Par Konvenciju par specializēto aģentūru privilēģijām un imunitātēm

1.pants. 1947.gada 21.novembra Konvencija par specializēto aģentūru privilēģijām un imunitātēm (turpmāk — Konvencija) ar šo likumu tiek pieņemta un apstiprināta.

2.pants. Konvencija tiek piemērota šādām specializētajām aģentūrām:

1) Starptautiskā darba organizācija;

2) Apvienoto Nāciju Organizācijas Pārtikas un lauksaimniecības organizācija;

3) Apvienoto Nāciju Organizācijas Izglītības, zinātnes un kultūras organizācija;

4) Starptautiskā civilās aviācijas organizācija;

5) Starptautiskais valūtas fonds;

6) Starptautiskā rekonstrukcijas un attīstības banka;

7) Pasaules veselības organizācija;

8) Pasaules pasta savienība;

9) Starptautiskā telekomunikāciju savienība;

10) Starptautiskā bēgļu organizācija;

11) Pasaules meteoroloģijas organizācija;

12) Starptautiskā jūrniecības organizācija;

13) Starptautiskā finanšu korporācija;

14) Starptautiskā attīstības asociācija;

15) Pasaules intelektuālā īpašuma organizācija;

16) Starptautiskais lauksaimniecības attīstības fonds.

3.pants. Konvencijā paredzēto saistību izpildi koordinē Ārlietu ministrija.

4.pants. Konvencija stājas spēkā tās 41.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

5.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināma Konvencija un tās pielikumi angļu valodā un Konvencijas un tās pielikumu tulkojums latviešu valodā.

CONVENTION ON THE PRIVILEGES AND IMMUNITIES OF THE SPECIALIZED AGENCIES

(Approved by the General Assembly of the United Nations on 21 November)

Final texts and revised texts of the annexes

(as approved by specialized agencies as at 1 April 2003)

Whereas the General Assembly of the United Nations adopted on 13 February 1946 a resolution contemplating the unification as far as possible of the privileges and immunities enjoyed by the United Nations and by the various specialized agencies; and

Whereas consultations concerning the implementation of the aforesaid resolution have taken place between the United Nations and the specialized agencies;

Consequently, by resolution 179(II) adopted on 21 November 1947 the General Assembly has approved the following Convention, which is submitted to the specialized agencies for acceptance and to every Member of the United Nations and to every other State member of one or more of the specialized agencies for accession.

Article I

DEFINITIONS AND SCOPE

Section 1

In this Convention:

(i) The words "standard clauses" refer to the provisions of articles II to IX.

(ii) The words "specialized agencies" mean:

(a) The International Labour Organization;

(b) The Food and Agriculture Organization of the United Nations;

(c) The United Nations Educational, Scientific and Cultural Organization;

(d) The International Civil Aviation Organization;

(e) The International Monetary Fund;

(f) The International Bank for Reconstruction and Development;

(g) The World Health Organization;

(h) The Universal Postal Union;

(i) The International Telecommunications Union; and

(j) Any other agency in relationship with the United Nations in accordance with Articles 57 and 63 of the Charter.

(iii) The word "Convention" means, in relation to any particular specialized agency, the standard clauses as modified by the final (or revised) text of the annex transmitted by that agency in accordance with sections 36 and 38.

(iv) For the purposes of article III, the words "property and assets" shall also include property and funds administered by a specialized agency in furtherance of its constitutional functions.

(v) For the purposes of articles V and VII, the expression "representatives of members" shall be deemed to include all representatives; alternates, advisers, technical experts and secretaries of delegations.

(vi) In sections 13, 14, 15 and 25, the expression "meetings convened by a specialized agency" means meetings: (1) of its assembly and of its executive body (however designated), and (2) of any commission provided for in its constitution; (3) of any international conference convened by it; and (4) of any committee of any of these bodies.

(vii) The term "executive head" means the principal executive official of the specialized agency in question, whether designated "Director-General" or otherwise.

Section 2

Each State party to this Convention in respect of any specialized agency to which this Convention has become applicable in accordance with section 37 shall accord to, or in connexion with, that agency the privileges and immunities set forth in the standard clauses on the conditions specified therein, subject to any modification of those clauses contained in the provisions of the final (or revised) annex relating to that agency and transmitted in accordance with sections 36 or 38.

Article II

JURIDICAL PERSONALITY

Section 3

The specialized agencies shall possess juridical personality. They shall have the capacity (a) to contract, (b) to acquire and dispose of immovable and movable property, (c) to institute legal proceedings.

Article III

PROPERTY, FUNDS AND ASSETS

Section 4

The specialized agencies, their property and assets, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process except in so far as in any particular case they have expressly waived their immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution.

Section 5

The premises of the specialized agencies shall be inviolable. The property and assets of the specialized agencies, wherever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action.

Section 6

The archives of the specialized agencies, and in general all documents belonging to them or held by them, shall be inviolable, wherever located.

Section 7

Without being restricted by financial controls, regulations or moratoria of any kind:

(a) The specialized agencies may hold funds, gold or currency of any kind and operate accounts in any currency;

(b) The specialized agencies may freely transfer their funds, gold or currency from one country to another or within any country and convert any currency held by them into any other currency.

Section 8

Each specialized agency shall, in exercising its rights under section 7 above, pay due regard to any representations made by the Government of any State party to this Convention in so far as it is considered that effect can be given to such representations without detriment to the interests of the agency.

Section 9

The specialized agencies, their assets, income and other property shall be:

(a) Exempt from all direct taxes; it is understood, however, that the specialized agencies will not claim exemption from taxes which are, in fact, no more than charges for public utility services;

(b) Exempt from customs duties and prohibitions and restrictions on imports and exports in respect of articles imported or exported by the specialized agencies for their official use; it is understood, however, that articles imported under such exemption will not be sold in the country into which they were imported except under conditions agreed to with the Government of that country;

(c) Exempt from duties and prohibitions and restrictions on imports and exports in respect of their publications.

Section 10

While the specialized agencies will not, as a general rule, claim exemption from excise duties and from taxes on the sale of movable and immovable property which form part of the price to be paid, nevertheless when the specialized agencies are making important purchases for official use of property on which such duties and taxes have been charged or are chargeable, States parties to this Convention will, whenever possible, make appropriate administrative arrangements for the remission or return of the amount of duty or tax.

Article IV

FACILITIES IN RESPECT OF COMMUNICATIONS

Section 11

Each specialized agency shall enjoy, in the territory of each State party to this Convention in respect of that agency, for its official communications, treatment not less favourable than that accorded by the Government of such State to any other Government, including the latter's diplomatic mission in the matter of priorities, rates and taxes on mails, cables, telegrams, radiograms, telephotos, telephone and other communications, and press rates for information to the press and radio.

Section 12

No censorship shall be applied to the official correspondence and other official communications of the specialized agencies.

The specialized agencies shall have the right to use codes and to dispatch and receive correspondence by courier or in sealed bags, which shall have the same immunities and privileges as diplomatic couriers and bags.

Nothing in this section shall be construed to preclude the adoption of appropriate security precautions to be determined by agreement between a State party to this Convention and a specialized agency.

Article V

REPRESENTATIVES OF MEMBERS

Section 13

Representatives of members at meetings convened by a specialized agency shall, while exercising their functions and during their journeys to and from the place of meeting, enjoy the following privileges and immunities:

(a) Immunity from personal arrest or detention and from seizure of their personal baggage, and in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;

(b) Inviolability for all papers and documents;

(c) The right to use codes and to receive papers or correspondence by courier or in sealed bags;

(d) Exemption in respect of themselves and their spouses from immigration restrictions, aliens' registration or national service obligations in the State which they are visiting or through which they are passing in the exercise of their functions;

(e) The same facilities in respect of currency or exchange restrictions as are accorded to representatives of foreign Governments on temporary official missions;

(f) The same immunities and facilities in respect of their personal baggage as are accorded to members of comparable rank of diplomatic missions.

Section 14

In order to secure for the representatives of members of the specialized agencies at meeting convened by them complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Section 15

Where the incidence of any form of taxation depends upon residence, periods during which the representatives of members of the specialized agencies at meetings convened by them are present in a member State for the discharge of their duties shall not be considered as periods of residence.

Section 16

Privileges and immunities are accorded to the representatives of members, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions in connexion with the specialized agencies. Consequently, a member not only has the right but is under a duty to waive the immunity of its representatives in any case where, in the opinion of the member, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Section 17

The provisions of sections 13, 14 and 15 are not applicable in relation to the authorities of a State of which the person is a national or of which he is or has been a representative.

Article VI

OFFICIALS

Section 18

Each specialized agency will specify the categories of officials to which the provisions of this article and of article VIII shall apply. It shall communicate them to the Governments of all States parties to this Convention in respect of that agency and to the Secretary-General of the United Nations. The names of the officials included in these categories shall from time to time be made known to the above-mentioned Governments.

Section 19

Officials of the specialized agencies shall:

(a) Be immune from legal process in respect of words spoken or written and all acts performed by them in their official capacity;

(b) Enjoy the same exemptions from taxation in respect of the salaries and emoluments paid to them by the specialized agencies and on the same conditions as are enjoyed by officials of the United Nations;

(c) Be immune, together with their spouses and relatives dependent on them, from immigration restrictions and alien registration;

(d) Be accorded the same privileges in respect of exchange facilities as are accorded to officials of comparable rank of diplomatic missions;

(e) Be given, together with their spouses and relatives dependent on them, the same repatriation facilities in time of international crises as officials of comparable rank of diplomatic missions;

(f) Have the right to import free of duty their furniture and effects at the time of first taking up their post in the country in question.

Section 20

The officials of the specialized agencies shall be exempt from national service obligations, provided that; in relation to the States of which they are nationals, such exemption shall be confined to officials of the specialized agencies whose names have, by reason of their duties, been placed upon a list compiled by the executive head of the specialized agency and approved by the State concerned.

Should other officials of specialized agencies be called up for national service, the State concerned shall, at the request of the specialized agency concerned, grant such temporary deferments in the call-up of such officials as may be necessary to avoid interruption in the continuation of essential work.

Section 21

In addition to the immunities and privileges specified in sections 19 and 20, the executive head of each specialized agency, including any official acting on his behalf during his absence from duty, shall be accorded in respect of himself, his spouse and minor children, the privileges and immunities, exemptions and facilities accorded to diplomatic envoys, in accordance with international law.

Section 22

Privileges and immunities are granted to officials in the interests of the specialized agencies only and not for the personal benefit of the individuals themselves. Each specialized agency shall have the right and the duty to waive the immunity of any official in any case where, in its opinion, the immunity would impede the course of justice and can be waived without prejudice to the interests of the specialized agency.

Section 23

Each specialized agency shall co-operate at all times with the appropriate authorities of member States to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuses in connexion with the privileges, immunities and facilities mentioned in this article.

Article VII

ABUSES OF PRIVILEGE

Section 24

If any State party to this Convention considers that there has been an abuse of a privilege or immunity conferred by this Convention, consultations shall be held between that State and the specialized agency concerned to determine whether any such abuse has occurred and, if so, to attempt to ensure that no repetition occurs. If such consultations fail to achieve a result satisfactory to the State and the specialized agency concerned, the question whether an abuse of a privilege or immunity has occurred shall be submitted to the International Court of Justice in accordance with section 32. If the International Court of Justice finds that such an abuse has occurred, the State party to this Convention affected by such abuse shall have the right, after notification to the specialized agency in question, to withhold from the specialized agency concerned the benefits of the privilege or immunity so abused.

