The Saeima 1 has adopted
and the President has proclaimed the following Law:

Legal Deposit Law

Section 1.

The following terms are used in this Law:

1) electronic publication - an audio record, video record or computer record which is produced in multiple copies in cassettes, floppy disks, discs, compact discs and in a similar way and is intended for public use;

2) online publication of restricted access - an online publication for the access to which a user's authorisation is required;

3) printed publication - any publication that contains textual or visual information, which has been produced on paper or other material and is intended for public use;

4) publisher - a person who performs publishing, publishes printed publications, electronic publications, online publications, as well as unconventional or "grey literature";

5) publishing - preparation and communication to the public of printed publications;

6) unconventional or "grey literature" - literature which contains publicly accessible information and is not distributed in a commercial network (analytical reviews, reports of technical or scientific researches, deposited scientific work, a conference or congress programme, materials and the like);

7) legal deposit copy - a copy of a printed publication, electronic publication or unconventional or "grey literature", intended for public use, which shall be received by the National Library of Latvia in accordance with the procedure specified in this Law, or an online publication, which it harvests and archives ;

8) online publishing - providing of accessibility of textual, visual or audiovisual work on the Internet;

9) online publication - any work created in Latvia and accessible on the Internet, which contains publicly accessible textual, visual or audiovisual information; and

10) printer - a person producing the reproduction of printed publications, audio records, video records or computer records upon the order of a publisher.

Section 2.

(1) The purpose of the Law is to ensure the permanent preservation, processing and public use of the national cultural heritage - all the printed publications, unconventional or "grey literature", electronic publications and online publications of Latvia.

(2) The Law prescribes the procedures by which the legal deposit copies intended for public use shall be supplied to the National Library of Latvia, the procedure by which the legal deposit copies shall be distributed among the libraries referred to in Section 7 of this Law, as well as the procedures by which the National Library of Latvia shall harvest and archive online publications and perform the control of the delivery of the legal deposit copies.

Section 3.

(1) A supplier of legal deposit copies is a publisher, who has published a printed publication, electronic publication or unconventional or "grey literature". A supplier of legal deposit may also be a printer of a publication, if the publisher has agreed in writing with the printer regarding the supply of legal deposit copies to the National Library of Latvia.

(2) A supplier of legal deposit copies of electronic publications, in delivering a copy, shall present concurrently the system requirements and access conditions for the identification of the publication content.

Section 4.

(1) All legal deposit copies, except for online publications, shall be provided for the National Library of Latvia, which shall transfer the part of legal deposit copies received to other libraries in accordance with the procedures specified in Section 7 of this Law.

(2) Libraries shall receive legal deposit copies free of charge,

(3) The National Library of Latvia has the right and duty to save one copy of an online publication created in Latvia.

Section 5.

(1) The requirement of this Law regarding provision of legal deposit copies shall apply to each printed publication, electronic publication, published in the Republic of Latvia or printed outside the Republic of Latvia upon the order of the author or of the publisher registered in the Republic of Latvia, and to unconventional or "grey literature".

(2) The following copies shall be supplied to the National Library of Latvia:

1) 5 copies of each printed publication type (except for books, brochures and publications for blind people);

2) 7 copies from each publication of a book and brochure;

3) 1 copy of each publication for blind people;

4) 3 copies of each electronic publication, except for cases referred to in Paragraph three of this Section; and

5) 2 copies of each unconventional or "grey literature".

(3) If an electronic publication is a component of an annex to a printed publication or a training set, it shall be provided together with the printed publication in accordance with the number of copies of the relevant printed publication.

(4) The types of printed publications, electronic publications, as well as unconventional or "grey literature", the legal deposit copies of which are to be supplied to the National Library of Latvia, are specified in the Annex to this Law.

(5) Online publications of free access on the Internet shall be harvested and archived automatically by the National Library of Latvia.

(6) Publishers of online publications of restricted access shall ensure access to an online publication for the National Library of Latvia in order to obtain a copy of the online publication.

Section 6.

(1) Legal deposit copies of periodicals shall be supplied to the National Library of Latvia before the commencement of realisation thereof; legal deposit copies of other printed publications, as well as electronic publications, shall be supplied to the National Library of Latvia within 14 days after the publishing thereof, legal deposit copies of unconventional or "grey literature", shall be supplied to within 30 days after the announcement thereof.

(2) If any of the libraries referred to in Section 7 of these Law has received a legal deposit copy of poor quality (the information included therein is not perceptible in full value due to mechanical damage, typographical errors, damaged electronic data carrier or due to other reasons), a library within 10 days from the time of receipt shall notify thereof the National Library of Latvia. Upon the request of the National Library of Latvia a copy of poor quality shall be replaced within two weeks after the receipt of the request.

(3) Legal deposit copies shall be delivered to the National Library of Latvia together with the bill of lading-invoice.

(4) A publisher shall submit a report regarding the publications published during the previous 6 months to the National Library of Latvia once every 6 months.

(5) The National Library of Latvia shall compile the data regarding the value of the legal deposit copies provided at the end of the current year and submit them to the Ministry of Culture.

