Regulations Regarding the Amount of the Service of a Psychologist to a Person up to 18 Years of Age for whom Disability has been Determined for the First Time and who Lives in a Family, as well as to his or her Legal Representative, and the Procedures for Receipt of the ServiceIssued pursuant to 1. This Regulation prescribes the amount of the service of a psychologist paid from the State budget (hereinafter - service of a psychologist) to a person up to 18 years of age for whom disability has been determined for the first time and who lives in a family, as well as to his or her legal representative, and the procedures for receipt of the service. 2. A person, as well as his or her legal representative shall request the service of a psychologist in the local government in which the person or his or her legal representative has declared his or her place of residence. 3. The service of a psychologist shall be two consultations lasting 45 minutes. The price for one consultation of a psychologist shall be nine lats, including administration expenditure. 4. The service of a psychologist shall be ensured by the social service office of the local government, utilising not more than 10 per cent from the funds from the State budget allocated for the provision of the service of a psychologist for administration expenditure. 5. The service of a psychologist may be provided by a person who has a corresponding education and experience of at least two years in consulting families with children. 6. The service of a psychologist may be requested and received within a year after disability has been determined to a person for the first time. 7. In order to receive the service of a psychologist, the legal representative of the person or the person, if he or she has reached the age of 18 years (hereinafter - service requester): 7.1. shall submit a written submission regarding granting of the service of a psychologist to the social service office of the local government. The following information shall be indicated in the submission: 7.1.1. the given name, surname, personal identity number of the person, address of the declared place of residence and address of the actual place of residence, if different from the address of the declared place of residence; 7.1.2. the given name, surname, personal identity number of the legal representative of the person, address of the declared place of residence and address of the actual place of residence, if different from the address of the declared place of residence; 7.1.3. the recipient of the service (or recipients of the service); 7.1.4. the preferable provider of the service of a psychologist (if any); 7.1.5. the preferable type of communication (telephone number, e-mail address, postal address shall be indicated accordingly); 7.2. the submission may also be submitted in electronic form (in accordance with the laws and regulations regarding drawing up of electronic documents) or sent by post. 8. The social service office of the local government: 8.1. shall accept the submission referred to in Sub-paragraph 7.1 of this Regulation, examine and assess the conformity of the service requested with the conditions for the receipt of the service of a psychologist referred to in Paragraph 1 of this Regulation and register the service requested for the receipt of the service of a psychologist referred to in Paragraph 3 of this Regulation; 8.2. within five working days: 8.2.1. shall take a decision to grant the service of a psychologist or to refuse to grant the service of a psychologist, if the person does not conform to the conditions for the receipt of the service of a psychologist referred to in Paragraph 1 of this Regulation; 8.2.2. shall enter into a contract with the provider of the service of a psychologist selected by the service requester or the provider of the service of a psychologist selected in accordance with the procedures stipulated by the local government, if the service requester has not indicated the preferable provider of the service of a psychologist in accordance with Sub-paragraph 7.1.4 of this Regulation and a contract regarding the provision of the service of a psychologist has not been entered into at the local government; 8.2.3. shall issue a decision to grant the service and a referral to the service requester for the receipt of the service of a psychologist stipulated in Paragraph 3 of this Regulation or a decision to refuse to grant the service of a psychologist, if the person does not conform to the conditions for the receipt of the service of a psychologist referred to in Paragraph 1 of this Regulation. 9. The service requester may contest a decision of the social service office of the local government within a month from the day of entering into effect of the decision by submitting a relevant submission to the local government council. A decision of the local government council may be appealed to the administrative court within a month from the day of entering into effect of the decision of the responsible official of the local government council. 10. The service to be provided, its amount, the contractual amount, the procedures for the provision of the service, the payment procedures, the procedures by which a report on the provides service shall be provide, as well as the time period of providing the service shall be indicated in the contract referred to in Sub-paragraph 8.2.2 of this Regulation. 11. The social service office of the local government shall control the carrying out of the liabilities of the contract referred to in Sub-paragraph 8.2.2 of this Regulation and the conformity of the amount of the provided service of a psychologist with the contract entered into. 12. The social service office of the local government shall submit a report (Annex) to the Ministry of Welfare on the provision of services of a psychologist in the previous month by the tenth date. 13. The Ministry of Welfare: 13.1. shall make payment to the social service office of the local government for the provided service of a psychologist within 10 working days after receipt of the report referred to in Paragraph 12 of this Regulation (if the report has been submitted in accordance with this Regulation); 13.2. is entitled to perform random control of the utilisation of the funds allocated from the State budget, requesting the documents related to the provision of the service of a psychologist and the utilisation of the funds from the State budget from the social service office of the local government. 14. If the Ministry of Welfare determines that the service of a psychologist has been provided or the settlement of accounts has been performed not in conformity with this Regulation, it shall deduct the funds unduly paid from the funds from the State budget provided for the social service office of the local government in the next month for the provision of the service of a psychologist referred to in Paragraph 3 of this Regulation. 15. If due to objective reasons it is not possible to deduct the pay-out referred to in Paragraph 14 of this Regulation, the social service office of the local government shall repay the funds received unduly, transferring them into the revenue of the State basic budget. 16. The amount and price of the service of a psychologist shall be reviewed by the Cabinet upon proposal of the Minister for Welfare. 17. This Regulation shall apply from 1 January 2011.