Section 25

1. Representatives of members at meetings convened by specialized agencies, while exercising their functions and during their journeys to and from the place of meeting, and officials within the meaning of section 18, shall not be required by the territorial authorities to leave the country in which they are performing their functions on account of any activities by them in their official capacity. In the case, however, of abuse of privileges of residence committed by any such person in activities in that country outside his official functions, he may be required to leave by the Government of that country provided that:

2. (I) Representatives of members, or persons who are entitled to diplomatic immunity under section 21, shall not be required to leave the country otherwise than in accordance with the diplomatic procedure applicable to diplomatic envoys accredited to that country.

(II) In the case of an official to whom section 21 is not applicable, no order to leave the country shall be issued other than with the approval of the Foreign Minister of the country in question, and such approval shall be given only after consultation with the executive head of the specialized agency concerned; and, if expulsion proceedings are taken against an official, the executive head of the specialized agency shall have the right to appear in such proceedings on behalf of the person against whom they are instituted.

Article VIII

LAISSEZ-PASSER

Section 26

Officials of the specialized agencies shall be entitled to use the United Nations laissez-passer in conformity with administrative arrangements to be concluded between the Secretary-General of the United Nations and the competent authorities of the specialized agencies, to which agencies special powers to issue laissez-passer may be delegated. The Secretary-General of the United Nations shall notify each State party to this Convention of each administrative arrangements so concluded.

Section 27

States parties to this Convention shall recognize and accept the United Nations laissez-passer issued to officials of the specialized agencies as valid travel documents.

Section 28

Applications for visas, where required, from officials of specialized agencies holding United Nations laissez-passer, when accompanied by a certificate that they are travelling on the business of a specialized agency, shall be dealt with as speedily as possible. In addition, such persons shall be granted facilities for speedy travel.

Section 29

Similar facilities to those specified in section 28 shall be accorded to experts and other persons who, though not the holders of United Nations laissez-passer, have a certificate that they are travelling on the business of a specialized agency.

Section 30

The executive heads, assistant executive heads, heads of departments and other officials of a rank not lower than head of department of the specialized agencies, travelling on United Nations laissez-passer on the business of the specialized agencies, shall be granted the same facilities for travel as arc accorded to officials of comparable rank in diplomatic missions.

Article IX

SETTLEMENT OF DISPUTES

Section 31

Each specialized agency shall make provision for appropriate modes of settlement of:

(a) Disputes arising out of contracts or other disputes of private character to which the specialized agency is a party;

(b) Disputes involving any official of a specialized agency who by reason of his official position enjoys immunity, if immunity has not been waived in accordance with the provisions of section 22.

Section 32

All differences arising out of the interpretation or application of the present Convention shall be referred to the International Court of Justice unless in any case it is agreed by the parties to have recourse to another mode of settlement. If a difference arises between one of the specialized agencies on the one hand, and a member on the other hand, a request shall be made for an advisory opinion on any legal question involved in accordance with Article 96 of the Charter and Article 65 of the Statute of the Court and the relevant provisions of the agreements concluded between the United Nations and the specialized agency concerned. The opinion given by the Court shall be accepted as decisive by the parties.

Article X

ANNEXES AND APPLICATION TO INDIVIDUAL SPECIALIZED AGENCIES

Section 33

In their application to each specialized agency, the standard clauses shall operate subject to any modifications set forth in the final (or revised) text of the annex relating to that agency, as provided in sections 36 and 38.

Section 34

The provisions of the Convention in relation to any specialized agency must be interpreted in the light of the functions with which that agency is entrusted by its constitutional instrument.

Section 35

Draft annexes 1 to 9 are recommended to the specialized agencies named therein. In the case of any specialized agency not mentioned by name in section 1, the Secretary-General of the United Nations shall transmit to the agency a draft annex recommended by the Economic and Social Council.

Section 36

The final text of each annex shall be that approved by the specialized agency in question in accordance with its constitutional procedure. A copy of the annex as approved by each specialized agency shall be transmitted by the agency in question to the Secretary-General of the United Nations and shall thereupon replace the draft referred to in section 35.

The Convention shall not itself operate so as to abrogate, or derogate from, any provisions of the constitutional instrument of any specialized agency or any rights or obligations which the agency may otherwise have, acquire, or assume.

Section 37

The present Convention becomes applicable to each specialized agency when it has transmitted to the Secretary-General of the United Nations the final text of the relevant annex and has informed' him that it accepts the standard clauses, as modified by this annex, and undertakes to give effect to sections 8, 18, 22, 23, 24, 31, 32, 42 and 45 (subject to any modification of section 32 which may be found necessary in order to make the final text of the annex consonant with the constitutional instrument of the agency) and any provisions of the annex placing obligations on the agency. The Secretary-General shall communicate to all Members of the United Nations and to other States members of the specialized agencies certified copies of all annexes transmitted to him under this section and of revised annexes transmitted under section 38.

Section 38

If, after the transmission of a final annex under section 36, any specialized agency approves any amendments thereto in accordance with its constitutional procedure, a revised annex shall be transmitted by it to the Secretary-General of the United Nations.

Section 39

The provisions of this Convention shall in no way limit or prejudice the privileges and immunities which have been, or may hereafter be, accorded by any State to any specialized agency by reason of the location in the territory of that State of its headquarters or regional offices. This Convention shall not be deemed to prevent the conclusion between any State party thereto and any specialized agency of supplemental agreements adjusting the provisions of this Convention or extending or curtailing the privileges and immunities thereby granted.

Section 40

It is understood that the standard clauses, as modified by the final text of an annex sent by a specialized agency to the Secretary-General of the United Nations under section 36 (or any revised annex sent under section 38), will be consistent with the provisions of the constitutional instrument then in force of the agency in question, and that if any amendment to that instrument is necessary for the purpose of making the constitutional instrument so consistent, such amendment will have been brought into force in accordance with the constitutional procedure of that agency before the final (or revised) annex is transmitted.

Article XI

FINAL PROVISIONS

Section 41

Accession to this Convention by a Member of the United Nations and (subject to section 42) by any State member of a specialized agency shall be effected by deposit with the Secretary-General of the United Nations of an instrument of accession which shall take effect on the date of its deposit.

Section 42

Each specialized agency concerned shall communicate the text of this Convention together with the relevant annexes to those of its members which are not Members of the United Nations and shall invite them to accede thereto in respect of that agency by depositing an instrument of accession to this Convention in respect thereof either with the Secretary-General of the United Nations or with the executive head of the specialized agency.

Section 43

Each State party to this Convention shall indicate in its instrument of accession the specialized agency or agencies in respect of which it undertakcs to apply the provisions of this Convention. Each State party to this Convention may by a subsequent written notification to the Secretary-General of the United Nations undertake to apply the provisions of this Convention to one or more further specialized agencies. This notification shall take effect on the date of its receipt by the Secretary-General.

Section 44

This Convention shall enter into force for each State party to this Convention in respect of a specialized agency when it has become applicable to that agency in accordance with section 37 and the State party has undertaken to apply the provisions of the Convention to that agency in accordance with section 43.

Section 45

The Secretary General of the United Nations shall inform all Members of the United Nations, as well as all members of the specialized agencies, and executive heads of the specialized agencies, of the deposit of each instrument of accession received under section 41 and of subsequent notifications received under section 43. The executive head of a specialized agency shall inform the Secretary-General of the United Nations and the members of the agency concerned of tile deposit of any instrument of accession deposited with him under section 42.

Section 46

It is understood that, when an instrument of accession or a subsequent notification is deposited on behalf of any State, this State will be in a position under its own law to give effect to the terms of this Convention, as modified by the final texts of any annexes relating to the agencies covered by such accessions or notifications.

Section 47

1. Subject to the provisions of paragraphs 2 and 3 of this section, each State party to this Convention undertakes to apply this Convention in respect of each specialized agency covered by its accession or subsequent notification, until such time as a revised convention or annex shall have become applicable to that agency and the said State shall have accepted the revised convention or annex. In the case of a revised annex, the acceptance of States shall be by a notification addressed to the Secretary-General of the United Nations, which shall take effect on the date of its receipt by the Secretary-General.

2. Each State party to this Convention, however, which is not, or has ceased to be, a member of a specialized agency, may address a written notification to tile Secretary-General of the United Nations and the executive head of the agency concerned to the effect that it intends to withhold from that agency the benefits of this Convention as from a specified date, which shall not be earlier than three months from the date of receipt of the notification.

3. Each State party to this Convention may withhold the benefit of this Convention from any specialized agency which ceases to be in relationship with the United Nations.

4. The Secretary-General of the United Nations shall inform ail members States parties to this Convention of any notification transmitted to him under the provisions of this section.

Section 48

At the request of one-third of the States parties to this Convention, the Secretary-General of the United Nations will convene a conference with a view to its revision.

Section 49

The Secretary-General of the United Nations shall transmit copies of this Convention to each specialized agency and to the Government of each Member of the United Nations.

 

ANNEXES

Annex I

INTERNATIONAL LABOUR ORGANISATION

1. In their application to the International Labour Organisation the standard clauses shall operate subject to the following provisions:

Article V (other than paragraph (c) of section 13) and section 25, paragraphs 1 and 2 (a), of Article VII shall extend to the employers' and workers' members and deputy members of the Governing Body of the International Labour Office and their substitutes; except that any waiver of the immunity of any such person member under section 16 shall be by the Governing Body.

2. The privileges, immunities, exemptions and facilities referred to in Section 21 of the standard clauses shall also be accorded to any Deputy Director-General of the International Labour Office and any Assistant Director-General of the International Labour Office.

3. (i) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for, the Organisation shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent' on journeys in connection with service on such committees or missions:

(a) Immunity from personal arrest or seizure of their personal baggage;

(b) In respect of words spoken or written or acts done by them in the performance of their official functions, immunity of legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Organisation;

(c) The same facilities in respect of currency and exchange restrictions and in respect of their personal baggage as are accorded to officials of foreign Governments on temporary official missions;

(d) Inviolability of their papers and documents relating to the work on which they are engaged for the Organisation.

(ii) In connection with (d) of 3 (i) above, the principle contained in the last sentence of section 12 of the standard clauses shall be applicable.

(iii) Privileges and immunities are granted to the experts of the Organisation in the interests of the Organisation and not for the personal benefit of the individuals themselves. The Organisation shall have the right and the duty to waive the immunity of any expert in any case where in its opinion the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the Organisation.

Annex II

FOOD AND AGRICULTURE ORGANIZATION OF THE UNITED NATIONS

In their application to the Food and Agriculture Organization of the United Nations (hereinafter called "the Organization") the standard clauses shall operate subject to the following provisions:

1. Article V and section 25, paragraphs 1 and 2 (I) of article VII shall extend to the Chairman of the Council of the Organization and to the representatives of Associate Members, except that any waiver of the immunity of the Chairman under section 16 shall be by the Council of the Organization.

