prezidents izsludina šādu likumu:
Par Latvijas Republikas un Polijas Republikas brīvās tirdzniecības līguma Apvienotās komitejas lēmumu Nr. 1/1999 "Par izmaiņām Latvijas Republikas un Polijas Republikas brīvās tirdzniecības līguma 3.protokolā"

1.pants. 1999.gada 1.jūlijā Rīgā parakstītais Latvijas Republikas un Polijas Republikas brīvās tirdzniecības līguma Apvienotās komitejas lēmums nr. 1/1999 "Par izmaiņām Latvijas Republikas un Polijas Republikas brīvās tirdzniecības līguma 3.protokolā" (turpmāk — Lēmums) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Lēmums latviešu un angļu valodā.

3.pants. Lēmums stājas spēkā tā 2.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

Likums Saeimā pieņemts 2000.gada 21.septembrī.

Latvijas Republikas un Polijas Republikas brīvas tirdzniecības līguma Apvienotās komitejas lēmums Nr. 1/1999 par izmaiņām Latvijas Republikas un Polijas Republikas brīvās tirdzniecības līguma 3.protokolā

Latvijas Republika (turpmāk tekstā Latvija) un Polijas Republika (turpmāk tekstā Polija),

Atsaucoties uz 1997.gada 28.aprīlī Varšavā parakstīto Brīvās tirdzniecības līgumu starp Latvijas Republiku, no vienas puses, un Polijas Republiku, no otras puses, tā 38.pantu un 3.Protokola 36.pantu;

Ievērojot to, ka 3.Protokola termina "izcelsmes produkti" definīcija ir jāmaina, lai nodrošinātu paplašinātās kumulācijas sistēmas, kas pieļauj Eiropas Kopienas, Polijas Republikas, Ungārijas Republikas, Čehijas Republikas, Slovākijas Republikas, Bulgārijas Republikas, Rumānijas, Latvijas Republikas, Lietuvas Republikas, Igaunijas Republikas, Slovēnijas Republikas, Eiropas Ekonomiskās Telpas (turpmāk tekstā "EET"), Islandes, Norvēģijas un Šveices izcelsmes materiālu lietošanu, atbilstošu darbību;

Ievērojot to, ka starp Kopienu un Turciju pastāv īpaši noteikumi attiecībā uz industriālo produktu iegādi, būtu jārekomendē turpināt piemērot līdz 2000.gada 31.decembrim 3.Protokola 15.pantā minēto noteiktas likmes maksājumu sistēmu saistībā ar aizliegumu atmaksāt muitas nodokli vai atbrīvot no tā;

Ievērojot to, ka būtu nepieciešams paplašināt kumulācijas sistēmu arī uz noteiktām Turcijas izcelsmes precēm,

Ievērojot to, ka būtu vēlams mainīt 3.Protokola 3., 4. un 12.pantu formulējumus, lai veicinātu tirdzniecību un vienkāršotu administratīvos uzdevumus;

Ievērojot to, ka jāprecizē apstrādes un pārstrādes noteikumu saraksts, kas jāizpilda neizcelsmes materiāliem, lai tie iegūtu izcelsmes statusu, ņemot vērā izmaiņas pārstrādes metodēs un atsevišķu izejmateriālu trūkumu,

IR NOLĒMUŠAS SEKOJOŠO:

1. pants

3. Protokols par "izcelsmes produktu" jēdziena definējumu un administratīvās sadarbības metodēm tiek mainīts sekojoši:

1) 1. (i) pants tiek aizvietots ar:

"(i) par "pievienoto vērtību" tiek uzskatīta ex-works cena mīnus katra iekļautā materiāla, kuru izcelsme ir kāda no 3. un 4.pantā minētajām valstīm, muitas vērtība vai, ja muitas vērtība nav zināma vai to nevar noteikt, pirmā cena, ko apstiprināmi maksā par šīm precēm Latvijā vai Polijā.";

2) 3. un 4.panti tiek aizvietoti ar sekojošo:

"3. pants

Kumulācija Latvijā

1. Nekādi neietekmējot 2.panta 1.paragrāfa nosacījumus, produkti tiks uzskatīti par Latvijas izcelsmes produktiem, ja tie ir iegūti tur, iekļaujot Latvijas, Kopienas, Polijas, Bulgārijas, Ungārijas, Čehijas, Slovākijas, Rumānijas, Lietuvas, Igaunijas, Slovēnijas, Islandes, Norvēģijas, Šveices (ieskaitot Lihtenšteinu*) vai Turcijas izcelsmes materiālus, saskaņā ar līgumu starp Latviju un katru no šīm valstīm Protokolu par preču izcelsmes noteikumu nosacījumiem, nodrošinot, ka Latvijā veiktā apstrāde vai pārstrāde pārsniedz šī Protokola 7.pantā minēto. Šādiem materiāliem nav jābūt izgājušiem pietiekamu apstrādi vai pārstrādi.

