Par 1974.gada Atēnu konvenciju par pasažieru un to bagāžas jūras pārvadājumu un tās 1976.gada protokolu

1.pants. 1974.gada Atēnu konvencija par pasažieru un to bagāžas jūras pārvadājumu (turpmāk — Konvencija) un tās 1976.gada protokols (turpmāk — Protokols) ar šo likumu tiek pieņemti un apstiprināti.

2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināma Konvencija un Protokols angļu valodā un to tulkojums latviešu valodā.

3.pants. Konvencija stājas spēkā tās 24.pantā un Protokols — tā IV pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

4.pants. Satiksmes ministrija koordinē Konvencijā un Protokolā paredzēto saistību izpildi.

(PAL 1974) Athens Convention Relating to the Carriage of Passengers and their Luggage by Sea, 1974
(Athens, December 13, 1974)

The States Parties to this Convention,

Having recognized the desirability of determing by agreement certain rules relating to the carriage of passengers and their luggage by sea;

Have decided to conclude a Convention for this purpose and have thereto agreed as follows:

Article 1. Definitions

In this Convention the following expressions have the meaning hereby assigned to them:

1. (a) "carrier" means a person by or on behalf of whom a contract of carriage has been concluded, whether the carriage is actually performed by him or by a performing carrier;

(b) "performing carrier" means a person other than the carrier, being the owner, charterer or operator of a ship, who actually performs the whole or a part of the carriage;

2. "contract of carriage" means a contract made by or on behalf of a carrier for the carriage by sea of a passenger or of a passenger and his luggage, as the case may be;

3. "ship" means only a seagoing vessel, excluding an air-cushion vehicle;

4. "passenger" means any person carried in a ship,

(a) under a contract of carriage, or

(b) who, with the consent of the carrier, is accompanying a vehicle or live animals which are covered by a contract for the carrage of goods not governed by this Convention;

5. "luggage" means any article or vehicle carried by the carrier under a contract of carriage, excluding:

(a) articles and vehicles carried under a charter party, bill of lading or other contract primarily concerned with the carriage of goods, and

(b) live animals;

6. "cabin luggage" means luggage which the passenger has in his cabin or is otherwise in his possession, custody or control. Except for the application of paragraph 8 of this Article and Article 8, cabin luggage includes luggage which the passenger has in or on his vehicle;

7. "loss of or damage to luggage" includes pecuniary loss resulting from the luggage not having been re-delivered to the passenger within a reasonable time after the arrival of the ship on which the luggage has been or should have been carried, but does not include delays resulting from labour disputes;

8. "carriage" covers the following periods:

(a) with regard to the passenger and his cabin luggage, the period during which the passenger and/or his cabin luggage are on board the ship or in the course of embarkation or disembarkation, and the period during which the passenger and his cabin luggage are transported by water from land to the ship or vice-versa, if the cost of such transport is included in the fare or if the vessel used for the purpose of auxiliary transport has been put at the disposal of the passenger by the carrier. However, with regard to the passenger, carriage does not include the period during which he is in a marine terminal or station or on a quay or in or on any other part installation;

(b) with regard to cabin luggage, also the period during which the passenger is in a marine terminal or station or on a quay or in or on any other port installation if that luggage has been taken over by the carrier or his servant or agent and has not been re-delivered to the passenger;

(c) with regard to other luggage which is not cabin luggage, the period from the time of its taking over by the carrier or his servant or agent onshore or on board until the time of its re-delivery by the carrier or his servant or agent;

9. "international carriage" means any carriage in which, according to the contract of carriage, the place of departure and the place of destination are situated in two different States, or in a single State if, according to the contract of carriage or the scheduled itinerary, there is an intermediate port of call in another State.

Article 2. Application

1. This Convention shall apply to any international carriage if

(a) the ship is flying the flag of or is registered in a State Party to this Convention, or

(b) the contract of carriage has been made in a State Party to this Convention, or

(c) the place of departure or destination, according to the contract of carriage, is in a State Party to this Convention.

2. Notwithstanding paragraph 1 of this Article, this Convention shall not apply when the carriage is subject, under any other international convention concerning the carriage of passengers or luggage by another mode of transport, to a civil liability regime under the provisions of such convention, in so far as those provisions have mandatory application to carriage by sea.

Article 3. Liability of the carrier

1. The carrier shall be liable for the damage suffered as a result of the death of or personal injury to a passenger and the loss of or damage to luggage if the incident which caused the damage so suffered occurred in the course of the carriage and was due to the fault or neglect of the carrier or of his servants or agents acting within the scope of their employment.

2. The burden of proving that the incident which caused the loss or damage occurred in the course of the carriage, and the extent of the loss or damage, shall lie with the claimant.

3. Fault or neglect of the carrier or of his servants or agents acting within the scope of their employment shall be presumed, unless the contrary is proved, if the death of or personal injury to the passenger or the loss of or damage to cabin luggage arose from or in connection with the shipwreck, collision, stranding, explosion or fire, or defect in the ship. In respect of loss of or damage to other luggage, such fault or neglect shall be presumed, unless the contrary is proved, irrespective of the nature of the incident which caused the loss or damage. In all other cases the burden of proving fault or neglect shall lie with the claimant.

Article 4. Performing carrier

1. If the performance of the carriage or part thereof has been entrusted to a performing carrier, the carrier shall nevertheless remain liable for the entire carriage according to the provisions of this Convention. In addition, the performing carrier shall be subject and entitled to the provisions of this Convention for the part of the carriage performed by him.

2. The carrier shall, in relation to the carriage performed by the performing carrier, be liable for the acts and omissions of the performing carrier and of his servants and agents acting within the scope of their employment.

3. Any special agreement under which the carrier assumes obligations not imposed by this Convention or any waiver of rights conferred by this Convention shall affect the performing carrier only if agreed by him expressly and in writing.

4. Where and to the extent that both the carrier and the performing carrier are liable, their liability shall be joint and several.

5. Nothing in this Article shall prejudice any right of recourse as between the carrier and the performing carrier.

Article 5. Valuables

The carrier shall not be liable for the loss of or damage to monies, negotiable securities, gold, silverware, jewellery, ornaments, works of art, or other valuables, except where such valuables have been deposited with the carrier for the agreed purpose of safe-keeping in which case the carrier shall be liable up to the limit provided for in paragraph 3 of Article 8 unless a higher limit is agreed upon in accordance with paragraph I of Article 10.

Article 6. Contributory fault

If the carrier proves that the death of or personal injury to a passenger or the loss of or damage to his luggage was caused or contributed to by the fault or neglect of the passenger, the court seized of the case may exonerate the carrier wholly or partly from his liability in accordance with the provisions of the law of that court.

Article 7. Limit of liability for personal injury

1. The liability of the carrier for the death of or personal injury to a passenger shall in no case exceed 700,000 francs per carriage. Where in accordance with the law of the court seized of the case damages are awarded in the form of periodical income payments, the equivalent capital value of those payments shall not exceed the said limit.

2. Notwithstanding paragraph 1 of this Article, the national law of any State Party to this Convention may fix, as far as carriers who are nationals of such State are concerned, a higher per capita limit of liability.

Article 8. Limit of liability for loss of or damage to luggage

1. The liability of the carrier for the loss of or damage to cabin luggage shall in no case exceed 12,500 francs per passenger, per carriage.

2. The liability of the carrier for the loss of or damage to vehicles including all luggage carried in or on the vehicle shall in no case exceed 50,000 francs per vehicle, per carriage.

3. The liability of the carrier for the loss of or damage to luggage other than that mentioned in paragraphs 1 and 2 of this Article shall in no case exceed 18,000 francs per passenger, per carriage.

4. The carrier and the passenger may agree that the liability of the carrier shall be subject to a deductible not exceeding 1,750 francs in the case of damage to a vehicle and not exceeding 200 francs per passenger in the case of loss of or damage to other luggage, such sum to be deducted from the loss or damage.

