Saeima ir pieņēmusi un Valsts
prezidents izsludina šādu likumu:

1.pants. 1987.gada 26.novembra Eiropas konvencija par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu un tās pielikums (turpmāk — Konvencija), kā arī Konvencijas 1993.gada 4.novembra 1.protokols (turpmāk — 1.Protokols) un 2.protokols (turpmāk — 2.Protokols) ar šo likumu tiek pieņemti un apstiprināti.

2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināma Konvencija, 1.Protokols un 2.Protokols angļu valodā un to tulkojums latviešu valodā.

3.pants. Tieslietu ministrija veic koordinatora funkcijas Konvencijā, 1.Protokolā un 2.Protokolā paredzēto saistību izpildē.

4.pants. Konvencija stājas spēkā tās 19.pantā, 1.Protokola 8.pantā un 2.Protokola 3.pantā noteiktajā laikā un kārtībā, un par to Ārlietu ministrija paziņo laikrakstā "Latvijas Vēstnesis".

European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment

Strasbourg, 26.XI.1987

The member States of the Council of Europe, signatory hereto,

Having regard to the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms;

Recalling that, under Article 3 of the same Convention "no one shall be subjected to torture or to inhuman or degrading treatment or punishment";

Noting that the machinery provided for in that Convention operates in relation to persons who allege that they are victims of violations of Article 3;

Convinced that the protection of persons deprived of their liberty against torture and inhuman or degrading treatment or punishment could be strengthened by non- judicial means of a preventive character based on visits,

Have agreed as follows:

Chapter I

Article 1

There shall be established a European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (hereinafter referred to as "the Committee"). The Committee shall, by means of visits, examine the treatment of persons deprived of their liberty with a view to strengthening, if necessary, the protection of such persons from torture and from inhuman or degrading treatment or punishment.

Article 2

Each Party shall permit visits, in accordance with this Convention, to any place within its jurisdiction where persons are deprived of their liberty by a public authority.

Article 3

In the application of this Convention, the Committee and the competent national authorities of the Party concerned shall co-operate with each other.

Chapter II

Article 4

1. The Committee shall consist of a number of members equal to that of the Parties.

2. The members of the Committee shall be chosen from among persons of high moral character, known for their competence in the field of human rights or having professional experience in the areas covered by this Convention.

3. No two members of the Committee may be nationals of the same State.

4. The members shall serve in their individual capacity, shall be independent and impartial, and shall be available to serve the Committee effectively.

Article 5

1. The members of the Committee shall be elected by the Committee of Ministers of the Council of Europe by an absolute majority of votes, from a list of names drawn up by the Bureau of the Consultative Assembly of the Council of Europe; each national delegation of the Parties in the Consultative Assembly shall put forward three candidates, of whom two at least shall be its nationals.

Where a member is to be elected to the Committee in respect of a non-member State of the Council of Europe, the Bureau of the Consultative Assembly shall invite the Parliament of that State to put forward three candidates, of whom two at least shall be its nationals. The election by the Committee of Ministers shall take place after consultation with the Party concerned.

2. The same procedure shall be followed in filling casual vacancies.

3. The members of the Committee shall be elected for a period of four years. They may be re-elected twice. However, among the members elected at the first election, the terms of three members shall expire at the end of two years. The members whose terms are to expire at the end of the initial period of two years shall be chosen by lot by the Secretary General of the Council of Europe immediately after the first election has been completed.

4. In order to ensure that, as far as possible, one half of the membership of the Committee shall be renewed every two years, the Committee of Ministers may decide, before proceeding to any subsequent election, that the term or terms of office of one or more members to be elected shall be for a period other than four years but not more than six and not less than two years.

5. In cases where more than one term of office is involved and the Committee of Ministers applies the preceding paragraph, the allocation of the terms of office shall be effected by the drawing of lots by the Secretary General, immediately after the election.

Article 6

1. The Committee shall meet in camera. A quorum shall be equal to the majority of its members. The decisions of the Committee shall be taken by a majority of the members present, subject to the provisions of Article 10, paragraph 2.

2. The Committee shall draw up its own rules of procedure.

3. The Secretariat of the Committee shall be provided by the Secretary General of the Council of Europe.

Chapter III

Article 7

1. The Committee shall organise visits to places referred to in Article 2. Apart from periodic visits, the Committee may organise such other visits as appear to it to be required in the circumstances.

2. As a general rule, the visits shall be carried out by at least two members of the Committee. The Committee may, if it considers it necessary, be assisted by experts and interpreters.

Article 8

1. The Committee shall notify the Government of the Party concerned of its intention to carry out a visit. After such notification, it may at any time visit any place referred to in Article 2.

2. A Party shall provide the Committee with the following facilities to carry out its task:

a. access to its territory and the right to travel without restriction;

b. full information on the places where persons deprived of their liberty are being held;

c. unlimited access to any place where persons are deprived of their liberty, including the right to move inside such places without restriction;

d. other information available to the Party which is necessary for the Committee to carry out its task. In seeking such information, the Committee shall have regard to applicable rules of national law and professional ethics.

3. The Committee may interview in private persons deprived of their liberty.

4. The Committee may comunicate freely with any person whom it believes can supply relevant information.

5. If necessary, the Committee may immediately comunicate observations to the competent authorities of the Party concerned.

