Procedures by which Military Aviation Aircraft of the Republic of Latvia shall use Civil Aerodromes, and Procedures by which Civil Aircraft shall use Military Aerodromes of the Republic of Latvia

Section 29 of the law On Aviation

I. General Provisions

1. This Regulation prescribes the procedures by which military aviation aircraft of the Republic of Latvia shall use civil aerodromes, and the procedures by which civil aircraft shall use military aerodromes of the Republic of Latvia. This Regulation shall not prejudice the requirements for the use of aerodromes, including for entering into relevant contracts on the use of aerodromes, provided for in other laws and regulations.

2. Terms used in this Regulation:

2.1. alternative security measures - a set of measures allowing for derogation from the security measures laid down in the Regulation (EC) No 300/2008 of the European Parliament and of the Council of 11 March 2008 on common rules in the field of civil aviation security and repealing Regulation (EC) No 2320/2002;

2.2. military aviation aircraft personnel - natural persons on board of a military aviation aircraft during its flight, except for the military aviation aircraft crew;

2.3. baggage of the military aviation aircraft personnel - personal property of the military aviation aircraft personnel and the logistics supply necessary for the performance of service or work duties which are linked to a certain person during the flight of a military aviation aircraft;

2.4. military cargo - ammunition, armaments, special means and technological equipment transferred for transportation with a military aviation aircraft intended for the use for the purposes of foreign armed forces or the National Armed Forces, and also the State cargo transported with a military aviation aircraft;

2.5. accompanying persons - persons who are not on board of a military aviation aircraft during its flight, but may be present in the civil aerodrome to ensure organisation of a military aviation aircraft flight and servicing thereof.

3. Military aviation aircraft of the Republic of Latvia shall use civil aerodromes in accordance with the conditions for the operation of civil aerodromes. Civil aircraft shall use military aerodromes of the Republic of Latvia in accordance with the conditions for the operation of military aerodromes of the Republic of Latvia.

II. Use of Civil Aerodromes for the Purposes of Military Aviation Aircraft

4. The use of civil aerodromes for the purposes of military aviation aircraft shall be organised by the National Armed Forces (hereinafter - the flight organiser).

5. The flight organiser shall:

5.1. determine the officials responsible for organising the servicing of military aviation aircraft and their personnel in a civil aerodrome;

5.2. ensure that the responsible officials referred to in Sub-paragraph 5.1 of this Regulation are trained in accordance with the requirements of Point 11.2.2 of the Annex to Commission Implementing Regulation (EU) 2015/1998 of 5 November 2015 laying down detailed measures for the implementation of the common basic standards on aviation security and have received permanent pass for the respective civil aerodrome;

5.3. enter into a cooperation agreement on the servicing of military aviation aircraft with the administration of the civil aerodrome which is being used or is planned to be used by military aviation aircraft, and shall inform the Civil Aviation Agency thereof.

6. If the civil aerodrome from which the cargo is transported by air is planned to be used for the purposes of military aviation aircraft, then the use for the purposes of military aviation aircraft shall be planned outside the traffic flow of the civil aerodrome and peak periods of the aerodrome.

7. The flight organiser shall, not later than 48 hours before the military aviation aircraft flight, submit an application to the administration of the civil aerodrome (Annex) if:

7.1. the military aviation aircraft use the civil aerodrome for the following purposes:

7.1.1. for planned military aviation aircraft flights;

7.1.2. for military aviation aircraft training flights;

7.1.3. for the transport of military cargo and military aviation aircraft personnel;

7.2. the military aviation aircraft personnel, baggage thereof, military cargo and accompanying persons are subject to the following alternative security measures:

7.2.1. the exemption from access control;

7.2.2. the exemption from security check;

7.2.3. application of special security checks.

8. If emergency action is necessary, the time period for submitting the application referred to in Paragraph 7 of this Regulation may be reduced to the period for which the flight organiser has agreed with the administration of the relevant civil aerodrome.

9. The ground handling of a military aviation aircraft (baggage servicing, servicing on apron, physical servicing of the incoming, outgoing and transit freight and mail in the stage between the airport terminal and the aircraft, control of the loading of the baggage on board of the aircraft, exchange of information and provision of communication) in a civil aerodrome which is subject to the laws and regulations governing the procedures for granting access to the airport ground handling market shall be ensured by a merchant who is entitled to provide the aforementioned ground handling services in the respective civil aerodrome.

10. The ground handling of a military aviation aircraft which is not referred to in Paragraph 9 of this Regulation or the ground handling of a military aviation aircraft in a civil aerodrome which is not subject to the laws and regulations laying down the procedures for granting access to the ground handling market provided by the airport shall be ensured by the flight organiser or a merchant who is entitled to provide the respective ground handling services in the respective civil aerodrome.

11. If there is a wish to receive a ground handling service of a military aviation aircraft from a merchant other than an operator of the civil aerodrome, the flight organiser shall additionally submit the application referred to in Paragraph 7 of this Regulation to the respective merchant.

12. Servicing of military cargo shall be ensured by the flight organiser or an official cargo agent in the aviation security programme of which a section on servicing military cargo is included, and it is approved by the Civil Aviation Agency.

13. If on board a military aviation aircraft are dangerous substances or goods referred to in Annex 18 to the Convention on International Civil Aviation of 7 December 1994 and in the document Technical Instruction for the Safe Transport of Dangerous Goods by Air (Doc 9284) of the International Civil Aviation Organisation, its ground handling services shall be ensured in accordance with the laws and regulations governing the procedures by which the transport of dangerous goods and freight by air shall be performed.