2. Ja apstrāde vai pārstrāde, kas veikta Latvijā nepārsniedz 7.pantā minētās darbības, iegūtais produkts tiks uzskatīts par Latvijas izcelsmes produktu tikai tad, ja vērtība, kas tur pievienota, ir lielāka par izmantoto jebkuras no 1.paragrāfā minētās valsts izcelsmes materiālu vērtību. Ja tā nav, iegūtais produkts tiek uzskatīts par tās valsts izcelsmes produktu, kuras izmantoto materiālu ražošanai Latvijā vērtība ir vislielākā.

3. Produkti, kuru izcelsme ir kāda no 1.paragrāfā minētajām valstīm un kuri netiek pakļauti jebkādai apstrādei vai pārstrādei Latvijā, saglabā to izcelsmi, ja tiek eksportēti uz kādu no šīm valstīm.

4. Kumulācija, kas nodrošināta ar šo pantu, var tikt pielietota tikai attiecībā uz materiāliem un produktiem, kas ieguvuši savu izcelsmi piemērojot identiskus izcelsmes noteikumus šajā Protokolā minētajiem.

4. pants

Kumulācija Polijā

1. Nekādi neietekmējot 2.panta 2.paragrāfa nosacījumus, produkti tiks uzskatīti par Polijas izcelsmes produktiem, ja tie ir iegūti tur, iekļaujot Latvijas, Kopienas, Polijas, Bulgārijas, Ungārijas, Čehijas, Slovākijas, Rumānijas, Lietuvas, Igaunijas, Slovēnijas, Islandes, Norvēģijas, Šveices (ieskaitot Lihtenšteinu*) vai Turcijas izcelsmes materiālus, saskaņā ar līgumu starp Poliju un katru no šīm valstīm Protokolu par preču izcelsmes noteikumiem nosacījumiem, nodrošinot, ka Polijā veiktā apstrāde vai pārstrāde pārsniedz šī Protokola 7.pantā minēto. Šādiem materiāliem nav jābūt izgājušiem pietiekamu apstrādi vai pārstrādi.

2. Ja apstrāde vai pārstrāde, kas veikta Polijā nepārsniedz 7.pantā minētās operācijas, iegūtais produkts tiks uzskatīts par Polijas izcelsmes produktu tikai tad, ja vērtība, kas tur pievienota, ir lielāka par izmantoto jebkuras no 1.paragrāfā minētās valsts izcelsmes materiālu vērtību. Ja tā nav, iegūtais produkts tiek uzskatīts par tās valsts izcelsmes produktu, kuras izmantoto materiālu ražošanai Polijā vērtība ir vislielākā.

3. Produkti, kuru izcelsme ir kāda no 1.paragrāfā minētajām valstīm un kuri netiek pakļauti jebkādai apstrādei vai pārstrādei Polijā, saglabā to izcelsmi, ja tiek eksportēti uz kādu no šīm valstīm.

4. Kumulācija, kas nodrošināta ar šo pantu, var tikt pielietota tikai attiecībā uz materiāliem un produktiem, kas ieguvuši savu izcelsmi piemērojot identiskus izcelsmes noteikumus šajā Protokolā minētajiem."

3) 12.pants tiek aizvietots ar sekojošo:

"12. pants

Teritoriālais princips

1. Izņemot kā noteikts 3. un 4.pantos un šī panta 3.paragrāfā, II nodaļā aprakstītajiem nosacījumiem izcelsmes iegūšanai ir jābūt izpildītiem Latvijā vai Polijā.

2. Izņemot kā dots 3. un 4.pantos, ja izcelsmes preces, kas eksportētas no Latvijas vai Polijas uz citu valsti, tiek atsūtītas atpakaļ, tās jāuzskata par neizcelsmes, ja vien muitas iestādēm var pierādīt, ka:

(a) atpakaļ atsūtītās preces ir tās pašas preces, kuras tika eksportētas; un

(b) tās nav tikušas pakļautas nekādām darbībām vairāk kā tām, kas nepieciešamas, lai saglabātu tās labā stāvoklī kamēr tās atradās šajā valstī vai kamēr tikušas eksportētas.

