Procedures by which a Social Service Provider is Registered in a Register of Social Service Providers and Removed TherefromIssued pursuant to Section 17, Paragraph
two 1. These Regulations prescribe the procedures by which a social service (hereinafter - services) provider shall be registered in a register of social service providers (hereinafter -Register) and removed therefrom. 2. The Ministry of Welfare (hereinafter - Ministry) shall be the manager of the Register. [19 January 2010] 3. Private individuals, State and local government authorities and the institutions, branches and territorial units thereof, which provide the social services specified in the Social Services and Social Assistance Law, shall be registered in the Register. 4. When registering a service provider, the Ministry shall issue a registration certificate (Annex 1). The registration certificate shall be issued for an unspecified period of time. [19 January 2010] 5. If a service provider provides different types of services, the service provider shall be issued an individual registration certificate for each service. 6. If there are several actual addresses of service provision (the territorial units or branches of the service provider are located in different places), an individual registration certificate shall be issued to the service provider according to each place of service provision and shall be registered as an individual service provider. 7. Information regarding the service provider and the service provided included in the Register shall be freely accessible. If additional information is required, the Ministry, upon the receipt of a written request, shall provide it free of charge to State and local government institutions, but for a fee - to private individuals. [19 January 2010] 8. In order to register a service provider, the head of the service provider or an authorised person thereof, prior to the commencement of the service provision, but not later than within three months after commencement of service provision, shall submit the following to the Ministry: 8.1. an application (Annex 2); and 8.2. a copy of the articles of association (by-law) of the service provider (presenting the original), except direct State administrative institutions. If documents are submitted electronically, the original of the articles of association (bylaw) of the service provider need not be presented. [19 January 2010] 9. If a service provider provides different types of service, the Ministry shall evaluate each service individually. [19 January 2010] 10. Within one month after submission of the documents referred to in Paragraph 8 or the information indicated in Paragraph 15 of these Regulations, the Ministry shall take a decision regarding the registration of a service provider or regarding the refusal to register the service provider, if the requirements referred to in these Regulations have not been observed. [19 January 2010] 11. When taking a decision regarding the registration of a service provider, the Ministry shall assign one or several registration codes to the service provider, inform the service provider thereof, issue one or several registration certificates, as well as make an entry in the Register. [19 January 2010] 12. The following shall be written in the Register: 12.1. information regarding the service provider and the service provided: 12.1.1. the registration number and date; 12.1.2. the name of the service provider; 12.1.3. the legal address and actual address; 12.1.4. the legal status of the service provider; 12.1.5. the telephone and fax number, e-mail address, Internet home page address (if any); 12.1.6. the unified registration number of the service provider, but if the service provider is a territorial unit or branch - the unified registration number of the private individual or State authority, local government or institution which has established the territorial unit or branch; 12.1.7. the method of provision of the social service; 12.1.8. the service to be provided or the services to be provided; 12.1.9. clients according to age and gender; 12.1.10. the group of clients to whom services are provided; 12.1.11. general information regarding the service provider; 12.1.12. the given name, surname and position of the service provider; and 12.1.13. if the service provider is a territorial unit or branch - the given name, surname and position of the private individual or the head of the State authority, local government or institution which has established it; 12.2. the registration codes assigned to the service provider. Each registration code shall be created in accordance with the following requirements: 12.2.1. the first part of the code shall be the code (seven characters) assigned to the administrative territory and the territorial unit according to the Classification of Administrative Territories and Territorial Units of the Republic of Latvia (ATVK); 12.2.2. the second part shall be in accordance with the code assigned by the Statistical Classification of Products by Activity (CPA); 12.2.3. the third part shall be the code of the service provider (six characters) in accordance with Annex 3 to these Regulations; 12.3. [19 January 2010]; 12.4. [19 January 2010]; and 12.5. a note regarding removal from the Register, the date of removal and the reasons for removal. 13. A service provider shall receive a registration certificate after it has submitted a payment document which confirms the payment of a State fee for the issuance of the registration certificate. 