Saeima ir pieņēmusi un Valsts
prezidents izsludina šādu likumu:
Par 1950.gada 4.novembra Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas 6.protokolu

1.pants. 1950.gada 4.novembra Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas 6.protokols (turpmāk — Protokols) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Protokols angļu valodā un tā tulkojums latviešu valodā.

3.pants. Protokols stājas spēkā tā 8.pantā noteiktajā laikā un kārtībā, un par to Ārlietu ministrija paziņo laikrakstā "Latvijas Vēstnesis".

Protocol No.6 to the Convention for the Protection of Human Rights and Fundamental Freedoms Concerning the Abolition of the Death Penalty

The member States of the Council of Europe, signatory to this Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4 November 1950 (hereinafter referred to as "the Convention"),

Considering that the evolution that has occurred in several member States of the Council of Europe expresses a general tendency in favour of abolition of the death penalty,

Have agreed as follows:

Article 1

The death penalty shall be abolished. No one shall be condemned to such penalty or executed.

Article 2

A State may make provision in its law for the death penalty in respect of acts committed in time of war or of imminent threat of war; such penalty shall be applied only in the instances laid down in the law and in accordance with its provisions. The State shall communicate to the Secretary General of the Council of Europe the relevant provisions of that law.

Article 3

No derogation from the provisions of this Protocol shall be made under Article 15 of the Convention.

Article 4

No reservation may be made under Article 64 of the Convention in respect of the provisions of this Protocol.

Article 5

1. Any State may, at the time of signature or when depositing its instrument of ratification, acceptance or approval, specify the territory or territories to which this Protocol shall apply.

2. Any State may at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Protocol to any other territory specified in the declaration. In respect of such territory the Protocol shall enter into force on the first day of the month following the date of receipt of such declaration by the Secretary General.

3. Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General. The withdrawal shall become effective on the first day of the month following the date of receipt of such notification by the Secretary General.

Article 6

As between the States Parties the provisions of Articles 1 to 5 of this Protocol shall be regarded as additional articles to the Convention and all the provisions of the Convention shall apply accordingly.

Article 7

This Protocol shall be open for signature by the member States of the Council of Europe, signatories to the Convention. It shall be subject to ratification, acceptance or approval. A member State of the Council of Europe may not ratify, accept or approve this Protocol unless it has, simultaneously or previously, ratified the Convention.

Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 8

1. This Protocol shall enter into force on the first day of the month following the date on which five member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 7.

2. In respect of any member State which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the date of the deposit of the instrument of ratification, acceptance or approval.

Article 9

The Secretary General of the Council of Europe shall notify the member States of the Council of:

a) any signature;

b) the deposit of any instrument of ratification, acceptance or approval;

c) any date of entry into force of this Protocol in accordance with Articles 5 and 8;

d) any other act, notification or communication relating to this Protocol.

In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.

Done at Strasbourg, this 28th day of April 1983, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe.

Cilvēka tiesību un pamatbrīvību aizsardzības konvencijas protokols Nr.6, par nāvessoda atcelšanu

Eiropas Padomes dalībvalstis, kas parakstījušas šo protokolu Cilvēka tiesību aizsardzības un pamatbrīvību konvencijai, kas parakstīta Romā 1950.gada 4.novembrī (turpmāk tekstā "Konvencija"),

Ņemot vērā to, ka attīstība, kas notikusi vairākās Eiropas Padomes dalībvalstīs liecina par vispārēju tendenci par labu nāvessoda atcelšanai,

Vienojās par sekojošo:

1.pants

Nāvessods tiks atcelts. Nevienam cilvēkam šādu sodu nedrīkst piespriest vai izpildīt.

2.pants

Valsts ir tiesīga paredzēt likumdošanā nosacījumu par nāvessodu par noziegumiem, kas pastrādāti kara laikā vai kara draudu apstākļos; šāds sods tiek piemērots vienīgi likumā paredzētajos gadījumos un saskaņā ar tā nosacījumiem. Valsts informēs Eiropas Padomes Ģenerālsekretāru par attiecīgajiem šī likuma nosacījumiem.

