prezidents izsludina šādu likumu:
Par Latvijas Republikas valdības, Igaunijas Republikas valdības un Lietuvas Republikas valdības protokolu par Karmelavas apvienotā kontroles un ziņošanas centra un tā personāla statusu

1.pants. 2007.gada 2.martā Vīsbādenē parakstītais Latvijas Republikas valdības, Igaunijas Republikas valdības un Lietuvas Republikas valdības protokols par Karmelavas apvienotā kontroles un ziņošanas centra un tā personāla statusu (turpmāk - Protokols) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Protokolā paredzēto saistību izpildi koordinē Aizsardzības ministrija.

3.pants. Protokols stājas spēkā tā XII pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

4.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Protokols latviešu un angļu valodā.

LATVIJAS REPUBLIKAS VALDĪBAS, IGAUNIJAS REPUBLIKAS VALDĪBAS UN LIETUVAS REPUBLIKAS VALDĪBAS PROTOKOLS PAR KARMELAVAS APVIENOTĀ KONTROLES UN ZIŅOŠANAS CENTRA UN TĀ PERSONĀLA STATUSU

Igaunijas Republikas valdība, Latvijas Republikas valdība un Lietuvas Republikas valdība, (turpmāk tekstā Puses),

atsaucoties uz Latvijas Republikas valdības, Igaunijas Republikas valdības un Lietuvas Republikas valdības 2007. gada 2.martā Vīsbādenē parakstītās vienošanās (turpmāk tekstā- Vienošanās) par Baltijas gaisa telpas novērošanas tīkla un kontroles sistēmas attīstību IV panta otro daļu, kurā Puses vienojas atsevišķā protokolā noteikt Apvienotā Kontroles un ziņošanas centra Karmelavā (turpmāk tekstā AKZC) un tā personāla statusu,

ir vienojušās šādi:

I PANTS
PIEMĒROŠANAS JOMA

1. AKZC ir izveidots saskaņā ar Vienošanos. Protokola nosacījumi attiecas uz AKZC Lietuvas Republikas teritorijā un uz militāro vai civilo personālu, kas norīkots dienestam AKZC vai nodarbināts AKZC, kā arī uz viņu apgādājamiem tad, ja šāds personāls atrodas jebkuras Puses teritorijā saistībā ar oficiālo dienesta pienākumu pildīšanu, bet attiecībā uz piederīgajiem tad, ja šādus oficiālus dienesta pienākumus pilda viņu dzīvesbiedrs vai vecāki.

2. Šā protokola piemērošanas nolūkā termini "militārais personāls", "civilais personāls" un "apgādājamie" visur, kur tie šajā protokolā ir sastopami, attiecīgi nozīmē "spēki", "civilais komponents" un "apgādājamie", kā to atbilstoši definē 1951. gada 19. jūnijā Londonā parakstītais Ziemeļatlantijas Līguma dalībvalstu līgums par to bruņoto spēku statusu (turpmāk tekstā - NATO SOFA).

II PANTS
JURIDISKĀS PERSONAS STATUSS

1. AKZC ir juridiskās personas statuss. Tas ir tiesīgs slēgt līgumus, atvērt bankas kontu, kā arī iegādāties un rīkoties ar īpašumu.

2. Saskaņā ar protokola nosacījumiem AKZC var būt puse tiesas prāvā. Tomēr AKZC var vienoties ar jebkuru no Pusēm par to, ka attiecīgās Puses (Nacionālās) Aizsardzības ministrija atkarībā no tiesas nacionālās jurisdikcijas rīkojas AKZC vārdā jebkurā tiesas prāvā, kurā AKZC piedalās kā viena no pusēm. Izdevumus, kas saistīti ar līgumu izpildi vai tiesas prasību apmierināšanu, sedz AKZC.

III PANTS
AKZC PĀRSTĀVĪBA

AKZC pārstāv AKZC komandieris vai persona, kuru viņš/viņa var iecelt saskaņā ar nosacījumiem un procedūrām, kas noteiktas, lai nodrošinātu AKZC funkcionēšanu un administrēšanu.

IV PANTS
AKZC TELPU, ĪPAŠUMU, FINANŠU LĪDZEKĻU UN AKTĪVU STATUSS UN IMUNITĀTE

1. Ja vien protokols neparedz citādus nosacījumus, tad telpās, ko izmanto vienīgi AKZC, piemēro Lietuvas Republikas likumdošanu.

