Saeima ir pieņēmusi un Valsts
prezidents izsludina šādu likumu:
Par 1991.gada un 1993.gada grozījumiem Konvencijā par Starptautisko jūrniecības organizāciju

1.pants. 1991.gada 7.novembrī un 1993.gada 4.novembrī Londonā izdarītie grozījumi (turpmāk — Grozījumi) 1948.gada Ženēvas konvencijā par Starptautisko jūrniecības organizāciju (turpmāk — Konvencija) ar šo likumu tiek pieņemti un apstiprināti.

2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināmi Grozījumi angļu valodā un to tulkojums latviešu valodā.

3.pants. Grozījumi stājas spēkā Konvencijas 66.pantā noteiktajā laikā un kārtībā, un par to Ārlietu ministrija paziņo laikrakstā "Latvijas Vēstnesis".

Adopted on 7 November 1991
Amendments to the Convention on the International Maritime Organization, 1991

The Assembly,

Recalling resolution A.640(16) adopted at its sixteenth regular session by which it decided to take the necessary steps at its seventeenth regular session to adopt amendments to the IMO Convention in order to institutionalize the Facilitation Committee in the IMO Convention,

Having considered the recommendations of the Facilitation Committee on the proposed amendments to the IMO Convention and the views of the Council on these recommendations,

1. Adopts amendments to the Convention on the International Maritime Organization, the texts of which are contained in the annex to this resolution, consisting of:

— the amendments to Articles 11, 15, 21, 25, 56 and 57;

— the addition to a new part XI consisting of new Articles 47 to 51;

— consequential renumbering of existing parts XI to XX;

— consequential renumbering of existing Articles 47 to 77;

— consequential changes in the references to the renumbered Articles in Articles 5, 6, 7, 8, 66, 67, 68, 70, 72, 73 and 74;

— consequential changes to the references to the renumbered parts in Articles 15 and 25(a); and

— consequential change to the number of the renumbered Article referred to in appendix II;

2. Requests the Secretary-General of the Organization to deposit the adopted amendments with the Secretary-General of the United Nations in accordance with Article 72 (previously Article 67) of the IMO Convention and to receive instruments of acceptance and declarations as provided for in Article 73 (previously Article 68); and

3. Invites Member Governments to accept these amendments at the earliest possible date after receiving copies thereof by communicating the appropriate instrument of acceptance to the Secretary-General in accordance with Article 73 (previously Article 68) of the Convention.

Annex

Amendments to the Convention on the International Maritime Organization

(Institutionalization of the Facilitation Committee)

Article 11

The text is replaced by the following:

"The Organization shall consist of an Assembly, a Council, a Maritime Safety Committee, a Legal Committee, a Marine Environment Protection Committee, a Technical Co-operation Committee, a Facilitation Committee and such subsidiary organs as the Organization may at any time consider necessary; and a Secretariat."

Article 15

The text of paragraph (1) is replaced by:

"(1) To take decisions in regard to convening any international conference or following any other appropriate procedure for the adoption of international conventions or of amendments to any international conventions which have been developed by the Maritime Safety Committee, the Legal Committee, the Marine Environment Protection Committee, the Technical Co-operation Committee, the Facilitation Committee, or other organs of the Organization."

Article 21

The text is replaced by the following:

"(a) The Council shall consider the draft work programme and budget estimates prepared by the Secretary-General in the light of the proposals of the Maritime Safety Committee, the Legal Committee, the Marine Environment Protection Committee, the Technical Co-operation Committee, the Facilitation Committee and other organs of the Organization and, taking these into account, shall establish and submit to the Assembly the work programme and budget of the Organization, having regard to the general interest and priorities of the Organization.

(b) The Council shall receive the reports, proposals and recommendations of the Maritime Safety Committee, the Legal Committee; the Marine Environment Protection Committee, the Technical Co-operation Committee, the Facilitation Committee and other organs of the Organization and shall transmit them to the Assembly and, when the Assembly is not in session, to the Members for information, together with the comments and recommendations of the Council.

(c) Matters within the scope of articles 28, 33, 38, 43 and 48 shall be considered by the Council only after obtaining the views of the Maritime Safety Committee, the Legal Committee, the Marine Environment Protection Committee, the Technical Co-operation Committee or the Facilitation Committee, as may be appropriate."

