prezidents izsludina šādu likumu:
Par Līgumu par izmēģinājumu vietu Kioto mehānismu izmantošanai Baltijas jūras reģiona enerģētikas projektos

1.pants. Līgums par izmēģinājumu vietu Kioto mehānismu izmantošanai Baltijas jūras reģiona enerģētikas projektos (turpmāk — Līgums) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Ekonomikas ministrija koordinē Līgumā paredzēto saistību izpildi.

3.pants. Līgums stājas spēkā tā 14.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

4.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Līgums angļu valodā un tā tulkojums latviešu valodā.

AGREEMENT
ON A TESTING GROUND FOR APPLICATION OF THE KYOTO MECHANISM ON ENERGY PROJECTS IN THE BALTIC SEA REGION

Whereas the Governments of the countries in the Baltic Sea Region, hereunder Denmark, Estonia, Finland, Germany, Iceland, Latvia, Lithuania, Norway, Poland, Russia and Sweden, hereinafter named as the Parties, have ratified the United Nations Framework Convention on Climate Change (UNFCCC) and have ratified or are in the process of ratifying the Kyoto Protocol, adopted by the Conference of the Parties to the UNFCCC at its third session;

Whereas the Ministers of Energy of the Baltic Sea Region decided, in Vilnius in November 2002, to establish the Testing Ground for international cooperation in the use of flexible mechanisms, as: envisaged by the" same "ministers at their Helsinki Conference in 1999, with the objectives to build capacity and competence to use the" Joint Implementation (JI) mechanism, to promote the realization of high quality projects in the energy sector generating emissions reductions, to develop methods and procedures in conformity with the rules and guidelines of the Kyoto Protocol, to collaborate in addressing administrative and financial barriers, and to minimize transaction costs, especially regarding small scale JI projects, to facilitate generation, ensure issuance and transfer of Emission Reduction Units (ERUs) and Assigned Amount Units (AAUs) related to or accruing from n projects, and to implement projects early and offer credit for emissions reductions prior to 2008 by appropriate means;

Whereas the Nordic Environment Ministers and Nordic Energy Ministers in 2000 agreed to work for establishment of a Testing Ground and an investment fund in relation to the Nordic Environment Finance Corporation (NEFCO), confirmed their support in 2001 and, for the same purpose, the Nordic Energy Ministers decided in June 2002 to establish a Testing Ground Facility;

Whereas Article 6 of the Kyoto Protocol allows an Annex I Party, with a commitment inscribed in Annex B to the Kyoto Protocol to transfer to or acquire from an other Annex I Party emission reduction units (ERUs) resulting from projects aimed at reducing anthropogenic emissions by sources or enhancing anthropogenic removals by sinks for the purpose of meeting its commitments under Article 3 of the Protocol;

Whereas Article 17 of the Kyoto Protocol allows an Annex I Party with a commitment inscribed in Annex B to the Kyoto Protocol to transfer or acqilire Assigned Amount Units (AAUs), for the purpose of fulfilling its commitments under Article 3;

Noting in particular Article 3.10 and 3.1 of the Kyoto Protocol on transfer and acquisition of ERUs or AAUs accruing from the use of Joint Implementation and - Emissions Trading;

Further noting that the Parties to the UNFCCC agreed on the principles, modalities, rules and guidelines for the Kyoto Mechanisms at the Seventh Conference of the Parties in Marrakech;

Further noting the importance of complying with the obligations under Article 5 and 7 of the Kyoto Protocol;

The Parties to this Agreement have agreed as follows:

Article I

Definitions

For the purposes of the present Agreement:

1. "Assigned Amount Unit" means a unit issued in a national registry pursuant to the Kyoto Protocol and is equal to one metric tonne of carbon dioxide equivalent;

2. "BASREC" means Baltic Sea Region Energy Cooperation;

3. "BASREC Regional Handbook on Procedures for Joint Implementation in the Baltic Sea Region" means the handbook developed for BASREC to provide guidance for implementation of JI projects under this Testing Ground Agreement;

4. "Emission Reduction Unit" means a unit issued in a national registry pursuant to the Kyoto Protocol and is equal to one metric tonne of carbon dioxide equivalent;

5. "Host Party" means the country in which the project is implemented and which transfers assigned amount units and/or emission reduction units;