Section 7.

The National Library of Latvia shall distribute legal deposit copies received from the supplier in the following way:

1) to the National Library of Latvia:

a) 2 copies of each type of a printed publication,

b) 1 copy of each electronic publication,

c) 1 copy of each online publication,

d) 1 copy of each unconventional or "grey literature";

2) to the Latvian Academic Library:

a) 2 copies of each type of a printed publication,

b) 1 copy of each electronic publication,

c) 1 copy of each unconventional or "grey literature";

3) to the University Library of Latvia - 1 of each type of a printed publication and each electronic publication in the social sciences, humanitarian sciences, mathematics and natural sciences, information technologies and medical science;

4) to the Riga Technical University Scientific Library - 1 copy of each type of a printed publication and each electronic publication in the technical sciences and architecture;

5) to the Fundamental Library of the Latvian University of Agriculture - one copy of each printed publication and each electronic publication on the issues of agriculture, rural rights, rural development and sociology, water management, environmental management, veterinary medicine, forestry, woodworking, food technology, housekeeping and fishery;

6) to the Patent Technology Library of Latvia - one copy of each publication of a patent, normative-technical printed publication and electronic publication;

7) to the Medical Library of Latvia - one copy of each printed publication and each electronic publication on the issues of health and environmental protection, medical sciences and social care;

8) to the Latvian Library for the Blind - 1 copy of each publication for blind people;

9) to the Latgale Central Library - 1 copy of each book and brochure; and

10) to the Central Library of Liepāja - 1 copy of each book and brochure.

Section 8.

Materials of collections of online publications, for the use of which an authorisation is required, shall be accessible for research or study at the premises of the National Library of Latvia.

Section 9.

The National Library of Latvia shall control the procedures for the provision of legal deposit copies.

Section 10.

Persons at fault regarding the violation of this Law shall be held liable in accordance with the procedures specified in the Latvian Administrative Violations Code. The director of the National Library of Latvia or his or her authorised person shall draw up a report regarding the non-provision of legal deposit copies, as well as regarding the violations of the procedures for the provision of legal deposit copies.

Transitional Provision

With the coming into force of this Law, the Law On Provision of Free Legal deposit of Printed and Other Publications (Latvijas Republikas Saeimas un Ministru Kabineta Ziņotājs, 1997, No. 23) is repealed.

This Law has been adopted by the Saeima on 18 May 2006.

Annex to the Legal Deposit Law

Types of Printed Publications, Electronic Publications, as well as Unconventional or "Grey Literature", Legal Deposit Copies of which are to Be Delivered to the National Library of Latvia

I. Printed Publications

1. Textual publications:

1.1. non-periodicals;

1.1.1. books and brochures (mono publications, one-volume publications and multi-volume publications, collections, summaries of promotion works, preprints, atlases, prospectuses, exhibition catalogues etc.);

1.1.2. leaf publications; and

1.1.3. posters;

1.2. continued publications and annexes thereto:

1.2.1. serial publications; and

1.2.2. periodicals (newspapers; magazines; bulletins; collections, annual reports; calendars); and

1.3. textual publications with annexes of electronic publications.

2. Printed music.

3. Cartographic publications:

3.1. cartographic atlases;

3.2. maps (also schematic maps);

3.3. cartographic booklets and guides; and

3.4. sets of cartographic publications.

4. Graphic productions:

4.1. albums;

4.2. posters;

4.3. postcards;

4.4. reproductions of works of art;

4.5. training visual aids;

4.6. picture books; and

4.7. art calendars and tabular calendars.

5. Patent documents.

6. Normative-technical documents:

6.1. the national standards of the Republic of Latvia;

6.2. foreign/ international standards recognised as national standards (adapted) in the territory of the Republic of Latvia and certain business standards;

6.3. business standards;

6.4. construction standards;

6.5. building norms and regulations;

6.6. technical regulations; and

6.7. technical descriptions (prescriptions) and other documentation, in which the requirements for safety and quality of goods released for circulation or services provided are specified.

7. Publications for blind people (Braille, relief type printing).

II. Electronic Publications

8. Sound recordings:

8.1. gramophone records;

8.2. audiocassettes;

8.3. audio compact discs and minidisks; and

8.4. sound recordings with textual annexes.

9. Video recordings:

9.1. videocassettes;

9.2. videodiscs;

9.3. CD-I; and

9.4. video recordings with annexes of textual publications.

10. Computer records (on floppy disks, discs and computer records duplicated on compact discs of full assemblage).

III. Unconventional or "Grey Literature"

11. Analytical overviews approved by the State administrative institutions regarding the work or certain areas of operations for a year and a longer period of time, as well as conceptions and programmes, which are not published.

12. Promotion works, deposited scientific works.

13. Reports on fundamental and applied research and pilot studies.

14. Programmes, synopsis, texts of reports of the conferences or congresses organised by the State administrative institutions, associations and establishments, political and religious organisations, higher educational establishments, colleges and scientific institutions and merchants.

15. Articles of association, programmes and analytical overviews of operation of associations and establishments, political and religious organisations.

16. Bibliographies (unpublished).