Article 25

The text of paragraph (b) is replaced by:

"(b) Having regard to the provisions of part XVI and to the relation maintained with other bodies by the respective Committees under Articles 28, 33, 38, 43 and 48, the Council shall between sessions of the Assembly be responsible for relations with other organizations."

Part XI

A new text is inserted, as follows:

"THE FACILITATION COMMITTEE

Article 47

The Facilitation Committee shall consist of all the Members.

Article 48

The Facilitation Committee shall consider any matter within the scope of the Organization concerned with the facilitation of international maritime traffic and in particular shall:

(a) Perform such functions as are or may be conferred upon the Organization by or under international conventions for the facilitation of international maritime traffic, particularly with respect to the adoption and amendment of measures or other provisions, as provided for in such conventions.

(b) Having regard to the provisions of Article 25, the Facilitation Committee, upon request by the Assembly or the Council or if it deems such action useful in the interests of its own work, shall maintain such close relationship with other bodies as may further the purposes of the Organization.

Article 49

The Facilitation Committee shall submit to the Council:

(a) Recommendations and guidelines which the Committee has developed.

(b) A report on the work of the Committee since the previous session of the Council.

Article 50

The Facilitation Committee shall meet at least once a year. It shall elect its officers once a year and shall adopt its own Rules of Procedure.

Article 51

Notwithstanding anything to the contrary in this Convention, but subject to the provisions of Article 47, the Facilitation Committee, when exercising the functions conferred upon it by or under any international convention or other instrument, shall conform to the relevant provisions of the convention or instrument in question, particularly as regards the rules governing the procedures to be followed."

Article 56 (renumbered as Article 61)

The text is replaced by the following:

"Any Member which fails to discharge its financial obligation to the Organization within one year from the date on which it is due shall have no vote in the Assembly, the Council, the Maritime Safety Committee, the Legal Committee, the Marine Environment Protection Committee, the Technical Co-operation Committee or the Facilitation Committee unless the Assembly, at its discretion, waives this provision."

Article 57 (renumbered as Article 62)

The text is replaced by the following:

"Except as otherwise provided in the Convention or in any international agreement which confers functions on the Assembly the Council, the Maritime Safety Committee, the Legal Committee, the Marine Environment Protection Committee, the Technical Co-operation Committee, or the Facilitation Committee, the following provisions shall apply to voting in these organs:

(a) Each Member shall have one vote.

(b) Decisions shall be by a majority vote of the Members present and voting and, for decisions where a two-thirds majority vote is required, by a two-thirds majority vote of those present.

(c) For the purpose of the Convention, the phrase "Members present and voting" means "Members present and casting an affirmative or negative vote". Members which abstain from voting shall be considered as 'not voting'."

Articles 5, 6 and 7

The references to Article 71 are replaced by references to Article 76.

Article 8

The reference to Article 72 is replaced by a reference to Article 77.

Article 15

The reference in paragraph (g) to Part XII is replaced by a reference to Part XIII.

Article 25

The reference in paragraph (a) to Part XV is replaced by a reference to Part XVI.

Parts XI to XX

Parts XI to XX are renumbered as Parts XII to XXI.

Articles 47 to 77

Articles 47 to 77 are renumbered as Articles 52 to 82.

Article 66 (renumbered as Article 71)

The reference to Article 73 is replaced by a reference to Article 78.

Appendix II

The reference in the heading to Article 65 is replaced by a reference to Article 70.

Articles 67 and 68 (renumbered as Articles 72 and 73, respectively)

Amendments to the Convention on the International Maritime Organization

THE ASSEMBLY,

RECALLING that at its seventeenth regular session several delegations expressed concern about the outcome of the election to the Council for the 1992-1993 biennium,

NOTING

that the council at its sixty-eighth session established an Ad Hoc Working Group, open to all members of the Organization, to consider possible amendments to the provisions for elections to the Council,

NOTING WITH SATISFACTION that the needed revisions in the IMO Convention have all been initiated within the Organization and have been considered in a spirit of goodwill and mutual accommodation and adopted with the general agreement of Members,

HAVING CONSIDERED that amendments to the IMO Convention recommended by the Ad Hoc Working Group on Elections to the Council and approved by the Council at its sixty - ninth session,

1. ADOPTS amendments to Articles 16, 17 and 19 of the Convention on the International Maritime Organization, the texts of which are contained in the annex to this resolution;

2. REQUESTS the Secretary - General of the Organization to deposit the adopted amendments with the Secretary - General of the United Nations in accordance with Article 67 of the IMO Convention and to receive instruments of acceptance and declarations as provided for in Article 68; and

3. INVITES the Members of the Organization to accept these amendments with at the earliest date after receiving copies thereof by communicating the appropriate instrument of acceptance to the Secretary - General in accordance with Article 68 of the Convention.

