Republic of Latvia Cabinet By-law of the Competition CouncilIssued pursuant to 1. The Competition Council is a direct administrative institution subject to the supervision of the Minister for Economics. 2. The Competition Council, in accordance with the tasks specified and rights granted thereto in the Competition Law, Advertising Law and other regulatory enactments, shall implement State policy in the matters of development and protection of competition. The Chair of the Competition Council (hereinafter - the Chair) shall perform the functions of the head of the direct administration institution specified in the State Administration Structure Law and the functions specified in the Competition Law. 4. The Competition Council shall be composed of: 4.1. a collegial decision-making authority - Council; and 4.2. an Executive Directorate. 5. The Council shall be composed of a Chair and two members of the Council. Council members shall be independent in taking a decision in the field of competition and advertising, as well as a decision regarding entering into an administrative contract. [23 March 2010] 6. The Chair shall specify the duties and rights of Council members in a job description. 7. The Executive Director shall perform the functions prescribed by the Competition Law. 8. In the absence of the Executive Director, the duties thereof shall be performed by the deputy. 9. The Chair shall ensure the rule of law in the operation of the Competition Council. The Chair shall be responsible for the establishment and operation of the system for the internal control and examination of administrative decisions. 10. The Council shall ensure the rule of law in the decisions taken in the field of competition and advertising. 11. The decisions in the field of competition and advertising taken by the Competition Council and actual action may be appealed to an Administrative Regional Court. 12. The Competition Council shall prepare once a year a public report regarding its operation and shall provide reports regarding expenditure of the budget resources. 13. Cabinet Regulation No. 849 of 12 October 2004, By-law of the Competition Council (Latvijas Vēstnesis, 2004, No. 164) is repealed. Prime Minister I. Godmanis Minister for Economics K. Gerhards