2. (i) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for, the Organization shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connection with service on such committees or missions;

(a) Immunity from personal arrest or seizure or their personal baggage;

(b) In respect of words spoken or written or acts done by them in the performance of their official functions, immunity of legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for the Organization;

(c) The same facilities in respect of currency and exchange restrictions and in respect of their personal baggage as are accorded to officials of foreign Governments on temporary official missions;

(d) Inviolability of their papers and documents relating to the work on which they are engaged for the Organization and, for the purpose of their communication with the Organization, the rights to use codes and to receive pates or correspondence by courier or in sealed bags.

(ii) In connection with (d) of 2 (i) above, the principle contained in the last sentence of section 12 of the standard clauses shall be applicable.

(iii) Privileges and immunities are granted to the experts in the interests of the Organization and not for the personal benefit of the individuals themselves. The Organization shall have the right and the duty to waive the immunity of any experts in any case where in its opinion the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the Organization.

3. The privileges, immunities, exemptions and facilities referred to in section 21 of the standard clauses shall also be accorded to any Deputy Director-General of the Organization and the Assistant Directors-General of the Organization.

Annex III

INTERNATIONAL CIVIL AVIATION ORGANIZATION

The standard clauses shall operate in respect to the International Civil Aviation Organization (hereinafter called "the Organization") subject to the following provisions:

1. The privileges, immunities, exemptions and facilities referred to in section 21 of the standard clauses shall also be accorded to the President of the Council of the Organization.

2. (i) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for, the Organization shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connexion with service on such committees or missions:

(a) Immunity from personal arrest or seizure of their personal baggage;

(b) Immunity from legal process of every kind in respect of words spoken or written or acts done by them in the performance of their official functions, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Organization;

(c) The same facilities in respect of currency and exchange restrictions and in respect of their personal baggage as are accorded to officials of foreign Governments on temporary official missions;

(d) Inviolability of their papers and documents relating to the work on which they are engaged for the Organization.

(ii) In connexion with (d) of 2 above, the principle contained in the last sentence of section 12 of the standard clauses shall be applicable.

(iii) Privileges and immunities are granted to the experts of the Organization in the interests of the Organization and not for the personal benefit of the individuals themselves. The Organization shall have the right and the duty to waive the immunity of any expert in any case where in its opinion the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the Organization.

Annex IV

UNITED NATIONS EDUCATIONAL, SCIENTIFIC AND CULTURAL ORGANIZATION

The standard clauses shall operate in respect to the United Nations Educational, Scientific and Cultural Organization (hereinafter called "the Organization") subject to the following provisions:

1. Article V and section 25, paragraphs 1 and 2 (I) of article VII shall extend to the President of the Conference and members of the Executive Board of the Organization, their substitutes and advisers except that any waiver of the immunity of any such person of the Executive Board under section 16, shall be by the Executive Board.

2. The Deputy Director-General of the Organization, his spouse and minor children shall also enjoy the privileges and immunities, exemptions and facilities accorded to diplomatic envoys in accordance with international law, which article VI, section 21, of the convention ensures to the executive head of each specialized agency.

3. (i) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for, the Organization shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connexion with service on such committees or missions:

(a) Immunity from personal arrest or seizure of their personal baggage;

(b) In respect of words spoken or written or acts done by them in the performance of their official functions, immunity of legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Organization;

(c) The same facilities in respect of currency and exchange restrictions and in respect of their personal baggage .as are accorded to officials of foreign Governments on temporary official missions.

(ii) Privileges and immunities are granted to the experts of the Organization in the interests of the Organization and not for the personal benefit of the individuals themselves. The Organization shall have the right and duty to waive the immunity of any expert in any case where in its opinion the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the Organization.

Annex V

INTERNATIONAL MONETARY FUND

In its application to the International Monetary Fund (hereinafter called "the Fund"), the convention (including this annex) shall operate subject to the following provisions:

1. Section 32 of the standard clauses shall only apply to differences arising out of the interpretation or application of privileges and immunities which are derived by the Fund solely from this convention and are not included in those which it can claim under its Articles of Agreement or otherwise.

2. The provisions of the convention (including this annex) do not modify or amend or require the modification or amendment of the Articles of Agreement of the Fund or impair or limit any of the rights, immunities, privileges or exemptions conferred upon the Fund or any of its members, Governors, Executive Directors, alternates, officers or employees by the Articles of Agreement of the Fund, or by any statute, lav or regulation of any member of the Fund or any political subdivision of any such member, or otherwise.

Annex VI

INTERNATIONAL BANK FOR RECONSTRUCTION AND DEVELOPMENT

In its application to the International Bank for Reconstruction and Development (hereinafter called the Bank), the convention (including this annex) shall operate subject to the following provisions:

1. The following shall be substituted for section 4:

"Actions may be brought against the Bank only in a court of competent jurisdiction in the territories of a member of the Bank in which the Bank has an office, has appointed an agent for the purpose of accepting service or notice of process, or has issued or guaranteed securities. No actions shall, however, be brought by members or persons acting for or deriving claims from members. The property and assets of the Bank shall, whosesoever located and by whomsoever held, be immune from all forms of seizure, attachment or execution before the delivery of final judgment against the Bank."

2. Section 32 of the standard clauses shall only apply to differences arising out of the interpretation or application of privileges and immunities which are derived by the Bank solely from this convention and are not included in those which it can claim under its Articles of Agreement or otherwise.

3. The provisions of the convention (including this annex) do not modify or amend or require the modification or amendment of the Articles of Agreement of the Bank or impair or limit any of the rights, immunities; privileges or exemptions conferred upon the Bank or any of its members, Governors, Executive Directors, alternates, officers or employees by the Articles of Agreement of the Bank or by any statute, law or regulation of any member of the Bank or any political subdivision of any such member, or otherwise.

Annex VII

WORLD HEALTH ORGANIZATION

In their application to the World Health Organization (hereinafter called "the Organization") the standard clauses shall operate subject to the following modifications:

1. Article V and section 25, paragraphs 1 and 2 (I) of article VII shall extend to persons designated to serve on the Executive Board of the Organization, their alternates and advisers, except that any waiver of the immunity of any such persons under section 16 shall be by the Board.

2. (i) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for, the Organization shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connexion with service on such committees or missions:

(a) Immunity from personal arrest or seizure of their personal baggage;

(b) In respect of words spoken or written or acts done by them in the performance of their official functions, immunity of legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Organization;

(c) The same facilities in respect of currency and exchange restrictions and in respect of their personal baggage as are accorded to officials of foreign Governments on temporary official missions;

(d) Inviolability for all papers and documents;

(e) The right to use codes and to receive documents and correspondence by courier or in sealed dispatch bags for their communications with the World Health Organization.

(ii) Privileges and immunities are granted to the experts of the Organization in the interests of the Organization and not for the personal benefit of the individuals themselves. The Organization shall have the right and the duty to waive the immunity of any expert in any case where in its opinion the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the Organization.

3. Article V and section 25, paragraph 1 and 2 (I) of article VII shall extend to the representatives of associate members participating in the work of the Organization in accordance with articles 8 and 47 of the Convention.

Annex VIII

UNIVERSAL POSTAL UNION

The standard clauses shall apply without modification.

Annex IX

INTERNATIONAL TELECOMMUNICATIONS UNION

The International Telecommunications Union has not yet transmitted the final text of the annex. Draft annex recommended by the General Assembly to this agency reads as follows: "The standards clauses shall apply without modification,"

Annex XII

INTERNATIONAL MARITIME ORGANIZATION

The privileges and immunities, exemptions and facilities referred to in article VI, section 21 of the standard clauses, shall be accorded to the Secretary-General of the Organization, to the Deputy Secretary-General, to the Secretary of the Maritime Safety Committee and to the Directors of the Administrative Division, the Technical Co-operation Division, the Legal Affairs and External Relations Division, the Conference Division and the Marine Environment Division, provided that the provisions of this paragraph shall not require the Member in whose territory the Organization has its Headquarters to apply article VI, section 21 of the standard clauses to any person who is its national. If the Organization changes the titles of any of the Director posts at any time, the holders for the time being of such posts shall continue to be accorded the privileges and immunities, exemptions and facilities referred to in this paragraph.

(a) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for, the Organization shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including time spent on journeys in connection with service on such committees or missions:

(i) immunity from personal arrest or seizure of their personal baggage;

(ii) in respect of words spoken or written or acts done by them in the performance of their official functions, immunity from legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Organization;

The Organization shall have the right and duty to waive the immunity of any expert in case where, in its opinion, the immunity would impede the course of justice and it can be waived without prejudice to the interests of the Organization

Annex XIII

INTERNATIONAL FINANCE CORPORATION

In its application to the International Finance Corporation (hereinafter called "the Corporation") the Convention (including this annex) shall operate subject to the following provisions:

1. The following shall be substituted for Section 4:

"Actions may be brought against the Corporation only in a court of competent jurisdiction in the territories of a member in which the Corporation has an office, has appointed an agent for the purpose of accepting service or notice of' process, or has issued or guaranteed securities. No actions shall, however, be brought by members or persons acting for or deriving claims from members. The property and assets of the Corporation shall, wheresoever located and by whomsoever held, be immune from all forms of seizure, attachment or execution before the delivery of final judgment against the Corporation."

2. Paragraph (b) of Section 7 of the standard clauses shall apply to the Corporation subject to Article III, Section 5 of the Articles of Agreement of the Corporation.

3. The Corporation in its discretion may waive any of the privileges and immunities conferred under Article VI of its Articles of Agreement to such extent and upon such conditions as it may determine.

4. Section 32 of the standard clauses shall only apply to differences arising out of the interpretation or application of privileges and immunities which are derived by the Corporation from this Convention and are not included in those which it can claim under its Articles of Agreement or otherwise.

5. The provisions of the Convention (including this annex) do not modify or amend or require the modification or amendment of the Articles of Agreement of the Corporation or impair or limit any of the rights, immunities, privileges or exemptions conferred upon the Corporation or any of its members, Governors, Executive Directors, Alternates, officers and employees by the Articles of Agreement of the Corporation, or by any statute, law or regulation of any member of the Corporation or any political subdivision of any such member, or otherwise.

Annex XIV

INTERNATIONAL DEVELOPMENT ASSOCIATION

In its application to the International Development Association (hereinafter called " the Association ") the Convention, including this annex, shall operate subject to the following provisions:

In their application to the World Intellectual Property Organization (hereinafter called "the Organization"), the standard clauses shall operate subject to the following modifications:

1. The privileges, immunities, exemptions and facilities referred to in article VI, section 21, of the standard clauses shall also be accorded to the Deputy Directors General of the Organization.

2. (a) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for, the Organization shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connexion with service on such committees or missions:

(i) immunity from personal arrest or seizure of their personal baggage;

(ii) in respect of words spoken or written or acts done by them in the performance of their official functions, immunity from legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Organization;

(iii) the same facilities in respect of currency and exchange restrictions and in respect of their personal baggage as are accorded to officials of foreign Governments on temporary official missions;

(iv) inviolability for all papers and documents relating to the work on which they are engaged for the Organization;

(v) for their communications with the Organization, the right to use codes and to receive documents and correspondence by courier or in sealed dispatch bags.

In connexion with (iv) and (v) above, the principle contained in the last sentence of section 12 of the standard clauses shall be applicable.

