Procedures for Classification, Labelling and Packaging of Plant Protection Products

Issued pursuant to
Section 5, Clause 8
of the Plant Protection Law

I. General Provisions

1. These Regulations prescribe the procedures for classification, labelling and packaging of plant protection products.

2. These Regulations shall refer to chemical plant protection products as well as products containing micro-organisms or viruses (hereinafter - plant protection products).

II. Procedures for Classification of Plant Protection Products

3. A manufacturer of a plant protection product shall classify it in accordance with these Regulations and regulatory enactments regarding the procedures for classification, labelling and packaging of chemical substances and chemical products.

4. An explosive, extremely flammable, highly flammable and flammable plant protection product shall be classified in accordance with:

4.1. the regulatory enactments regarding the procedures for classification, labelling and packaging of chemical substances and chemical products; and

4.2. the physical and chemical properties, which are evaluated by using internationally recognised methods referred to in regulatory enactments regarding the registration of plant protection products.

5. The properties of a plant protection product - explosive, oxidising, extremely flammable, highly flammable and flammable - shall not be determined in the following cases:

5.1. if it is determined in an evaluation, which has been performed by using the internationally recognised methods referred to in regulatory enactments regarding the registration of plant protection products, that the chemical substances, which the plant protection product contains, do not possess the properties specified in the introductory part of this Paragraph; or

5.2. if the composition of the classified plant protection product is changed and it can be scientifically proved that the relevant changes shall not affect the classification of the plant protection product.

6. Plant protection products that are hazardous to health and the environment (very toxic, toxic, harmful, corrosive, irritant, sensitising, carcinogenic, mutagenic and toxic for reproduction) shall be classified:

6.1. in accordance with their properties, which are determined on the basis of an evaluation that has been performed by using internationally recognised methods referred to in regulatory enactments regarding the registration of plant protection products;

6.2. in accordance with the regulatory enactments regarding the procedures for classification, labelling and packaging of chemical substances and chemical products; and

6.3. by dividing carcinogenic, mutagenic chemical substances and chemical substances toxic for reproduction in categories 1, 2 or 3 in accordance with the regulatory enactments regarding the procedures for classification, labelling and packaging of chemical substances and chemical products.

7. If, in using a plant protection product, it creates a special risk for human beings and animals, the standard phrases specified in Annex 1 of these Regulations shall be used in the description of the plant protection product.

8. The risk referred to in Paragraph 7 of these Regulations shall be determined on the basis of a dermal and respiratory sensitisation test, which has been performed in accordance with the standardised methods specified by regulatory enactments regarding the registration of plant protection products, as well as taking into account the criteria specified in Annex 2 of these Regulations.

9. If, in using a plant protection product, it is necessary to follow special safety precautions for human and animal protection, the standard phrases referred to in Annex 3 of these Regulations shall be used in the description of the plant protection product.

10. The safety precautions referred to in Paragraph 9 of these Regulations shall be determined on the basis of a dermal and respiratory sensitisation test, which has been performed in accordance with the standardised methods specified by regulatory enactments regarding the registration of plant protection products, as well as taking into account the criteria specified in Annex 4 of these Regulations.

III. Labelling of a Plant Protection Product

11. A manufacturer of a plant protection product shall label it in accordance with these Regulations and regulatory enactments regarding the registration of plant protection products and the procedures for classification, labelling and packaging of chemical substances and chemical products.

12. The textual part of the safety phrase designation S1, S2, S13 or S20/21 shall be indicated on the packaging of a plant protection product in accordance with the regulatory enactments regarding the procedures for classification and labelling of chemical substances and chemical products.

13. If the packaging of a plant protection product consists of a protective packaging that contains several packaging units, the protective packaging shall be labelled in accordance with the regulatory enactments regarding the registration of plant protection products or in accordance with the regulatory enactments regarding the transportation of hazardous cargo.

IV. Packaging of a Plant Protection Product

14. The general requirements for the packaging of a plant protection product shall be specified in regulatory enactments regarding the registration of plant protection products and the procedures for classification, labelling and packaging of chemical substances and chemical products.

