The Royal Norwegian Embassy in Riga presents its compliments
to the Ministry of Foreign Affairs of the Republic of Latvia and
has the honour to refer to the discussions between our two
Governments concerning the termination of the Agreement between
the Government of the Kingdom of Norway and the Government of the
Republic of Latvia on the Mutual Promotion and Protection of
Investments, signed in Riga on 16 June 1992, and has the honour
to suggest the following:
1. The Agreement between the Government of the Kingdom of
Norway and the Government of the Republic of Latvia on the Mutual
Promotion and Protection of Investments, signed in Riga on 16
June 1992 (hereinafter referred to as "the Agreement on the
Promotion and Protection of Investments") is terminated
according to the terms set out in this Agreement.
2. Article XIII of the Agreement on the Promotion and
Protection of Investments, which extends the protection of
investment made prior to the date of the termination, is
terminated and shall not produce legal effects.
3. The Agreement on the Promotion and Protection of
Investments shall not serve as legal basis for initiating any new
arbitration proceedings after the entering into force of this
Agreement. For greater certainty, it means that no arbitration
tribunal can be constituted under the Agreement on the Promotion
and Protection of Investments after this agreement has entered
into force.
The Contracting Parties share the understanding that the
afore-mentioned applies to all State-State and Investor-State
Arbitration proceedings based on the Agreement on the Promotion
and Protection of Investments under any arbitration convention or
set of rules.
If the foregoing proposals are acceptable to the Government of
the Republic of Latvia, the Embassy suggests that this note,
together with your reply to that effect, shall constitute an
Agreement between our two Governments which shall enter into
force thirty (30) days after the date of the last written
notification by the Contracting Parties through diplomatic
channels confirming that the national legal procedures necessary
for the entry into force of this Termination Agreement have been
completed.
The Royal Norwegian Embassy in Riga avails itself of this
opportunity to renew to the Ministry of Foreign Affairs of the
Republic of Latvia the assurances of its highest
consideration."

of 20 April 2022 with the proposal to terminate the Agreement
between the Government of the Republic of Latvia and the
Government of the Kingdom of Norway on the Mutual Promotion and
Protection of Investments, which reads as follows:

The Ministry of Foreign Affairs of the Republic of Latvia has
the honour to inform the Embassy that the foregoing proposals are
acceptable to the Government of the Republic of Latvia and that
the Embassy's note No 09/22 of 20 April 2022 and this reply note
shall constitute the Termination Agreement between our two
Governments which shall enter into force thirty (30) days after
the date of the last written notification by the Contracting
Parties through diplomatic channels confirming that the national
legal procedures necessary for the entry into force of this
Termination Agreement have been completed.
The Ministry of Foreign Affairs of the Republic of Latvia
avails itself of this opportunity to renew to the Royal Norwegian
Embassy the assurances of its highest consideration.