6. "Independent Entity" means an entity accredited by the Kyoto Protocol Article 6 Supervisory Committee to determine and verify whether a JI project and the ensuing reductions in emissions meet the requirements of Article 6 of the Kyoto Protocol. Until such Independent Entities have been accredited, entities accredited as operational entities under Article 12 of the Kyoto Protocol may, for the purpose of this agreement, fill the functions of an Independent Entity;

7. "Investor Party/Parties" means the country/countries investing in the project and acquiring assigned amount units and/or emission reduction units;

8. "Joint Implementation project" (JI project) means a project implemented jointly by an Investor Party/Parties and a Host Party aimed at reducing emissions of greenhouse gases and that meets all requirements of Article 6 of the Kyoto Protocol;

9. "Kyoto Mechanisms" means the mechanisms established under Article 6 (Joint Implementation), Article 12 (Clean Development Mechanism) and Article 17 (Emissions Trading) of the Kyoto Protocol;

10. "Kyoto Protocol" means the Kyoto Protocol to the United Nations Framework Convention on Climate Change (UNFCCC). Whenever Kyoto Protocol is referred to in this Agreement, it also refers to all relevant decisions adopted under the UNFCCC and the Kyoto Protocol, in particular on principles, modalities, rules and guidelines for the Kyoto Mechanisms;

11. "Legal Entity" means any company or corporation, privately or state owned, or government institution or state authority;

12. "Verification" means a procedure where an Independent Entity or a Host Party verifies that reductions in emissions accruing from a JI project are additional to any that would otherwise occur accordance with the requirements of Article 6 of the Kyoto Protocol.

Article 2

Baltic Sea Region Testing Ground

The Parties agree to establish a Testing Ground for the Baltic Sea Region to gain experience from and facilitate the use of Joint Implementation (JI) under Article 6 and Emissions Trading (ET) under Article 17 of the Kyoto Protocol and to implement projects generating emission reductions prior to and during the commitment period commencing in 2008, in order to reduce anthropogenic emissions of greenhouse gases cost-effectively.

Article 3

Objectives of Testing Ground Cooperation

a) to build capacity and competence to use the Kyoto mechanisms and promote common understanding of concepts, rules and guidelines for use of the flexible mechanisms of the Kyoto Protocol, to promote realization of high quality projects in the energy sector generating emissions reductions;

b) to gain experience with the Joint Implementation (JI) mechanism under the Kyoto Protocol in the energy sector, especially with projects in the fields of energy saving, energy efficiency, fuel switching in combination with energy efficiency or saving, and renewable energy sources;

c) to develop methods and procedures in conformity with the rules and guidelines of the Kyoto Protocol with a view to ensuring the environmental integrity of projects;

d) to collaborate in addressing administrative and financial barriers and the level of transaction costs, especially regarding small-scale JI projects;

e) to facilitate generation, ensure issuance and transfer of ERUs and AAUs related to or accruing from JI projects and Emissions Trading and

f) to implement projects early and offer credit for emission reductions prior to 2008.

Article 4

Participation

Participation in the activities on the Testing Ground for the Baltic Sea Region is open to public and private legal entities in Baltic Sea Region States that are Parties to this Agreement.

Article 5

Project Implementation

1. The Parties encourage business, industries, energy utilities, financial institutions, regional and local authorities to take an active role in identification and implementation of Joint Implementation projects within the framework of the Testing Ground. Such projects are to be carried out in the Baltic Sea Region.

2. In order to foster and contribute to the implementation of JI projects and to fulfill the Objectives of this Agreement, a Testing Ground Facility (TGF) is being established. The Testing Ground Facility will serve as a multilateral financing instrument for JI projects under this Agreement.

Article 6

Criteria, Approval and Registration of Projects

1. All Projects implemented under this Agreement shall be carried out in the Baltic Sea Region and shall be approved by the Investor Party and Host Party in accordance with the Kyoto Protocol and the relevant rules, decisions and guidelines thereunder. A written approval shall be issued either by the Testing Ground Facility and the Host Party or by the Investor Party/Parties and the Host Party. Before a written approval is issued, project owners shall demonstrate how the proposed project will contribute to the objectives of the Testing Ground.

2. The co-operation within the Testing Ground shall focus on energy-related climate change mitigation projects especially in the fields of energy saving, energy efficiency, fuel switching in combination with energy efficiency or saving and renewable energy sources.

3. The Testing Ground shall also be open to the projects implemented by legal entities in Parties without financing through the TGF, under the precondition that they are compatible with this Agreement and contribute to the objectives of this Agreement by participating in capacity building and exchange of information. After the written approval has been issued, Participating projects shall be registered with the Testing Ground Committee to be established under Article 11 of this Agreement.