Article 9

1. In exceptional circumstances, the competent authorities of the Party concerned may make representations to the Committee against a visit at the time or to the particular place proposed by the Committee. Such representations may only be made on grounds of national defence, public safety, serious disorder in places where persons are deprived of their liberty, the medical condition of a persons or that an urgent interrogation relating to a serious crime is in progress.

2. Following such representations, the Committee and the Party shall immediately enter into consultations in order to clarify the situation and seek agreement on arrangements to enable the Committee to exercise its functions expeditiously. Such arrangements may include the transfer to another place of any person whom the Committee proposed to visit. Until the visit takes place, the Party shall provide information to the Committee about any person concerned.

Article 10

1. After each visit, the Committee shall draw up a report on the facts found during the visit, taking account of any observations which may have been submitted by the Party concerned. It shall transmit to the latter its report containing any recommendations it considers necessary. The Committee may consult with the Party with a view to suggesting, if necessary, improvements in the protection of persons deprived of their liberty.

2. If the Party fails to co-operate or refuses to improve the situation in the light of the Committee's recommendations, the Committee may decide, after the Party has had an apportunity to make known its views, by a majority of two-thirds of its members to make a public statement on the matter.

Article 11

1. The information gathered by the Committee in relation to a visit, its report and its consultations with the Party concerned shall be confidential.

2. The Committee shall publish its report, together with any comments of the Party concerned, whenever requested to do so by that Party.

3. However, no personal data shall be published without the express consent of the person concerned.

Article 12

Subject to the rules of confidentiality in Article 11, the Committee shall every year submit to the Committee of Ministers a general report on its activities which shall be transmitted to the Consultative Assembly and to any non-member State of the Council of Europe which is a party to the Convention, and made public.

Article 13

The members of the Committee, experts and other persons assisting the Committee are required, during and after their terms of office, to maintain the confidentiality of the facts or information of which they have become aware during the dischange of their functions.

Article 14

1. The names of persons assisting the Committee shall be specified in the notification under Article 8, paragraph 1.

2. Experts shall act on the instructions and under the authority of the Committee. They shall have particular knowledge and experience in the areas convered by this Convention and shall be bound by the same duties of independence, impartiality and availability as the members of the Committee.

3. A Party may exceptionally declare that an expert or other person assisting the Committee may not be allowed to take part in a visit to a place within its jurisdiction.

Chapter IV

Article 15

Each Party shall inform the Committee of the name and address of the authority competent to receive notifications to its Government, and of any liaison officer it may appoint.

Article 16

The Committee, its members and experts referred to in Article 7, paragraph 2 shall enjoy the privileges and immunities set out in the Annex to this Convention.

Article 17

1. This Convention shall not prejudice the provisions of domestic law or any international agreement which provide greater protection for persons deprived of their liberty.

2. Nothing in this Convention shall be construed as limiting or derogating from the competence of the organs of the European Convention on Human Rights or from the obligations assumed by the Parties under the Convention.

3. The Committee shall not visit places which representatives or delegates of Protecting Powers or the International Committee of the Red Cross effectively visit on a regular basis by virtue of the Geneva Conventions of 12 August 1949 and the Additional Protocols of 8 June 1977 thereto.

Chapter V

Article 18

1. This Convention shall be open for signature by the member States of the Council of Europe. It is subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

2. The Committee of Ministers of the Council of Europe may invite any non-member State of the Council of Europe to accede to the Convention.

Article 19


1. This Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date on which seven member States of the Council of Europe have expressed their consent to be bound by the Convention in accordance with the provisions of Article 18.

2. In respect of any State which subsequently expresses its consent to be bound by it, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of the instrument of ratification, acceptance approval or accession.

Article 20

1. Any State may at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Convention shall apply.

2. Any State may at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Convention to any other territory specified in the declaration. In respect of such territory the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of receipt of such declaration by the Secretary General.

3. Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General. The withdrawal shall become effective on the first day of the month following the expiration of a period of three months after the date of receipt of such notification by the Secretary General.

Article 21


No reservation may be made in respect of the provisions of this Convention.

Article 22

1. Any Party may, at any time, denounce this Convention by means of a notification addressed to the Secretary General of the Council of Europe.

2. Such denunciation shall become effective on the first day of the month following the expiration of a period of twelve months after the date of receipt of the notification by the Secretary General.

Article 23

The Secretary General of the Council of Europe shall notify the member States and any non-member State of the Council of Europe party to the Convention of:

a. any signature;

b. the deposit of any instrument of ratification, acceptance, approval or accession;

c. any date of entry into force of this Convention in accordance with Articles 19 and 20;

d. any other act, notification or communication relating to this Convention, except for action taken in pursuance of Articles 8 and 10.

Annex


Privileges and immunities ( Article 16 )

1. For the purpose of this annex, references to members of the Committee shall be deemed to include references to experts mentioned in Article 7, paragraph 2.

2. The members of the Committee shall, while exercising their functions and during journeys made in the exercise of their functions, enjoy the following privileges and immunities:

a. immunity from personal arrest or detention and from seizure of their personal baggage and, in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;

b. exemption from any restrictions on their freedom of movement on exit from and return to their country of residence, and entry into and exit from the country in which they exercise their functions, and from alien registration in the country which they are visiting or through which they are passing in the exercise of their functions.

3. In the course of journeys undertaken in the exercise of their functions, the members of the Committee shall, in the matter of customs and exchange control, be accorded:

a. by their own Government, the same facilities as those accorded to senior officials travelling abroad on temporary official duty;

b. by the Governments of other Parties, the same facilities as those accorded to representatives of foreign Governments on temporary official duty.