(b) Privileges and immunities are granted to the experts referred to in paragraph (a) above in the interests of the Organization and not for the personal benefit of the individuals themselves. In there application to the International Fund for Agricultural Development (hereinafter called "the Fund") the standard clauses shall operate subject to the following provisions:

1. The privileges, immunities, exemptions and facilities referred to in section 21 of the standard clauses shall also be accorded to any Vice-President of the Fund

2. (i) Experts (other than officials coming within the scope of article VI) serving on committees of, or performing missions for the Fund shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connection with service on such committees or missions:

(a) immunity from personal arrest or seizure of their personal baggage;

(b) in respect of words spoken or written or acts done by them in the performance of their official functions, immunity from legal process of every kind, such immunity to continue notwithstanding that the persons concerned are no longer serving on committees of, or employed on missions for, the Fund;

(c) the same facilities in respect of currency and exchange restrictions and in respect of their personal baggage as are accorded to officials of foreign governments on temporary official missions;

(d) inviolability of their papers and documents relating to the work on which they are engaged for the Fund and, for the purpose of their communications with the Fund, the right to use codes and to receive papers or correspondence by courier or in sealed bags

(ii) In connection with (d) of 2 (i) above, the principle contained in the last sentence of section 12 of the standard clauses shall be applicable.

(a) Experts (other than officials coming within the scope of article VI) serving as committees of, or performing missions for, the Organization shall be accorded the following privileges and immunities so far as is necessary for the effective exercise of their functions, including the time spent on journeys in connection with service on such committees or missions:

(i) Immunity from personal arrest or seizure of their personal baggage;

(ii) In respect of words spoken or written or acts done by them in the performance of their official functions, immunity from legal process of every kind, such immunity to continue notwithstanding that the person concerned is no longer serving on committees of, or employed on missions for, the Organization;

(iii) The same facilities in respect of currency and exchange restrictions and in respect of their personal baggage as are accorded to officials of foreign Governments on temporary official missions;

(iv) inviolability for all papers and documents;

(v) For their communications with the Organization, the right to use codes and to receive documents and correspondence by courier or in sealed bags;

(b) In connection with subparagraphs (iv) and (v) of paragraph 1 (a) above, the principle contained in the last sentence of section 12 of the standard clauses shall be applicable;

(c) Privileges and immunities are granted to experts of the Organization in the interests of the Organization and not for the personal benefit of the individuals themselves. The Organization shall have the right and the duty to waive the immunity of any expert in any case where in its opinion the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the Organization.

2. The privileges, immunities, exemptions and facilities referred to in section 21 of the standard clauses shall also be accorded to any Deputy Director-General of the Organization.

Ievērojot, ka 1946. gada 13. februārī Apvienoto Nāciju Organizācija pieņēma rezolūciju ar mērķi, cik vien iespējams, unificēt imunitātes un privilēģijas, kuras bauda Apvienoto Nāciju Organizācija un dažādas specializētās aģentūras; un

Ievērojot, ka starp Apvienoto Nāciju Organizāciju un specializētajām aģentūrām ir notikušas konsultācijas par augstākminētās rezolūcijas ieviešanu;

Tādējādi ar 1947. gada 21. novembrī pieņemto rezolūciju 179(II) Apvienoto Nāciju Organizācijas Ģenerālā Asambleja ir apstiprinājusi šo Konvenciju, kas ir iesniegta specializētajām aģentūrām, lai tās apstiprinātu šo Konvenciju, un ikvienai Apvienoto Nāciju Organizācijas dalībvalstij, kā arī ikvienai valstij, kas ir dalībvalsts vienā vai vairākās specializētajās aģentūrās, lai tās pievienotos šai Konvencijai.

I nodaļa

Definīcijas un mērķis

1. pants

Šajā Konvencijā:

(i) Termins "standarta noteikumi" attiecas uz II līdz IX pantos minētajiem noteikumiem.

(ii) Termins "specializētās aģentūras" nozīmē:

(a) Starptautisko darba organizāciju;

(b) Apvienoto Nāciju Organizācijas Pārtikas un lauksaimniecības organizāciju;

(c) Apvienoto Nāciju Organizācijas Izglītības, zinātnes un kultūras organizāciju;

(d) Starptautisko civilās aviācijas organizāciju;

(e) Starptautisko valūtas fondu;

(f) Starptautisko rekonstrukcijas un attīstības banku;

(g) Pasaules veselības organizāciju;

(h) Pasaules pasta savienību;

(i) Starptautisko telekomunikāciju savienību;

(j) Jebkuru citu aģentūru, kas ir saistīta ar Apvienoto Nāciju Organizāciju saskaņā ar Apvienoto Nāciju Organizācijas Statūtu 57. un 63. pantu.

(iii) Termins "Konvencija" attiecībā uz jebkuru specializēto aģentūru nozīmē standarta noteikumus kopā ar grozījumiem, kas izdarīti ar galīgo (vai pārskatīto) pielikuma tekstu, un kurus specializētā aģentūra iesniegusi saskaņā ar 36. vai 38. punktu;

(iv) III panta izpratnē termins "īpašumi un aktīvi" ietver arī īpašumu un naudas līdzekļus, kurus pārvalda specializētā aģentūra tās Dibināšanas līgumā noteikto funkciju izpildei;

(v) V un VII panta izpratnē termins "dalībvalstu pārstāvji" ietver visus delegāciju vadītājus, vietniekus, padomniekus, tehniskos ekspertus un sekretārus;

(vi) 13., 14., 15. un 25. punktā termins "sanāksmes, ko sasauc specializētā aģentūra" nozīmē: (1) to asambleju vai izpildinstitūciju (neatkarīgi no to nosaukuma) sanāksmes; (2) jebkuras to Dibināšanas līgumos noteikto komisiju sanāksmes; (3) jebkuru starptautisku konferenci, ko tās sasauc; (4) jebkuru to komiteju sanāksmi.

(vii) Termins "izpildinstitūcijas vadītājs" nozīmē attiecīgās specializētās aģentūras galveno izpildinstitūcijas amatpersonu (Ģenerālsekretārs vai cita amatpersona, kas atbilst iepriekšminētajai definīcijai)

2. pants

(i) Katra šīs Konvencijas dalībvalsts attiecībā pret jebkuru specializēto aģentūru, kurai šī Konvencija ir kļuvusi piemērojama saskaņā ar 37. punktu, piemēro attiecībā uz vai saistībā ar šo aģentūru privilēģijas un imunitātes, kuras ir noteiktas standarta noteikumos ar nosacījumiem, kādi tajos ir ietverti kopā ar grozījumiem, kas izdarīti ar galīgo (vai pārskatīto) pielikuma tekstu, un kurus specializētā aģentūra iesniegusi saskaņā ar 36. vai 38. punktu;

II nodaļa

Juridiskās personas tiesībspēja

3. pants

Speciālajām aģentūrām ir jābūt juridiskās personas tiesībspējai. Tām ir jābūt tiesībspējai (a) slēgt līgumus, (b) iegūt vai pārdot kustamo un nekustamo īpašumu, (c) vērsties ar prasību tiesā.

III nodaļa

Īpašums, naudas līdzekļi un aktīvi

4. pants

Specializētās aģentūras, to īpašumi un aktīvi, lai kur tie atrastos un lai kā pārvaldījumā tie būtu, bauda imunitāti pret jebkāda veida tiesvedību, izņemot gadījumus, kad tās kādā konkrētā gadījumā ir skaidri un nepārprotami atteikušās no šādas imunitātes. Šāda atteikšanās neattiecas uz tiesas nolēmuma izpildi.

5. pants

Specializēto aģentūru telpas ir neaizskaramas. Specializēto aģentūru īpašums un aktīvi, lai kur tie atrastos un lai kā pārvaldījumā tie būtu, bauda imunitāti pret kratīšanu, rekvizīciju, konfiskāciju, ekspropriāciju vai cita veida aizskārumiem, kas ir saistīti ar dalībvalsts izpildvaras, administratīvās, tiesu vai likumdevējvaras iestāžu rīcību.

6. pants

Specializēto aģentūru arhīvi un visi dokumenti, kas tām pieder vai ir to valdījumā, ir neaizskarami, lai arī kur tie atrastos.

7. pants

Bez finanšu kontroles ierobežojumiem vai cita veida noteikumiem un ierobežojumiem:

(a) Specializētā aģentūra var pārvaldīt naudas līdzekļus, zeltu vai jebkura veida valūtu un rīkoties ar rēķiniem jebkurā valūtā;

(b) Specializētās aģentūras var brīvi pārvest savus naudas līdzekļus, zeltu vai valūtu no vienas valsts uz otru vai jebkuras valsts robežās un konvertēt jebkuru valūtu, kas ir to valdījumā.

8. pants

Ikviena specializētā aģentūra īstenojot 7. punktā noteiktās tiesības, ievēro jebkuras šīs Konvencijas dalībvalsts valdības izvirzītas prasības tiktāl, cik šādu prasību ievērošana neierobežo aģentūras intereses.

9. pants

Specializētās aģentūras, to aktīvi, ienākumi un citi īpašumi tiek:

(a) atbrīvoti no visiem tiešajiem nodokļiem, tomēr specializētās aģentūras nevar prasīt, lai tās tiktu atbrīvotas no nodokļiem, kas faktiski nav nekas vairāk kā maksa par komunālajiem pakalpojumiem;

(b) atbrīvoti no muitas nodevām, kā arī importa vai eksporta aizliegumiem un ierobežojumiem attiecībā uz precēm, kuras specializētās aģentūras importē vai eksportē savai oficiālai lietošanai, tomēr preces, kas tiek importētas iepriekšminētajā kārtībā, nedrīkst tikt pārdotas valstī, uz kuru tās tika importētas, izņemot gadījumus, kad tās tiek pārdotas saskaņā ar nosacījumiem, par kuriem ir panākta vienošanās ar šīs valsts valdību;

(c) atbrīvoti no nodevām un importa un eksporta aizliegumiem attiecībā uz to publikācijām.

10. pants

Specializētajām aģentūrām nav tiesību prasīt atbrīvojumu no akcīzes nodevām un no nodokļiem par kustamā vai nekustamā īpašuma pārdošanu, kas veido daļu no maksājuma cenas. Tomēr, ja specializētā aģentūra veic svarīgus iepirkumus īpašuma oficiālai lietošanai, par kuru ir samaksātas nodevas un nodokļi vai tie ir jāmaksā, šīs Konvencijas dalībvalstis, ja vien tas ir iespējams, apņemas veikt attiecīgus administratīvus pasākumus nodevas vai nodokļa atmaksāšanai vai atdošanai.

IV nodaļa

Sakaru nodrošināšana

11. pants

Ikviena specializētā aģentūra Konvencijas dalībvalsts teritorijā bauda tādu pašu attieksmi attiecībā uz tās oficiālajiem sakariem, kādu dalībvalsts valdība attiecina uz jebkuras citas valsts valdību un tās diplomātiskajām pārstāvniecībām priekšrocību, likmju un nodokļu sfērā attiecībā uz pastu, starptautiskajām telegrammām, telegrammām, telefona un citiem sakariem, kā arī informācijas apjomu presei un radio.

12. pants

Specializēto aģentūru oficiālā korespondence un citi oficiālie paziņojumi netiek cenzēti.

Specializētajām aģentūrām ir tiesības uzmantot kodus, kā arī nosūtīt un saņemt korespondenci ar kurjeru vai aizzīmogotās kurjersomās, kas bauda tādas pašas privilēģijas un imunitātes kā diplomātiskie kurjeri un kurjersomas.