4. It is recommended that all the projects to be implemented under this Agreement to the extent appropriate follow the guidance given in the BASREC Regional Handbook on Procedures for Joint Implementation in the Baltic Sea Region developed for the Testing Ground of the Baltic Sea Region.

Article 7

Project Validation and Verification

1. Emission reductions generated by the projects shall be subject to verification in accordance with the Kyoto Protocol and the relevant rules, decisions and guidelines hereunder. The verification process entails the validation of the amount of the emission reductions generated by the project during a specified time period. Verification shall be carried out pursuant to the verification procedures established under the Kyoto Protocol either by an independent entity under the Supervisory Committee or by the Host Party. Emission reductions generated by the projects prior to the first commitment period under the Kyoto Protocol shall be verified by an independent entity. Verification by a Host Party may be conducted during the first commitment period of the Kyoto Protocol and thereafter provided that the host party meets the eligibility requirements under the Kyoto Protocol and the relevant rules, decisions and guidelines hereunder.

2. Whenever the Host Party is titled to verify the emission reductions, the Investor Party/Parties may still require that emission reductions are verified by an independent entity.

The Parties to this Agreement shall undertake the necessary steps for issuance of ERUs and AAUs corresponding to the verified amount of emissions reductions.

Article 8

Transfer af Credits

1. The Parties shall ensure the timely transfer of ERUs and AAUs accruing from the projects from the Host Party to the Investor Party/Parties in accordance with the Kyoto Protocol and the relevant rules, decisions and guidelines thereunder.

2. The transfer of the verified ERUs and AAUs shall be based on the written approval issued by the Host Party under Article 6 of this Agreement.

3. The Host Party shall transfer the verified amount of credits accruing from the projects to the Investor Party/Parties as ERUs under Article 6 of the Kyoto Protocol or AAUs under Article 17 of the Kyoto Protocol. Credits from emission reductions can also be facilitated through forward sales of AAUs or ERUs as agreed/indicated by the project participants.

Article 9

Capacity Building

The Parties agree to work together to build capacity and competence regarding the Kyoto Mechanisms in the public and private sectors to facilitate co-operation in this field, i.e. through arranging workshops, seminars and conferences. The BASREC Regional Handbook on Procedures for Joint Implementation in the Baltic Sea Region has been developed as a contribution to common understanding of JI concepts, the JI project cycle and to capacity building.

Article 10

Sharing Experience

The Parties are encouraged to share information and experience of JI activities. Such information should include information relating to the JI project cycle, credit issuance and transfer of credits. Exchange of views and experiences on institutional matters, methodology, administrative and financial barriers as well as transaction costs for JI projects should take place on an annual basis.

Article 11

A Testing Ground Committee

The development of testing ground activities will be surveyed by a Testing Ground Committee to be comprised by representatives of Parties with no more than two representatives appointed by each Party. The Committee will register participating projects and under the guidance of the Group of Senior Energy Officials of the Baltic Sea Region Energy Cooperation appropriately contribute to capacity building, sharing of relevant experience and dissemination of information. The Committee reports on progress, development and relevant experience and suggests proposals concerning further development of the testing ground cooperation to the Group of Senior Energy Officials of the Baltic Sea Region Energy Cooperation.

Article 12

Dispute Settlement

Any dispute regarding the interpretation or application of this Agreement will be resolved by consultations between the Parties. At the request of the parties to the dispute, the Testing Ground Committee shall provide assistance in the settlement of disputes.

Article 13

Consent to be bound by this Agreement

1. Consent to be bound by this Agreement shall be expressed by (a) signature with the Depositary; or

(b) signature subject to ratification, acceptance or approval followed by the deposit of an instrument of ratification, acceptance or approval with the Depositary; or

(c) the deposit of an instrument of accession with the Depositary.

2. This Agreement shall be open for signature under paragraphs 1 (a) or 1 (b) by the Governments of the Kingdom of Denmark, the Republic of Estonia, the Republic of Finland, the Federal Republic of Germany, the Republic of Iceland, the Republic of Latvia, the Republic of Lithuania, the Kingdom of Norway, the Republic of Poland, the Russian Federation and the Kingdom of Sweden until December 31st 2003.

3. After its entry into force, this Agreement shall be open for accession under paragraph 1.(c) by such Governments mentioned in paragraph 2 which have not signed the Agreement, and by such parties to the Kyoto Protocol which are accepted by the Parties to this Agreement at the time of accession.

