Procedure by which Close Relatives of Missing Persons Shall Give Written Consent for Inclusion of the Comparative Samples and Information in the National DNA Database and the Processing Thereof

Issued pursuant to
Section 12, Paragraph three
of the Law On Development
and Use of the National DNA Database

1. These Regulations prescribe the procedure by which close relatives of missing persons shall give written consent for inclusion of the comparative samples and information in the National DNA Database and the processing thereof.

2. Close relatives (parents and children) of missing persons shall give consent for inclusion of the comparative samples and information in the National DNA Database and the processing thereof by completing in writing the Protocol Regarding the Submission of the Comparative Samples of Close Relatives of Missing Persons for Inclusion in the National DNA Database (Annex).

3. The comparative samples from a minor may only be taken with the written consent of his or her legal guardian.

Protocol Regarding the Submission of the Comparative Samples of Close Relatives of Missing Persons for Inclusion in the National DNA Database

Part A
(to be completed by a close relative of the missing person - the donor of the comparative sample)

I have been informed that in accordance with Section 8, Paragraph one of the Personal Data Protection Law a sample donor has the right to acquire information regarding the data operator of the Forensic Department, as well as the address thereof and the objective and substantiation for processing of the data. In accordance with Section 8, Paragraph two, Clause 2 of the referred to Law the sample donor has the right to access his or her personal data and has the possibility to make corrections but in accordance with Section 16, Paragraph one of the Law the sample donor has the right to request that his or her personal data are corrected, as well as their processing is terminated or they are destroyed if they are incomplete, outdated, false or no longer required.