2. Ja vien protokols neparedz citādus nosacījumus, tad, kā to paredz piemērojamie likumi, objektos, kurus izmanto vienīgi AKZC, notiekošās darbības, darījumi vai nolaidības gadījumi ir Lietuvas Republikas tiesu vai citu atbilstošu institūciju kompetencē.

3. Tādas darbības kā īpašumu, dokumentu, aktīvu vai finanšu līdzekļu arests, pārmeklēšana, rekvizīcija, konfiscēšana, ekspropriācija un cita veida iejaukšanās, kas vērsta pret AKZC objektiem vai notiek tajos neatkarīgi no tā, vai tās balstās uz administratīvām prasībām, tiesu varas aktiem vai likumdošanas prasībām, nav pieļaujamas, izņemot gadījumus, kad:

a) tas ir nepieciešams, lai veiktu vajadzīgo likumu pārkāpumu izmeklēšanu un savāktu pierādījumus, ieskaitot to objektu arestu un attiecīgos gadījumos pārņemšanu, kuri ir saistīti ar likumu pārkāpumu, tostarp muitas un finanšu likumu un noteikumu pārkāpumiem.

b) vai arī citādi, kad tās notiek ar Pušu piekrišanu un/vai saskaņā ar Pušu apstiprinātiem nosacījumiem.

4. AKZC pēc Pušu atbildīgo iestāžu lūguma un pieprasījuma iesniedzējas Puses (nacionālās) Aizsardzības ministrijas pārstāvja klātbūtnē pārbauda jebkādu to dokumentu raksturu un saturu, kas apstiprina to, ka Pusēm saskaņā ar šo pantu ir tiesības uz imunitāti.

5. Saskaņā ar protokolu AKZC piešķirtās imunitātes neliedz Pusēm veikt ar AKZC saistītas savstarpēji saskaņotas funkcijas.

6. Lietuvas Republikas atbildīgās iestādes nodrošina mieru AKZC objektos tā, lai to darbību netraucētu nekādas personas vai grupas nesankcionētas iekļūšanas mēģinājumi vai mēģinājumi izraisīt nekārtības objektu tiešā tuvumā. Pēc AKZC komandiera pieprasījuma Lietuvas Republikas atbildīgās iestādes sniedz nepieciešamo palīdzību, lai nodrošinātu likumu un kārtību AKZC objektos un atbrīvotu objektus no šādām personām.

V PANTS
PIEKĻUVES BRĪVĪBA

1. Neskarot noteikto kārtību un starptautiskās vienošanās, Puses apņemas atļaut AKZC militārā un civilā personāla, kā arī visu citu personu, kas ir uzaicinātas uz AKZC, iebraukšanu savā teritorijā, lai veiktu savus dienesta pienākumus tieši centrā vai saistībā ar AKZC. Tas neatbrīvo nevienu personu no karantīnas vai citu ar veselības aizsardzību saistītu noteikumu ievērošanas.

2. Nekādas darbības, lai piespiestu šā panta pirmajā daļā minētās personas atstāt kādas Puses teritoriju, nedrīkst veikt bez konsultācijām ar tās valsts diplomātiskajiem pārstāvjiem, kuras pilsonis ir attiecīgā persona.

3. Personas, kurām saskaņā ar Lietuvas Republikas likumiem ir tiesības iekļūt AKZC objektos, lai pildītu savas oficiālās dienesta funkcijas, var iekļūt AKZC objektos vienīgi ar AKZC komandiera vai viņa/viņas ieceltās personas atļauju. Tomēr flagrante delicto/pārkāpuma izdarīšanas brīdī vai gadījumos, ko paredz šā protokola IV panta trešā daļa, šāda atļauja tiek dota automātiski.

VI PANTS
ROBEŽAS ŠĶĒRSOŠANA

AKZC militārā un civilā personāla un viņu apgādājamo robežu šķērsošanu tiek regulēta atbilstoši NATO SOFA un Pušu piemērojamiem tiesību aktiem.

VII PANTS
NODOKĻI UN NODEVAS

1. AKZC ir atbrīvots no muitas nodevām, pievienotās vērtības nodokļa un akcīzes nodokļiem attiecībā uz precēm un pakalpojumiem, kurus izmanto pats AKZC savām oficiālajām vajadzībām tādā mērā, kādā to pieļauj attiecīgās Puses teritorijā piemērojamie tiesību akti.

2. Preces, kas tiek ievestas bez nodokļu maksāšanas, drīkst nodot tikai saskaņā ar attiecīgās Puses teritorijā piemērojamiem tiesību aktiem.