4. Participation in the Testing Ground does not affect rights of participants to enter into other agreements on the Kyoto mechanisms, nor does it affect the obligations of Participants under the Kyoto protocol.

Article 14

Entry into force

This Agreement shall enter into force on the first day of the second month following the date on which six (6) Governments mentioned in paragraph 2 of Article 13 have expressed their consent to be bound by the Agreement. For any other Government, this Agreement shall enter into force on the first day of the second month following the date on which that Government expresses Its consent to be bound by the Agreement.

Article 15

Amendments

Any amendments or modifications to this Agreement, and any additional protocol to it, shall be agreed by the consensus of the Parties. The amendments, modifications or additional protocols will enter into force on the 90th day after the date on which all the Parties have notified the Depositary that they have fulfilled the formalities required by national legislation.

Article 16

Evaluation, withdrawal and determination

This Agreement shall be evaluated by the Parties by December 31, 2005. If the Kyoto Protocol has not entered into force by that date, the Agreement shall terminate without any further notice. In case the Kyoto Protocol has entered into force, the Agreement shall terminate as of December 31,2012.

A Party may withdraw from this Agreement by giving written notice of the withdrawal to the Depositary. The withdrawal shall be effective one hundred twenty (120) days after receipt of the notice of withdrawal by the Depositary.

Article 17

Depositary

The Government of Finland is hereby designated as the Depositary. The Depositary shall fulfill its duties in accordance with Article 77 of the Vienna Convention on the Law of Treaties adopted on 23 May 1969.

LĪGUMS PAR IZMĒĢINĀJUMU VIETU KIOTO MEHĀNISMU IZMANTOŠANAI BALTIJAS JŪRAS ENERĢĒTIKAS PROJEKTOS

Ievērojot to, ka Baltijas jūras reģiona valstu Dānijas, Igaunijas, Somijas, Vācijas, Islandes, Latvijas, Lietuvas, Norvēģijas, Polijas, Krievijas un Zviedrijas valdības, turpmāk dēvētas par Pusēm, ir ratificējušas Apvienoto Nāciju Vispārējās konvencijas par klimata pārmaiņām (Konvencijas) un ir ratificējušas vai gatavojas ratificēt Kioto protokolu, kurš pieņemts Konvencijas Pušu konferences 3.sesijā;

Ievērojot to, ka Baltijas jūras reģiona Enerģētikas ministri 2002. gada novembrī Viļņā nolēma starptautiski sadarboties, izveidojot izmēģinājumu vietu starptautiskai sadarbībai elastīgo mehānismu izmantošanā, kā paredzēja minētie ministri 1999.gada Helsinku konferencē, ar mērķi radīt administratīvas struktūras un iegūt pieredzi, lai izmantotu kopīgi īstenojamo (KĪ) projektu mehānismu, veicinātu augstas kvalitātes projektu realizāciju enerģētikas sektorā, radot izmešu samazināšanos, izstrādātu metodes un procedūras saskaņā ar Kioto protokola noteikumiem un norādījumiem, piedalītos administratīvo un finansiālo barjeru pārvarēšanā un samazinātu transakciju izdevumus, sevišķi attiecībā uz maza mēroga KĪ projektiem, veicinātu un nodrošinātu izmešu samazināšanas vienību (ISV) un noteiktā daudzuma vienību (NDV), kas attiecas uz vai ir radušās no KĪ projektiem, rašanos un nodošanu, un nekavējoties ieviestu projektus un piedāvātu kredītu izmešu samazināšanai ar attiecīgajiem līdzekļiem ātrāk par 2008. gadu;

Ievērojot to, ka Ziemeļvalstu Vides ministri un Ziemeļvalstu Enerģētikas ministri 2000. gadā piekrita darboties, lai nodibinātu izmēģinājumu vietu un investīciju fondu, kas ir saistīti ar Ziemeļvalstu Vides Finansu Korporāciju (ZVFKO), apliecinot savu atbalstu 2001. gadā, un, tā paša iemesla dēļ, Ziemeļvalstu Enerģētikas ministri 2002. gada jūnijā nolēma izveidot Izmēģinājumu vietas vienību (administratīvu struktūru);

Ievērojot to, ka Kioto protokola 6. pants atzīst I Pielikuma Puses saistības, kas noteiktas Kioto protokola B Pielikumā, nodot vai iegūt no I Pielikuma Puses izmešu samazināšanas vienības, kas radušās no projektiem, kuru mērķis ir samazināt antropogēnos izmešus no to avotiem vai palielināt to piesaistīšanu, lai izpildītu saistības, kādas noteiktas Protokola 3. pantā;