15. A packaging of a plant protection product shall conform to the following special requirements:

15.1. the packaging shall be such that children may not open it if the packaging is intended to be opened and closed several times and if the packaging prepared for retail contains:

15.1.1. a liquid chemical substance that may present an aspiration hazard to a human being due to low viscosity;

15.1.2. a plant protection product that contains 3% or more methanol; or

15.1.3. a plant protection product that contains 1% or more dichloromethane;

15.2. if the plant protection product is registered in the registration class No. 2 and is classified as a very toxic, toxic or corrosive, the packaging thereof (regardless of its volume) shall be such that children may not open it; and

15.3. if the plant protection product is registered in the registration class No. 3, the packaging thereof shall comply with the requirements specified in regulatory enactments regarding the registration of plant protection products and a tactile danger warning symbol provided for the blind consumers shall be placed on the packaging (regardless of volume thereof).

16. On aerosols, hermetically sealed gas cylinders or tubes tactile danger warning symbols shall be placed as follows:

16.1. on aerosols - on the head of the diffuser, which is irremovable during utilisation;

16.2. on hermetically sealed gas cylinders - on the opening part as close to the vent as possible; and

16.3. on tubes - on the cap.

V. Closing Provisions

17. The State Plant Protection Service shall evaluate again by the date indicated in this Paragraph the plant protection products, which contain the following active substances and which are included in the Register of Plant Protection Products, as well as determine that the relevant plant protection products shall be assigned the standard phrases specified in Annexes 1, 2, 3 and 4 of these Regulations:

17.1. imazalil - by 1 March 2005;

17.2. azoxystrobin - by 1 March 2005;

17.3. kresoxim-methyl - by 1 March 2005;

17.4. spiroxamine - by 1 March 2005;

17.5. azimsulfuron - by 1 March 2005;

17.6. fluroxypyr - by 1 March 2005;

17.7. metsulfuron methyl - by 1 July 2005;

17.8. prohexadione calcium - by 1 March 2005;

17.9. triasulfuron - by 1 August 2005;

17.10. esfenvalerate - by 1 August 2005;

17.11. bentazone - by 1 August 2005;

17.12. lambda-cyhalothrin - by 1 January 2006;

17.13. fenhexamid (KBR 2738) - by 1 March 2005;

18. The State Plant Protection Service shall evaluate plant protection products regarding which a submission for registration has been submitted to the Service up to the day of coming into force of these Regulations and shall determine the applicable standard phrases in accordance with Annexes 1, 2, 3 and 4 of these Regulations.

Standard Phrases Indicating Special Risks for Humans and Animals

1. Toksisks, nonākot saskarē ar acīm [toxic by eye contact] (RSh1).

2. Var izraisīt fotosensibilizāciju [may cause photosensitisation] (RSh2).

3. Saskarē ar tvaikiem izraisa ādas un acu apdegumus, saskarē ar šķidrumu izraisa apsaldējumus [contact with vapour causes burns to skin and eyes and contact with liquid causes freezing] (RSh3).

Annex 2

Standard Phrases that describe the Special Risk of a Plant Protection Product for Humans and Animals and the Criteria for Attribution Thereof

1. The standard phrase RSh1 shall be assigned if:

1.1. overt signs of systemic toxicity of a plant protection product (for example, related to cholinesterase inhibition) or death of the test animals, which may be attributed to absorption of the active substance through the mucous membranes of the eye have been proved; or

1.2. systemic toxicity for humans after eye contact with the plant protection product has been proved.

2. The standard phrase RSh2 shall be assigned if:

2.1. the photosensitising effects of a plant protection product have been proven;

2.2. facts regarding photosensitising effects of a plant protection product after human contact with the plant protection product are documented; or

2.3. a plant protection product contains 1% (w/w) or more of the active substance or formulant which shows a photosensitising effect in humans.

3. The standard phrase RSh3 shall be assigned to plant protection products the preparatory form of which is liquefied gas (for example, preparations of methyl bromide). In cases where the descriptions R34 or R35 of chemical substance effect is applied, this phrase shall not be used.

