Regulations Regarding Training of Professional Users of Plant Protection Products, Operators of Application of Plant Protection Products, Distributors of Plant Protection Products and Plant Protection Advisors and Procedures for Issuing Certificates

Issued pursuant to
Section 5, Clause 21 of the Plant Protection Law

I. General Provisions

1. This Regulation prescribes:

1.1. procedures for issuing permits for training of professional users of plant protection products, operators of application of plant protection products, distributors of plant protection products and plant protection advisors (hereinafter - the permit);

1.2. requirements for obtaining of the permit;

1.3. procedures for training and content of training programme;

1.4. procedures for examinations and issuing of the certificate.

II. Procedures for Issuing Permit for Training and Requirements for Obtaining the Permit

2. The State Plant Protection Service (hereinafter - the Service) shall issue the following permits:

2.1. the permit for training of professional users of plant protection products;

2.2. the permit for training of operators of application of plant protection products;

2.3. the permit for training of distributors of plant protection products;

2.4. the permit for training of plant protection advisors.

3. In order to obtain the permit a person wishing to implement the training of professional users of plant protection products, operators of application of plant protection products, distributors of plant protection products and plant protection advisors (hereinafter - the performer of training process) shall lodge a relevant submission to the Service. The name, legal address of the performer of training process, the type of the permit to be obtained and desirable form of receipt of the permit - paper form or in the form of electronic document, shall be indicated in the submission. The following documents shall be appended to the submission:

3.1. a list of lecturers by indicating education of the lecturers and information regarding work experience (specifying workplace and number of the years worked) in the intended field of training in accordance with the training programme;

3.2. a training programme in which the content of teaching classes and intended number of lessons are indicated.

4. The Service shall issue a permit if the following requirements are met:

4.1. [1 July 2014];

4.2. a training programme developed by a person complies with the requirements referred to in Annexes 1, 2, 3 or 4 of this Regulation;

4.3. lecturers, who will provide classes, must have a higher education and work experience of at least one year in the intended field of training in accordance with the training programme;

4.4. a person, who wishes to train plant protection advisors, must be registered with the Educational Institution Register of the State Service of Education Quality.

5. The Service shall examine the documents abovementioned in Paragraph 3 of this Regulation within a month from the day of the receipt of the submission, assess the conformity of the performer of training with the requirements abovementioned in Paragraph 4 of this Regulation and take a decision to issue a permit or to refuse to issue a permit. The performer of training shall be informed in writing regarding the decision. A notification to issue a permit shall be published in the official publication Latvijas Vēstnesis and on the website of the Service.

6. The following information shall be indicated in a permit:

6.1. full name of the issuing authority;

6.2. name, registration number and legal address of the permit recipient;

6.3. type of training in accordance with Paragraph 2 of this Regulation;

6.4. date of issuance and number of the permit;

6.5. given name, surname and signature of the permit issuer (if the permit is issued in the paper form).

7. If the information included in the submitted documents is not sufficient or all the documents abovementioned in Paragraph 3 of this Regulation are not submitted, the Service shall send a request in the paper form or in the form of electronic documents to the performer of training within 10 working days after receipt of the request to adjust provided information or submit necessary documents.

8. The Service shall take a decision to refuse to issue a permit if:

8.1. the performer of training has not adjusted provided information or submitted the necessary documents within the time period abovementioned in Paragraph 7 of this Regulation;

8.2. the requirements abovementioned in Paragraph 4 of this Regulation have not been met.

9. If amendments are to be made in the permit, the performer of training shall lodge a relevant submission to the Service. The Service shall make amendments within 10 working days after receipt of a submission and issue a new permit.

9.1 If changes have occurred in the composition of lecturers, the place of occurrence of the training or contact details of the performer of training have changed, the performer of training shall inform the Service within 10 working days after the abovementioned changes.

10. The Service shall maintain the list of performers of training and publish it on the website thereof, by indicating:

10.1. the name and contact details of the performer of training;

10.2. the type of the permit issued and the date of issuance of the permit;

10.3. the date of cancellation of permit.

III. Procedures for Training, Content of Training Programme, Procedures for Examinations and Issuing of Certificate

11. The Service shall issue the following certificates:

11.1. the certificate for professional users of plant protection products:

11.1.1. for activities with the plant protection products of the first class of registration;

11.1.2. for activities with the plant protection products of the second class of registration;

11.2. the certificate for an operator of application of plant protection product for activities with the plant protection products of the second class of registration;

11.3. the certificate for a plant protection advisor;

11.4. the certificate for a distributor of plant protection products.