3. Izcelsmes statusa iegūšanu saskaņā ar II nodaļā aprakstītajiem noteikumiem neietekmēs ārpus Latvijas vai Polijas veiktā apstrāde vai pārstrāde materiāliem, kuri eksportēti no Latvijas vai Polijas un pēc tam reimportēti tur, nodrošinot, ka:

(a) minētie materiāli ir pilnībā iegūti Latvijā vai Polijā vai tiem pirms eksportēšanas ir veikta apstrāde vai pārstrāde vairāk kā 7.pantā aprakstītās nepietiekamās operācijas; un

(b) muitas iestādēm var uzrādīt, ka:

(i) reimportētās preces ir iegūtas, apstrādājot vai pārstrādājot eksportētos materiālus; un

(ii) kopējā pievienotā vērtība, kas iegūta ārpus Latvijas vai Polijas, piemērojot šī panta nosacījumus, nepārsniedz 10% no gala produkta, kam tiek pieprasīts izcelsmes statuss, ex-works cenas.

4. 3.paragrāfa nolūkiem II nodaļā aprakstītie izcelsmes statusa iegūšanas noteikumi neattieksies uz apstrādi vai pārstrādi, kas veikta ārpus Latvijas vai Polijas. Ja II pielikuma sarakstā, nosakot gala produkta izcelsmes statusu, tiek piemērots noteikums, kas nosaka maksimālo vērtību visiem izmantotajiem neizcelsmes materiāliem, visu neizcelsmes materiālu, kas izmantoti ieinteresētās puses teritorijā, kopējā vērtība, saskaitot kopā ar kopējo pievienoto vērtību, kas iegūta ārpus Latvijas vai Polijas, piemērojot šī panta noteikumus, nepārsniegs minēto daudzumu procentuāli.

5. 3. un 4.paragrāfu noteikumu piemērošanas nolūkā "kopējā pievienotā vērtība" nozīmē visas izmaksas, kas rodas ārpus Latvijas vai Polijas, ieskaitot tur izmantoto materiālu vērtību.

6. 3. un 4.paragrāfu noteikumi neattiecas uz produktiem, kuri neatbilst II pielikuma sarakstā dotajiem nosacījumiem vai kuri var tikt uzskatīti kā pietiekami apstrādāti vai pārstrādāti tikai, ja tiek pielietoti 6(2).pantā aprakstītie vispārīgie noteikumi.

7. 3. un 4.paragrāfu noteikumi neattiecas uz produktiem, kuri tiek aprakstīti Harmonizētās Sistēmas 50. līdz 63.nodaļās.

8. Jebkura veida apstrāde vai pārstrāde, kas ietverta šī panta noteikumos un kas veikta ārpus Latvijas vai Polijas, tiks veikta saskaņā ar līgumiem par ievešanu uz pārstrādi vai līdzīgiem līgumiem."

4) 13., 14., 15., 17., 21., 27., 30. un 32.pantos vārdi "... 4.pantā ..." tiks aizvietots ar "... 3. un 4.pantos ...";

5) 15.pantā tiek pievienots sekojošs paragrāfs 6:

"Neskatoties uz 1.paragrāfu, Polija un Latvija var pielietot nosacījumus muitas nodokļu vai nodokļu ar ekvivalentu efektu trūkumu vai izņēmumus no tiem piemērotiem materiāliem, kas tiek lietoti izcelsmes produktu lietošanā kā subjekti sekojošiem nosacījumiem:

a) 5% muitas tarifu likme tiek saglabāta Harmonizētās Sistēmas 25-49 un 64-97 nodaļu attiecīgajām precēm, vai tā zemākā likme, kas ir spēkā kādā no Pusēm;

b) 10% muitas tarifu likme var tikt saglabāta Harmonizētās Sistēmas 50.-63.nodaļu attiecīgajām precēm vai tā zemākā likme, kas ir spēkā Polijā vai Latvijā.

Šī paragrāfa noteikumi tiek piemēroti līdz 2000.gada 31.decembrim un var tikt pārskatīti pēc Pušu savstarpējās vienošanās.