Nekas šajā punktā nevar tikt interpretēts tādējādi, lai neļautu veikt atbilstošus drošības pasākumus, kas ir atrunāti līgumā starp šīs Konvencijas dalībvalsti un specializēto aģentūru.

V nodaļa

Dalībvalstu pārstāvji

13. pants

Dalībvalstu pārstāvjiem specializēto aģentūru sasauktajās sanāksmēs, pildot savas funkcijas, kā arī brauciena laikā uz vai no sanāksmes vietas, ir šādas privilēģijas un imunitātes:

(a) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju, kā arī pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros;

(b) visu dokumentu un materiālu neaizskaramība;

(c) tiesības izmantot kodus un saņemt dokumentus vai korespondenci ar kurjeru vai aizzīmogotās kurjersomās;

(d) dalībvalstu pārstāvji un to laulātie ir atbrīvojami no imigrācijas ierobežojumiem, ārvalstnieku reģistrācijas vai nacionālā dienesta pienākuma valstī, kuru tie apmeklē, vai kuru tie šķērso, veicot savas funkcijas;

(e) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kādas tiek piešķirtas ārvalstu valdību pārstāvjiem īslaicīgu oficiālu vizīšu laikā;

(f) tādas pašas imunitātes un priekšrocības attiecībā uz to personisko bagāžu, kādas tiek piešķirtas pielīdzināma līmeņa diplomātiskajiem aģentiem.

14. pants

Lai nodrošinātu specializētās aģentūras dalībvalstu pārstāvjiem tās sasauktajās sanāksmēs pilnīgu vārda brīvību un neatkarību savu pienākumu izpildē, imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie veikuši savu oficiālo pilnvaru ietvaros, tiek arī turpmāk nodrošināta, neskatoties uz to, ka minētās personas vairs nav iesaistītas šo pienākumu izpildē.

15. pants

Ja jebkāda aplikšana ar nodokļiem ir atkarīga no uzturēšanās ilguma, par uzturēšanās laiku netiek uzskatīti laika posmi, kuros specializēto aģentūru dalībvalstu pārstāvji atrodas dalībvalstī, lai pildītu savus pienākumus specializētās aģentūras sasauktajās sanāksmēs.

16. pants

Privilēģijas un imunitātes dalībvalstu pārstāvjiem tiek piešķirtas ne pašu indivīdu personiskajam labumam, bet gan lai nodrošinātu to funkciju neatkarīgu izpildi saistībā ar specializētajām aģentūrām. Tādējādi dalībvalstij ir ne tikai tiesības, bet pat pienākums atsaukt tās pārstāvju imunitāti, ja dalībvalsts uzskata, ka šīs imunitātes varētu kavēt tiesvedību, un ja tās var tikt atceltas, nekaitējot mērķim, kādam tās ir piešķirtas.

17. pants

13., 14., un 15. punkta noteikumi nav piemērojami attiecībās starp tās valsts varas iestādēm, kuras pilsonis pārstāvis ir, vai kuras pārstāvis tas ir vai ir bijis.

VI nodaļa

Amatpersonas

18. pants

Ikviena specializētā aģentūra nosaka amatpersonu kategorijas, uz kurām attiecas šī panta un VIII. panta noteikumi. Tā paziņo amatpersonu kategorijas visu valstu valdībām, kas ir šīs Konvencijas dalībvalstis attiecībā uz to, un Apvienoto Nāciju Organizācijas Ģenerālsekretāram. Šajās kategorijās iekļauto amatpersonu vārdi tiek regulāri paziņoti augstākminētajām valdībām.

19. pants

Specializēto aģentūru amatpersonas:

(a) bauda imunitāti pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros;

(b) ir atbrīvojamas no visa veida aplikšanas ar nodokļiem attiecībā uz algām un ienākumiem, kurus tām maksā specializētā aģentūra, tādā pašā kārtībā kā Apvienoto Nāciju Organizācijas amatpersonas;

(c) kopā ar saviem laulātajiem un personām, kas ir to apgādībā, bauda imunitāti pret imigrācijas ierobežojumiem un ārvalstnieku reģistrāciju;

(d) bauda tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kādas tiek piešķirtas pielīdzināma līmeņa diplomātisko misiju amatpersonām;

(e) kopā ar to laulātajiem un personām, kas ir to apgādībā, bauda tādas pašas repatriācijas iespējas starptautisko krīžu laika kā pielīdzināma līmeņa diplomātisko misiju amatpersonas;

(f) drīkst bez nodevām ievest valstī savas mēbeles un tiem piederošas lietas laikā, kad tie pirmoreiz stājas pie sava amata pienākumu pildīšanas.

20. pants

Specializēto aģentūru amatpersonas ir atbrīvotas no nacionālā dienesta pienākumiem, nosakot, ka attiecībā uz valstīm, kuru pilsoņi tie ir, šāds atbrīvojums tiek attiecināts uz specializēto aģentūru amatpersonām, ja to vārdi sakarā ar pienākumu pildīšanu ir tikuši iekļauti specializētas aģentūras vadītāja sastādītā sarakstā, kuru ir apstiprinājusi attiecīgās valsts valdība.

Ja pārējās specializēto aģentūru amatpersonas tiek iesauktas nacionālā dienestā, attiecīgā valsts pēc attiecīgās specializētās aģentūras lūguma uz laiku atliek to amatpersonu iesaukšanu dienestā, kas ir nepieciešamas, lai izvairītos no pamatdarba pārtraukšanas.

21. pants

Papildus 19. un 20. punktā minētajām privilēģijām un imunitātēm ik vienas specializētās aģentūras vadītājam, tai skaitā jebkurai amatpersonai, kura viņu aizvieto prombūtnes laikā, viņa laulātajam un nepilngadīgajiem bērniem tiek piešķirtas privilēģijas un imunitātes, atbrīvojumi un priekšrocības, kas tiek piešķirtas diplomātiskajiem sūtņiem saskaņā ar starptautiskajām tiesībām.

22. pants

Privilēģijas un imunitātes tiek piešķirtas amatpersonām vienīgi specializēto aģentūru interesēs un nevis pašu indivīdu personiskajam labumam. Ikvienai specializētai aģentūrai ir tiesības un pienākums atcelt jebkuras amatpersonas imunitāti gadījumā, ja pēc tās viedokļa imunitāte varētu kavēt tiesvedību, un no tās var attiekties, nekaitējot specializētās aģentūras interesēm.

23. pants

Ikvienai specializētai aģentūrai ir jāsadarbojas ar dalībvalstu attiecīgajām varas iestādēm, lai veicinātu atbilstošu tiesvedību, nodrošinātu kārtības noteikumu ievērošanu un novērstu jebkuru pārkāpumu izdarīšanu sakarā ar šajā pantā minētajām privilēģijām, imunitātēm un priekšrocībām.

VII nodaļa

Privilēģiju ļaunprātīga izmantošana

24. pants

Ja kāda šīs Konvencijas dalībvalsts uzskata, ka ir tikušas ļaunprātīgi izmantotas privilēģijas vai imunitātes, kas ir piešķirtas ar šo Konvenciju, starp šo valsti un attiecīgo specializēto aģentūru notiek konsultācijas, lai noteiktu, vai ļaunprātība ir notikusi, un, ja tā ir notikusi, lai mēģinātu nodrošināt notikušā neatkārtošanos. Ja šādas konsultācijas nesniedz vēlamo rezultātu, kas apmierina konkrēto valsti un specializēto aģentūru, jautājums, vai ir notikusi ļaunprātīga privilēģiju un imunitāšu izmantošana, saskaņā ar Konvencijas 32. punktu, tiek nodots Starptautiskajai tiesai. Ja Starptautiskā tiesa konstatē, ka šāda ļaunprātība ir notikusi, ieinteresētai dalībvalstij ir tiesības pēc specializētās aģentūras informēšanas atcelt šīs specializētās aģentūras ļaunprātīgi izmantotās privilēģijas.

25. pants

1. Dalībvalstu pārstāvjiem sanāksmēs, kuras ir sasaukušas specializētās aģentūras, savu funkciju izpildes laikā, kā arī brauciena laikā uz vai no sanāksmes vietas, kā arī amatpersonām 18. punkta izpratnē, vietējās varas iestādes nevar pieprasīt atstāt valsti, kurā tie veic savas funkcijas saistībā ar jebkādām darbībām, kuras tie veic savu oficiālo pienākumu ietvaros. Tomēr, ja šī persona ir ļaunprātīgi izmantojusi uzturēšanās privilēģijas, veicot valstī darbības, kas neietilpst personas oficiālajos pienākumos, attiecīgās valsts valdība var prasīt, lai persona atstāj valsti, ar nosacījumu, ka:

2. (I) Dalībvalstu pārstāvjiem vai personām, kam ir tiesības uz diplomātisko imunitāti saskaņā ar 21. punktu, netiek izvirzītas prasības atstāt valsti citāti, kā vien saskaņā ar diplomātisko procedūru, kāda tiek piemērota diplomātiskajiem sūtņiem, kas ir akreditēti šajā valstī.

(II) Attiecībā uz amatpersonām, kurām nav piemērojams 21. pants nav piemērojams, pavēle atstāt valsti tiek izdota vienīgi ar attiecīgās valsts ārlietu ministra apstiprinājumu. Šādu apstiprinājumu var izdot vienīgi pēc konsultācijām ar attiecīgās specializētās aģentūras vadītāju un, ja attiecībā uz šo personu tiek veikta izraidīšanas procedūra, specializētās aģentūras vadītājam ir tiesības pārstāvēt šo personu tās vārdā šīs procedūras laikā.

VIII nodaļa

Laissez-passer

26. pants

Specializēto aģentūru amatpersonām ir tiesības izmantot Apvienoto Nāciju Organizācijas piešķirto laissez-passer saskaņā ar administratīvo vienošanos, kas ir noslēgta starp Apvienoto Nāciju Organizācijas Ģenerālsekretāru un specializēto aģentūru kompetentajām iestādēm, kurām var tikt deleģētas tiesības piešķirt laissez-passer. Apvienoto Nāciju Organizācijas Ģenerālsekretārs paziņo ikvienai šīs Konvencijas dalībvalstij par katru šāda veidā noslēgtu vienošanos.

27. pants

Šīs Konvencijas dalībvalstis atzīst un pieņem Apvienoto Nāciju Organizācijas specializēto aģentūru amatpersonām izdoto laissez-passer kā derīgu ceļošanas dokumentu.

28. pants

Specializēto aģentūru amatpersonu, kurām ir izdots Apvienoto Nāciju Organizācijas laissez-passer, vīzu pieprasījumi, ja tādi ir nepieciešami, un tiem klāt ir pievienots apliecinājums, ka amatpersonas ceļo specializēto aģentūru uzdevumā, tiek izskatīti pēc iespējas ātrāk. Papildus tam šādām personām tiek nodrošinātas iespējas ceļot bez aizkavēšanās.

29. pants

Ekspertiem un citām personām, kas, lai gan nav saņēmušas Apvienoto Nāciju Organizācijas izdoto laissez-passer, bet kurām ir apliecinājums, ka tās ceļo specializētās aģentūras uzdevumā, tiek nodrošinātas tādas pašas priekšrocības, kādas ir noteiktas Konvencijas 28.punktā.