VIII PANTS
PERSONĀLA PRIVILĒĢIJAS UN IMUNITĀTES

1. Attiecībā uz AKZC militāro un civilo personālu, kas atrodas jebkuras Puses teritorijā, veicot ar AKZC saistītas darbības, un to apgādājamiem Puses vienojas piemērot NATO SOFA un piemērojamo tiesību aktu nosacījumus.

2. Statuss, kas tiek piešķirts AKZC militārajam un civilajam personālam, tādā pašā veidā var tikt piemērots AKZC norīkotajam personālam no valsts, kura nav protokola puse, ieskaitot valstīm, kuras nav NATO SOFA vai 1995.gada 19.jūnijā Briselē parakstītā Ziemeļatlantijas līguma organizācijas dalībvalstu un valstu, kas piedalās programmā "Partnerattiecības mieram", līguma par to bruņoto spēku statusu (PfP) parakstītājvalstis, notu apmaiņas veidā, kas notiek, starp un Igaunijas Republikas valdību, Latvijas Republikas valdību un Lietuvas Republikas valdību. Vienošanās, kas tiek noslēgta ar valsti, kas nav parakstītājvalsts, stājas spēkā pēc Pušu pēdējā paziņojuma par tās parakstīšanu saņemšanas.

IX PANTS
PERSONĀLS, KURU DARBĀ PIEŅEM AKZC

Ikgadējā apstiprinātā AKZC budžeta ietvaros AKZC ir tiesības algot civilo personālu. Šāda personāla noalgošana tiek veikta atbilstoši Lietuvas Republikā piemērojamiem tiesību aktiem.

X PANTS
SAKARU IESPĒJAS UN AKZC DOKUMENTU UN CITU MATERIĀLU PĀRVADĀŠANA

1. Attiecībā uz visiem oficiālajiem pasta un elektronisko sakaru pakalpojumiem attiecīgās Puses piemēro AKZC tādu pat režīmu, kādu tās piemēro saviem Bruņotajiem spēkiem.

2. Puses veic vajadzīgos pasākumus, lai neatkarīgi no izmantojamiem sakaru līdzekļiem nodrošinātu AKZC oficiālās sarakstes neaizskaramību.

XI PANTS
DEPOZITĀRIJS

Lietuvas Republikas valdība ir oficiālais protokola depozitārijs.

XII PANTS
STĀŠANĀS SPĒKĀ, DARBĪBAS ILGUMS UN DENONSĒŠANA

1. Protokols stājas spēkā trīsdesmit (30) dienas pēc tam, kad Depozitārijs pa diplomātiskiem kanāliem ir saņēmis pēdējo rakstisko paziņojumu, kurā norādīts, ka ir izpildītas nepieciešamās nacionālo normatīvo aktu prasības, lai protokols stātos spēkā. Depozitārijs informē Puses par katru saņemto paziņojumu un par protokola stāšanās spēkā datumu.

2. Protokols ir noslēgts uz nenoteiktu laiku. Jebkura Puse to var denonsēt, rakstiski brīdinot Depozitāriju, kas, savukārt, pa diplomātiskiem kanāliem informē pārējās Puses par katru šādu brīdinājumu un tā saņemšanas datumu.

3. Denonsēšana stājas spēkā sešus (6) mēnešus pēc tam, kad Depozitārijs ir saņēmusi attiecīgu brīdinājumu. Gadījumā, ja kāda no Pusēm denonsē protokolu, tas pārstāj darboties attiecībā uz konkrēto Pusi.

4. Līdz protokola stāšanās spēkā procedūru pabeigšanai pēc tā parakstīšanas protokola nosacījumi tiek piemēroti pagaidu kārtībā.

5. Protokols zaudē spēku līdz ar brīdi, kad spēku zaudē Vienošanās.

XIII PANTS
DOMSTARPĪBU RISINĀŠANA

Pušu domstarpības attiecībā uz protokola interpretēšanu vai piemērošanu Puses risina pārrunu ceļā pēc iespējas zemākā līmenī un tās netiek nodotas risināšanai nevienā starptautiskajā tiesā vai trešajai pusei.

XIV PANTS
GROZĪJUMI

Jebkura Puse jebkurā brīdī var ierosināt protokola grozījumus. Grozījumu pieprasījumu ir jāadresē Depozitārijam, kurš pa diplomātiskiem kanāliem informē pārējās Puses par katru šādu pieprasījumu un tā saņemšanas datumu. Šādi grozījumi stājas spēkā saskaņā ar protokola XII panta pirmās daļas nosacījumiem.