Part VI

The Council

Article 16

Replace text of Article 16 by:

The Council shall be composed of forty Members elected by the assembly.

Article 17

Replace text of Article 17 by:

In electing the Members of the Council, the Assembly shall observe the following criteria:

(a) Ten shall be States with the largest interest in providing international shipping services;

(b) Ten shall be other States with the largest interest in international seaborne trade;

(c) Twenty shall be States not elected under (a) or (b) above which have special interests in maritime transport or navigation, and whose election to the Council will ensure the representation of all major geographic areas of the world.

Article 19(b)

Replace text of Article 19(b) by:

(b) Twenty- six Members of the Council Shall constitute a quorum.

Pieņemta 1991. gada 7. novembrī
Starptautiskās Jūrniecības organizācijas konvencijas grozījumi, 1991

Asambleja,

Atsaucoties uz Rezolūciju A. 640(16), kas pieņemta sešpadsmitās kārtējās sesijas laikā, kurā nolēma veikt nepieciešamos pasākumus tās septiņpadsmitās sesijas laikā, lai pieņemtu SJO konvencijas grozījumus attiecībā uz likumīgā statusa piešķiršanu Attīstības komitejai SJO konvencijā,

Ņemot vērā Attīstības komitejas ieteikumus attiecībā uz piedāvātajiem SJO konvencijas grozījumiem un Padomes viedokļus par šiem ieteikumiem,

1. Pieņem Starptautiskās Jūrniecības organizācijas konvencijas grozījumus, kuru tekstus ietver šīs rezolūcijas pielikums, kurš sastāv no:

11., 15., 21., 25., 56. un 57. panta grozījumiem;

— jaunas daļas pievienošanas, kura ietver jaunus pantus no 47. līdz 51;

— sekojošas esošo daļu XI līdz XX pārnumurēšanas;

— sekojošas esošo pantu 47. līdz 51. pārnumurēšanas;

— sekojošām izmaiņām atsaucēs uz pārnumurētajiem pantiem 5., 6., 7., 8., 66., 67., 68., 70., 72., 73. un 74. pantā;

— sekojošām izmaiņām, atsaucēs uz pārnumurētajām daļām 15. pantā un 25. panta (a) punktā;

— sekojošām izmaiņām attiecībā uz pārnumurētā panta numuru II pielikumā;

2. Lūdz Organizācijas Ģenerālsekretāram deponēt Apvienoto Nāciju Ģenerālsekretāram pieņemtos grozījumus saskaņā ar SJO konvencijas 72. pantu (sākotnēji 67. pants) un saņemt pievienošanās un paziņojumu instrumentus, kā tas noteikts 73. pantā (sākotnēji 68. pants); un

3. Uzaicina Dalībnieku valdības akceptēt šos grozījumus iespējami ātrāk pēc kopiju saņemšanas, nosūtot attiecīgos akceptēšanas instrumentus Ģenerālsekretāram saskaņā ar Konvencijas 73. pantu (sākotnēji 68. pants).

11. pants

Teksts ir aizstāts ar sekojošu:

"Organizācija sastāv no Asamblejas, Padomes, Kuģošanas Drošības komitejas, Juridiskās komitejas, Jūras Vides Aizsardzības komitejas, Tehniskās Sadarbības komitejas, Attīstības komitejas un tādām pakārtotām institūcijām, kādas Organizācija var jebkurā laikā uzskatīt par nepieciešamām; un Sekretariāta."

