Procedures for the Conformity Assessment of Flavourings Used in Food with the Classification and Quality Requirements

Section 4, Paragraph four
of the Law On the Supervision of the Handling of Food

1. This Regulation prescribes the procedures for the conformity assessment of flavourings used in food and food ingredients with flavouring properties with the classification and quality requirements.

2. When using flavourings in food products and food ingredients with flavouring properties, the following classification and quality requirements for the use of flavourings shall be observed, which have been specified in:

2.1. Regulation (EC) No 1334/2008 of the European Parliament and of the Council of 16 December 2008 on flavourings and certain food ingredients with flavouring properties for use in and on foods and amending Council Regulation (EEC) No 1601/91, Regulations (EC) No 2232/96 and (EC) No 110/2008 and Directive 2000/13/EC (hereinafter - Regulation No 1334/2008);

2.2. Regulation (EC) No 2065/2003 of the European Parliament and of the Council of 10 November 2003 on smoke flavourings used or intended for use in or on foods (hereinafter - Regulation No 2065/2003).

3. A merchant, which commences production and use of new food flavourings and food ingredients with flavouring properties, shall observe the requirements specified in Regulation (EC) No 1331/2008 of the European Parliament and of the Council of 16 December 2008 establishing a common authorisation procedure for food additives, enzymes and food flavourings (hereinafter - Regulation No 1331/2008) and Regulation No 2065/2003.

4. The Food and Veterinary Service shall carry out:

4.1. the functions of the competent authority in accordance with Article 7(2) of Regulation No 2065/2003 and Article 3 of Regulation No 1331/2008;

4.2. supervision and control functions in relation to the application of the requirements of Regulation No 1334/2008 and Regulation No 2065/2003 for the use of flavourings in food.

5. Cabinet Regulation No. 131 of 14 April 1998, Regulations regarding Use of Flavourings in Food, (Latvijas Vēstnesis, 1998, No. 102/105; 2000, No. 331/333; 2006, No. 118) is repealed.

6. This Regulation shall apply as of 20 January 2011.