4. Documents and papers of the Committee, in so far as they relate to the business of the Committee, shall be inviolable.

The official correspondence and other official communications of the Committee may not be held up or subjected to censorship.

5. In order to secure for the members of the Committee complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

6. Privileges and immunities are accorded to the members of the Committee, not for the personal benefit of the individuals themselves but in order to safeguard the independent exercise of their functions. The Committee alone shall be competent to waive the immunity of its members; it has not only the right, but is under a duty, to waive the immunity of one of its members in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is acorded.


Protocol No. 1 to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment

The member States of the Council of Europe, signatories to this Protocol to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, signed at Strasbourg on 26 November 1987 ( hereinafter referred to as "the Convention"),

considering that non- member States of the Council of Europe should be allowed to accede to the Convention at the invitation of the Committee of Ministers,

Have agreed as follows:

Article 1

A sub-paragraph shall be added to Article 5, paragraph 1, of the Convention as follows:

"Where a member is to be elected to the Committee in respect of a non-member State of the Council of Europe, the Bureau of the Consultative Assembly shall invite the Parliament of that State to put forward three candidates, of whom two at least shall be its nationals. The election by the Committee of Ministers shall take place after consultation with the Party concerned."

Article 2

Article 12 of the Convention shall read as follows:

"Subject to the rules of confidentiality in Article 11, the Committee shall every year submit to the Committee of Ministers a general report on its activities which shall be transmitted to the Consultative Assembly and to any non-member State of the Council of Europe which is a party to the Convention, and made public."

Article 3

The text of Article 18 of the Convention shall become paragraph 1 of that article and shall be supplemented by the following second paragraph:

(2) The Committee of Ministers of the Council of Europe may invite any non-member State of the Council of Europe to accede to the Convention."

Article 4

In paragraph 2 of Article 19 of the Convention, the word "member" shall be deleted and the word "or approval", shall be replaced by "approval or accession."

Article 5

In paragraph 1 of Article 20 of the Convention, the word "or approval"shall be replaced by "approval or accession,".

Article 6

1. The introductory sentence of Article 23 of the Convention shall read as follows:

"The Secretary General of the Council of Europe shall notify the member States and any non-member State of the Council of Europe party to the Convention of:"

2. In Article 23.b of the Convention, the words "or approval ;" shall be replaced by "approval or accession;".

Article 7

1. This Protocol shall be open for signature by member States of the Council of Europe signatories to the Convention, which may express their consent to be bound by:

a. signature without reservation as to ratification, acceptance or approval; or

b. signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.

2. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 8

This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol, in accordance with the provisions of Article 7.

Article 9

The Secretary General of the Council of Europe shall notify the member States of the Council of Europe of :

a. any signature;

b. the deposit of any instrument of ratification, acceptance or approval;

c. the date of entry into force of this Protocol, in accordance with Article 8;

d. any other act, notification or communication relating to this Protocol.

In witness whereof, the undersigned, being duly authorised thereto, have signed this Protocol.

Protocol No. 2 to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment

The States, signatories to this Protocol to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, signed at Strasbourg on 26 November 1987 ( hereinafter referred to as "the Convention"),

Convinced of the advisability of enabling members of the European Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment

(hereinafter referred to as "the Committee") to be re-elected twice;

Also considering the need to guarantee an orderly renewal of the membership of the Committee;

Have agreed as follows:

Article 1

1. In Article 5, paragraph 3, the second sentence shall read as follows:

"They may be re-elected twice."

2. Article 5 of the Convention shall be suplemented by the following paragraphs 4 and 5:

(4) In order to ensure that, as far as possible, one half of the membership of the Committee shall be renewed every two years, the Committee of Ministers may decide, before proceeding to any subsequent election, that the term or terms of office of one or more members to be elected shall be for a period other than four years but not more than six and not less than two years.

(5) In cases where more than one term of office is involved and the Committee of Ministers applies the preceding paragraph, the allocation of the terms of office shall be effected by the drawing of lots by the Secretary General, immediately after the election."

Article 2

1. This Protocol shall be open for signature by States signatories to the Convention or acceding thereto, which may express their consent to be bound by:

a. signature without reservation as to ratification, acceptance or approval; or

b. signature subject to ratification, acceptance or approval, followed by __ratification, acceptance or approval.

2. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 3

This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol, in accordance with the provisions of Article 2.

Article 4

The Secretary General of the Council of Europe shall notify the member States of the Council of Europe and non-member States Parties to the Convention of:

a. any signature;

b. the deposit of any instrument of ratification, acceptance or approval;

c. the date of any entry into force of this Protocol, in accordance with Article 3;

d. any other act, notification or communication relating to this Protocol.

In witness whereof, the undersigned, being duly authorised thereto, have signed this Protocol.