Article 9. Monetary unit and conversion

1. The franc mentioned in this Convention shall be deemed to refer to a unit consisting of65.5 milligrams of gold millesimal fineness 900.

2. The amounts referred to in Article 7 and 8 shall be converted into the national currency of the State of the court seized of the case on the basis of the official value of that currency, by reference to the unit defined in paragraph 1 of this Article, on the date of the judgment or the date agreed upon by the parties. If there is no such official value, the competent authority of the State concerned shall determine what shall be considered as the official value for the purpose of this Convention.

Article 10. Supplementary provisions on limits of liability

1. The carrier and the passenger may agree, expressly and in writing, to higher limits of liability than those prescribed in Articles 7 and 8.

2. Interest on damages and legal costs shall not be included in the limits of liability prescribed in Articles 7 and 8.

Article 11. Defences and limits for carriers' servants

If an action is brought against a servant or agent of the carrier or of the performing carrier arising out of damage covered by this Convention, such servant or agent, if he proves that he acted within the scope of his employment, shall be entitled to avail himself of the defences and limits of liability which the carrier or the performing carrier is entitled to invoke under this Convention.

Article 12. Aggregation of claims

1. Where the limits of liability prescribed in Articles 7 and 8 take effect, they shall apply to the aggregate of the amounts recoverable in all claims arising out of the death of or personal injury to any one passenger or the loss of or damage to his luggage.

2. In relation to the carriage performed by a performing carrier, the aggregate of the amounts recoverable from their servants and agents acting within the scope of their employment shall not exceed the highest amount which could be awarded against either the carrier or the performing carrier under this Convention, but none of the persons mentioned shall be liable for a sum in excess of the limit applicable to him.

3. In any case where a servant or agent of the carrier or of the performing carrier is entitled under Article 11 of this Convention to avail himself of the limits of liability prescribed in Articles 7 and 8, the aggregate of the amounts recoverable from the carrier, or the performing carrier as the case may be, and from that servant or agent, shall not exceed those limits.

Article 13. Loss of right to limit liability

1. The carrier shall not be entitled to the benefit of the limits of liability prescribed in Articles 7 and 8 and paragraph 1 of Article 10, if it is proved that the damage resulted from an act or omission of the carrier done with the intent to cause such damage, or recklessly and with knowledge that such damage would probably result.

2. The servant or agent of the carrier or of the performing carrier shall not be entitled to the benefit of those limits if it is proved that the damage resulted from an act or omission of that servant or agent done with the intent to cause such damage, or recklessly and with knowledge that such damage would probably result.

Article 14. Basis for claims

No action for damages for the death of or personal injury to a passenger, or for the loss of or damage to luggage, shall be brought against a carrier or performing carrier otherwise than in accordance with this Convention.

Article 15. Notice of loss or damage to luggage

1. The passenger shall give written notice to the carrier or his agent:

(a) in the case of apparent damage to luggage:

(i) for cabin luggage, before or at the time of disembarkation of the passenger;

(ii) for all other luggage, before or at the time of its re-delivery;

(b) in the case of damage to luggage which is not apparent, or loss of luggage, within fifteen days from the date of disembarkation or re-delivery or from the time when such re-delivery should have taken place.

2. If the passenger fails to comply with this Article, he shall be presumed, unless the contrary is proved, to have received the luggage undamaged.

3. The notice in writing need not be given if the condition of the luggage has at the time of its receipt been the subject of joint survey or inspection.

Article 16. Time-bar for actions

1. Any action for damages arising out of the death of or personal injury to a passenger or for the loss of or damage to luggage shall be time-barred after a period of two years.

2. The limitation period shall be calculated as follows:

(a) in the case of personal injury, from the date of disembarkation of the passenger;

(b) in the case of death occurring during carriage, from the date when the passenger should have disembarked, and in the case of personal injury occurring during carriage and resulting in the death of the passenger after disembarkation, from the date of death, provided that this period shall not exceed three years from the date of disembarkation;

(c) in the case of loss of or damage to luggage, from the date of disembarkation or from the date when disembarkation should have taken place, whichever is later.

3. The law of the court seized of the case shall govern the grounds of suspension and interruption of limitation periods, but in no case shall an action under this Convention be brought after the expiration of a period of three years from the date of disembarkation of the passenger or from the date when disembarkation should have taken place, whichever is later.

4. Notwithstanding paragraphs 1, 2 and 3 of this Article, the period of limitation may be extended by a declaration of the carrier or by agreement of the parties after the cause of action has arisen. The declaration or agreement shall be in writing.

Article 17. Competent jurisdiction

1. An action arising under this Convention shall, at the option of the claimant, be brought before one of the courts listed below, provided that the court is located in a State Party to this Convention:

(a) the court of the place of permanent residence or principal place of business of the defendant, or

(b) the court of the place of departure or that of the destination according to the contract of carriage, or

(c) a court of the State of the domicile or permanent residence of the claimant, if the defendant has a place of business and is subject to jurisdiction in that State, or

(d) a court of the State where the contract of carriage was made, if the defendant has a place of business and is subject to jurisdiction in that State.

2. After the occurrence of the incident which has caused the damage, the parties may agree that the claim for damages shall be submitted to any jurisdiction or to arbitration.

Article 18. Invalidity of contractual provisions

Any contractual provision concluded before the occurrence of the incident which has caused the death of or personal injury to passenger or the loss of or damage to his luggage, purporting to relieve the carrier of his liability towards the passenger or to prescribe a lower limit of liability than that fixed in this Convention except as provided in paragraph 4 of Article 8, and any such provision purporting to shift the burden of proof which rests on the carrier, or having the effect of restricting the option specified in paragraph 1 of Article 17, shall be null and void, but the nullity of that provision shall not render void the contract of carriage which shall remain subject to the provisions of this Convention.

Article 19. Other conventions on limitation of liability

This Convention shall not modify the rights or duties of the carrier, the performing carrier, and their servants or agents provided for in international conventions relating to the limitation of liability of owners of seagoing ships.

Article 20. Nuclear damage

No liability shall arise under this Convention for damage caused by a nuclear incident:

(a) if the operator of a nuclear installation is liable for such damage under either the Paris Convention of 29 July 1960 on Third Party Liability in the Field of Nuclear Energy as amended by its Additional Protocol of 28 January 1964, or the Vienna Convention of 21 May 1963 on Civil Liability for Nuclear Damage, or

(b) if the operator of a nuclear installation is liable for such damage by virtue of a national law governing the liability for such damage provided that such law is in all respects as favourable to persons who may suffer damage as either the Paris or the Vienna Conventions.

Article 21. Commercial carriage by public authorities

This Convention shall apply to commercial carriage undertaken by States or Public Authorities under contracts of carriage within the meaning of Article 1.

Article 22. Declaration of non-application

1. Any Party may at the time of signing, ratifying, accepting, approving or acceding to this Convention, declare in writing that it will not give effect to this Convention when the passenger and the carrier are subjects or nationals of that Party.

2. Any declaration made under paragraph 1 of this Article may be withdrawn at any time by a notification in writing to the Secretary-General of the Organization.

Article 23. Signature, ratification and accession

1. This Convention shall be open for signature ac the Headquarters of the Organization until 31 December 1975 and shall thereafter remain open for accession.

2. States may become Parties to this Convention by:

(a) signature without reservation as to ratification, acceptance or approval;

(b) signature subject to ratification, acceptance or approval followed by ratification, acceptance or approval; or

(c) accession.

3. Ratification, acceptance, approval or accession shall be effected by the deposit of a formal instrument to that effect with the Secretary-General of the Organization.

Article 24. Entry into force

1. This Convention shall enter into force on the ninetieth day following the date on which ten States have either signed it without reservation as to ratification, acceptance or approval or have deposited the requisite instruments of ratification, acceptance, approval or accession.

2. For any State which subsequently signs this Convention without reservation as to ratification, acceptance or approval, or deposits its instrument of ratification, acceptance, approval or accession, the Convention shall come into force on the ninetieth day after the date of such signature or deposit.

