Regulations Regarding Permits for Increasing Electricity Production Capacities or the Introduction of New Production Equipment

Issued pursuant to
Section 22, Paragraph one of the
Electricity Market Law

1. These Regulations prescribe the requirements to be met in order to receive a permit for increasing electricity production capacities or the introduction of new production equipment (hereinafter - permit), as well as the procedures for the issuance, cancellation and extension of the period of validity of the permit.

2. An applicant shall complete an application for the receipt of a permit for increasing electricity production capacities or the introduction of new production equipment (hereinafter - application) (Annex 1) and submit it to the ministry responsible for the energy sector (hereinafter - ministry). The following shall be appended to the application:

2.1. a site plan of the planned electricity station on the immovable property in the scale of 1:500. If, in accordance with the Protection Zone Law, a protection zone has been specified for an electricity production equipment, the height of the electricity production equipment and the site of the protection zone to full extent shall be indicated in the plan;

2.2. a technical description of the electricity production equipment to be installed in accordance with Annex 2 to these Regulations;

2.3. a copy of the document confirming the possession right regarding the immovable property, on which the introduction of the new electricity production equipment or increasing the existing electricity production capacities is planned, if the respective immovable property is not owned by the applicant or if his or her possession right have not been recorded in the Land Register. If it is planned to introduce new electricity production equipment or to increase the electricity production capacities in the territorial waters of the Republic of Latvia or in the exclusive economic zone of the Republic of Latvia, the name, number and date of such legal act shall be indicated in the application, by which the producer of electricity has been granted the right to use the territorial waters of the Republic of Latvia or the exclusive economic zone of the Republic of Latvia for the respective purpose, in accordance with Section 11 of the Law On the Continental Shelf and Exclusive Economic Zone of the Republic of Latvia.

3. The ministry shall examine the submitted documents, verify the veracity of the information indicated therein and, within 30 days, take a decision regarding the issuance of a permit.

4. If the information indicated in the submitted documents is insufficient, incorrect or inaccurate, the ministry shall inform the applicant regarding the detected deficiencies and shall determine a time period for elimination of the deficiencies.

5. If the applicant does not provide all the necessary information or documents within the time period specified by the ministry, the ministry shall take a decision regarding the refusal to issue a permit.

6. The applicant shall, within 24 months after the date of the coming into effect of the decision referred to in Paragraph 3 of these Regulations, commence the building of the electricity production equipment indicated in the decision or the increase of the electricity production capacities and inform the ministry thereof in writing, submitting a certification (Annex 3). The ministry shall verify the veracity of the information indicated in the submitted documents, as well as is also entitled to verify whether building of the respective electricity production equipment or the increase in capacities has been commenced.

7. If an applicant does not fulfil the duty referred to in Paragraph 6 of these Regulations or the ministry establishes during verification that building of the electricity production equipment or increase in capacities has not been commenced, the ministry shall, within 30 days after the term referred to in Paragraph 6 of these Regulations, take a decision regarding the revocation of the decision referred to in Paragraph 3 of these Regulations and send it to the electricity producer, the regulator, the public trader and electricity system operator.

8. The recipient of the permit shall, within 30 days after implementation of the activities permitted in the decision, inform the ministry thereof, submitting a certification regarding the connection of the electricity production equipment to the electricity grid (Annex 4) and a copy of the deed regarding the connection of the electricity production equipment to the electricity grid.

9. The period of validity of a permit shall be:

9.1. three years, if the ministry has issued a permit to introduce new electricity production equipment, the capacity of which is one megawatt or less, or if the existing electricity production capacities are increased by one megawatt or less; or

9.2. five years, if the ministry has issued a permit to introduce new electricity production equipment, the capacity of which exceeds one megawatt, or if the existing electricity production capacities are increased by more than one megawatt.

10. An applicant is entitled to request an extension of the validity period of a permit three months prior to the expiry date of the permit, if he or she provides information regarding the process of implementation of a project of increasing electricity production capacities or the introduction of new production equipment and a justification why it is not possible to implement the project within the term specified in the permit. The ministry is entitled to extend the validity period of the permit by not more than two years.

11. The ministry shall send the permits, in which the introduction of new electricity production equipment or increasing electricity production capacities by more than one megawatt is allowed, without delay to the regulator and the operator of the electricity transmission system.

12. The ministry shall aggregate the permits, in which the introduction of new electricity production equipment or increasing electricity production capacities by one megawatt or less is allowed, and shall once a year (by 31 March) send the aggregated information to the regulator and the operator of the electricity transmission system.

13. The ministry shall register and record all the issued decisions referred to in Paragraph 3 of these Regulations. The ministry shall publish a list of the referred to decisions on the Internet homepage thereof and update it on the first working day of each month, indicating the date of issuance thereof, the merchant company, the registration number, the legal address, the type of power plant and the capacities installed.

14. Cabinet Regulation No. 695 of 29 August 2006, Regulations Regarding Permits for Increasing Electricity Production Capacities or the Introduction of New Production Equipment (Latvijas Vēstnesis, 2006, No. 140), is repealed.

15. Applications for the receipt of a permit to increase electricity production capacities or to introduce new production equipment, which have been submitted by the date of the coming into force of these Regulations, shall be examined in accordance with the procedures specified in Cabinet Regulation No. 695 of 29 August 2006, Regulations Regarding Permits for Increasing Electricity Production Capacities or the Introduction of New Production Equipment.

On the basis of Paragraph 2 of Cabinet Regulation No. 883 of 11 August 2009, Regulations Regarding Permits for Increasing Electricity Production Capacities or the Introduction of New Production Equipment,