Eiropas konvencija par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu Strasbūra

26.XI.1987

Šo Konvenciju parakstījušās Eiropas Padomes dalībvalstis,

Ņemot vērā Cilvēktiesību un Pamatbrīvību aizsardzības konvencijas noteikumus;

Atgādinot, ka saskaņā ar iepriekšminētās konvencijas 3.pantu "neviens nedrīkst tikt pakļauts spīdzināšanai vai necilvēcīgai vai pazemojošai rīcībai vai sodam";

Atzīmējot, ka ar minēto konvenciju noteiktais mehānisms darbojas attiecībā uz personām, kuras apgalvo, ka viņas ir konvencijas 3.panta noteikumu pārkāpumu upuri;

Būdamas pārliecinātas, ka to personu, kurām ir atņemta brīvība, aizsardzības pret spīdzināšanu un necilvēcīgu vai pazemojošu rīcību vai sodu varētu tikt pastiprināta nevis ar tiesas, bet preventīva rakstura līdzekļiem, kuru pamatā būtu šo personu apmeklēšana brīvības atņemšanas vietās;

Ir vienojušās par sekojošo:

I NODAĻA

1.pants

Tiek nodibināta Eiropas Komiteja spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanai (tālāk tekstā "Komiteja"). Komitejai veicot apmeklējumus ir jāpārbauda izturēšanās pret personām, kurām ir atņemta brīvība, lai nepieciešamības gadījumā pastiprinātu šādu personu aizsardzību pret spīdzināšanu un pret necilvēcīgu vai pazemojošu rīcību vai sodu.

2.pants

Katrai Pusei, saskaņā ar šo Konvenciju, ir pienākums atļaut apmeklējumus uz jebkuru tās jurisdikcijā esošu vietu, kurā atrodas personas, kam valsts pārvaldes iestāde ir atņēmusi brīvību.

3.pants

Komitejai un kompetentām attiecīgās Puses valsts varas iestādēm ir savstarpēji jāsadarbojas piemērojot šīs Konvencijas normas.

II NODAĻA

4.pants

1. Komitejas sastāvā esošo locekļu skaits atbilst Konvencijas dalībvalstu skaitam.

2. Komitejas locekļus izvēlas no personām ar visaugstāko morālo stāju, atzītu kompetenci cilvēktiesību jomā vai ar profesionālu pieredzi jomās, kuras regulē šī Konvencija.

3. No katras valsts Komitejā nedrīkst būt pa diviem locekļiem.

4. Komitejas locekļi darbojas individuāli, neatkarīgi un objektīvi, un viņiem ir jābūt spējīgiem efektīvi darboties Komitejā.

5.pants

1. Komitejas locekļus ievēl Eiropas Padomes Ministru Komiteja ar absolūtu balsu vairākumu no kandidātu saraksta, kuru sastāda Eiropas Padomes Konsultatīvās Asamblejas birojs; katras Puses valsts delegācijai Konsultatīvajā Asamblejā ir jāizvirza trīs kandidāti, no kuriem vismaz diviem ir jābūt tās pilsoņiem.

Gadījumā, ja Komitejā jāievēl loceklis no valsts, kura nav Eiropas Padomes dalībvalsts, Konsultatīvās Asamblejas Birojam jāaicina šīs valsts Parlaments izvirzīt trīs kandidātus, no kuriem vismaz diviem ir jābūt tās pilsoņiem. Vēlēšanām Ministru Komitejā ir jānotiek pēc sarunām ar attiecīgo Pusi.

2. Tāda pati procedūra tiek piemērota aizpildot atbrīvojušās Komitejas locekļu vietas.

3. Komitejas locekļus ievēlē uz četriem gadiem. Viņi var tikt atkārtoti ievēlēti divas reizes. Tomēr, no tiem Komitejas locekļiem, kuri tika ievēlēti pirmajās vēlēšanās, divu locekļu pilnvaru termiņš beidzas pēc diviem gadiem. Locekļus, kuru darbības termiņš beidzas pēc sākotnējiem diviem gadiem, izvēlas Eiropas Padomes Ģenerālsekretārs izlozes ceļā, uzreiz pēc pirmo vēlēšanu beigām.

4. Lai iespēju robežās nodrošinātu, ka puse no Komitejas locekļu sastāva nomainās ik pēc diviem gadiem, Ministru Komiteja pirms uzsāk nākošās vēlēšanas var nolemt, ka pilnvaru termiņš vai termiņi vienam vai vairākiem ievēlamajiem locekļiem var būt četri gadi, bet tas nedrīkst būt ilgāks par sešiem un īsāks par diviem gadiem.

5. Gadījumos par vairāk nekā vienu pilnvaru laiku un, kad Ministru Komiteja piemēro šī panta 4.daļu, pilnvaru termiņus noskaidro ar izlozes palīdzību, ko veic Ģenerālsekretārs tūlīt pēc locekļu ievēlēšanas.

6.pants

1. Komitejas sanāksmes ir slēgtas. Kvorums ir vienāds ar Komitejas locekļu vairākumu. Komitejas lēmumi tiek pieņemti ar klātesošo Komitejas locekļu balsu vairākumu, saskaņā ar 10.panta 2.daļas noteikumiem.

2. Komiteja pati nosaka savu darba kārtību.

3. Eiropas Padomes Ģenerālsekretārs nodrošina Komitejas sekretariāta darbību.

III NODAĻA

7.pants

1. Komiteja organizē apmeklējumus uz 2.pantā minētajām vietām. Komiteja organizē periodiskus apmeklējumus, un, vadoties no apstākļiem, var organizēt arī citus apmeklējumus.

2. Parasti apmeklējumus veic vismaz divi Komitejas locekļi. Nepieciešamības gadījumā Komitejai palīdzību var sniegt eksperti un tulki.

8.pants

1. Komitejai ir jāpaziņo attiecīgās Puses valdībai par nodomu veikt apmeklējumu. Pēc šāda paziņojuma, tā jebkurā laikā var apmeklēt jebkuru no 2.pantā minētajām vietām.