Ievērojot to, ka Kioto protokola 17. pants ļauj I Pielikuma Pusei, kas uzņēmusies saistības, kas noteiktas Kioto protokola B Pielikumā, nodot vai iegūt nodotā lieluma vienības (NDV), lai izpildītu saistības, kādas noteiktas Protokola 3. pantā;

Ievērojot sevišķi Kioto protokola 3.1. un 3.10. punktu par ISV un NDV nodošanu jeb iegūšanu, izmantojot projektu kopīgo īstenošanu un starptautisko emisiju tirdzniecību;

Vēl ievērojot, ka Puses piekrita Konvencijas principiem, modalitātēm, noteikumiem un norādījumiem Kioto mehānismiem Pušu 7. konferencē Marakešā;

Vēl ievērojot saistību atbilstības Kioto protokola 5. un 7. pantam nozīmīgumu;

Puses noslēdz līgumu par sekojošo:

1. pants

Definīcijas

Šī Līguma ietvaros:

1. "Noteiktā daudzuma vienība" ir vienība, kas saskaņā ar Kioto protokolu ir iekļauta valsts reģistrā un atbilst 1 metriskai tonnai CO2 ekvivalenta;

2. "BJRVSE" apzīmē Baltijas jūras reģiona valstu sadarbības programmu enerģētikā;

3. "BJRVSE reģionālā rokasgrāmata par kopīgi īstenojamajām procedūrām Baltijas jūras reģionā" nozīmē, ka rokasgrāmata ir izstrādāta BJRVSE, lai nodrošinātu KĪ projektu īstenošanas vadību, kas paredzēta šajā Izmēģinājumu Vietas Līgumā;

4. "Izmešu samazināšanas vienība" ir vienība, kas saskaņā ar Kioto protokolu ir iekļauta valsts reģistrā un 1 ISV atbilst 1metriskai tonnai CO2 ekvivalenta;

5. "Saņēmējvalsts" apzīmē valsti, kurā ievieš projektu un kas nodod noteiktā daudzuma vienības un/vai izmešu samazināšanas vienības;

6. "Neatkarīga organizācija" apzīmē organizāciju, kuru akreditējusi Uzraudzības komiteja saskaņā ar Kioto protokola 6. pantu, lai noteiktu un pārbaudītu, vai KĪ projekts un radušies izmeši atbilst Kioto protokola 6. panta prasībām. Kamēr šāda neatkarīga organizācija nav akreditēta, organizācija, kas akreditēta kā darbojoša organizācija saskaņā ar Kioto protokola 12.pantu, šī Līguma ietvaros var veikt neatkarīgas organizācijas funkcijas;

7. "Investorvalsts" apzīmē valsti/valstis, kuras veic ieguldījumus projektā un iegūst noteiktā daudzuma vienības un/vai izmešu samazināšanas vienības;

8. "Kopīgi īstenojamais projekts" (KĪ projekts) apzīmē Investorvalsts un Saņēmējvalsts kopīgi īstenojamo projektu, kuras mērķis ir samazināt siltumnīcas efektu izraisošo gāzu izmešus un visu to, kas atbilst Kioto protokola 6. pantam;

9. "Kioto mehānisms" apzīmē mehānismus, kas radīti saskaņā ar Kioto protokola 6. pantu (Kopīgi īstenojams), 12. pantu (Tīrās attīstības mehānisms) un 17. pantu (Starptautisko emisiju tirdzniecība);

10. "Kioto protokols" apzīmē Apvienoto Nāciju Vispārējās Konvencijas par Klimata Pārmaiņām (Konvencijas) Kioto protokolu. Kad Kioto protokolu attiecina uz šo Līgumu, tas ir attiecināms arī uz atbilstošajiem lēmumiem, kas pieņemti, vadoties pēc Konvencijas un Kioto protokola, balstoties pārsvarā uz principiem, modalitātēm, noteikumiem un norādījumiem Kioto mehānismiem;

11. "Juridiskā organizācija" apzīmē jebkuru uzņēmumu vai apvienību, privātu vai valsts, vai valdības institūciju vai valsts pārstāvi;

12. "Pārbaude" apzīmē procedūru, kurā neatkarīga organizācija vai Saņēmējvalsts apstiprina, ka no KĪP projekta radusies izmešu samazināšana saskaņā ar Kioto protokola 6.pantu ir papildus jebkurai citai, kas pretējā gadījumā notiktu.

