Regulations Regarding the State Uniform Geospatial Information Portal

Issued pursuant to
Section 28, Paragraph three of the Geospatial Information Law

I. General Provisions

1. This Regulation prescribes:

1.1. the metadata and geospatial data sets (hereinafter - data sets) to be included in the State uniform geospatial information portal (hereinafter - geoportal);

1.2. the functions and tasks of the manager of the geoportal;

1.3. the requirements to be put forward to the holders of data sets and their duties in order to ensure the availability of metadata and data sets in the geoportal and use thereof;

1.4. the provisions for the use of geospatial information included in the geoportal.

2. The geoportal shall ensure uniform access to metadata, data sets and geospatial information services (hereinafter - services).

3. The web address of the geoportal shall be www.geolatvija.lv.

II. Metadata and Data Sets to be Included in the Geoportal

4. Metadata and data sets shall be included in the geoportal if:

4.1. they relate to an area where the Republic of Latvia exercises jurisdictional rights;

4.2. they are in electronic format;

4.3. they relate to geospatial data themes (Annex).

5. Such metadata and data sets shall also be included in the geoportal, which do not conform to Sub-paragraph 4.3 of this Regulation, if metadata and data sets are necessary in order to implement the norms specified in regulatory enactments and international agreements binding to Latvia.

6. Metadata and data sets, which are included in the geoportal, shall conform to the following requirements:

6.1. information regarding data sets and services shall be included in metadata, conforming to the requirements specified in regulatory enactments regarding mandatory content of metadata;

6.2. basic data, which conform to the requirements specified in the regulatory enactments regarding acquisition, preparation and maintaining of basic data, shall be used for the preparation and updating of data sets;

6.3. the classification and classifiers (code systems) specified in the regulatory enactments regarding the uniform classification system of national geospatial objects shall be used for geospatial objects included in data sets;

6.4. file formats, the specification of which is accessible to the public and which ensure the interoperability of geospatial data sets and services, shall be used for metadata and data sets.

III. Functions and Tasks of the Manager of the Geoportal

7. The manager of the geoportal shall ensure the functionality of the geoportal necessary for the provision of the services referred to in Section 28, Paragraph two of the Geospatial Information Law (hereinafter - network services), complying with the requirements specified in regulatory enactments in relation to network services.

8. The manager of the geoportal shall ensure the creation of the geoportal, as well as the maintenance of information and technical resources necessary for the operation of the geoportal and the security management thereof, complying with the requirements specified in the regulatory enactments regarding State information systems.

9. The manager of the geoportal shall ensure the functionality of the geoportal necessary for the use and reuse of data sets of State information systems, complying with the requirements specified in regulatory enactments for the maintenance and operation of State information systems management integrators.

10. The manager of the geoportal shall ensure access to the geospatial information at the disposal of the holder of geospatial information and services related thereto, if the relevant geospatial information and services conform to the requirements specified in regulatory enactments in relation to metadata, network services and interoperability of data sets and services.

11. The manager of the geoportal shall ensure access to the geospatial information and services at the disposal of the holder of geospatial information on the basis of an agreement with the holder of geospatial information. Agreement document shall contain an indication of metadata, data sets and services, access to which is ensured by the geoportal, and conditions for the provision of access to the indicated metadata, data sets and services according to the functionality of the geoportal.

12. The manager of the geoportal shall provide advisory support to holders of geospatial information in order to ensure access to geospatial information and services in the geoportal.

13. The geoportal shall carry out supply of unaltered content of geospatial information from the holder of geospatial information to a person using the geoportal in order to access geospatial information and services (hereinafter - user of the geoportal). The manager of the geoportal shall take safety measures of the geoportal in order to prevent the damaging of geospatial information or coming at the disposal of unauthorised persons during the supply of geospatial information.

14. The manager of the geoportal shall ensure the holder of geospatial information with access to the audit records of the geoportal, which are related to access to the geospatial information at the disposal of the holder of geospatial information or services.

15. If a safety incident of the geoportal has occurred, which may endanger the safety of the geospatial information included in the geoportal, the manager of the geoportal shall, without delay, inform holders of geospatial information thereof and perform measures co-ordinated with them in order to eliminate the threat to the safety of geospatial information.

16. The manager of the geoportal shall insert information in the geoportal, which is related to the use of the geoportal and the services available therein, as well as provide advisory support to users of the geoportal in the use of the geoportal.

17. The manager of the geoportal shall ensure access to information regarding the number of requests for network services per year, indicating the number of requests for each type of network service.