Article 25. Denunciation

1. This Convention may be denounced by a Party at any time after the date on which the Convention entered into force for that Parry.

2. Denunciation shall be effected by the deposit of an instrument with the Secretary-General of the Organization who shall inform all other Parties of the receipt of the instrument of denunciation and of the date of its deposit.

3. A denunciation shall take effect one year after the deposit of an instrument of denunciation, or after such longer period as may be specified in the instrument.

Article 26. Revision and amendment

1. A Conference for the purpose of revising or amending this Convention may be convened by the Organization.

2. The Organization shall convene a Conference of the Parties to this Convention for revising or amending it at the request of not less than one-third of the Parties.

3. Any State becoming a Party to this Convention after the entry into force of an amendment adopted by a conference convened in accordance with this Article shall be bound by the Convention as amended.

Article 27. Depositary

1. This Convention shall be deposited with the Secretary-General of the Organization. 2. The Secretary-General of the Organization shall:

(a) inform all States which have signed or acceded to this Convention of

(i) each new signature and each deposit of an instrument together with the date thereof

(ii) the date of entry into force of this Convention;

(iii) any denunciation of this Convention and the date on which it takes effect;

(b) transmit certified true copies of this Convention to all signatory States and to all States which have acceded to this Convention.

3. Upon entry into force of this Convention, a certified true copy thereof shall be transmitted by the Secretary-General of the Organization to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

Article 28. Languages

This Convention is established in a single original in the English and French languages, both texts being equally authentic. Official translations in the Russian and Spanish languages shall be prepared by the Secretary-General of the Organization and deposited with the signed original.

In witness whereof the undersigned being duly authorized for that purpose have signed this Convention.

Protocol of 1976 to the Athens Convention Relating to the Carriage of Passengers and their Luggage by Sea, 1974

The Parties to the present protocol

Being Parties to the Athens Convention Relating to the Carriage of passengers and their Luggage by Sea, done at Athens on 13 December 1974;

Have agreed as follows:

Article I

For the purpose of the present Protocol:

1. "Convention" means the Athens Convention Relating to the Carriage of Passengers and their Luggage by Sea, 1974.

2. "Organization" has the same meaning as in the Convention.

3. "Secretary-General" means the Secretary-General of the Organization.

Article II

(1) Article 7, paragraph 1 of the Convention is replaced by the following text:

1. The liability of the carrier for the death of or personal injury to a passenger shall in no case exceed 46,666 units of account per carriage. Where in accordance with the law of the court seized of the case damages are awarded in form of periodical income payments, the equivalent capital value of those payments shall not exceed the said limit.

(2) Article 8 of the Convention is replaced by the following text:

1. The liability of the carrier for the loss of or damage to cabin luggage shall in no case exceed 833 units of account per passenger, per carriage.

2. The liability of the carrier for the loss of or damage to vehicles including all luggage carried in or on the vehicle shall in no case exceed 3,333 units of account per vehicle, per carriage.

3. The liability of the carrier for the loss of or damage to luggage other than that mentioned in paragraphs 1 and 2 of this Article shall in no case exceed 1,200 units of account per passenger, per carriage.

4. The carrier and the passenger may agree that the liability of the carrier shall be subject to a deductible not exceeding 117 units of account in the case of damage to a vehicle and not exceeding 13 units of account per passenger in the case of loss of or damage to other luggage, such sum to be deducted from the loss or damage.

(3) Article 9 of the Convention and its title are replaced by the following:

Units of account or monetary unit and conversion

1. The Unit of Account mentioned in this Convention is the Special Drawing Right as defined by the International Monetary Fund. The amounts mentioned in Articles 7 and 8 shall be converted into the national currency of the State of the Court seized of the case on the basis of the value of that currency on the date of the judgment or the date agreed upon by the Parties. The value of the national currency, in terms of the Special Drawing Right, of a State which is a member of the International Monetary Fund, shall be calculated in accordance with the method of valuation applied by the International Monetary Fund in effect at the date iii question for its operations and transactions. The value of the national currency, in terms of the Special Drawing Right, of a State which is not a member of the International Monetary Fund, shall be calculated in a manner determined by the State.

2. Nevertheless, a State which is not a member of the International Monetary Fund and whose law does not permit the application of the provisions of paragraph 1 of this Article may, at the time of ratification or accession or at any time the thereafter, declare that the limits of liability provided for in this Convention to be applied in its territory shall be fixed as follows:

(a) in respect of Article 7, paragraph 1, 700,000 monetary units;

(b) in respect of Article 8, paragraph 1, 12,500 monetary units;

(c) in respect of Article 8, paragraph 2, 50,000 monetary units;

(d) in respect of Article 8, paragraph 3, 18,000 monetary units;

(e) in respect of Article 8, paragraph 4, the deductible shall not exceed 1,750 monetary units in the case of damage to a vehicle and shall not exceed 200 monetary units per passenger in the case of loss of or damage to other luggage.

The monetary unit referred to in this paragraph corresponds to sixty-five and a half milligrammes of gold of millesimal fineness nine hundred. The conversion of the amounts specified in this paragraph into the national currency shall be made according to the law of the State concerned.

3. The calculation mentioned in the last sentence of paragraph 1 and the conversion mentioned in paragraph 2 shall be made in such a manner as to express in the national currency of the State as far as possible the same real value for the amounts in Articles 7 and 8 as is expressed there in units of account. States shall communicate to the depositary the manner of calculation pursuant to paragraph 1 or the result of the conversion in paragraph 2 as the case may be, when depositing an instrument referred to in Article 1II and whenever there is a change in either.

Article III. Signature, ratification and accession

1. The present Protocol shall be open for signature by any State which has signed the Convention or acceded thereto and by any State invited to attend the Conference to Revise the Unit of Account Provisions in the Athens Convention Relating to the Carriage of Passengers and their Luggage by Sea, 1974, held in London from 17 to 19 November 1976. This Protocol shall be open for signature from 1 February 1977 to 31 December 1977 at the Headquarters of the Organization.

2. Subject to paragraph 4 of this Article, the present Protocol shall be subject to ratification, acceptance or approval by the States which have signed it.

3. Subject to paragraph 4 of this Article, this Protocol shall be open for accession by States which did not sign it.

4. The present Protocol may be ratified, accepted, approved or acceded to by States Parties to the Convention.

5. Ratification, acceptance, approval or accession shall be effected by the deposit of a formal instrument to that effect with the Secretary-General.

6. Any instrument of ratification, acceptance, approval or accession deposited after the entry into force of an amendment to the present Protocol with respect to all existing Parties or after the completion of all measures required for the entry into force of the amendment with respect to all existing Parties shall be deemed to apply to the Protocol as modified by the amendment.

Article IV. Entry into force

1. The present Protocol shall enter into force for the States which have ratified, accepted, approved or acceded to it on the ninetieth day following the date on which ten States have either signed it without reservation as to ratification, acceptance or approval or have deposited the requisite instruments of ratification, acceptance, approval or accession.

2. However, the present Protocol shall not enter into force before the Convention has entered into force.

3. For any State which subsequently signs this Protocol without reservation as to ratification, acceptance or approval, or deposits its instrument of ratification, acceptance, approval or accession, the present Protocol shall come into force on the ninetieth day after the date of such signature or deposit.

Article V. Denunciation

1. The, present Protocol may be denounced by a Party at any time after the date on which the Protocol enters into force for that Party.

2. Denunciation shall be effected by the deposit of an instrument with the Secretary-General who shall inform all other Parties of the receipt of the instrument of denunciation and of the date of its deposit.

3. A denunciation shall take effect one year after the deposit of an instrument of denunciation, or after such longer period as may be specified in the instrument.

Article VI. Revision and amendment

1. A Conference for the purpose of revising or amending the present Protocol may be convened by the Organization.

2. The Organization shall convene a Conference of the Parties to the present Protocol for revising or amending it at the request of not less than one-third of the Parties.

