Regulations Regarding Certification of Civil Aviation Flight Crew Members

Issued pursuant to
Section 30, Paragraph two and Section 32,
Paragraph four of the law On Aviation

1. General Provisions

1. The Regulation prescribes:

1.1. the procedures by which the civil aviation flight crew (hereinafter - the flight crew) member licence shall be issued;

1.2. the requirements for obtaining the flight crew member licence.

2. Terms used in this Regulation:

2.1. approved training organisation - an organisation certified by the competent authority of a Member State of the European Union, Swiss Confederation, European Economic Area, or the Convention on International Civil Aviation of 7 December 1944 (hereinafter - the Convention) and which has received certification of the right to provide training for the receipt of the flight crew member licence and related ratings and certificates, and also a training organisation which, on the basis of the declaration, is entitled to train pilots;

2.2. pilotʼs logbook - a document where a flight crew member records information regarding all flights made while acting as a flight crew member, practical trainings and practical examinations taken in an aircraft and simulator;

2.3. differences training - training on differences between aircrafts (other variants of aircrafts within the same class or of the same aircraft type) during which additional knowledge on the aircraft and practical skills are acquired by conducting flights;

2.4. familiarisation training - training during which additional knowledge on the aircraft of the same variant with different equipment is acquired without conducting a flight;

2.5. cross-country flight - a flight between a point of departure and a point of arrival following a pre-planned route, using standard navigation procedures;

2.6. theoretical examination - a test of theoretical knowledge required for the issuance of the flight crew member licence;

2.7. practical examination - a test of practical skills which includes:

2.7.1. a skill test (including demonstration of theoretical knowledge) - demonstration of the skills required for the issuance of the flight crew member licence or rating;

2.7.2. a proficiency check (including taking of an oral examination) - demonstration of skills for the revalidation or renewal of ratings;

2.7.3. assessment of competence - demonstration of the skills required for the issuance of the flight engineer instructor endorsement, the flight instructor licence, and the flight examiner licence, and for their revalidation and renewal.

3. This Regulation applies to:

3.1. the persons who want to obtain a leisure pilot licence with appropriate rating which gives the privilege to conduct flights with the ultralight aircrafts referred to in Annex I to Regulation (EU) 2018/1139 of the European Parliament and of the Council of 4 July 2018 on common rules in the field of civil aviation and establishing a European Union Aviation Safety Agency, and amending Regulations (EC) No 2111/2005, (EC) No 1008/2008, (EU) No 996/2010, (EU) No 376/2014 and Directives 2014/30/EU and 2014/53/EU of the European Parliament and of the Council, and repealing Regulations (EC) No 552/2004 and (EC) No 216/2008 of the European Parliament and of the Council and Council Regulation (EEC) No 3922/91 (hereinafter - Regulation No 2018/1139), and the persons who want to obtain the flight engineer licence with appropriate aircraft category and type rating which gives the privilege to operate the machinery and equipment of such aircraft type under the guidance and supervision of a pilot-in-command;

3.2. the persons who want to obtain the flight crew member licence in accordance with Commission Regulation (EU) No 1178/2011 of 3 November 2011 laying down technical requirements and administrative procedures related to civil aviation aircrew pursuant to Regulation (EC) No 216/2008 of the European Parliament and of the Council (hereinafter - Regulation No 1178/2011).

4. Within the meaning of point FCL.001 of Regulation No 1178/2011 the competent authority is the State agency Civil Aviation Agency (hereinafter - the Civil Aviation Agency).

5. The Civil Aviation Agency shall:

5.1. issue the flight crew member licence to the persons referred to in Sub-paragraph 3.1 of this Regulation in accordance with the sample indicated in Annex 1 to this Regulation;

5.2. issue the flight crew member licence to the persons referred to in Sub-paragraph 3.2 of this Regulation in accordance with the requirements of Appendix 1 to Part-ARA of Annex VI to Regulation No 1178/2011;

5.3. grant the flight engineer instructor endorsement with entry thereof in the flight engineer licence;

5.4. issue the flight instructor certificate in accordance with the sample indicated in Annex 2 to this Regulation;

5.5. issue the flight examiner certificate in accordance with the sample indicated in Annex 3 to this Regulation.

6. In accordance with these provisions, the Civil Aviation Agency shall grant the rating which gives a holder of the flight crew member licence the privilege to conduct flights on the aircraft of specific category and type. The Civil Aviation Agency shall grant:

6.1. the endorsement for the leisure pilot licence for flights in aircrafts of the following categories:

6.1.1. ULA (land), ULA (sea) - ultralight land or sea aeroplane;

6.1.2. ULTMG - ultralight touring motor glider;

6.1.3. ULH (land), ULH (sea) - ultralight land or sea helicopter;

6.1.4. ULS - ultralight sailplane and powered sailplane;

6.1.5. HG - hang glider;

6.1.6. MHG (land), MHG (sea) - land or sea motor hang glider;

6.1.7. ULGYR (land), ULGYR (sea) - ultralight land or sea gyroplane;

6.2. the following additional ratings:

6.2.1. NR - night flights;

6.2.2. ABTR - aerobatic flights;

6.2.3. SPTR - sailplane towing;

6.2.4. BRTR - banner towing;

6.2.5. MR - mountain flights;

6.2.6. CLR - flights with a sailplane in clouds;

6.3. the flight engineer endorsement for flights in aircrafts of the following categories and types:

6.3.1. (A) - aeroplane with a type indication;

6.3.2. (H) - helicopter with a type indication.

7. Flight crew member licences and the ratings referred to in Sub-paragraphs 6.1 and 6.2 of this Regulation shall be valid for an indefinite period of time (except for the rating referred to in Sub-paragraph 6.2.5 of this Regulation) and shall remain valid for as long as the flight crew member conforms to the requirements of this Regulation. The MR rating referred to in Sub-paragraph 6.2.5 of this Regulation shall be valid for two years.

8. The flight engineer endorsements referred to in Sub-paragraph 6.3 of this Regulation shall be valid for one year.

9. The flight engineer instructor endorsement, the flight instructor certificate, and the flight examiner certificate shall be valid for three years.

10. In accordance with the requirements referred to in point FCL.050 of Regulation No 1178/2011 and in point FCL.050 of AMC1 of the European Aviation Safety Agency document "Acceptable Means of Compliance. Part-FCL", a flight crew member shall record in the pilotʼs logbook information regarding each made flight, and training flight, and practical examination taken in an aircraft, and also practical training and practical examination taken in the simulator. The pilotʼs logbook shall be authenticated accordingly by the signature of:

10.1. the flight crew member - each flight that is not a training or skill test/proficiency check;

10.2. the instructor - each training flight conducted in an aircraft and practical training in the simulator;

10.3. the flight examiner - each practical examination conducted in an aircraft and simulator.

11. The European Aviation Safety Agency document "Acceptable Means of Compliance. Part-FCL" for the application of the requirements laid down in Regulation No 1178/2011 has been translated into Latvian and published on the website of the Civil Aviation Agency (www.caa.lv).

2. Procedures for the Issuance of the Civil Aviation Flight Crew Member Licence

12. In order to obtain the flight crew member licence referred to in Paragraph 3 of this Regulation with ratings and certificates (hereinafter jointly in this Chapter - the flight crew member licence), the applicant shall submit an application (Annex 4) to the Civil Aviation Agency. The application shall be submitted not later than within six months after passing of the practical examination. The following documents shall be appended to the application:

12.1. a copy of a personal identification document;

12.2. a copy of a valid medical certificate or medical statement (by presenting the original) (according to the requirements for obtaining the relevant flight crew member licence);

12.3. a notarially certified consent of at least one parent or guardian for the receipt of the flight crew member licence, if the application is submitted by a person who has not attained 18 years of age;

12.4. a certification issued by an approved training organisation on the acquisition of the training course in theoretical knowledge and practical flights (according to the requirements for obtaining the relevant flight crew member licence). The abovementioned certification must specify the requirements to which the respective training conforms, and also information regarding the training flights conducted by the applicant and their evaluation;

12.5. a copy of the pilotʼs logbook (by presenting the original) with records attesting the flight experience of the applicant in the aircraft and simulator (according to the requirements for obtaining the relevant flight crew member licence), including records on:

12.5.1. conducting of training flights endorsed by the signature of the flight instructor;

12.5.2. passing of practical examinations endorsed by the signature of the flight examiner;

12.6. a document (statement) issued by the competent authority of another country which includes information regarding completed training courses and passed theoretical examinations (according to the requirements for obtaining the relevant flight crew member licence), and also a copy of the certificate of the training course or the certificate issued by an approved training organisation, if theoretical or practical training has been completed or examinations have been passed in another country;

12.7. a document attesting that the English language proficiency of the applicant conforms to at least the fourth level in accordance with Annex 1 to the Convention;

12.8. a sample form signed by the flight examiner on the passing of the examination after completion of the training course which is required for the receipt of the relevant flight crew member licence or rating.