6) 26(1). pantā termini "C2/CP3" tiks aizvietoti ar "CN22/CN23";

7) I pielikuma 5.2. piezīmē:

(a) starp uzskaitījumu

"- mākslīgie pavedieni" un

"- sintētiskās štāpeļšķiedras no polipropilēna"

tiks ievietots sekojošais:

"- strāvu vadoši pavedieni"

(b) piektais piemērs ("Tepiķis ar pušķiem ... svara nosacījumi.") tiks svītrots,

8) II pielikums tiks mainīts sekojoši:

(a) sekojošais tiek ielikts starp HS pozīcijām 2202 un 2208:

"HSpozīcija

Preces apraksts

Ar neizcelsmes materiāliem veiktā apstrāde vai pārstrāde, lai tie iegūtu izcelsmes statusu

2207Nedenaturēts etilspirts ar spirta 80% vai vairāk no tilpuma;

etilspirts un citi spirti, denaturēti, ar jebkuru spirta saturu

Ražošana:

- izmantojot materiālus, kas netiek klasificēti 2207 vai 2208 pozīcijās"

(b) ieraksts 57.nodaļai tiks mainīts ar:

"HS pozīcija

Preces apraksts

Ar neizcelsmes materiāliem veiktā apstrāde vai pārstrāde, lai tie iegūtu izcelsmes statusu

57.nodaļaPaklāji un citas tekstila grīdsegas:

- No adatu cauršūtā filca

Ražošana no 1:

- dabīgajām šķiedrām, vai ķīmiskiem materiāliem, vai tekstila pulpas

Tomēr var izmantot:

- 5402 pozīcijā klasificēto polipropilēna pavedienu,

- 5503 vai 5506 pozīcijā klasificētos polipropilēna pavedienus,

- 5501 pozīcijas polipropilēna pavedienu grīstes, kuru lineārais blīvums visos monopavediena vai šķiedras gadījumos ir mazāks par 9 decitekiem, nodrošinot, ka to vērtība nepārsniedz 40% no produkcijas ex works cenas

-džutas audumi var tikt izmantoti oderējumam
- No pārējā filcaRažošana no 1:

- nekārstām vai neķemmētām vai citādi neapstrādātām dabīgām šķiedrām, ķīmiskiem materiāliem vai tekstila pulpas

- PārējieRažošana no 1:

- kokosšķiedras vai džutas dzijas 2,

- sintētiskās vai mākslīgās pavedienu dzijas,

- dabīgām šķiedrām, vai

- nekārstām vai neķemmētām, vai citādi vērpšanai neapstrādātām sintētiskām štāpeļšķiedrām

- džutas audumi var tikt lietoti oderējumam

(c) HS pozīcijas 7006 ieraksts tiks mainīts ar:

"7006Preču pozīcijās 7003, 7004 vai 7005 klasificētais stikls, izliekts, slīpēts, gravēts, urbts, emaljēts vai citādā veidā apstrādāts, bez rāmja, un nav kombinēts ar citiem materiāliem:

- stikla plāksne, kas pārklāta ar dielektrisku pārklājumu, pusvadītāju kategorija saskaņā ar SEMII 1 standartiem

- pārējie
Ražošana no nepārklāta stikla plāksnes, kas klasificēta 7006 pozīcijā.

Ražošana no 7001 pozīcijā klasificētajiem materiāliem.

(d) HS pozīcijas 7601 noteikumi tiks aizvietoti ar:

nepārsniedz 50 % produkta

- visi izmantotie materiāli tiek klasificēti citā pozīcijā kā produkts;

un

- visu izmantoto materiālu vērtība nepārsniedz 50% produkta ex-works cenas vai

Ražošana no termiski vai elektrolītiski apstrādāta nekausēta alumīnija vai alumīnija atgriezumiem un lūžņiem";

2. pants

Lēmums stāsies spēkā piecpadsmitajā dienā pēc Puses pēdējā paziņojuma par iekšējo juridisko procedūru par spēkā stāšanos prasību izpildi.

APLIECINOT IEPRIEKŠ MINĒTO, attiecīgas amatpersonas ir parakstījušas šo Lēmumu.

PARAKSTĪTS Rīgā, 1999.gada 1.jūlijā divos oriģināleksemplāros, katrs no tiem latviešu, poļu un angļu valodā, visi teksti ir vienlīdz autentiski. Atšķirīgas interpretācijas gadījumā dominē Lēmuma teksts angļu valodā.