2. Lai Komiteja veiktu savu uzdevumu, Pusei ir jānodrošina sekojošais:

a. iekļūšana tās teritorijā un tiesības tajā pārvietoties bez ierobežojumiem;

b. pilnīga informācija par brīvības atņemšanas vietām;

c. neierobežota iekļūšana jebkurā brīvības atņemšanas vietā un tiesības tajā pārvietoties bez ierobežojumiem;

d. cita informācija, kura ir pieejama Pusei un nepieciešama Komitejai tās uzdevumu veikšanai. Lūdzot šādu informāciju, Komitejai jāņem vērā spēkā esošie nacionālie likumi un profesionālās ētikas normas.

3. Komitejai ir tiesības uz konfidenciāla rakstura pārrunām ar personām, kurām ir atņemta brīvība.

4. Komitejai ir tiesības brīvi sazināties ar jebkuru personu, kura pēc Komitejas uzskata var sniegt tai vajadzīgo informāciju.

5. Nepieciešamības gadījumā Komitejai ir tiesības nekavējoties darīt zināmus savus konstatējumus attiecīgās Puses kompetentām valsts varas iestādēm.

9.pants

1. Izņēmuma gadījumā, attiecīgās Puses kompetentās valsts varas iestādes var iebilst pret Komitejas piedāvāto apmeklējuma laiku un vietu. Iebildumi var tikt pamatoti tikai ar valsts aizsardzību, sabiedrisko drošību, nopietnām nekārtībām brīvības atņemšanas vietās, personas veselības stāvoklis vai, kad sakarā ar smagu noziegumu tiek veikta neatliekama neatliekama pratināšana.

2. Pēc iebildumu saņemšanas, Komitejai un Pusei nekavējoties jāuzsāk sarunas, lai noskaidrotu situāciju un panāktu vienošanos par pasākumiem, kuri dotu iespēju Komitejai savlaicīgi veikt tās funkcijas. Šādi pasākumi varētu nozīmēt jebkuras personas, kuru Komiteja ir izvēlējusies apmeklēt, pārvietošanu uz citu vietu. Līdz apmeklējumam Puse nodrošina Komiteju ar informāciju par jebkuru to interesējošo personu.

10.pants

1. Pēc katra apmeklējuma Komitejai jāraksta ziņojums par apmeklējuma laikā konstatētiem faktiem, ņemot vērā attiecīgās puses iesniegtās piezīmes. Komiteja nosūta Pusei ziņojumu, ietverot tajā rekomendācijas, kuras tā uzskata par nepieciešamām. Ja nepieciešams, Komiteja var konsultēties ar Pusi, lai ierosinātu uzlabot personu aizsardzību, kurām ir atņemta brīvība.

2. Ja Puse nesadarbojas vai atsakās uzlabot situāciju saskaņā ar Komitejas rekomendācijām, Komitejai, pēc Puses viedokļa uzklausīšanas, ir tiesības ar tās locekļu divu trešdaļu balsu vairākumu savus konstatējumus attiecīgajā jautājumā paziņot publiski.

11.pants

1. Informācija, kuru apmeklējuma laikā apkopojusi Komiteja, ziņojums un sarunas ar attiecīgo Pusi ir konfidenciālas.

2. Komiteja publicē savu ziņojumu, pievienojot tam attiecīgās Puses komentārus, kad vien Puse lūdz to darīt.

3. Tomēr, nekādi personu raksturojoši dati nav publicējami bez attiecīgās personas piekrišanas.

12.pants

Saskaņā 11.panta konfidencialitātes noteikumiem, Komitejai katru gadu par tās darbību jāiesniedz Ministru Komitejai vispārējs ziņojums, kurš jānosūta uz Konsultatīvo Asambleju un uz jebkuru valsti, kura nav Eiropas Padomes dalībvalsts, bet kura ir Konvencijas dalībvalsts un jāpaziņo sabiedrībai.

13.pants

Savu pilnvaru laikā, kā arī tām beidzoties, Komitejas locekļiem, ekspertiem un citām personām, kas asistē Komitejai, ir jāsaglabā konfidencialitāte par faktiem vai informāciju, kas viņiem ir kļuvusi zināma, veicot savus pienākumus.

14.pants

1. Personu, kuras asistē Komitejai, vārdi jānorāda paziņojumā saskaņā ar 8.panta 1.daļu.

2. Eksperti darbojas saskaņā ar instrukcijām un Komitejas pilnvarām. Viņiem nepieciešamas īpašas zināšanas un pieredze jomās, kuras regulē šī Konvencija, un viņiem jāievēro tādi paši neatkarīguma, objektivitātes un pieejamības principi kā Komitejas locekļiem.

3. Izņēmuma kārtā, Puse var paziņot, ka vietas apmeklējumā, kura ir tās jurisdikcijā, nav atļauts piedalīties ekspertam vai citai personai, kura asistē Komitejai.

IV NODAĻA

15.pants

Katra Puse informē Komiteju par valsts varas iestādes nosaukumu un adresi, kuras kompetencē ir saņemt valdībai adresētus paziņojumus, un par jebkuru Puses nozīmētu kontaktpersonu.

16.pants

7.panta 2.daļā minēto Komitejas locekļu un ekspertu privilēģijas un imunitātes ir noteiktas šīs Konvencijas pielikumā.