Article VII. Depositary

1. The present Protocol shall be deposited with the Secretary-General.

2. The Secretary-General shall:

(a) inform all States which have signed or acceded to the present Protocol of

(i) each new signature and each deposit of an instrument together with the date thereof

(ii) the date of entry into force of the present Protocol;

(iii) the deposit of any instrument of denunciation of the present Protocol together with the date on which the denunciation takes effect;

(iv) any amendments to the present Protocol;

(b) transmit certified true copies of the present Protocol to all States which have signed the present Protocol or acceded thereto.

3. Upon entry into force of the present Protocol, a certified true copy thereof shall be transmitted by the Secretary-General to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

Article VIII. Languages

The present Protocol is established in a single original in the English and French Languages, both texts being equally authentic. Official translations in the Russian and Spanish languages shall be prepared by the Secretary-General and deposited with the signed original.

Done at London this nineteenth day of November one thousand nine hundred and seventy-six.

1974. gada Atēnu konvencija par pasažieru un to bagāžas jūras pārvadājumu

Šīs Konvencijas Dalībvalstis,

Atzīstot vēlmi vienoties par atsevišķiem likumiem pasažieru un to bagāžas pārvadājumos pa jūru;

Ir nolēmušas šajā nolūkā parakstīt Konvenciju un turklāt vienojušās par sekojošo:

1. pants. Definīcijas

Šajā Konvencijā sekojošiem izteicieniem ir šāda nozīme:

1. (a) "pārvadātājs" ir persona, ar kuru vai kuras vārdā ir noslēgts pārvadājuma līgums, balstoties uz kura viņš vai faktiskais pārvadātājs, veic pārvadājumu;

(b) "faktiskais pārvadātājs" ir persona, kura nav pārvadātājs, bet ir īpašnieks, fraktētājs vai kuģa operators, kas praktiski veic visu pārvadājumu vai tā daļu;

2. "pārvadājuma līgums" ir līgums par pasažieru vai pasažieru un to bagāžas pārvadāšanu pa jūru, atkarībā no gadījuma, kas noslēgts ar pārvadātāju vai tā vārdā;

3. "kuģis" ir tikai jūras kuģis, izņemot gaisa spilvena transporta līdzekli;

4. "persona" ir jebkura persona, kura tiek pārvadāta kuģī:

(a) saskaņā ar pārvadājuma līgumu, vai

(b) kura, ar pārvadātāja piekrišanu, pavada transporta līdzekli vai dzīvus dzīvniekus, kuri uzrādīti preču pārvadājuma līgumā, kuru neregulē šī Konvencija;

5. "bagāža" ir jebkurš priekšmets vai transporta līdzeklis, ko pārvadātājs pārvadā saskaņā ar pārvadājuma līgumu, izņemot:

(a) priekšmetus un transporta līdzekļus, kas tiek pārvadāti saskaņā ar frakta līgumu, konosamentu vai ar citu līgumu, kas ir primāri saistīts ar preču pārvadājumu, un

(b) dzīvos dzīvniekus;

6. "kajītes bagāža" ir bagāža, kas atrodas pasažiera kajītē vai citādi atrodas viņa īpašumā, uzraudzībā vai kontrolē. Neraugoties uz šā panta 8. punkta un 8. pantā minēto, kajītes bagāža ietver bagāžu, kas pasažierim atrodas transporta līdzeklī vai tiek ar to pārvadāta;

7. "bagāžas nozaudēšana vai sabojāšana" ietver finansiālus zaudējumus, kuru iemesls ir bagāžas nesavlaicīga piegādāšana pasažierim pēc kuģa ierašanās, uz kura bagāža tika pārvadāta vai to vajadzēja pārvadāt, bet neietver aizkavēšanos, kuru iemesls ir darbinieku nesaskaņas;

8. "pārvadājums" aptver sekojošu periodu:

(a) attiecībā uz pasažieri un viņa kajītes bagāžu, laika posms, kura laikā pasažieris un /vai viņa kajītes bagāža atrodas uz kuģa vai pasažieru uzņemšanas laikā vai laikā, kad notiek izkāpšana krastā un laika posms, kurā pasažieris un viņa kabīnes bagāža tiek transportēta pa ūdeni no sauszemes uz kuģi vai otrādi, ja šāda transportēšanas izmaksa ir iekļauta braukšanas maksā vai, ja kuģi ko izmanto kā papildus transporta līdzekli pasažieru pārvadāšanai, ir norīkojis pārvadātājs. Tomēr, attiecībā uz pasažieri, pārvadājums neietver laika posmu, kurā viņš atrodas jūras pasažieru terminālā vai stacijā, vai krastmalā vai kādā citā instalācijas daļā;

(b) attiecībā uz kajītes bagāžu, arī laika posms, kurā pasažieris ir jūras pasažieru terminālā vai stacijā, vai krastmalā vai jebkurā citā ostas instalācijā, ja šo bagāžu ir pārņēmis pārvadātājs vai viņa darbinieks vai aģents un nav nogādāta pasažierim;

(c) attiecībā uz bagāžu, kas nav kajītes bagāža, laika posms, skaitot no laika, kad to pārņem pārvadātājs vai viņa darbinieks, vai aģents krastā vai uz kuģa, līdz laikam, kamēr pārvadātājs vai viņa darbinieks vai aģents tās piegādā;

9. "starptautiskais pārvadājums" nozīmē jebkuru pārvadājumu, kurā saskaņā ar pārvadājuma līgumu atiešanas osta un gala osta atrodas divās dažādās valstīs, vai vienā valstī, ja saskaņā ar pārvadājuma līgumu vai grafikā paredzēto maršrutu, kuģis iegriežas ostā citā valstī.

2. pants. Piemērošana

1. Šī Konvencija ir saistoša jebkuram starptautiskajam pārvadājumam, ja

(a) kuģis kuģo ar šās konvencijas Dalībvalsts karogu vai ir reģistrēts tajā, vai

(b) pārvadājuma līgums ir sastādīts šās Konvencijas Dalībvalstī, vai

(c) atiešanas osta un gala osta, saskaņā ar pārvadājuma līgumu, atrodas šās Konvencijas dalībvalstī.

2. Neņemot vērā šā panta 1. punktu, šī Konvencija nav saistoša, ja attiecībā uz pārvadājumu, saskaņā ar jebkuru citu starptautisko konvenciju par pasažieru vai bagāžas pārvadāšanu ar cita veida transporta līdzekli, ir piemērojama civilā atbildība saskaņā ar šās Konvencijas nosacījumiem, tiktāl, ciktāl šie nosacījumi ir saistoši jūras pārvadājumam.

3. pants. Pārvadātāja atbildība

1. Pārvadātājs ir atbildīgs par izraisītajiem zaudējumiem, kuru iemesls ir pasažiera bojāeja vai miesas bojājumu nodarīšana tam, vai bagāžas nozaudēšana vai sabojāšana, ja negadījums, kas izraisīja zaudējumus, notika pārvadājuma laikā un tā iemesls bija pārvadātāja vai viņa darbinieku, vai aģentu, kuri pilda savus darba pienākumus, kļūda vai nevērība.

2. Prasītājam ir jāpierāda, ka negadījums, kas izraisījis zaudējumus vai bojājumu, radās pārvadājuma laikā un šādu zaudējumu vai bojājuma apmēru.

3. Pārvadātāja vai viņa darbinieku, vai aģentu, kas pilda savus darba pienākumus, darbība tiek uzskatīta par kļūdu vai nevērību, ja vien nav pierādīts pretējais, ka pasažiera nāve vai miesas bojājumu nodarīšana tam, vai kajītes bagāžas nozaudēšana vai sabojāšana ir radusies no vai saistībā ar kuģa bojāeju, sadursmi, uzskriešanu uz sēkļa, eksploziju vai ugunsgrēku, vai kuģī esošu nepilnību. Cita veida bagāžas nozaudēšana vai sabojāšana, tiek uzskatīta par kļūdu vai nevērību, ja vien nav pierādīts pretējais, neatkarīgi no negadījuma, kas izraisīja zaudējumus vai bojājumu, būtības. Pārējos gadījumos kļūda vai nevērība ir jāpierāda prasītājam.