12. The Service shall issue:

12.1. the certificate for a professional user of plant protection products, if a person complies with one of the following conditions:

12.1.1. he or she has acquired the programme referred to in Annex 1 of this Regulation and passed examination successfully;

12.1.2. he or she has higher or secondary vocational education in agriculture and he or she has passed examination successfully (except the certificate for the application of plant protection products of the first class of registration);

12.2. the certificate for an operator of application of plant protection product, if a person complies with one of the following conditions:

12.2.1. he or she has acquired the programme abovementioned in Annex 2 of this Regulation and passed examination successfully;

12.2.2. he or she has higher or secondary vocational education in agriculture and he or she has passed examination successfully;

12.2. the certificate for a plant protection advisor, if a person complies with one of the following conditions:

12.3.1. he or she has acquired the programme referred to in Annex 3 of this Regulation and passed examination successfully (for the application of plant protection products of the first class of registration has additionally acquired the programme referred to in Chapter II of Annex 1 to this Regulation);

12.3.2. he or she has higher education in agriculture and he or she has passed examination successfully;

12.4. the certificate for a distributor of plant protection products, if a person complies with one of the following conditions:

12.4.1. he or she has acquired the programme referred to in Annex 4 of this Regulation and passed examination successfully;

12.4.2. he or she has higher or secondary vocational education in agriculture and he or she has passed examination successfully.

13. The following information shall be indicated in a certificate:

13.1. full name of the issuing authority;

13.2. certificate number and date of the issuance;

13.3. given name, surname, personal identity number, address and photography of the recipient of the certificate;

13.4. type and date of the certificate until which the certificate is valid in conformity with Paragraph 25 of this Regulation;

13.5. date of taking examination (if it is taken);

13.6. given name, surname and signature of the issuer of the certificate.

14. Before beginning of the training a person shall lodge a submission to the performer of training where the type of the certificate, that he or she wishes to receive, shall be indicated.

15. In order for a person to take examination for acquisition of professional qualification of professional user of plant protection products, operator of application of plant protection products, distributors of plant protection products and plant protection advisors, he or she shall submit to the Service:

15.1. a submission in which the type of the certificate, that he or she wishes to receive, shall be indicated. The submission shall contain a certification regarding covering of expenditures, if expenditures for the examination or issuance of the certificate in accordance with Paragraph 36.1 will be covered by other person;

15.2. a photography (3 x 4 centimetres);

15.3. a copy of the education document or a statement regarding acquisition of the training programme where the name of the performer of training, person's given name, surname and personal identity number, information regarding acquired training programme, date of issue of the statement and given name, surname and signature of the issuer are indicated. If examination is taken with the performer of training, the statement shall not be submitted to the Service.

16. The performer of training shall maintain record regarding training process. Registration documents shall be stored 10 years and they shall contain the following information:

16.1. regarding training - the type of training, training subjects, number of lessons, given name, surname and signature of the teacher, given name, surname and signature of the training participant;

16.2. regarding training participants - given name, surname, type of training, that the training participant has acquired, number and date of the issued statement.

17. Expenditure related to training shall be covered by the person to be trained. The performer of training shall determine the procedures for performance of payment for training, and also amount thereof.

18. Upon the request of the training participant, the performer of training shall issue a statement regarding listening of complete training course.

19. The Service shall in co-operation with the performer of training organise examination at the place of occurrence of the training. If there are less than 40 persons in the training group, the examination shall be organised at the place of occurrence of the training on the last day of training. If a person complies with the requirements abovementioned in Sub-paragraphs 12.1.2, 12.2.2, 12.3.2 or 12.4.2 of this Regulation and takes examination without training, the examination shall be organised by the Service. The Service shall place the information regarding place and time of occurrence of the examination on the website thereof.

19.1 If there are more than 40 persons in the training group, the performer of training shall determine the time and place of occurrence of the examination upon agreement with the Service.

19.2 The performer of training shall at least one month before the beginning of the training co-ordinate with the Service the necessity of examination, the place and time of occurrence of the examination and the type of certificate to be issued.

21. Before examination the Service shall verify the identity of the participants of the examination.

22. The examination shall take place in writing.

23. The examination shall be assessed by a commission approved by the director of the Service.

24. The Service shall issue the certificate abovementioned in Paragraph 11 of this Regulation, if the examination is passed successfully. The examination shall be regarded as passed successfully, in which a person has answered correctly to at least 80 per cent of the questions asked, or, in order to obtain the certificate for the application of the plant protection products of the first class of registration - to at least 90 per cent of the questions asked.

25. A person who has received a certificate for professional user of plant protection products, a certificate for an operator of application of plant protection products, a certificate for a plant protection product advisor or a certificate for a distributor of plant protection products, is acquiring a training course regarding novelties in the laws and regulation on plant protection in order to renew knowledge:

25.1. a professional user of plant protection products and distributor of plant protection products - after every five years;

25.2. an operator of application of plant protection products - after every 10 years;

25.3. a plant protection advisor - after every five years.