2. pants

Baltijas jūras reģiona izmēģinājumu vieta

Puses piekrīt dibināt izmēģinājumu vietu Baltijas jūras reģionam, lai iegūtu pieredzi un veicinātu KĪ projektu izmantošanu saskaņā ar Kioto protokola 6.pantu un starptautisko izmešu tirdzniecību (ET) — 17. pantu un ieviestu projektus, kas ģenerē izmešu samazināšanos pirms saistību perioda un tā laikā, kas sākas 2008.gadā, lai samazinātu siltumnīcas efektu izraisošo gāzu antropogēnos izmešus par mazākām izmaksām.

3. pants

Izmēģinājumu vietas sadarbības mērķi

a) attīstīt spējas un zināšanas, lai izmantotu Kioto mehānismus un veicinātu savstarpējo saprašanos par pieņēmumiem, noteikumiem un norādījumiem Kioto protokola elastīgo mehānismu lietošanā, veicinātu augstas kvalitātes projektu realizāciju enerģētiskajā sektorā, radot emisiju samazināšanos;

b) iegūt pieredzi enerģētiskajā sektorā par Kioto protokola KĪ projektu mehānismu izmantošanu, jo sevišķi projektos, kas saistīti ar enerģijas taupīšanu, energoefektivitātes paaugstināšanu, izmantojamo energoresursu nomaiņu savienojumā ar enerģijas taupīšanu un efektivitātes paaugstināšanu, un atjaunojamiem energoresursiem;

c) izstrādāt metodes un procedūras saskaņā ar Kioto protokola noteikumiem un norādījumiem ar nolūku nodrošināt projektu vides integritāti ;

d) piedalīties administratīvo un finansiālo barjeru un transakciju izmaksu līmeņa pārvarēšanā, sevišķi, kas attiecas uz maza mēroga KĪ projektiem;

e) veicināt un nodrošināt ISV un NDV rašanos, izsniegšanu un nodošanu, kas attiecas uz vai ir radušās no KĪ projektiem un emisiju tirdzniecības un

f) nekavējoties ieviest projektus un piedāvāt kredītu izmešu samazināšanai ātrāk par 2008. gadu.

4. punkts

Dalība

Piedalīties aktivitātēs, kas saistītas ar Baltijas jūras reģiona izmēģinājumu vietu, var sabiedriskie un privātie uzņēmumi Baltijas jūras reģiona valstīs, kuras ir šī Līguma Puses.

5. pants

Projekta īstenošana

1. Puses iedrošina tirdzniecības uzņēmumus, rūpniecības nozares, enerģētikas uzņēmumus, finansu institūcijas, reģionālos un vietējos varas pārstāvjus aktīvi piedalīties KĪ projektu identificēšanā un īstenošanā Izmēģinājumu vietas ietvaros. Šādus projektus jārealizē Baltijas jūras reģionā.

2. Lai attīstītu un sekmētu KĪ projektu īstenošanu un sasniegtu šī Līguma mērķus, tiek radīta Izmēģinājumu vietas Vienība (IVV). Izmēģinājumu vietas Vienība darbosies kā daudzpusīgs finansēšanas instruments KĪ projektiem šajā Līgumā.

6. pants

Projektu kritēriji, pieņemšana un reģistrācija

1. Visus projektus, kas ieviesti, balstoties uz šo Līgumu, realizē Baltijas jūras reģionā un tos pieņem (apstiprina) Investorvalsts un Saņēmējvalsts saskaņā ar Kioto protokolu un atbilstošajiem noteikumiem, lēmumiem un norādījumiem. Rakstveida apstiprinājumu izdod vai nu IVV un Saņēmējvalsts, vai Investorvalsts un Saņēmējvalsts. Pirms rakstveida apstiprinājuma izdošanas, projekta īpašniekiem jāpierāda, kāds ir dotā projekta ieguldījums Izmēģinājumu vietas mērķu sasniegšanā.

2. Sadarbība Izmēģinājumu vietā tiek koncentrēta uz Klimata izmaiņu samazināšanas projektiem, jo sevišķi projektos, kas saistīti ar enerģijas taupību, energoefektivitātes paaugstināšanu, izmantoto energoresursu nomaiņu un atjaunojamiem energoresursiem.