30. pants

Izpildinstitūciju vadītāji, to vietnieki, departamentu vadītāji un citas amatpersonas, kuru rangs nav zemāks par specializēto aģentūru departamenta vadītāja rangu, kas ceļo ar Apvienoto Nāciju Organizācijas laissez-passer specializēto aģentūru uzdevumā, tiek nodrošinātas tādas pašas priekšrocības ceļojuma laikā, kā pielīdzināma ranga amatpersonām diplomātiskajās misijās.

IX nodaļa

Strīdu izšķiršana

31. pants

Ikviena specializētā aģentūra paredz atbilstošu strīdu izšķiršanu procedūru:

(a) Kas rodas sakarā ar privāttiesiskiem līgumiem vai citiem privāttiesiskiem strīdiem, kuros aģentūra ir viena no iesaistītajām pusēm;

(b) Kuros ir iesaistītas specializēto aģentūru amatpersonas, kas sava oficiāla amata dēļ bauda imunitāti, ja vien tā nav atcelta saskaņā ar Konvencijas 22. punkta noteikumiem.

32. pants

Visas domstarpības, kas rodas šīs Konvencijas interpretācijas vai piemērošanas sakarā, tiek nodotas Starptautiskajai tiesai, ja vien puses nav vienojušās par citu strīdu izšķiršanas veidu. Ja domstarpības rodas starp kādu no specializētajām aģentūrām un dalībvalsti, tiek sagatavots pieprasījums par konsultatīvo viedokli par jebkuru juridisku jautājumu saskaņā ar Apvienoto Nāciju Organizācijas Statūtu 96. pantu un Starptautiskās tiesas Statūtu 65. pantu, kā arī attiecīgajiem noteikumiem līgumos, kas noslēgti starp Apvienoto Nāciju Organizāciju un attiecīgo specializēto aģentūru. Puses pieņem Starptautiskās tiesas atzinumu par izšķirošu.

X nodaļa

Pielikumi un piemērošana atsevišķām specializētajām aģentūrām

33. pants

Attiecībā uz ikvienu specializēto aģentūru, standarta noteikumi tiek piemēroti, ievērojot izmaiņas, kas norādītas galīgajā vai pārstrādātajā tekstā, kas attiecas uz šo aģentūru, kā noteikts 36. un 38. punktā.

34. pants

Konvencijas noteikumi attiecībā uz jebkuru specializēto aģentūru ir interpretējami kontekstā ar funkcijām, kuras ir paredzētas tās dibināšanas dokumentos.

35. pants

I līdz IX pielikuma projekts tiek ieteikts tajos minētajām specializētajām aģentūrām. Ja kāda no specializētajām aģentūrām nav minēta Konvencijas 1. punktā, Apvienoto Nāciju Organizācijas Ģenerālsekretārs nosūta aģentūrai Ekonomiskās un sociālās padomes ieteikto pielikuma projektu.

36. pants

Ikviena pielikuma galīgo tekstu apstiprina attiecīgā specializētā aģentūra saskaņā ar tās dibināšanas dokumentos noteikto kārtību. Pielikuma eksemplāru, kuru apstiprinājusi specializētā aģentūra nosūta Apvienoto Nāciju Organizācijas Ģenerālsekretāram, aizvietojot 35. punktā minēto projektu.

37. pants

Šī konvencija tiek piemērota attiecībā uz ikvienu specializēto aģentūru, kad tā ir nodevusi Apvienoto Nāciju Organizācijas Ģenerālsekretāram attiecīgā pielikuma galīgo tekstu un ir to informējusi, ka pieņem standarta noteikumus ar pielikumā izdarītajiem grozījumiem, kā arī apņemas nodrošināt 8., 18., 22,, 23., 24., 31., 32., 42. un 45. punktu spēkā stāšanos (ar jebkuriem 32. punkta grozījumiem, kas var tikt uzskatīti par nepieciešamiem, lai nodrošinātu pielikuma galīgā teksta atbilstību aģentūras dibināšanas dokumentiem) un jebkuru pielikuma noteikumu, kas nosaka aģentūras pienākumus, spēkā stāšanos. Ģenerālsekretārs nosūta visām Apvienoto Nāciju Organizācijas dalībvalstīm un citām valstīm, kuras ir specializēto aģentūru dalībvalstis, visus tam nosūtīto pielikumu apstiprinātus eksemplārus, kā arī pārskatīto pielikumu eksemplārus, kas nodoti saskaņā ar 38. punktu, saskaņā ar šo paragrāfu.

38. pants

Ja pēc galīgā pielikuma nodošanas saskaņā ar 36. punktu kāda specializētā aģentūra pieņem tajos jebkādus grozījumus saskaņā ar tās dibināšanas dokumentos noteikto kārtību, tā nosūta pārskatīto pielikumu Apvienoto Nāciju Organizācijas Ģenerālsekretāram.

39. pants

Šīs Konvencijas noteikumi nekādā veidā neierobežo privilēģijas un imunitātes, kuras kāda valsts ir piešķīrusi vai vēlāk piešķir jebkurai specializētai aģentūrai sakarā ar tās galvenās mītnes vai reģionālā biroja atrašanos šīs valsts teritorijā. Šī Konvencija nekādā veidā neaizliedz papildus līguma noslēgšanu starp šis Konvencijas dalībvalsti un jebkuru specializēto aģentūru, pielāgojot šīs Konvencijas noteikumus, paplašinot vai sašaurinot tajā noteiktās privilēģijas un imunitātes.

40. pants

Tiek uzskatīts, ka standarta noteikumi ar pielikuma teksta grozījumiem, kuru specializētā aģentūra nosūtījusi Apvienoto Nāciju Organizācijas Ģenerālsekretāram saskaņā ar 36. punktu (vai jebkurš cits pārskatīts pielikums, kas nosūtīts saskaņā ar 38. punktu), atbilst attiecīgās aģentūras tai brīdī spēkā esošajiem dibināšanas dokumentiem. Ja ir nepieciešams izdarīt jebkādus grozījumus dibināšanas dokumentos, lai nodrošinātu šādu atbilstību, izdarītajiem grozījumiem ir jāstājas spēkā saskaņā ar attiecīgās aģentūras dibināšanas dokumentos noteikto kārtību pirms galīgā (vai pārskatītā) pielikuma nosūtīšanas.

XI nodaļa

Noslēguma noteikumi

41. pants

Apvienoto Nāciju Organizācijas dalībvalstis un (saskaņā ar 42. punktu) jebkura valsts, kas ir kādas specializētās aģentūras dalībvalsts, var pievienoties šai Konvencijai, iesniedzot Apvienoto Nāciju Organizācijas Ģenerālsekretāram pievienošanās dokumentu, kas kļūst saistošs ar iesniegšanas brīdi.

42. pants

Ikviena specializētā aģentūra nosūta šīs Konvencijas tekstu kopā ar attiecīgajiem pielikumiem tām aģentūras dalībvalstīm, kuras nav Apvienoto Nāciju Organizācijas dalībvalstis, un uzaicina tās pievienoties Konvencijai attiecībā pret šo aģentūru, iesniedzot pievienošanās dokumentu šai Konvencijai Apvienoto Nāciju Organizācijas Ģenerālsekretāram vai specializētās aģentūras vadītājam.

43. pants

Ikviena šīs Konvencijas dalībvalsts savā pievienošanās dokumentā norāda, specializēto aģentūru vai aģentūras, uz kurām tā attiecinās šīs Konvencijas noteikumus. Ikviena šīs Konvencijas dalībvalsts var jebkurā laikā iesniegt rakstisku paziņojumu Apvienoto Nāciju Organizācijas Ģenerālsekretāram, ar kuru tā apņemas piemērot šīs Konvencijas noteikumus vienai vai vairākām specializētajām aģentūrām. Paziņojums stājas spēkā dienā, kad to saņem ANO Ģenerālsekretārs.

44. pants

Šī Konvencija stājas spēkā ikkatrai tās dalībvalstij attiecībā uz kādu specializēto aģentūru, kad tā ir kļuvusi piemērojama attiecībā uz šo aģentūru saskaņā ar Konvencijas 37. punktu un dalībvalsts ir apņēmusies piemērot Konvencijas noteikumus attiecību uz aģentūru saskaņā ar 43. punktu.

45. pants

Apvienoto Nāciju Organizācijas Ģenerālsekretārs informē visas Apvienoto Nāciju Organizācijas dalībvalstis, kā arī specializēto aģentūru dalībvalstis un specializēto aģentūru vadītājus par ikviena pievienošanās dokumenta iesniegšanu, kas saņemts saskaņā ar 41. punktu un turpmākajiem paziņojumiem, kas saņemti saskaņā ar 43. punktu. Specializētās aģentūras vadītājs informē Apvienoto Nāciju Organizācijas Ģenerālsekretāru un attiecīgās aģentūras dalībvalstis par ikviena pievienošanās raksta iesniegšanu, ko viņš saņēmis saskaņā ar 42. punktu.

46. pants

Jebkuras valsts vārdā iesniegts pievienošanās dokuments vai tam sekojošs paziņojums apliecina, ka valsts saskaņā ar saviem tiesību aktiem varēs pieņemt par spēkā esošiem šīs Konvencijas noteikumus un grozījumus, kas veikti ar jebkuru pielikumu galīgajam tekstam, attiecībā uz aģentūrām, uz kurām pievienošanās un paziņojumi attiecas.

47. pants

1. Saskaņā ar šī punkta 2. un 3. panta noteikumiem ikviena šīs Konvencijas dalībvalsts apņemas piemērot šo Konvenciju attiecībā uz ikvienu specializēto aģentūru, kas minēta tās pievienošanās dokumentā vai vēlākajos paziņojumos, līdz laikam, kad šai aģentūrai kļūst piemērojama pārskatītā konvencija vai pielikumi, un minētā valsts ir pieņēmusi pārskatīto Konvenciju vai pielikumu. Pārskatīta pielikuma gadījumā valsts dara zināmu, ka tā pieņem pielikumu, iesniedzot paziņojumu Apvienoto Nāciju Organizācijas Ģenerālsekretāram, kas stājas spēkā datumā, kad to saņem Ģenerālsekretārs.

2. Ikviena šīs Konvencijas dalībvalsts, kas nav vai ir pārstājusi būt specializētās aģentūras dalībvalsts, var adresēt rakstisku paziņojumu Apvienoto Nāciju Organizācijas ģenerālsekretāram un attiecīgās aģentūras vadītājam, ka tā gatavojas atcelt aģentūrai saskaņā ar šo Konvenciju piešķirtās privilēģijas ar konkrētu datumu, kas nav agrāk kā trīs mēnešus no paziņojuma saņemšanas datuma.

3. Ikviena šīs Konvencijas dalībvalsts var atsaukt saskaņā ar šo Konvenciju piešķirtās privilēģijas jebkurai specializētajai aģentūrai, kas pārtrauc attiecības ar Apvienoto Nāciju Organizāciju.

4. Apvienoto Nāciju Organizācijas Ģenerālsekretārs informē visas šīs Konvencijas dalībvalstis par ikvienu paziņojumu, kas tam nodots saskaņā šī punkta noteikumiem.

48. pants

Pēc vienas trešdaļas šīs Konvencijas dalībvalstu lūguma Apvienoto Nāciju Organizācijas Ģenerālsekretārs sasauc konferenci Konvencijas pārskatīšanai.

