Regulations On the Provision of the Information included within the National DNA Database

Issued Pursuant to Section 16, Paragraph three
of the Law On Development and Use
of the National DNA Database

1. This Regulation prescribes the information to be included in a request and its substantiation necessary in order to receive information from the National DNA Database, as well as the procedure for examination of the request and provision of information.

2. Authorities, which in accordance with the Law On Development and Use of the National DNA Database have the right to receive information from the National DNA Database (hereinafter - requester), shall submit a completed request form (Annex) to the Forensic Service Department of the State Police (hereinafter - Forensic Service Department).

3. A request and its substantiation shall include the following:

3.1. given name, surname and personal identity number (if there is none - the date of birth) of the person for whom it is necessary to acquire information;

3.2. number of the criminal case;

3.3. circumstances of the criminal offence or incident;

3.4. presentation of the matter;

3.5. position, given name, surname and signature of the responsible person;

3.6. harmonisation of the request with the prosecutor - the office of the prosecutor, position, given name, surname and signature.

4. Requests shall be registered and stored by the Forensic Service Department for a period of five years from the day of the registration thereof.

5. The Forensic Service Department shall issue a written reply to a request within a period of 15 days following the day the request was received.

6. The compliance of the request to the Law On Development and Use of the National DNA Database and the requirements of this Regulation shall be examined by the Head of the Forensic Service Department or his or her deputy.

7. A copy of the issued reply shall be stored by the Forensic Service Department for a period of five years from the day of the issue thereof.