13. If an applicant who holds a flight crew member licence issued by the competent authority of a third country in accordance with Annex 1 to the Convention wants to obtain the leisure pilot licence and the flight engineer licence referred to in Sub-paragraph 5.1 of this Regulation, the Civil Aviation Agency shall, upon receipt of the application referred to in Paragraph 12 of this Regulation, request from the competent authority of the relevant country information regarding the validity of the issued licence, the conformity thereof with the requirements of Annex 1 to the Convention, and the completed training courses which could be credited in order to issue the relevant licence. The Civil Aviation Agency shall assess the received information in accordance with the requirements for issuing the relevant licence referred to in this Regulation and take a decision in accordance with Paragraph 16 of this Regulation.

14. If an applicant who holds a flight crew member licence issued by the competent authority of a third country in accordance with Annex 1 to the Convention wants to obtain the commercial pilot licence (CPL), the multi-pilot aeroplane licence (MPL), or the airline transport pilot licence (ATPL), then, in addition to the requirements for obtaining the abovementioned licence laid down in Regulation No 1178/2011, at least one of the following conditions also needs to exist:

14.1. the principal place of business of the aircraft operator which is used or planned to be used by the applicant for conducting flights is the Republic of Latvia;

14.2. the aircraft with which the applicant conducts or plans to conduct flights is registered in the Republic of Latvia;

14.3. the permanent place of residence of the applicant is the Republic of Latvia.

15. If the information indicated in the application is incomplete or all the documents referred to in Paragraph 12 of this Regulation have not been submitted, the Civil Aviation Agency shall request the applicant to clarify the submitted information and to submit the missing documents within 10 working days.

16. Upon receipt of the application referred to in Paragraph 12 of this Regulation, the Civil Aviation Agency shall take the decision to issue the flight crew member licence or to refuse to issue the licence in accordance with the procedures laid down in the Administrative Procedure Law.

17. The Civil Aviation Agency shall take the decision to refuse to issue the flight crew member licence, if the applicant:

17.1. fails to meet the requirements referred to in Paragraph 15 of this Regulation;

17.2. fails to comply with the requirements for obtaining the relevant flight crew member licence laid down in this Regulation or Regulation No 1178/2011.

18. Prior to the receipt of the flight crew member licence, the person shall pay for the relevant paid service of the Civil Aviation Agency according to the approved price list for public paid services.

19. Decisions of the Civil Aviation Agency which have been taken in accordance with this Regulation may be appealed in accordance with the procedures laid down in the Administrative Procedure Law.

20. If the Civil Aviation Agency revokes or suspends the licence in accordance with Section 6, Paragraph two, Clause 5 of the law On Aviation, the flight crew member shall submit the licence to the Civil Aviation Agency within three working days after notification of the relevant decision.

3. Requirements for Obtaining the Leisure Pilot Licence and Rating

3.1. General Requirements

21. The leisure pilot licence with one or several ratings referred to in Sub-paragraphs 6.1 and 6.2 of this Regulation may been obtained by a person who has attained:

21.1. 17 years of age - for flights in the ultralight aeroplane, ultralight helicopter, and ultralight gyroplane;

21.2. 16 years of age - for flights in the ultralight sailplane, ultralight touring motor glider, hang glider, or powered hang glider.

22. In order to obtain the leisure pilot licence with the rating referred to in this Regulation, the applicant shall acquire theoretical knowledge and shall conduct training flights according to an approved training programme, and also shall take theoretical examinations in accordance with the requirements referred to in Chapter 8 of this Regulation and the practical examination (the skill test) in accordance with the requirements referred to in Chapter 9 of this Regulation.

23. The applicant shall conduct training flights in the ultralight aircraft of the same category, class, type, or variant which is used in the skill test. During the skill test the applicant shall, while acting as the pilot-in-command of the ultralight aircraft of the relevant category, demonstrate the ability to perform tasks at such a level of competence which is appropriate for the privileges assigned by the abovementioned licence and rating.

24. The rating indicated in the leisure pilot licence shall give the privilege to conduct flights on the same category, class, type, or variant of aircraft which was used in the skill test.

3.2. Requirements for Obtaining the ULA (Land), ULA (Sea) or ULTMG Rating

25. In order to obtain the ULA (land), ULA (sea) or ULTMG rating, the applicant shall complete at least 30 hours of flight instruction in the ultralight aeroplane or ultralight touring motor glider, including:

25.1. 15 hours of dual flight instruction in an aeroplane or ultralight touring motor glider of such class with which the skill test is taken;

25.2. six solo hours of flight instruction under the supervision of the flight instructor, including at least three hours of solo cross-country flight time whereof one solo cross-country flight shall be of at least 150 kilometres with one landing and a full-stop landing at an aerodrome which is not the departure aerodrome of the aircraft.

26. In order to obtain the ULA (land) rating, the leisure pilot who holds a licence with a valid ULS and ULTMG rating and who after receipt of the ULTMG rating has a minimum of 21 hours flight time in the ultralight touring motor glider shall fulfil the following requirements:

26.1. complete three hours of flight instruction, including 10 dual instruction take-off and landing manoeuvres and 10 solo training take-off and landing manoeuvres under the supervision of the flight instructor;

26.2. pass the skill test and during the test demonstrate the theoretical knowledge of the ultralight aeroplane in the following areas:

26.2.1. aircraft operational procedures;

26.2.2. flight performance and planning;

26.2.3. aircraft general knowledge.

27. In order to obtain the ULA (sea) rating, the leisure pilot who holds a licence with a valid ULA (land) rating, or, in order to obtain the ULA (land) rating, the leisure pilot who holds a licence with a valid ULA (sea) rating shall fulfil at least one of the following requirements:

27.1. complete at least eight hours of dual flight instruction , if there is a valid rating for the relevant class or type;

27.2. complete 10 hours of dual flight instruction, if the rating for the relevant class or type is not valid.

28. If the leisure pilot who wants to obtain the ULA (land), ULA (sea), or ULTMG rating has flight experience as the pilot-in-command, the compliance with the requirements referred to in Sub-paragraph 25.1 of this Regulation may be credited towards obtaining the abovementioned rating. The scope of the requirements to be credited shall be determined by an approved training organisation where the leisure pilot acquires the training course, taking into account the evaluation of the skill test/proficiency check conducted prior to commencing training in accordance with the requirements for obtaining the ULA (land), ULA (sea) or ULTMG rating. The number of flight hours to be credited may not exceed the total amount of flight hours while acting as the pilot-in-command and 50 % of the flight hours referred to in Sub-paragraph 25.1 of this Regulation.

29. In order to maintain the ULA (land), ULA (sea), or ULTMG rating, within 24 months the leisure pilot shall fulfil the following requirements in the ultralight land aeroplane, ultralight sea aeroplane, or ultralight touring motor glider or also in the ultralight land aeroplane and ultralight touring motor glider, if the leisure pilot has both ratings:

29.1. complete at least 12 flight hours as the pilot-in-command, conducting 12 take-off and landing manoeuvres;

29.2. participate in the refresher training of flight skills as part of which a flight with duration of at least one hour shall be dual instruction time.

30. The refresher training of flight skills in the ultralight land aeroplane may be omitted, if the leisure pilot has passed the proficiency check for the class or type rating, the skill test, or the assessment of competence in the land aeroplane of any class or type. The refresher training of flight skills in the ultralight sea aeroplane may be omitted, if the leisure pilot has passed the proficiency check for the class or type rating, the skill test, or the assessment of competence in the sea aeroplane of any class or type.

31. If the ULA (land), ULA (sea), or ULTMG rating is not maintained in accordance with the procedures referred to in Paragraph 29 of this Regulation, the leisure pilot shall fulfil one of the following requirements:

31.1. conduct dual instruction flights or solo flights under the supervision of the flight instructor in accordance with the requirements referred to in Paragraph 29 of this Regulation;

31.2. complete the proficiency check prior to using the privileges assigned by the rating.

32. If the leisure pilot holds a licence with a valid ULA (land) and ULA (sea) rating, then, for the purpose of maintaining both abovementioned ratings, within 24 months the leisure pilot shall complete at least 12 flight hours as the pilot-in-command, conducting 12 take-off and landing manoeuvres with land or sea ultralight aeroplane or both abovementioned aircraft, including in each aircraft:

32.1. complete at least one flight hour as the pilot-in-command, conducting six take-off and landing manoeuvres;

32.2. participate in the refresher training of flight skills as part of which a flight with duration of at least one hour shall be dual instruction time. If the conditions referred to in Paragraph 30 of this Regulation are fulfilled, the refresher training of flight skills may be omitted.