4. pants. Faktiskais pārvadātājs

1. Ja pārvadājuma vai tā daļas veikšana ir uzticēta faktiskajam pārvadātājam, saskaņā ar šīs Konvencijas nosacījumiem pārvadātājs tomēr ir atbildīgs par visu pārvadājumu. Pie tam, attiecībā uz faktisko pārvadātāju ir attiecināmi un viņš ir tiesīgs izmantot šās Konvencijas nosacījumus par pārvadājuma daļu, ko tas veicis.

2. Pārvadātājs, attiecībā uz pārvadājumu, ko veicis faktiskais pārvadātājs, paliek atbildīgs par faktiskā pārvadātāja un viņa darbinieku, un aģentu, kas pilda savus darba pienākumus, darbību un nolaidību.

3. Jebkurš īpašais līgums, saskaņā ar kuru pārvadātājs uzņemas pienākumus, ko neuzliek šī Konvencija vai jebkura atteikšanās no tiesībām, ko tai piešķir šī Konvencija, faktisko pārvadātāju skar tikai tādā gadījumā, ja ar viņu ir noslēgta īpaša vienošanās rakstiskā veidā.

4. Ja abas puses — gan pārvadātājs, gan faktiskais pārvadātājs ir atbildīgi, viņu atbildība tiek apvienota vai nošķirta.

5. Nekas šajā pantā nav pretrunā ar jebkurām regresa tiesībām starp pārvadātāju un faktisko pārvadātāju.

5. pants. Vērtslietas

Pārvadātājs nav atbildīgs par naudas, vērtspapīru, zelta, sudrablietu, dārglietu, greznumlietu, mākslas darbu un citu vērtslietu nozaudēšanu vai sabojāšanu, izņemot gadījumus, ja šādas vērtslietas ir nodotas pārvadātāja glabāšanā, pārvadātājs ir atbildīgs 8. panta 3. punktā noteiktajā atbildības apmērā, ja vien saskaņā ar 10. panta 1. punktu atbildības apmērs nav paaugstināts.

6. pants. Pasažiera veicināta kļūda

Ja pārvadātājs pierāda, ka pasažiera nāvi vai miesas bojājumu nodarīšanu tai, vai viņa bagāžas nozaudēšanu vai sabojāšanu ir izraisījusi vai veicinājusi pasažiera kļūda vai nolaidība, tiesa, kas izskata lietu, pilnīgi vai daļēji var atbrīvot pārvadātāju no viņa atbildības, saskaņā ar tiesā piemēroto likumdošanu.

7. pants. Atbildības ierobežojums par miesas bojājumu nodarīšanu personai

1. Pārvadātāja atbildība par pasažiera nāvi vai miesas bojājumu nodarīšanu tai nevienā no gadījumiem nepārsniedz 700 000 frankus par pārvadājumu. Ja saskaņā ar tiesā, kas izskata lietu, piemēroto likumdošanu, zaudējumu atlīdzība ir piespriesta periodisku maksājumu veidā, šo maksājumu līdzvērtīga pamatvērtība nepārsniedz iepriekš minēto atbildības apmēru.

2. Neņemot vērā šā panta 1. punktu, jebkuras šās Konvencijas Dalībvalsts nacionālā likumdošana, attiecībā uz pārvadātāju, kas ir šās valsts pilsonis, uz cilvēku var noteikt augstāku atbildības apmēru.

8. pants. Atbildības apmērs par bagāžas nozaudēšanu vai sabojāšanu

1. Pārvadātāja atbildības apjoms par kajītes bagāžas nozaudēšanu vai sabojāšanu nevienā no gadījumiem nepārsniedz 12 500 frankus uz pasažieri pārvadājuma laikā.

2. Pārvadātāja atbildības apjoms par transporta līdzekļa nozaudēšanu vai sabojāšanu, ieskaitot visu bagāžu, kas atrodas tajā vai tiek vesta ar to, nevienā no gadījumiem nepārsniedz 50 000 franku par transporta līdzekli pārvadājuma laikā.

3. Pārvadātāja atbildības apjoms par nozaudētu vai sabojātu bagāžu, kas nav minēta šā panta 1. un 2. punktā, nevienā no gadījumiem nepārsniedz 18 000 frankus uz pasažieri pārvadājuma laikā.

4. Pārvadātājs un pasažieris var vienoties par to, ka pārvadātāja atbildības apjomu var samazināt, nepārsniedzot 1750 frankus par transporta līdzekli tā sabojāšanas gadījumā un nepārsniedzot 200 frankus uz pasažieri bagāžas, kas nav kajītes bagāža, nozaudēšanas vai sabojāšanas gadījumā, šī summa tiek atskaitīta no zaudējuma vai bojājuma apmēra.

9. pants. Norēķinu vienība un konvertēšana

1. Franks, kas minēts Konvencijā tiek uzskatīts par atbilstošu vienībai, kuras vērtība ir 65,5 augstākās proves (900) zelta miligrami.

2. Summas, kas minētas 7. un 8. pantā tiek konvertētas valsts, kura izskata lietu, nacionālajā valūtā, pamatojoties uz šās valūtas oficiālo kursu, atsaucoties uz vienību, kas noteikta šā panta 1. punktā, sprieduma dienā vai datumā, par kuru puses vienojušās. Ja tāda oficiālā kursa nav, attiecīgās valsts kompetentā pārvaldes institūcija nosaka, kas šās Konvencijas izpratnē tiek uzskatīts par oficiālo kursu.

10. pants. Atbildības apmēru ierobežošanas papildus nosacījumi

1. Pārvadātājs un pasažieris nepārprotami un rakstveidā var vienoties par augstākiem atbildības ierobežojuma apmēriem, nekā aprakstīti 7. un 8. pantā.

2. Zaudējuma summas procenti un tiesas izmaksas nav ietvertas atbildības apmēru ierobežojumos, kas noteikti 7. un 8. pantā.

11. pants. Aizstāvība un ierobežojumi pārvadātāja darbiniekiem

Ja prasība, kura izriet no zaudējumiem saskaņā ar šo Konvenciju, celta pret pārvadātāja darbinieku vai aģentu, vai faktisko pārvadātāju, šādam darbiniekam vai aģentam, ja tas pierāda, ka ir pildījis savus darba pienākumus, ir tiesības uz tādu pašu aizstāvību un atbildības ierobežošanu, uz kādu ir tiesīgs pārvadātājs vai faktiskais pārvadātājs saskaņā ar šo Konvenciju.

12. pants. Prasību apvienošana

1. Ja 7. un 8. pantā noteiktie atbildības ierobežojumi ir spēkā, tie attiecināmi uz visām prasībām, kuru iemesls ir personas nāve vai miesas bojājumu nodarīšana tai, vai tās bagāžas nozaudēšana vai sabojāšana, atlīdzināmo summu kopumu.

2. Attiecībā uz pārvadājumu, ko veicis faktiskais pārvadātājs, tā darbinieku un aģentu, kas pilda savus darba pienākumus, atlīdzināmo summu kopums, nepārsniedz lielāko summu, kādu varētu piespriest pārvadātājam vai faktiskajam pārvadātājam saskaņā ar šo Konvenciju, bet neviena no minētājām personām nav atbildīga par summu, kas pārsniedz tiem piemērojamo ierobežojumu.

3. Katrā gadījumā, kur pārvadātāja darbinieks vai aģents, vai faktiskais pārvadātājs saskaņā ar Konvencijas 11. pantu ir tiesīgs savā labā izmantot atbildības ierobežojumus, kas noteikti 7. un 8. pantā, pārvadātāja vai faktiskā pārvadātāja, atkarībā no gadījuma, un darbinieku vai aģentu atmaksājamo summu kopums, nepārsniedz šos ierobežojumus.