Standard Phrases by which Special Safety Precautions when Operating with Plant Protection Products are Determined

1. All plant protection products shall be labelled with the standard phrase "Nepiesārņot ūdeni ar augu aizsardzības līdzekli un tā iepakojumu" [do not contaminate water with the product or its container] supplemented with the text "(netīrīt smidzināšanas tehniku ūdenstilpju un ūdensteču tuvumā/izsargāties no piesārņošanas caur drenāžu no pagalmiem un ceļiem)" [do not clean application equipment near surface water/avoid contamination via drains from farmyards and roads] (SP1).

2. In determining safety phrases, the following general requirements shall be observed:

2.1. suitable personal protective equipment and specific elements of special personal protective equipment (for example, coveralls, apron, gloves, sturdy shoes, rubber boots, face protection, tightly fitting glasses, hat, hood or respirator of a specified type) may be specified;

2.2. activities, the performance of which requires personal protective equipment (mixing of plant protection products, loading of a spray tank or handling undiluted plant protection product, spraying the diluted plant protection product, handling recently sprayed material, for example, plants, soil, or entering recently treated areas) may be specified; and

2.3. the following additional requirements for plant protection engineering controls may be determined:

2.3.1. a closed transfer system shall be used when transferring a plant protection product from the packaging to a spray tank;

2.3.2. while spraying, the user of a plant protection product shall work in a closed cabin, which has been equipped with an air conditioning system; and

2.3.3. the plant protection product engineering controls may replace the necessity to use personal protective equipment if an equal or higher level of protection is provided.

3. The following safety phrases (SPo) shall be determined for plant protection product users:

3.1. pēc saskares ar ādu vispirms notīrīt augu aizsardzības līdzekli no ādas ar sausu drānu un pēc tam mazgāt ādu ar lielu ūdens daudzumu [after contact with skin, first remove product with a dry cloth and then wash the skin with plenty of water] (SPo 1);

3.2. pēc lietošanas izmazgāt visu aizsargtērpu [wash all protective clothing after use] (SPo 2);

3.3. pēc augu aizsardzības līdzekļa aizdedzināšanas neieelpot dūmus un nekavējoties atstāt apstrādāto platību [after igniting the product, do not inhale smoke and leave the treated area immediately] (SPo 3);

3.4. iepakojumu atvērt ārpus telpām un sausos apstākļos [the container must be opened outdoors and in dry conditions] (SPo 4);

3.5. pirms atgriešanās rūpīgi vedināt apstrādātās platības/siltumnīcas "…" (norāda laiku), kamēr izsmidzinātais škidrums nožuvis [ventilate treated areas/greenhouses thoroughly "…" (time to be specified) until spray has dried before re-entry] (SPo 5).

4. The following safety phrases (SPe) shall be determined for safety of the environment:

4.1. lai aizsargātu gruntsūdeni/augsnes organismus, nelietot augu aizsardzības līdzekli "…" (norāda nosaukumu) vai citu augu aizsardzības līdzekli, kurš satur "…" (norāda darbīgās vielas nosaukumu vai darbīgo vielu grupas nosaukumu) vairāk nekā "…" (norāda apstrāžu skaitu noteiktā laika periodā) [to protect groundwater/soil organisms do not apply this product "…" (identify the name) or any other product containing "…" (identify active substance or class of substances, as appropriate) more than "…" (time period or frequency to be specified)] (SPe 1);

4.2. lai aizsargātu gruntsūdeni/augsnes organismus, nelietot "…" (norāda augsnes tipu vai apstākļus) augsnēs [to protect groundwater/aquatic organisms do not apply to "…" (soil type or situation to be specified) soils] (SPe 2);