17.pants

1. Šī Konvencija neietekmē nacionālos likumus vai jebkurus starptautiskos līgumus, kuri personām, kurām ir atņemta brīvība paredz lielāku aizsardzību.

2. Nekas šajā Konvencijā nav jāiztulko kā tāds, kas ierobežo vai pasliktina ar Eiropas Cilvēktiesību Konvenciju izveidoto institūciju darbību vai pienākumus, kurus Puses ir uzņēmušās saskaņā ar iepriekšminēto Konvenciju.

3. Komitejai nav jāapmeklē vietas, kuras saskaņā ar 1949.gada 12.augusta Ženēvas Konvencijām un 1977.gada 8.jūnija Papildprotokoliem pie tām, regulāri un efektīvi apmeklē aizsargājošo institūciju pārstāvji vai Starptautiskā Sarkanā Krusta Komiteja.

V NODAĻA

18.pants

1. Šī Konvencija ir atvērta parakstīšanai Eiropas Padomes dalībvalstīm. Tā ir jāratificē, jāpieņem vai jāapstiprina. Ratifikācijas, pieņemšanas un apstiprināšanas dokumenti jānodod glabāšanā Eiropas Padomes Ģenerālsekretāram.

2. Eiropas Padomes Ministru Komiteja var uzaicināt jebkuru valsti, kura nav Eiropas Padomes dalībvalsts, pievienoties Konvencijai.

19.pants

1. Konvencija stājas spēkā ceturtā mēneša pirmajā dienā no dienas, kad septiņas Eiropas Padomes dalībvalstis ir vienprātīgi izteikušas piekrišanu pildīt Konvenciju saskaņā ar 18.panta nosacījumiem.

2. Attiecībā uz jebkuru Eiropas Padomes valsti, kura vēlāk izteikusi savu vēlmi pievienoties Konvencijai, tā stājas spēkā ceturtā mēneša pirmajā dienā no dienas, kad šī valsts ir iesniegusi ratifikācijas, piekrišanas, apstiprināšanas vai pievienošanās dokumentu.

20.pants

1. Katra valsts parakstot šo Konvenciju vai iesniedzot ratifikācijas, piekrišanas, apstiprināšanas vai pievienošanās dokumentu, var norādīt teritoriju vai teritorijas, uz kurām šī Konvencija attiecas.

2. Katra valsts, jebkurā brīdī var ar Eiropas Padomes Ģenerālsekretāram adresētu paziņojumu paplašināt šīs Konvencijas darbību uz jebkuru citu paziņojumā norādītu teritoriju. Attiecībā uz šo teritoriju Konvencija stājas spēkā ceturtā mēneša pirmajā dienā no dienas, kad paziņojumu saņēmis Ģenerālsekretārs.

3. Katrs paziņojums, kas sastādīts saskaņā ar šī panta 1.un 2.daļu attiecībā uz jebkuru paziņojumā norādītu teritoriju, var tikt anulēts, nosūtot Ģenerālsekretāram adresētu paziņojumu. Šāds anulējums stājās spēkā ceturtā mēneša pirmajā dienā no dienas, kad paziņojumu saņēmis Ģenerālsekretārs.

21.pants

Attiecībā uz Konvencijas noteikumiem nevar tikt izdarīti nekādi iebildumi.

22.pants

1. Jebkura Puse šo Konvenciju var denonsēt jebkurā laikā ar paziņojumu, kurš adresēts Eiropas Padomes Ģenerālsekretāram.

2. Šāda denonsācija stājas spēkā trīspadsmitā mēneša pirmajā dienā no datuma, kurā Ģenerālsekretārs saņēmis paziņojumu.

23.pants

Eiropas Padomes Ģenerālsekretārs paziņo Eiropas Padomes dalībvalstīm un jebkurai valstij, kura nav Eiropas Padomes dalībvalsts, bet ir šīs Konvencijas dalībvalsts par:

a. katru parakstīšanu;

b. katru dokumentu, kas tiek iesniegts par ratifikāciju, pieņemšanu, apstiprināšanu vai pievienošanos;

c. katru termiņu, kad šī Konvencija stājas spēkā saskaņā ar 19. un 20.pantu;

d. jebkuru citu aktu, paziņojumu vai korespondenci, kas attiecas uz šo Konvenciju, izņemot par darbībām, kuras veiktas saskaņā ar 8. un 10.pantu.

Apliecinot iepriekšminēto, apakšā parakstījušās, un attiecīgi uz to pilnvarotas, personas ir parakstījušas šo Konvenciju.

Parakstīta Strasbūrā 1987.gada 26.novembrī, angļu un franču valodā, abi teksti ir vienlīdz autentiski, vienā eksemplārā, kurš tiek nodots glabāšanā Eiropas Padomes arhīvos. Eiropas Padomes Ģenerālsekretārs nosūta apliecinātas kopijas visām Eiropas Padomes dalībvalstīm.

Pielikums


Privilēģijas un imunitātes (16.pants.)

1. Pielikuma atsauksmes attiecībā uz Komitejas locekļiem ir jāuzskata arī par atsauksmēm uz 7.panta 2.daļā minētajiem ekspertiem.

