Regulations regarding Stipends

Issued pursuant to
Section 52, Paragraph three of
the Law on Institutions of Higher Education and
Section 14, Clause 23 of
the Education Law

I. General Provisions

1. These Regulations prescribe the minimum amount of stipends and the procedures for the receipt of stipends for:

1.1. students of higher education programmes who have been admitted on the basis of competition procedures and who fill the State-financed places;

1.2. students of vocational basic education and vocational secondary education programmes who have been admitted in conformity with the number of State-financed places, except persons in places of imprisonment; and

1.3. students of vocational basic education and vocational secondary education programmes who have been admitted in conformity with the number of local government-financed places, except persons in places of imprisonment.

2. The student referred to in Sub-paragraph 1.1 of these Regulations and the student referred to in Sub-paragraph 1.2 of these Regulations shall receive a stipend from the stipend fund of the educational institution, which is composed of the State budget funds - a subsidy from general revenues. The student referred to in Sub-paragraph 1.3 of these Regulations shall receive a stipend from the stipend fund that is composed from the local government budget funds.

II. Procedures by which Students of higher Educational Programmes Receive Stipends

3. A stipend may be received on the basis of competition procedures by the student referred to in Sub-paragraph 1.1 of these Regulations who:

3.1. successfully passes the required examinations within a specified time period;

3.2. acquires the complete number of credit points required for the semester of the relevant academic year; and

3.3. 2) is not considered to be an employee or a self-employed person in accordance with the Law On State Social Insurance;

3.1 The conditions referred to in Sub-paragraph 3.3 of these Regulations do not apply to the student referred to in Sub-paragraph 1.1 of these Regulations who, while studying in a higher education programme, simultaneously carries out pedagogical and scientific work in an institution of higher education or State non-profit scientific or training undertaking established by the institution of higher education (institute, centre, clinic, experimental station, observatory and other undertaking), as well as in a scientific, educational or medical treatment institution, if such institution participates in the implementation of higher education programmes.

4. The following may be granted from the stipend fund of an educational institution:

4.1. a stipend for the acquisition of a study programme:

4.1.1. to a student of a bachelor study programme, higher professional education programme, masters study programme and to a resident in medicine - 10 months a year (the stipend shall not be granted for July and August); and

4.1.2. to a student of a doctoral study programme - 11 months a year (the stipend shall not be granted for August);

4.2. a one-time stipend once a semester. The amount of the one-time stipend shall not exceed the amount of the minimum stipend; and

4.3. an increased stipend. The amount of the increased stipend shall not exceed the double amount of the minimum stipend.

5. An institution of higher education shall approve the by-law for the granting of stipend and establish a commission for the granting of stipends. Representatives of the administration of the institution of higher education, academic staff and student local government shall be included in the composition of the commission.

6. The stipend fund of an institution of higher education shall be established, providing for:

6.1. 102 lats a year - for each place of a full-time bachelor study programme, each place of a higher vocational education programme, each place of a masters study programme and each study place of a resident in medicine;

6.2. 696 lats a year - for each place of a full-time doctoral study programme;

6.3. 720 lats a year - for each place of a full time doctoral study programme in the thematic area of education approved by the Minister for Education and Science; and

6.4. four lats a year for the payment of stipends during maternity leave - for each student of a full time higher education programme.

7. Not more than five per cent of the amount of the stipend fund of an institution of higher education shall be provided for one-time stipends.

8. The minimum monthly stipends for students shall be determined in the following amounts:

8.1. for a student of a bachelor study programme, higher professional education programme, masters study programme and for a resident in medicine - 70 lats a month; and

8.2. for a student of a doctoral study programme:

8.2.1. for the acquisition of the study programme - 80 lats a month; and

8.2.2. for the earning of the academic degree - 60 lats a month.

9. In order to receive the stipend referred to in Paragraph 4 of these Regulations, a student shall submit the following documents to the stipend commission of an institution of higher education:

9.1. a submission for the receipt of a stipend (Annex); and

9.2. a statement from a workplace, if the student is an employee employed by an employer.

9.1 If a stipend holder has become an employee or self-employed, he or she has a duty to notify the stipend commission regarding non-conformity with the condition referred to in Sub-paragraph 3.3 of these Regulations.

10. After each semester of an academic year and matriculation, a stipend commission shall:

10.1. examine submissions for the receipt of stipends, evaluate the conformity of the applicant with the criteria referred to in Paragraph 3 of these Regulations, as well as school results or the results of entrance examinations and scientific work performance (publications, participation in conferences, participation in projects and other indicators); and

10.2. take a decision regarding the granting of stipends, not exceeding the resources of the stipend fund of the institution of higher education . Information regarding the approved submissions for stipends shall be public.

11. If two or more students who apply for the stipend referred to in Paragraph 4 of these Regulations have equivalent school and scientific work performance indicators, the stipend commission shall grant a stipend to the following persons first:

11.1. a disabled person, orphan or a person without parental care, as well as to a student whose family, with which he or she has an undivided household (hereinafter - family), has been granted the status of a family in need on the basis of a statement regarding eligibility for the status of a family (person) in need issued in accordance with the procedures specified by regulatory enactments;

11.2. a student from a family in which three or more children are being raised; and

11.3. a student whose family has children.