13. pants. Gadījumi, kad nedrīkst ierobežot atbildību

1. Pārvadātājs nav tiesīgs izmantot 7. un 8. pantā un 10. panta 1. punktā noteiktos atbildības ierobežojumus, ja ir pierādīts, ka zaudējumus radījusi mērķtiecīga pārvadātāja darbība vai nolaidība, vai neapdomība, apzinoties šādu zaudējumu iespējamību.

2. Pārvadātāja vai faktiskā pārvadātāja darbinieks vai aģents nav tiesīgs izmantot šos ierobežojumus, ja ir pierādīts, ka zaudējumus radījusi mērķtiecīga darbinieku vai aģentu darbība vai nolaidība, vai neapdomība, apzinoties šādu zaudējumu iespējamību.

14. pants. Prasību pamats

Prasība pret pārvadātāju vai faktisko pārvadātāju personas nāves vai miesas bojājuma nodarīšanas gadījumā, vai bagāžas nozaudēšanas vai sabojāšanas gadījumā tiesā tiek celta saskaņā ar šo Konvenciju.

15. pants. Paziņojums par bagāžas nozaudēšanu vai sabojāšanu

1. Pasažierim jāiesniedz rakstisks paziņojums pārvadātājam vai tā aģentam:

(a) gadījumā, kad ir acīm redzams bojājums bagāžai:

(i) kabīnes bagāžai pirms vai laikā, kad notiek pasažieru izkāpšana krastā;

(ii) pārējai bagāžai pirms vai bagāžas nogādāšanas laikā;

(b) gadījumā, kad nav acīm redzama bojājuma vai bagāžas nozaudēšanas gadījumā, piecpadsmit dienu laikā, skaitot no krastā izkāpšanas datuma vai bagāžas nogādāšanas brīža, vai no laika, kad vajadzēja nogādāt.

2. Ja pasažieris nav rīkojies saskaņā ar šā panta nosacījumiem, tiek uzskatīts, ja vien nav pierādīts pretējais, ka pasažieris ir saņēmis veselu bagāžu.

3. Rakstveida ziņojums nav jāiesniedz, ja bagāžas nosacījumi paredz to saņemšanas laikā pārbaudīt kopējā apskatē vai inspekcijā.

16. pants. Prasības noilguma termiņš

1. Katras prasības par zaudējumiem, kas radušies pasažiera nāves vai miesas bojājuma nodarīšanas rezultātā vai bagāžas nozaudēšanas vai sabojāšanas gadījumā, noilguma termiņš ir divi gadi.

2. Noilguma termiņu sākumu aprēķina šādi:

(a) miesas bojājumu nodarīšanas gadījumā — no datuma, kad pasažieris izkāpis krastā;

(b) personas nāves gadījumā, kas iestājusies pārvadājuma laikā — no datuma, kad pasažierim vajadzēja izkāpt krastā un miesas bojājumu nodarīšanas gadījumā, kas noticis pārvadājuma laikā un, kas beidzies ar pasažiera nāvi pēc izkāpšanas krastā — no nāves iestāšanās brīža, paredzot, ka šis periods nepārsniedz trīs gadus no krastā izkāpšanas datuma;

(c) bagāžas nozaudēšanas vai tās sabojāšanas gadījumā — no krastā izkāpšanas datuma vai no datuma, kad izkāpšanai krastā vajadzēja notikt, ņemot vērā vēlāk notikušo.

3. Tiesas, kura izskata lietu, likumdošana regulē noilguma perioda atlikšanu vai pārtraukšanu, bet nekādā gadījumā prasību nevar celt, ja pagājuši trīs gadi kopš datuma, kad notikusi pasažiera izkāpšana krastā vai kad izkāpšanai krastā vajadzēja notikt, ņemot vērā vēlāk notikušo.

4. Neņemot vērā šā panta 1., 2. un 3. punktu, noilguma termiņu var pagarināt pamatojoties uz pārvadātāja ziņojuma vai pušu vienošanos, ja ir celta prasība. Ziņojums vai līgums iesniedzams rakstiskā veidā.

17. pants. Prasības piekritība

1. Prasību, kas celta saskaņā ar šo Konvenciju, pēc prasītāja izvēles var celt kādā no zemāk minētajām tiesām, paredzot, ka tiesa atrodas šās Konvencijas Dalībvalstī:

(a) atbildētāja pastāvīgās dzīvesvietas vai komercdarbības atrašanās vietas tiesā, vai

(b) kuģa atiešanas vai pienākšanas ostas valsts, saskaņā ar pārvadājuma līgumu tiesā, vai

(c) prasītāja juridiskās adreses vai pastāvīgās dzīvesvietas valsts tiesā, ja atbildētājam ir komercdarbības vieta un tā atrodas tās valsts jurisdikcijā, vai

(d) tās valsts tiesā, kurā tika noslēgts pārvadājuma līgums, ja prasītājam ir komercdarbības vieta un tā atrodas šās valsts jurisdikcijas pakļautībā.

2. Pēc negadījuma, kas izraisījis zaudējumus, puses var vienoties par prasības iesniegšanu jebkurā citā tiesā vai šķīrējtiesā.

18. pants. Līguma nosacījumu spēkā neesamība

Jebkura vienošanās, kas noslēgta, pirms noticis negadījums, kas izraisīja pasažiera nāvi vai nodarīja tam miesas bojājumus, vai nozaudēja vai sabojāja bagāžu, kas atbrīvo pārvadātāju no viņa atbildības pret pasažieri vai nosaka zemāku atbildības ierobežojumu, nekā tas noteikts šajā Konvencijā, izņemot 8. panta 4. punktā noteiktos gadījumus, un jebkuri tādi nosacījumi, kas atceļ pārvadātāja pierādīšanas pienākumu vai kuru mērķis ir ierobežot izvēli, kas noteikta 17. panta 1. punktā, ir spēkā neesoši, bet šo nosacījumu anulēšana neatceļ pārvadājuma līgumu, kuram ir piemērojami šās Konvencijas nosacījumi.

19. pants. Citas konvencijas par atbildības apjoma ierobežošanu

Šī Konvencija neietekmē pārvadātāja, faktiskā pārvadātāja vai tā darbinieku, vai aģentu tiesības vai pienākumus, ko paredz starptautiskās konvencijas par jūras kuģu īpašnieku atbildības ierobežošanu.

20. pants. Atompostījumi

Šī Konvencija neparedz atbildību par zaudējumiem, kuru iemesls ir atomnegadījums:

(a) ja atomiekārtas operators ir atbildīgs par šādiem zaudējumiem saskaņā ar 1960. gada 29. jūlija Parīzes Konvenciju par trešās Puses atbildību atomenerģijas jomā, kas grozīta ar tās 1964. gada 28. janvāra Protokolu vai 1963. gada 21. maija Vīnes Konvenciju par civilo atbildību par atompostījumiem, vai

(b) ja atomiekārtas operators par šādiem zaudējumiem ir atbildīgs saskaņā ar nacionālo likumdošanu, kas regulē atbildību par šādiem zaudējumiem, paredzot, ka šī likumdošana ir vienādi labvēlīga personām, kuras var ciest no atompostījumiem un Parīzes vai Vīnes konvencijas Pusēm.

21. pants. Komerciāla rakstura pārvadājumi, ko veic valsts pārvaldes institūcijas

Šī Konvencija piemērojama komerciāla rakstura pārvadājumiem, ko veic valstis vai valsts pārvaldes institūcijas saskaņā ar pārvadājuma līgumiem 1. panta izpratnē.

22. pants. Paziņojums par nepiemērošanu

1. Katra Dalībvalsts šās Konvencijas parakstīšanas, ratificēšanas, akceptēšanas, apstiprināšanas vai pievienošanās laikā, rakstiskā veidā var paziņot, ka šo Konvenciju nepiemēros, ja pasažieris un pārvadātājs ir šīs Dalībvalsts pavalstnieks vai pilsonis.

2. Katru ziņojumu, kas veikts saskaņā šā panta 1. punktu, var atsaukt jebkurā laikā, nosūtot rakstisku ziņojumu Organizācijas Ģenerālsekretāram.