2. Komitejas locekļiem, veicot savas funkcijas, kā arī apmeklējumu laikā ir sekojošas privilēģijas un imunitātes:

a. imunitāte pret arestēšanu vai aizturēšanu vai personīgās bagāžas apķīlāšanu, imunitāte attiecībā uz viņu teikto un rakstīto un visām darbībām, ko tie ir veikuši kā amatpersonas, imunitāti pret jebkāda veida tiesas procesu;

b. atbrīvojums no jebkādiem ierobežojumiem, kas varētu būt vērsti pret viņu pārvietošanās brīvību izbraucot no viņu dzīvesvietas valsts un atgriežoties tajā, un, iebraucot un izbraucot no valsts, kurā viņi veic savas funkcijas, un atbrīvojumu no ārvalstnieku reģistrācijas valstī, kuru viņi apmeklē vai caur kuru viņi brauc, lai veiktu savas funkcijas.

3. Braucienu laikā, lai veiktu savas funkcijas, Komitejas locekļiem muitas un valūtas kontroles jautājumos jāgarantē:

a. viņu pašu valdībai - tādi atvieglojumi, kādi tiek piešķirti augstākstāvošām valsts amatpersonām, kuras dodas uz ārvalstīm īslaicīgā oficiālā vizītē;

b. citu Pušu valdībām - tādi atvieglojumi, kādi tiek piešķirti ārvalstu valdību pārstāvjiem, kuri atrodas īslaicīgā oficiālā vizītē.

4. Komitejas dokumentiem un tiem pielīdzinātai korespondencei tiktāl, cik tā attiecas uz Komitejas darbību, jābūt neaizskaramai.

Komitejas oficiālā sarakste un citi sakari nedrīkst tikt aizkavēti vai pakļauta cenzūrai.

5. Lai Komitejas locekļiem garantētu pilnīgu runas brīvību un pilnīgu neatkarību veicot viņu pienākumus, ir jāparedz imunitāte pret jebkāda veida saukšanu pie atbildības attiecībā uz viņu teikto vai rakstīto un darīto, veicot savus pienākumus, neskatoties uz to, ka attiecīgās personas vairs nav iesaistītas šādu pienākumu veikšanā.

6. Privilēģijas un imunitātes tiek piešķirtas Komitejas locekļiem nevis viņu personīgo labumu dēļ, bet, lai nodrošinātu viņu funkciju neatkarīgu veikšanu. Vienīgi Komitejai ir tiesības atņemt tās locekļiem imunitāti; tai ir ne tikai tiesības, bet arī pienākums atņemt imunitāti kādam no tās locekļiem tajos gadījumos, kad, saskaņā ar Komitejas viedokli, imunitāte varētu traucēt taisnīgumam, un, atņemot to, netiktu kaitēts mērķim, kura dēļ imunitāte ir piešķirta.

Protokols Nr.1 Eiropas konvencijai par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu


Eiropas Padomes dalībvalstis, kas parakstījušas šo Protokolu pie Eiropas Konvencijas "Par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu", kas parakstīta 1987.gada 26.novembrī Strasbūrā, (turpmāk-Konvencija),

Uzskatot, ka valstīm, kuras nav Eiropas Padomes dalībvalstis pēc Ministru Komitejas ielūguma ir jāļauj pievienoties Konvencijai,

Ir vienojušās par sekojošo:

1.pants

Konvencijas 5.panta 1.punkts ir jāpapildina ar sekojošu apakšdaļu:

"Gadījumā, ja Komitejā jāievēl loceklis no valsts, kura nav Eiropas Padomes dalībvalsts, Konsultatīvās Asamblejas Birojam jāaicina šīs valsts Parlaments izvirzīt trīs kandidātus, no kuriem vismaz diviem ir jābūt tās pilsoņiem. Vēlēšanām Ministru Komitejā ir jānotiek pēc sarunām ar attiecīgo Pusi."

2.pants

Izteikt Konvencijas 12.pantu šādā redakcijā:

"Saskaņā 11.panta konfidencialitātes noteikumiem, Komitejai katru gadu par tās darbību jāiesniedz Ministru Komitejai vispārējs ziņojums, kurš jānosūta uz Konsultatīvo Asambleju un uz jebkuru valsti, kura nav Eiropas Padomes dalībvalsts, bet kura ir Konvencijas dalībvalsts un jāpaziņo sabiedrībai."

3.pants

Konvencijas 18.panta teksts kļūst par šī panta 1.daļu un tiek papildināts ar sekojošu otro daļu:

"(2) Eiropas Padomes Ministru Komiteja var uzaicināt jebkuru valsti, kura nav Eiropas Padomes dalībvalsts, pievienoties Konvencijai."

4.pants

Konvencijas 19.panta 2.daļā vārda daļa "dalīb" - tiek svītrota un vārdi "vai apstiprināšanas" ir jāaizstāj ar vārdiem "apstiprināšanas vai pievienošanās".

5.pants

Konvencijas 20.panta 1.daļā vārdi "vai apstiprināšanas" ir jāaizstāj ar vārdiem "apstiprināšanas vai pievienošanās".

6.pants

1. Izteikt Konvencijas 23.panta ievadteikumu šādā redakcijā:

"Eiropas Padomes Ģenerālsekretārs paziņo Eiropas Padomes dalībvalstīm un jebkurai valstij, kura nav Eiropas Padomes dalībvalsts, bet ir šīs Konvencijas dalībvalsts par: "

2. Konvencijas 23.panta b. punktā vārdi "vai apstiprināšanu" ir jāaizstāj ar "apstiprināšanu vai pievienošanos".

7.pants

1. Šis Protokols ir atvērts parakstīšanai Eiropas Padomes dalībvalstīm, kuras ir parakstījušas Konvenciju izsakot savu piekrišanu būt saistītām :

a. to parakstot bez iebildumiem par ratifikāciju, pieņemšanu vai apstiprināšanu;

b. to parakstot un ratificējot, pieņemot vai apstiprinot, kam seko ratifikācija, pieņemšana vai apstiprināšana.