12. In order to receive a stipend for the earning of a scientific degree (hereinafter - stipend equivalent to a credit), an applicant shall enter into a contract with an institution of higher education. The contract shall indicate:

12.1. the obligations of the institution of higher education in respect to the provision of studies, research and creative work;

12.2. the obligations of the applicant in respect to the development of doctoral works and the earning of the scientific degree, with a stipulation that the obligations are to be fulfilled within a period of five years after matriculation;

12.3. the conditions for an extension of the time period;

12.4. the procedures for the resolution of disputes and disagreements; and

12.5. the procedures for the exchange of information.

13. If a student of the doctoral study programme referred to in Sub-paragraph 6.3 of these Regulations fails to acquire a scientific degree within a period of five years after matriculation or terminates studies, he or she shall refund the stipend equivalent to a credit in accordance with the procedures specified in Cabinet Regulation No. 219 of 29 May 2001, Procedures by which a Study Loan from the State Budget Funds is Granted, Repaid and Extinguished.

14. Not later than by 1 March of the current year the Minister for Education and Science shall approve with an order a list of thematic areas of education for the subsequent financial year for doctoral study programmes in which a student may apply for a stipend equivalent to a credit.

15. A minimum stipend shall be granted to the person referred to in Paragraph 3 of these Regulations during maternity leave on the basis of a sick-leave certificate that has been issued in accordance with the procedures specified by regulatory enactments regulating the certification of work disability.

16. the stipend referred to in Paragraph 15 of these Regulations shall be disbursed together for two months of maternity leave.

17. An institution of higher education shall transfer the amount provided for a stipend to a settlement account or to an accounting card account of the recipient of the stipend.

18. The stipend commission of an institution of higher education shall revoke a decision regarding the granting of a stipend during a semester if such commission determines that a person:

18.1. has provided false information;

18.2. fails to fulfil academic commitments provided for in a study plan;

18.3. violates internal procedural regulations of the educational institution; or

18.4. has become an employee or self-employed person, except the students referred to in Paragraph 3.1 of these Regulations.

19. The disbursement of a stipend shall be discontinued in an institution of higher education during a break in studies. Disbursement of the stipend may be renewed after the break in studies if a person continues the studies successfully.

III. Procedures by which Students of Vocational Basic Education and Vocational Secondary Education Programmes Receive a Stipend

20. A student who acquires a vocational basic education or vocational secondary education programme in full-time studies at a vocational education institution shall receive a monthly stipend from a stipend fund.

21. The stipend fund of a vocational basic education and vocational secondary education institution (hereinafter - vocational education institution) shall be composed providing for 8.5 lats a month for each student.

22. The minimum monthly stipend for a student shall be determined in the amount of six lats.

23. An increased stipend shall be granted to a student of a vocational education institution if the person:

23.1. is an orphan or a child left without parental care who has not been placed into child care and instructional institution, foster family or a guardian's family; or

23.2. he or she is a successful student of legal age who has been left without parental care, or an orphan.

24. A vocational education institution may grant the following stipends from a vocational education fund:

24.1. a one-time stipend, if a student submits a relevant submission regarding the necessary additional expenses for which the State social insurance system does not provide compensation. Not more than five per cent of the amount of the stipend fund shall be provided for one-time stipends; and

24.2. an increased stipend for good and excellent school results and activity in social life of the educational institution.

25. The amount of a one-time and increased stipend shall not exceed the quintuple amount of the minimum monthly stipend.

26. A vocational education institution shall transfer the amount intended for the stipend to a settlement account or accounting card account of the recipient of the stipend:

26.1. at the beginning of the academic year and once a month henceforth;

26.2. once a month during a traineeship; and

26.3. a day before the beginning of the summer recess.

27. A vocational education institution shall approve the by-law for the granting of a stipend and establish a commission for the granting of stipends. Representatives of the administration, teaching staff and the full-time student local government of the vocational education institution shall be included in the composition of the commission.

28. If two or more students who have applied for a one-time stipend have equivalent school performance, a stipend commission shall first grant a stipend to:

28.1. a disabled child, orphan or a child left without parental care, as well as a student from a family in need; and

28.2. a student from a family in which three or more children are being raised.

29. The minimum monthly stipend shall be granted to a student of a vocational education institution during maternity leave on the basis of a sick-leave certificate that has been issued in accordance with the procedures specified by regulatory enactments regulating the certification of work disability.

30. If a student of a vocational education institution is on academic leave due to his or her state of health, he or she shall not be granted a stipend.

IV. Closing Provisions

31. Cabinet Regulation No. 182 of 7 May 2002, Regulations regarding Stipends (Latvijas Vēstnesis, 2002, No. 88), is repealed.

32. Sub-paragraph 6.4, Paragraphs 15 and 16 of these Regulations shall come into force on 1 January 2005.

33. A stipend equivalent to a credit that has been granted until the day of the coming into force of these Regulations shall be disbursed in accordance with the contract entered into between an educational institution and an applicant regarding the granting of a stipend and in compliance with the requirements of Cabinet Regulation No. 219 of 29 May 2001, Procedures by which a Study Loan from the State Budget Funds is Granted, Repaid and Extinguished.

34. The financing for stipends shall be granted from the State Budget funds provided for the relevant year.