33. The leisure pilot who has received the licence with the ULA (land), ULA (sea), or ULTMG rating has the privilege to conduct flights on the ultralight aeroplane or ultralight touring motor glider of another variant which was not used in the skill test, if the leisure pilot has completed the differences training or familiarisation training and has completed solo flights under the supervision of the flight instructor.

3.3. Requirements for Obtaining the ULH (Land) or ULH (Sea) Rating

34. In order to obtain the ULH (land) rating the applicant shall complete at least 40 hours of flight instruction in the ultralight land helicopter, including:

34.1. 20 hours of dual flight instruction in the ultralight helicopter with which the skill test is taken;

34.2. 10 solo hours of flight instruction under the supervision of the flight instructor, including at least five hours of solo cross-country flight time whereof one cross-country flight shall be of at least 150 kilometres with one landing and a full-stop landing at an aerodrome which is not the departure aerodrome of the aircraft.

35. In order to obtain the ULH (sea) rating, the leisure pilot who holds a licence with a valid ULH (land) rating, or, in order to obtain the ULH (land) rating, the leisure pilot who holds a licence with a valid ULH (sea) rating shall fulfil at least one of the following requirements:

35.1. complete at least eight hours of dual flight instruction, if there is a valid rating for the relevant type;

35.2. complete 10 hours of dual flight instruction, if the rating for the relevant type is not valid.

36. If the leisure pilot who wants to obtain the ULH (land) rating has flight experience as the pilot-in-command, the compliance with the requirements referred to in Sub-paragraph 34.1 of this Regulation may be credited towards obtaining the abovementioned rating. The scope of requirements to be credited shall be determined by an approved training organisation where the leisure pilot acquires the training course, taking into account the evaluation of the skill test/proficiency check conducted prior to commencing training in accordance with the requirements for obtaining the ULH (land) rating. The number of flight hours to be credited may not exceed the total number of flight hours while acting as the pilot-in-command and 50 % of the 40 flight hours referred to in Sub-paragraph 34 of this Regulation.

37. In order to maintain the ULH (land) or ULH (sea) rating, within 12 months the leisure pilot shall complete the following in the ultralight helicopter:

37.1. complete at least six hours of flight instruction in the as the pilot-in-command, conducting six take-off and landing manoeuvres;

37.2. participate in the refresher training of flight skills as part of which a flight with duration of at least one hour shall be conducted with the flight instructor.

38. The refresher training of flight skills in the ultralight land helicopter may be omitted, if the leisure pilot has passed the proficiency check for the type rating, the skill test, or the assessment of competence in the land helicopter of any type. The refresher training of flight skills in the ultralight sea helicopter may be omitted, if the leisure pilot has passed the proficiency check for the type rating, the skill test, or the assessment of competence in the sea helicopter of any type.

39. If the ULH (land) or ULH (sea) rating is not maintained in accordance with the procedures referred to in Paragraph 37 of this Regulation, the leisure pilot shall fulfil one of the following requirements:

39.1. conduct dual instruction flights or solo flights under the supervision of the flight instructor in accordance with the requirements referred to in Paragraph 37 of this Regulation;

39.2. complete the proficiency check prior to using the privileges assigned by the rating.

40. If the leisure pilot holds a licence with a valid ULH (land) and ULH (sea) rating, then, for the purpose of maintaining both abovementioned ratings, within 12 months the leisure pilot shall complete at least six flight hours as the pilot-in-command, conducting six take-off and landing manoeuvres with land or sea ultralight helicopter or both abovementioned aircraft, including in each aircraft:

40.1. complete at least one flight hour as the pilot-in-command, conducting three take-off and landing manoeuvres;

40.2. participate in the refresher training of flight skills as part of which a flight with duration of at least one hour shall be conducted with the flight instructor. If the conditions referred to in Paragraph 38 of this Regulation are fulfilled, the refresher training of flight skills may be omitted.

41. The leisure pilot who has received a licence with the ULH (land) rating has the privilege to conduct flights on the ultralight helicopter of another type which was not used in the skill test, if he or she:

41.1. completes five hours of flight instruction, including 15 dual instruction take-off and landing manoeuvres and 15 solo take-off and landing manoeuvres under the supervision of the flight instructor;

41.2. passes the skill test and during the test demonstrates the theoretical knowledge of the ultralight helicopter in the following subjects:

41.2.1. aircraft operational procedures;

41.2.2. flight performance and planning;

41.2.3. aircraft general knowledge.

42. The leisure pilot who has received a licence with the ULH (land) or ULH (sea) rating has the privilege to conduct flights on the ultralight helicopter of another variant which was not used in the skill test, if the leisure pilot has completed the differences training or familiarisation training.

3.4. Requirements for Obtaining ULS Rating

43. In order to obtain the ULS rating, the applicant shall complete at least 15 hours of flight instruction in the ultralight sailplane or ultralight touring motor glider, including:

43.1. 10 hours of dual flight instruction in the ultralight sailplane or ultralight touring motor glider with which the skill test is taken;

43.2. two solo hours of flight instruction under the supervision of the flight instructor, including at least 45 launches and landing manoeuvres. One solo cross-country flight under the supervision of the flight instructor shall be of at least 50 kilometres or one flight hour of dual instruction time - of at least 100 kilometres.

44. It shall be allowed to complete seven out of 15 hours of flight instruction referred to in Paragraph 43 of this Regulation in the ultralight touring motor glider.

45. If the leisure pilot who wants to obtain the ULS rating has flight experience as the pilot-in-command, the compliance with the requirements referred to in Sub-paragraph 43.1 of this Regulation may be credited towards obtaining the abovementioned rating. The scope of requirements to be credited shall be determined by an approved training organisation where the leisure pilot acquires the training course, taking into account the evaluation of the skill test/proficiency check conducted prior to commencing training in accordance with the requirements for obtaining the ULS rating. The number of flight hours to be credited may not exceed the total number of flight hours while acting as the pilot-in-command and 50 % of flight hours referred to in Sub-paragraph 43.1 of this Regulation.

46. If the leisure pilot has received a licence with the ULS rating and wants to obtain the ULTMG rating, he or she shall fulfil the following requirements:

46.1. complete at least six hours of flight instruction in the ultralight touring motor glider, including four hours of dual instruction time;

46.2. complete one solo cross-country flight of at least 150 kilometres with one landing and a full-stop landing at an aerodrome which is not the departure aerodrome of the aircraft;

46.3. pass the skill test and during the test demonstrate the theoretical knowledge of the ultralight touring motor glider in the following subjects:

46.3.1. principles of flight;

46.3.2. aircraft operational procedures;

46.3.3. flight performance and planning;

46.3.4. aircraft general knowledge;

46.3.5. navigation.

47. The leisure pilot who has received a licence with the ULS rating may conduct flights on the sailplane with another take-off method than used in the skill test, if he or she fulfils the following requirements:

47.1. completes 10 take-offs of dual flight instruction and five solo take-offs of flight instruction under the supervision of the flight instructor in the case of winch launch and car launch of the sailplane;

47.2. completes five take-offs of dual flight instruction and five solo take-offs of flight instruction under the supervision of the flight instructor in the case of self-launch or aeroplane launch of the sailplane;

47.3. completes three take-offs of dual flight instruction or three solo take-offs of flight instruction under the supervision of the flight instructor in the case of a bungee launch of the sailplane.

48. Entries regarding take-offs of flight instruction with the ultralight sailplane or ultralight touring motor glider and the take-off method used in these flights shall be made in the pilotʼs logbook.

49. In order for the leisure pilot to maintain the privilege to conduct flights by using each of the take-off methods referred to in Paragraph 47 of this Regulation, in the time period of 24 months he or she shall conduct at least five take-off manoeuvres (except for a bungee launch- at least two take-off manoeuvres shall be conducted in this case).

50. If the leisure pilot fails to meet the requirements referred to in Paragraph 49 of this Regulation, he or she shall conduct take-offs of dual flight instruction or solo take-offs of flight instruction under the supervision of the flight instructor in accordance with the procedures referred to in Paragraph 47 of this Regulation.

51. In order to maintain the ULS rating, within 24 months the leisure pilot shall fulfil the following in the ultralight sailplane or ultralight touring motor glider:

51.1. complete at least five flight hours as the pilot-in-command, conducting 15 take-off and landing manoeuvres;

51.2. conduct at least two take-offs of dual flight instruction.

52. If the ULS rating is not maintained in accordance with the procedures referred to in Paragraph 51 of this Regulation, the leisure pilot shall fulfil one of the following requirements:

52.1. conduct dual instruction flights or solo flights under the supervision of the flight instructor in accordance with the requirements referred to in Paragraph 51 of this Regulation;

52.2. complete the proficiency check prior to the use of the privileges assigned by the rating.