Decision No. 1/1999 of the Joint Committee of the Free Trade Agreement between the Republic of Latvia and the Republic of Poland on Amendments to the Protocol 3 on Rules of Origin to the Free Trade Agreement between the Republic of Latvia and the Republic of Poland

The Republic of Latvia (hereinafter called Latvia ) and Republic of Poland (hereinafter called Poland),

Having regard to the Free Trade Agreement between the Republic of Poland , of the one part, and the Republic of Latvia, of the other part, signed in Warsaw on 28 April 1997, and in particular Article 38 thereof and Article 36 of the Protocol 3,

Whereas within this Protocol 3 the definition of the term "originating products" needs to be amended to ensure the proper operation of the extended system of cumulation which permits the use of materials originating in the European Community, the Republic of Poland, the Republic of Hungary, the Czech Republic, the Slovak Republic, the Republic of Bulgaria, Romania, the Republic of Estonia, Republic of Lithuania, the Republic of Latvia, the Republic of Slovenia, the European Economic Area (hereinafter referred to as "the EEA"), Iceland, Norway and Switzerland;

Whereas it would seem advisable to introduce the system of flat rate charges in Article 15 of this Protocol 3 in connection with the prohibition of drawback and exemption from customs duty until 31 December 2000;

Whereas, in view of the particular arrangements on industrial products obtaining between the Community and Turkey, it would also be appropriate to extend the cumulation system to such products originating in Turkey;

Whereas to facilitate trade and simplify administrative tasks it is desirable to amend the wording of Articles 3, 4 and 12 of Protocol 3;

Whereas, take account of changes in processing techniques and shortages of certain raw materials, some corrections must be made to the list of working and processing requirements which non-originating materials have to fulfil to qualify for originating status,

HAVE DECIDED AS FOLLOWS:

Article 1

Protocol 3 concerning the definition of the concept of "originating products" and methods of administrative cooperation is hereby amended as follows:

1) Article 1(i) shall be replaced by:

"(i) "added value" shall be taken to be the ex-works price minus the customs value of each of the materials incorporated which originate in the other countries referred to in Article3 and 4 or, where the customs value is not known or cannot be ascertained, the first price verifiably paid for the products in Latvia or Poland.";

2) Articles 3 and 4 shall be replaced by the following:

"Article 3

Cumulation in Latvia

1. Without prejudice to the provisions of Article 2(1) products shall be considered as originating in Latvia if such products are obtained there, incorporating materials originating in Latvia, the Community, Poland, Bulgaria, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein*) or Turkey in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between Latvia and each of these countries, provided that the working or processing carried out in Latvia goes beyond that referred to in Article 7 of this Protocol. It shall not be necessary that such materials have undergone sufficient working or processing.

2. Where the working or processing carried out in Latvia does not go beyond the operations referred to in Article 7, the product obtained shall be considered as originating in Latvia only where the value added there is greater than the value of the materials used originating in any one of the other countries referred to in paragraph 1. If this is not so, the product obtained shall be considered as originating in the country which accounts for the highest value of originating materials used in the manufacture in Latvia.

3. Products, originating in one of the countries referred to in paragraph 1, which do not undergo any working or processing in Latvia, retain their origin if exported into one of these countries.

4. The cumulation provided for in this Article may only be applied to materials and products which have acquired originating status by an application of rules of origin identical to those given in this Protocol.

Article 4

Cumulation in Poland

1. Without prejudice to the provisions of Article 2(2), products shall be considered as originating in Poland if such products are obtained there, incorporating materials originating in Latvia, the Community, Poland, Bulgaria, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein*) or Turkey in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between Poland and each of these countries, provided that the working or processing carried out in Poland goes beyond that referred to in Article 7 of this Protocol. It shall not be necessary that such materials have undergone sufficient working or processing.

2. Where the working or processing carried out in Poland does not go beyond the operations referred to in Article 7, the product obtained shall be considered as originating in Poland only where the value added there is greater than the value of the materials used originating in any one of the other countries referred to in paragraph 1. If this is not so, the product obtained shall be considered as originating in the country which accounts for the highest value of originating materials used in the manufacture in Poland.

3. Products, originating in one of the countries referred to in paragraph 1, which do not undergo any working or processing in Poland, retain their origin if exported into one of these countries.

4. The cumulation provided for this Article may only be applied to materials and products which have acquired originating status by an application of rules of origin identical to those given in this Protocol.";

* The principality of Liechtenstein has a customs union with Switzerland, and is a Contracting Party to the Agreement on the European Economic Area.