18. The manager of the geoportal shall ensure the use of the geoportal in the official language, also providing for the use of other languages specified by international obligations.

IV. Requirements and Duties to be Put Forward to the Holders of Data Sets

19. A holder of data set has a duty to ensure the availability of metadata and data sets to be included in the geoportal.

20. A holder of data set shall maintain the metadata and data sets included in the geoportal, as well as services related thereof, complying with the requirements specified in regulatory enactments in relation to metadata, network services and interoperability of data sets and services.

21. When using the geoportal, a holder of data set shall ensure shared use of the data set at the disposal thereof or transfer thereof for reuse.

22. A holder of data set shall ensure a possibility of accessing metadata and data sets after they have been requested in the geoportal, complying with the requirements specified in regulatory enactments for the provision of access to metadata and data sets.

23. A holder of data set shall, not more than a month prior to making changes in metadata or data sets, inform the manager of the geoportal thereof, if the changes to be made are related to the possibility of accessing the geospatial information at the disposal of the holder of data set or services, using the geoportal.

24. If, in using the geoportal, a holder of data set ensures access to metadata and data sets in the State information system under the management thereof, the holder of data set shall ensure the functionality thereof in compliance with the regulatory enactments regarding the procedures, by which the functionality of the State information system shall be ensured within the scope of the State information system, using a State information systems management integrator.

25. A holder of data set has a duty to inform, without delay, the manager of the geoportal regarding changes necessary in the information referred to in Paragraph 16 of this Regulation, if it applies to access to metadata or data sets.

26. If a holder of data set detects that, in using the geoportal, the metadata or data sets at the disposal thereof and included in the geoportal have been damaged, destroyed or have come at the disposal of unauthorised persons, the holder of data set shall, without delay, inform the manager of the geoportal thereof and take measures co-ordinated therewith in order to eliminate the incident related to the security of geospatial information included in the geoportal.

V. Provisions for the Use of Geospatial Information Included in the Geoportal

27. A user of the geoportal shall use the geospatial information included in the geoportal according to the provisions for use thereof, regarding which the user of the geoportal has agreed with the holder of the relevant geospatial information in compliance with the regulatory enactments regarding provision of geospatial information. The geoportal shall ensure the user of the geoportal with an opportunity of requesting and receiving a permit of the holder of geospatial information for the use of geospatial information included in the geoportal in accordance with the regulatory enactments regarding the mandatory content of provisions for the use of geospatial data set and the procedures for receipt of a permit.

28. If access or use limitations have been determined for geospatial information included in the geoportal, the geoportal shall ensure access to the geospatial information at the disposal of the holder of geospatial information to an identified user of the geoportal. The geoportal shall ensure a possibility of performing an identity check (authentification) of the user of the geoportal.

29. If fee for the use of geospatial information included in the geoportal has been specified, a user of the geoportal shall make the relevant payment using the geoportal. Payment for the use of geospatial information included in the geoportal shall be received by the holder of the relevant geospatial information.

VI. Closing Provisions

30. The manager of the geoportal shall ensure the creation and availability of the geoportal by 1 November 2013.

31. Sub-paragraph 6.3 of this Regulation shall be applied after introduction of the uniform national classification system of geospatial objects in compliance with the conditions of Section 19, Paragraph three of the Geospatial Information Law.

This Regulation contains legal norms arising from Directive 2007/2/EC of the European Parliament and of the Council of 14 March 2007 establishing an Infrastructure for Spatial Information in the European Community (INSPIRE).