23. pants. Parakstīšana, ratificēšana un pievienošanās

1. Šī Konvencija ir atvērta parakstīšanai Organizācijas vadības mītnē līdz 1975. gada 31. decembrim un pēc tam ir atvērta pievienošanās nolūkam.

2. Valstis var kļūt par šās Konvencijas Dalībvalstīm:

(a) parakstot, bez atrunas par ratificēšanu, akceptēšanu vai apstiprināšanu; vai

(b) parakstot ar atrunu par ratificēšanu, akceptēšanu vai apstiprināšanu ar sekojošu ratificēšanu, akceptēšanu vai apstiprināšanu; vai

(c) pievienojoties.

3. Ratificēšana, akceptēšana, apstiprināšana vai pievienošanās tiek veikta deponējot attiecīgu dokumentu Organizācijas Ģenerālsekretāram.

24. pants. Stāšanās spēkā

1. Šī Konvencija stājas spēkā deviņdesmitajā dienā, skaitot no datuma, kurā desmit valstis ir parakstījušas to bez atrunas par ratificēšanu, akceptēšanu vai apstiprināšanu vai ir iesniegušas nepieciešamos ratificēšanas, akceptēšanas, apstiprināšanas vai pievienošanās dokumentus.

2. Attiecībā uz ikvienu valsti, kura pēc tam parakstījusi Konvenciju bez atrunas par ratificēšanu, akceptēšanu vai apstiprināšanu vai deponējusi ratificēšanas, akceptēšanas, apstiprināšanas vai pievienošanās dokumentus, Konvencija stājas spēkā deviņdesmitajā dienā, kad notikusi šāda parakstīšana vai dokumenta deponēšana.

25. pants. Denonsēšana

1. Dalībvalsts šo Konvenciju var denonsēt jebkurā laikā pēc datuma, kurā Konvencija ir stājusies spēkā attiecībā uz šo Dalībvalsti.

2. Denonsēšana ir veicama deponējot dokumentu Organizācijas Ģenerālsekretāram, kurš informē pārējās Dalībvalstis par denonsēšanas dokumenta saņemšanu un tā deponēšanas datumu.

3. Denonsēšana stājas spēkā pēc viena gada vai tāda ilgāka laika posma, kāds noteikts dokumentā, pēc denonsēšanas dokumenta deponēšanas.

26. pants. Pārskatīšana un grozīšana

1. Organizācija var sasaukt konferenci ar mērķi pārskatīt vai grozīt šo Konvenciju.

2. Organizācija sasauc šās konvencijas Dalībvalstu konferenci ar mērķi pārskatīt vai grozīt to, ja lūgumu izteikusi ne mazāk kā viena trešdaļa Dalībvalstu.

3. Ikvienai valstij, kļūstot par šās Konvencijas Dalībvalsti, pēc grozījumu, kurus pieņēmusi konference, kas sasaukta saskaņā ar šo pantu, stāšanās spēkā, grozītā Konvencija ir saistoša.

27. pants. Deponēšana

1. Šī Konvencija tiek deponēta Organizācijas Ģenerālsekretāram.

2. Organizācijas Ģenerālsekretārs:

(a) informē visas valstis, kuras ir parakstījušas vai pievienojušās šai Konvencijai par:

(i) katru jaunu parakstīšanu un dokumenta deponēšanu un to veikšanas datumiem;

(ii) datumu, kurā šī Konvencija stājas spēkā;

(iii) ikvienu šās Konvencijas denonsēšanas gadījumu un datumu, kurā tas stājas spēkā;

(b) nosūta šās Konvencijas likumīgi apstiprinātas kopijas visām valstīm, kuras to parakstījušas un visām valstīm, kuras ir pievienojušās šai Konvencijai.

3. Pēc tam, kad šī Konvencija stājusies spēkā, tās likumīgi apstiprinātas kopijas Organizācijas Ģenerālsekretārs nosūta Apvienoto Nāciju organizācijas Ģenerālsekretāram reģistrēšanai un publicēšanai saskaņā ar Apvienoto Nāciju organizācijas Statūtu 102. pantu.

28. pants. Valodas

Šī Konvencija sastādīta vienā eksemplārā angļu un franču valodā, abi teksti ir vienlīdz autentiski. Organizācijas Ģenerālsekretārs sagatavo oficiālos tulkojumus krievu un spāņu valodā un deponē kopā ar parakstītajiem oriģināliem.

To apliecinot, apakšā parakstījušies savu valdību pienācīgi pilnvaroti pārstāvji parakstījuši šo Konvenciju.

Parakstīta Atēnās tūkstoš deviņi simti septiņdesmit ceturtā gada trīspadsmitajā decembrī.

1974.gada Atēnu konvencijas par pasažieru un to bagāžas jūras pārvadājumu 1976.gada protokols

Šā Protokola Dalībvalstis

Esot 1974.gada Atēnu konvencijas par pasažieru un to bagāžas jūras pārvadājumu Dalībvalstīm, kas parakstīta 1974.gada 13.decembrī,

Ir vienojušās:

I pants

Šā Protokola izpratnē:

1. "Konvencija" ir 1974.gada Atēnu konvencija par pasažieru un to bagāžas jūras pārvadājumu.

2. "Organizācijai" ir tāda pati nozīme kā Konvencijā.

3. "Ģenerālsekretārs" ir Organizācijas Ģenerālsekretārs.

II pants

(1) Konvencijas 7.panta 1.punkts tiek aizstāts ar šādu tekstu:

1. Pārvadātāja atbildības apmērs par pasažiera nāvi vai par miesas bojājumu nodarīšanu tai nevienā no gadījumiem nepārsniedz 46,666 norēķinu vienības par pārvadājumu. Ja saskaņā ar tiesas, kurā lieta tiek izskatīta, likumdošanu zaudējumi tiek piespriesti periodisku maksājumu veidā, šo maksājumu līdzvērtīga pamatvērtība nepārsniedz minēto ierobežojumu.

(2) Konvencijas 8.pants tiek aizstāts ar šādu tekstu:

1. Pārvadātāja atbildības apmērs par kajītes bagāžas nozaudēšanu vai sabojāšanu nekādā gadījumā nepārsniedz 833 norēķinu vienības par pasažieri pārvadājuma laikā.

2. Pārvadātāja atbildības apmērs par transporta līdzekļu nozaudēšanu vai bojājuma nodarīšanu tam, ieskaitot bagāžu, kura tiek pārvadāta tajā vai ar to, nevienā no gadījumiem nepārsniedz 3,333 norēķinu vienības par transporta līdzekli pārvadājuma laikā.

3. Pārvadātāja atbildības apmērs par bagāžas, izņemot šā panta 1. un 2.punktā minētos gadījumus, nozaudēšanu vai sabojāšanu nevienā no gadījumiem nepārsniedz 1,200 norēķinu vienības par pasažieri pārvadājumā laikā.

4. Pārvadātājs un pasažieris var vienoties, ka pārvadātāja atbildības apmērs tiek samazināts, nepārsniedzot 117 norēķinu vienību robežu, ja izdarīts bojājums transporta līdzeklim un nepārsniedzot 13 norēķinu vienību robežu par pasažieri, citas bagāžas nozaudēšanas vai sabojāšanas gadījumā, šāda summa tiek atskaitīta no zaudējuma vai bojājuma apmēra.

(3) Konvencijas 9.pants un tā nosaukums tiek aizvietots ar sekojošo:

Norēķinu vienība vai valūtas vienība un konvertēšana

1. Norēķinu vienība, kas minēta šajā Konvencijā ir Speciālās aizņemšanās tiesības, ko noteicis Starptautiskais Valūtas fonds. 7. un 8.pantā minētās summas tiek konvertētas valsts, kura izskata lietu, nacionālajā valūtā, pamatojoties uz šīs valsts valūtas vērtību sprieduma dienā vai datumā, par kuru Dalībvalstis ir vienojušās. Valstij, kura ir Starptautiskā Valūtas fonda Dalībvalsts, nacionālās valūtas vērtība, Speciālo Aizņemšanās tiesību izteiksmē, tiek aprēķināta saskaņā ar taksācijas metodi, ko Starptautiskais Valūtas fonds savās operācijās un transakcijās piemēro minētājā datumā. Nacionālās valūtas vērtību Speciālo Aizņemšanās tiesību izteiksmē, valstij, kura nav Starptautiskā Valūtas fonda Dalībvalsts aprēķina piemērojot metodi, ko noteikusi valsts.