3) Article 12 shall be replaced by the following:

" Article 12

Principle of territoriality

1. Except as provided for in Articles 3 and 4 and paragraph 3 of this Article, the conditions for acquiring originating status set out in Title II must continue to be fulfilled at all times in Latvia or Poland.

2. Except as provided for in Articles 3 and 4, where originating goods exported from Latvia or Poland to another country return, they must be considered as non-originating, unless it can be demonstrated to the satisfaction of the customs authorities that:

(a) the returning goods are the same as those that were exported; and

(b) they have not undergone any operation beyond that necessary to preserve them in good condition while in that country or while being exported.

3. The acquisition of originating status in accordance with the conditions set out in Title II shall not be affected by working or processing done outside Latvia or Poland on materials exported from Latvia or Poland and subsequently reimported there, provided:

(a) the said materials are wholly obtained in Latvia or Poland or have undergone working or processing beyond the insufficient operations listed in Article 7 prior to being exported; and

(b) it can be demonstrated to the satisfaction of the customs authorities that:

(i) the reimported goods have been obtained by working or processing the exported materials; and

(ii) the total added value acquired outside Latvia or Poland by applying the provisions of this Article does not exceed 10% of the ex-works price of the end product for which originating status is claimed.

4. For the purposes of paragraph 3, the conditions for acquiring originating status set out in Title II shall not apply to working or processing done outside Latvia or Poland. But where, in the list in Annex II, a rule setting a maximum value for all the non-originating materials incorporated is applied in determining the originating status of the end product, the total value of the non-originating materials incorporated in the territory of the party concerned, taken together with the total added value acquired outside Latvia or Poland by applying the provision of this Article, shall not exceed the stated percentage.

5. For the purposes of applying the provisions of paragraphs 3 and 4, "total added value" shall be taken to mean all costs arising outside Latvia or Poland, including the value of the materials incorporated there.

6. The provisions of paragraphs 3 and 4 shall not apply to products which do not fulfil the conditions set out in the list in Annex II or which can be considered sufficiently worked or processed only if the general values fixed in Article 6(2) are applied.

7. The provisions of paragraphs 3 and 4 shall not apply to products coming under Chapters 50 to 63 of the Harmonised System.

8. Any working or processing of the kind covered by the provisions of this Article and done outside Latvia or Poland shall be done under the outward processing arrangements, or similar arrangements.";

4) In Articles 13,14,15,17,21,27,30 and 32, the phrase "referred to in Article 4" shall be replaced by "referred to in Articles 3 and 4" ;

5) In Article 15 the following paragraph 6 shall be added:

"Notwithstanding paragraph 1, Poland and Latvia may apply arrangements for drawback of, or exemption from, customs duties or charges having an equivalent effect, applicable to materials used in the manufacture of originating products, subject to the following provisions

a) a 5 per cent of customs charge shall be retained in respect of products falling within Chapters 25 to 49 and 64 to 97 of the Harmonized System, or such lower rate as is in force in Poland or Latvia;

b) a 10 per cent of customs charge shall be retained in respect of products falling within Chapters 50 to 63 of the Harmonized System, or such lower rate as is in force in Poland or Latvia.

The provisions of this paragraph shall be apply until 31 December 2000 and may be reviewed by common accord.";

6) In Article 26 (1), the terms C2/CP3" shall be replaced by "CN22/CN23";

7) In Annex I, Note 5.2 :

(a) between the indents

"- artificial man-made filaments" and

"- synthetic man-made staple fibres of polypropylene",

the following shall be inserted:

"- current conducting filaments";

(b) the fifth Example ("A carpet with tufts ...are met.") shall be deleted;

8) In Annex II shall be amended as follows:

(a) the following shall be inserted between the entries for HS heading Nos 2202 and 2208:

Manufacture by thermal or electrolytic treatment from unalloyed aluminium or waste and scrap of aluminium";

Article 2

This Decision shall enter into force fifteen days after the last notification of the Party that its internal legal procedures related to entering into force of the Agreement have been completed.

IN WITNESS WHEREOF the undersigned plenipotentiaries, being duly authorised thereto, have signed this Decision.

DONE at Riga, this first day of July, one thousand nine hundred and ninety nine in duplicate copies in the Latvian, Polish and English languages, all texts being equally authentic. In case of divergence the English text shall prevail.
