Regulations Regarding the Certification of the Equipments, Devices or Instruments and their Components Specially Designed or Adapted for the Operational Activity Measures to be Performed by a Specific Method, the Amount of the State Fee and the Procedures for its Payment

Issued pursuant to Section 51, Paragraph ten of the
Law On the Circulation of Goods of Strategic Significance

I. General Provisions

1. These Regulations prescribe:

1.1. the procedures for certification of the equipments, devices or instruments and their components specially designed or adapted for the operational activity measures to be performed by a specific method (hereinafter - special devices) referred to in the National List of Goods and Services of Strategic Significance of the Republic of Latvia;

1.2. the procedures for the payment of the State fee for certification of special devices, and the amount thereof.

2. Special devices shall be certified by a certification commission established by the Chief of the Security Police (hereinafter - Commission). The commission shall issue a special device certificate (hereinafter - certificate) on the basis of an application by a merchant.

II. Submission of the Application

3. In order to receive the certificate the merchant shall submit an application for receipt of the certificate (hereinafter - application) (Annex 1). The following shall be indicated in the application:

3.1. name and unified registration number of the merchant;

3.2. legal address, telephone number and e-mail address of the merchant;

3.3. way for receipt of the certificate - in paper form or electronically;

3.4. complete name and number of the special device (if such has been assigned by the manufacturer); and

3.5. list of the attached technical documentation.

4. The following shall be appended to the application:

4.1. technical documentation for the special device (hereinafter - technical documentation); and

4.2. sample of the special device, except in the case referred to in Clause 5 of these Regulations.

5. If the circulation of the special device has not been started in the Republic of Latvia, sample of the special device shall not be submitted.

6. If only technical documentation is appended to the application, the merchant shall submit the application in paper form or electronically in accordance with the procedures prescribed in the regulatory enactments regulating the circulation of electronic documents.

7. If sample of the special device is also appended to the application, the merchant shall submit the application in paper form.

III. Examination of the Application and Certification of the Special Device

8. Within one month following the receipt of an application the Commission shall assess the documents appended to the application, research the sample of the special device (if such has been submitted) and take a decision regarding the issue of the certificate or refusal to issue the certificate. The decision of the Commission may be contested in accordance with the procedures prescribed by the Administrative Procedure Law submitting the relevant application to the Chief of the Security Police. The decision of the Chief of the Security Police may be appealed to the Administrative District Court.

9. Special devices whose circulation has not been commenced in the Republic of Latvia shall be assessed by the Commission on the basis of the documentation submitted by the merchant.

10. The Commission shall take a decision to refuse to issue the certificate if:

10.1. the merchant has not submitted the documents referred to in Clauses 3 and 4 of these Regulations and a sample of the special device (if such is required);

10.2. the special device does not comply with the parameters for special devices as prescribed by the National List of Goods and Services of Strategic Significance of the Republic of Latvia; or

10.3. when examining the sample of the special device referred to in Clause 8 of these Regulations, it is determined that the special device has not been designed or adapted for the operational activity measures to be performed by a specific method.

11. If the information indicated in the submitted documents is incomplete or imprecise; the documents referred to in Clauses 3 and 4 of these Regulations and a sample of the special device (if such is required) have not been received, or it is necessary to investigate the information in order to take a decision regarding the issue of the certificate or refusal to issue the certificate, the Commission in accordance with the procedures prescribed by the Administrative Procedure Law shall lengthen the term for taking a decision and shall perform an additional assessment or request the necessary information and a sample of the special device (if such is required) from the merchant.

12. The Commission shall send the referred to decision to the merchant within three working days after taking a decision regarding the issue of the certificate or regarding the refusal to issue the certificate.

13. If the Commission has refused to issue the certificate and the merchant repeatedly submits the special device for certification, the State fee shall be paid repeatedly.

14. The type, name, number and other identifying data shall be indicated on the certificate (Annex 2) in accordance with the technical documentation of the special device.

15. The Commission shall return the special device sample to the merchant within 10 working days after taking a decision regarding the issue of the certificate or regarding the refusal to issue the certificate.

16. When receiving the certificate in paper form, the representative of the merchant shall produce his or her personal identification document and the supporting document regarding the representation, and shall certify the receipt of the certificate by signature.

17. If the merchant has expressed a wish to receive the certificate electronically, the Commission shall send to the merchant the certificate in accordance with the procedures prescribed in the regulatory enactments regulating the circulation of electronic documents within three working days from announcing its decision.

IV. Amount and Procedures for Payment of the State fee

18. The merchant shall pay the State fee for the amount of LVL 25 for the receipt of the certificate.

19. The State fee shall be paid prior to submission of the application. The payment shall be made through the paying authority which has the right to provide payment service within the meaning of the Law on Payment Services.

20. The coefficient 0.9 shall be applied to the State fee payment if an application is submitted and the certificate is issued electronically.

21. The State fee shall be paid into the State basic budget.

V. Closing Provision

22. Special devices which are in circulation in the Republic of Latvia until the day of coming into force of these Regulations, shall be submitted to the Security Police for certification no later than by 1 April 2011.