3.5. Requirements for Obtaining HG Rating

53. In order to obtain the HG rating, the applicant shall complete at least 10 hours of flight instruction in the hang glider, including:

53.1. six hours of dual flight instruction;

53.2. three solo hours of flight instruction under the supervision of the flight instructor, including at least 50 take-off and landing manoeuvres.

54. In order to maintain the HG rating, within 24 months the leisure pilot shall complete at least five flight hours in the hang glider as the pilot-in-command, conducting 15 take-off and landing manoeuvres.

55. If the HG rating is not maintained in accordance with the procedures referred to in Paragraph 54 of this Regulation, the leisure pilot shall fulfil one of the following requirements:

55.1. conduct dual instruction flights or solo flights under the supervision of the flight instructor in accordance with the requirements referred to in Paragraph 54 of this Regulation;

55.2. complete the proficiency check prior to the use of the privileges assigned by the rating.

3.6. Requirements for Obtaining the MHG (Land) or MHG (Sea) Rating

56. In order to obtain the MHG (land) or MHG (sea) rating, the applicant shall complete at least 20 hours of flight instruction in the land or sea motor hang glider, including:

56.1. 10 hours of dual flight instruction in the motor hang glider with which the skill test is taken;

56.2. eight solo hours of flight instruction under the supervision of the flight instructor, including at least three solo cross-country flight hours whereof one cross-country flight shall be of at least 50 kilometres with one landing and a full-stop landing at an aerodrome which is not the departure aerodrome of the aircraft.

57. In order to obtain the MHG (sea) rating, the leisure pilot who holds a licence with a valid MHG (land) rating, or, in order to obtain the MHG (land) rating, the leisure pilot who holds a licence with a valid MHG (sea) rating shall fulfil at least one of the following requirements:

57.1. complete at least eight hours of dual flight instruction, if there is a valid rating for the relevant class;

57.2. complete 10 hours of dual flight instruction, if the rating for the relevant class is not valid.

58. If the leisure pilot who wants to obtain the MHG (land) or MHG (sea) rating has flight experience as the pilot-in-command, the compliance with the requirements referred to in Sub-paragraph 56.1 of this Regulation may be credited towards obtaining the abovementioned rating. The scope of requirements to be credited shall be determined by an approved training organisation where the leisure pilot acquires the training course, taking into account the evaluation of the skill test/proficiency check conducted prior to commencing training in accordance with the requirements for obtaining the MHG (land) or MHG (sea) rating. The number of flight hours to be credited may not exceed the total number of flight hours while acting as the pilot-in-command and 50 % of the flight hours referred to in Sub-paragraph 56.1 of this Regulation.

59. In order to maintain the MHG (land) or MHG (sea) rating, the leisure pilot shall complete at least 12 flight hours within 24 months as the pilot-in-command in the powered hang glider, conducting 12 take-off and landing manoeuvres.

60. If the MHG (land) or MHG (sea) rating is not maintained in accordance with the procedures referred to in Paragraph 59 of this Regulation, the leisure pilot shall fulfil one of the following requirements:

60.1. conduct training flights or solo flights under the supervision of the flight instructor in accordance with the requirements referred to in Paragraph 59 of this Regulation;

60.2. complete the proficiency check prior to the use of the privileges assigned by the rating.

61. If the leisure pilot holds a licence with a valid MHG (land) and MHG (sea) rating, then, for the purpose of maintaining both abovementioned ratings, within 24 months the leisure pilot shall complete at least 12 flight hours as the pilot-in-command, conducting 12 take-off and landing manoeuvres in the land or sea motor hang glider or both abovementioned aircraft, including in each aircraft:

61.1. complete at least one flight hour as the pilot-in-command, conducting six take-off and landing manoeuvres;

61.2. participate in the refresher training of flight skills as part of which a flight with duration of at least one hour shall be dual instruction time.

3.7. Requirements for Obtaining the ULGYR (Land) or ULGYR (Sea) Rating

62. In order to obtain the ULGYR (land) or ULGYR (sea) rating, the applicant shall complete at least 35 hours of flight instruction in the ultralight land or sea gyroplane, including:

62.1. 20 hours of dual flight instruction in the ultralight land or sea gyroplane with which the skill test is taken;

62.2. 10 solo hours of flight instruction under the supervision of the flight instructor, including at least five hours of solo cross-country flight time whereof one cross-country flight shall be of at least 150 kilometres with one landing and a full-stop landing at an aerodrome which is not the departure aerodrome of the aircraft.

63. In order to obtain the ULGYR (sea) rating, the leisure pilot who holds a licence with a valid ULGYR (land) rating, and, in order to obtain the ULGYR (land) rating, the leisure pilot who holds a licence with a valid ULGYR (sea) rating shall fulfil at least one of the following requirements:

63.1. complete at least eight hours of dual flight instruction, if there is a valid rating for the relevant class or type;

63.2. complete 10 hours of dual flight instruction, if the rating for the relevant class or type is not valid.

64. If the leisure pilot who wants to obtain the ULGYR (land) or ULGYR (sea) rating has flight experience as the pilot-in-command, the compliance with the requirements referred to in Sub-paragraph 62.1 of this Regulation may be credited towards obtaining the abovementioned rating. The scope of requirements to be credited shall be determined by an approved training organisation where the leisure pilot acquires the training course, taking into account the evaluation of the skill test/proficiency check conducted prior to commencing training in accordance with the requirements for obtaining the ULGYR (land) or ULGYR (sea) rating. The number of flight hours to be credited may not exceed the total number of flight hours while acting as the pilot-in-command and 50 % of the flight hours referred to in Sub-paragraph 62.1 of this Regulation.

65. In order to maintain the ULGYR (land) or ULGYR (sea) rating, with 24 months the leisure pilot shall complete the following in the ultralight gyroplane:

65.1. complete at least 12 flight hours as the pilot-in-command, conducting 12 take-off and landing manoeuvres;

65.2. complete at least one hour of the refresher training of flight skills with the flight instructor.

66. The refresher training of flight skills in the ultralight land gyroplane may be omitted, if the leisure pilot has passed the proficiency check for the class or type rating, the skill test or assessment of competence in the land gyroplane of any class or type. The refresher training of flight skills in the ultralight sea gyroplane may be omitted, if the leisure pilot has passed the proficiency check for the class or type rating, the skill test or assessment of competence in the sea gyroplane of any class or type.

67. If the ULGYR (land) or ULGYR (sea) rating is not maintained in accordance with the procedures referred to in Paragraph 65 of this Regulation, the leisure pilot shall meet one of the following requirements:

67.1. conduct dual instruction flights or solo flights under the supervision of the flight instructor in accordance with the requirements referred to in Paragraph 65 of this Regulation;

67.2. complete the proficiency check prior to the use of the privileges assigned by the rating.

68. If the leisure pilot holds a licence with a valid ULGYR (land) and ULGYR (sea) rating, then, for the purpose of maintaining both abovementioned ratings, within 24 months the leisure pilot shall complete at least 12 flight hours as the pilot-in-command, conducting 12 take-off and landing manoeuvres in the land or sea ultralight gyroplane or both abovementioned aircraft, including in each aircraft:

68.1. complete at least one flight hour as the pilot-in-command, conducting six take-off and landing manoeuvres;

68.2. participate in the refresher training of flight skills as part of which a flight with duration of at least one hour shall be conducted with the flight instructor. If the conditions referred to in Paragraph 66 of this Regulation are fulfilled, the refresher training of flight skills may be omitted.

69. The leisure pilot who has received a licence with the ULGYR (land) or ULGYR (sea) rating has the privilege to conduct flights on an ultralight gyroplane of another variant which was not used in the skill test, if the leisure pilot has completed the differences training or familiarisation training.

3.8. Requirements for Obtaining Additional Rating for the Leisure Pilot Licence

70. The leisure pilot may obtain the additional ratings referred to in Sub-paragraph 6.2 of this Regulation, if he or she has acquired theoretical knowledge and has conducted training flights in accordance with the relevant training programme of an approved training organisation.

71. In order to obtain the NR rating, the leisure pilot who holds a valid ULA (land) or ULTMG rating shall complete seven hours of flight instruction, including:

71.1. two hours of basic instrument dual instruction time which covers simple manoeuvres, straight and horizontal flights with various engine power and configuration settings, climb and descent manoeuvres, turns with standard speed, climbs and descents to fly according to the selected route, completion of turns during climbs and descents of the aircraft;

71.2. three hours of dual flight instruction;

71.3. at least one hour of dual flight instruction, conducting a cross-country flight of at least 50 kilometres with one landing and a full-stop landing at an aerodrome that is not the departure aerodrome of the aircraft;

71.4. five solo take-off and landing manoeuvres under the supervision of the flight instructor.