14. Military aviation aircraft shall be allowed to be placed in the demarcated area of a civil aerodrome for the provision of ground handling services.

15. The alternative security measures referred to in Sub-paragraph 7.2 of this Regulation shall be applied to the military aviation aircraft personnel, baggage thereof and military cargo which is outbound from a civil aerodrome of the Republic of Latvia, and also to accompanying persons.

16. The alternative security measures referred to in Sub-paragraphs 7.2.2 and 7.2.3 of this Regulation shall be applied to civil aerodromes from which transport by air is performed.

17. The flight organiser shall determine the alternative security measures that shall be applied to military aviation aircraft personnel, baggage thereof, military cargo and accompanying persons.

18. The administration of the civil aerodrome in cooperation with the flight organiser shall ensure that the military aviation aircraft personnel, baggage thereof and accompanying persons are transported to the military aircraft in isolation from the passengers and crew of civil aircraft and the civil aerodrome personnel not involved in the servicing of the military aviation aircraft.

19. The flight organiser shall ensure that the military aviation aircraft personnel and accompanying persons exempted from security check are informed regarding the safety procedures of the civil aerodrome and guarantee the compliance with them, thus preventing the endangerment of the civil aviation security.

20. The flight organiser shall ensure that third persons have not accessed the baggage of the military aviation aircraft personnel and military cargo from the moment of its completion until it is loaded on board a military aviation aircraft.

21. The special security check of a civil aerodrome shall be:

21.1. the preferential security check of a civil aerodrome - screening of baggage and outerwear with the x-ray screening equipment;

21.2. reinforced security check of a civil aerodrome - the flight organiser determines the additional security measures which shall be implemented.

III. Use of Military Aerodromes for the Purposes of Civil Aircraft

22. Civil aircraft may use military aerodromes of the Republic of Latvia if they correspond to the operational conditions of civil aerodromes and laws and regulations laying down the operation of civil aviation. Civil aircraft may use military aerodromes of the Republic of Latvia for transport by air if the military aerodromes of the Republic of Latvia or the parts and facilities thereof used for servicing such transportation comply with the conditions for the operation of civil aircraft in accordance with the requirements provided for in Sub-section B of the Annex IV to Commission Regulation (EC) No 965/2012 of 5 October 2012 laying down technical requirements and administrative procedures related to air operations pursuant to Regulation (EC) No 216/2008 of the European Parliament and of the Council.

23. After coordination with the State agency Civil Aviation Agency, the Ministry of Defence shall submit the information necessary for civil aircraft to use military aerodromes of the Republic of Latvia to the public corporation for the use of the airspace of the Republic of Latvia and organisation of air traffic for publication in the document Aeronautical Information Publication.

24. Aircraft threatened by danger, being in danger, or suffering an accident my use any aerodrome in the territory of the Republic of Latvia.

25. If the sports association is active in civil aviation sports, and organises educational and recreational activities for young people or cooperates with the Cadet Force and Information Centre, it may use military aerodromes of the Republic of Latvia free of charge for the events of civil aviation sports and aviation propaganda in accordance with the contract entered into with the Ministry of Defence and the laws and regulations governing the civil aviation sports by covering only the costs of those services which are provided by the services of military aerodromes of the Republic of Latvia. The sports association shall be considered as active in the field of aviation if it corresponds to at least one of the following criteria:

25.1. within a calendar year the sports association ensures not less than 500 parachute jumps;

25.2. within a calendar year the sports association performs at least 30 hours of flying;

25.3. within a calendar year the sports association has represented the State in at least one international civil aviation sporting event.

26. Before entering into the contract referred to in Paragraph 25 of this Regulation:

26.1. the sports association shall submit a written application to the Ministry of Defence. The military aerodrome of the Republic of Latvia which the sports association wishes to use and the time period for the use thereof shall be indicated in the application. Copies of the following documents shall be appended to the application (by presenting the original):

26.1.1. the articles of association;

26.1.2. the registration certificate;

26.1.3. the list of those members of the sports association who will perform activities in the military aerodrome of the Republic of Latvia. This list shall include the given name, surname and personal identity number of the member;

26.1.4. the documents attesting to at least one of the criteria referred to in Paragraph 25 of this Regulation;

26.2. after receipt of the application referred to in Sub-paragraph 26.1 of this Regulation the Ministry of Defence shall request an opinion of the State security institutions on the sports association and shall prepare the contract on the use of the military aerodrome of the Republic of Latvia. Obligations, rights and liability of the sports association regarding the use of a military aerodrome of the Republic of Latvia shall be laid down in the contract.

IV. Closing Provisions

27. Cabinet Regulation No. 587 of 18 July 2006, Regulations Regarding the Procedures by which Military Aviation Aircraft of the Republic of Latvia shall use Civil Aerodromes, and Procedures by which Civil Aircraft shall use Military Aerodromes of the Republic of Latvia (Latvijas Vēstnesis, 2006, No. 114; 2007, No. 33; 2009, No. 204; 2016, No. 21), is repealed.

28. This Regulation shall come into force on 1 January 2018.

Application for the Receipt of the Ground Handling Services of a Military Aviation Aircraft and Application of Alternative Security Measures at a Civil Aerodrome