4.3. lai aizsargātu ūdens organismus/ar lietojumu nesaistītus augus/ar lietojumu nesaistītus posmkājus/kukaiņus, ievērot "…" (norāda attālumu) aizsargjoslu līdz lauksaimniecībā neizmantojamai zemei/ūdenstilpēm un ūdenstecēm [to protect aquatic organisms/non-target plants/non-target arthropods/insects respect an unsprayed buffer zone of "…" (distance to be specified) to non-agricultural land/surface water bodies] (SPe 3);

4.4. lai aizsargātu ūdens organismus/ar lietojumu nesaistītus augus, nelietot augu aizsardzības līdzekli uz necaurlaidīgas virsmas, piemēram, asfalta, betona, bruģa, sliežu ceļiem un citās vietās ar augstu noteces risku [to protect aquatic organisms/non-target plants do not apply on impermeable surfaces such as asphalt, concrete, cobblestones, railway tracks and other situations with a high risk of run-off] (SPe 4);

4.5. lai aizsargātu putnus/savvaļas zīdītājus, augu aizsardzības līdzekli pilnībā iestrādāt augsnē. Nodrošināt augu aizsardzības līdzekļa pilnīgu iestrādi augsnē arī kultūraugu rindu galos [to protect birds/wild mammals the product must be entirely incorporated in the soil. Ensure that the product is also fully incorporated at the end of rows] (SPe 5);

4.6. lai aizsargātu putnus/savvaļas zīdītājus, savākt izšļakstīto vai izbirušo līdzekli [to protect birds/wild mammals remove spillages] (SPe 6);

4.7. nelietot putnu vairošanās periodā [do not apply during the bird breeding period] (SPe 7);

4.8. bīstams bitēm. Lai aizsargātu bites un citus apputeksnētājus, nelietot kultūraugu ziedēšanas laikā/nelietot vietās, kur bites aktīvi meklē barību/bišu stropus pārvietot vai pārsegt augu aizsardzības līdzekļa smidzināšanas laikā uz "…" (norāda, uz cik ilgu laiku) pēc smidzināšanas darba beigām/nelietot platībās, kurās ir ziedošas nezāles/apkarot nezāles pirms ziedēšanas/nelietot pirms "…" (norāda laiku) [Dangerous to bees. To protect bees and other pollinating insects do not apply to crop plants when in flower/do not use where bees are actively foraging/remove or cover beehives during application and for "…" (state time) after treatment/do not apply when flowering weeds are present/remove weeds before flowering/do not apply before "…" (state time)] (SPe 8).

5. The safety phrase "Lai izvairītos no rezistences veidošanās, nelietot šo vai jebkuru citu augu aizsardzības līdzekli, kurš satur "…" (norāda darbīgās vielas vai darbīgo vielu grupas nosaukumu) vairāk nekā "…" (norāda apstrāžu skaitu vai apstrādes laika periodu)" [to avoid the build-up of resistance do not apply this or any other product containing (identify active substance or class of substances, as appropriate) more than "…" (number of applications or time period to be specified)] (SPa 1) shall be specified with regard to good agricultural practice.

6. The following safety phrases (SPr) shall be specified for handling rodenticides:

6.1. ēsmu ejā ievietot tā, lai tā nebūtu pieejama citiem dzīvniekiem. Ēsmu nostiprināt, lai grauzēji to nevarētu aizvilkt [the baits must be securely deposited in a way so as to minimise the risk of consumption by other animals. Secure bait blocks so that they cannot be dragged away by rodents] (SPr 1);

6.2. apstrādes laikā apstrādājamo platību marķēt. Norādīt saindēšanās (primārās vai sekundārās) apdraudējumu ar antikoagulantu un tā antidotu [treatment area must be marked during the treatment period. The danger from being poisoned (primary or secondary) by the anticoagulant and the antidote against it should be mentioned] (SPr 2);

6.3. beigtos grauzējus no apstrādātās platības aizvākt katru dienu. Neizmest tos atkritumu tvertnēs vai kaudzēs [dead rodents must be removed from the treatment area each day during treatment. Do not place in refuse bins or on rubbish tips] (SPr 3).