49. pants

Apvienoto Nāciju Organizācijas Ģenerālsekretārs nosūta šīs Konvencijas eksemplārus ikvienai specializētajai aģentūrai un ikvienas Apvienoto Nāciju Organizācijas dalībvalsts valdībai.

PIELIKUMI

I pielikums

STARPTAUTISKĀ DARBA ORGANIZĀCIJA

Attiecībā uz Starptautisko darba organizāciju standarta noteikumi attiecas, ievērojot šādus noteikumus:

1. V nodaļa (izņemot 13. punkta (c) daļu) un 25. pants, VII panta 1. un 2 (I). pants attiecas arī uz darba devēju un darbinieku pārstāvjiem un Starptautiskās darba organizācijas izpildinstitūcijas locekļiem, to vietniekiem vai aizvietotājiem, izņemot gadījumus, kad Izpildinstitūcija saskaņā ar 16. punktu ir atsaukusi šo personu imunitāti.

2. Standarta noteikumu 21. punktā minētās privilēģijas, imunitātes, izņēmumi un priekšrocības tiek piešķirtas arī Starptautiskās darba organizācijas biroja Ģenerāldirektora vietniekam un Starptautiskās darba organizācijas Ģenerāldirektora palīgam.

3. (i) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

a. imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

b. imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbināta misijās Organizācijas uzdevumā;

c. tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

d. to materiālu un dokumentu neaizskaramību, kas attiecas uz darbu, kuru izpildei viņus ir nolīgusi Organizācija

(ii) Attiecībā uz augstākminēto 3. (i)(d) apakšpunktu tiek piemērots princips, kas ir noteikts Konvencijas 12. punkta pēdējā teikumā.

(iii) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm.

II pielikums

APVIENOTO NĀCIJU ORGANIZĀCIJAS PĀRTIKAS UN LAUKSAIMNIECĪBAS ORGANIZĀCIJA

Attiecībā uz Apvienoto Nāciju Organizācijas Pārtikas un lauksaimniecības organizāciju (tālāk saukta par "Organizāciju'') standarta noteikumi ir piemērojami, ievērojot šādus nosacījumus.

1. V nodaļa un 25. pants, VII panta 1. un 2(I). pants attiecas arī uz Organizācijas Padomes priekšsēdētāju un asociēto dalībnieku pārstāvjiem, izņemot gadījumus, kad Organizācijas padome saskaņā ar 16. punktu ir atsaukusi priekšsēdētāja imunitāti.

2.(i) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(a) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

(b) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbinātas misijās Organizācijas uzdevumā;

(c) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(d) to materiālu un dokumentu neaizskaramība, kas attiecas uz darbu, kuru izpildei viņus ir nolīgusi Organizācija, kā arī tiesības saziņai ar Organizāciju lietot šifrus un saņemt dokumentus un korespondenci ar kurjeru vai aizzīmogotās somās.

(ii) Attiecībā uz augstākminētā 2. (i)(d) apakšpunktu tiek piemērots princips, kas ir noteikts Konvencijas 12. punkta pēdējā teikumā.

(iii) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm.

3. Konvencijas 21. punktā minētās privilēģijas un imunitātes, izņēmumi un priekšrocības tiek piešķirtas arī Organizācijas Ģenerāldirektora vietniekam un Ģenerāldirektoru palīgiem.

III pielikums

STARPTAUTISKĀ CIVILĀS AVIĀCIJAS ORGANIZĀCIJA

Attiecībā uz Starptautisko civilās aviācijas organizāciju (tālāk saukta par "Organizāciju") standarta noteikumi ir piemērojami, ievērojot šādus nosacījumus.

1. Standarta noteikumu 21. punktā minētās privilēģijas, imunitātes, izņēmumi un priekšrocības ir attiecināmas arī uz Organizācijas Padomes prezidentu.

2.(i) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(a) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

(b) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbinātas misijās Organizācijas uzdevumā;

(c) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(d) to materiālu un dokumentu neaizskaramību, kas attiecas uz darbu, kuru izpildei viņus ir nolīgusi Organizācija.

(ii) Attiecībā uz augstākminēto 2. (i)(d) apakšpunktu tiek piemērots princips, kas ir noteikts Konvencijas 12. punkta pēdējā teikumā.

(iii) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm.

IV pielikums

APVIENOTO NĀCIJU ORGANIZĀCIJAS IZGLĪTĪBAS, ZINĀTNES UN KULTŪRAS ORGANIZĀCIJA

Attiecībā uz Apvienoto Nāciju Organizācijas Izglītības, zinātnes un kultūras organizāciju (turpmāk — "Organizācija") attiecināmi sekojoši nosacījumi:

1. V nodaļa un 25. pants, VII panta 1. un 2(I). pants attiecas arī uz Konferences priekšsēdētāju un uz Organizācijas Izpildinstitūcijas amatpersonām, to vietniekiem vai padomniekiem, izņemot gadījumus, kad Organizācijas izpildinstitūcija saskaņā ar 16. punktu ir atsaukusi iepriekšminēto personu imunitāti.

2. Organizācijas Ģenerāldirektora vietnieks, viņa laulātais un nepilngadīgie bērni bauda tādas pašas privilēģijas un imunitātes, izņēmumus un priekšrocības, kādas tiek piešķirtas diplomātiskajiem sūtņiem saskaņā ar starptautiskajām tiesībām, un kuras saskaņā ar Konvencijas VI panta 21. punktu tiek nodrošinātas ikvienam specializētās aģentūras vadītājam.

3. (i) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(a) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

(b) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbinātas misijās Organizācijas uzdevumā;

(c) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(ii) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm.

V pielikums

STARPTAUTISKAIS VALŪTAS FONDS

Attiecībā uz Starptautisko valūtas fondu (turpmāk saukts par "Fondu") Konvencija (tai skaitā šis pielikums) tiek piemērots, ievērojot šādus noteikumus:

1. Konvencijas 32. pants tiek piemērots vienīgi atšķirību gadījumā, kas rodas privilēģiju un imunitāšu interpretācijas vai piemērošanas rezultātā, kuras Fondam paredz vienīgi šī Konvencija, un kas nav iekļaujamas tajās privilēģijās un imunitātēs, ko tas var pieprasīt saskaņā ar tā Vienošanos par Līguma nosacījumiem vai citādi.

2. Konvencijas noteikumi (ieskaitot šo pielikumu) nemaina, negroza, vai neparedz Vienošanās par Līguma nosacījumiem izmainīšanu vai grozīšanu, neskar vai neierobežo kādu no tiesībām, imunitātēm, privilēģijām vai izņēmumiem, kuri Fondam vai jebkuram no tā dalībniekiem, pārvaldniekiem, izpilddirektoriem, vietniekiem, amatpersonām vai darbiniekiem ir piešķirti ar Fonda Vienošanos par Līguma nosacījumiem vai jebkurš Fonda dalībnieks vai kādas tā politiskās apakšstruktūras vai citas institūcijas statūti, noteikumi vai likumi.

VI pielikums

STARPTAUTISKĀ REKONSTRUKCIJAS UN ATTĪSTĪBAS BANKA

Attiecībā uz Starptautisko rekonstrukcijas un attīstības banku (turpmāk —"Banka") Konvencija (tai skaitā šis pielikums) tiek piemērota, ievērojot šādus noteikumus:

1. Konvencijas 4. pants tiek aizstāts ar šādu redakciju:

"Tiesvedība pret Banku var tikt iesniegta vienīgi tās Bankas dalībvalsts kompetentajā tiesā, kurā ir bankas birojs, kur tā ir iecēlusi aģentu tiesas pavēstes vai paziņojuma saņemšanai un ir izdevusi vai garantējusi vērtspapīrus. Bankas dalībnieki vai personas, kuras darbojas dalībnieka vārdā vai iegūst prasības no Bankas dalībnieka, nevar celt prasību pret Banku.

Bankas īpašumi un aktīvi, lai kur tie atrastos un kā pārvaldījumā tie būtu, bauda imunitāti pret visām aresta, mantas aresta izpildes pirms galīgā sprieduma pasludināšanas pret Banku".

2. Konvencijas 32. pants tiek piemērots vienīgi atšķirību gadījumā, kas rodas privilēģiju un imunitāšu interpretācijas vai piemērošanas rezultātā, kuras Bankai paredz vienīgi šī Konvencija, un kas nav iekļautas tajās privilēģijās un imunitātēs, ko tā var pieprasīt saskaņā ar savu Bankas Vienošanos par Līguma nosacījumiem.

3. Konvencijas noteikumi (ieskaitot šo pielikumu) nemaina vai negroza vai neparedz mainīt vai grozīt Bankas Vienošanos par Līguma nosacījumiem, kā arī neskar vai neierobežo kādu no tiesībām, imunitātēm, privilēģijām, vai izņēmumiem, kurus Bankai vai jebkuram tās dalībniekam, pārvaldniekam, izpilddirektoram, tā vietniekam, amatpersonai vai darbiniekam piešķir Bankas Vienošanās par Līguma nosacījumiem vai jebkurš Bankas dalībnieks vai kādas tā politiskās apakšstruktūras vai citas institūcijas statūti, noteikumi vai likumi.

VII pielikums

PASAULES VESELĪBAS ORGANIZĀCIJA

Attiecībā uz Pasaules veselības organizāciju (turpmāk — "Organizācija") standarta noteikumi tiek piemēroti, ievērojot šādus nosacījumus:

1. V nodaļa un 25. pants, VII panta 1. un 2(I). pants attiecas arī uz personām, kas ieceltas darbam Organizācijas izpildinstitūcijā, to aizvietotājiem vai padomniekiem, izņemot gadījumus, kad Organizācijas izpildinstitūcija saskaņā ar 16. punktu ir atsaukusi iepriekšminēto personu imunitāti.

2. (i) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(a) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

(b) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbinātas misijās Organizācijas uzdevumā;

(c) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(d) viņu materiālu un dokumentu neaizskaramību;

(e) tiesības sakariem ar Organizāciju izmantot kodus un saņemt dokumentu un korespondenci ar kurjeru vai aizzīmogotās kurjersomās.

(ii) Privilēģijas un imunitātes, kas ir noteiktas augstākminētajos (b) un (e) apakšpunktos, tiek piemērotas arī personām, kas ietilpst Organizācijas Ekspertu Padomnieku grupā, īstenojot to funkcijas.

(iii) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm.

3. V nodaļa un 25. punkts, VII panta 1. un 2(I). punkts attiecas arī uz asociēto dalībnieku pārstāvjiem, kas piedalās Organizācijas darbā saskaņā ar Konstitūcijas 8. un 47. pantu.

4. Privilēģijas, imunitātes, izņēmumi un priekšrocības, kas ir minētas standarta noteikumu 21. punktā, attiecas arī uz Organizācijas Ģenerāldirektora vietniekiem, ģenerāldirektora palīgiem un reģionāliem direktoriem.

VIII pielikums

PASAULES PASTA SAVIENĪBA

Standarta noteikumi tiek piemēroti bez izmaiņām.

IX pielikums

STARPTAUTISKĀ TELEKOMUNIKĀCIJU SAVIENĪBA

Konvencijas standarta noteikumi tiek piemēroti bez izmaiņām, izņemot to, ka Starptautiskā telekomunikāciju organizācija nevar sev prasīt privileģētu attieksmi attiecībā uz "Sakaru priekšrocībām", kas noteiktas IV panta 11. punktā.