3.pants

Nekādas atkāpes no šī Protokola nosacījumiem saskaņā ar Konvencijas 15.pantu nav pieļaujamas.

4.pants

Nekādas atrunas saskaņā ar Konvencijas 64.pantu attiecībā uz šī Protokola nosacījumiem nav pieļaujamas.

5.pants

1. Jebkura valsts Protokola parakstīšanas laikā, ratifikācijas, pieņemšanas vai apstiprināšanas instrumenta iesniegšanas laikā, ir tiesīga norādīt teritoriju vai teritorijas, attiecībā uz kurām šis Protokols būs spēkā.

2. Jebkura valsts jebkurā vēlākā laikā ir tiesīga ar deklarāciju, kas adresēta Eiropas Padomes Ģenerālsekretāram, paplašināt šī Protokola piemērošanu jebkurai citai teritorijai, kas norādīta deklarācijā. Attiecībā uz šādām teritorijām Protokols stāsies spēkā mēneša, kas seko dienai, kurā Ģenerālsekretārs saņēmis šo deklarāciju, pirmajā dienā.

3. Jebkura deklarācija, kas izdarīta saskaņā ar diviem iepriekšējiem punktiem, attiecībā uz jebkuru teritoriju, kas norādīta šajā deklarācijā, var tikt atcelta ar paziņojumu, kas adresēts Ģenerālsekretāram. Atcelšana stāsies spēkā mēneša, kas seko dienai, kurā Ģenerālsekretārs saņēmis šo paziņojumu, pirmajā dienā.

6.pants

Starp dalībniecēm valstīm šī Protokola 1. līdz 5.panta nosacījumi tiks uzskatīti kā papildus panti Konvencijai, un visi Konvencijas nosacījumi tiks attiecīgi piemēroti.

7.pants

Šis Protokols tiek atvērts parakstīšanai Eiropas Padomes dalībvalstīm, kas parakstījušas Konvenciju. Protokols tiek ratificēts, pieņemts vai apstiprināts. Eiropas Padomes dalībvalsts nav tiesīga ratificēt, pieņemt vai apstiprināt šo Protokolu, ja tā vienlaicīgi vai iepriekš nav ratificējusi Konvenciju.

Ratifikācijas, pieņemšanas vai apstiprināšanas instruments tiek iesniegts Eiropas Padomes Ģenerālsekretāram.

8.pants

1. Šis Protokols stājas spēkā mēneša, kas seko dienai, kurā piecas Eiropas Padomes dalībvalstis ir izteikušas savu vēlēšanos atzīt Protokolu sev par saistošu saskaņā ar 7.panta nosacījumiem, pirmajā dienā.

2. Attiecībā uz valstīm, kas izteikušas savu vēlēšanos atzīt to par sev saistošu pēc tam, Protokols stājas spēkā mēneša, kas seko dienai, kad iesniegts ratifikācijas, pieņemšanas vai apstiprināšanas instruments, pirmajā dienā.

9.pants

Eiropas Padomes Ģenerālsekretārs informēs Eiropas Padomes dalībvalstis par:

a) jebkuru parakstīšanu;

b) jebkura ratifikācijas, pieņemšanas vai apstiprināšanas instrumenta iesniegšanu;

c) jebkuru gadījumu, kad Protokols stājas spēkā saskaņā ar 5. un 8.pantu;

d) jebkuru citu aktu, paziņojumu vai iesniegumu attiecībā uz šo Protokolu.

To apliecinot, apakšā parakstījušies, attiecīgi pilnvaroti, parakstīja šo Protokolu.

Parakstīts Strasbūrā, 1983.gada 28.aprīlī, angļu un franču valodā, kur abi teksti ir vienādi autentiski, vienā eksemplārā, kas tiek nodots glabāšanā Eiropas Padomes arhīvā. Eiropas Padomes Ģenerālsekretārs izsūtīs apstiprinātas kopijas ikvienai Eiropas Padomes dalībvalstij.
