Procedures for Using Civil Aircraft for Military Needs

Issued pursuant to
Section 115, Paragraph two of the Law On Aviation

1. This Regulation prescribes the procedures by which civil aircraft shall be used for military needs.

2. The Latvian National Armed Forces shall use the civil aircraft for military needs if the capabilities of the military aircraft of the Republic of Latvia are insufficient or they are not intended for the performance of the following tasks:

2.1. carriage of personnel and cargoes;

2.2. training and instruction of personnel, maintaining and raising qualification thereof;

2.3. support while performing other tasks (except for performance of combat operations).

3. Civil aircraft used by the Latvian National Armed Forces for military needs shall be comparable to military aircraft. They obtain and lose the status of the State aircraft from the moment specified in the aircraft rental agreement (hereinafter - the agreement) referred to in Paragraph 5 of this Regulation.

4. The Latvian National Armed Forces shall use civil aircraft for military needs:

4.1. without civil aircraft crew - if the military aviation personnel of the Republic of Latvia is qualified to operate the relevant type of civil aircraft;

4.2. with civil aircraft crew which is qualified to perform the operations referred to in Paragraph 2 of this Regulation.

5. The Latvian National Armed Forces shall use civil aircraft for military needs on the basis of the agreement. The agreement shall be concluded directly with the civil aircraft owner or through representative of the owner (including operator who has a certificate of aircraft airworthiness).

6. If the Latvian National Armed Forces shall use civil aircraft for military needs with civil aircraft crew, the provisions of the agreement which are related to the liability for aircraft flight safety shall be co-ordinated with the State agency Civil Aviation Agency.

7. Civil aircraft used by Latvian National Armed Forces with civil aircraft crew shall be operated in accordance with the laws and regulations governing the civil aviation.

8. Civil aircraft used by Latvian National Armed Forces without civil aircraft crew shall be operated in accordance with the requirements of the military aviation of the Republic of Latvia.

9. This Regulation shall come into force on 1 March 2008.