14. The Ministry shall take a decision regarding the suspension of registration if: 14.1. not all the documents referred to in Paragraph 8 of these Regulations have been received; 14.2. the documents submitted have not been filled in completely or it is not indicated in the articles of association (bylaw) submitted that the applicant provides the services referred to in the application; or 14.3. the Ministry has justified doubts regarding the genuineness of the information provided. [19 January 2010] 15. The Ministry shall take a decision regarding the suspension of registration within 14 working days from the day of the receipt of the documents referred to in Paragraph 8 of these Regulations and shall inform a service provider thereof in writing . The head of the service provider or an authorised person thereof shall, within 14 working days after receipt of the decision, submit the documents or information indicated in the decision regarding the suspension of registration or a justified request to extend the deadline for the submission of documents. [19 January 2010] 16. The Ministry shall take a decision regarding the refusal to register a service provider, if: 16.1. the service does not conform with the types of services referred to in the Social Services and Social Assistance Law; 16.2. the documents and information indicated in the referred to decision or a justified request to extend the deadline for the submission of documents have not been submitted within 14 working days after receipt of the decision referred to in Paragraph 15 of these Regulations regarding the suspension of registration; 16.3. false information has been provided; or 16.4. the service provider does not conform with the requirements which are specified in the regulatory enactments regarding social service providers. [19 January 2010] 17. The head of a registered service provider or an authorised person thereof, but in cases where the service provider is a territorial unit or branch - the private individuals, the head of a State authority, local government or institution which has established it, has a duty to inform the Ministry regarding the cessation or termination of activities, or changes in the organisation or provision of services within 10 working days by submitting documents attesting the changes. [19 January 2010] 18. The Ministry shall evaluate the documents referred to in Paragraph 17 of these Regulations and make changes to the Register or shall, within 14 working days, take a decision regarding the registration of changes and the issuance of a new registration certificate or the removal of the service provider from the Register. [19 January 2010] 19. If the legal address, telephone or fax number, e-mail address, Internet home page address (if any) of the service provider or the head of the service provider has changed, the Ministry shall make the appropriate changes in the Register, without changing the registration certificate of the service provider. [19 January 2010] 20. If the Ministry receives other information regarding a registered service provider, it shall, within five working days, but not less than once a month, update the information in the Register. 21. If a registration certificate is lost or damaged, the Ministry shall issue a duplicate of the registration certificate (if the registration certificate has been issued in the form of electronic document, - the original) on the basis of the application of the service provider. The Ministry shall prepare a duplicate within two weeks after receipt of an application. A duplicate certificate shall be issued to a service provider (if the registration certificate has been issued in the form of electronic document - the original) after the submission of a payment document which confirms the payment of the State fee for the issuance of a registration certificate. Upon the receipt of the duplicate registration certificate, the service provider shall hand over the damaged certificate to the Ministry. 22. The Ministry shall take a decision regarding the removal of a service provider or the provided service from the Register, if: 22.1. a written application of the service provider regarding removal from the Register has been received; 22.2. the service provider has terminated activities; 22.3. the service provider does not conform with the requirements which are specified in the regulatory enactments regarding social service providers, has been administratively punished for non-conformity with the specified requirements and has not eliminated the non-conformities established within the deadline specified by the Ministry; 22.4. an adjudication of court has come into effect regarding the suspension, or termination of the economic activities or the insolvency of the service provider; or 22.5. the Ministry establishes that the service provider has discontinued the provision of services. [19 January 2010] 23. If a service provider or a service provided thereby is removed from the Register, the head of the service provider or an authorised person thereof, but in cases where the service provider is a territorial unit or a branch - the private individuals or head of the State authority, local government or institution which has established it, has a duty to hand over the previously issued certificate to the Ministry. [19 January 2010] 24. The Ministry shall post a list of the registered service providers, as well as a list of the service providers removed from the Register on the Internet home page thereof. The list shall contain the following: 24.1. for registered service providers: 24.1.1. the name, registration date and registration number of the service provider; 24.1.2. the legal status of the service provider; 24.1.3. the method of service provision; 24.1.4. the service to be provided; 24.1.5. clients (by age and gender) to whom services are provided; 24.1.6. the group of clients to whom services are provided; 24.1.7. the legal address and actual address of the service provider if it differs from the legal address; and 24.1.8. the telephone and fax number, e-mail address, Internet home page address (if any) of the service provider. 24.2. for service providers or individual services removed from the Register: 24.2.1. the name and registration number of the service provider; 24.2.2. the legal status of the service provider; and 24.2.3. the date of removal of the service provider or the service provided and the reasons for removal. [15 January 2008] 25. A service provider which has commenced the provision of services prior to the coming into force of these Regulations and is not registered in the Register, shall submit an application for registration within 12 months after coming into force of these Regulations. 26. Registration certificates issued up to the date of coming into force of these Regulations shall be valid up to the end of the term of validity thereof. If a service provider has decided to continue the provision of services after the end of the term of validity of the registration certificate, the head of the service provider or the authorised person thereof shall submit the application referred to in Sub-paragraph 8.1 of these Regulations to the Ministry with a request to re-register the service provider and issue a registration certificate, as well as hand over the previously issued registration certificate. 27.