25.1 The issued certificate shall be valid during a time period indicated in Paragraph 25 of this Regulation. If a person has not extended it during a year until the end of the term of validity of the issued certificate in conformity with Paragraphs 25 and 26 of this Regulation, a new certificate it shall acquire only after he or she has listened to a training course regarding novelties in the laws and regulations in the field of plant protection and has passed successfully examination regarding basic training programme.

26. In order to extend the term of validity of the certificate a person shall lodge a submission to the Service, the certificate, a statement of the performer of training regarding acquisition of the training course abovementioned in Paragraph 25 of this Regulation and a photography. The Service shall extend the term of validity of the certificate on the basis of the information indicated in the submission and statement. The statement is not necessary, if the Service extends the term of validity of the certificate with the performer of training with which he or she has acquired the training programme.

27. A person, who has received a certificate for a plant protection advisor, concurrently acquires the status of a professional user of plant protection products for the application of plant protection products of the first class of registration, the status of a distributor of plant protection products and operator of application of plant protection products for five years.

A person, who has received a certificate for a professional user of plant protection products for the application of plant protection products of the first class of registration, concurrently acquires the status of a distributor of plant protection products and operator of application of plant protection products for five years.

32. The Service shall carry out the supervision of the performer of training, establish and maintain a database in the State System for Surveillance of Cultivated Plants. The database shall contain the information regarding:

32.1. performers of training to whom permits for training have been issued in accordance with the procedures laid down in this Regulation;

32.2. issued certificates, by indicating the given name and surname of those persons to whom certificates are issued., data of issuance of certificates and term of validity thereof.

33. The Service shall take a decision to suspend temporarily the activity of the permit issued to the performer of training, if he or she fails to comply with the requirements abovementioned in Paragraph 4 of this Regulation anymore or fails to meet the requirements abovementioned in Paragraph 16 of this Regulation. The Service shall determine the time period for rectification of non-conformities which is not shorter than a month and not longer than three months.

34. The Service shall take a decision to cancel a permit issued to a performer of training if:

34.1. the performer of training has not rectified the non-conformities abovementioned in Paragraph 33 of this Regulation within the laid down time period;

34.2. the performer of training refuses to use the permit;

34.3. more than 30 per cent of the persons, who have been trained during one year with the particular performer of training and have taken the examination organised by the Service in the relevant year, failed to pass it successfully.

35. A notification regarding a decision abovementioned in Paragraph 34 of this Regulation shall be published in the official publication Latvijas Vēstnesis and on the website of the Service.

36. A person shall cover expenditures related to issuance of the permit, performance of examinations and issuance of the certificates and also issuance of certificate of other type in accordance with the laws and regulations regarding the pricelist of paid services provided by the Service.

36.1 After submission of the certification to the Services regarding covering of expenditures related to passing of examinations or issuance of the certificate, the abovementioned expenditures may be covered by other person instead of the relevant person or several persons. In such case the person, who is passing examination, or a person, to whom the certificate is issued, and a person, who has submitted the certification to the Service regarding covering of expenditures, shall be solidary liable for the covering of expenditures.

IV. Final Provisions

37. This Regulation shall come into force from 1 June 2013.

38. The certificates that have been issued in accordance with Cabinet Regulation No. 463 of 29 April 2004, Regulations regarding Placing on the Market, Storage and Use of Plant Protection Products, shall be valid until the end of the term of validity indicated therein.

39. After the end of the term of validity for such certificate regarding acquisition of the minimum knowledge on plant protection which was issued in accordance with Cabinet Regulation No. 463 of 29 April 2004, Regulations regarding Placing on the Market, Storage and Use of Plant Protection Products, a person shall renew the knowledge in accordance with Paragraph 25 of this Regulation and acquire the certificate for a professional user of plant protection products for the activities with plant protection products of the second class of registration.

40. After the end of the term of validity for such certificate for a distributor-advisor which was issued in accordance with Cabinet Regulation No. 463 of 29 April 2004, Regulations regarding Placing on the Market, Storage and Use of Plant Protection Products, a person shall renew the knowledge in accordance with Paragraph 25 of this Regulation and acquire the certificate for a distributor of plant protection products.

41. If during a year after the end of the term of validity of such certificate, which was issued in accordance with Cabinet Regulation No. 463 of 29 April 2004, Regulations regarding Placing on the Market, Storage and Use of Plant Protection Products, a person has not extended the term of validity of the certificate in conformity with Paragraphs 39 or 40 of this Regulation, he or she shall acquire a new certificate only after he or she has listened to the training course regarding novelties in the laws and regulations in the field of plant protection and has passed successfully examination regarding basic training programme.