15. pants

(a) punkta teksts ir aizstāts ar:

"(a) pieņemt lēmumus attiecībā uz jebkuras starptautiskas konferences sasaukšanu vai sekojoši jebkuru citu atbilstošu darbību sakarā ar starptautisko konvenciju pieņemšanu vai grozījumu, kurus izstrādājusi Kuģošanas Drošības komiteja, Juridiskā komiteja, Jūras Vides Aizsardzības komiteja, Tehniskās Sadarbības komiteja, Attīstības komiteja vai citas Organizācijas institūcijas;"

21. pants

Teksts ir aizstāts ar sekojošu:

"(a) Padome apspriež darba programmas projektu un budžeta tāmes, ko sagatavojis Ģenerālsekretārs, ievērojot Kuģošanas drošības komitejas, Juridiskās komitejas, Jūras vides aizsardzības komitejas, Tehniskās sadarbības komitejas, Attīstības komitejas un citu organizācijas institūciju priekšlikumus, un ņemot tos vērā, izstrādā un iesniedz Asamblejai Organizācijas darba programmu un budžetu, ievērojot Organizācijas vispārējās intereses un prioritātes.

(b) Padome saņem Kuģošanas drošības komitejas, Juridiskās komitejas, Jūras vides aizsardzības komitejas, Tehniskās sadarbības komitejas, Attīstības komitejas un citu Organizācijas institūciju ziņojumus, priekšlikumus un rekomendācijas un nosūta tās Asamblejai, bet Asamblejas sesiju starplaikos, Dalībniekiem informācijai, kopā ar Padomes komentāriem un ieteikumiem.

(c) Jautājumus, kurus ietver 28., 33., 38., 43. un 48. pants, Padome izskata tikai pēc, atbilstoši, Kuģošanas drošības komitejas, Juridiskās komitejas, Jūras vides aizsardzības komitejas, Tehniskās sadarbības komitejas vai Attīstības komitejas viedokļu saņemšanas."

25. pants

(b) punkta teksts ir aizstāts:

(b) Ņemot vērā XVI daļas noteikumus un attiecības ar attiecīgo Komiteju institūcijām saskaņā ar 28., 33., 38., 43. un 48. pantiem, Padome, Asamblejas sesiju starplaikā ir atbildīga par attiecībām ar citām organizācijām.

XI daļa

Ievietots šāds jauns teksts:

"ATTĪSTĪBAS KOMITEJA

47. pants

Attīstības komiteja sastāv no visiem Dalībniekiem.

48. pants

Attīstības komiteja izskata jebkuru jautājumu Organizācijas ietvaros, kurš saistīts ar starptautisko jūras transportu un īpaši:

(a) veic tādas funkcijas, kuras ir nodotas vai var būt nodotas Organizācijai saskaņā ar starptautiskajām konvencijām par starptautiskā jūras satiksmes veicināšanu, īpaši attiecībā uz mēru vai citu noteikumu pieņemšanu vai grozīšanu, kā nosaka šīs konvencijas;

(b) Ņemot vērā 25. panta noteikumus Attīstības komiteja uztur saiknes ar citām institūcijām pēc Asamblejas vai Padomes pieprasījuma vai, ja komiteja pati uzskata to par lietderīgu Organizācijas mērķu izpildes veicināšanai.

49. pants

Attīstības komiteja iesniedz Padomei:

(a) Rekomendācijas un vadlīnijas, kuras komiteja ir izstrādājusi;

(b) Ziņojumu par komitejas darbu kopš pagājušās Padomes sesijas.

50. pants

Attīstības komiteja sanāk vismaz vienu reizi gadā. Tā vienu reizi gadā ievēl savas amatpersonas un pieņem savus procesa noteikumus.

51. pants

Neņemot vērā neko, kas izteikts pretēji šajā Konvencijā, bet ievērojot 47. panta noteikumus, Attīstības komiteja, pildot funkcijas, kuras tai nodotas saskaņā ar starptautisko konvenciju vai citu starptautisku instrumentu, saskaņo savu darbību ar attiecīgajiem konvencijas vai instrumenta noteikumiem, īpaši, attiecībā uz procedūras noteikumiem."

56. pants (pārnumurēts kā 61.)

Teksts ir aizstāts ar sekojošu:

"Jebkurš Dalībnieks, kas gada laikā neizpilda savus finansiālos pienākumus attiecībā pret Organizāciju, skaitot no dienas, kad uzlikts šāds pienākums, zaudē balss tiesības Asamblejā, Padomē, Kuģošanas drošības komitejā, Juridiskajā komitejā, Jūras vides aizsardzības komitejā vai Tehniskās sadarbības komitejā, Attīstības komitejā, ja vien Asambleja, pēc tās ieskata, neatsakās no šī noteikuma."