72. If the leisure pilot has a licence with the ULA (land) and ULTMG rating, the requirements referred to in Paragraph 71 of this Regulation may be fulfilled if flights are conducted both with the ultralight land aeroplane and ultralight touring motor glider.

73. In order to obtain the ABTR rating, the leisure pilot who has a valid ULA (land) or ULTMG rating and who after receipt of the abovementioned rating has completed 40 flight hours in the relevant aircraft as the pilot-in-command, or the leisure pilot who has a valid ULS rating and who has completed 120 solo take-off manoeuvres as the pilot-in-command shall fulfil one of the following requirements:

73.1. complete five hours of flight instruction;

73.2. complete 20 flights of aerobatic instruction in an aircraft of the ultralight category.

74. The leisure pilot shall exercise the privileges assigned by the ABTR rating to conduct flights on the aircraft of the category which was used for training flights.

75. The leisure pilot may exercise the privileges assigned by the ABTR rating to conduct flights on an aircraft of another category, if the leisure pilot has obtained the rating for conducting flights in the aircraft of the relevant category and if he or she has:

75.1. completed three hours of dual flight instruction;

75.2. completed the full aerobatic training syllabus for the relevant category of aircraft.

76. In order to obtain the SPTR rating, the leisure pilot who has a valid ULA (land) or ULTMG rating and who after receipt of the abovementioned rating has completed 30 flight hours in the relevant aircraft as the pilot-in-command, and who has completed 60 take-off and landing manoeuvres in the aircraft with which the sailplane is going to be towed shall fulfil the following requirements:

76.1. completes 10 training flights by towing ultralight sailplane, including five dual instruction flights;

76.2. completes five familiarisation flights in the ultralight sailplane towed with the aircraft, if the leisure pilot does not have such experience in conducting flights with a sailplane or ultralight sailplane.

77. In order to obtain the BRTR rating, the leisure pilot who has a valid ULA (land) or ULTMG rating and who after receipt of the abovementioned rating has completed 100 flight hours in the relevant aircraft as the pilot-in-command, including 200 take-off and landing manoeuvres, and 30 flight hours in the aircraft with which the poster towed, shall complete 10 training flights in banner towing, including five dual instruction flights.

78. The leisure pilot may exercise the privileges assigned by the BRTR rating for conducting flights in another ultralight aircraft which was not used in the training of banner towing, if the leisure pilot has completed three training flights under the supervision of the flight instructor, completing the full banner towing training syllabus in the relevant aircraft.

79. In order to maintain the SPTR or BRTR rating, within 24 months the leisure pilot shall conduct five sailplane towing or five banner towing flights.

80. If the SPTR and BRTR rating is not maintained in accordance with the procedures referred to in Paragraph 79 of this Regulation, the leisure pilot shall fulfil one of the following requirements:

80.1. conduct dual instruction sailplane towing and banner towing flights;

80.2. conduct solo flights under the supervision of the flight instructor in accordance with the requirements referred to in Paragraph 79 of this Regulation.

81. In order to obtain the MR rating, the leisure pilot who holds a licence with a valid ULA (land) or ULTMG rating shall fulfil the following requirements:

81.1. within 24 months completes training flights in the ultralight aeroplane and ultralight touring motor glider on wheels in order to obtain the privilege to take-off and land on a surface not covered with snow or on skis in order to obtain the privilege to take-off and land on a surface covered with snow;

81.2. passes the skill test in order to demonstrate the ability to conduct flights on mountains. The abovementioned test shall cover the following:

81.2.1. a theoretical test on flights in mountains;

81.2.2. six landings and take-offs from at least two different surfaces (except for the surface from which the take-off is conducted) in accordance with the requirements of the mountain flight rating.

82. The MR rating may be revalidated, if the leisure pilot complies with at least one of the following requirements:

82.1. has completed at least six landing manoeuvres in mountains within the last 24 months;

82.2. has passed the proficiency check by complying with the requirements referred to in Sub-paragraph 81.2.2 of this Regulation.

83. In order to obtain the CLR rating, the leisure pilot who holds a valid ULS rating and who after receipt of the abovementioned rating has completed 30 flight hours with the sailplane or powered sailplane (except for the ultralight touring motor glider) as the pilot-in-command shall meet the following requirements:

83.1. complete at least two hours of basic instrument flight instruction;

83.2. pass the skill test.

84. In order to maintain the CLR rating, within 24 months the leisure pilot shall fulfil at least one the following requirements in the ultralight sailplane or ultralight powered sailplane:

84.1. complete at least one flight hour;

84.2. conduct five flights as the pilot-in-command in accordance with the cloud flying rating.

85. If the CLR rating is not maintained in accordance with the procedures referred to in Paragraph 84 of this Regulation, the leisure pilot shall fulfil one of the following requirements:

85.1. conduct dual instruction flights in accordance with the requirements referred to in Paragraph 84 of this Regulation;

85.2. complete the proficiency check prior to the use of the privileges assigned by the rating.

4. Requirements for Conducting Technical Inspection Flights

86. A technical inspection flight is a special flight which is completed in the ultralight aircraft referred to in Annex 1 to Regulation No 2018/1139 and which does not conform to the requirements for airworthiness, but which has obtained the permission for conducting a special flight in accordance with the laws and regulations regarding aircraft airworthiness.

87. The technical inspection flight shall be conducted by a leisure pilot who holds a licence with a valid rating in an aircraft of the relevant category, if he or she has fulfilled the following requirements:

87.1. has obtained the flight instructor certificate;

87.2. has completed at least 1000 flight hours in an aircraft of the relevant category, including 400 flight hours as the pilot-in-command;

87.3. has completed at least 30 flight hours in an aircraft of the relevant category within the last 12 months;

87.4. over the previous 90 days has completed at least three solo take-off and landing manoeuvres in an aircraft of the relevant category.

5. Requirements for Obtaining the Flight Engineer Licence and Rating

88. The flight engineer licence with the ratings referred to in Sub-paragraph 6.3 of this Regulation may be obtained by a person who has attained 18 years of age.

89. The applicant shall acquire theoretical knowledge and complete training flights in an approved training organisation.

90. In order to obtain the flight engineer licence with the relevant endorsement the applicant shall pass:

90.1. the following theoretical examinations:

90.1.1. in general subjects - the air law, human performance, communications;

90.1.2. in specific subjects - principles of flight, operational procedures, flight performance and planning, aircraft general knowledge;

90.2. the skill test completed in the aircraft of such type which was used in training.

91. In the skill test, the applicant shall, while acting as the flight engineer of the relevant category of aircraft and under the supervision of the flight instructor or flight examiner appointed by the Civil Aviation Agency, demonstrate the ability to perform a task in an aircraft of the relevant type at such a level of competence which conforms to the privileges assigned under the flight engineer licence.

92. After fulfilling the requirements referred to in Paragraph 91 of this Regulation, the flight engineer licence shall be issued to the applicant with limitation which requires to complete at least 100 flight hours under the supervision of the flight engineer or the pilot-in-command. The abovementioned limitation shall be removed, if the flight engineer submits the Civil Aviation Agency a certification of the fulfilment of the abovementioned conditions.

93. The Civil Aviation Agency may reduce the amount of limitation time referred to in Paragraph 92 of this Regulation by 50 %, if the flight engineer has conducted flights as the pilot-in-command or has fulfilled the duties of the flight engineer in the flight simulator under the supervision of the flight instructor.

94. For the revalidation of flight engineer endorsement referred to in Paragraph 8 of this Regulation, the flight engineer shall pass the proficiency check in an aircraft of the relevant category and type.

95. For the renewal of flight engineer endorsement, the flight engineer shall fulfil the following requirements:

95.1. if the term of validity of the endorsement has expired less than three months ago, the proficiency check shall be completed in an aircraft of the relevant category and type under the supervision of the flight instructor or flight examiner appointed by the Civil Aviation Agency;

95.2. if the term of validity of the endorsement has expired more than three months ago, but not more than three years ago, theoretical knowledge is acquired and practical training is completed in the extent specified by an approved training organisation. After completing the abovementioned training, the proficiency check shall be completed in an aircraft of the relevant category and type under the supervision of the flight instructor or flight examiner appointed by the Civil Aviation Agency;

95.3. if the term of validity of the endorsement has expired more than three years ago, training is completed in an approved training organisation according to the initial training programme in the extent specified by an approved training organisation.

