within 15 days after carrying out the inspections referred to in Paragraphs 12 and 13 of this Regulation, decide on the issue of the certificate of a blaster or certificate of a blasting manager or on the refusal to issue the certificate of a blaster or certificate of a blasting manager, and notify the person thereof in writing.

15. If additional examination of information is necessary to take the decision on the issue of a certificate or on the refusal to issue the certificate, the licensing commission shall extend the time period for taking a decision in accordance with the procedures laid down in the Administrative Procedure Law.

16. Before the issue of the certificate of a blaster or certificate of a blasting manager the licensing commission shall ascertain in accordance with the procedures laid down in the laws and regulations that the State fee has been paid.

17. If a person has expressed the wish to receive the certificate of a blaster or certificate of a blasting manager in the form of an electronic document, the licensing commission shall inspect whether the payment of the State fee has been received in the State budget, and within three working days after receipt of the State fee payment in the State budget shall send the relevant certificate in the form of an electronic document in conformity with the laws and regulations regarding the drawing up of electronic documents.

18. If a person fails to pay the determined State fee within two months after receipt of the information on the issue of the certificate of a blaster or certificate of a blasting manager, the application for obtaining of the certificate of a blaster or certificate of a blasting manager shall be submitted anew in accordance with general procedures.

19. If the certificate of a blaster or certificate of a blasting manager issued in printed form is lost, stolen or damaged, the person shall, within five working days after establishing the relevant fact, inform the licensing commission thereon in writing by submitting an application and photograph (3 x 4 cm) taken not earlier than three months before to the licensing commission. The licensing commission shall issue a duplicate of the relevant certificate within five working days after receipt of the abovementioned information.

20. If the certificate of a blaster or certificate of a blasting manager issued in the form of an electronic document is damaged, lost or stolen, the person shall, within five working days after establishing the relevant fact, inform the licensing commission thereon in writing by submitting an application and a photograph (3 x 4 cm) taken not earlier than three months before to the licensing commission. The licensing commission shall issue a duplicate of the relevant certificate within five working days after receipt of the abovementioned information.

21. If the given name or surname of a blaster or blasting manager has changed, the person shall, within five working days, inform the licensing commission thereon and submit a photograph (3 x 4 cm) taken not earlier than three months before. The licensing commission shall issue a repeated relevant certificate within five working days after receipt of the abovementioned information.

22. A duplicate of the certificate and repeated certificate shall be issued by complying with the procedures referred to in Paragraphs 16 and 17 of this Regulation.

23. In the case referred to in Paragraph 21 of this Regulation, a person has the obligation to destroy the previously issued relevant certificate after obtaining a repeated certificate.

24. A decision of the licensing commission to refuse to issue the certificate of a blaster (or duplicate thereof) or the certificate of a blasting manager (or a duplicate thereof) may be contested by submitting the relevant application to the Head of the State Police.

IV. Revocation of the Certificate of a Blaster and Certificate of a Blasting Manager

25. A decision to revoke the certificate of a blaster or certificate of a blasting manager shall be taken by the licensing commission if conformity with the restrictions for the receipt of the relevant certificate specified in the Law on the Handling of Explosives for Civil Uses has been found.

26. Within three working days after taking the decision to revoke the certificate of a blaster or certificate of a blasting manager, the licensing commission shall inform the person thereof for whom the relevant certificate has been revoked.

27. A person whose certificate of a blaster or certificate of a blasting manager has been revoked shall, within three working days after receipt of the decision referred to in Paragraph 26 of this Regulation, destroy the relevant certificate.

28. The decision of the licensing commission to revoke the certificate of a blaster or certificate of a blasting manager may be contested and appealed in accordance with the procedures laid down in the Administrative Procedure Law. Contesting and appeal of the abovementioned decision shall not suspend its operation.

29. A person whose certificate of a blaster or certificate of a blasting manager has been revoked is entitled to receive a new certificate after passing the qualification examinations referred to in Sub-paragraph 7.1 or 9.1 of this Regulation accordingly, however not earlier than a year after the decision to revoke the certificate has been taken.

V. The Procedures for and the Amount of the Payment of the State Fee for the Issue of the Certificate of a Blaster or the Certificate of a Blasting Manager, a Duplicate and a Repeated Certificate Thereof

30. The State fee shall be paid for the issue of the certificate of a blaster or certificate of a blasting manager, a duplicate and repeated certificate thereof in the following amount:

30.1. for the issue of the certificate - EUR 55.34;

30.2. for the issue of a duplicate of the certificate - EUR 22.13;

30.3. for the issue of a repeated certificate - EUR 22.13.

31. If the certificate of a blaster or certificate of a blasting manager has been issued in the form of an electronic document, the State fee referred to in Sub-paragraphs 30.1, 30.2 and 30.3 of this Regulation shall be paid by applying a coefficient 0.9.

32. The State fee shall be paid before the receipt of the certificate.

33. The State fee shall be paid with the intermediation of a provider of payment services who has the right to provide payment services within the meaning of the Law on Payment Services and Electronic Money.

34. The State fee shall be transferred into the State basic budget.

VI. Closing Provisions

35. Until 1 January 2013, in order to obtain the certificate of a blaster, a copy of the document which attests acquiring of the professional qualification of a blaster in such education programme for further training which was implemented before the implementation of the education programme for further training referred to in Paragraph 4 of this Regulation may be submitted instead of a copy of the document referred to in Sub-paragraph 7.1 of this Regulation.

36. Until 1 January 2013, in order to obtain the certificate of a blasting manager, a copy of the document which attests acquiring of the professional qualification of a blasting manager in such education programme for further training which was implemented before the implementation of the education programmes for further training referred to in Paragraph 4 of this Regulation may be submitted instead of a copy of the document referred to in Sub-paragraphs 9.1 of this Regulation which attests acquiring of the education programmes for further training of a blasting manager and passing qualification examination.