XII pielikums

STARPTAUTISKĀ JŪRNIECĪBAS ORGANIZĀCIJA

Privilēģijas, imunitātes, izņēmumus un priekšrocības, kas ir minētas standarta noteikumu VI panta 21. punktā attiecina uz Organizācijas Ģenerālsekretāru, Ģenerālsekretāra vietnieku, Jūras drošības komitejas sekretāru un uz Administratīvās nodaļas, Tehniskās sadarbības nodaļas, Juridisko un ārējo lietu nodaļas, Konferenču nodaļas un Jūras vides nodaļas direktoriem, nosakot, ka šī punkta noteikumi neliek dalībniekam, kura teritorijā Organizācijai ir galvenā mītne, attiecināt Standarta noteikumu VI panta 21. punktu uz ikvienu personu, kas ir tās pilsonis. Ja Organizācija maina direktora amata nosaukumu, uz personām, kas ieņēma iepriekšējo amatu, turpina attiekties privilēģijas un imunitātes, izņēmumi un priekšrocības, kas ir minētas šajā punktā.

(a) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(i) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

(ii) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbinātas misijās Organizācijas uzdevumā;

(iii) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(iv) viņu materiālu un dokumentu neaizskaramību;

(v) tiesības sakariem ar Organizāciju izmantot kodus un saņemt dokumentu un korespondenci ar kurjeru vai aizzīmogotās kurjersomās.

Princips, kas ir ietverts standarta noteikumu 12. punkta pēdējā teikumā, tiek piemērots saistībā ar augstākminētā 2. (a)(iv) un (v) apakšpunktiem.

(b) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm.

XIII pielikums

STARPTAUTISKĀ FINANŠU KORPORĀCIJA

Attiecībā uz Starptautisko finanšu korporāciju (turpmāk saukta — "Korporācija") Konvencija (ieskaitot šo pielikumu) tiek piemērota, ievērojot zemākminētos nosacījumus:

1. Konvencijas 4. nodaļa tiek aizvietota šādā redakcijā:

"Tiesvedība pret Korporāciju var tikt uzsākta vienīgi tās Korporācijas dalībvalsts kompetentajā tiesā, kurā ir Korporācijas birojs, kur tā ir iecēlusi aģentu tiesas pavēstes vai paziņojuma saņemšanai un ir izdevusi vai garantējusi vērtspapīrus. Korporācijas dalībnieki vai personas, kuras darbojas dalībnieka vārdā vai iegūst prasības no Korporācijas dalībnieka, nevar celt prasību pret Korporāciju.

Korporācijas īpašumi un aktīvi, lai kur tie atrastos un kā pārvaldījumā tie būtu, bauda imunitāti pret visām aresta, mantas aresta vai pavēles izpildes formām pirms galīgā sprieduma pasludināšanas pret Korporāciju".

2. Standarta noteikumu 7. punkta (b) apakšpants attiecībā uz Korporāciju ir piemērojams kontekstā ar Korporācijas Vienošanos par Līgumu nosacījumiem III panta 5. daļu.

3. Korporācija var atteikties no privilēģijām un imunitātēm, kas ir noteiktas tās Vienošanās par Līguma nosacījumiem VI pantā tādā apmērā un ar tādiem nosacījumiem, kādus tā uzskata par nepieciešamiem.

4. Konvencijas 32. pants tiek piemērots vienīgi atšķirību gadījumā, kas rodas privilēģiju un imunitāšu interpretācijas vai piemērošanas rezultātā, kuras Korporācijai paredz vienīgi šī Konvencija, un kas nav iekļautas tajās privilēģijās un imunitātēs, ko tā var pieprasīt saskaņā ar savu Korporācijas Vienošanos par Līguma nosacījumiem.

5. Konvencijas noteikumi (ieskaitot šo pielikumu) nemaina vai negroza vai neparedz mainīt vai grozīt Korporācijas Vienošanos par Līguma nosacījumiem, kā arī neskar vai neierobežo kādu no tiesībām, imunitātēm, privilēģijām, vai izņēmumiem, kurus korporācijai vai jebkuram tās dalībniekam, pārvaldniekam, izpilddirektoram, tā vietniekam, amatpersonai vai darbiniekam piešķir Korporācijas Vienošanās par Līguma nosacījumiem vai jebkurš Korporācijas dalībnieks vai kādas tā politiskās apakšstruktūras vai citas institūcijas statūti, noteikumi vai likumi.

XIV pielikums

STARPTAUTISKĀ ATTĪSTĪBAS ASOCIĀCIJA

Attiecībā uz Starptautisko attīstības asociāciju (turpmāk — "Asociācija") Konvencija, ieskaitot šo pielikumu, tiek piemērota, ievērojot zemākminētos nosacījumus:

1. Konvencijas 4. nodaļa tiek aizvietota šādā redakcijā:

"Tiesvedība pret Asociāciju var tikt uzsākta vienīgi tās Asociācijas dalībvalsts kompetentajā tiesā, kurā ir Asociācijas birojs, kur tā ir iecēlusi aģentu tiesas paziņojuma saņemšanai un tā ir izdevusi vai garantējusi vērtspapīrus. Asociācijas dalībnieki vai personas, kuras darbojas dalībnieka vārdā vai iegūst prasības no Asociācijas dalībnieka, nevar celt prasību pret Asociāciju.

Asociācijas īpašumi un aktīvi, lai kur tie atrastos un kā pārvaldījumā tie būtu, bauda imunitāti pret visām aresta, mantas aresta vai pavēles izpildes formām pirms galīgā sprieduma pasludināšanas pret Asociāciju".

2. Konvencijas 32. pants tiek piemērots vienīgi atšķirību gadījumā, kas rodas no privilēģiju un imunitāšu interpretācijas vai piemērošanas rezultātā, kuras Asociācijai paredz vienīgi šī Konvencija, un kas nav iekļautas tajās privilēģijās un imunitātēs, ko tā var pieprasīt saskaņā ar savu Asociācijas Vienošanos par Līguma nosacījumiem.

3. Konvencijas noteikumi (ieskaitot šo pielikumu) nemaina vai negroza vai neparedz mainīt vai grozīt Asociācijas Vienošanos par Līguma nosacījumiem, kā arī neskar vai neierobežo kādu no tiesībām, imunitātēm, privilēģijām, vai izņēmumiem, kurus Asociācijai vai jebkuram tās dalībniekam, pārvaldniekam, izpilddirektoram, tā vietniekam, amatpersonai vai darbiniekam piešķir Asociācijas Vienošanās par Līguma nosacījumiem vai jebkurš Asociācijas dalībnieks vai kādas tā politiskās apakšstruktūras vai citas institūcijas statūti, noteikumi vai likumi.

XV pielikums

PASAULES INTELEKTUĀLĀ ĪPAŠUMA ORGANIZĀCIJA

Attiecībā uz Pasaules intelektuālā īpašuma organizāciju (turpmāk — "Organizācija") standarta noteikumi attiecas ar zemākminētajiem pārveidojumiem:

"1. Privilēģijas, imunitātes, izņēmumi un priekšrocības, kas ir minēti standarta noteikumu VI panta 21. punktā, ir attiecināmi arī uz Organizācijas direktora vietniekiem".

"2. (a) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(i) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

(ii) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbinātas misijās Organizācijas uzdevumā;

(iii) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(iv) viņu materiālu un dokumentu neaizskaramību;

(v) tiesības sakariem ar Organizāciju izmantot kodus un saņemt dokumentu un korespondenci ar kurjeru vai aizzīmogotās kurjersomās.

Princips, kas ir ietverts standarta noteikumu 12. punkta pēdējā teikumā, tiek piemērots saistībā ar augstākminētajiem (iv) un (v) apakšpunktiem.

(b) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem augstākminētajā (a) punktā Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm".

XVI pielikums

STARPTAUTISKAIS LAUKSAIMNIECĪBAS ATTĪSTĪBAS FONDS

Attiecībā uz Starptautisko lauksaimniecības attīstības fondu (turpmāk — "Fonds") standarta noteikumi tiek piemēroti, ievērojot zemāk minētos noteikumus:

1. Privilēģijas, imunitātes, izņēmumi un priekšrocības, kas ir minētas standarta noteikumu 21. punktā, tiek piemērotas arī Fonda viceprezidentam.

2. (i) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(a) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju;

(b) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā Fondā vai nav nodarbinātas misijās Fonda uzdevumā;

(c) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(d) saziņai ar Fondu to dokumentu neaizskaramība, kas ir saistīti ar to darbu, kuru veikt Fonds tos ir nolīdzis, un tiesības izmantot kodus un saņemt dokumentus vai korespondenci aizzīmogotās kurjersomās;

(ii) Saistībā ar augstākminēto 2. (i)(d) apakšpunktu tiek piemērots princips, kas ir ietverts standarta noteikumu 12. punktā;

(iii) Privilēģijas un imunitātes tiek piešķirtas ekspertiem Fonda interesēs, bet ne pašu indivīdu personiskajam labumam. Fondam ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Fonda interesēm.

XVII pielikums

APVIENOTO NĀCIJU INDUSTRIĀLĀS ATTĪSTĪBAS ORGANIZĀCIJA

Attiecībā uz Apvienoto Nāciju Industriālās attīstības organizāciju (turpmāk — "Organizācija") standarta noteikumi tiek piemēroti, ievērojot zemākminētos noteikumus:

1. (a) Ekspertiem (kas nav amatpersonas, uz kurām attiecas VI nodaļa), kas strādā Organizācijas komitejās un veic misijas Organizācijas uzdevumā, tiek piešķirtas sekojošas privilēģijas un imunitātes, ciktāl tas ir nepieciešams to funkciju efektīvai izpildei, ieskaitot laiku, kas pavadīts, dodoties uz vai no darba šādās komitejās vai misijās:

(i) imunitāte pret arestu vai aizturēšanu un personiskās bagāžas konfiskāciju,

(ii) imunitāte pret jebkāda veida tiesvedību par to rakstiskā vai mutiskā formā pausto viedokli un darbībām, ko tie ir veikuši savu oficiālo pilnvaru ietvaros. Šī imunitāte turpinās, neskatoties uz to, ka attiecīgā persona vairs nestrādā organizācijā vai nav nodarbinātas misijās Organizācijas uzdevumā;

(iii) tādas pašas priekšrocības attiecībā uz valūtas maiņu vai uz tās ierobežojumiem, kā arī uz to personisko bagāžu, kādas tiek piešķirtas ārvalstu valdību amatpersonām īslaicīgu oficiālu vizīšu laikā;

(c) Privilēģijas un imunitātes tiek piešķirtas Organizācijas ekspertiem Organizācijas interesēs, bet ne pašu indivīdu personiskajam labumam. Organizācijai ir tiesības un pienākums atcelt jebkuras ekspertu imunitātes, ja tā uzskata, ka imunitāte varētu kavēt tiesvedību, un to var atcelt, nekaitējot Organizācijas interesēm.

2. Privilēģijas, imunitātes, izņēmumi un priekšrocības, kas ir minētas standarta noteikumu 21. punktā, ir attiecināmas arī uz jebkuru Organizācijas Ģenerāldirektora vietnieku.