2. Ratifikācijas, pieņemšanas vai apstiprināšanas instrumenti ir jāiesniedz Eiropas Padomes Ģenerālsekretāram.

8.pants

Šis Protokols stājas spēkā ceturtā mēneša pirmajā dienā no dienas, kad visas Puses, kas parakstījušas šo Konvenciju, ir izteikušas piekrišanu būt saistītām ar Protokola nosacījumiem saskaņā ar 7.panta noteikumiem.

9.pants

Eiropas Padomes Ģenerālsekretārs paziņo Eiropas Padomes dalībvalstīm par:

a. katru parakstīšanu;

b. katru dokumentu, kas tiek iesniegts par ratifikāciju, pieņemšanu vai apstiprināšanu;

c. šī Protokola spēkā stāšanās datumu saskaņā ar 8.pantu;

d. jebkuru citu lēmumu, pieteikumu vai paziņojumu, kas attiecas uz šo Protokolu.

Apliecinot iepriekšminēto, apakšā parakstījušās, un attiecīgi uz to pilnvarotas, personas, ir parakstījušas šo Protokolu.

Parakstīts Strasbūrā 1993.gada 4.novembrī, angļu un franču valodā, abi teksti ir vienlīdz autentiski, vienā eksemplārā, kurš tiek nodots glabāšanā Eiropas Padomes arhīvos. Eiropas Padomes Ģenerālsekretārs nosūta apliecinātas kopijas visām Eiropas Padomes dalībvalstīm.

Protokols Nr.2 Eiropas konvencijai par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu

Valstis, kas parakstījušas šo Protokolu pie Eiropas Konvencijas "Par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu", kas parakstīta 1987.gada 26.novembrī Strasbūrā, (turpmāk-Konvencija),

Pārliecinātas par Eiropas Komitejas par spīdzināšanas vai necilvēcīgas un pazemojošas rīcības novēršanu (turpmāk - Komiteja) locekļu atkārtotas ievēlēšanas lietderību;

Apsverot nepieciešamību noteikt kārtību dalības atjaunošanai Komitejā,

Ir vienojušās par sekojošo:

1.pants

1. Izteikt 5.panta 3.daļas otro teikumu šādā redakcijā:

"Viņi var tikt atkārtoti ievēlēti divas reizes".

2. Konvencijas 5.pants ir jāpapildina ar sekojošu 4. un 5.daļu:

"(4) Lai iespēju robežās nodrošinātu, ka puse no Komitejas locekļu sastāva nomainās ik pēc diviem gadiem, Ministru Komiteja pirms uzsāk nākošās vēlēšanas var nolemt, ka pilnvaru termiņš vai termiņi vienam vai vairākiem ievēlamajiem locekļiem var būt četri gadi, bet tas nedrīkst būt ilgāks par sešiem un īsāks par diviem gadiem."

"(5) Gadījumos par vairāk nekā vienu pilnvaru laiku un, kad Ministru Komiteja piemēro šī panta 4.daļu, pilnvaru termiņus noskaidro ar izlozes palīdzību, ko veic Ģenerālsekretārs tūlīt pēc locekļu ievēlēšanas."

2.pants

1. Šis Protokols ir atvērts parakstīšanai valstīm, kuras ir parakstījušas vai pievienojušās Konvencijai, izsakot savu piekrišanu būt saistītām :

a. to parakstot bez iebildumiem par ratifikāciju, pieņemšanu vai apstiprināšanu;

b. ar parakstu, kurš ir pakļauts ratifikācijai, pieņemšanai vai apstiprināšanai, kam seko ratifikācija, pieņemšana vai apstiprināšana.

2. Ratifikācijas, pieņemšanas vai apstiprināšanas instrumenti ir jāiesniedz Eiropas Padomes Ģenerālsekretāram.

3.pants

Protokols stājas spēkā ceturtā mēneša pirmajā dienā no dienas, kad visas Konvencijas dalībvalstis būs izteikušas savu vēlmi uzskatīt to par saistošu saskaņā ar 2.panta nosacījumiem.

4.pants

Eiropas Padomes Ģenerālsekretārs paziņo Eiropas Padomes dalībvalstīm un citām valstīm, kas ir Konvencijas dalībvalstis par:

a. katru parakstīšanu;

b. katru dokumentu, kas tiek iesniegts par ratifikāciju, pieņemšanu vai apstiprināšanu;

c. šī Protokola spēkā stāšanās datumu saskaņā ar 3.pantu;

d. jebkuru citu lēmumu, pieteikumu vai paziņojumu, kas attiecas uz šo Protokolu.

Apliecinot iepriekšminēto, apakšā parakstījušās, un attiecīgi uz to pilnvarotas, personas ir parakstījušas šo Protokolu.

Parakstīts Strasbūrā 1993.gada 4.novembrī, angļu un franču valodā, abi teksti ir vienlīdz autentiski, vienā eksemplārā, kurš tiek nodots glabāšanā Eiropas Padomes arhīvos. Eiropas Padomes Ģenerālsekretārs nosūta apliecinātas kopijas visām Eiropas Padomes dalībvalstīm.