Annex 4

Criteria for Application of Special Standard Phrases for Safety Requirements

1. The standard phrase (SPo1) "Pēc saskares ar ādu vispirms notīrīt augu aizsardzības līdzekli no ādas ar sausu drānu un pēc tam mazgāt ādu ar lielu ūdens daudzumu" [after contact with skin, first remove product with a dry cloth and then wash the skin with plenty of water] shall be assigned for plant protection products containing ingredients which may react actively with water, such as cyanide salts or aluminium phosphide.

2. The standard phrase (SPo 2) "Pēc mazgāšanas izmazgāt visu aizsargtērpu" [wash all protective clothing after use] may be assigned if the user of a plant protection product is required to use protective clothing. It shall be mandatory for all plant protection products classified as toxic (T) or very toxic (T+).

3. The standard phrase (SPo 3) "Pēc augu aizsardzības līdzekļa aizdedzināšanas neieelpot dūmus un nekavējoties atstāt apstrādāto platību" [after igniting the product, do not inhale smoke and leave the treated area immediately] may be assigned to plant protection products used for fumigation in cases where the use of a respirator does not provide sufficient safety.

4. The standard phrase (SPo 4) "Iepakojumu atvērt ārpus telpām un sausos apstākļos" [the container must be opened outdoors and in dry conditions] shall be assigned for plant protection products which may react violently with water or damp air, such as aluminium phosphide, or which may cause spontaneous combustion, such as (alkylenebis-) dithiocarbamates. This phrase may also be assigned to volatile plant protection products to which the effect description R20, R23 or R26 has been assigned. Expert judgement is required in each individual case, to assess whether the properties of the plant protection product and the packaging may endanger the safety of a plant protection product user.

5. The standard phrase (SPo 5) "Pirms atgriešanās rūpīgi vedināt apstrādātās platības/siltumnīcas "…" (norāda vēdināšanas laiku), kamēr izsmidzinātais šķidrums nožuvis" [ventilate treated areas/greenhouses thoroughly "…" (time to be specified) until spray has dried before re-entry] may be assigned to plant protection products used in greenhouses or other confined spaces, such as stores.

6. The standard phrase (SPe 1) "Lai aizsargātu gruntsūdeni/augsnes organismus, nelietot augu aizsardzības līdzekli "…" (norāda nosaukumu) vai citu augu aizsardzības līdzekli, kurš satur "…" (norāda darbīgās vielas nosaukumu vai darbīgo vielu grupas nosaukumu) vairāk nekā "…" (norāda apstrāžu skaitu noteiktā laika periodā)" [to protect groundwater/soil organisms do not apply this product "…" (identify the name) or any other product containing "…" (identify active substance or class of substances, as appropriate) more than "…" "…" (time period or frequency to be specified)] shall be assigned if, according to the results of a risk evaluation performed in accordance with regulatory enactments regarding the procedures for the registration of plant protection products, it is necessary to determine risk-mitigation measures concerning accumulation in soil, effects on earthworms or other soil-dwelling organisms or soil microflora and/or contamination of groundwater for one or more of the uses indicated on the plant protection product labelling.

7. The standard phrase (SPe 2) "Lai aizsargātu gruntsūdeni/augsnes organismus, nelietot "…" (norāda augsnes tipu vai apstākļus) augsnēs" [to protect groundwater/effects on aquatic organisms do not apply to "…" (soil type or situation to be specified) soils] may be assigned if, according to the results of a risk evaluation performed in accordance with regulatory enactments regarding the procedures for the registration of plant protection products, it is necessary to determine risk-mitigation measures concerning any potential contamination of groundwater or surface water under vulnerable conditions (for example, associated to soil type, topography or for drained soils) for one or more of the uses indicated on the plant protection product labelling.