6. Requirements for Obtaining the Flight Instructor Certificate and Flight Engineer Instructor Endorsement and Revalidation and Renewal Thereof

96. The flight instructor certificate referred to in Sub-paragraph 5.4 of this Regulation may be obtained by a person who:

96.1. has attained 18 years of age;

96.2. has obtained the relevant leisure pilot licence with the relevant rating;

96.3. within six months before commencing the instructor training course for the purpose of assessing the ability to acquire this course has completed the skill test in accordance with the category, class, or type of aircraft under the supervision of the flight instructor or flight examiner appointed by the Civil Aviation Agency;

96.4. has completed the flight instructor training course in an approved training organisation;

96.5. has completed the assessment of competence.

97. In order to obtain the flight instructor certificate. the leisure pilot who has obtained a licence with one of the ULA (land), ULA (sea), ULH (land), ULH (sea), ULTMG, ULGYR (land) or ULGYR (sea) ratings shall fulfil the following requirements prior to commencing the instructor training course:

97.1. complete at least 200 flight hours, including 150 flight hours in an aircraft of the relevant category as the pilot-in-command and at least 30 flight hours in the single-engine piston ultralight aircraft of the relevant class or type (whereof at least five flight hours are completed within the last six months before commencing the instructor training course);

97.2. complete at least one cross-country flight of 300 kilometres as the pilot-in-command with one landing and a full-stop landing at an aerodrome which is not the departure aerodrome of the aircraft;

97.3. complete a module of at least 10 hours of basic instrument flight instruction in an aircraft (whereof not more than five hours - in the flight simulator). By making an entry in the pilotʼs logbook, the instrument flight instructor shall endorse the completion of the training of the relevant module.

98. After fulfilling the requirements referred to in Paragraphs 96 and 97 of this Regulation, the leisure pilot shall:

98.1. complete 50 hours of the theoretical knowledge instruction for instructors;

98.2. complete 25 hours of the teaching methodology programme;

98.3. complete 25 hours of instructor flight instruction in the aircraft of the relevant category, class, or type, including at least 20 hours of dual flight instruction. Five hours of flight instruction may be completed with another leisure pilot who wants to obtain the flight instructor endorsement.

99. In order to obtain the flight instructor certificate, the leisure pilot who has obtained a licence with a valid ULS, HG, MHG (land) or MHG (sea) rating, prior to commencing the flight instructor training course, shall complete at least 100 hours of flight instruction, including 75 hours in an aircraft of the relevant category as the pilot-in-command (whereof at least 15 hours of flight instruction are completed in the ultralight sailplane, hang glider, or motor hang glider within the last six months before commencing the flight instructor training course).

100. After fulfilling the requirements referred to in Paragraphs 96 and 99 of this Regulation, the leisure pilot shall:

100.1. complete 30 hours of the theoretical knowledge instruction for instructors;

100.2. complete 10 hours of the teaching methodology programme;

100.3. complete 10 hours of dual flight instruction for flight instructors in an aircraft of the relevant category, including at least 20 training take-off and landing manoeuvres.

101. An approved training organisation may reduce the number of theoretical training hours referred to in Sub-paragraphs 98.1 and 100.1 of this Regulation to 20 hours, if the leisure pilot has obtained the flight instructor certificate for flights in an aircraft of another category or type.

102. If the flight instructor certificate has been issued to the leisure pilot for the first time, it shall provide for the following limitations:

102.1. they shall not have the privilege to authorise a student pilot to conduct the first solo flight;

102.2. they shall not have the privilege to authorise a student pilot to conduct the first solo cross-country flight.

103. The Civil Aviation Agency shall remove the limitations referred to in Paragraph 102 of this Regulation, if under supervision of the flight instructor appointed by an approved training organisation the flight instructor has:

103.1. completed at least 50 hours of flight instruction in an ultralight aircraft of the relevant category;

103.2. supervised solo training flights of at least 25 student pilots.

104. For the revalidation of the flight instructor certificate, the flight instructor shall fulfil the following requirements within the 36-month period before the expiry of the term of validity of the abovementioned certificate:

104.1. complete 40 hours of flight instruction as the flight instructor or flight examiner (whereof at least 15 flight hours are completed over the previous 12 months);

104.2. complete at least 30 training take-off and landing manoeuvres in an ultralight aircraft of the relevant category (whereof 20 training take-off and landing manoeuvres are completed within the last 12 months).

105. In addition to the requirements referred to in Paragraph 104 of this Regulation, the flight instructor shall fulfil one of the following conditions:

105.1. attend the flight instructor seminar within 36 months before the expiry of the term of validity of the flight instructor certificate;

105.2. complete the assessment of competence within 12 months before the expiry of the term of validity of the flight instructor certificate.

106. If the flight instructor fails to fulfil the requirements referred to in Paragraph 104 of this Regulation, he or she shall fulfil the requirements referred to in Sub-paragraphs 105.1 and 105.2 of this Regulation in order to revalidate the flight instructor certificate.

107. For the revalidation of the flight instructor certificate, each alternate period the flight instructor shall complete the assessment of competence.

108. For the renewal of the flight instructor certificate, the flight instructor shall fulfil the following requirements:

108.1. attend the flight instructor seminar within 12 months before the renewal of the flight instructor certificate;

108.2. complete the assessment of competence.

109. In order to obtain the flight engineer instructor endorsement the flight engineer who holds the licence with the rating for the relevant aircraft category and type and who prior to commencing the instructor training course has completed at least 1500 flight hours while fulfilling the duties of the flight engineer shall fulfil the following requirements:

109.1. complete 10 hours of the theoretical knowledge instruction for instructors;

109.2. complete 25 hours of the teaching methodology programme;

109.3. complete 10 hours of flight instruction for instructors in a multi-pilot aircraft of the relevant category and type or the simulator of the relevant aircraft type.

110. For the revalidation of the flight engineer instructor endorsement, the flight engineer within 12 months before the expiry of the term of validity of the abovementioned endorsement shall fulfil one of the following requirements within the scope of the training course on the relevant type of aircraft:

110.1. conduct at least one simulator session (not less than three hours) with training exercises in order to obtain the aeroplane or helicopter type rating;

110.2. conduct one hour of flight instruction in the aircraft with training exercises in order to obtain the aeroplane or helicopter type rating, conducting at least two take-off and landing manoeuvres;

110.3. complete the refresher training course on flight skills for flight engineers instructors in an approved training organisation.

111. For the revalidation of the flight engineer instructor endorsement, each alternate period the flight engineer shall complete the assessment of competence .

112. For the renewal of the flight engineer instructor endorsement, the flight engineer shall fulfil the following requirements within 12 months before the renewal of the abovementioned endorsement:

112.1. complete 30 cross-country flights, take-off and landing manoeuvres while fulfilling the duties of the flight engineer (not more than 15 cross-country flights may be conducted in the flight simulator);

112.2. complete the refresher training course for flight engineers instructors in an approved training organisation;

112.3. complete not less than three hours of flight instruction in an aircraft of the relevant category and type or the simulator for the relevant aircraft type while fulfilling the duties of the flight engineer instructor according to the training programme in order to obtain the aircraft type rating under the supervision of the flight instructor or flight examiner appointed by the Civil Aviation Agency.

113. The flight engineer instructor may obtain the privilege to train for flights with an aircraft of another type, if his or her licence contains the relevant aircraft type rating and he or she:

113.1. within 12 months before requesting the instructor certificate for an aircraft of another type has completed at least 15 cross-country flights, including 15 take-off and landing manoeuvres while fulfilling the duties of the flight engineer (not more than seven flights may be conducted in the flight simulator);

113.2. has completed 10 hours of flight instruction for instructors in a multi-pilot aircraft of the relevant category and type or the simulator of the relevant aircraft type.

7. Requirements for Obtaining the Flight Examiner Certificate and Revalidation Thereof

114. General requirements for obtaining the flight examiner certificate and revalidation and renewal thereof are determined by the requirements of Subpart K of Annex I to Regulation No 1178/2011.

115. In order to obtain the flight examiner certificate, the leisure pilot who has obtained a licence with one ULA (land), ULA (sea), ULH (land), ULH (sea), ULTMG, ULGYR (land) or ULGYR (sea) rating and the flight instructor certificate shall fulfil the following requirements prior to commencing the flight examiner training course:

115.1. complete at least 500 flight hours, including 150 flight hours an aircraft of the relevant category as the pilot-in-command;

115.2. complete 500 take-offs and landings of flight instruction for the MR rating as the flight instructor to test the skills for the MR rating.

