Procedures for Equalisation of Degrees and Professional Qualifications

Issued pursuant to
Section 59, Paragraph four of the Law On Institutions of Higher Education

1. This Regulation prescribes the procedures by which degrees and professional qualifications acquired in Latvia after completion of a study programme the implementation of which was commenced prior to the coming into force of the legal regulation of degrees and professional qualifications laid down in the Law On Institutions of Higher Education on 26 December 2000 (hereinafter - previously acquired higher education) shall be equalised to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education, as well as the conditions of such equalisation.

2. A person who wishes to equalise his or her previously acquired higher education to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education shall submit an application to the Academic Information Centre.

3. In submitting an application to the Academic Information Centre, a person shall present or append to the application a document of a previously acquired higher education and a transcript of results. If the person presents a document of a previously acquired higher education and a transcript of results, then copies of such documents shall be appended to the application.

4. The application and the documents appended thereto or their copies shall be submitted in printed form or in the form of an electronic document in accordance with the laws and regulations regarding drawing up of electronic documents.

5. The Academic Information Centre shall, within one month after receiving an application, review it and take a decision to equalise a previously acquired higher education to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education, or to refuse to equalise a previously acquired higher education to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education.

6. The Academic Information Centre is entitled to verify the consistency of the provided information and data with the actual circumstances, for example, by requesting information from the institution of institution of higher education that issued the document certifying higher education.

7. If the Academic Information Centre does not have sufficient information to be able to objectively and thoroughly decide the issue on equalisation of a previously acquired higher education to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education, the Academic Information Centre is entitled to request additional information, as well as to extend the term for taking of the decision in accordance with the procedures laid down in the Administrative Procedure Law. The Academic Information Centre is entitled to invite representatives of the institution of higher education that awarded the respective degree or professional qualification to the person, as well as the representatives and experts of the Ministry of Education and Science to decide the issue.

8. A decision to equalise a previously acquired higher education to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education shall be taken, taking into consideration the following conditions:

8.1. qualifications for an acquired higher education awarded by an institution of higher education of the former U.S.S.R. on the basis of the legal regulation that was in force prior to the coming into force of the legal regulation of degrees and professional qualifications included in the Education Law of the Republic of Latvia on 1 July 1991, shall be equalised to an academic master's degree. If an institution of higher education of the former U.S.S.R. has issued a diploma to a person on higher education acquired in a specialty that corresponds to a profession for which, in accordance with the laws and regulations governing this profession, a requirement of a fifth level professional qualification is provided for, the qualifications referred to in the first sentence of this Sub-paragraph shall be equalised to a professional master's degree and a fifth level professional qualification;

8.2. the degree of a candidate of sciences or a doctor of sciences awarded by the Higher Attestation Commission of the U.S.S.R. shall be equalised to a doctoral scientific degree, with the exception of the restrictions laid down in Section 10, Paragraph six of the Law On Scientific Activity;

8.3. academic bachelor's degrees awarded for an acquired higher education on the basis of the legal regulation of degrees and professional qualifications laid down in the Education Law of the Republic of Latvia, which came into force on 1 July 1991, until the coming into force of the legal regulation of degrees and professional qualifications laid down in the Law On Institutions of Higher Education on 1 December 1995, shall be equalised to an academic bachelor's degree;

8.4. academic master's degrees awarded for an acquired higher education on the basis of the legal regulation of degrees and professional qualifications laid down in the Education Law of the Republic of Latvia, which came into force on 1 July 1991, until the coming into force of the legal regulation of degrees and professional qualifications laid down in the Law On Institutions of Higher Education on 1 December 1995, shall be equalised to an academic master's degree;

8.5. qualifications awarded for a higher vocational education programme completed in four-year-long full-time studies or for a higher vocational education programme completed in part-time studies equivalent to the full-time study programme in terms of content and amount, on the basis of the legal regulation of degrees and professional qualifications laid down in the Education Law of the Republic of Latvia, which came into force on 1 July 1991, until the coming into force of the legal regulation of degrees and professional qualifications laid down in the Law On Institutions of Higher Education on 1 December 1995, shall be equalised to a professional bachelor's degree and a fifth level professional qualification;

8.6. qualifications awarded for a higher vocational education programme completed in at least five-year-long full-time studies or for a higher vocational education programme completed in part-time studies equivalent to the full-time study programme in terms of content and amount, on the basis of the legal regulation of degrees and professional qualifications laid down in the Education Law of the Republic of Latvia, which came into force on 1 July 1991, until the coming into force of the legal regulation of degrees and professional qualifications laid down in the Law On Institutions of Higher Education on 1 December 1995, shall be equalised to a professional master's degree and a fifth level professional qualification;

8.7. qualifications awarded for a higher vocational education programme completed in four-year-long full-time studies or for a higher vocational education programme completed in part-time studies equivalent to the full-time study programme in terms of content and amount, on the basis of the legal regulation of degrees and professional qualifications laid down in the Law On Institutions of Higher Education, which came into force on 1 December 1995, until the day of coming into force of the Law "Amendments to the Law On Institutions of Higher Education" on 26 December 2000, shall be equalised to a professional bachelor's degree and a fifth level professional qualification;

8.8. qualifications awarded for a higher vocational education programme completed in at least five-year-long full-time studies or for a higher vocational education programme completed in part-time studies equivalent to the full-time study programme in terms of content and amount, on the basis of the legal regulation of degrees and professional qualifications laid down in the Law On Institutions of Higher Education, which came into force on 1 December 1995, until the day of coming into force of the Law "Amendments to the Law On Institutions of Higher Education" on 26 December 2000, shall be equalised to a professional master's degree and a fifth level professional qualification.

9. A decision to refuse to equalise a previously acquired higher education to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education shall be taken if at least one of the following conditions is met:

9.1. none of the conditions referred to in Paragraph 8 of this Regulation apply;

9.2. the higher education document was issued by an institution of higher education of the Communist Party of the Soviet Union and the All-Union Leninist Young Communist League, and the awarded qualification is related to party activity, scientific communism, party propaganda and agitation or other similar issues;

9.3. higher education documents were not issued using the forms of education documents recognised by the state at the respective time period, except cases when duplicates of the respective higher education documents or an archival statement have been issued.

10. In the decision to equalise a previously acquired higher education to the degrees and professional qualifications laid down in the Law On Institutions of Higher Education, the Academic Information Centre shall indicate the degree or degree and professional qualification laid down in the Law On Institutions of Higher Education to which the previously acquired higher education of a person shall be equalised.

11. The decision of the Academic Information Centre may be contested in the Ministry of Education and Science, and the decision of the Ministry of Education and Science may be appealed in a court in accordance with the procedures laid down in the Administrative Procedure Law.