8. The standard phrase (SPe 3) "Lai aizsargātu ūdens organismus/ar lietojumu nesaistītus augus/ar lietojumu nesaistītus posmkājus/kukaiņus, ievērot "…" (norāda attālumu) aizsargjoslu līdz lauksaimniecībā neizmantojamai zemei/ūdenstilpēm un ūdenstecēm" [to protect aquatic organisms/non-target plants/non-target arthropods/insects respect an unsprayed buffer zone of "…" (distance to be specified) to non-agricultural land/surface water bodies] shall be assigned if, according to the results of a risk evaluation performed in accordance with regulatory enactments regarding the procedures for the registration of plant protection products, it is necessary to determine risk-mitigation measures concerning non-target plants, non-target arthropods and/or aquatic organisms for one or more of the uses indicated on the plant protection product labelling.

9. The standard phrase (SPe 4) "Lai aizsargātu ūdens organismus/ar lietojumu nesaistītus augus, nelietot augu aizsardzības līdzekli uz necaurlaidīgas virsmas, piemēram, asfalta, betona, bruģa, sliežu ceļiem un citās vietās ar augstu noteces risku [to protect aquatic organisms/non-target plants do not apply on impermeable surfaces such as asphalt, concrete, cobblestones, railway tracks and other situations with a high risk of run-off] shall be assigned on the basis of the target usage of the plant protection product in order to prevent the risk of run-off and to protect aquatic organisms and non-target plants.

10. The standard phrase (SPe 5) "Lai aizsargātu putnus/savvaļas zīdītājus, augu aizsardzības līdzekli pilnībā iestrādāt augsnē. Nodrošināt augu aizsardzības līdzekļa pilnīgu iestrādi augsnē arī kultūraugu rindu galos" [to protect birds/wild mammals the product must be entirely incorporated in the soil. 11. 12. The standard phrase (SPe 7) "Nelietot putnu vairošanās periodā" [do not apply during bird breeding period] shall be assigned if, according to the result of a risk evaluation performed in accordance with regulatory enactments regarding the procedures for the registration of plant protection products, it is necessary to determine risk-mitigation measures during bird breeding period for one or more of the uses indicated on the plant protection product labelling.

13. The standard phrase (SPe 8) "Bīstams bitēm. Lai aizsargātu bites un citus apputeksnētājus, nelietot kultūraugu ziedēšanas laikā/nelietot vietās, kur bites aktīvi meklē barību/bišu stropus pārvietot vai pārsegt augu aizsardzības līdzekļa smidzināšanas laikā un "…" (norāda, uz cik ilgu laiku) pēc smidzināšanas darba beigām/nelietot platībās, kurās ir ziedošas nezāles/apkarot nezāles pirms ziedēšanas/nelietot pirms "…" (norāda laiku" [Dangerous to bees. 14. The standard phrase (SPa 1) "Lai izvairītos no rezistences veidošanās, nelietot šo vai jebkuru citu augu aizsardzības līdzekli, kurš satur "…" (norāda darbīgās vielas vai darbīgo vielu grupas nosaukumu) vairāk nekā "…" (norāda apstrāžu skaitu vai apstrādes laika periodu)" [to avoid the build-up of resistance do not apply this or any other product containing (identify active substance or class of substances, as appropriate) more than "…" (number of applications or time period to be specified)] shall be assigned if a restriction is required to reduce the risk of development of resistance.

15. The standard phrase (SPr 1) "Ēsmu ejā ievietot tā, lai tā nebūtu pieejama citiem dzīvniekiem. Ēsmu nostiprināt, lai grauzēji to nevarētu aizvilkt" [the baits must be securely deposited in a way so as to minimise the risk of consumption by other animals. 16. The standard phrase (SPr 2) "Apstrādes laikā apstrādājamo platību marķēt. Norādīt saindēšanās (primārās vai sekundārās) apdraudējumu ar antikoagulantu un tā antidotu" [treatment area must be marked during the treatment period. The danger from being poisoned (primary or secondary) by the anticoagulant and the antidote against it should be mentioned] shall be highlighted on the label in order to make it particularly prominent and to avoid accidental poisoning.

17. In order to prevent secondary poisoning of animals, the standard phrase (SPr 3) "Beigtos grauzējus no apstrādātās platības aizvākt katru dienu. Neizmest tos atkritumu tvertnēs vai kaudzēs" [dead rodents must be removed from the treatment area each day during treatment.