57. pants ( pārnumurēts kā 62.)

Teksts ir aizstāts ar sekojošu:

"Ja vien Konvencijā vai jebkurā starptautiskā līgumā, kas piešķir funkcijas Asamblejai, Padomei, Kuģošanas drošības komitejai, Juridiskajai komitejai, Jūras vides aizsardzības komitejai, Tehniskās sadarbības komitejai vai Attīstības komitejai nav noteikts citādi, balsojot šajās institūcijās pielieto sekojošos noteikumus:

(a) katram Dalībniekam ir viena balss.

(b) lēmumus pieņem ar klātesošo un balsojošo Dalībnieku balsu vairākumu un lēmumos, kur nepieciešams divu trešdaļu balsu vairākums, ar divu trešdaļu balsu vairākumu no tiem, kas ir klāt.

(c) šajā konvencijā ar frāzi "klātesošie un balsojošie Dalībnieki saprot "klātesošos Dalībniekus, kas balso apstiprinoši vai noliedzoši". Dalībnieki, kas atturas no balsošanas, uzskatāmi par nebalsojušiem."

Starptautiskās Jūrniecības organizācijas konvencijas grozījumi

Asambleja,

Atsaucoties uz to , ka tās septiņpadsmitajā regulārajā sesijā vairākas delegācijas izteica interesi par Padomes vēlēšanu rezultātu 1992. - 1993. gadam,

Atzīmējot, ka Padome, tās sešdesmit astotajā sesijā izveidojusi ad hoc Darba grupu, kas ir atvērta visiem Organizācijas Dalībniekiem, lai izskatītu iespējamos Padomes vēlēšanu noteikumu grozījumus,

Ar gandarījumu atzīmējot, ka nepieciešamā SJO konvencijas pārskatīšana ir uzsākta Organizācijas ietvaros un ir izskatīta savstarpēji labvēlīgā gaisotnē un apstiprināta dalībniekiem vispārēji vienojoties,

Ņemot vērā SJO Konvencijas grozījumus, ko ieteikusi Padomes vēlēšanu ad hoc Darba grupa un kurus apstiprinājusi Padomes tās sešdesmit devītajā sesijā,

1. Apstiprina Starptautiskās Jūrniecības organizācijas Konvencijas 16., 17. un 19. panta grozījumus, kuru teksti ir ietverti šīs rezolūcijas pielikumā;

2. Lūdz Organizācijas Ģenerālsekretāram deponēt Apvienoto Nāciju Ģenerālsekretāram pieņemtos grozījumus, saskaņā ar SJO Konvencijas 67. pantu un saņemt pievienošanās un paziņojumu instrumentus, kā tas noteikts 68. pantā; un

3. Uzaicina Organizācijas Dalībniekus akceptēt šos grozījumus iespējami ātrāk pēc kopiju saņemšanas, nosūtot attiecīgos akceptēšanas instrumentus Ģenerālsekretāram saskaņā ar Konvencijas 68. pantu.

VI daļa

Padome

16. pants

16. panta tekstu aizstāt ar:

"Padome sastāv no četrdesmit dalībniekiem, kurus ievēl Asambleja."

17. pants

17. panta tekstu aizstāt ar:

"Ievēlot Padomes dalībniekus, Asambleja ņem vērā šādus principus:

(a) desmit valstis ar vislielāko nozīmi starptautisko kuģošanas pakalpojumu sniegšanā;

(b) desmit citas valstis ar vislielāko nozīmi starptautiskajā jūras tirdzniecībā;

(c) divdesmit valstis, kuras nav ievēlētas saskaņā ar augstākminētajiem (a) vai (b) apakšpunktiem, kurām ir īpaša nozīme jūras transportā vai navigācijā, un kuru ievēlēšana Padomē nodrošinās pasaules visu lielāko ģeogrāfisko zonu pārstāvību."

19(b). pants

Aizstāt 19. panta (b) punktu ar:

"(b) Divdesmit seši Padomes dalībnieki sastāda kvorumu."