Parakstīts 2007.gada 2.martā Vīsbādenē vienā oriģinālā eksemplārā igauņu, latviešu, lietuviešu un angļu valodā, visi teksti ir vienlīdz autentiski un tiek nodoti glabāšanā Depozitārija arhīvā. Depozitārijs visām Pusēm nosūta šā protokola apliecinātas kopijas.

Jebkādu neskaidrību gadījumā noteicošais ir teksts angļu valodā.

PROTOCOL BETWEEN THE GOVERNMENT OF THE REPUBLIC OF ESTONIA, THE GOVERNMENT OF THE REPUBLIC OF LATVIA AND THE GOVERNMENT OF THE REPUBLIC OF LITHUANIA CONCERNING THE STATUS OF COMBINED CONTROL AND REPORTING CENTRE KARMĖLAVA AND ITS PERSONNEL

The Government of the Republic of Estonia, the Government of the Republic of Latvia and the Government of the Republic of Lithuania (hereinafter referred to as the Parties),

Referring to the Article IV, paragraph 2, of the Agreement between the Government of the Republic of Estonia, the Government of the Republic of Latvia and the Government of the Republic of Lithuania on the development of the Baltic Air Surveillance Network and Control System, done in Wiesbaden on March 2, 2007 (hereinafter referred to as the Agreement), in which the Parties have agreed to determine the status of combined Control and Reporting Centre at Karmėlava (hereinafter referred to as CRC) and its personnel in a separate protocol,

Have agreed as follows:

ARTICLE I
SCOPE OF APPLICATION

1. CRC is established in accordance with the Agreement. The provisions of this Protocol shall apply to CRC in the territory of the Republic of Lithuania and to the military and civilian personnel assigned to or employed in CRC and their dependents, when such personnel is present in any territory of the Parties in connection with their official duties or, in the case of dependents, the official duties of their spouse or parent.

2. For the purpose of the application of this Protocol the terms "military personnel", "civilian personnel" and "dependent", wherever these terms occur in this Protocol, mean "force", "civilian component" and "dependent" respectively, as accordingly defined in the Agreement between the Parties to the North Atlantic Treaty regarding the Status of Their Forces, done in London on 19 June, 1951, (hereinafter referred to as the NATO SOFA).

ARTICLE II
LEGAL CAPACITY

1. CRC shall possess legal capacity. It shall have the capacity to conclude contracts, to open bank accounts, and to acquire and dispose of property.

2. Subject to the provisions of this Protocol, CRC may be a party to legal proceedings. However, CRC may agree with any of the Parties, that Ministry of (National) Defence of the Respective Party, depending on the nationality of the court, shall act on behalf of CRC in any legal proceedings to which CRC is a party before the courts of that state. The costs connected to carrying out contracts or settling legal actions shall be borne by CRC.

ARTICLE III
Representation of crc

CRC shall be represented by CRC Commander or by whom he/she may appoint, in accordance with the arrangements and procedures established for the operation and administration of CRC.

ARTICLE IV
Status and immunities of premises, property, funds and assets of CRC

1. Except as otherwise provided in this Protocol, the legislation of the Republic of Lithuania shall apply within the premises solely used by CRC.

2. Except as otherwise provided in this Protocol, the courts or other appropriate institutions of the Republic of Lithuania shall have jurisdiction, as provided in applicable laws, over acts, transactions or omissions taking place within the premises solely used by CRC.

3. Seizure, search, requisition, confiscation, expropriation and any other form of interference whether by administrative, judicial or legislative actions, of property, documents, assets or funds shall not take place against or within the premises of CRC, except:

(a) for facilitating necessary investigations into offences and collection of evidence, including seizure and, in proper cases, the handing over of objects connected with an offence, including offences against customs and fiscal laws and regulations.

(b) or otherwise with the consent of, and/or under the conditions approved by the Parties.

4. CRC shall, at the request of the authorities of the Parties and in the presence of a representative of the Ministry of (National) Defence of the requesting Party, verify the nature and contents of any documents to confirm that they are entitled to immunity under this Article.

5. The immunities granted to CRC by this Protocol shall not prevent the Parties from executing mutually agreed functions concerning CRC.

6. The appropriate authorities of the Republic of Lithuania shall ensure that the tranquility of the premises of CRC is not disturbed by any person or group of persons attempting unauthorised entry into or creating disturbances in the immediate vicinity of those premises. If so requested by CRC Commander, the appropriate authorities of the Republic of Lithuania shall provide the necessary assistance for the preservation of law and order in CRC and for the removal of persons from the premises.