116. In order to obtain the flight examiner certificate, the leisure pilot who has received the licence with a valid ULS rating and the flight instructor certificate, prior to commencing the flight examiner training course, shall:

116.1. complete at least 300 flight hours in an aircraft of the relevant category as the pilot-in-command;

116.2. complete 150 hours of flight instruction as the flight instructor or complete 300 take-off and landing manoeuvres;

116.3. complete 50 hours of flight instruction in the universal ultralight powered sailplane as the flight instructor for the extension of the privileges granted by the ULS rating to flights with the universal ultralight powered sailplane;

116.4. complete the skill tests and proficiency checks in respect of the CLR rating, if the flight examiner has completed at least 200 flight hours as the pilot of the ultralight sailplane or ultralight powered sailplane, including at least five hours of flight instruction or 25 training flights as the flight instructor in respect of the CLR rating.

117. In order to obtain the flight examiner certificate the leisure pilot who has received a licence with a valid HG, MHG (land) or MHG (sea) rating and the flight instructor certificate, prior to commencing the flight examiner training course, shall complete:

117.1. at least 150 flight hours in an aircraft of relevant category as the pilot-in-command;

117.2. at least 75 hours of flight instruction as the flight instructor.

118. In order to obtain additional privileges to check the activity of such flight instructor who undergoes training to obtain the ULA (land), ULA (sea), ULH (land), ULH (sea), ULTMG, ULGYR (land) or ULGYR (sea) rating, the flight examiner who has obtained the flight instructor certificate shall fulfil the following requirements:

118.1. complete 1000 flight hours as the pilot of an aircraft of the relevant category;

118.2. complete at least 50 flight hours, training a person who wants to obtain the flight instructor certificate.

119. In order to obtain additional privileges to check the activity of such flight instructor who undergoes training to obtain the ULS rating, the flight examiner who has received the flight instructor certificate shall fulfil the following requirements:

119.1. complete 300 flight hours in the ultralight sailplane or ultralight powered sailplane as the pilot-in-command;

119.2. complete at least 10 flight hours or complete 30 launch manoeuvres, training a person who wants to obtain the flight instructor certificate.

120. In order to obtain additional privileges to check the activity of such flight instructor who undergoes training to obtain the HG, MHG (land) or MHG (sea) rating, the flight examiner who has received the flight instructor certificate shall fulfil the following requirements:

120.1. complete at least 300 flight hours in an aircraft of the relevant category;

120.2. complete at least 20 flight hours, including 30 take-off and landing manoeuvres, training a person who wants to obtain the flight instructor certificate.

8. Requirements for Licence Holders to Conduct Flights with Ultralight Aircrafts and Aircrafts Referred to in Annex I to Regulation No 2018/1139, but not Included in the List of Aircraft Class or Type Ratings Published by the European Aviation Safety Agency

121. So that a flight crew member who has received a flight crew member licence with a valid rating for the relevant aircraft class or type in accordance with the requirements of Regulation No 1178/2011 could conduct flights in an aircraft of the relevant ultralight class or ultralight type, he or she shall fulfil the following requirements:

121.1. complete the differences training - conduct flights with the ultralight aircraft with the flight instructor;

121.2. complete three solo take-off and landing manoeuvres under supervision of the flight instructor;

121.3. obtain in the pilotʼs logbook the endorsement of the flight instructor on the compliance with the requirements referred to in Sub-paragraphs 121.1 and 121.2 of this Regulation.

122. The flight experience obtained on the ultralight aircraft is not credited in the total flight experience of the flight crew member in the aircraft category "aeroplane", "helicopter", "sailplane", and "gyroplane".

123. So that a flight crew member who has received the flight crew member licence without a valid rating for the relevant aircraft class or type in accordance with the requirements of Regulation No 1178/2011 could obtain the leisure pilot licence with the privilege to conduct flights on the ultralight aircraft of the same category, he or she shall fulfil the following requirements:

123.1. complete three hours of flight instruction in accordance with the approved relevant training programme, including 10 training take-off and landing manoeuvres with the flight instructor and 10 solo take-off and landing manoeuvres under the supervision of the flight instructor;

123.2. pass the skill test to demonstrate the ability to conduct flights with the relevant ultralight aircraft while acting as the pilot-in-command and, during the abovementioned test, demonstrate theoretical knowledge of the ultralight aircraft in the following areas:

123.2.1. aircraft operational procedures;

123.2.2. flight performance and planning;

123.2.3. ultralight aircraft general knowledge.

124. So that the flight instructor who has received the certificate with a valid rating for the relevant aircraft category or type in accordance with the requirements of Regulation No 1178/2011 could obtain the right to perform training for obtaining the leisure pilot licence and rating in the category of ultralight aircrafts, he or she shall fulfil the following requirements:

124.1. complete the differences training - flights with the ultralight aircraft with the flight instructor;

124.2. complete three solo take-off and landing manoeuvres under supervision of the flight instructor;

124.3. obtain in the pilotʼs logbook the endorsement of the flight instructor on the compliance with the requirements referred to in Sub-paragraphs 124.1 and 124.2 of this Regulation.

125. So that the flight instructor who has received the certificate in the relevant category aircraft in accordance with the requirements of Regulation No 1178/2011 without a valid relevant type rating of the aircraft and a valid instructor certificate could obtain the instructor certificate with the right to perform training for obtaining the leisure pilot licence and rating in the category of ultralight aircrafts in accordance with the requirements of this Regulation, he or she shall first of all meet the requirements referred to in Paragraph 123 of this Regulation and in addition shall fulfil the following requirements:

125.1. attend the flight instructor seminar within 12 months before the expiry of the term of validity of the abovementioned certificate;

125.2. complete the assessment of competence.

126. The flight instructor experience obtained when conducting flights on the ultralight aircraft is not credited in the total flight experience of the flight crew member in the aircraft category "aeroplane", "helicopter", "sailplane", and "gyroplane".

127. So that the flight examiner who has received the certificate with a valid relevant class or type aircraft rating in accordance with the requirements of Regulation No 1178/2011 could perform the skill test for the purpose of obtaining the leisure pilot licence and rating in the category of the ultralight aircraft and could obtain the relevant flight examiner certificate, he or she shall meet the following requirements:

127.1. complete the differences training - flights with the ultralight aircraft with the flight instructor;

127.2. complete three solo take-off and landing manoeuvres under the supervision of the flight instructor;

127.3. obtain the endorsement of the flight instructor in the pilotʼs logbook on the compliance with the requirements referred to in Sub-paragraphs 127.1 and 127.2 of this Regulation.

128. The flight examiner experience obtained while performing skill tests, proficiency checks or assessment of competence for the purpose of obtaining the leisure pilot licence, flight instructor certificate, and ultralight class or ultralight type aircraft rating is not credited in the total flight experience of the flight crew member in the aircraft category "aeroplane", "helicopter", "sailplane", and "gyroplane".

129. So that a flight crew member who has received the licence in accordance with the requirements of Regulation No 1178/2011 could conduct flights on aircrafts referred to in Annex I to Regulation No 2018/1139, but not included in the list of aircraft class or type ratings published by the European Aviation Safety Agency, he or she shall meet the following requirements:

129.1. complete the training course on the relevant category, class, or type aircraft in an approved training organisation;

129.2. pass the skill test under the supervision of the flight examiner appointed by the Civil Aviation Agency.

130. After fulfilling the requirements referred to in Paragraph 129 of this Regulation, the Civil Aviation Agency shall grant the flight crew member the relevant category, class, or type aircraft rating, indicating it in the annex to the flight crew member licence (Annex 5), except when the aircraft is used for commercial air transport.

9. Taking of Theoretical Examinations

131. The person who wants to obtain the flight crew member licence or a new rating, within 12 months after receipt of the certification on completion of the training course on theoretical knowledge, shall take the following theoretical examination in the Civil Aviation Agency:

131.1. in general subjects - the air law, human performance, meteorology, communications, navigation;

131.2. in specific subjects - principles of flight, operational procedures, flight performance and planning, aircraft general knowledge.

132. If within 12 months after receipt of the certification on completion of the training course on theoretical knowledge the applicant has not started to take at least one of the theoretical examinations referred to in Paragraph 131 of this Regulation, the approved training organisation shall repeatedly assess the knowledge level of the applicant and the necessity to complete additional training and also shall issue a new certification.

133. The applicant shall take theoretical examinations in not more than six sessions within 18 months, counting from the last day of the calendar month when the applicant took the first theoretical examination. It shall be allowed to take an examination once in one or several subjects within one theoretical examination session. The examination in one subject may be taken not more than four times.

134. The applicant shall coordinate the time for taking the theoretical examination and subjects with the Civil Aviation Agency not later than five working days before the day of taking the planned theoretical examination.

135. The procedures for taking an examination referred to in Annex 6 to this Regulation shall be conformed to during the theoretical examination. During the theoretical examination the applicant shall, in the form of a test, answer a definite number of questions in a definite period of time on each subject based on the rating he or she wants to obtain (Annex 6). The applicant shall take the theoretical examination independently, without the assistance of other persons.