3. Izmēģinājumu vieta ir pieejama arī tiem projektiem, kurus ievieš Pušu uzņēmumi bez IVV finansējuma ar priekšnoteikumu, ka tie ir atbilst šim Līgumam un palīdz sasniegt šī Līguma mērķus, piedaloties spēju attīstīšanā un informācijas apmaiņā. Pēc rakstveida apstiprinājuma izdošanas, tos projektus, kuri piedalās, reģistrē Izmēģinājumu vietas komiteja, kas minēta šī Līguma 11. pantā.

4. Visiem projektiem, kurus ievieš šī Līguma ietvaros, iespēju robežās ieteicams sekot norādījumiem, kas sniegti BJRVSE reģionālās Rokasgrāmatas procedūrās par KĪ projektiem Baltijas jūras reģionā.

7. pants

Projekta apstiprināšana un pārbaude

1. Izmešu samazināšana, ko izraisa projekti, ir pārbaudes priekšmets saskaņā ar Kioto protokolu un atbilstošajiem noteikumiem, lēmumiem un norādījumiem. Pārbaudes process ietver apstiprinājumu izmešu samazināšanas apjomam, ko izraisa projekts noteiktā laika periodā. Pārbaudi veic vai nu neatkarīga organizācija Uzraudzības komitejas pakļautībā vai Saņēmējvalsts saskaņā ar pārbaudes procedūrām, kas izstrādātas Kioto protokolā. Izmešu samazināšanu, ko izraisa projekti pirms pirmo saistību perioda pēc Kioto protokola, pārbauda neatkarīga organizācija. Saņēmējvalsts var veikt pirmo pārbaudi pirmo saistību perioda laikā saskaņā ar Kioto protokolu, nodrošinot, ka Saņēmējvalsts izpilda prasības, kas noteiktas Kioto protokolā, un ievēro atbilstošos noteikumus, lēmumus un norādījumus.

2. Ja Saņēmējvalsts ir tiesīga pārbaudīt izmešu samazināšanos, Investorvalsts tomēr var pieprasīt, lai neatkarīga organizācija pārbauda izmešu samazināšanos.

3. Šī Līguma Puses apņemas veikt nepieciešamos pasākumus, lai ISV un NDV tiktu izsniegti atbilstoši pārbaudītajam izmešu samazināšanās apjomam.

8. pants

Kredītu nodošana

1. Puses nodrošina savlaicīgu ISV un NDV, kas radušās no Saņēmējvalsts projektiem, nodošanu Investorvalstij saskaņā ar Kioto protokolu un atbilstošajiem noteikumiem, lēmumiem un norādījumiem.

2. Pārbaudīto ISV un NDV nodošana balstās uz rakstveida apstiprinājumu, ko izdod Saņēmējvalsts saskaņā ar šī Līguma 6. pantu.

3. Saņēmējvalsts nodod apstiprināto vienību daudzumu, kas radušies no projektiem, Investorvalstij kā ISV pēc Kioto protokola 6.panta vai NDV saskaņā ar Kioto protokola 17. pantu. Kredītus no izmešu samazināšanas var veicināt ar priekšlaicīgu ISV un NDV nodošanu pēc projekta dalībnieku saskaņojuma/ norādījumiem.

9. pants

Produktivitātes celšana

Puses piekrīt darboties kopīgi, lai celtu produktivitāti un uzkrātu pieredzi, kas attiecas uz Kioto mehānismiem sabiedriskajā un privātajā sektorā, lai sekmētu sadarbību šajā sfērā, tas ir, organizējot seminārus, nodarbības un konferences. Ir izstrādāta BJRVSE reģionālā Rokasgrāmata par KĪ projektu procedūrām Baltijas jūras reģionā kā ieguldījums kopējā izpratnē par KĪ projektu koncepciju un projektu ciklu, kā arī administratīvo spēju celšanā.

10. pants

Pieredzes apmaiņa

Puses tiek atbalstītas dalīties pieredzes un informācijas apmaiņā par KĪ projektu aktivitātēm. Šādā informācijā jāiekļauj informāciju, kas attiecas uz KĪ projektu ciklu, kredītu piešķiršanu un nodošanu. Uzskatu un pieredze apmaiņai par KĪ projektu oficiālām lietām, metodikām, administratīvajiem un finansiālajiem šķēršļiem, kā arī transakciju izmaksām jānotiek ikgadēji.

