Procedures for Reporting Occurrences in Civil Aviation

Issued pursuant to
Section 64, Paragraph four of the law On Aviation

1. This Regulation prescribes the procedures by which such occurrences in civil aviation shall be reported which influence the safety of the flight of an aircraft.

2. The terms used in this Regulation conform to the terms used in Article 2 of Regulation (EU) No 376/2014 of the European Parliament and of the Council of 3 April 2014 on the reporting, analysis and follow-up of occurrences in civil aviation, amending Regulation (EU) No 996/2010 of the European Parliament and of the Council and repealing Directive 2003/42/EC of the European Parliament and of the Council and Commission Regulations (EC) No 1321/2007 and (EC) No 1330/2007 (hereinafter - Regulation No 376/2014).

3. Occurrences in civil aviation shall be reported by complying with Regulation No 376/2014, Commission Implementing Regulation (EU) 2015/1018 of 29 June 2015 laying down a list classifying occurrences in civil aviation to be mandatorily reported according to Regulation (EU) No 376/2014 of the European Parliament and of the Council, and the requirements of this Regulation.

4. This Regulation shall apply to occurrences in civil aviation which are referred to in Articles 3(1)(a), 3(2), 4(1) of Regulation No 376/2014, as well as to occurrences in civil aviation and other information related to safety regarding such aircraft involved which have been included in Article 4(4) and Annex 2 to Regulation (EC) No 216/2008 of the European Parliament and of the Council of 20 February 2008 on common rules in the field of civil aviation and establishing a European Aviation Safety Agency, and repealing Council Directive 91/670/EEC, Regulation (EC) No 1592/2002 and Directive 2004/36/EC.

5. The State agency "Civil Aviation Agency" (hereinafter - the Civil Aviation Agency) shall carry out the duties of a Member State in accordance with Articles 4(3), 5(2), 7(3), 8(2), 9, 13(6), (7), (8), (10), (11) and (12), 15(1) and (2), 16(3), as well as shall be the competent authority within the meaning of Article 6(3) of Regulation No 376/2014.

6. The Transport Accident and Incident Investigation Bureau shall be the safety investigation authority within the meaning of Article 2(11) of Regulation No 376/2014.

7. The Civil Aviation Agency shall, in conformity with Articles 4(3), 5(2), (4) and (8), 6(3), (6) and (7), 7(4), 9(1), 15(1), 16(3) of Regulation No 376/2014, maintain a database of reports in which information regarding the occurrences in civil aviation referred to in Paragraph 4 of this Regulation is aggregated and stored.

8. The persons referred to in Article 4(6) of Regulation No 376/2014 shall report the occurrences in civil aviation referred to in Paragraph 4 of this Regulation to the Civil Aviation Agency in accordance with the procedures indicated in the introductory part of Article 4(6) of Regulation No 376/2014 and within the time period specified in Article 4(7) of Regulation No 376/2014.

9. The Civil Aviation Agency in co-operation with the Transport Accident and Incident Investigation Bureau shall, in conformity with Article 13(11) of Regulation No 376/2014, prepare and publish a report on safety of civil aviation aircraft flights on the website of the Civil Aviation Agency www.caa.lv.

10. The Civil Aviation Agency may prepare and publish information on the website of the Civil Aviation Agency www.caa.lv regarding occurrences in civil aviation and results of risk analysis by complying with data anonymity in conformity with Article 13(12) of Regulation No 376/2014 and the Personal Data Protection Law.

11. The person referred to in Article 4(6) of Regulation No 376/2014 which is of the opinion that the principle of "just culture" referred to in Article 2(12), 6(1), 16(9) and (11) of Regulation No 376/2014 is not observed in relation to him may submit a submission to the Civil Aviation Agency.

12. The Civil Aviation Agency shall, within one month, examine the submission referred to in Paragraph 11 of this Regulation and prepare an answer in which an opinion may be expressed as to whether the principle of "just culture" has been observed in the relevant case.

13. Cabinet Regulation No. 1033 of 27 December 2005, Procedures for Reporting Occurrences in Civil Aviation (Latvijas Vēstnesis, 2006, No. 2, 2007, No. 203, 2008, No. 45), is repealed.

14. This Regulation shall come into force on 15 November 2015.
