Agreement between the Republic of Latvia and the Republic of Estonia On the transfer of the user's rights of the plot of land

The Republic of Latvia and the Republic of Estonia ( hereinafter - Parties),

Considering the principles of good neighbouring relationships,

Desiring to improve the organisation of the border control on the border of the Republic of Latvia and the republic of Estonia,

Considering the Agreement of July 10, 1996 between the Governments of the Republic of Latvia and the Republic of Estonia regarding Border Crossing Points, and the Agreement of August 31, 1994 between the Governments of the Republic of Latvia and the Republic of Estonia on Joint border Control

Have agreed on the following:

Article 1

The Republic of Latvia shall transfer to the Republic of Estonia the user's right of the plot of land located in the city of Valka, R?jienas street 31, total size of it 42150 square meters (hereinafter - the Plot of Land) , for establishing and managing of a joint customs border control post Valka - Valga on it.

Article 2

The authorised institutions of the Parties shall conclude an agreement on terms of the building and maintenance of the joint Customs border control post. The authorised institution from the Republic of Latvia is the Ministry of Finance of the Republic of Latvia and from the Republic of Estonia -Ministry of Finance of the Republic of Estonia.

Article 3

The Republic of Estonia shall construct and establish the joint customs border control post on its expenses.

Article 4

Buildings, constructions and communications which form the joint customs border control post, shall belong to the Republic of Estonia.

Article 5

The Parties shall pay equal share of immovable property tax for the Plot of Land in accordance with the legislation of the Republic of Latvia.

Article 6

Any disputes arising upon the fulfilment, amending and termination of the Agreement shall be settled by negotiations.

The disputes arising upon the fulfilment, amending and termination of the Agreement, which cannot be solved by negotiating, shall be resolved in a court in order provided for in the legislation of the Republic of Latvia.

Article 7

The Agreement shall enter into force on the date on which the Parties have notified each other that all necessary constitutional procedures for its entry into force have been completed.

This Agreement shall remain in force for all the time of existence and management of the joint border control post.

This Agreement has been signed in Valka on March. 5,1999 in 2 (two) copies in Latvian, Estonian and English, all texts being equally authentic. In case of any dispute of interpretation of the text of the Agreement the English text shall prevail.