136. The applicant shall take a theoretical examination in:

136.1. English - to obtain the flight crew member licence in accordance with the requirements of Regulation No 1178/2011;

136.2. Latvian or English - to obtain the flight crew member licence referred to in Sub-paragraph 3.1 of this Regulation.

137. The theoretical examination shall be considered as passed, if the applicant has at least 75 per cent of correct answers.

138. The Civil Aviation Agency shall announce the results of the theoretical examination to the applicant in writing within five working days from the date of taking the examination.

139. If the applicant, when taking the examinations referred to in Paragraph 131 of this Regulation, fails to fulfil the requirements referred to in Paragraph 133 of this Regulation, the approved training organisation shall repeatedly assess the knowledge level of the applicant and issue a new certification for re-taking of theoretical examinations.

140. The results of theoretical examinations taken for obtaining the flight crew member licence referred to in Sub-paragraph 5.1 of this Regulation shall be valid for 24 months from the date of taking the last examination.

141. If during taking of the theoretical examination the applicant violates the procedures for taking an examination referred to in Paragraph 135 of this Regulation, the applicant shall be prohibited from taking theoretical examinations in the period of upcoming 12 months. The Civil Aviation Agency shall take the decision to cancel the result of the examination during which the procedures for taking an examination were violated, and also to cancel the results of all previously taken examinations.

10. Taking of the Practical Examination

142. The applicant shall take the practical examination within six months after completing the training course on practical flights.

143. The applicant shall take the practical examination on the aircraft of the same class or type which was used in flight instruction.

144. The applicant shall submit to the Civil Aviation Agency the certification on the acquisition of the training course on theoretical knowledge and practical flights and also the application for taking the practical examination and appointment of the flight examiner not later than five working days before the planned skill test or assessment of competence of the flight examiner.

145. The Civil Aviation Agency shall appoint a flight examiner for taking the practical examination within five working days.

146. Prior to taking of the practical examination, the applicant shall present the following documents to the flight examiner:

146.1. a personal identification document;

146.2. the pilotʼs logbook;

146.3. Class 1 or Class 2 medical certificate or at least a medical statement issued for a driver of B category vehicles.

147. In addition to the documents referred to in Paragraph 145 of this Regulation, the applicant, prior to the skill test or assessment of competence of the flight examiner, shall present the following documents to the flight examiner:

147.1. certification of the acquisition of the training course of theoretical knowledge and practical flights;

147.2. training records which contains information regarding training flights conducted by the applicant, the analysis and results thereof;

147.3. certification on passing of theoretical examinations in the Civil Aviation Agency.

148. The practical examination shall consist of the following stages:

148.1. pre-flight preparation (including aircraft check);

148.2. a theoretical test on operational procedures of the relevant aircraft, flight performance and planning, aircraft general knowledge;

148.3. a skill test/proficiency check, fulfilling the duties of the pilot-in-command or flight engineer;

148.4. post-flight assessment (attestation).

149. During the skill test/proficiency check referred to in Sub-paragraph 148.3 of this Regulation the applicant shall demonstrate that he or she is able to:

149.1. pilot the aircraft, operate the machinery and equipment of such aircraft, function within the crew in accordance with the rating to be obtained, and also ensure successful completion of all procedures and manoeuvres to be performed;

149.2. identify potential hazards and eliminate the errors made;

149.3. perform all tasks of the flight (manoeuvres);

149.4. successfully use the available air navigation information during the flight;

149.5. communicate with confidence with other flight crew members and air traffic control services when preparing for the flight and during the flight.

150. Each stage of the practical examination shall consist of one or several parts during which the applicant shall complete the tasks approved by the Civil Aviation Agency. Each task may be completed not more than twice. If the applicant fails to pass any of the tasks, the entire part shall be deemed as failed.

151. The practical examination shall be:

151.1. passed, if the applicant passes all parts of the practical examination;

151.2. partially passed, if the applicant fails to pass one part of the examination;

151.3. failed, if the applicant fails to pass two or more parts of the examination.

152. If the applicant has partially passed the practical examination, only the failed part of the examination must be re-taken.

153. The applicant who has twice failed the practical examination may re-take the examination if he or she has acquired an additional training course in an approved training organisation.

154. The results of the practical examination taken for obtaining the flight crew member licence referred to in Sub-paragraph 5.1 of this Regulation shall be valid for six months from the date of passing the examination.

11. Closing Provision

155. Cabinet Regulation No. 51 of 18 January 2011, Regulations Regarding Certification of Civil Aviation Flight Crew Members (Latvijas Vēstnesis, 2011, No. 21; 2013, No. 170), is repealed.

Information to be Indicated for Obtaining the Aircraft Flight Crew Member Licence, Rating and Certificate

1. The licence which the person wants to obtain (leisure pilot licence, private pilot licence, sailplane pilot licence, balloon pilot licence, commercial pilot licence, multi-crew pilot licence, airline transport pilot licence, flight engineer licence). It shall be indicated, for instance, whether the licence should be issued for the first time, the licence should be supplemented, or changes in personal data should be made.

2. Given name and surname of the person (in Latvian or in Latin characters) according to the data indicated in the passport or personal identification document.

3. Date of birth (day, month, year).

4. The declared place of residence and actual place of residence of the person (if different), contact details.

5. Nationality.

6. Information regarding valid aircraft flight crew member licences in the possession of the person (licence number, issuing country, date of issuance, term of validity, limitations).

7. Information regarding the medical certificate of the person (number, issuing country, date of issuance, term of validity, limitations) in accordance with the requirements for obtaining the relevant licence and rating.

8. Information regarding the training programme on theoretical knowledge and practical flights acquired by the flight crew member, duration of the training (start and end of the training), and the country where the indicated training programme has been acquired in accordance with the requirements for obtaining the relevant flight crew member licence, rating, or certificate.

9. Information regarding the aircraft category, type, or class ratings, additional ratings, instructor or examiner certificate which the person wants to obtain.

10. Information regarding the number of flight hours in an aircraft and simulator (the number of hours of flight instruction, number of solo flight hours, total number of flight hours while acting as the pilot-in-command and, if necessary, flight experience on the aircraft of another category, type, or class).

11. Information regarding the acquired level of proficiency in radio communications, phraseology, and English in accordance with Annex 1 to the Convention on International Civil Aviation of 7 December 1944.

12. Information regarding the date and country where the theoretical and practical examinations have been passed in accordance with the requirements for obtaining the relevant licence, rating, or certificate.

13. Statement of the person on:

13.1. flight crew member licences or ratings (valid or invalid) issued to him or her;

13.2. awareness of the applicant that he or she may be held administratively liable if false information is provided;

13.3. awareness of the applicant that in accordance with the laws and regulations governing the field of aviation information regarding flight crew member licences, ratings, and flight experience is transferred to competent authorities of other countries or may be requested from the relevant authorities, and also awareness that such information is being obtained and stored by the Civil Aviation Agency to oversee the activity of persons in the field of civil aviation.

14. The date of submitting the application (date, month, year) and signature of the submitter. The detail of the document "signature" shall not be completed, if the application has been drawn up in accordance with the laws and regulations regarding drawing up electronic documents.

Note. The person shall certify the information indicated in the application by submitting the relevant documents to the Civil Aviation Agency.

3. Procedures for taking the theoretical examination:

3.1. prior to the start of the examination the examiner shall check the identity of the applicant. The applicant shall present a personal identification document (passport, identification card) and the latter shall be on the table of the applicant throughout the examination time;

3.2. during the examination the applicant may use:

3.2.1. a pen;

3.2.2. a non-programmable calculator without specific aviation calculating functions;

3.2.3. a mechanical flight computer (E6B, CRP-5 or similar);

3.2.4. a protractor;

3.2.5. a bow compass;

3.2.6. a ruler;

3.2.7. a dictionary which is not specific in the field of aviation;

3.2.8. manuals and information materials provided by the Civil Aviation Agency;

3.2.9. draft paper provided by the Civil Aviation Agency;

3.3. all aids that the applicant wants to use during the examination must be presented to the examiner prior to the start of the examination;

3.4. personal belongings (including mobile phones and other electronic devices) shall be placed by the applicant in the location indicated by the examiner and shall be returned after the end of the examination or with the permission of the examiner. The sound signal of the mobile phone must be turned off;

3.5. during the examination the applicant is prohibited from:

3.5.1. using any reference sources and materials not referred to in Sub-paragraphs 3.2 and 3.3 of this Annex;

3.5.2. communicating with other applicants and other persons;

3.5.3. leaving the seat without the permission of the examiner;

3.6. question-and-answer sheets and also draft sheets shall be handed over by the applicant to the examiner after the end of the examination.