Article V
Freedom of access

1. Without prejudice to established procedures and international arrangements, the Parties undertake to allow the entry of the military and civilian personnel of CRC into their territory as well as all other persons invited to CRC during the performance of their duties directly for or in relation to CRC. This does not exempt anyone from the application of quarantine or other health regulations.

2. No action to force the persons referred to in paragraph 1 of this Article to leave the territory of one of the Parties may be taken except after consultation with the diplomatic representatives of their state.

3. Persons who are entitled under the laws of the Republic of Lithuania to enter the premises of the CRC for the purpose of performing their official functions may only enter the premises with the consent of CRC Commander or his appointed person. However, in cases of flagrante delicto or in cases envisaged in Article IV, paragraph 3, of this Protocol, such authorisation shall be given automatically.

Article VI
Border Crossing

The border crossing of CRC military and civilian personnel and their dependents is regulated in accordance with the NATO SOFA and applicable legislation of the Parties.

Article VII
Taxation and fees

1. CRC shall be exempted from customs duties, value added tax and excise-duties on goods and services utilized by CRC itself for its official use to the extent possible according to the legal acts applicable in the territory of the appropriate Party.

2. Items imported tax-free by CRC shall only be transferred in accordance with the legal acts applicable in the territory of the appropriate Party.

Article VIII
Privileges and immunities of personnel

1. With regard to CRC military and civilian personnel and their dependants, the Parties agree to apply the provisions of the NATO SOFA and applicable legislation of the Parties, when present in the territory of any of the Parties due to activities connected to CRC.

2. The status granted to CRC military and civilian personnel may be applied equivalently to personnel assigned to CRC by a state non-signatory to this Protocol, including states non-signatories to the NATO SOFA or Agreement among the States Parties to the North Atlantic Treaty and the other States participating in the Partnership for Peace regarding the Status of their Forces, done in Brussels on 19 June, 1995 (PfP SOFA), by an Exchange of Notes between the non-signatory and the Government of the Republic of Estonia, the Government of the Republic of Latvia and the Government of the Republic of Lithuania. The agreements concluded with non- signatories shall enter into force after the receipt of the last notification with the one of the signatories.

Article IX
Personnel hired by CRC

The CRC may hire civilian personnel within the limits of the annually approved CRC budget. Legislation applicable in the Republic of Lithuania will govern such employment.

Article X
Communications facilities and transport of CRC documents and other materials

1. For all official postal and electronic communications, the Respective Parties shall accord to CRC treatment equivalent to that accorded to their Armed Forces.

2. The Parties take reasonable measures to secure the inviolability of the official correspondence of CRC, without regard to the means of communication used.

Article XI
Depository

The Government of the Republic of Lithuania shall act as the official Depository for this Protocol.

Article XII
Entry into Force, DURATION AND DENUNCIATION

1. This Protocol shall enter into force 30 (thirty) days after the Depository has received through diplomatic channels the last written notification stating that the necessary national legal requirements for this Protocol to enter into force have been completed. The Depository shall inform the Parties of each notification received, and of the entry into force date of the Protocol.

2. The present Protocol is concluded for an unlimited period of time. It may be denounced by any of the Parties by written notification sent through diplomatic channels to the Depository, which shall notify all the other Parties of each such notification and the date of the receipt thereof.

3. The denunciation shall take effect 6 (six) months after the receipt of the notification by the Depository. In case of denunciation of this Protocol by any of the Parties, it shall cease to be in effect regarding that specific Party.

4. Pending the completion of the procedure for the entry into force of this Protocol, the provisions of this Protocol shall be applied provisionally upon its signature.

5. This Protocol shall be terminated upon the termination of the Agreement.

Article XIII
Disputes

Disputes between the Parties regarding the interpretation or application of this Protocol shall be resolved by negotiation between the Parties at the lowest possible level and shall not be referred to any international tribunal or third party for settlement.

Article XIV
Amendments

Any of the Parties may at any time request amendments to this Protocol. The request shall be addressed to the Depository, which shall notify through diplomatic channels all the other Parties of each such notification and the date of the receipt thereof. Such amendments shall come into force pursuant to the provisions of Article XII, paragraph 1 of this Protocol.

Done in Wiesbaden on March 2, 2007 in a single original in the Estonian, Latvian, Lithuanian and English languages, all texts being equally authentic, which shall be deposited in the archives of the Depository. The Depository shall transmit certified copies of the Protocol to all Parties. In case of any divergence, the English version shall prevail.