1. Coordinate reference systems Systems for uniquely referencing spatial information in space as a set of coordinates (x, y, z) or latitude, longitude and height, based on a geodetic horizontal and vertical datum
2. Geographical grid systems Harmonised multi-resolution grid with a common point of origin and standardised location and size of grid cells
3. Geographical names Names of administrative areas, regions, localities, cities, suburbs, towns or settlements, or any geographical or topographical feature of public or historical interest
4. Administrative units Units of administration, dividing areas where the Republic of Latvia has jurisdictional rights, for local, regional and national governance, separated by administrative boundaries
5. Addresses Location of properties based on address identifiers (usually by road name, house number, postal code)
6. Cadastral parcels Areas defined by cadastral registers or equivalent
7. Transport networks Road, rail, air and water transport networks and related infrastructure. Also includes links between different networks, also the trans-European transport network comprising transport infrastructure (road, rail and inland waterway networks, seaports, inland waterway ports and other interconnection points between modal networks), traffic management systems and the positioning and navigation systems (the necessary technical installations and information and telecommunications systems to ensure harmonious operation of the network and efficient traffic management)
8. Hydrography Hydrographic elements, including marine areas and all other water bodies and items related to them, including river basins and sub-basins, as well as an aggregate of dedicated buildings and equipment for regulation of the surface water regime. In the relevant case surface water bodies are watercourses (rivers, brooks, channels or parts thereof), water bodies (lakes, ponds, reservoirs or parts thereof). Sea waters - territorial sea, continental shelf, exclusive economic zone and inland marine waters of the Republic of Latvia
9. Protected sites Area designated or managed within a framework of international, European Union and Member States' legislation to achieve specific objectives for conservation of nature and cultural heritage
10. Elevation Digital elevation models for land, ice and ocean surface. Includes terrestrial elevation, bathymetry and shoreline.
11. Land cover Physical and biological cover of the earth's surface including physical and biological cover of artificial surfaces, agricultural areas, forests, (semi-)natural areas, wetlands, water bodies
12. Orthoimagery Geo-referenced image data of the Earth's surface, from eight satellite or airborne sensors
13. Geology Geology characterised according to composition and structure, including information regarding bedrock, aquifers and geomorphology
14. Statistical units Units for dissemination or use of statistical information
15. Buildings Geographical location of buildings
16. Soil Soils and subsoil characterised according to depth, texture, structure and content of particles and organic material, stoniness, erosion, where appropriate mean slope and anticipated water storage capacity
17. Land use Territory characterised according to its current and future planned functional dimension or socio-economic purpose (e.g. residential, industrial, commercial, agricultural, forestry, recreational)
18. Human health and safety Geographical distribution of dominance of pathologies (e.g. allergies, cancers, respiratory diseases), information indicating the effect on health (biomarkers, decline of fertility, epidemics) or well-being of humans (fatigue, stress) linked directly (air pollution, chemicals, depletion of the ozone layer, noise) or indirectly (food, genetically modified organisms) to the quality of the environment
19. Utility and governmental services Utility facilities such as sewage, waste management, energy supply and water supply, administrative and social governmental services such as public administrations, civil protection sites, schools and hospitals
20. Environmental monitoring facilities Location and operation of environmental monitoring facilities includes observation and measurement of emissions, of the state of environmental media and of other ecosystem parameters (e.g. biodiversity, ecological conditions of vegetation) by or on behalf of public authorities
21. Production and industrial facilities Industrial production sites, including production and industrial facilities in energy industries, production and processing of metals, mineral industry, chemical industry, waste management, water abstraction facilities, mining and storage sites
22. Agricultural and aquaculture facilities Farming equipment and production facilities (including irrigation systems, greenhouses and stables)
23. Population distribution - demography Geographical distribution of people, including population characteristics and activity levels, aggregated by grid, region, administrative unit or other analytical unit
24. Area management, restriction, regulation zones and reporting units Areas managed, regulated or used for reporting at international, European, national, regional and local levels. Includes dumping sites, restricted areas around drinking water sources, nitrate-vulnerable zones, regulated fairways at sea or large inland waters, areas for the dumping of waste, noise restriction zones, prospecting and mining permit areas, river basin districts, relevant reporting units and coastal zone management areas
25. Natural risk zones Vulnerable areas characterised according to natural hazards (all atmospheric, hydrologic, seismic, volcanic and wildfire phenomena that, because of their location, severity, and frequency, have the potential to seriously affect society), e.g. floods, landslides and subsidence, avalanches, forest fires, earthquakes, volcanic eruptions
26. Atmospheric conditions Physical conditions in the atmosphere. Includes spatial data based on measurements, on models or on a combination thereof, as well as includes measurement locations
27. Meteorological geographical features Weather conditions and their measurements; precipitation, temperature, evapotranspiration, wind speed and direction
28. Sea regions Physical conditions of seas and saline water bodies divided into regions and sub-regions with common characteristics
29. Bio-geographical regions Areas with relatively homogenous ecological conditions with common characteristics
30. Habitats and biotopes Geographical areas characterised by specific ecological conditions, processes, structure, and (life support) functions that physically support the organisms that live there. Includes terrestrial and aquatic areas distinguished by geographical, abiotic and biotic features, whether entirely natural or semi-natural
31. Species distribution Geographical distribution of occurrence of animal and plant species aggregated by grid, region, administrative unit or other analytical unit
32. Energy resources Energy resources including hydrocarbons, hydropower, bio-energy, solar energy, wind energy, where relevant including depth/height information on the extent of the resource
33. Mineral resources Mineral resources including metal ores, industrial minerals, where relevant including depth/height information on the extent of the relevant resource