2. Tomēr valsts, kura nav Starptautiskā Valūtas fonda Dalībvalsts un kuras likumdošana nepieļauj šā panta 1.punkta nosacījumu piemērošanu, ratificēšanas vai pievienošanās laikā vai jebkurā vēlākā laikā var paziņot, ka atbildības ierobežojuma apmēri, ko paredz šī Konvencija, tiek piemēroti tās teritorijā un tos nosaka šādi:

(a) attiecībā uz 7.panta 1.punktu, 700,000 norēķina vienības;

(b) attiecībā uz 8.panta 1.punktu, 12,500 norēķina vienības;

(c) attiecībā uz 8.panta 2.punktu, 50,000 norēķina vienības;

(d) attiecībā uz 8.panta 3.punktu, 18,000 norēķina vienības;

(e) attiecībā uz 8.panta 4.punktu, samazināšana nepārsniedz 1,750 norēķina vienību robežu, gadījumā, ja nodarīts zaudējums transporta līdzeklim un nepārsniedz 200 norēķina vienību robežu par pasažieri, ja nozaudēta vai sabojāta bagāža, kura nav uzskatāma par kabīnes bagāžu.

Norēķinu vienība, kas minēta šajā pantā atbilst sešdesmit pieciem un pus miligramiem augstākās proves (deviņsimtās) zeltam. Šajā punktā noteikto summu konvertēšana nacionālajā valūtā tiek veikta saskaņā ar attiecīgās valsts likumdošanu.

3. Aprēķins, kas minēts 1.punkta pēdējā teikumā un konvertēšana, kas minēta 2. punktā, tiek īstenota tādā veidā, lai valsts nacionālajā valūtā iespējami tuvāk izteiktu tādu pašu reālo vērtību kāda ir 7. un 8.pantā minētājām summām, kas šeit ir izteiktas norēķinu vienībās. Deponējot III pantā minēto dokumentu, saskaņā ar 1.punktu, valstis nosūta glabāšanai aprēķināšanas metodi vai konvertēšanas rezultātu, kas minēts 2.pantā, atkarībā no situācijas, ja kādā no minētajiem ir izmaiņas.

III pants. Parakstīšana, ratificēšana un pievienošanās

1. Šo Protokolu var parakstīt jebkura valsts, kas ir parakstījusi Konvenciju, vai pievienojusies tai, un jebkura valsts, kura ir uzaicināta piedalīties Konferencē, kas notika Londonā, 1976.gadā no 17.-19.novembrim, lai pārskatītu 1974.gada Atēnu konvencijas par pasažieru un to bagāžas jūras pārvadājumu Norēķinu vienības nosacījumus. Šis Protokols ir atvērts parakstīšanai no 1977.gada 1.februāra līdz 1977.gada 31.decembrim Organizācijas vadības mītnē.

2. Saskaņā ar šā panta 4.punktu valstīm, kuras ir parakstījušas šo Protokolu, tas ir jāratificē, jāakceptē vai jāapstiprina.

3. Saskaņā ar šā panta 4.punktu valstīm, kuras nav parakstījušas šo Protokolu, tas ir atvērts pievienošanās nolūkam.

4. Šās Konvencijas Dalībvalstis var ratificēt akceptēt, apstiprināt vai pievienoties šim Protokolam.

5. Ratificēšana, akceptēšana, apstiprināšana vai pievienošanās tiek veikta deponējot Organizācijas Ģenerālsekretāram attiecīgu dokumentu.

6. Katrs ratificēšanas, akceptēšanas, apstiprināšanas vai pievienošanās dokuments, kas deponēts pēc tam, kad stājušies spēkā šā Protokola grozījumi attiecībā uz visām esošajām Dalībvalstīm vai pēc tam, kad veikti visi nepieciešamie pasākumi, lai grozījumi stātos spēkā attiecībā uz visām esošajām Dalībvalstīm, tiek uzskatīts par iemērojamu grozītajam Protokolam.

IV pants. Stāšanās spēkā

1. Attiecībā uz valstīm, kuras ir ratificējušas, akceptējušas, apstiprinājušas vai pievienojušās šim Protokolam, Protokols stājas spēkā deviņdesmitajā dienā, skaitot no dienas, kad desmit valstis ir parakstījušas to bez atrunas par ratificēšanu, akceptēšanu vai apstiprināšanu, vai ir deponējušas nepieciešamos ratificēšanas, akceptēšanas, apstiprināšanas vai pievienošanās dokumentus.

2. Tomēr šis Protokols nestājas spēkā, kamēr nav stājusies spēkā Konvencija.

3. Ikvienai valstij, kura pēc tam paraksta šo Protokolu bez atrunas par ratificēšanu, akceptēšanu vai apstiprināšanu vai deponē savu ratificēšanas, akceptēšanas, apstiprināšanas vai pievienošanās dokumentu, Protokols stājas spēkā deviņdesmitajā dienā, kas seko datumam, kad notikusi parakstīšana vai dokumenta deponēšana.

V pants. Denonsēšana

1. Dalībvalsts šo Protokolu var denonsēt jebkurā laikā pēc datuma, kurā Protokols stājas spēkā attiecībā uz šo Dalībvalsti.

2. Denonsēšana ir veicama deponējot dokumentu Organizācijas Ģenerālsekretāram, kurš informē visas pārējās Dalībvalstis par denonsēšanas dokumenta saņemšanu un tā deponēšanas datumu.

3. Denonsēšana stājas spēkā pēc viena gada vai tāda ilgāka laika posma, kāds noteikts dokumentā, skaitot no denonsēšanas dokumenta deponēšanas brīža.

VI pants. Pārskatīšana un grozīšana

1. Organizācija var sasaukt konferenci ar mērķi pārskatīt vai grozīt šo Protokolu.

2. Organizācija sasauc šā Protokola Dalībvalstu konferenci ar nolūku pārskatīt vai grozīt to, ja lūgumu izteikusi ne mazāk kā viena trešdaļa Dalībvalstu.

VII pants. Deponēšana

1. Protokols tiek deponēts Organizācijas Ģenerālsekretāram.

2. Organizācijas Ģenerālsekretārs:

(a) informē visas valstis, kuras ir parakstījušas vai pievienojušās šim Protokolam, par:

(i) katru jaunu parakstīšanu un dokumenta deponēšanu, un to veikšanas datumiem;

(ii) datumu, kurā šis Protokols stājas spēkā;

(iii) ikvienu šā Protokola denonsēšanas gadījumu un datumu, kurā denonsēšana stājas spēkā;

(iv) katru šā Protokola grozījumu;

(b) nosūta visām valstīm šā Protokola likumīgi apstiprinātās kopijas, kuras ir parakstījušas šo Protokolu vai pievienojušās tam.

3. Pēc tam, kad šis Protokols ir stājies spēkā, tā likumīgi apstiprinātas kopijas Organizācijas Ģenerālsekretārs nosūta Apvienoto Nāciju organizācijas sekretariātam reģistrēšanai un publicēšanai saskaņā ar Apvienoto Nāciju organizācijas Statūtu 102.pantu.

VIII pants. Valodas

Šis Protokols sastādīts vienā eksemplārā angļu un franču valodā, abi teksti ir vienlīdz autentiski. Organizācijas Ģenerālsekretārs sagatavo oficiālos tulkojumus krievu un spāņu valodā un deponē kopā ar parakstītajiem oriģināliem.

Parakstīta Londonā tūkstoš deviņi simti septiņdesmit sestā gada deviņpadsmitajā novembrī.