11. pants

Izmēģinājumu vietas komiteja

Izmēģinājumu vietas darbības attīstību uzrauga Izmēģinājumu vietas komiteja, kuras sastāvā ietilpst ne vairāk kā divi Pušu pārstāvji, kuru nozīmē katra Puse. Komiteja reģistrē dalības projektus, kurus vada Baltijas jūras reģiona vecāko enerģētikas ierēdņu grupa, kas iesniedz attiecīgo ieguldījumu produktivitātes celšanā, dalās vajadzīgajā pieredzē un izplata informāciju. Komiteja ziņo par progresu, attīstību un attiecīgo pieredzi un sniedz priekšlikumus par Izmēģinājumu vietas tālāku attīstību sadarbībā ar Baltijas jūras reģiona vecāko enerģētikas ierēdņu grupu.

12. pants

Strīdus jautājumi

Jebkurš strīds, kas attiecas uz šī Līguma interpretāciju tiks atrisināts sarunu ceļā starp Pusēm. Pēc Pušu lūguma par strīdus izšķiršanu, Izmēģinājumu vietas komiteja sniegs palīdzību strīdus jautājumu atrisināšanā.

13. pants

Saistības

1. Piekrišana saistībai ar šo līgumu tiek izteikta ar:

a) parakstu, vai

b) parakstu, kas pakļauts ratifikācijai, pieņemšanai vai apstiprināšanai, ko dod Depozitārija ratifikācija,

c) pieņemšanas vai apstiprināšanas Depozitārija izsniegta pieejas atļauja.

2. Līgums saskaņā ar pirmās daļas (a) vai 1. (b) punktu ir atvērts parakstīšanai Dānijas Karalistes, Igaunijas Republikas, Somijas Republikas, Vācijas Federatīvās Republikas, Islandes Republikas, Latvijas Republikas, Lietuvas Republikas, Norvēģijas Karalistes, Polijas Republikas, Krievijas Federācijas un Zviedrijas Karalistes valdībai līdz 2003. gada 31. decembrim.

3. Līgums pēc tā stāšanās spēkā ir atvērts pievienošanās procedūrai saskaņā ar pirmās daļas (c) punktu Valdībām, kas minētas otrā daļā, kas nav Līgumu parakstījušas, un tām Kioto protokola līgumslēdzēja pusēm, kuras Līguma Puses akceptējušas pievienošanās laikā.

4. Dalība izmēģinājumu vietā neietekmē dalībnieku tiesības slēgt citus līgumus par Kioto mehānismiem nedz arī ietekmē dalībnieku saistības, kas paredzētas Kioto protokolā.

14. pants

Spēkā stāšanās

Šis Līgums stājas spēkā otrā mēneša 1. dienā pēc datuma, kurā sešas (6) valdības, kas minētas 13. panta otro daļu ir devušas savu piekrišanu būt iesaistītām šajā Līgumā. Jebkurai citai valdībai šis Līgums stāsies spēkā otrā mēneša 1. dienā pēc datuma, kurā šī valdība ir devusi savu piekrišanu būt iesaistītai šajā Līgumā.

15. pants

Labojumi

Jebkuri labojumi vai izmaiņas un papildus protokoli šajā Līgumā ir jāsaskaņo ar Pusēm un jāsaņem to piekrišana. Labojumi, izmaiņas vai papildus protokoli stāsies spēkā 90. dienā pēc datuma, kad visas Puses būs informējušas Depozitāriju par to formalitāšu izpildīšanu, kuras pieprasa šo valstu likumdošana.

16. pants

Novērtēšana, anulēšana un apņemšanās

Šo Līgumu Puses novērtēs līdz 2005. gada 31. decembrim. Ja Kioto protokols līdz tam nebūs stājies spēkā, šis Līgums tiks anulēts bez iepriekšējas paziņošanas. Ja Kioto protokols ir stājies spēkā, šis Līgums beigsies 2012. gada 31. decembrī.

Jebkura no Pusēm var atteikties no šī Līguma, iesniedzot Depozitārijam rakstveida iesniegumu. Līgums tiks uzskatīts par anulētu simts divdesmit (120) dienas pēc tam, kad Depozitārijs saņems anulēšanas iesniegumu.

17. pants

Depozitārijs

Ar šo Somijas valdība ir nozīmēta par Depozitāriju. Depozitārijs veic savus pienākumus saskaņā ar 1969. gada 23. maija Vīnes Konvencijas par starptautisko līgumu tiesībām 77. pantu.

Līgums parakstīts vienā oriģinālā angļu valodas versijā, kas parakstīts 2003. gada 29. septembrī, Gēteborgā.
